Singapur tributa un arancel preferencial de importación del 10,9% - Purés, Salsas y Extractos de tomate: se clasifican en la posición arancelaria 2002.90.80 del Nomenclador de Importaciones de Estados Unidos (HTSUS) que corresponde a las demás preparaciones de tomates distintas de los tomates enteros o en trozos preparados o conservado, excepto en vinagre o en ácido acético y tomate en polvo y tiene un arancel de importación de 11,6 %. Cabe destacar que los países de menor desarrollo, Canadá, los países miembros del AGOA (Acta de Crecimiento y Oportunidad Africano) y los países de la Cuenca del Caribe, Pacto Andino, Israel, Jordania y México están exceptuados del pago de derecho de importación, ya que tienen tratamiento preferencial. DESCRIPCIÓN DEL MERCADO La industria del tomate en Estados Unidos es una de las más grandes del mundo. La gran cantidad de tomates crudos para procesar junto con un eficiente, altamente automatizado y rentable sector (tomate procesado), permite que la industria de los EE.UU. sea competitiva con las de otros países, por lo menos para las ventas en el mercado interno. Estados Unidos es también un importante importador de tomate procesados de países que utilizan tecnologías competitivas. El sector de tomate procesado en Estados Unidos cuenta con 50 empresas envasadoras, la mayoría localizada en California. Muchas de estas empresas están transformando tomates crudos en productos semielaborados (a granel o pasta concentrada de tomate), mientras que otras están transformando la pasta concentrada y otros productos a granel en productos finales (tomates enlatados y salsa).

Cabe destacar que los países de menor desarrollo, Canadá, los países miembros del AGOA (Acta de Crecimiento y Oportunidad Africano) y los países de la Cuenca del Caribe, Pacto Andino, Israel, Jordania y México están exceptuados del pago de derecho de importación, ya que tienen tratamiento preferencial. El arancel de importación de la posición arancelaria 2002.10.00 (12,5%) será reducido gradualmente hasta llegar a cero en 12 años después de la implementación del acuerdo de libre comercio de EE.UU. con Chile (U.S.- Chile Free Trade Agreement). DESCRIPCIÓN DEL MERCADO

La industria del tomate en Estados Unidos es una de las más grandes del mundo. La gran cantidad de tomates crudos para procesar junto con un eficiente, altamente automatizado y rentable sector (tomate procesado), permite que la industria de los EE.UU. sea competitiva con las de otros países, por lo menos para las ventas en el mercado interno. Estados Unidos es también un importante importador de tomate procesados de países que utilizan tecnologías competitivas. El sector de tomate procesado en Estados Unidos cuenta con 50 empresas envasadoras, la mayoría localizada en California. Muchas de estas empresas están transformando tomates crudos en productos semielaborados (a granel o pasta concentrada de tomate), mientras que otras están transformando la pasta concentrada y otros productos a granel en productos finales (tomates enlatados y salsa).

Aunque Estados Unidos es uno de los productores más grandes del mundo de productos procesados de tomate, las exportaciones de tales productos son significativas pero representan una pequeña proporción del total producido en Estados Unidos. Las exportaciones de estos productos están principalmente destinadas a Canadá, Japón, y México.

La Nueva Etiqueta de los Alimentos Los pasillos de los supermercados se han convertido en vías a los mejores conocimientos sobre nutrición. La nueva etiqueta de los alimentos lo hace posible: como resultado de las nuevas regulaciones bajo la Administración de Drogas y Alimentos del Departamento de Salud y Servicios Humanos y del Servicio de Inspección y Seguridad del Departamento de Agricultura de los Estados Unidos, la etiqueta de los alimentos ofrece ahora información más completa, útil y precisa sobre nutrición que antes. El objetivo de la reforma de la etiqueta de los alimentos es simple: despejar la confusión que ha prevalecido en los estantes de los supermercados durante muchos años, ayudar a los consumidores a escoger dietas más saludables y extender a las compañías elaboradoras de productos alimenticios, un incentivo para el mejoramiento de las cualidades nutritivas de sus productos. Entre las modificaciones claves figuran:

• etiquetas sobre el valor nutritivo de casi todos los alimentos. Los consumidores pueden informarse ahora acerca de las cualidades alimenticias de casi todos los productos que compran.

• un nuevo, característico formato fácil de leer que habilita a los consumidores a encontrar rápidamente la etiqueta con la información necesaria para escoger los alimentos más saludables.

• información concerniente a la cantidad por porción de grasa saturada, colesterol, fibra dietética y otros nutrientes, que hoy son causa de mayor preocupación para la salud de los consumidores.

• referencia de valores de nutrición exactos, como porcentajes % de Valores Diarios que ayudan a los consumidores a comprender cómo un alimento puede encajar en una dieta común.

• definiciones uniformes para los términos que describen el contenido nutritivo de un alimento--"ligero," "bajo en grasa", "alto en fibra"--para asegurarse que tales términos siempre significan lo mismo en cualquier producto en donde aparezcan. Estas descripciones son particularmente útiles para aquellos consumidores tratando de moderar y controlar el consumo de sus calorías o de la grasa, o para los que tratan de aumentar ciertos nutrientes como la fibra.

• afirmaciones acerca del vínculo entre un nutriente o alimento y una enfermedad, como en el caso del calcio y la osteoporosis, o el cáncer y la grasa. Estas son de gran ayuda para las personas interesadas en el consumo de alimentos que quizás puedan ayudar a mantenerlas saludables por más tiempo.

• uniformidad de las porciones de los alimentos, con el fin de poder hacer comparaciones alimenticias más fáciles de productos similares .

• declaración del porcentaje total de un jugo en bebidas derivadas de este. Esto le indicará a los consumidores la cantidad exacta del jugo que hay en el producto.

• información voluntaria sobre la cantidad de nutrientes de muchos alimentos crudos.

