Transportation Enhancement Program

• Created by U.S. Congress in 1991• It requires each state to reserve a percentage

of its Federal Surface Transportation Program funds for Transportation Enhancement activities.

• Ensures that transportation spending supports more than just roads and bridges.

What are these funds called?

• “Transportation Enhancement” funds• IS-TEA & TEA21 refers to a Highway bill, not

this specific program.• Most recent Highway Bill is SAFETEA-LU. It

expired in September of 2009.• Currently there is not an active Highway bill.• We are currently funded by a Continuing

Resolution under the SAFETEA-LU bill.

Current Funding

• FY2010 for District 10 - $1,159,530• FY2011 for District 10 - $1,159,530

• TOTAL FUNDING for this Application Process: $ 2,319,060

Eligible Activities

• MoDOT Leadership has limited this allotment of TE funds to the construction of Bicycle and/or Pedestrian Facilities.

Eligible Activities

• Eligible Activities Include:– Sidewalks– Trails (Pedestrian, Bicycle, or Shared-Use)– Conversion of Abandoned Railway Corridors to Trails– Bike Lanes (Including Striping and Bike Safe Grates)– Pedestrian Bridges– Riverwalks– ADA improvements to existing facilities– Reconstruction of Existing Sidewalks

Ineligible Activities

• Routine Maintenance• Placques, Artwork• Awnings• Recreational Trails around a lake

T.E. Funds are REIMBURSED!

• This is not a Grant, where money will be ‘given’ to a city/county to build a project.

• The city/county will need to be able to cashflow the projects.

• Progress Invoices will be submitted as the project progresses. FHWA/MoDOT will reimburse as each progress invoice is submitted and approved.

• All TE projects will be reimbursed at a pro-rata share of 80/20. 80% Reimbursed; 20% Local Match!

Pro-Rata Share – 80/20

• Please Take Note: This is NOT 100% funding!• This program is being reimbursed at an 80/20

ratio.• There is a required local match of 20%

Project Funding Limits

• Minimum Project Size for Southeast District is $100,000 in federal funds. At an 80/20 pro-rata share, this would be a minimum total project size of $125,000.

• Maximum Project Size for Southeast District is $400,000 in federal funds. At an 80/20 pro-rata share, this would be a maximum total project size of $500,000.

Timeline

• Application Deadline: C.O.B. Oct. 29th, 2010• Award Goal: November 12th, 2010• Final PS&E Submittal Deadline: Nov. 1st, 2011• Projects must be under construction in or

before May of 2012.

Design/Inspection

• All projects MUST be designed and inspected by a Missouri Professional Engineer. It can either be a staff engineer, or can be a contracted consulting engineer.

Using a Consulting Engineer

• FHWA does not allow the use of a consultant that serves as a ‘city engineer’.

• Each project MUST go through MoDOT approved RFQ process. RFQ must be posted on MoDOT’s website for 14 days. Consultant must be selected based on qualifications, not costs.

• City/County & Consultant must sign MoDOT approved Engineering Services Contract

• Do NOT start RFQ process until being notified of award by MoDOT

Design Guidelines

• Project must adhere to published guidelines:– ADA Accessibility Guidelines– MoDOT General Pedestrian & Bicycle Guide– Guide for the Development of Bicycle Facilities, by

AASHTO– Guide Specifications for the Design of Pedestrian

Bridges, by AASHTO– District 10 “Helpful Hints”– EOR must reference their design specifications

Property & Maintenance

• Project MUST be constructed on property that is owned/leased by the project sponsor.

• Any property that needs to be acquired MUST follow federal guidelines!

• 25 Year Maintenance Plan must be part of consideration.

State & Federal Regulations

• These projects will be funded with Transportation Enhancement which originate with FHWA, so these projects must comply with state AND federal regulations and policies.

• Failure to follow the rules may jeopardize funding!

Americans with Disabilities Act

• All pedestrian facilities must be designed and built in accordance with the Americans with Disabilities Act Accessibility Guidelines (ADAAG).

• Any items that are constructed that are not ADA-compliant will be replaced or will not be reimbursed.

National Environmental Policy Act (NEPA)

• All Transportation Enhancement projects must be evaluated for a level of documentation with the National Environmental Policy Act.

• Projects will be assigned a level of documentation:– Environmental Impact Statement (EIS)– Environmental Assessment (EA)– Categorical Exclusion (CE)

• Projects may require public meeting(s)

Federal & StateEnvironmental Clearances

• Projects must comply with all APPLICABLE environmental clearances:– 106 – State Historic Preservation Office (SHPO)– MO Dept of Conservation – Endangered Species– Flood Plain Development Permits– 4F Determination– COE Permit – Crossing Waterway

Local Matching Funds

• Private Funds• In-Kind Labor *• Donations – Labor and/or Materials *• Other Eligible State/Federal Funding

* Valued at 80% - Please consult MoDOT personnel regarding these items.

In-Kind Work Example

• Total Project Cost = $250,000– 80% Federal = $200,000– 20% Match Required = $50,000

• In-Kind Work To Be Used As Match– Required Amount = $62,500– 80% of $62,500 = $50,000 = Required Match

Local Matching Funds

• State Funding– Any state funds are eligible with FHWA– Check with State Agency to determine– Examples: CDBG

• Federal Funding– Some Non-USDOT funding sources MAY be eligible

to match– Check with Federal Agency to determine– Examples: USDA (RD), DRA, USFS, COE, NPS

TE Funds - Matching

• TE Funds cannot be used for a match on another federal agency’s funds unless specifically authorized by federal law.

Application Process

• MoDOT is hereby soliciting for project applications

• Applications must be submitted on or before 4:00 pm on Friday, October 29th, 2010.

• Applications will be reviewed and prioritized by the selection committee.

• MoDOT Staff will notify the applicants of the committee’s decisions.

• You will leave with a blank application today.• A word document of the application will be

available later today on MoDOT’s website for the Southeast District at: http://www.modot.mo.gov/southeast/

Application Instructions

• Submit 7 Copies of the application to the Southeast District (Attn: Jo Secoy)

• Include Photos of the Project Area• Staple Applications in upper left-hand corner;

no covers, binders, tabs or other devices.• Deliver in person or mail to:

Application Deadline

• Applications must be in our possession no later than 4:00 pm (CST) on Friday, October 29th, 2010

• Applications received after this time will not be considered.

Application Tips

• Have someone review the completed application to check for grammar, typographical or mathematical errors.

• Be creative• Have a realistic completion plan• Plan for cost increases and inflation• Plan for long-term maintenance• Provide photos of the proposed project location

Application Instructions

• Include ALL Potential Costs – Plan Carefully! • It’s better to have too much than not enough.

You will not be able to ask for more later.• Include ADEQUATE costs for design and

construction inspection and prevailing wages!• Any Costs above the federal fund award

amount will be the sole responsibility of the project sponsor!

Application Review

• Page One – General Information– Take note of notes at top of page– Fill out everything accordingly– Make sure to put contact person and phone #

• Page Two & Three – Project Description– Take 1-2 Pages to Describe the Project in Detail– Include what the project will connect, how it

serves the community, and how it addresses any pedestrian safety issues.

Application Review

• Page Four – Project Budget– Complete the budget as outlined– Include all potential costs including engineering,

right of way, utility relocation, etc.– Confirm your local match. If In-kind work is to be

used, make sure that an adequate amount is planned.

– Account for adequate engineering costs, and prevailing wages.

Application & Selection Process

• Application Deadline – October 29th, 2010• Selection Committee will meet in early

November to make selections• Awards will be announced on or before

November 19th, 2010• Project Agreements will be sent to sponsors of

awarded projects in late November for agreement execution.

Key Items to Review• Only submit applications for eligible projects.• Projects must be able to move quickly. Final

Design and any R/W acquisition must be complete by November 1st, 2011.
