    Vohor stated yesterday that

    the Oppositions initiative to

    lodge a constitutional peti-

    tion has prompted his gov-

    ernment to look at doing the

    same but this time to ask the

    court whether the ormer

    prime minister was elect-

    ed according to the require-

    ments o the constitution.

    Vohor said when ormer

    Speaker o Parliament,

    George Wells, prevent-

    ed the media rom making

    a live coverage or cover-

    ing the election o ormer

    prime minister Sato Kilman,

    many people did not know

    that the election was not

    done through secret ballot

    as required by the constitu-

    tion.

    He said while the pub-

    lic did not witness this, the

    MPs in parliament witnessed

    what happened.

    He said the ormer prime

    minister was declared unop-posed by the Speaker and

    declared as prime minister

    without ullling the require-

    ments under Article 41 o

    the constitution which states

    that the election o a prime

    minister shall be made by

    secret ballot.

    PM Vohor said he does

    not have anything against

    ormer prime minister, Sato

    Kilman, but because o the

    issue o legal challenges to

    interpret the constitution, he

    believes this is one area that

    needs clarication.

    I am thinking o ind-

    ing a lawyer to le a case in

    court to interpret the powers

    o a prime minister who was

    elected through the proc-

    ess o voting and that o a

    declared prime minister who

    never went through the vot-

    ing process.

    This does not need a

    commission o inquiry into

    it because all o us leaders

    o this country were in par-

    liament at that time and we

    witnessed it, Vohor said.

    Meanwhile, the prime

    minister announced that his

    government will be appoint-

    ing independent Commis-

    sions o Inquiry (COI) thatwi ll look in to ou ts ta nd-

    ing issues that include that

    o NISCOL, threats to press

    reedom, and the copra sub-

    sidy.

    The Appellants legal

    counsel Thursday aternoon

    agreed that the rst Consti-

    tutional application was not

    val id ater the lodging o

    the amended constitutional

    application led on Wednes-

    day April 27, and asked that

    the court intervene and inter-

    pret the question o absolute

    majority.Chie Justice Vincent Lun-

    abek refected that there two

    dierent scenarios here- un-

    damental rights and breach

    o constitutional rights.

    In consideration o the

    Prime Ministers undamen-

    tal rights and provisions

    in the constitution Oppo-

    sition leader MP Kilman is

    maintaining inringement o

    seven sections in the Con-stitution, these are section

    39(1), 49 (1), 43(2 and 3)

    and 5(1) d which in response

    the respondents legal coun-

    sel said that in light o the

    urgency o the case time

    is needed to get detailed

    extractions rom the Speak-

    er o Parliament.

    In deliberating the proc-

    ess and relevance o the 12

    Opposition MPs who arethe second applicants, the

    inringement o constitution-

    al rights and that they were

    appointed by the Prime Min-

    ister, they were removed

    as second applicants in the

    case.

    to celebrate this year 2011 as

    the International Day o Forests.

    The launching will be ociated

    today at the Le Lagoon Resort in

    Port Vila.

    The launching will kick start

    activities that Vanuatu will beimplementing to raise aware-

    ness about the three main goals

    that have been identied to be

    promoted; importance o the or-

    est, ways to protect and develop

    orests and their resources, the

    importance o reorestation, and

    the proper ways to plant trees.

    The importance of forests

    Forest which covers a third

    o our planets land ullls many

    roles such as providing renew-

    able raw materials and ener-gy, maintaining biodiversity,

    and protecting land and water

    resources. To mention a ew

    major ones, orest is the source

    o ood, clean water, clean air,

    shelter, shade, irewood, etc

    According to acts, the live-

    lihoods o 1.6 billion people

    depend on orests, over 40% o

    the worlds oxygen is produced

    by rainorests, orests are home

    to 80% o the worlds terrestri-

    al biodiversity, more than a quar-ter o modern medicines, worth

    an estimated US$ 108 billion a

    year, originate rom tropical or-

    est plants.