NLEA Estos y otros cambios son parte de las reglas finales publicadas en el Federal Register Registro Federal en 1992 y 1993. Las reglas de la FDA, ponen en ejecución las

disposiciones del Acto de Educación, Nutrición y Etiquetado de 1990 (NLEA), el cual, entre otras cosas, exige la rotulación de la mayoría de los alimentos (excepto carnes de res y de aves) y autoriza el uso de contenido de nutrientes y se subscribe a los reclamos de salud aprobados por la FDA. Carnes de res y de aves, son productos regulados por el USDA y no están cubiertos por NLEA. Sin embargo, las regulaciones de la USDA, corren paralelas con las de la FDA, anotadas aquí. Etiquetas de Nutrición-Alimentos Apropiados Las recientes regulaciones, la mayoría de las cuales entraron en vigencia en 1994, requieren etiquetas de nutrición en casi todos los alimentos. Además, establecen programas voluntarios de información sobre muchos alimentos crudos: los 20 vegetales, frutas y pescado crudos que se consumen con más frecuencia, bajo el programa sobre información voluntaria en el momento de la compra de la FDA, y los 45 cortes de carne que tienen mejor aceptación y se venden más según el programa de la USDA. Aunque voluntarios, el programas de la FDA de productos crudos y pescado, lleva un fuerte incentivo para la participación de los comerciantes menores. El programa permanecerá voluntario, si por lo menos el 60 por ciento de los comerciantes al por menor continúa suministrando la información necesaria. (En un encuesta en 1994, la FDA encontró que más del 70 por ciento de las tiendas de alimentos y mercados estaban de acuerdo). Información sobre nutrición de algunos alimentos de los restaurantes también será provista. Las regulaciones actuales requieren información de alimentos sobre los cuales afirmaciones de salud o contenido de nutrientes aparecen en avisos y placas en los restaurantes. En Junio de 1993, la FDA propuso requisitos similares para los menús de los restaurantes con tales afirmaciones. Bajo dicha propuesta, los restaurantes tendrían que proveer una "base razonable" para sustentarlas. A la vez, alguna flexibilidad les sería extendida para demostrar una base razonable. Por ejemplo, podrían depender de recetas de cocina reconocidas por grupos médicos o dietéticos. Bajo la NLEA, algunos alimentos están exentos de llevar etiquetas de nutrición. Estos incluyen:

• alimentos servidos para el consumo inmediato, como en las cafeterías de los hospitales, aviones, vendedores ambulantes, mostradores de golosinas en centros comerciales y máquinas de vender comida

• alimentos listos para comer que no son consumidos inmediatamente, pero preparados en el lugar--por ejemplo, bizcochos, fiambres, y dulces

• alimentos despachados en masa mientras no sean vendidos en esa forma a los consumidores

• alimentos médicos como los usados para atender las necesidades nutritivas de pacientes con ciertas enfermedades

• simple café y té, algunas especias, y otros alimentos que no contienen cantidades significativas de elementos nutritivos.

Alimentos producidos por negocios pequeños también están exentos, según enmiendas de la NLEA en 1993. Las enmiendas estipulan un sistema en el cual exenciones se basadas en el número de personas que una compañía emplea y la cantidad de unidades dentro de una misma línea que produce al año.

Bajo este sistema, las indulgencias por cada factor son rebajadas gradualmente. Actualmente, únicamente negocios con un equivalente menor de 100 empleados de tiempo completo, produciendo menos de 100,000 unidades de un producto de una misma línea para distribución en los Estados Unidos, puede ser aprobado para una exención. Casi todas las compañías en busca de una exención tendrán que notificar a la FDA que cumplen con esa norma. Aquellas que no tienen que notificar a la FDA son las firmas de los Estados Unidos con menos de 10 empleados, produciendo menos de 10,000 unidades de un alimento por año. Aunque esos alimentos están exentos, son libres de llevar información de nutrición cuando sea apropiado-- mientras cumplan con las las nuevas regulaciones. A la vez, perderán sus exenciones si sus etiquetas muestran el contenido de un nutriente, una afirmación de salud u otra información de nutrición. Información sobre el valor nutritivo de carnes de animales de cacería--venado, bisonte, conejo, codorniz, pavo salvaje, y avestruz--no se exige en paquetes individuales. En cambio, se puede dar en tarjetas de mostradores, señales, avisos, hojas volantes y otros materiales similares en el lugar de la venta. Debido a la escasa información de nutrición que existe sobre este tipo de alimentos, al FDA ha concluido que conceder esta opción a los elaboradores de carnes de caza, les permitirá dar máxima prioridad a reunir información apropiada y se les será más fácil mantenerla al día según nueva información nutritiva vaya apareciendo. Título de la Tabla de Nutrición La nueva etiqueta de los alimentos presenta una tabla de nutrición renovada. Ahora tiene un nuevo título, "Datos de Nutrición" el cual reemplaza el antiguo "Información de Nutrición por Porción." El nuevo título indica que los productos han sido clasificados de acuerdo con las nuevas regulaciones. También y por primera vez, se han establecido condiciones en el estilo de tipo de letras, tamaño, espacios entre las letras y contraste, para asegurar una etiqueta distintiva, clara y fácil de leer. Tamaño de las Porciones El tamaño de la porción continúa siendo la base para reportar el contenido nutritivo de cada alimento. Sin embargo, diferente al pasado cuando el tamaño de una porción era establecido a la discreción del manufacturero del alimento, ahora las porciones son más uniformes y reflejan la realidad de las cantidades que el consumidor actualmente come. Estas nuevas porciones deben ser expresadas en términos comunes y usando el sistema métrico de medidas. La FDA acepta como medidas domésticas comunes: la taza, la cuchara de mesa, la cucharita de té, la tajada, la fracción (como en el caso de "1/4 de pizza") y recipientes comunes para empacar alimentos caseros (una bandeja pequeña o una jarra.) Onzas pueden ser usadas, pero solamente cuando una unidad casera no es apropiada y una unidad visual es usada como ejemplo, 1 onza (28g/ alrededor de 1/2 pepino). Gramos (g) y mililitros (mL) son las unidades métricas usadas en relación con tamaños de porciones. NLEA interpreta tamaños de porciones la cantidad de comida que se acostumbra a comer una vez. Los tamaños de las porciones que aparecen en las etiquetas de los alimentos están basadas en listas establecidas por la FDA de "Referencia de Cantidades Comúnmente Consumidas en una Comida."

