• The mandate for POP:• Section 205 (3) of the Constitution (Act

200 of1993)• Section 17(1) & (2) of SAPS Act, 1995

(Act 68 of 1995)• The National Commissioner, subject to

Section 218(1)(F) of the Constitution, must establish and maintain a National Public Order Policing capacity to maintain public order.

The right to demonstrate (non violent and non destructively) is a fundamental right of democratic citizenship and the central responsibility of the police to facilitate the right to demonstrate.SAPS have an obligation to maintain public order.