    Protect and develop the forestDue to their importance,

    orests have to be protected

    to ensure the sustainability o

    its benets. To mark the Inter-

    national Year o Forest people

    are encouraged to take care

    o the orests by minimizing

    orest clearance. Avoid mak-ing gardening on hilly plac-

    es, because cutting down trees

    in such areas can lead to land-

    slides. Trees along riverbanks

    and river mouth should not be

    cut down.

    ReforestationReorestation is the restock-

    ing o existing orests and

    replanting o tree that have

    been depleted, an eect o

    deorestation. Reorestation

    can be used to improve thequality o human lie by soak-

    ing up pollution and dust rom

    the air, rebuild natural habitats

    and ecosystems, mitigate global

    warming since orests acilitate

    biosequestration o atmospheric

    carbon dioxide, and harvest or

    resources, particularly timber.

    2011 was declared as Inter-

    national Year o Forests by the

    Unites Nations General Assem-

    bly to raise awareness on

    sustainable management, con-servation and sustainable devel-

    opment o all types o orests.

    COIs will be proessionals and

    know what they are doing but

    not those who have conficts o

    interest or have outstanding inthe institution that will compro-

    mise their position.

    Act, which companies such as

    NISCOL are registered under.

    He said i this independent

    COI inds that there are areas

    that need needs the attention o

    the law then so be it as no one

    is above the law.

    In the area o press reedom,

    Vohor said being one o the

    leaders who initiated Compre-

    hensive Reorm Program (CRP)

    o which one o its principles is

    good governance, the people

    must be shown a good example

    o how a country is governed

    where people know that their

    rights are protected. He said it

    is true that media must always

    be balance in their reporting buthe is one o those that supports

    press reedom.

    He said reports that a media

    organisation is looking at bring-

    ing in an overseas prosecutor

    to deal with its case is a serious

    issue that does not refect well

    not only on the government but

    the law-enorcing arm o the

    government.

    He said i there are set-

    backs, especially in the judicial

    sector that prevent the law to

    take its ull course then he will

    make sure these obstacles are

    removed.

    have realised the importance

    o natural disaster preven-

    tion, preparedness and miti-

    gation.

    The community disaster

    action work was taken place

    during the second week oApril in the village o Neren-

    ingman and in Rah Island.

    The activities carried out

    were: the replant o trees on

    the coastal line, the digging

    o drainage in lood prone

    areas and the creation o rub-

    bish disposal.

    Chie Laurent Jean, chair-

    man o Motalava council o

    chies, said that Vanuatu Red

    Cross engagement with his

    people in Motalava is crucial

    as it helps educate the com-

    munity to not only ocus on

    development but also to con-

    sider disaster risk that the

    community is exposed to aspart o their own develop-

    ment. The community disas-

    ter action plan are integrated

    into the chies 10 years work

    plan and thus much ocus is

    now put in place to ensure

    ull completion o the action

    plan implementation.

    The three targeted com-

    munities in Motalava have

    inserted the action plan into

    the chie yearly plan. The

    days allocated to the chies

    are Monday and Friday.

    However, the chies have

    agreed that the action plan

    be implemented as soon as

    possible to increase the com-

    munity resilience. The com-

    munities o Motalava are

    overwhelmed with commu-

    nity commitments and it isor these reasons the chies

    have allocate a day to the

    community to work on their

    action plan.

    Al l Co mm un it y Di sa s-

    ter Committees Chairmen

    work closely with the chies

    to ensure that the chies are

    well inormed o the activi-

    ties. It then becomes the duty

    o the chies to make the

    announcement in the village

    to make people aware. The

    last announcement is done

    on Sunday during the church

    service by the church repre-

    sentatives.

    The people o Motalava

    are known or their willing-

    ness and enthusiasm when it

    comes to community activi-

    ty. The people highly respectand cherish the chies deci-

    sions which thereore become

    a bond o solidarity between

    the chies and their people.

    The community, with

    the strong support rom the

    chies, is very involved in

    the implementation o their

    action plan.

    The involvement o women

    during the implementation o

    the action plan varies accord-

    ing to the intensity o the

    workload. However, women

    express their participation in

    dierent ways such as pre-

    paring o oods or men who

    work or they wou ld bring

    water to men when they are

    thirsty, etc.