Estas cifras de referencias, que son parte de las regulaciones fueron divididas en 139 categorías de productos regulados por la FDA, incluyendo 11 grupos de alimentos formulados o preparados para niños menores de 4 años de edad. En la lista figuran las cantidades de alimentos usualmente consumidos de cada categoría en cada ocasión, principalmente basados en estudios del consumo nacional de alimentos. La lista de la FDA suministra también porción sugerida en la etiqueta del producto. Por ejemplo, la categoría "panes (excluyendo el tipo dulce) tiene un cantidad de 50 g, en la referencia y en la descripción de la etiqueta para pan tajado o panecillos es " pedazo (s) ( g)" o, para pan sin tajar, "2 onzas (56 g/ pulgadas cada tajada)" El tamaño de las porciones de los productos que vienen en unidades pequeñas, como las galletas, barras de chocolate y productos en tajadas, es el número de unidades completas que se aproxima más a la cantidad de la referencia. Las galletas son un ejemplo. Bajo la categoría de productos de panadería", las galletas tienen una referencia de cantidad de 30 g. La medida casera más cercana a esta cantidad, es el número de galletas que más se acerca al peso de 30g. De esta manera, el tamaño de la porción en la etiqueta de un paquete de galletas en el cual cada una pesa 13g, es "2 galletas (26 g)." Si una unidad pesa más del 50 por ciento pero menos que el 200 por ciento de la cantidad en la referencia, el tamaño de la porción es una unidad. Por ejemplo, la cantidad en la referencia para el pan es 50 g; por lo tanto, la etiqueta de una hogaza de pan en la que cada tajada pesa más de 25 g, indica que una tajada equivale a una porción. Ciertas reglas se aplican a alimentos empacados que se venden individualmente. Si el peso de uno de estos paquetes es menos del 200 por ciento de la cantidad de la referencia aplicable, el producto es clasificado como una porción. Por lo tanto, una lata, de bebida carbonatada de 360-mililitros (mL)(12-onzas- líquidas) es una porción, ya que la cantidad de la referencia para bebidas gaseosas es 240 mL (8 onzas). No obstante, si la cantidad del producto tiene una referencia de 100 g o 100 mL o más, y el paquete contiene más del 150 por ciento pero menos de 200 por ciento de la cantidad de referencia, los manufactureros tienen la opción de decidir si el producto se puede considerar una porción o dos porciones. Un ejemplo de lo anterior es una lata de sopa de 15 onzas (420 g). La porción y la cantidad de la referencia para sopa es de 245 g. Como consecuencia, el manufacturero tiene la opción de calificar la lata de sopa como una porción o como dos porciones. Información de Nutrición Ahora existe un nuevo grupo de componentes dietéticos en el cuadro de nutrición. Los componentes obligatorios (en negrillas) los voluntarios y el orden en que deben aparecer son:

• total de calorías • calorías de grasa • calorías de grasa saturada • total de grasa • grasa saturada • grasa poliinsaturada • grasa monoinsaturada • colesterol • sodio • potasio

• total de carbohidratos • fibra dietética • fibra soluble • fibra insoluble • azúcares • alcohol de azúcar (por ejemplo, el azúcar que substituye xilitol, manitol y

sorbitol) • otro carbohidrato (la diferencia entre carbohidrato total y la suma de fibra

dietética, azúcares, y alcohol de azúcar si es mencionado) • proteína • vitamina A • por ciento de vitamina A presente como beta carotena • vitamina C • calcio • hierro • otras vitaminas y minerales esenciales

Si un reclamo es hecho acerca de alguno de los componentes opcionales, o si un alimento es fortalecido o enriquecido con alguno de ellos, información sobre nutrición para esos componentes será declarada obligatoria. Estos componentes, obligatorios o voluntarios son los únicos permitidos en el cuadro de nutrición. La inclusión en la lista de aminoácidos sencillos, maltodextrina, calorías de grasa poliinsaturada y calorías de carbohidratos, por ejemplo, no son permitidos en la etiqueta como parte de los Datos de Nutrición. Los nutrientes exigidos fueron escogidos porque son los que hoy responden a las preocupaciones de salud. El orden en que deben aparecer, refleja las prioridades de las recomendaciones dietéticas actuales. La tiamina, la riboflavina y la niacina dejaron de ser necesarias en las etiquetas de nutrición porque las deficiencias de cualquiera de ellas ya no es considerada de mucha importancia en la salud pública. Sin embargo, se pueden mencionar en la etiqueta voluntariamente. Formato del Panel de Nutrición El formato para declarar el contenido de nutrientes por porción también ha sido revisado. Ahora, todos los nutrientes deben ser declarados como porcentajes de los Valores Diarios--la referencia de valores de la nueva etiqueta. La cantidad en gramos o miligramos de macronutrientes (grasa, colesterol, sodio, carbohidratos, y proteína) todavía deben ser incluidos en la lista a la derecha de cada uno de los nombres de esos nutrientes. Pero, por primera vez, una columna encabezada "% Valor Diario" ha aparecido. Exigir que los nutrientes sean declarados como porcentajes de los Valores Diarios obedece a la prevención de malas interpretaciones que se pueden presentar con valores cuantitativos, o sea con el análisis que determina las porciones de cada ingrediente en la etiqueta. Por ejemplo, un alimento con 140 miligramos (mg) de sodio, podría ser confundido con un alimento rico en sodio, porque 140 es relativamente un número alto. Actualmente, sin embargo, esa cantidad representa menos del 6 por ciento del Valor Diario del sodio, el cual es 2,400 mg.

Visto de otra manera, un alimento con 5g de grasa saturada podría analizarse como siendo bajo en ese nutriente. En efecto, ese alimento podría proveer una cuarta parte del total del Valor Diario ya que 20g es el Valor Diario para grasa saturada, basada en una dieta de 2,000 calorías. Cuadro de Nutrición Nota al Pie La lista del % (porcentaje) del Valor Diario agrega al final, una nota anunciando que los porcentajes están basados en una dieta de 2,000 calorías. Algunas etiquetas de nutrición--por lo menos las de paquetes grandes--también tienen al final:

• una frase indicando que el objetivo principal de nutrición de una persona está basado en los requisitos individuales de calorías

• listas de los valores diarios de ciertos nutrientes basados en una dieta de 2,000 a 2,500 calorías.

Una nota opcional al pie de la página en paquetes de cualquier tamaño es el número de calorías por gramo de grasa (9), carbohidratos y proteína (4). Modificaciones de Formato En limitadas circunstancias, variaciones en el formato de nutrición son permitidas, algunas son obligatorias. Por ejemplo, las etiquetas de alimentos para niños menores de 2 años (no incluye la fórmula para infantes con reglas de etiquetas especialmente reguladas por el Acto de Formulas Para Infantes de 1980) no pueden incluir información acerca de grasa saturada, grasa poliinsaturada, grasa monoinsaturada, colesterol, calorías de grasa, o calorías de grasas saturadas. La razón es para evitar que los padres equivocadamente crean que los infantes y los niños empezando a caminar deben ser restringidos de la grasa por completo, cuando en efecto, debe ser lo contrario. La grasa es importante durante esos años para asegurar adecuado crecimiento y desarrollo. Las etiquetas de alimentos para niños menores de 4 años no pueden incluir los porcentajes (%) de Valores Diarios de grasa total, grasa saturada, colesterol, sodio, potasio, total de carbohidratos y fibra dietética. Sin embargo, pueden aparecer los porcentajes de proteínas, vitaminas y minerales. Estos son los únicos nutrientes para los cuales la FDA ha fijado Valores Diarios en lo que concierne a este grupo de niños. De esta manera, la parte superior de los cuadros de Datos de Nutrición de alimentos para niños menores de 4 años consistirá de dos columnas. Los nombres de los nutrientes aparecerán en la lista de la izquierda y las cantidades cuantitativas, en la columna de la derecha. En el fondo del cuadro estarán los porcentajes (%) de Valores Diarios para proteínas, vitaminas y minerales. Únicamente la información sobre conversión de caloría será obtenible como una nota final al pie del cuadro. Algunos alimentos llenan los requisitos para una etiqueta con un formato simplificado. Este tipo de formato cuando en alimento contiene insignificantes cantidades de siete o más de los nutrientes obligatorios y total de calorías. "Insignificante" quiere decir que una explicación de cero es válida en la etiqueta relativa a los nutrientes, o cuando el total de carbohidratos, fibra dietética y proteína "es de menos de 1 gramo." El formato simplificado también puede ser aplicado en alimentos para niños menores de 2 años, si el producto contiene cantidades insignificantes de 6 o más de lo siguiente: calorías, grasa total, carbohidratos, fibra dietética, azúcares, proteína, vitaminas A y C, calcio y hierro.

Si el formato simplificado es usado, información sobre el total de calorías, total de grasa, total de carbohidratos, proteína y sodio --aún en las cantidades insignificantes--deben ser añadidos a la lista. Otros nutrientes, al tiempo con las calorías de grasas deben ser mostrados si están presentes en cantidades más que insignificantes. Otros nutrientes añadidos al alimento deben también ser declarados en la lista . Algunas excepciones existen para empaques medianos y pequeños. Empaques con menos de 12 pulgadas cuadradas de espacio para la etiqueta (el tamaño de un paquete de goma de mascar) están exentos de llevar la información a menos que el contenido de un nutriente o declaración de salud se haga para el producto. De todos modos, una dirección o número de teléfono deben ser proveídos para los consumidores que deseen obtener la información requerida sobre los nutrientes. Si los manufactureros desean proveer información voluntaria acerca de la nutrición en los empaques, tienen a su alcance las siguientes opciones:

1. presentar la información en un tipo de letra más pequeño que el requerido para empaques más grandes, o

2. presentar la información en formato tabular o linear. Tanto el formato tabular como el linear pueden ser usados en empaques con menos de 40 pulgadas cuadradas disponibles para la etiqueta e insuficiente espacio para la forma vertical completa. Otras opciones para empaques con menos de 40 pulgadas cuadradas de espacio para la etiqueta son:

• Abreviar los nombres de los componentes dietéticos • Omitir las notas al pie de la página, con excepción del informe de que el %

porcentaje de los Valores Diarios están basados en una dieta de 2,000 calorías. • colocar la información sobre la nutrición en otros paneles donde el consumidor

pueda verlos con facilidad. Un escogido grupo de empaques con más de 40 pulgadas cuadradas de espacio para la etiqueta, goza también de una excepción en el formato. Estos son los empaques con insuficiente espacio vertical (cerca de 3 pulgadas) para acomodar la información requerida. Algunos ejemplos son las bolsas para panes, cajas de pasteles y bolsas de vegetales congelados. En estos paquetes los Datos Sobre la Nutrición pueden aparecer horizontalmente, con la información de la nota al pie de la página (foot note) al extremo derecho del empaque. Para empaques de tamaño grande en los que no hay suficiente espacio en el panel principal de exhibición, o en el panel de información a la derecha, la FDA permite que la información sobre nutrición aparezca en cualquiera de los paneles, donde sea más fácil de ver para los consumidores. Este intento reduce las posibilidades de aglomerar la información y anima a los manufactureros, a suministrar la mayor cantidad de información sobre nutrición posible. Para aquellos productos que requieren preparación adicional antes de comerlos, como las mezclas para bizcochos y tortas y pasta seca para la cena, o los que usualmente se comen con otro u otros alimentos adicionales, como los cereales con leche al desayuno, la FDA aconseja a los manufactureros a proveer voluntariamente una segunda columna de información sobre nutrición. Esto se conoce como doble declaración.

Con esta variación, la primera columna que es obligatoria, contiene información de nutrición de los alimentos al tiempo de comprarlo y una segunda columna de información al prepararlo y comerlo. Todavía otra variación es el despliegue agregado. Este es permitido en etiquetas de alimentos variados como los cereales listos para comer y copas de helados de una variedad de sabores. Con este despliegue la cantidad total y el % porcentaje de Valores Diarios por cada nutriente son presentados en columnas separadas bajo el nombre de cada alimento. Valores Diarios--DRVs La referencia de valor, Valor Diario de la nueva etiqueta abarca dos tipos de criterio dietético: Referencia de Valores Diarios (DRVs) y Referencia de Consumo Diario (RDIs). Únicamente el término de los Valores Diarios aparece, para que la lectura de la etiqueta sea más fácil. La Referencia de Valores Diarios ha sido establecida para los macronutrientes que son fuente de energía: carbohidrato (inclusive fibra) y proteína; también para colesterol, sodio y potasio, las cuales no contribuyen con calorías. La Referencia de Valores Diarios de los nutrientes productores de energía se basan en el número de calorías consumidas en un día. Un consumo de 2,000 calorías ha sido establecido como referencia. Este nivel fue escogido en parte, porque es el que se aproxima a la necesidades calóricas de la mujer después de la menopausia. Este grupo es el que tiene el riesgo más alto por el excesivo consumo de calorías y grasa. Las Referencias de Valores Diarios de los nutrientes productores de energía se calculan de la siguiente manera:

• grasa basada en 30 por ciento de calorías • grasa saturada basada en 10 por ciento de calorías • carbohidrato basado en 60 por ciento de calorías • proteína basada en 10 por ciento de calorías. (Las Referencias de Valores Diarios

de proteínas se aplican únicamente a adultos y niños mayores de 4 años. Referencias de Consumo Diario (RDIs) de proteína para grupos especiales han sido establecidas.)

• fibra basada en 11.5 g de fibra por cada 1,000 calorías. Debido a corrientes recomendaciones de salud pública, Referencias de Valores Diarios de algunos nutrientes representan el límite más elevado considerado como deseable. Las Referencias de Valores Diarios para grasas y sodio son:

• total grasa: menos de 65 g • grasa saturada: menos de 20 g • colesterol: menos de 300 mg • sodio: menos de 2,400 mg

Valores Diarios--RDIs El RDI reemplaza el término "U.S. RDA," introducido en 1973 como una etiqueta de referencia del valor de vitaminas, minerales y proteínas durante el tiempo del rotulado voluntario. • Libre. Este término significa que un producto no contiene una cantidad, o contiene solamente una "insignificante o fisiológicamente sin importancia" cantidad de, uno o más de éstos componentes: grasa, grasa saturada, colesterol, sodio, azúcares y calorías. Por ejemplo, "libre de calorías", significa menos de 5 calorías por porción y "libre de azúcar" y "libre de grasa", ambos significan menos de 0.5 g por porción. Sinónimos de "libre" incluyen "sin," "no," y "cero."

