TO: MSAE Members FROM: Shelby DeMars, MSAE Executive Director DATE: 07-19-19 SUBJECT: Commissioner of Political Practices, SAVA Agenda Item Summary MSAE Members, Below is a brief summary of the agency bill concepts that were presented by Commissioner of Political Practices, Jeff Mangan, at the State Administration & Veterans Affairs (“SAVA”) Interim Committee on Wednesday, July 18th, 2018. Please note that these are ideas for potential bills and are not yet available in bill draft form, but are ideas that the agencies hope to put forward. There was much discussion among the SAVA committee members about whether some of these proposals were under their jurisdiction or were under the purview of another committee. The SAVA committee will meet again on (most likely) September 6th. This is generally the meeting where they conduct final action on their committee bills. However, if they have a bill that is requested in September, they could review and take action on it in November. The following is a list of bill ideas presented by Commissioner Jeff Mangan of the Montana Office of Political Practices: 1. Revise Time for Filing Reports: This would require that everyone use electronic filing and attempts to simplify the reporting calendar for both political committees and candidates. The proposal from the Commissioners office would simplify the reporting calendars to report 4 times before each election and there would be two separate calendars—one for political committees and one for candidates. Each calendar would still require that any committee, candidate or otherwise, to file Form C7 or C7 (e) which are the reports for contributions and expenditures made immediately prior to an election. 2. Revised Ethics Laws: This topic area covers several separate proposals from the Commissioners office:

o TheCommissionersofficeisproposingastatutorychangethatseekstoupdatethestatutessothattheyareconsistentwitharecentlydecidedcourtcaseontheconfidentialityofethicscomplaints.ThedraftlanguagesubmittedtothecommitteedelineatesthatwhenacomplaintismadetotheCommissionersoffice,thatitwillremainconfidentialuntiladecisionismadebytheCommissioner,unlessitiswaivedbythesubjectofthecomplaint,therecordsarealreadypublic,oriftherecordsaremadepublicinthecourseofahearing.Pleaseseetheattacheddocumentformoredetailsonthisproposal.

o MCA2-2-121liststhatacandidatecannotuseorpermittheuseofstatefundsforanycampaignpurposes.Thestatuteprovidesalistofresourcesthatcandidatesarenotallowedtouse.TheCommissionersproposedchangewouldadd‘internet’tothatlistofstateresourcesthatacandidatecannotuseforanythingrelatedtotheirelection.

3. IndependentExpenditures:Thisproposalseekstoclarifywhatactionsqualifyas

‘electioneeringcommunications’.Thesechangeswouldalsobeaimedatensuringthattheincidentalcommitteefilingformsareclearandeasytounderstandfornon-politicalentitiesthatmayberequiredtoreportelectioneeringactivity.

4. AddaReportingRequirementfor‘DateContributionReceived’:Thisproposalwould

requirethatthedateacontributionwasreceivedbereportedonthefilingswiththeCommissionerofPoliticalPracticesOffice.

5. RepealNamingStatute:Thisproposalwouldrepealthestatutethatdescribesthe

criteriaapoliticalcommitteemustuseintoselectacommitteename.ThecurrentcommitteenamingrequirementsareinMCA13-37-210.

6. DeputizeinHouseCouncil:ThisisverysimilartoSB23fromthe2017

Session.CurrentlytheCommissionerhastogofindoutsidecounselauthorizeasadeputyCommissionerifheisconflicted.Thiswouldallowthemtodeputizestaffthatisalreadyin-houseattheCommissionersofficeincertaincircumstances.

7. UpdateVoteDisclosure:Thiswouldremovelanguagedeemedunconstitutionalthat

requiresprintedelectionmaterialthatincludesinformationaboutacandidatesvotingrecordtoincludeareferencetotheparticularvotetakenandallrelatedvotesonthesamebillorenactment.TheMCAlistedintheattacheddocumentsdistributedbytheCommissioneris13-37-225(3)—ThisisatypoandshouldactuallybeMCA13-35-225.

8. FairNotice:ThissuggestionwouldincludeballotissuecommitteesintheexistingFair

Noticestatutes(MCA13-35-402)

9. RepealPettyCash:Currentlypettycashcanbeusedonacandidatecampaignorbyapoliticalcommittee,butitisdifficulttoreportandisrarelyused.(MCA13-37-335)

10. LobbyistStatutes:DependingonwhatisdecidedbytheLegislativeCouncil,theCommissionersofficeisconsideringpotentiallyputtinginplacearequirementthat,inordertobecomearegisteredlobbyist,youmustcompleteanethics/sexualharassmenttrainingconsistentwiththeprioritiessetforthbytheLegislativeCouncil.TherewasalsosomediscussionaboutpassingaCodeofConductforregisteredlobbyists(ThiswouldpotentiallybeplacedunderMCA5-7-103)

11. ClarifyLocalCandidateReporting:Thisproposalwouldseektoprovideclaritytolocal

candidatesonwhetherornottheircandidatefilingfeethatispaidtotheSecretaryofStatesofficecountstowardstheir$500expenditurethresholdthattriggersreporting.