    The chies o the communi-

    ties in Motalava acknowledgeand praise the Vanuatu Red

    Cross or supplying to them

    the disaster tools which the

    community was able to use to

    implement the disaster action

    plan. The chies encourage

    the community to always pri-

    oritise and consider the dis-

    aster action plan o the three

    communities to ensure that it

    is being implemented or the

    benet o the community.

    This project, unded by

    the European Commissions

    Humanitarian Aid Depart-

    ment, has the objective o

    limiting the vulnerabili-

    ty o outlying, inaccessible

    and resourceless commu-

    nities.

    Lunabek has adjourned theVanuaaku Pati (VP) trial to

    May 16-23.

    Day three o the VP trial

    Thursday morning heard the

    deence counsel in the VP case

    indicating that there is a likeli-

    hood that it will be cross exam-

    ining only 10 o the 12 existing

    witnesses p resented by the

    Claimants counsel.Deence lawyer Silas Hakwa

    told the Supreme Court that it

    is likely that there are two who

    will not be cross examined,

    they are: Finance Minister and

    Eate MP Bakoa Kaltongga and

    MP or Maewo constituency

    Philip Boedero.

    From the claimants counsel,

    Edward Nalyal will be ling inthree sworn statements by May

    5, 2011, specically:

    Reply to sworn statement

    o Isabelle Kalo which was led

    on April 27, 2011.

    Statement of Jessy Dick in

    relation to the drating o the

    VP Congress resolutions on

    Ira and;

    Statement of Christina Wilson in relation to the events

    surrounding the drating o the

    The Supreme Court heard

    onboard the HMNZS Canter-

    bury, a New Zealand Deence

    Force rigate which arrived

    in Luganville Wednesday this

    week with supplies and mili-

    tary equipment including hel-

    icopters to be used during the

    six-week program.

    The military vessels have

    arrived in Luganville or

    the program which include

    HMNZS Canterbury which

    was rst to arrive, USS Cleve-

    land, HMAS Balikpapan and

    HMAS Betano.

    On board the USS Cleve-

    land there is a total o 400crew members, 2 Mh-60S hel-

    icopters, 1 land crat, utility,

    57-ton trucks and our long

    wheel base jeeps and onboard

    the HMZS Canterbury there is

    a total o 100 crew, 1 SA0330

    Puma helicopter(French

    detachment), 2 landing crat

    and 12 medium trucks.

    For HMAS Balikpapan and

    HMAS Betano there are a

    total o 13 crews with deploy-

    able geospatial survey team.

    The United States o

    America prov ide the l argest

    number o medical personal

    with 130 person in the medi-

    cal team, New Zealand has a

    total o 28 and Australia has

    a total o 19 person medical

    contingent.

    The partnership programhave already started or the

    past two weeks with com-

    bination o Vanuatu Mobile

    Forces rom Port Vila and

    Luganville teaming up with

    Am er ic an an d Ne w Ze a-

    land personals to carry rep-

    aration and instalment o

    school acilities mainly class-

    rooms and toilets at Banban,

    Kamewa and schools in the

    rural areas.

    With all partner countries

    now have arrived in Santo,

    busy and many people.

    Paciic Partnership is an

    annual deployment o orcesrom the Paciic Fleet o the

    United States Navy (USN),

    in cooperation with region-

    al governments and military

    orces, along with humani-

    tarian and non government

    organisation.

    The deployment was con-

    ceived ollowing the 2004

    Indian Oceania earthquake

    and tsunmai, as a way to

    improve the interoperability

    o the regions military orces,

    governments, and humanitar-

    ian organisations during dis-

    aster relie operations, while

    providing humanitarian, med-

    ical, dental, and engineeringassistance to nations o the

    Paciic, and strengthening

    relationships and security ties

    between the nations.

    The deployment is typically

    based around an amphibious

    warare vessel or hospital ship

    o the USNs Pacic Fleet.