• Bajo este término puede ser usado en alimentos que se pueden comer frecuentemente sin exceder las guías dietéticas de uno o más de éstos componentes: grasa, grasa saturada, colesterol, sodio y calorías. De esta manera, las palabras pueden definirse como sigue:

• bajo en grasa: 3 g o menos por porción • bajo en grasa saturada: 1 g o menos por porción • bajo en sodio: 140 mg o menos por porción • muy bajo en sodio: 35 mg o menos por porción • bajo en colesterol: 20 mg o menos y 2 g o menos de grasa saturada por

porción • bajo en calorías: 40 calorías o menos por porción.

Sinónimos de "bajo" incluyen: "pequeños" ("little,") "pocas" ("few") y "fuente baja de" ("low source of")

• Magra y extra magra. Estos términos se pueden usar para describir el contenido de grasa en la carne de res, de aves, pescado y la carne de animales de caza.

• Reducido. Este término significa que un producto nutricionalmente alterado contiene por lo menos 25 por ciento menos de un nutriente o de calorías que el producto regular. Sin embargo, no se puede en este caso alegar reducción del producto, si su alimento de referencia ya cumple con la condición de "bajo."

• Menos. Este término significa que un alimento alterado o no, contiene 25 por ciento o menos de un nutriente o de calorías que el alimento de referencia. Por ejemplo, pretzels (un bizcocho salado en forma de lazo) que tienen 25 por ciento menos grasa que las hojuelas de papas fritas podrían alegar que tienen "menos". Un sinónimo aceptable sería "menor."

• Liviano. Esta descripción puede significar dos cosas:

Primero, que un producto cuyo valor nutritivo ha sido alterado contiene un tercio de calorías menos o la mitad de la grasa indicada en la referencia del alimento. Si el alimento deriva 50 por ciento o más de sus calorías de la grasa, la reducción debe ser 50 por ciento de la grasa. Segundo, que el contenido de sodio de un alimento bajo en calorías, y bajo en grasa ha sido reducido a 50 por ciento. Además, "liviano en sodio" puede ser usado en un alimento en el que el contenido de sodio ha sido reducido por lo menos 50 por ciento. Todavía el término liviano puede usarse para describir ciertas propiedades como textura y color, siempre y cuando la etiqueta explique la razón o intención para hacerlo, por ejemplo, "azúcar morena clara" y "ligera y esponjosa."

• Más. Este término significa que una porción de un alimento que haya sido alterado o no, contiene un nutriente que es por lo menos más del 10 por ciento del Valor Diario del alimento de la referencia. Este 10 por ciento del Valor Diario también correspondería a "fortificado" "enriquecido" y "añadido", pero en este caso, el alimento tendría que ser alterado.

Deletreo opcional de esos términos descriptivos y sus correspondientes sinónimos son permitidos--por ejemplo, "hi" por ("alto") y "lo" por (bajo") mientras las opciones no sean falsas. Otras Definiciones Las regulaciones también atienden otras demandas. Entre ellas:

• Porcentaje libre de grasa: Un producto llevando esta demanda, debe ser bajo en grasa o completamente libre de ella. Fuera de eso, la demanda debe señalar con precisión la cantidad de grasa presente en 100 g del alimento. Por lo tanto, si un alimento contiene 2.5 g de grasa por cada 50 g, la demanda debe ser "95 por ciento libre de grasa".

• Implícito: Estos tipos de demandas son prohibidas cuando equivocadamente implican que un alimento contiene o no contiene un significativo nivel de un nutriente. Por ejemplo, un producto reclamando haber sido hecho con un ingrediente conocido de ser una fuente de fibra (ej."hecho con afrecho de avena"), no es permitido, a menos que el producto contenga una cantidad suficiente del ingrediente (por ejemplo afrecho de avena) para satisfacer la definición de ser "una buena fuente" de fibra. En otro ejemplo, una afirmación de que un producto no contiene "aceites tropicales" es permitido--pero solamente en alimentos que son "bajos" en grasa saturada porque los consumidores consideran los aceites tropicales con grasas altamente saturadas.

• Comidas y platos principales: Afirmaciones de que una comida o plato principal está "libre" de un nutriente como el sodio o el colesterol, debe satisfacer las mismas condiciones de los alimentos individuales. Otras demandas pueden ser usadas bajo circunstancias especiales. Por ejemplo, "bajo en calorías" indica que la comida o el plato principal contiene 120 calorías o menos por 100 g. "Bajo en sodio significa que el alimento tiene 140 mg o menos por 100 g. "Bajo colesterol" indica que el alimento contiene 20 mg de colesterol o menos por 100 g pero no más de 2 g de grasa saturada. "Liviano" quiere decir que la comida o plato principal es bajo en grasa o bajo en calorías.

• Alimentos Estandarizados: Cualquier afirmación que se haga sobre un nutriente, tal como "reducido en grasa" o "bajo en calorías" o "liviano" puede ser usado con un término estandarizado, si el nuevo producto ha sido específicamente formulado y satisface los requisitos de la FDA en cuanto a la afirmación, no es inferior en nutrición al alimento tradicionalmente estandarizado, y cumple con ciertas condiciones impuestas por la FDA. Un producto nuevo llevando un reclamo debe tener características similares a las del alimento estandarizado. De lo contrario y si las diferencias materialmente limitan el uso del producto, (por ejemplo, no se recomienda para hornear) para informar a los consumidores.

• Saludable: Un alimento "saludable" debe ser bajo en grasa saturada, y poseer cantidades limitadas de colesterol y sodio. Además, si es un alimento de un solo componente, debe proporcionar por lo menos, un 10 por ciento de dos o tres vitaminas A o C, hierro, calcio, proteína o fibra. Si es un producto tipo comida, como un plato principal congelado, debe proveer a los consumidores un 10 por ciento de dos o tres de esas vitaminas o minerales, o de proteína y fibra, además de cumplir con otras normas. Los límites en el sodio fueron puestos en práctica. A partir de enero de 1996, los alimentos etiquetados como "saludables", regulados por la FDA, deben proveer no menos de 480 mg de sodio por porción. Después del primero de enero de 1998, el límite de sodio para los alimentos regulados por la FDA bajará a 360 mg por porción en los alimentos empacados individualmente y 480 mg por porción de alimentos conocidos como tipo comida llevando la afirmación de "saludable" en la etiqueta. Las fechas efectivas para la introducción gradual del sodio en los alimentos regulados por la USDA comenzó en noviembre de 1995 y continuará en noviembre de 1997. Los límites del sodio son iguales a los de la FDA.

'Fresco' La FDA he emitido una regulación para el término "fresco", aunque no ha sido ordenado por la NLEA. La agencia ha tomado est a medida debido a la preocupación acerca del posible mal uso que se le pueda dar en algunas de las etiquetas de los alimentos. La regulación define la palabra "fresco/a" cuando es usada para definir que un alimento es crudo o no ha sido elaborado. De esta manera, "fresco" puede tan sólo ser usado cuando un alimento es crudo, jamás ha sido congelado o calentado y no contiene ninguna clase de preservativos. (Irradiación a niveles bajos es permitida.) "Fresco congelado," "congelado fresco," "recientemente congelado". Este último debe interpretarse en casos en que el alimento ha sido congelado rápidamente mientras está fresco. (Breve escaldadura sin llegar al punto de ebullición, es permitida antes de la congelación para la conservación de los nutrientes.) Otros usos del término "fresco," tales como "leche fresca" o "pan fresco", insinuando que acaba de salir del horno no son afectados. Alimentos para Bebés La FDA no está permitiendo hasta ahora el uso extenso de reclamos de nutrientes en los alimentos de infantes o niños. Sin embargo, quizás en el futuro, la agencia llegue a proponer algunos términos para ésos alimentos específicamente. Las especificaciones actuales "sin endulzar" y "sin sal," son permitidos en estos alimentos, porque se refieren al sabor y no al contenido nutritivo de ellos. Reclamos de Salud

Afirmaciones de ocho relaciones o vínculos entre un nutriente o un alimento y el riesgo de contraer una enfermedad o una condición relacionada con la salud, no son permitidas. Estas se pueden hacer de varias maneras: por medio de testimonios o referencias de terceros como el Instituto Nacional de Cancerología; declaraciones; símbolos, como un corazón; ilustraciones o descripciones. No importa el caso, debe reunir los requisitos autorizados para los reclamos de la salud; por ejemplo, no puede simplemente expresar el grado de la reducción del peligro y tan sólo se puede usar "podría" o "puede", al discutir el nutriente o el vínculo de alimento-enfermedad. Además otros factores que juegan un papel importante en la enfermedad deben ser discutidos. Los reclamos también deben ser expresados de tal manera que los consumidores puedan entender la relación entre el nutriente y la enfermedad, lo mismo que la importancia del vínculo del nutriente con la dieta diaria. Un ejemplo de un reclamo apropiado es: "Siendo que muchos factores afectan las enfermedades del corazón, las dietas bajas en grasa saturada y colesterol, reducen el riesgo de esta enfermedad.' Los reclamos de la conexión de nutriente-enfermedad permitidos, y las reglas para su uso son:

• Calcio y osteoporosis: Para llevar esta afirmación, el alimento debe tener un contenido de 20 por ciento o más del Valor Diario de calcio (200 mg) por porción, un contenido de calcio que iguale o exceda el contenido de fósforo del alimento, y una forma de calcio que pueda ser absorbido y usado por el cuerpo. Esta afirmación debe mencionar el grupo más necesitado del consumo de calcio, (esto es, adolescentes y adultos blancos y mujeres asiáticas) y que mencione la necesidad de ejercicios físicos y una dieta saludable. Un producto que contenga 40 por ciento o más de Valores Diarios en calcio, debe mencionar en la etiqueta que un total consumo dietético mayor de 200 por ciento de los Valores Diarios de calcio (esto es, 2,000 mg o más) no ofrece beneficios adicionales.

• La Grasa y el Cáncer: Para llevar esta afirmación un alimento debe cumplir con los requisitos de la categoría "bajo en grasa", o si se refiere a pescado o carne de animales de caza, con los requisitos de la categoría "extra magra."

La afirmación puede mencionar el vínculo entre el riesgo reducido de CHD y grasa saturada y consumos de colesterol, y niveles bajos de colesterol en la sangre.

• Fibra-Contenido de fibra en productos derivados de granos, frutas y vegetales, y el cáncer: Para llevar esta afirmación el alimento debe ser, o por lo menos llevar un producto de un grano, fruta o vegetal y reunir los requisitos que demandan la descripción de la categoría "bajo en grasa" y sin fortalecimiento, ser una "buena fuente" de fibra dietética

• Frutas, vegetales y derivados de granos que contienen fibra y Riesgo de CHD: Para llevar esta afirmación, el alimento debe ser, o contener frutas, vegetales y productos derivados de granos. También debe reunir los requisitos

incluidos en la descripción de "bajo en grasa saturada" "bajo colesterol", "bajo en grasa" y contener, sin fortalecimiento, al menos 0.6 g de fibra soluble por porción.

• Sodio e hipertensión (presión alta de sangre): Para llevar esta afirmación el alimento debe reunir los requisitos de la descripción de la categoría "bajo en sodio".

• Frutas vegetales y cáncer: Esta afirmación se puede hacer para frutas y vegetales que reúnen los requisitos de la categoría "bajo en grasa" y sin fortalecimiento, para la categoría "buena fuente" y por lo menos con uno de los siguientes nutrientes: fibra dietética y vitaminas A o C. Esta afirmación relaciona las dietas bajas en grasa y ricas en frutas y vegetales (y de ahí las vitaminas A y C con la fibra dietética) para reducir el peligro del cáncer. La FDA autoriza esta afirmación en lugar de un antioxidante vitaminas y cáncer.

• El ácido Fólico y los defectos del tubo neural: En enero 4 de 1994 la FDA autorizó el uso de una afirmación de salud acerca de la relación entre el ácido fólico y el riesgo de los defectos de nacimiento y el tubo neural para suplementos dietéticos y para alimentos convencionales que por naturaleza son altos en ácido fólico. (En 1992, el Servicio de Salud Pública de los Estados Unidos recomendó a todas las mujeres capacitadas para la maternidad, consumir diariamente 0.4 mg de ácido fólico para reducir el riesgo de dar a luz una criatura afectada con un tubo neural defectuoso.) Rotulación de Ingredientes La lista de ingredientes ha sufrido algunos cambios también. El más importante es una demanda por la completa rotulación de los ingredientes en los "alimentos estandarizados", que previamente estaban exentos. La declaración individual de ingredientes de todos los alimentos con más de uno, ahora es obligatoria. Así mismo, la lista de ingredientes incluye cuando es apropiado:

• Colores añadidos certificados por la FDA, como FD&C Blue No. 1 por nombre • fuentes de proteínas hidrolizadas, usadas como sabor en sí, o como

La razón principal para estos nuevos requisitos, es la posibilidad de que algunas personas sean alérgicas a tales aditivos y ahora sea mucho más fácil evitarlos. Según lo exige la NLEA, las bebidas que alegan incluir jugos, ahora deben declarar el porcentaje total de ellos en el panel informativo de la etiqueta. Además, las regulaciones de la FDA establecen el discernimiento de darle nombre a las bebidas que reclaman jugos como parte de sus ingredientes. Por ejemplo, cuando la etiqueta de una bebida que alega estar compuesta de varios jugos, pero nombra uno o más pero no todos, y el jugo predominante está presente en pequeñas cantidades, el nombre del producto debe ser mencionado como una mezcla o con sabor a ése jugo, y declarar que la cantidad de jugo fluctúa en incrementos de 5 por ciento --por ejemplo, "mezcla de jugo con sabor a frambuesa" o "contiene una mezcla de 5 a 7 por ciento de jugo de frambuesa." (b) The term general statement of substandard fill means the statement ``Below Standard in Fill'' printed in Cheltenham bold condensed caps. If the quantity of the contents of the container is less than 1 pound, the statement is in 12-point type; if such quantity is 1 pound or more, the statement is in 14-point type. Such statement is enclosed within lines, not less than 6 points in width, forming a rectangle; but if the statement specified in paragraph (a) of this section is also used, both statements (one following the other) may be enclosed within the same rectangle. Such statement or statements, with enclosing lines, are on a strongly contrasting, uniform background, and are so placed as to be easily seen when the name of the food or any pictorial representation thereof [[Page 293]] is viewed, wherever such name or representation appears so conspicuously as to be easily seen under customary conditions of purchase.

The tomatoes may or may not be peeled, but shall have had the stems and calicies removed and shall have been cored, except where the internal core is insignificant to texture and appearance. (ii) Canned tomatoes may contain one or more of the safe and suitable optional ingredients specified in paragraph (a)(2) of this section, be packed without any added liquid or in one of the optional packing media specified in paragraph (a)(3) of this section and be prepared in one of the styles specified in paragraph (a)(4) of this section. Such food is sealed in a container and before or after sealing is so processed by heat as to prevent spoilage. (2) Optional ingredients. One or more of the following safe and suitable ingredients may be used: (i) Calcium salts in a quantity reasonably necessary to firm the tomatoes, but the amount of calcium in the finished canned tomatoes is

not more than 0.045 percent of the weight, except that when the tomatoes are prepared in one of the styles specified in paragraphs (a)(4) (ii) to (iv) of this section the amount of calcium is not more than 0.08 percent of the weight of the food. (iii) Dry nutritive carbohydrate sweeteners whenever any organic acid provided for in paragraph (a)(2)(ii) of this section is used, in a quantity reasonably necessary to compensate for the tartness resulting from such added acid. (iv) Salt. (v) Spices, spice oils. (vi) Flavoring and seasoning. (vii) Vegetable ingredients such as onion, peppers, and celery, that may be fresh or preserved by physical means, in a quantity not more than 10 percent by weight of the finished food. (3) Packing media. (i) The liquid draining from the tomatoes during or after peeling or coring. (ii) The liquid strained from the residue from preparing tomatoes for canning consisting of peels and cores with or without tomatoes or pieces thereof. (iii) The liquid strained from mature tomatoes (tomato juice). (iv) Tomato paste, or tomato puree, or tomato pulp complying with the compositional requirements of Sec. 155.191. (4) Styles. (i) Whole. (ii) Diced. (iii) Sliced. (iv) Wedges. (5) Name of the food. (i) The name of the food is ``tomatoes'', except that when the tomatoes are not peeled the name is ``unpeeled tomatoes''. (ii) The following shall be included as part of the name or in close proximity to the name of the food: (a) A declaration of any flavoring that characterizes the product as specified in Sec. 101.22 of this chapter. (b) A declaration of any added spice, seasoning, or vegetable ingredient that characterizes the product, (e.g., ``with added ------'' or, ``with ------'' the blank to be filled in with the word(s)

(c) The word ``stewed'' if the tomatoes contain characterizing amounts of at least the three optional vegetables listed in paragraph (a)(2)(vii) of this section. (d) The styles: ``Diced'', ``sliced'', or ``wedges'' as appropriate. (e) The name of the packing medium: ``tomato paste'', ``tomato puree'', or ``tomato pulp'' as provided in paragraph (a)(3)(iv) of this section, or ``strained residual tomato material from preparation for canning'' as provided for in paragraph (a)(3)(ii) of this [[Page 479]] section, as appropriate. The name of the packing medium shall be preceded by the word ``with''. (iii) The following may be included as part of the name or in close proximity to the name: (a) The word ``whole'' if the tomato ingredient is whole or almost whole, and the weight of such ingredient is not less than 80 percent of the drained weight of the finished food as determined in accordance with the method prescribed in paragraph (b)(2) of this section. (b) The words ``solid pack'' when none of the optional packing media specified in paragraph (a)(3) of this section are used. (c) The words ``in tomato juice'' if the packing medium specified in paragraph (a)(3)(iii) of this section is used. (6) Label declaration. The name of each ingredient used shall be declared on the label as required by the applicable sections of parts 101 and 130 of this chapter. (b) Quality. (1) The standard of quality for canned tomatoes is as follows: (i) The drained weight, as determined by the method prescribed in paragraph (b)(2)(i) of this section, is not less than 50 percent of the weight of water required to fill the container, as determined by the general method for water capacity of containers prescribed in Sec.

130.12(a) of this chapter; (ii) The strength and redness of color as determined by the method prescribed in paragraph (b)(2) of this section, are not less than that of the blended color of any combination of the color discs described in such method in which one-third the area of disc 1, and not more than one-third the area of disc 2, is exposed; (iii) Peel per kilogram (2.2 pounds) of the finished food covers an area of not more than 15 cm\2\ (2.3 square inches) which is equivalent to 6.8 cm\2\ (1.06 square inches) per pound based on an average of all containers examined provided, however, that the area of peel is not a factor of quality for canned unpeeled tomatoes labeled in accordance with paragraph (a)(5)(i) of this section; and (iv) Blemishes per kilogram (2.2 pounds) of the finished food cover an area of not more than 3.5 cm\2\ (0.54 square inch) which is equivalent to 1.6 cm\2\ (0.25 square inch) per pound based on an average of all containers examined. (2) Canned tomatoes shall be tested by the following method to determine whether or not they meet the requirements of paragraphs (b)(1) (i) and (ii) of this section: (i) Remove lid from container, but in the case of a container with lid attached by double seam, do not remove or alter the height of the double seam. Tilt the opened container so as to distribute the contents over the meshes of a circular sieve which has previously been weighed. The diameter of the sieve used is 20.3 centimeters (8 inches) if the quantity of the contents of the container is less than 1.4 kilograms (3 pounds) or 30.5 centimeters (12 inches) if such quantity is 1.4 kilograms (3 pounds) or more. The meshes of such sieve are made by so weaving wire of 1.4 mm (0.054 inch) diameter as to form square openings 11.3 mm by 11.3 mm (0.446 inch by 0.446 inch). Without shifting the tomatoes, so incline the sieve as to facilitate drainage of the liquid. Two minutes from the time drainage begins, weigh the sieve and drained tomatoes. The weight so found, less the weight of the sieve, shall be considered to be the drained weight. (ii) Remove from the sieve the drained tomatoes, cut out and segregate successively those portions of least redness until 50 percent of the drained weight has been so segregated. Comminute the segregated portions to a uniform mixture without removing or breaking the seeds.

