SOUTH AUSTRALIAN TOURISM COMMISSION 6 May 2016 Mr Neville Kitchin General Secretary Public Service Association of SA Inc GPO Box 2170 ADELAIDE SA 5001 Dear Mr Kitchin, Re: Notice of Dispute - Lack of Genuine Consultation - Workplace Restructure I write in response to your letter dated 3 May 2016 regarding a Notice of Dispute in relation to the South Australian Tourism Commission's (SATC) Marketing Group and seek to address your concerns and claims that the SATC has genuinely failed to consult in regards to workplace change. As your office is aware the SATC is currently in the process of undergoing consultation with affected staff in relation to potential restructuring of its marketing function. The SATC is undertaking this consultation process in complete accordance with its obligations under Clause 26 of the South Australian Public Sector Wages Parity Enterprise Agreement and otherwise at law. Further to conversations with the PSA today, the SATC has identified three roles in a digital space to focus on specialised technology and ensure that website production, development and performance are ably supporting the consumer needs, where the current roles primarily focus on loading content. This is a significant shift in both the duties and skills required to dutifully perform these tasks. Information provided by the team leader on staff skills and functions would tend to suggest that the individuals directly impacted by the proposed restructure, don't currently possess the skills required for these new roles. In the event that the proposed structure proceeds, affected staff will have the opportunity to represent their skills, knowledge and experience against the job requirements for these roles. The position descriptions will be circulated to the impacted staff as part of the consultation process. The SATC will be managing the demands within the proposed digital structure in accordance with reasonable allocations of tasks and workloads. As you will appreciate, the SATC needs to operate within its budgetary and FTE cap, which means making appropriate choices of the best allocation of these resources in the overall digital marketing context. The reasons for the proposed structure were articulated to staff concerned both individually and in a whole of team meeting. In addition the SATC is developing tender documentation to approach the openmarket for specialised digital marketing services. These services include searchengine optimisation, search engine marketing, analytics and insights and displayadvertising. These are highly specialised new services which are not currently, orhave ever been, provided by SATC staff. Accordingly the SATC is not outsourcingany work currently performed by its staff.

With respect to consultation I can advise that a number of individual staff wereinformed on an individual basis of the proposed structure as the proposal had thegreatest impact on these individuals. These staff, as with the wider business wereinvited to consider the proposed structure and provide feedback and anyalternative options within a fortnight (ie. by either 4 May 2016, or 5 May 2016). TheSATC recognised that any proposed structure and any potential impact to staff isa sensitive situation and therefore provided a number of the team the option totake time out of the office to consider the proposal and seek additional support. Itis important to understand that this was optional. Providing such an option is notin any way an indication of a predetermined outcome but rather a demonstrationof the SATC's consideration for the personal impact on those staff as part of agenuine consultation process.

As part of the consultation process, the SATC has endeavoured to clarify optionsif the proposed structure were to proceed. As part of this discussion, individualswere informed that there was potential for Targeted Voluntary SeparationPackages (TVSPs) for staff who were employed under ongoing arrangements andthe SATC would support staff who may be redeployed, to find suitable employmentwithin the SA Public Sector. To withhold such information would be inconsistentwith the SATC's obligations under clause 26.

The SATC will continue to meet all of its obligations to its employees, with aparticular focus on consultation and support of affected workers, as it worksthrough the change process. The SATC's intention is to review feedback receivedin regards to the proposed structure by no later than 13 May 2016 and make a finaldecision after this time.