    Bule in custody: We have written

    to the Police or an update

    last week will continue its

    enquiry into late John Bule's

    death and the Coroners Report

    recommendations. The aim o

    the Commission is to enquire

    into the extent to which the

    police and law enorcement

    authorities have complied

    with the recommendations

    o the Coroner and to a ur-

    ther extent, whether the Pub-

    lic Prosecutor has prosecuted

    anyone as a result o the said

    stated that it is at the dis-

    cretion o the DG whether

    or not a report is led. They

    also reported that it was only

    a minor accident and the pic-

    ture taken and published in

    the media was a ake and this

    might be a reason why the

    DG is adamant to take any

    action. However, it was con-

    rmed by the Daily Post that

    the picture published was

    sent to them by a sta rom

    the Finance Dept.

    5. The hearing of the corruption

    case against David Moses, the formerland Ofcer was held on the 14th of

    April 2011. The matter has

    been adjourned to 19 May

    2011 at 9:00 am.

    ing an update and why there hasbeen no annual reports issued since

    2002 from this Ofce.7. ALAC: the complaint oce

    o Transparency Vanuatu has

    lion per year with limited

    stang. We can advise, the ALAC

    ofce is still currently receiving newcomplaints daily.

    When Serge Vohor was elected as Prime Minister, only 27 members of

    parliament were present in the parliament chamber after a roll call of MPs

    because the government side boycotted the election process. Only those 27

    MPs went through the procedure of Secret Ballot including Speaker of Par-liament, Maxime Carlot Korman. There were 26 MPs on the floor and the

    27th was the Speaker of Parliament, Korman. There were 27 votes for Vohor

    as Prime Minister when the votes were read out in parliament. So the 27th

    vote was Korman's vote.

    Dear Editor,

    On Sunday 24 April, 2011 I lis-

    tened to the selected MPs becoming

    Ministers and taking their oath of

    allegiance. I do not know whether

    they really know the true meaning

    of the words in the oath or not,

    because if they do the government

    would be stable during the term of

    1 parliament.

    No they do not know the meaning

    of the oath. That is why Vanuatu hasso many changes of government.

    MPs also take oath of allegiance

    after winning an election. They

    swear to treat everyone without

    fear or favor but what a bunch of

    lies. They do exactly the opposite for

    personal glory void of any public

    interest consideration.

    Personal and Political interest

    reign supreme in Vanuatu politics. I

    say this because if you look at the

    campaign platform of all the politi-

    cal groupings you would see that

    they promise development. Succes-

    sive governments have not demon-

    strated any major difference apart

    from the person being the Prime

    Minister and Minister so why the

    change? What are the major differ-

    ences in political ideology? Non, non

    at all.

    Same number or more politicalappointees, commission of enquiry

    into the running of government com-

    panies and other petty politics such

    as sharing of salaries between non-

    on-location employees, number hus-

    tling like cattle rustling and

    continuous disregard of the oath

    allegiance by treating people with

    fear and favor the majority of time,

    times and time and times.

    But in Vanuatu petty politics back

    stabbing, sleeping with the torturers

    of our Melanesian brothers and sis-

    ters in West Papua, allowing politi-

    cal arm twisting by Australia, and

    many more political innuendos

    occur at the expense of the public

    purse.

    Vanuatu seems to have no princi-

    ples any more. But we voted them

    into office and pay them for every

    bad thing they have done and con-tinue to do. In fact they believe they

    are God's gift to Vanuatu and they

    could not be more wrong. Show

    them we are the boss in the next

    election or maybe the public will

    succumb to the same old maus

    wora again come next election.

    cern that since 1991, an

    ongoing trend o both past

    and present governments

    stained by countless motions

    o no condence is something

    we all should be concerned

    about.

    Even though we live in

    a democracy, why is it now

    becoming a habit or Vanuatu

    politics that whenever a gov-

    ernment comes into power,

    we always have the Opposi-

    tion, moving a motion o no

    condence based on political

    power struggle or portolios

    rather than or developmentneeds o the people?

    This ongoing trend is

    seriously undermining the

    nation's progress and it does

    not look like it is in the inter-

    est o our national aspira-

    tions at all and the wishes o

    the voters who have put them

    there.It is evident among the

    ordinary Ni-Vanuatu that peo-

    ple are ed up o motions o

    no condence in parliament

    or simply the abuse o tax

    payers' money, deteriorating

    trust o parliamentarians and

    less progress in development

    and peace.

