HazardousmaterialsareanysubstancesdefinedbytheSecretaryofTransportationasposinganunrea-sonablerisktohealthandsafetyorproperty.Mostpeople recognize gasoline, propane, or dynamite as beinghazardousmaterials,butdidyouknowthatcommon materials such as paint, nail polish remover, adhesives, cleaning compounds, hair spray, matches, andothersmaybeclassifiedashazardousmaterials?It is important to know if you are transporting haz-ardousmaterialsbecauseviolationsoftheHazardousMaterialsRegulations(HMR)carrycivilfinesofupto$32,500andpossiblecriminalpenaltiesincludinguptofiveyearsinjail.Hazardousmaterialsfallintooneofthefollowingbasicclassesanddivisions:

To determine if a material you are transporting is haz-ardous, contact the shipper who provided the material orseethedefinitionsofthesematerialsinthehazard-ous materials regulations.

What do I need to do if I transport Haz-ardous Materials?

A motor carrier that transports a hazardous material, whether interstate or intrastate, must comply with the FederalHazardousMaterialsRegulations,49CFR100-180. These regulations include requirements including registration, training, shipping papers, labels,placards,andpackages.Inaddition,thereareadditionalrequirementsintheFederalMotorCarrierSafetyRegulations,whichincludeinsurancerequire-ments, operational restrictions, commercial driver’s li-cense endorsements, routing, parking, and attendance requirements for hazardous materials.

IntroductionThe purpose of this training is to ensure that each hazmat employer trains its hazmat employees regarding safe loading, unloading, handling, storing and transporting of hazardous materials and emer-gency preparedness for responding to accidents or incidents involving the transportation of hazardous materials.

DefinitionsHazmat Employer:

A. A person who employs or uses at least one hazmat employee on a full-time, part-time, or temporarybasis;B. Apersonwhoisself-employed(includingan owner-operator of a motor vehicle, vessel, or aircraft)transportingmaterialsincommerce;C. Adepartment,agency,orinstrumentalityof theUnitedStatesGovernment,oranauthor- ityofaState,politicalsubdivisionofaState,or anIndiantribe;andwho:n Transportshazardousmaterialsincommerce;n Causeshazardousmaterialtobetransportedor shippedincommerce;orn Designs,manufactures,fabricates,inspects, marks, maintains, reconditions, repairs or tests a package, container, or packaging compo- nentthatisrepresented,marked,certified,or soldbythatpersonasqualifiedforuseintrans- portinghazardousmaterialsincommerce;n Representing, marking, certifying, selling, of- fering, reconditioning, testing, repairing, or modifying containers, drums, or packagings as qualifiedforuseinthetransportationofhazard- ous materials.

Hazmat Employee:

A. A person employed on a full-time, part-time, ortemporarybasisbyahazmatemployerand in the course of such employment directly af- fects hazardous materials transportation safety. B. Self-employed(includinganowner-operator ofamotorvehicle,vessel,oraircraft)transport- ing hazardous materials in commerce and in

the course of such self-employment directly affects hazardous materials transportation safety.C. Arailroadsignalman;orD. Arailroadmaintenance-of-wayemployeewho:n Loads,unloads,orhandleshazardousmaterials;n Designs,manufactures,fabricates,inspects, marks, maintains, reconditions, repairs or tests a package, container, or packaging component that isrepresented,marked,certified,orsoldas qualifiedforuseintransportinghazardousmate- rialincommerce;n Prepareshazardousmaterialsfortransportation;n Isresponsibleforsafetyoftransportinghazardous materials;n Operatesavehicleusedtotransporthazardous materials.

Examples of who will be required to be trained are: n A person determining if a material is a hazardous material;n A person who designs, produces and/or sells a packagingforhazardousmaterials;n A person determining proper packaging for a haz- ardousmaterial;n A person who puts the hazardous material in the package;n Apersonwhomarksandlabelsthepackage;n Apersonwhofillsoutshippingpapers;n A person who loads or unloads hazardous materi- als;n A person who moves the packaging in a ware- houseduringthecourseoftransportation;n A person who operates a vehicle transporting the material;n Arailroadsignalman;orn A railroad maintenance-of-way employee.

