    To the Commonwealth Ombudsman, Privacy Commissioner and DEEWR

    On Tuesday the 18 th of January I had an appointment with my Job Network Provider: LETS LocalEmployment and Training Solutions. We discussed a transport problem for TAFE studies now DEEWRwould not support the Menindee community Bus service use for TAFE Educational Studies in Broken Hill.Towards the end of interview I was quickly passed a page titled CentaCare Local Employment andTraining Solutions and asked to write the words: Release and Obtain. Then I was told to tick all boxesexcept the last 2, and sign the document.I was then handed the regular Employment Pathway Plan to sign as the man outside again stuck hishead around the door in wanting his appointment in a hurry.

    At the end of the interview and with some confusion I started to question what the release letter wasabout, I asked and was told there were new rules for client privacy restricting information that LETScould access and it would allow LETS to ask of me if I were sick in hospital for example. I received acopy of their Employment Pathway Plan and was not offered a copy of the Release and Obtaindocument. I left feeling I might have been duked out of my privacy rights and confused about thedocument contents, as the man outside was back standing at the door for his interview.

    After returning home I read the Employment Pathway PlanPrivacy (last page)- Quote: Youll be pleased to know that your privacy is protected by law. Yourpersonal information can only be disclosed where Commonwealth law allows it, or in specialcircumstances, or when you give permission!

    On Thursday 20 th of January I caught the bus to Broken Hill to obtain and read a copy of the Releaseand Obtain document from LETS employment. The organisations and individuals listed in thedocument were extensive and descriptions of individual organisation types very in-concise and broad.

    I explained to LETS that I did not agree with this document or the practice to obtain, I explained clients

    treat Job Network Providers very seriously and do what they are told to do when asked withoutquestion. Quoted from appointment letter: Please treat all communications from your Provider veryseriously, because it is the same as being notified of your requirements by Centre link END QUOTE.

    I acknowledge and understand LETS interviews on this day may have been a little chaotic withprevious appointments canceled due to rain, and that it was the first interviews since the Christmasbreak which are not the issue. The issue is behavior of CentaCare with regards to the documentscontent and the method of acquisition or enforcement.

    If rights of privacy were not in question the document would not be in existence, the document isunethical in content and method of acquisition or enforcement, as such to not be given option, thisdocument serves to remove privacy right and give CentaCare very broad indemnity against client rightsto prove or prosecute any infringement. I would not agree to such a document were I asked if acceptable & given the option to question or refuse, further to this the document drawn may be illegal.

    I now invoke my rights to refuse this CentaCare Release and Obtain document & do not Consent tothe Release & Exchange of information with the organisations & individuals listed through its use.