    Unless parliamentari-

    ans address this problem

    o political party instabili-

    ty by crossing loors, there

    will continually be increasing

    issues o governance crisis in

    the uture and this ongoing

    trend o removing one gov-ernment out and replacing it

    with another, will simply be

    the kind o politics that will

    never get this country any

    urther.

    This is a serious matter to

    deal with because it will ulti-

    mately in the end, aect the

    kind o economic develop-ment growth that we aspire

    or and this means more tax-

    payers money will have to be

    drained.

    We need a government

    that is transparent, accounta-

    ble, and one that respects the

    wishes of people. We need

    MPs who work together across

    party lines on behal o all the

    Vanuatu people but not those

    that pursue their own person-

    al agendas and greed.

    Vanuatu has a long record

    o instability and the motions

    o no conidences signi-

    y the abuse o parliamenta-

    ry democracy that politicianshave oten taken advantage

    o over the years.

    In act we have learned

    rom previous and past politi-

    cal crises and rom neighbour-

    ing countries, that whenever

    there is a weak political party

    system in place and rampant

    issues o corruption, it is like-ly that more bigger problems

    would occur that can lead to

    social unrest.

    Democracy indeed dic-

    tates economic prosperity but

    where is this promised pros-

    perity i political party mem-

    bers keep on acting as i there

    is a personal war going on

    between two actions who

    have been all but caught up in

    their own personal disputes?

    It is important to learn

    rom the past and to acknowl-

    edge that as a nation, it was

    because o our government's

    lack o good governance that

    had ultimately brought aboutthe Comprehensive Reorm

    Program (CRP) that have

    now put burden on ordinary

    people to repay the loan o

    Vt2 billion.

    Thus good governance is

    what this country needs in

    order or stability to occur

    and political parties stabili-ty in parliament, is where we

    should begin with.

    It is a trend that is weak-

    ening our resolve to polit-

    ical maturity and it will be

    our weakness in the ace o

    increasing and mounting

    pressure, rom our own per-

    sonal demands and expec-

    tations upon the MP's in the

    uture.

    People need to be aware

    that the more they elect MPs

    who are in the habit o cross-

    ing loors they risk eective

    government perormance in

    the long run. MPs crossing

    foors and changing politicalaliation unnecessarily and

    without legitimate reasons is

    just unacceptable.

    This ongoing political

    changes and maneuvering

    means allowing a downward

    spiral trend to develop with

    increasing risks attached to

    it. People need to know thatevery time there is a change

    in government, over Vt5 mil-

    lion o taxpayers money is

    spent to pay ormer Ministers

    and their sta.

    With the current political

    situation where numbers rom

    the Government and Oppo-

    sition side are airly unsta-

    ble, anything could happen

    with the possibility o anoth-

    er motion.

    In act, there are two real

    practical solutions i we do

    not want this to continue

    into the uture. It needs the

    political will o all political

    leaders to make changes inthe Constitution that would

    cater or more stability such

    as limiting the number o

    political parties and provi-

    sions regulating MPs cross-

    ing the loor and also or

    voters to make wise and bet-

    ter choices when voting.

    The National Parks and

    Wildlie Service has cordoned

    o the entrance to the rocks at

    the northern end o Newport

    Beach.Oicials have hoped since

    in a series o methane blasts on

    November 19 say the revela-

    tion, together with news the

    mines frefghting box had been

    opened, was a painul indica-

    tion the men may have sur-

    vived the frst explosion.

    think maybe there was hope,

    maybe we should have orced

    them somehow to get in there

    earlier and try to save them,

    Bernie Monk, said today.

    Mr Monk confrmed he had

    contacted the amilies o the

    two Queensland victims, Willie

    Joynson, 49, and Josh Uer, 25,

    news.

    Michael in the South Island

    tragedy.

    A United Nations team visiting the Libyan capital,

    Moamar Gaddaf, are surrounding towns in the west o

    The Australian Prime Minister, Julia Gillard, has own