Trainingforahazmatemployeemustbecompletedwithin90daysafteremployment.Eachhazmatemployee must again receive the required training at least once every three years.

Training Requirements

Four/*FiveCategoriesoftrainingforhighwaymode:

n General Awareness/Familiarization Training Eachhazmatemployeeshallbeprovidedgeneral awareness/familiarization training designed to provide familiarity with the requirements of this subchapter,andtoenabletheemployeetorecog- nize and identify hazardous materials consistent with the hazard communication standards of this subchapter.n Function Specific Training Eachhazmatemployeeshallbeprovidedfunction- specifictrainingconcerningrequirementsofthis subchapter,orexemptionsissuedundersubchapter Aofthischapter,whicharespecificallyapplicable to the functions the employee performs.n Safety Training Eachhazmatemployeeshallreceivesafetytraining concerning- (i)Emergencyresponseinformationrequiredby subpartGofPart172; (ii)Measurestoprotecttheemployeefromthe hazards associated with hazardous materials to whichtheymaybeexposedintheworkplace, includingspecificmeasuresthehazmatemployer has implemented to protect employees from expo- sure;and (iii)Methodsandproceduresforavoidingac- cidents, such as the proper procedures for handling packages containing hazardous materials. n Security Awareness Training Eachhazmatemployeemustreceivetrainingthat provides an awareness of security risks associated with hazardous materials transportation and meth- ods designed to enhance transportation security. This training must also include a component cover- inghowtorecognizeandrespondtopossiblesecu-

New hazmat employees must receive thesecurityawarenesstrainingrequiredbythis paragraphwithin90daysafteremployment.n *In-Depth Security Training(Onlywhenre- quiredtohaveaSecurityPlan,see172.800) Eachhazmatemployeeofapersonrequiredto haveasecurityplaninaccordancewithsubpart Iofthispartmustbetrainedconcerningthesecuri- typlananditsimplementation.Securitytraining mustincludecompanysecurityobjectives,respon- sibilities,actionstotakeintheeventofasecurity breach,andtheorganizationalsecuritystructure.

Eachpersonwhooffersfortransportationincom-merce or transports in commerce one or more of the following hazardous materials must develop and adhere to a security plan for hazardous materials that conformstotherequirementsofthissubpart:

Security Plan Requirements Start-ing 04/08/10ListedbelowbyClass/Divisionarethehazardousmaterialsandthresholdssubjecttosecurityplanningunderthisfinalrule.Thephrase‘‘largebulkquan-tity,’’asusedinthefollowingtable,referstoaquan-titygreaterthan6,614poundsforsolidsor792gallonsfor liquids and gases in a single packaging such as a cargotankmotorvehicle,portabletank,tankcar,orotherbulkcontainer.

Therefore,inthisfinalruleshippersandcarriersofoxygenandotherDivision2.2compressedgaseswithasubsidiaryhazardofDivision5.1oxidizer,inquantitiesgreaterthan793gallonsinasinglepackage

or container, are required to develop and implement securityplans.AlistofDivision2.2oxidizinggasesthatareauthorizedfortransportationinlargebulkquantitiesisprovidedbelow.

Components of a Security Plan: 172.802Everymotorcarriershouldevaluatethelevelofsecu-rity and safety within their own system, including at a minimumthefollowing:

Personnel Security

n Understand any employee could pose a security risk. n Implementamethodforsecurityidentification(i.e. IDBadges).Identificationshouldincludethe employee name, the company name, the employee’spicture,andaphonenumberwherethe employee’sidentificationcanbeconfirmed.n Review the list of drivers and request the required numberofdriverqualificationfilesforreview.n Complywiththeinvestigationandinquiryrequire mentsof49CFRSection391.23.Discusswiththe companyofficialanyadditionalchecksmade,such ascriminalbackgroundchecks,personalreference checks, credit checks, etc. n Whenreviewingthecontentsofdriverqualification files,payparticularattentionto:s Gaps in employment s Frequentjobshiftss Allnamesusedbytheapplicants Type of military discharge s Citizenships Present and prior residence information s Personal references s Criminalhistoryn ComplywiththeImmigrationReformandCon trolActof1986.AllI-9formsmustbeproperly completed and maintained for all employees.

n Use face-to-face interviews of prospective employ ees,toobtaininformationtohelptoappraisethe applicants’ personality, character, motivation, hon esty,integrity,andreliability.n Any information or suspicious activity discovered duringthereviewofthesefilesshouldbereported immediatelytoyourstate’sHomelandSecurityorthestateorlocalDepartmentofTransportationofficeforpossiblereferraltoalocalFBIoffice.

Hazardous Materials and Package Controls

Securityenhancementsthatmightbeconsidered:n Arethefacilitygroundsadequatelylighted?n Arehazardousmaterialslocatedinasecurearea?n Aretransportvehicleslocatedinasecurearea?n Is the access to hazardous materials limited and/or monitored(sign-in/signout)?n Considerrequiringemployeeidentificationcards/ badges.n Considerotherprotectivemeasures,suchas,secu- rity alarms, video surveillance, security services, etc.n Considerifaguardforceisappropriate(DOD Shipments,PIH,RAM,other).n Require records for removal of HM from secure locations. n Reinforce, with employees, the importance to remain aware of their surroundings at all times. n Recommend standard procedures for control of HM packages, educating all employees on package control measures. Post procedures prominently at appropriate locations. n Knowwhoyouaredealingwith,includingship- pers, receivers and vendors that service your facil- ity. n Limitandtrackkeys/entrycards,payingspecial attention to those issued to employees that are no longer with the company.

En Route Security

n Avoid high population centers, including down town and/or metropolitan areas, tunnels and bridgeswherepossible(see49CFR397.67).n Ensurethatallhazardousmaterialsaredelivered expeditiously.

n Instruct drivers to lock vehicles when in transit or unattended. n Reinforceattendanceandparkingrulesin49CFR Part397.n Driversmustbeawareofvehiclesthatmaybefol- lowing their truck and strangers asking inappropri- ate questions.n Besuspiciousofindividualsaskingyoutostopasa resultofanallegedtrafficaccident.Ifunsure whether the accident occurred, drive to a police stationortoawell-litbusylocationbeforestop- ping.n Becautiousaboutstoppingtohelpstrandedmotor- istsorataccidentscenes.Ifpossible,calltheState Police instead.n Donotpickuphitchhikers.n Donotdiscussthenatureofthecargoatcoffee shops,trucks,overtheCBradio,etc.n Driversmustremainawareoftheirsurroundingsat all times.n Driversshouldhaveameanstomaintaincom- munication with the company, such as, cell phones, 2-wayradios,CBs,satellitecommunicationsys- tems, etc.

n Make yourself aware of technical innovations that could assist in security such as cell phones, satellite tracking, and surveillance systems. n Lookatstateoftheartlocksandseals.n Areaccesscontrolsystemsappropriate?n Considertamperprooflockingfeaturesforfifth wheels(sothattrailerscan’tbestolen).n Considerinstallingelectronicenginecontrols that require a code, in addition to a key, to start a vehicle. n Considertheftpreventiondevices,steeringlocks, fuel cut-off switches, electrical cut-off switches, and other high security ignition devices.

Readjustment Based Upon Current Conditions

1. Definitions

A. ShippingPaper-(49CFR171)Ashippingpaper isashippingorder,billoflading,manifest,or other shipping document serving a similar purpose andcontainingtheinformationrequiredby49 CFR182.201,172.202and172.204.

B. Theterms“dangerousgoods”and“hazardous materials”areconsideredsynonymous.

Shipper’s Responsibility (49CFR172.200(a))

The person offering a hazardous material for transport hastheresponsibilitytoproperlypreparetheshippingpaper.(Seealso173.22)

A.Contents-Whendescribingahazardousmaterial on a shipping paper, that description must conform tothefollowingrequirements:

1) Whenahazardousmaterialandothermateri- alsarebothdescribedonthesameshipping paper, the hazardous material description en- tries: a)Mustbeenteredfirst,or b)Mustbeenteredinacontrastingcolor(or highlighted in a contrasting color - for repro- ducedcopiesoftheshippingpaperonly),or c)Mustbeidentifiedbytheentry“X”placed beforethepropershippingnameinacolumn captioned“HM”.The“X”maybereplaced by“RQ”(ReportableQuantity),ifappropri- ate. 2) Therequiredshippingdescriptionontheorigi- nalshippingpaperandallcopiesmustbeleg- ibleandprinted(manuallyormechanically)in English. 3) Therequireddescriptionmaynotcontainany codeofabbreviation,unlessitisspecifically

Hazardous Materials Description (49CFR172.202) The shipping description of a hazardous material on a shippingpapermustincludethefollowing:

A. Theidentificationnumberforthematerial(pre- cededby“UN”or“NA”,asappropriate49CFR 172.202(a)(3)).B. A. Emergency Response Information Requirements(172.201(D),SubpartG,172.600)

A. Emergencyresponseinformation(172.602) 1) “Emergencyresponseinformation”means informationthatcanbeusedinthemitigation of an incident involving hazardous materials and, as a minimum, must contain the following information: a) Thebasicdescriptionandtechnicalnameof thehazardousmaterial; b) Immediatehazardstohealth; c) Riskoffireorexplosion; d) immediateprecautionstobetakeninthe eventofanaccidentorincident; e) Immediatemethodsforhandlingfires; f) Initialmethodsforhandlingspillsorleaks intheabsenceoffire;and

g) Preliminaryfirstaidmeasures. 2) Formofinformation.Theemergencyresponse informationmustbe: a) PrintedlegiblyinEnglish; b) Availableforuseawayfrompackagecon- tainingthehazardousmaterial;and c) Presentedwithorontheshippingpaper. 3) Maintenanceofinformation-Emergencyre- sponseinformationshallbemaintainedasfol- lows: a) Carriers-Eachcarrierwhotransportsa hazardous material shall maintain the emergency response information in the samemannerasprescribedforshipping papers. b) Facilityoperators-Eachoperatorofa facility where a hazardous material is re- ceived, stored or handled during transpor- tation, shall maintain the emergency re- sponse information whenever the haz- ardous material is present, and the in- formationmustbeaccessibletofacility personnel in the event of an incident in- volving the hazardous materials.

B. Emergencyresponsetelephonenumber(172.604) 1) Apersonwhooffersahazardousmaterialfor transportation must provide a 24-hour emer- gencyresponsetelephonenumber,includ - ing the area code, for use in the event of an emergency involving the hazardous materials. Thetelephonenumbermustbe: a) Monitoredatalltimesthehazardousmate- rial is in transportation, including storage incidentaltotransportation; b) Thenumberofapersonwhoiseither knowledgeableofthehazardsandcharac- teristicsofthehazardousmaterialbeing shipped and has comprehensive emergency response and incident mitigation informat- ion for that material, or has immediate ac- cess to a person who possesses such knowl- edgeandinformation;and c) Enteredonashippingpaper,asfollows: i. 173.6 Materials of Trade Exceptions

Whentransportedbymotorvehicleinconformancewiththissection,amaterialsoftradeisnotsubjecttoanyotherrequirementsofthissubchapterbesidesthose set forth or referenced in this section.

(A) Materials and Amounts

Amaterialsoftradeislimitedtothefollowing:(1)AClass3,8,9,Division4.1,5.1,5.2,6.1,orORM- Dmaterialcontainedinapackaginghavinga grossmassorcapacitynotover— (i) 0.5kg(1pound)or0.5L(1pint)foraPack- ingGroupImaterial; (ii) 30kg(66pounds)or30L(8gallons)fora Packing Group II, Packing Group III, or ORMDmaterial; (iii) 1500L(400gallons)foradilutedmixture, not to exceed 2 percent concentration, of a Class9material.(2)ADivision2.1or2.2materialinacylinderwith agrossweightnotover100kg(220pounds),or a permanently mounted tank manufactured to ASMEstandardsofnotmorethan70gallonwater capacityforanon-liquefiedDivision2.2material withnosubsidiaryhazard.(3)ADivision4.3materialinPackingGroupIIorIII contained in a packaging having a gross capacity notexceeding30ml(1ounce).(4)Thissectiondoesnotapplytoahazardousmate- rialthatisself-reactive(see173.124),poisonousby inhalation(see173.133),orahazardouswaste.

(D) Aggregate Gross Weight

Exceptforamaterialsoftradeauthorizedbypara-graph(a)(1)(iii)ofthissection,theaggregategrossweight of all materials of trade on a motor vehicle may notexceed200kg(440pounds).

(E) Other Exceptions

Amaterialsoftrademaybetransportedonamotorvehicle under the provisions of this section with other hazardousmaterialswithoutaffectingitseligibilityforexceptionsprovidedbythissection.

TheHMSafetyPermittingProgramrequirescarriersofcertainhazardousmaterialstoholdanHMSafetyPermitissuedbytheFederalMotorCarrierSafetyAdministration. Federal hazardous material trans-portationlaw,49U.S.C.5101etseq.,wasenacted“toprovide adequate protection against the risks to life and property inherent in the transportation of hazard-ousmaterialincommerce...”.

What Hazardous Materials Require An HM Safety Permit? The following hazardous materials carried in these quantityamountswillrequireanHMSafetyPermit:1. RadioactiveMaterials:Ahighwayroute-controlled quantityofClass7material,asdefinedin173.403 of49CFR.2.Explosives:Morethan25kg(55pounds)ofaDivi- sion1.1,1.2or1.3material,oranamountofaDivi- sion1.5materialrequiringaplacardunderPart172 SubpartFof49CFR.3.ToxicbyInhalationMaterials: HazardZoneA:Morethatoneliter(1.08quarts)

Do The Permitting Requirements Apply To Mate-rials That Have Subsidiary Hazards That Fall In The Materials List, Even If Their Primary Hazard Does Not? Example: A Flammable Liquid, Class 3, Has A Subsidiary Poison Inhalation Hazard. Materialspoisonousbyinhalationthatmeetthedefini-tionsin171.8,173.116(a)and173.133(a)willrequireapermit regardless of other hazards the materials may exhibit.Materialswillgenerallynothaveasubsid-iary radioactive or explosive hazard as these hazards wouldbeconsideredtheprimaryhazard.Liquefiedgasesmusthaveatleast85%methanecontenttorequireapermit,ormeetthedefinitionsofmaterialstoxicbyinhalation,explosiveorradioactive.

Are Shipments Of LPG Covered Under The HM Safety Permit Program? No.Onlyshipmentsofflammablegascontainingatleast85%methanecontentarecoveredbytheHMSafetyPermitprogram.

Is Anhydrous Ammonia Covered Under The HM Safety Permit Program? Yes.Eventhoughanhydrousammoniaisregulateddomesticallyasanon-flammablegas,anhydrousam-moniastillmeetsthedefinitionofatoxicbyinhala-tionmaterialHazardZoneDandiscoveredwhentransported in a packaging having a capacity greater than13,248L(3,500gallons).WhenDoINeedToHaveMyHMSafetyPermit?MotorcarrierswillberequiredtoapplyfortheHMSafetyPermit,oraTemporaryHMSafetyPermit,thenexttimetheyrenewtheirbiennialupdate(fil-ingtheMCS-150).Foramotorcarrier,suchasanintrastatecarrier,thathasnotfiledaMCS-150form,theymustholdtheHMSafetyPermitoraTemporaryHMSafetyPermitinordertotransportthepermittedhazardousmaterials(HM).
