EPA notesthatDaikin Americahasidentifiedtheneedfor anadditionalchangetothe textofCopy #2of theRCA mailedto tile signatorycompanieson August16, 2004. hiaddition,EPA’sreviewof thematerialsreturnedfrom supplementalmailings(September9. 2004andOctober6, 2004) identifiedthatsomeor all of thereplacementpageswerenotreturnedand/orinitialed from someof thecompanies,andthattheheaderon theofficial versionfor twoo~thecompaniesincorrectlyassertedthat thepagecontainedconfidentialbusinessmformatjc.n(CBI) whenthesecompanieshadno CBI to claim. Thepurposeofthismailing is to maketheneededcorrectionsspecificto eachcompany,and to explaintheimpactof thesechangeson theRCA signatureprocess.
As notedin previouscorrespondence,whereverthereis a changeto thetextoftile RCA,all signatoriesarerequiredto acknowledgeconcurrencefor thechange.Daikin America,Inc.identifiedan additionalchangeto achemicalnamelisted on page4 ofRCA Copy #2. Sincethis

determinedthat it will beeasierto preparearevisedreplacementpagelincorporatirigall threechangesto thispagefor eachcompanyto tmhalanddatç Tl~cprocedut~ensuresthateachcompanywill be signingadocumentthatis consistentacrossall thecompanIesandthateachcompanyis in agreementwith thechanges.In addition,EPA’sreviewof signaturematerialsreturnedto EPA revealedthat Daikin Americadid not return thereplacementpages#4, #14, #19,#20, #23, #A.3.1, and #A.4.2 that wereincludedwith the letterfrom WardPenberthydatedOctober6, 2004. document.EPA asksthatyou indicateyourconcurrenceforthechangesto theabovementionedpagesofECA Copy#2 by initialing and datingtherevisedreplacementpagesenclosedwith thi~letterandreturningthemto EPAfollowing thereturnmailing suggestionsasdescribedin EPA’sletterofAugust16,2004. I suggestthatyou incorporatetheduplicaterevisedreplacementpagesintoTab3 ofyourcompanyECA binderprovidedwith theAugust 16,2004mailing.
EPAsoriginal intentwasto developmultiple copiesoftheRCA specificto each -
company.This originalplanassumed-thatall correctionsto thedocumenthadbeenidentifiedduringthePublicCommentperiod. Unfortunatelythiswasnot thecase.As notedabove,additionalneededchangeswereidentifiedafterthePublicCommentperiodended.As aresult,theofficial RCAdocumentwill nowbe comprisedofthefollowing:
