THE CONSENT CALENDAR IS APPROVED. PUBLIC COMMENT Opportunity for Public Comment on non-agenda matters. Testimony limited to three

CHAIR KAFOURY: DO WE HAVE PUBLIC COMMENT? YES, MADAM CHAIR, WE HAVE FIVE. (BOARD CLERK CALLS NAMES) I AM PAUL PHILLIPS, AND I SPOKE HERE JANUARY 7 ABOUT THE IPO, STANDS FOR INJURED AND PISSED OFF, AND I AM STILL INJURED AND PISSET OFF BUT SO I WAS INJURED AND PISSED OFF THAT I FORGOT TO MENTION MY INJURIES. AND I OBTAINED A BROKEN LEFT HIP AND TWO FRACTURES TO MY SPINAL CORD, AND WHEN I HAVE SAT HERE AND SAID THAT THERE IS 10,000 PEOPLE A YEAR WITH PERMANENT SPINAL CORD INJURIES, THAT'S WHERE THEY ARE PARALYZED, AND THE UPPER, LOWER ARMS. ARMS AND LEGS. THAT'S A SMALL CITY, AND THAT'S EACH YEAR. AND ANOTHER 2,000 TO 10,000 MORE PEOPLE ARE WHAT THEY CALL INCOMPLETE SPINAL CORD INJURIES, WHAT I HAVE. AND I THINK THAT THAT'S A TERRIBLY LARGE NUMBER OF PEOPLE, BUT WITH THE SAME -- SAYING IN MY PREVIOUS DISCUSSIONS, ONE-THIRD OF THE NATION, 100 MILLION PEOPLE HAVE INCURRABLE DISEASES. THAT'S AN AWFUL A LOT OF PEOPLE. AS I SAID, I AM SUFFERING WITH HIGH BLOOD PRESSURE FROM THE LACK OF OBTAINING BLOOD PRESSURE MEDICATION, THAT'S A LIFETIME PRESCRIPTION, BUT DON'T SEEM TO, I GUESS, IF I DIE, I DON'T NEED THE MEDICATION. ANOTHER THING IS MY BROTHER IN HOME FORWARD, APPARENTLY, THEY ACCEPTED HIS RENT, THIS TIME, AND APPARENTLY DISCHARGED TOO MANY. HE HAD TO GO TO A HOSPITAL, AND THEY FOUND OUT THAT HE HAD BED BUGS ON HIM, AND A HAZMAT TEAM WAS, WAS ORGANIZED, AND I GUESS, THEY HAVE THEM IN THE HOSPITALS, TOO. THEY HAVE NOT SPRAYED HIS PLACE COMPLETELY, FREE OF BEDBUGS YET. NOW, I WILL GIVE UP MY TIME. IT'S NICE TO SEE JOE,

THOUGH, BACK TO VEST THE ONE CASE IN FEDERAL COURT, AGAINST THE CITY MAYOR, AND THE CITY, ITSELF, FOR FIRST AMENDMENT RIGHTS, AND MR. LIGHTNING BEING A WATCHDOG POLITICAL WATCHDOG, AND MYSELF BEING INJURED AND PISSED OFF BECAUSE I NEVER GOT ANY JUSTICE AT ALL THANK YOU. CHAIR KAFOURY: THANK YOU. NOW, AGAIN, THERE ARE PEOPLE OUT THERE THAT WANT TO SEE THAT MADE INTO A SHELTER. AS WE KNOW, BARRY AND JORDAN MENACHE HAVE DONE A GREAT THING CREATING ANOTHER SHELTER DOWNTOWN. BUT, THERE ARE WAYS TO GET THAT DONE. MAYOR HALES APPROVED THAT IMMEDIATELY. IT'S DONE. AGAIN, FROM MY POSITION ON WAPATO, MANY PEOPLE BELIEVE THAT THAT WOULD MAKE AN IDEAL SHELTER. WHEN I AM GOING TO PROPOSE TO MAYOR HALES, TO BUY WAPATO FROM MULTNOMAH COUNTY. IT'S DECLARED A SURPLUS PROPERTY. THE CITY OF PORTLAND SHOULD HAVE A RIGHT TO STEP IN, AND BUY THAT PROPERTY. AND IT SHOULD BE TRANSFERRED TO THE CITY OF PORTLAND, AND LET MAYOR HALES BEGIN TO PROCEED FORWARD, AND GET THAT OPENED UP AS A SHELTER. IT SAT AT MULTNOMAH COUNTY FOR TEN YEARS, THE BIGGEST BLUNDER OUT THERE. I MEAN, WHO WOULD BUILD A BUILDING FOR 58 MILLION, HAVE IT SIT EMPTY FOR TEN YEARS, AND PAY 300,000 A YEAR, COMPLETE LOSS, AND THEY THINK THAT'S SOMETHING GOOD. GET IT OFF THE BOOKS IN MULTNOMAH COUNTY, AND LET THE CITY OF PORTLAND STEP FORWARD, AND OPEN THAT UP, AS A SHELTER, WHICH IS NEEDED, AND TO GET THE JOB DONE. AGAIN, WAPATO IS NOTHING BUT A BLUNDER. IT'S AN EMBARRASSMENT. MAKE SOMETHING GOOD OUT OF IT. WAPATO SHELTER, TRANSFERRED TO CITY OF PORTLAND, $1, PUBLIC GOOD. THANK YOU. CHAIR KAFOURY: THANK YOU. WHO IS NEXT? GOOD MORNING. GOOD MORNING, I AM JOE WALSH, FOR THE RECORD, AND I REPRESENT INDIVIDUALS FOR JUSTICE. LAST NIGHT I WAS OUT AND ABOUT IS, AT A GATHERING AT OUR GOOD COMMISSIONER [INAUDIBLE] WAS ALSO PRESENT. AND ON THE WAY HOME, BECAUSE I USED THE BUS, AND THE TRAINS, I GOT STUCK DOWN IN DIVISION AND 92ND STREET IN THE COLD. IT WAS ABOUT 8:00. AND MY TOES WERE SO COLD, THAT THE THOUGHT WENT THROUGH MY MIND, YOU KNOW, I AM GOING TO GO HOME AND IN THE NEXT OR 10 OR 15 MINUTES, AND I AM GOING TO TAKE MYSELF A REALLY HOT SHOWER. JUST TO

GET THE CIRCULATION BACK INTO MY TOES. BUT, SUPPOSE THAT I HAD NO PLACE TO GO. WHAT WOULD I DO? WHERE WOULD I GO? AND I LOOKED AROUND, AND THERE WERE SHELTERS, AND A DOORWAYS, LADIES AND GENTLEMEN, WE LOSE 54 PEOPLE ON THE STREETS THAT DIE YEAR AFTER YEAR. YEAR AFTER YEAR. THEY HAVE NO PLACE TO GO, SO WHEN I GOT HOME LAST NIGHT, I DID TAKE A SHOT SHOWER AND I ASKED MY WIFE, PATTY, I SAID WHAT THE HECK IS THE TEMPERATURE? AND SHE LOOKED IT UP, AND IT WAS ONLY 48 DEGREES. 48 DEGREES. BUT, THE WIND FACTOR ON THAT PARTICULAR SETTING, WHERE THE BUS COMES AT THE MAX, IS WIDE OPEN. AND THE COLD IS UNBELIEVABLE. AND THAT'S WHAT I WENT THROUGH, AND WE ARE NOT DOING A GOOD ENOUGH JOB. WE HAVE THE SHERIFF USING PRISONERS FROM OUR JAILS TO SWEEP HOMELESS PEOPLE, AND STEAL ALL THEIR STUFF. WE HAVE THE CITY STILL DOING IT. WHEN ARE WE GOING TO STOP? JUST STOP? I KNOW THAT THE CHAIR, THIS IS A PRIORITY FOR YOU. IT'S GOT TO BE A PRIORITY EVERY DAY. YOU HAVE GOT TO BE ON THE PHONE EVERY DAY, LIKE WE ARE. AND ASKING PEOPLE, STOP IT! DO WHAT NEVADA DID, DO WHAT SALT LAKE CITY DID, JUST GET THEM OFF THE STREETS. WAPATO IS, IS -- IT'S AN AVENUE THAT YOU COULD TRAVEL DOWN. I DON'T CARE. GET THEM OFF THE STREETS! AND STOP PLAYING POLITICS WITH THIS. PEOPLE ARE DYING, EVERY YEAR. AND WE JUST PLAY GAMES. AND IT'S BREAKING MY HEART. AND LASTLY, IT WAS REAL. VERY REAL TO ME BECAUSE I HAD A PLACE TO GO. AND THEY DON'T. THEY DIE ALONE IN THE COLD, WHERE THE COPS TOOK THEIR BLANKETS. WHAT THE HELL IS THE MATTER WITH US? THANK YOU. CHAIR KAFOURY: THANK YOU. GO AHEAD. GOOD MORNING, MADAM CHAIR, AND COMMISSIONER, I AM KEVIN FITS, WITH THE OREGON MENTAL HEALTH CONSUMER ASSOCIATION. IN MY TWO MINUTES I HAVE ONE GOAL, AND THAT IS TO PERSUADE YOU TO CREATE A PEER SERVICES COORDINATOR AS A PROGRAM MANAGER IN YOUR BEHAVIORAL HEALTH DIVISION AND FISCAL YEAR 2017 BUDGET. WHY SHOULD THIS BE DONE AND WHY IS THIS IMPORTANT? CLACKAMAS COUNTY HAS HAD A SIMILAR POSITION, AND THEIR COUNTY STRUCTURE FOR 4.5 YEARS. THIS IS MARKET DISRUPTION. MARKET DISRUPTION IS HAPPENING ALL OVER THE PLACE, IN THE FOR PROFIT SYSTEMS, GOOD IDEAS MAKE MONEY AND GOOD IDEAS SAVE MONEY. AND NEW BUSINESS MODELS, AND WAYS OF SERVING THE CUSTOMER, LIKE UBER AND AMAZON AND AIRBNB, AND APPLE AND SPOTIFY ARE REPLACING, RESHAPING AND REPLACING THE BUSINESS LANDSCAPE. COMPANIES LIKE WAL-MART, TAXIS, KODAK AND MACY'S AND COMCAST ARE STRUGGLING TO ADAPT AND REMAIN PROFITABLE. CREATIVE DISRUPTION CAN AND DOES OCCUR IN SERVICE ORGANIZATIONS, BUT SOMETIMES, THEY NEED A LITTLE PUSH. BY FORWARD THINKING LEADERSHIP, WHO ARE NOT AFRAID TO TAKE RISKS AND SHAKE UP SERVICE

PROVIDERS, CONTRACTUAL EXPECTATIONS. FOR EXAMPLE, HERE IN MULTNOMAH COUNTY, FOUR MAJOR SERVICE PROVIDERS CONTROL 85% OF THE SUBCONTRACTED ADULT BEHAVIORAL HEALTH SERVICE THIS IS MULTNOMAH COUNTY. CREATIVE DISRUPTION HERE IN PORTLAND MEANS THREATENING THE EMPIRES, AND IN PLACES LIKE PHILADELPHIA, LONG BEACH, CALIFORNIA, WASHINGTON, AND NEW YORK CITY, PEERS ARE AN ESSENTIAL PART IN A MAJORITY OF MOST OF THEIR BEHAVIORAL HEALTH SERVICE SYSTEMS. AND SOME OF THESE CITIES THEY ARE SPENDING 20 TO 30 MILLION A YEAR ON PEER DIRECTED AND PEER SERVICE PROVIDERS, INCH PEERS ARE SERVICE PROVIDERS OF UP TO 35 TO 40% OF THE WORKFORCE IN THESE SYSTEMS. I APPRECIATE THE BEHAVIORAL HEALTH DIRECTOR DAVID WITH THE TRAINING PROGRAMS AND THE FINANCIAL SUPPORT OF NORTH STAR CLUBHOUSE AS MENTIONED IN THE BRIEFING ON TUESDAY. AND WE WANT A LARGER COMMITMENT TO PEERS AS SERVICE PROVIDERS. THIS NEEDS SUPPORT WITH, WITHOUT, BECAUSE WITHOUT CONCERTED FOCUS, STEWARDSHIP AND PLANNING, PEERS WILL OCCUPY ONLY 3% OF MULTNOMAH COUNTY'S BEHAVIORAL HEALTH SERVICE PROVIDER'S WORKFORCE AND BEFORE? BECAUSE IN ORDER TO CREATE THE JOBS, THE COUNTY HAS TO WRITE CONTRACTS AND SET MANDATES FOR THE SUBCONTRACTORS, TO, ACTUALLY, HIRE AND CREATE THESE POSITIONS. THAT'S WHY IT'S ESSENTIAL TO CREATE A PEER SERVICES COORDINATOR WITHIN MULTNOMAH COUNTY BEHAVIORAL HEALTH. THIS MEANS UPSETTING THE PYRAMID OF THE PSYCHIATRIST AS THE UNQUESTIONABLE EXPERT. PEOPLE WITH LIVED EXPERIENCE AND IN RECOVERY FOR MENTAL HEALTH AND ADDICTIONS, CAN DISCOVER WHAT WORKS. PEERS ARE BECOMING EDUCATED THROUGH SELF HELP AND MUTUAL SUPPORT ON FACEBOOK AND THE INTERNET, AND THAT OUTDATED MODELS OF BRAIN DISEASE AND CHEMICAL IMBALANCE THEORY FALLACIES NEED TO BE REPLACED WITH CURRENT RESEARCH AND BEST PRACTICES. THIS IS TURNING CONVENTIONAL SERVICE DELIVERY ON ITS HEAD IN CITIES AND COUNTIES ACROSS THE UNITED STATES. I WILL WRAP UP. I HAVE TWO OTHER POINTS, BUT THAT'S IN MY HANDOUT. AS A RECENT 2015 BEHAVIORAL SURVEY HAD SUGGESTED, WHEN PEOPLE WHO ARE RECEIVING SERVICES HAVE AN OPPORTUNITY TO CHOOSE PEERS AS SERVICE PROVIDERS, OVER TRADITIONAL SERVICE PROVIDERS, THE VAST MAJORITY OF PEOPLE CHOOSE TO WORK WITH PEERS. TO END, IN THREE WEEKS FROM NOW AROUND FEBRUARY, AROUND FEBRUARY 11, WHEN THE HEALTH DIRECTOR JOANNA FULLER COME TO YOU WITH THEIR 2017 BUDGET AGENDA, I ASKED IS THAT YOU INSIST THEY CHUNK OUT MONEY TO CREATE A POSITION WITHIN YOUR ORGANIZATION. CHAIR KAFOURY: THANK YOU. I AM NANCY NEWELL, AND I AM PROUD TO SAY THAT I WAS PART OF THE EXPOSURE OF THE ENRON DEAL, AND SEVERAL OTHER MERGER DEALS IN OUR ELECTRIC GRID IN THIS CITY. AND I AM ALSO AN ANTI-NUCLEAR ACTIVIST AND HAVE SUCCEEDED IN CLOSING THREE NUCLEAR PLANTS THROUGHOUT THIS COUNTRY. I AM HERE TODAY BECAUSE I HAVE READ THIS BOOK ABOUT THE WASHINGTON PUBLIC POWER SUPPLY SYSTEM. WHICH, THAT PLANT, THAT RESULTED, WAS A -- THE SINGLE LARGEST MUNICIPAL BOND DEFAULT IN THE HISTORY OF THE UNITED STATES. NOW, WE HAVE THE WEST COAST INFRASTRUCTURE, ON OUR WATER, THAT HAS BEEN OK'D BY STATE LEGISLATION, BY THE CHAIR, JULES BAILEY, AND TED WHEELER, THAT HIT THE BEGINNINGS OF IT FOR A YEAR. WE WERE ABLE TO EXPOSE WHAT WAS GOING ON. AND THERE HASN'T BEEN FULL PUBLIC DEBATE ON THE BEAUTIFUL BULL RUN WATER, WHERE IT'S GOING, FROM CANADA TO MEXICO, AND WHERE THE STRUCTURE COSTS ARE GOING TO BE, AND WHO IS GOING TO BE HELD ACCOUNTABLE, AND MULTI-NATIONALS ARE RUNNING THE CITY PRACTICALLY, AND YOU ARE SAYING, AND OFFERING AS YOU RUN FOR OFFICE, THAT YOU ARE GOING TO BE ABLE TO SOLVE THESE PROBLEMS WITH ALL OF THE DEBT THAT WE'RE INCURRING, AND THE INABILITY TO EVEN HAVE ANY PUBLIC ACCOUNTABILITY FOR SOME OF THE THINGS THAT GO ON. WE HAD A TREMENDOUS INITIATIVE CAMPAIGN TO STOP FLUORIDE IN THE WATER BECAUSE THE FLUORIDE WE FOUND WAS GOING TO COME FROM CHINA LOADED WITH AGRICULTURAL TOXINS, AND THE OVERSIGHT ON THAT, FAILED. AND THE OVERSIGHT ON THIS, WE HAVE THAT NUCLEAR PLANT RUNNING, IT CAN BLOW UP THE ENTIRE NORTHWEST, AND IT'S NOT BEING CLOSED, LUCKILY WE JUST GOT WORD FROM A WHISTLE-BLOWER, AND MAYBE YOU WILL LISTEN NOW, AND I ASK FOR A RESOLUTION OUT OF THIS COMMITTEE, AND I HAVE A GROUP OF PEOPLE, AND I HAVE NOT SEEN THAT YET, AND I HAVE NOT SEEN THAT FROM ANY PUBLIC OFFICIAL, AND I AM WONDERING WHAT'S WRONG WITH, WE CLOSED TROJAN, WHAT'S WRONG WITH OREGON? WE ARE PURCHASING THROUGH [INAUDIBLE] ELECTRICITY. IT SHOULD BE SHUT TODAY. WE HAVE TREMENDOUS WASTE PROBLEMS, AND THERE IS NO PLACE TO PUT THE WASTE. WE ARE SPENDING FORTUNES ON ALL OF THESE TYPES OF THINGS, AND WE NEED MONEY, AS YOU WELL KNOW, IN OUR COMMUNITIES FOR SOMETHING THAT'S A LOT HEALTHIER. THE EPIDEMIC IS SO OBVIOUS, THAT IT EVEN CAME UP LAST WEEK IN THE DEMOCRATIC PRESIDENTIAL DEBATES WHEN HILLARY CLINTON AND BERNIE GIUSTO CALLED OUT -- BERNIE SANDERS CALLED OUT THE MEASURES WE HAVE TAKEN TO SAVE LIVES. THE REPRESENTATIVES HAVE PASSED LEGISLATION THAT SAVES PEOPLE'S LIVES. I AM GOING TO ASK THE TRICOUNTY HEALTH OFFICER, DR. PAUL LEWIS, AND HAVEN WHEELOCK OF OUTSIDE IN, TO PLEASE COME UP AND TALK ABOUT THE DIFFERENCE THAT THESE TWO REPRESENTATIVES HAVE MADE. GOOD MORNING, MR. LEWIS, DR. LEWIS. AND TOBACCO, INAPPROPRIATE USE OF DRUGS INTENDED FOR OTHER PURPOSES, AND ILLEGAL DRUGS LIKE HEROIN AND METH. WITH NO LEGITIMATE USE. OPIATES LIKE HEROIN AND PAIN PILLS ARE A SPECIFIC PROBLEM, AND AS THE CHAIR MENTIONED, THE FOCUS OF THE NATIONAL AND REGIONAL ATTENTION. THE LAST YEAR WE HAVE COMPLETE DATA, 2014, WE HAD MORE THAN A DEATH A WEEK FROM HEROIN OVERDOSE, AND MORE THAN A DEATH A WEEK FROM A PAIN PILL OVERDOSE. AND FAR TOO MANY PEOPLE IN THIS ROOM, MYSELF INCLUDED, KNOW PERSONALLY THAT THESE SUBSTANCES CAN KILL, QUICKLY, OR ERODE FAMILIES IN OTHER LIVES OVER DECADES. WE'RE ALL VULNERABLE TO SUBSTANCE MISUSE, INDIVIDUALS, FAMILIES, AND AS A COMMUNITY. WHILE DEATHS FROM HEROIN AND ILLEGALLY PRESCRIBED PAIN PILLS ARE PEAKING, HOPE IS EMERGING THROUGH A BROAD RESPONSE OF CONCERNED INDIVIDUALS, AND AGENCIES, PROFESSIONALS, AND THE POLICY-MAKERS THAT WE'RE HONORING TODAY. EVEN THOUGH THERE IS NO SINGLE LAW OR RULE THAT CAN PREVENT ALL OF THE HARMS FROM THESE SUBSTANCES, THERE IS PROGRESS. IN THE 2013 LEGISLATIVE SESSION, OREGON LAW CHANGED TO ALLOW LAY PEOPLE TO POSSESS AND ADMINISTER IN THE LOCK ZONE, THIS IS THE LAZARUS DRUG THAT AWAKENS THE OPIOID OVERDOSE VICTIMS FROM A FATAL SLEEP. IT'S AN DOTE THAT GIVES VICTIMS A CHANCE TO START THEIR JOURNEY BACK TO RECOVERY AND HEALTH. AND IT'S A DRAMATIC INTERVENTION THAT MAKES US ALL REALIZE WE NEED A COMPREHENSIVE EFFORT TO PREVENT, RECOGNIZE, AND TREAT THIS DISEASE. AND I WANT TO EMPHASIZE THAT THIS IS A DISEASE, IN NOT A MORAL FAILING. AS MANY OF MY COLLEAGUES POINTED OUT, IF SOMEONE HAD HIGH BLOOD PRESSURE, WE WOULD NOT CONSIDER THAT A MORAL FAILURE BUT A DISEASE THAT NEEDS TREATMENT. IN THE FIRST FULL YEAR AFTER THE 2013 LAW PASSED, THANKS TO PARTNERS LIKE OUTSIDE IN, MULTNOMAH COUNTY SAW AN UNPRECEDENTED 30% DECREASE. BUT WE KNEW THERE WAS MORE THAT NEEDED TO BE DONE. THEY UNDERSTOOD THAT BYSTANDERS ARE WORRIED ABOUT CALLING 9-1-1, AND FIRST RESPONDERS WOULD NOT ARRIVE IN TIME TO HELP. OUR SURVEYS AND PERSONAL STORIES LIKE THOSE OF ADVOCATES LIKE MICHELLE CHISOLM TELL US MANY ARE CONCERNED ABOUT ARRESTS FOR MINOR VIOLATIONS THEY MIGHT HESITATE TO CALL 9-1-1. A HESITATION THAT COULD BE FATAL OR LEAD TO IRREVERSIBLE BRAIN DAMAGE. THE 2015 GOOD SAMARITAN LAW, IS SIMILAR TO A LAW THAT ENCOURAGES UNDERAGED BYSTANDERS TO CALL FOR HELP WHEN THEY SEE ALCOHOL POISONING. THE NEW LAW WENT INTO EFFECT JUST THREE WEEKS AGO, AND IT WILL HELP VICTIMS GET HELP MORE QUICKLY AND BEGIN THE JOURNEY TO RECOVERY. JENNIFER WILLIAMSON WAS KEY IN MAKING OREGON THE 33RD STATE WITH THIS TYPE OF GOOD SAMARITAN LAW, AS CO-CHIEF SPONSORS, OF SENATE BILL 839. THEY TESTIFIED PASSIONATELY FOR THE BILL IN COMMITTEE AND CARRIED IT TO THE HOUSE FLOOR. REPRESENTATIVES WILLIAMSON WAS ALSO A SPONSOR OF SENATE BILL 384, THE 2013 BILL. THEY WORKED TO PROTECT THE FAMILIES AND CHILDREN IN THE COMMUNITY, WHOSE LIVES ARE

DEVASTATED BY ADDICTION, AND OREGON IS BETTER BECAUSE OF THEIR SERVICE. I WOULD MIKE TO INTRODUCE HAVEN WHEELOCK FROM OUTSIDE IN. CHAIR KAFOURY: THANK YOU. GOOD MORNING. THANK YOU COMMISSIONER KAFOURY AND THE REST OF THE COMMISSIONERS, I'M HAVEN WHEELOCK, THE PROGRAM COORDINATOR FOR THE SYRINGE EXCHANGE AT OUTSIDE IN. AND I AM HERE TODAY TO SAY THANK YOU TO THESE AMAZING REPRESENTATIVES, FOR THEIR HARD WORK AND PREVENTING OVERDOSE DEATHS FOR OUR STATE. OUTSIDE IN SYRINGE EXCHANGE PROGRAM SERVES 4,000 CLIENTS EVERY YEAR, AND I WOULD ARGUE THAT OVERDOSES TOUCH THE LIVES OF ALL OF THEM. MANY HAVE LOST PEOPLE THAT THEY CARE ABOUT TO OVERDOSED DEATHS AND ROUGHLY HALF HAVE REPORTED OVERDOSES THEMSELVES THROUGHOUT THEIR LIFETIME. THE LEGISLATION, THE LEGISLATIVE ACTIONS BY THESE TWO CHAMPIONS HAVE HELPED TO ENSURE THAT MORE AND MORE OVERDOSE EVENTS DO NOT RESULT IN DEATH. I HAVE THE HONOR OF TALKING TO FOLKS EVERY DAY IN OUR PROGRAM, WHO HAVE USED NALOXONE TO SAVE THE LIVES OF PEOPLE THEY CARE ABOUT AND EXPRESSED GRATITUDE FOR KNOWING THAT THEY CAN CALL FOR HELP IF THEY NEED IT, WITHOUT WORRYING ABOUT ARREST. JUST THIS WEEK I HAD A MAN TELL ME HOW HE SAVED THE LIFE OF HIS FRIEND AND STAYED AFTER CALLING 9-1-1 BECAUSE OF AN OVERDOSE. HE TOLD ME THAT HE HISTORICALLY WOULD LEAVE AN OVERDOSE EVENT, CALL 9-1-1, AND RUN, LEAVING HIS FRIENDS UNCONSCIOUS, BECAUSE HE WAS AFRAID, AND THAT WITH THE NEW LAWS IN PLACE, HE WAS ABLE TO STAY AND CONTINUE RESCUE BREATHING UNTIL HELP ARRIVED, AND HE LEFT KNOWING THAT ONE, HIS FRIEND WAS OKAY, AND TWO, HE DID NOT FEEL THE GUILT THAT HE USUALLY WOULD FEEL AFTER THESE EVENTS FOR HAVING TO LEAVE. THE WORK ON THESE TWO BILLS HAS, AND WILL CONTINUE TO SAVE LIVES ACROSS OUR STATE, AND IN OUR COMMUNITY, SO ON BEHALF OF DRUG USERS, THEIR FRIENDS, AND THEIR FAMILIES, ASK THE STAFF OF OUTSIDE IN, AS WELL AS MULTNOMAH COUNTY SYRINGE EXCHANGE, I JUST HAVE TO EXPRESS SINCERE AND HEARTFELT GRATITUDE TO THESE REPRESENTATIVES FOR CHAMPIONING THESE BILLS. AND IN 2012, WHEN I WAS RUNNING FOR OFFICE, I TALK ABOUT THIS BEING AN ISSUE THAT I CARED ABOUT, AND LUCKILY, I FOUND THE MULTNOMAH COUNTY TEAM IN SALEM LED BY CLAUDIA BLACK, WHO HAS A PASSION ABOUT THIS WORK, AS WELL, AND WAS ABLE TO SPONSOR BOTH THE 2013 BILL, AND THE 2014 BILL, WITH REPRESENTATIVE FAGAN, AND HEARING THE STORIES, ESPECIALLY FROM HAVEN AND THE FOLKS AT OUTSIDE IN ABOUT HOW OUR POLICY CHANGE IN SAVING LIVES IS TRULY -- TRULY REMARKABLE. IN TERMS OF WHY I WANTED TO BE A SPONSOR OF THIS TYPE OF LEGISLATION, I WILL START BY SAYING SOMETHING KIND OF STRANGE, WHICH IS THAT, IN OCTOBER OF 2014, OCTOBER 30, MY MOM, UNEXPECTEDLY PASSED AWAY, AFTER COMPLICATIONS FROM A ROUTINE SURGERY. THIS WAS FIVE DAYS BEFORE THE ELECTION, OF WHICH I WAS RUNNING IN A FIERCE RE-ELECTION CAMPAIGN, AND THE WEIRD THING FOR ME TO SAY IS THIS WAS A REALLY HAPPY ENDING. SIX YEARS PRIOR, WHEN I WAS ABOUT TO START MY THIRD SEMESTER OF LAW SCHOOL, I WAS CALLED TO THE HOSPITAL, ACTUALLY, PORTLAND ADVENTIST IN EAST PORTLAND, BECAUSE MY MOM HAD BEEN TAKEN TO, BY AN AMBULANCE AFTER OVERDOSING ON HEROIN, AND AT THAT POINT, MY MOM WAS AN ADDICT MY ENTIRE LIFE, ON AND OFF THE STREETS OF EAST PORTLAND, AND A VARIETY OF OPIOID AND WHATEVER THAT SHE COULD GET, METHAMPHETAMINE, ADDICTIONS, AND SHE HAD OVERDOSED, AND SHE WAS IN THE ICU, AND WAS UNCONSCIOUS. SO, I WENT THERE, AND LEARNED THAT HER HUSBAND, AND HER HAD BEEN PARTYING THE NIGHT BEFORE, AND THAT SHE HAD OVERDOSED, AND THAT HE KIND OF JUST KEPT PARTYING, AND THEN THE NEXT MORNING HE COULD NOT WAKE HER. AND HE

DID NOT CALL THE POLICE FOR THE EXACT REASON THAT HE WAS SCARED OF GETTING IN TROUBLE. AND THEY WERE LIVING WITH HIS PARENTS AT THE TIME, AND COINCIDENTALLY, MY MOM'S BROTHER-IN-LAW STOPPED BY THAT MORNING TO, I THINK, TO RETURN A SPATULA, TO HER DAD, WHICH THEY LIVED IN THE BASEMENT AND NOTICED MY MOM WAS UNCONSCIOUS AND CALLED THE POLICE, AND SO YOU KNOW, WE GOT LUCKY ENOUGH TO WHERE SHE DID GET THERE IN TIME THANKS TO THE COINCIDENCE OF A SPATULA RETURN, AND WAS ABLE TO SAVE HER LIFE, AND SHE YOU KNOW, WE GOT THE BLESSING AND THE FACT THAT THAT WAS HER TURNING POINT. SHE LEFT PORTLAND. MOVED TO PENDLETON, MY BROTHERS AND I SUPPORTED HER FOR A YEAR WHILE SHE, YOU KNOW, GOT CLEAN AND GOT HER FIRST NON-BARTENDING JOB AND SPENT THE NEXT, ALMOST SIX YEARS BEING A MAJOR PART OF HER GRANDKIDS' LIVES AND OWNING HER FIRST HOME AND GETTING TO EXPERIENCE THE BENEFITS OF BEING CLEAN AND SOBER, AND SO WHEN I LOOK AT THESE BILLS, I KNOW THE UNFORTUNATE REALITY THAT MANY IN THE PUBLIC, AND UNFORTUNATELY, SOME OF OUR COLLEAGUES IN THE LEGISLATURE LOOK AT THESE BILLS, AND SAY, YOU KNOW WHAT, WHY DO A POLICY CHANGE? WHO ARE WE SAVING HERE? THESE ARE ADDICTS. WHO ARE THESE PEOPLE? I AM ACUTELY AWARE THAT FOR ALL OF THESE PEOPLE, THEY ARE SOMEBODY'S, SOMEBODY. THANK YOU FOR THE WORK THAT YOU DID IN GETTING THIS PASSED AND OUR GOVERNMENT RELATIONS FOLKS FOR REALLY PUSHING THIS. THANK YOU, MADAM CHAIR. THANK YOU. GOOD MORNING, I'M JOHN WASIUTYNSKI, THE DIRECTOR OF THE SUSTAINABILITY HERE AT MULTNOMAH COUNTY. I AM HERE TO TALK ABOUT THE OIL TRAINS. EVERYBODY READ IN THE PAPER RECENTLY ABOUT THE RISE OF OIL EXTRACTION, IN NORTH AMERICA, AND DUE TO FRACKING, AND NEW TECHNOLOGIES ALLOW US TO EXTRACT OIL FROM SHALE. A LOT OF THAT ACTIVITY IS GOING ON IN NORTH DAKOTA REGIONALLY, AND THAT OIL NEEDS TO FIND ITS WAY TO MARKETS, AND A LOT OF TIMES, IT'S TRAVELING THROUGH THE COLUMBIA GORGE AND MULTNOMAH COUNTY TO REACH IT'S DESTINATION. THE COUNTY WAS ASKED BY OREGON CITIZENS FOR SOCIAL RESPONSIBILITIES AND OTHER MEMBERS OF THE COMMUNITY TO LOOK INTO THE DANGER THAT THIS NEW COMMODITY OR, NOT NEW, BUT THIS COMMODITY POSES TO RESIDENTS, INCLUDING THE NUMBER OF RESIDENTS THAT ARE SERVED WITHIN THE DANGER ZONE. MY OFFICE TOOK THE LEAD ON DEVELOPING THAT RESEARCH, AND WITH HELP FROM THE OFFICE OF EMERGENCY MANAGEMENT, AND WE HAVE CHRIS VOSS, AND SUPPORT FROM THE COUNTY HEALTH DEPARTMENT. I WANT TO START THE FINDINGS BY SAYING THAT BY AND LARGE, TRANSPORTER OF CARGO BY RAIL, IS SAFE AND EFFICIENT. WE HAVE LOTS 6 CARGO MOVING EVERY DAY, AND IT GETS TO THE ULTIMATE DESTINATION SAFELY. THE RAIL INDUSTRIES INVEST A LOT OF MONEY INTO GETTING SAFER AND BETTER. THIS PARTICULAR COMMODITY PRESENTS CHALLENGES THAT ARE IMPORTANT TO HIGHLIGHT, AND ADD TO THE PROBLEMATIC NATURE. IT’S IS MORE EXPLOSIVE THAN TRADITIONAL OIL, AND IT'S -- WHAT'S MAKING UP THE MAJORITY, TRAVELING THROUGH OUR REGION. THE INCREASE [INAUDIBLE], THERE WAS VERY LOW AMOUNT OF OIL BY RAIL TRAVELING THROUGH THE REGION TODAY, AND AS THE COMMISSIONER MENTIONED, THERE'S BEEN DRAMATIC INCREASES. THEY ARE LIKELY TO CONTINUE AS THE NEW EXPORT TERMINALS ARE DEVELOPED IN THE NORTHWEST, AND THE EXPORT BAN WAS SHIFTED BY THE CONGRESS. THE OTHER THING, AND WE HAVE PORTLAND FIRE TO TALK MORE ABOUT THIS, THE RISE IN THIS COMMODITY LEFT REGULATORS AND EMERGENCY RESPONDERS PLAYING CATCHUP TO SORT OF COPE WITH THIS NEW REALITY. SO EVEN THOUGH THE RAIL INDUSTRY IS NOT REQUIRED TO ADOPT SAFER CARS, THOSE CARS WON'T BE ON THE RAILS UNTIL 2018. THE MOST UNSAFE CARS ARE GOING TO BE OFF THE RAILS, BUT THOSE WON'T BE IMPLEMENTED UNTIL 2018, THE FINDINGS FOUND THAT UP TO 12 TRAINS A WEEK CARRYING A MILLION GALLONS OR MORE OF CRUDE ARE TRAVELING THROUGH MULTNOMAH COUNTY, AND THE SMALLER SHIPISHMENTS ARE ALSO TRAVELING THROUGH THE COUNTY. THE COMMISSIONER MENTIONED 26% OF THE RESIDENTS LIVE WITHIN A HOOF MILE OF A RAIL LINE. THAT'S A BUFFER WE USE TO ANALYZE BECAUSE WE KNOW FROM THE STATE FIRE MARSHALL AND FROM THE FEDERAL SAFETY ADMINISTRATION, NOT SURE I GOT THAT FEDERAL AGENCY RIGHT BUT THE HALF MILE, THE LIKELY EVACUATION AREA, IN CASE OF A FIRE OR EXPLOSION FROM A RAIL CAR. THERE IS 108 SCHOOL

AND CHILDREN WITHIN -- I'M SORRY, 108 SCHOOLS AND CHILDCARE FACILITIES WITHIN THAT HALF MILE BUFFER. PEOPLE OF COLOR ARE MORE LIKELY TO LIVE WITHIN THAT BUFFER ZONE, MAKING IT AN ENVIRONMENTAL JUSTICE ISSUE, 25 BILLION OF IMPROVED PROPERTY WITHIN THAT RADIUS, AND VANCOUVER ENERGY PROJECT, WHICH IS BEING, UNDER REVIEW, AT THE PORT OF VANCOUVER, FURTHER INCREASE THE OIL BY RAIL TRAFFIC ON THE WASHINGTON SIDE, AND IT'S REASONABLE TO ASSUME THAT THAT'S GOING TO CAUSE CONGESTION ON THE WASHINGTON SIDE AND SENDS MORE OIL TRAFFIC TO THE OREGON SIDE. TODAY IS A RESOLUTION, WILL AUTHORIZE THE OFFICE OF SUSTAINABILITY TO SUBMIT COMMENT TO THE REGULATORS IN THE STATE OF WASHINGTON ABOUT THIS PROPOSED ENERGY TERMINAL, AND IT WILL ALIGN THE COUNTY WITH THE CITY OF VANCOUVER AND OTHER CITIES IN THE GORGE, AND IN OPPOSITION OF THIS PROJECT, AND THE OIL RAIL BY OIL GENERALLY. WITH THAT, I WILL TURN IT OVER TO OUR GUESTS HERE. SURE. CHRIS VOSS, DIRECTOR, OFFICE OF EMERGENCY MANAGEMENT. GOOD MORNING. WITH MULTNOMAH COUNTY. IS THAT WORKING? YEAH. OK. SO, I AM A BIT OF A NUMBER'S GUY SO I WILL NOT GO THROUGH THE REPORT BUT I THOUGHT THAT I WOULD GIVE IT SOME NUMBERS. FIRST I WANT TO SORT OF REPORT THAT SINCE 2012, MULTNOMAH COUNTY IS, ACTUALLY, HAS HAD 34% OF THE STATE'S RAIL INCIDENTS IN THE STATE, SO WE'RE GETTING MORE THAN OUR FAIR SHARE. ANOTHER NUMBER, THERE HAS BEEN A DECLINE OF RAIL INCIDENCES IN THE COUNTRY, HOWEVER THE NUMBER OF ACCIDENTS RELATED TO FIRE AND VIOLENT RUPTURE HAVE ACTUALLY NEARLY DOUBLED FROM 20 IN 2009 TO 38 IN 2014 NATIONALLY. SO, THE TYPES OF INCIDENTS WERE, WE'RE MOST CONCERNED WITH, WE HAVE SEEN AN INCREASE FOR, AND AS WE LOOK AT SORT OF THE WEST PORTLAND FACILITY, IT'S RECEIVING 120,000 BARRELS A DAY LOOKING TO INCREASE TO 360 DALLAS A DAY, IF ALL OF THE PROPOSED EXPANSES TO THE OIL FACILITIES IN OREGON AND WASHINGTON LOOKED AT AND APPROVED. YOU ARE LOOKING AT OVER A MILLION GALLONS. SO THERE ARE A LOT OF INCIDENTS, THEY TEND TO BE MINOR, THIS IS A LOW PROBABLY, HIGH CONSEQUENCE EVENT, BUT CERTAINLY, IF YOU ARE INCREASING THAT PROBABILITY, BETWEEN THREE AND NINE FOLD, JUST WITH THE SHEER VOLUME YOU ARE MORE LIKELY TO SEE A SIGNIFICANT EVENT, SO I THINK

THAT'S ONE THING TO KEEP IN MIND. IT IS LOW PROBABILITY, HIGH CONSEQUENCE, AND NUMBERS DON'T LIE, SO THREE TO NINE TIMES AS MANY TRAINS AND AS MUCH OIL WILL HAVE AN IMPACT FOR US. GOOD MORNING, I AM WILLIEO, A DEPUTY CHIEF WITH THE PORTLAND FIRE AND RESCUE, AND WITH ME HERE TODAY IS LIEUTENANT SHAWN CHRISTIANSEN, AND LIEUTENANT BRIAN PROFIT, BOTH ARE CURRENT AND PAST HAZMAT COORDINATORS, I WOULD LIKE TO READ A PREPARED STATEMENT REGARDING THE PORTLAND FIRE POSITION ON OIL TRAINS. PORTLAND FIRE AND RESCUE HAS THE FOLLOWING CONCERNS ABOUT LARGE QUANTITIES BEING TRANSPORTED THROUGH MULTNOMAH COUNTY. THE CRUDE OIL TRAIN DERAILMENT PRESENTS MANY CHALLENGES AND HAZARDS FROM THE COMMUNITY, AND THE ENVIRONMENT. THESE EVENTS ARE EXTREMELY LABOR AND EQUIPMENT INTENSIVE. A THIRD, FOURTH, AND FIFTH ALARM ASSIGNMENT FOR A LARGE INCIDENT DRAINS THE RESOURCES FROM THE REST OF THE CITY. THE SITUATION INCREASES RESPONSE TIMES AND AVAILABLE UNITS FOR ONGOING CALLS, FOR ASSISTANCE. THIS CAN CREATE LIFE THREATENING FIRE AND MEDICAL SITUATIONS ACROSS THE CITY DUE TO THE LACK OF FIRE APPARATUS AND PERSONNEL. LARGE HYDRO CARBON FIRES ARE UNIQUE INCIDENTS THAT CALL FOR SPECIFIC EQUIPMENT AND TRAINING. PORTLAND FIRE CURRENTLY HAS SOME RESOURCES, SOME RESOURCES FOR SUCH FIRES, HOWEVER, A LARGE CRUDE OIL DEREMAIN WOULD LIKELY OVERWHELM THE CURRENT CAPABILITIES. IN ADDITION TO EQUIPMENT, SUCCESSFUL CONCLUSION OF THE DERAILMENT ALSO REQUIRES SPECIFIC TRAINING. PORTLAND FIRE HAS A SMALL CADRE OF PERSONNEL TRAINED FOR THESE TYPES OF INCIDENTS. IDEALLY, ALL RESPONDERS WILL BE ON THE SCENE, SHOULD BE TRAINED. EVACUATIONS ON A SMALL OR LARGE SCALE ARE DIFFICULT. COUNTY AND CITY-WIDE NOTIFICATIONS FOR SHELTERING IN PLACE, AND-OR EVACUATION, ESSENTIAL, IS ESSENTIAL FOR A POSITIVE OUTCOME. EVACUATIONS ARE LABOR INTENSIVE, AND TIME CONSUMING. SOME INCIDENTS REQUIRE THIS TO TAKE PLACE QUICKLY, AS PREVIOUS INCIDENTS HAVE SHOWN HAVE SHOWN, THE NOTIFICATIONS ARE SPOTTY AT BEST. WHILE WE CONTINUE TO PURSUE GRANTS TO TRAIN ADDITIONAL PERSONNEL, AND OBTAIN THE NECESSARY RESOURCES NEEDED, SUCH AS PHONE UNITS WITH THE ABILITY TO BRING LARGE TOTES OF FOAM TO THE SCENE, AND SELF SUFFICIENT PUMPS TO APPLY THE FOAM, WE ARE NOT YET PREPARED IN THE MANNER THAT WE BELIEVE THAT WE SHOULD BE. IT SET UP A NEW POSITION WITH THE STATE FIRE MARSHALL'S OFFICE, WHO IS CHAD HAWKINS, AND HE'S GOING TO BE IN CHARGE OF RAIL INCIDENTS, TRAINING, ANYTHING DEALING WITH RAILROADS THROUGH THE STATE OF OREGON. HE'S IN CHARGE OF NOW. WHERE IT HELPS US THE MOST, IS THEY DELL WITH THE RAILROADS FOR THE LAST SIX MONTHS, AND THERE ARE SIX FOAM UNITS THAT ARE BEING PUT TOGETHER BETWEEN THE STATE AND THE RAILROADS. THE CITY OF PORTLAND WILL BE GETTING ONE OF THEM, AND IT'S, BASICALLY, GOING TO BE A TRAILER WITH FOUR TOTES OF FOAM. ALSO WITH THIS POSITION AND THAT HOUSE BILL THERE WILL BE SOME MORE TRAINING ON HOW TO USE THOSE TRAILERS, THROUGHOUT THE STATE. THE AMOUNT OF PRODUCT THAT TRANSPORTS ACROSS THE RAILROADS AND THIS COUNTRY, IS HUGE. BY VOLUME AND NUMBER. PROBABLY SOME OF THE MORE SIGNIFICANT THINGS THAT WE WORRY ABOUT ON HAZMAT WOULD BE OUR -- WOULD BE CHLORINE, AMMONIA, AND L&G, LIQUEFIED NATURAL GAS, AND LIQUEFIED PROPANE GAS, AND THERE IS, LIKE BRIAN WAS SAYING, THERE IS A LONG LIST OF CHEMICALS, SUBSTANCES BEING TRANSPORTED BY RAIL. AND THE OTHER COMMENT THAT I WOULD LIKE TO THROW OUT IS ON YOU KNOW, WHEN WE TALK, THE RAILROAD REPORT, THEY HAVE NUMBERS THAT THEY REPORT ON INCIDENTS THAT THEY HAVE, DERAILMENTS AND WHATNOT. AND A DERAILMENT ISN'T WHAT WE SEE ON THE NEWS OF 20 CARS LAID OVER ON THE SIDE. IT COULD JUST BE A RAIL CAR ON THE WHEELS. IT COULD BE AN INCIDENT FOR THEM, IT COULD BE A HUMAN CAUSE DIESEL RELEASE, WHICH IS ONE OF THE BIGGEST INCIDENTS WHEN THEY ARE REFUELING ONE OF THE ENGINES. THEY COULD RELEASE 100 TO 200 GALLONS WITHIN THE YARD, AND THEY HAVE CLEANUP CONTRACTORS THAT COME IN AND CLEAN IT UP. SO, I WANT TO THROW THAT OUT THERE, BUT ALSO, JUST BACK TO THE HAZMAT. THERE ARE OTHER CHEMICALS THAT WE LOOK AT THAT YOU KNOW, FOR US, WOULD BE A LARGE INCIDENT, ALSO. IF I CAN MAKE ONE OTHER POINT. I THINK THIS IS RELEVANT. I AM TRYING TO UNDERSTAND, WE HAVE TWO SUBJECT MATTERS AT ONCE, ONE IS A RESOLUTION, OPPOSING THE OIL TRAIPSE, AND THE OTHER IS A RESOLUTION TO SUPPORT THE ENVIRONMENTAL IMPACT STATEMENT DRAFTED TO GO TO VANCOUVER, SO I THINK THAT IMPACT OF THE VANCOUVER FACILITY ON OIL TRAIN TRAFFIC THROUGH PORTLAND IS A SIGNIFICANT MATTER OF FACT THAT WE NEED TO BE AWARE OF, AND WE NEED TO BE CAREFUL THAT WE'RE ACCURATE ABOUT IT. I WILL JUST SAY, WITH REGARD TO THE SORT OF THE INITIAL QUESTION, AND SORT OF THE NUMBERS, WHAT IS ULTIMATELY THAT TRIPLING MEAN TO US AS FAR AS THE NUMBERS? TO BE HONEST, WE JUST DON'T KNOW. IT'S VERY -- MY UNDERSTANDING IS THAT THEY ARE VERY EAGER, THE CITY IS EAGER TO DEVELOP THE WATERFRONTS, AND TO SEE MORE ALONG THE WATERFRONT, AND THEY ARE CONCERNED THAT THIS OIL FACILITY AT THE PORT WOULD MAKE THAT MORE -- WOULD MAKE THAT ECONOMIC DEVELOPMENT MORE DIFFICULT. I AM HERE TO EXPRESS SUPPORT FOR THE COUNTY'S REPORT TITLED OIL BY RAIL CARGO MOVEMENT IN MULTNOMAH COUNTY. OREGON AND WASHINGTON, PSR, COLLABORATED TO PRODUCE A RELATED REPORT BASED ON A REVIEW OF OVER 125 PEER REVIEWED MEDICAL JOURNALS, FOCUSING ON THE HEALTH IMPACTS OF CRUDE OIL TRANSPORT. OUR CONCLUSION, OIL TRANSPORT AND STORAGE IN OUR STATES IS AN UNACCEPTABLE THREAT TO THE HUMAN, HEALTH, AND SAFETY. I AM ALSO HERE TO EXPRESS THE SUPPORT FOR THE COUNTY'S DRAFT RESOLUTION, OPPOSING OIL BY RAIL, AND THE COUNTY'S COMMENTS ON THE DRAFT EIS FOR THE VANCOUVER ENERGY PROJECT. AND AS WE HAVE HEARD A NUMBER OF OIL TRAINED DERAILMENTS, AND EXPLOSIONS AND FIRES, THE NUMBER OF THOSE EVENTS IS ALARMING. NINE SINCE JULY OF 2013, WHEN AN OIL TRAIN EXPLOSION LEVELED BLOCKS OF QUEBEC AND 47 PEOPLE WERE KILLED. OTHER ACCIDENTS HAVE LED TO APOCALYPTIC SCENES WITH 300 FIREBALLS FLAMING TANKER CARS, FALLING INTO RIVERS AND FIRES THAT HAVE BURNED FOR UP TO TWO DAYS. THE ALARM UNDERSTANDING FREQUENCY OF THESE FAILURES SO DUE TO SEVERAL FACTORS DESCRIBED IN THE COUNTY'S BRIEFING REPORT. HERE'S ONE THAT WAS SURPRISING TO ME. TRAINS DERAIL ALL THE TIME. THERE HAVE BEEN SIX MAJOR TRAIN DERAILMENTS AROUND THE UNITED STATES, JUST SINCE CHRISTMAS. AND THAT'S THE MAJOR DERAILMENTS, LIKE THE ONE IN OGDEN, WHERE A CAR WAS DRUG THROUGH TOWN AND RIPPED UP FOUR CROSSINGS BEFORE THE TRAIN CAME TO A STOP, IN THE NORTHWEST, THE STUDY WAS DONE LOOKING AT JUNE 2011 AND 2013, AND THERE WAS, ON AVERAGE, ONE DEREMAIN EVERY 3.5 DAYS, MOST OF WHICH ARE SMALLER AND NEVER MAKE THE NEWS. TRAIN NOISE, WHICH ACTUALLY HAS MORE PROFOUND HEALTH IMPACTS THAN YOU MIGHT THINK AND DELAYS TO EMERGENCY VEHICLES. NOT NECESSARILY THE FIRST THING YOU THINK ABOUT. BUT IMAGINE YOU'RE HERE IN INNER SOUTHEAST WAITING FOR A TRAIN TO GO BY AND THEN IMAGINE THAT IT IS 100 CAR, ONE-MILE LONG UNIT OIL TRAIN AND THEN IMAGINE YOU ARE IN AN AMBULANCE WITH CRUSHING CHEST PAIN HAVING THE BIG ONE AND YOU'RE WAITING TO GET TO A HOSPITAL. GIVEN THREAT TO PUBLIC HEALTH AND WELL BEING, OIL BY RAIL PROPOSES -- BROAD COMMUNITY SUPPORT. THAT SUPPORT IS GROWING. ONE QUICK EXAMPLE, IN RECENT PUBLIC HEARINGS, VANCOUVER ENERGY PROJECT, DRAFT ENVIRONMENTAL IMPACT STATEMENT, 2,000 ATTENDEES OVER THREE

TRAINS DERAIL FOR VARIOUS REASONS. GORGE PRESENTS HIGH-RISK CHALLENGES. WE DON'T BELIEVE IT IS A MATTER OF IF, BUT A MATTER OF WHEN AND WHAT IS GOING TO BE THE RESPONSE. TOXIC, POTENTIALLY DAMAGING MATERIAL WITHIN THE TRAINS ELEVATES THE RISK TO THE ENVIRONMENT AND TO OUR COMMUNITIES, INCLUDING THIS COMMUNITY HERE. ANY TYPE OF CRUDE INTO THE RIVER WILL HAVE SIGNIFICANT LONG-TERM IMPACTS AQUATIC RESOURCES OF THE RIVER. BAKKEN CRUDE MAY EVAPORATE QUICKLY BUT IT HAS PROPERTIES THAT ARE IMMEDIATELY TOXIC TO FISH. CRUDE IS HEAVY AND WILL BE VIRTUALLY IMPOSSIBLE TO CLEAN. VANCOUVER ENERGY PROJECT, MANY MORE OIL TRAINS ON THE RAIL THROUGH THE COLUMBIA RIVER GORGE AND PROFOUND IMPACTS ON TRIBAL MEMBERS AND THEIR ACCESS TO THE RIVER. CURRENTLY THE RISK OF TRAIN STRIKES TO TRIBAL MEMBERS CROSSING THE RAILROAD IS TOO HIGH. MORE TRAINS WILL MAKE THIS ACCESS MORE TREACHEROUS. THAT IS THE SAME HERE. TRAINS GOING THROUGH THE COMMUNITY AND INCREASED TRAFFIC, OBVIOUSLY INCREASES STATISTICALLY THE LIKELIHOOD OF SOME SORT OF AN ACCIDENT. WASHINGTON STATE NOTED IN VARIOUS DOCUMENTS, BNSF RAILROAD -- NATIONAL SCENIC AREA ALONG OUR SACRED RIVER. TO US AND THAT IS COMPLETELY UNACCEPTABLE. THE FIRST RESPONDERS, YOU KNOW, RESPONSE TIME, ADDITIONAL TRAINING, WHO IS GOING TO PAY FOR THAT TRAINING, DOES YOUR COUNTY BEAR THAT BURDEN? DO CITIES? WHO BEARS THAT BURDEN. TRIBAL AND NONTRIBAL COMMUNITIES WILL BE LEFT TO LIVE WITH THE CONSEQUENCES OF THESE PROJECTS -- ALL IN THE NAME OF A COMPANY'S BOTTOM DOLLAR. THE FIRST THREATS WE LOOKED AT WAS THE RIVER AND WHAT WOULD HAPPEN WITH THIS INCREASED TRAFFIC -- OIL BARGE TRAFFIC ON THE RIVER. WE FIGURED IT IS JUST A MATTER OF TIME. NOT AN IF BUT WHEN WE HAD A SIGNIFICANT OIL SPILL ON THE RIVER AND IT WOULD SHUT DOWN THE RIVER, WHICH WOULD SHUT DOWN THE PORTS BECAUSE THERE WOULDN'T BE ANY SHIP TRAFFIC WHILE IT WAS BEING CLEANED UP. FUTURE WIND ENERGY PROJECTS AT THE PORT. WHERE THIS TERMINAL IS SLATED TO GO IN HAS ALWAYS BEEN USED FOR WIND ENERGY STORAGE, WIND MILL TOWERS, BLADES -- THIS FACILITY WOULD TAKE UP THAT SPACE. AND I QUESTION WHETHER OR NOT IF THIS FACILITY GOES IN WIND ENERGY PROJECTS WOULD TAKE A BACK SEAT TO OIL AT THAT POINT. THEN LAC-MEGANTIC, LIKE THE DOCTOR STATED, TOWN WAS LEVELLED AND 47 PEOPLE KILLED. AND TO ADDRESS YOUR QUESTION ABOUT FOAM AND WHAT WAS PASSED IN THE LEGISLATION MAYBE, NO AMOUNT OF FOAM WOULD HAVE PREVENTED 47 DEATHS. IT WAS THE INITIAL EXPLOSION THAT TOOK CARE OF THAT. 200 MEMBERS THAT WILL WORK ALONG THESE TRACKS, IT'S OUR 200 MEMBERS THAT WILL WORK IN THE GRAIN ELEVATOR THAT IS JUST YARDS FROM THE RAILROAD TRACKS, POTENTIALLY FOUR-MILE-LONG TRAINS WOULD GO BY A DAY LOADED. THEY AT THE VERY ORIGIN WERE LEADING EFFORTS WITH OTHER LEADERS AND THOUSANDS OF CITIZENS, PAST THE LANDMARK FEDERAL LEGISLATION, COLUMBIA RIVER GORGE NATIONAL SCENIC ACT IN 1986, AND I HAVE BEEN AROUND DOING THIS WORK SINCE -- ALMOST SINCE THEN. IN FACT, I WORKED FOR A GROUP THAT SUPPORTED THE ORIGINAL BILL. THIS IS THE BIGGEST THREAT WE HAVE SEEN SINCE 1986 ON THE COLUMBIA RIVER GORGE. WHAT WE ARE SEEING AN UNPRECEDENTED INCREASE IN THE AMOUNT OF OIL TRANSPORTED BY RAIL, AND VERY UNSAFE RAIL CARS, AND, UNFORTUNATELY, BECAUSE OF THE FAULT OF GEOGRAPHY, THE GORGE IS THE FUNNEL. IT'S THE EPICENTER FOR ALL OF THIS OIL. WHAT TEST -- TESORO SAVAGE IS PROPOSING 15 MILLION GALLONS OF OIL PER DAY -- THROUGH THE COLUMBIA RIVER GORGE, COMBINED WITH THE EXISTING AND -- 100 OIL TRAINS PER WEEK EACH CARRYING 3 MILLION GALLONS OF OIL THROUGH THE COLUMBIA RIVER GORGE. THIS IS A NATIONAL SCENIC AREA. IT IS NOT A NATIONAL OIL PIPELINE. WE ASK THAT YOU STEP IN, BE RELEVANT, PUT A MARKER IN AND OPPOSE THIS INCREDIBLE INCREASE IN OIL BY RAIL THROUGH OUR REGION. IT IS ESPECIALLY ALARMING BECAUSE THE OIL TRAIN DERAILMENTS AND EXPLOSIONS THAT HAVE OCCURRED OVER THE LAST 2 1/2 YEARS. TRANSPORTING OIL BY RAIL, WE BELIEVE, IS INHERENTLY UNSAFE. THERE IS A COMPARISON TO THE PINTO, WHICH I HAD THE PLEASURE OF DRIVING IN THE LATE '70S AND EARLY '80S. THIS IS MORE LIKE THE CORVAIR. REMEMBER THAT? UNSAFE AT ANY SPEED. IT IS EVEN WORSE THAN THE PINTO. YOU DON'T WANT TO DRIVE THIS. AND IN PARTICULAR, THE NEWEST CARS THAT AREN'T EVEN PRODUCED YET ARE ONLY RATED SAFE UP TO 18 MILES AN HOUR. THEY PUNCTURE AT SPEEDS AS LOW AS 18 MILES AN HOUR. THE NEW FEDERAL RULE ALLOWS THEM TO DRIVE THROUGH THE GORGE AT 50 MILES AN HOUR. THROUGH PORTLAND, WHICH IS DESIGNATED AS A HIGH HAZARD URBAN AREA, 40 MILES AN HOUR. BUT THEY'RE ONLY GOOD, EVEN THE BEST CARS THAT AREN'T PRODUCED YET ARE ONLY GOOD UP TO 18 MILES AN HOUR. YOU ARE PREVENTING A DISASTER FROM HAPPENING IN PORTLAND, IN MULTNOMAH COUNTY, IN THE COLUMBIA RIVER GORGE, BY OPPOSING THIS INCREASED IN OIL BY RAIL AND GOING ON RECORD OPPOSING THE TESORO SAVAGE TERMINAL. ALL OF THOSE EXCUSES BEING PUT FORWARD, HAVING A CONGLOMERATE OF TWO VERY COMPLEX, VERY IMPORTANT SUBJECT MATTERS IN FRONT OF US IN ONE RESOLUTION, I FIND DAUNTING. YOU KNOW, WHEREAS IN -- IN OTHER SUBJECT MATTERS THAT COME TO US, WE ARE EXTENSIVELY BRIEFED BY STAFF IN ADVANCE, BOTH PUBLICLY, PUBLIC BOARD BRIEFINGS, AND PRIVATELY IN OUR OFFICES SO THAT WE HAVE A CERTAIN GRASP OF THE ISSUE TO PREVENT US FROM EMBARRASSMENT. PROCEDURALLY, I WOULD REALLY PREFER THAT WE NOT HAVE MULTIPLE SUBJECT MATTER RESOLUTIONS PLACED IN FRONT OF US AS A BODY BECAUSE I THINK IT -- COMMISSIONER, I WILL APOLOGIZE AND TAKE RESPONSIBILITY FOR INADEQUATE BRIEFING AS A STAFF MEMBER WHO IS RESPONSIBLE FOR BRINGING FORWARD, HELPING TO BRING FORWARD THIS RESOLUTION. THE FACILITY WOULD ACCEPT OIL FROM RAIL CARS LOADED INTO TANKS AND THEN LOADED FROM THE TANKS ON TO OCEAN-GOING VESSELS FOR EXPORT TO FOREIGN MARKETS OR TRANSPORT TO DOMESTIC REFINERIES. THAT IS THE CONNECTION BETWEEN OIL BY RAIL AND VANCOUVER ENERGY PROJECT. COMMISSIONER, THANK YOU FOR YOUR REMARKS. A COUPLE OF THINGS THAT -- I WILL TRY TO SIMPLIFY A COMPLEX ISSUE AND THE RESOLUTION REALLY IS ABOUT ONE THING. IT IS ABOUT SHIPMENTS OF OIL BY RAIL AND ENDORSING THE TESORO SAVAGE VANCOUVER TERMINAL COMMENTS IN THE DEIS, WHICH IS AN OIL BY RAIL TERMINAL. THEY ARE INTRINSICALLY LINKED TOGETHER. I WAS ABLE TO MEET WITH YOUR STAFF ALONG WITH A NUMBER OF MY COLLEAGUES AS WELL, SIX WEEKS, TWO MONTHS AGO. VERY GOOD MEETING. REGARDING THE PORT OF VANCOUVER, IT'S TRUE THAT THE CITY OF VANCOUVER AND THE PORT ARE VERY MUCH IN DISAGREEMENT OVER THIS TERMINAL. BUT THE POLLING THAT HAS BEEN CONDUCTED IN THE PORT'S DISTRICT SHOWS THAT A MAJORITY OF RESIDENTS OF TAXPAYERS IN THAT PORT DISTRICT OPPOSE THE TESORO SAVAGE PROJECT. AN OPPONENT OF THE TERMINAL, VOCAL ACTIVE OPPONENT WAS ACTUALLY ELECTED TO THE PORT COMMISSION LAST NOVEMBER AS WELL. SO, I THINK THAT THE VOTERS HAVE SPOKEN IN THE PORT DISTRICT AND EXPRESSED THEIR OPPOSITION TO THE PROPOSED TESTER SAVAGE TERMINAL FOR MANY OF THE REASONS THAT YOU HAVE ALREADY HEARD TODAY. COMM. SHIPRACK: I APPRECIATE THAT. I JUST ASK YOU, MICHAEL, TO KEEP IN MIND THAT I AM NOT A CANDIDATE FOR ANY OFFICE. THIS IS AN ISSUE THAT AFFECTS OUR MEMBERS AND COMMUNITIES -- IT IS PART OF THE REASON SO MANY OF THEM ACROSS THE COUNTRY MOST LIKELY WILL COMMENT ON THE DEIS FOR THE TESORO SAVAGE PROJECT. JURISDICTION DOES NOT APPLY HERE GIVEN THERE ARE SO MANY IMPACTS THAT WILL HAPPEN FAR AND WIDE. THEY WILL ALSO WEIGH IN BASED ON THE IMPACTS TO THEIR COMMUNITIES. JUST YESTERDAY, NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION, 2015 THE HOTTEST YEAR ON RECORD. HE CAN STILL TURN THIS AROUND AND AVOID THE -- THAT WILL REQUIRE LEADERSHIP SUCH AS WE ARE FACED WITH TODAY. WE KNOW THAT MULTNOMAH COUNTY CAN BE AT THE FOREFRONT -- ASSURING THAT WE DON'T MAKE CARBON EMISSIONS WORSE. WE CAN'T STAND BY WHILE HARMFUL OIL PROJECTS ARE FACING THE REGION. THE LARGEST OIL BY RAIL FACILITY IN NORTH AMERICA AND TRANSPORTING HALF OF THE OIL THAT WOULD HAVE BEEN MOVED BY THE KEYSTONE XL PIPELINE, ICON OF CARBON EMISSIONS AND FLOOD GATES. THE WARMING TEMPERATURES CAUSED BY PROJECTS LIKE THIS AND OTHER SYMPTOMS OF CLIMATE CHANGE, SUCH AS EXTREME WEATHER AND HUMAN DISPLACEMENT ARE NOT GOING TO AFFECT ALL PEOPLE OR COMMUNITIES IN THE SAME WAY. WE KNOW THAT THE ELDERLY, CHILDREN, COMMUNITIES OF COLOR AND LOW-INCOME POPULATIONS WILL BE DISPROPORTIONATELY HARMED BY THE IMPACT OF CLIMATE CHANGE. COUNTY STAFF REPORT, DISPROPORTIONATE IMPACT HOLDS TRUE FOR CURRENT AND FUTURE OIL TRANSPORT IN OUR REGION. THESE POPULATIONS WOULD BE MORE LIKELY TO BE KILLED IN AN OIL TRAIN EXPLOSION AND WE HAVE A -- RESOLUTION REALLY STRIVES TO ADDRESS THAT TRUTH. AND IT ALSO CAN SERVE AS A MODEL FOR OTHER COUNTIES THAT SEEK TO BE RESPONSIBLE FOR THE FULL BREADTH OF THEIR CONSTITUENCIES. WE HAVE SEEN STATE AND LOCAL GOVERNMENTS ALL OVER THE COUNTRY HAVE BEEN STEPPING UP TO PROTECT THEIR COMMUNITIES TO REDUCE THEIR CARBON EMISSIONS AND MAKE INVESTMENTS IN A MORE SUSTAINABLE FUTURE. MULTNOMAH COUNTY IS ALREADY A POWERFUL EXAMPLE OF THIS AND HAS ALREADY REDUCED GLOBAL WARMING POLLUTION SIGNIFICANTLY PER CAPITA ALONGSIDE CONSIDERABLE GROWTH, SOMETHING TO REALLY BE PROUD OF. TESORO CARBON EMISSIONS WOULD BE THREE TIMES THE EMISSIONS OF MULTNOMAH COUNTY SETTING BACK THE IMPORTANT PROGRESS THAT WE HAVE MADE. TODAY'S RESOLUTION IS ALIGNED WITH OTHER SMART STEPS THE COUNTY HAS ALREADY TAKEN AND DEFENDS PREVIOUS POLICY DECISIONS THAT THE COUNTY HAS ALREADY MADE. AT THIS TIME, RAILROADS DEVELOPED CONSIDERABLE EXPERTISE IN DELIVERING THE FULL RANGE OF HAZARDOUS MATERIALS. THEY ARE REQUIRED TO MOVE AND MAINTAIN 99.99% SAFE DELIVERY RATE FOR HAZMAT. AS A RESULT OF THE RAILROAD'S AGGRESSIVE AND ONGOING SAFETY PROGRAMS, ACCIDENT RATES ON AMERICA'S RAIL LINES HAVE DECREASED BY 94% SINCE 1980. THIS IS WHERE YOUNG FAMILIES LIVE. LOW INCOME AND PEOPLE OF COLOR. IN OIL TRAINS ARE AT LEAST A MILE LONG, AND EACH ONE IS PROPELLED BY THREE OR FOUR LARGE DIESEL ENGINES EMITTING DIESEL AIR POLLUTION. THIS IS NOT JUST -- JUST CAUSES ASTHMA, BUT ITS FINE PARTICULATE MATTER CAUSES -- IS FILLED WITH BUTANE, FORMALDEHYDE AND BENZINE AND A WHOLE FAMILY OF COMPOUNDS THAT PENETRATE THE LUNGS, HEART, BRAIN, CAUSING CANCER, SERIOUS HEART DISEASE AND NEUROLOGICAL DAMAGE. BUT CONSIDER IN THE FACE OF THAT, THAT WE DO KNOW THAT BURNING FOSSIL FUELS IS A PRIMARY CAUSE OF CLIMATE CHANGE, YET AT THE SAME TIME WE KNOW THAT OIL TRAINS ARE CARRYING MILLIONS OF GALLONS OF OIL EVERY WEEK THROUGH MULTNOMAH COUNTY THAT.