Fill the mixture into a black container to a depth of at least 25.4 mm (1 inch). Free the mixture from air bubbles, and skim off or press below the surface all visible seeds. Compare the color of the mixture, in full diffused daylight or its equivalent, with the blended color of combinations of the following concentric Munsell color discs of equal diameter, or the color equivalent of such discs: (a) Red--Munsell 5 R 2.6/13 (glossy finish). (b) Yellow--Munsell 2.5 YR 5/12 (glossy finish). (c) Black--Munsell N 1/ (glossy finish). [[Page 480]] (d) Grey--Munsell N 4 (mat finish). (3) Determine compliance as specified in Sec. 155.3(b). (4) If the quality of canned tomatoes falls below the standard prescribed in paragraph (b)(1) of this section, the label shall bear the general statement of substandard quality specified in Sec. 130.14(a) of this chapter in the manner and form therein specified; if, however, the quality of canned tomatoes falls below standard with respect to only one of the factors of quality specified by paragraphs (b)(1) (i) to (iii) of this section, there may be substituted for the second line of such general statement of substandard quality (``Good Food--Not High Grade'') a new line, appropriate for the corresponding subparagraph designation of paragraph (b)(1) of this section which the canned tomatoes fail to meet, to read as follows: (i) ``Poor color'' or (ii) ``Excessive peel'' or (iii) ``Excessive blemishes''. (c) Fill of container. (1) The standard of fill of container for canned tomatoes is a fill of not less than 90 percent of the total capacity of the container, as determined by the general method for fill of containers prescribed in Sec. 130.12(b) of this chapter. (2) Determine compliance as specified in Sec. 155.3(b). (3) If canned tomatoes fall below the standard of fill of container prescribed in paragraph (c)(1) of this section, the label shall bear the general statement of substandard fill specified in Sec. 130.14(b) of this chapter, in the manner and form therein specified.

Catsup, ketchup, or catchup is the food prepared from one or any combination of two or more of the following optional tomato ingredients: (i) Tomato concentrate as defined in Sec. 155.191(a)(1), except that lemon juice, concentrated lemon juice, or safe and suitable organic acids may be used in quantities no greater than necessary to adjust the pH, and in compliance with Sec. 155.191(b). (ii) The liquid derived from mature tomatoes of the red or reddish varieties Lycopersicum esculentum P. Mill. (iii) The liquid obtained from the residue from preparing such tomatoes for canning, consisting of peelings and cores with or without such tomatoes or pieces thereof. (iv) The liquid obtained from the residue from partial extraction of juice from such tomatoes. Such liquid is strained so as to exclude skins, seeds, and other coarse

or hard substances in accordance with current good manufacturing practice. Prior to straining, food-grade hydrochloric acid may be added to the tomato material in an amount to obtain a pH no lower than 2.0. Such acid is then neutralized with food-grade sodium hydroxide so that the treated tomato material is restored to a pH of 4.20.2. The final composition of the food may be adjusted by concentration and/or by the addition of water. The food may contain salt (sodium chloride formed during acid neutralization shall be considered added salt) and is seasoned with ingredients as specified in paragraph (a)(2) of this section. The food is preserved by heat sterilization (canning), refrigeration, or freezing. When sealed in a container to be held at ambient temperatures, it is so processed by heat, before or after sealing, as to prevent spoilage. [[Page 483]] (2) Ingredients. One or any combination of two or more of the following safe and suitable ingredients in each of the following categories is added to the tomato ingredients specified in paragraph (a)(1) of this section: (i) Vinegars. (ii) Nutritive carbohydrate sweeteners. Such sweeteners if defined in part 168 of this chapter shall be as defined therein. (iii) Spices, flavoring, onions, or garlic. (3) Labeling. (i) The name of the food is ``Catsup,'' ``Ketchup,'' or ``Catchup.'' (ii) The following shall be included as part of the name or in close proximity to the name of the food: (a) The statement ``Made from'' or ``Made in part from,'' as the case may be, ``residual tomato material from canning'' if the optional tomato ingredient specified in paragraph (a)(1)(iii) of this section or tomato concentrate containing the ingredient specified in Sec. 155.191(a)(1)(ii) is present. (b) The statement ``Made from'' or ``Made in part from,'' as the case may be, ``residual tomato material from partial extraction of juice'' if the optional tomato ingredient specified in paragraph (a)(1)(iv) of this section or tomato concentrate containing the

Each of the ingredients used in the food shall be declared on the label as required by the applicable sections of parts 101 and 130 of this chapter; except that the name ``tomato concentrate'' may be used in lieu of the names ``tomato puree,'' ``tomato pulp,'' or ``tomato paste'' and when tomato concentrates are used, the labeling requirements of Sec. 155.191(a)(3)(ii)(a) and (a)(3)(ii)(b) do not apply. (b) Quality. (1) The standard of quality for catsup is as follows: The consistency of the finished food is such that its flow is not more than 14 centimeters in 30 seconds at 20 [deg]C when tested in a Bostwick Consistometer in the following manner: Check temperature of mixture and adjust to 20<PLUS-MINUS1 [deg]C. The trough must also be at a temperature close to 20 [deg]C. Adjust end-to-end level of Bostwick Consistometer by means of the spirit level placed in trough of instrument. Side-to-side level may be adjusted by means of the built-in spirit level. Transfer sample to the dry sample chamber of the Bostwick Consistometer. Fill the chamber slightly more than level full, avoiding air bubbles as far as possible. Pass a straight edge across top of chamber starting from the gate end to remove excess product. Release gate of instrument by gradual pressure on lever, holding the instrument down at the same time to prevent its movement as the gate is released. Immediately start the stop watch or interval timer, and after 30 seconds read the maximum distance of flow to the nearest 0.1 centimeter. Clean and dry the instrument and repeat the reading on another portion of sample. Do not wash instrument with hot water if it is to be used immediately for the next determination, as this may result in an increase in temperature of the sample. For highest accuracy, the instrument should be maintained at a temperature of 201 [deg]C. If readings vary more than 0.2 centimeter, repeat a third time or until satisfactory agreement is obtained. Report the average of two or more readings, excluding any that appear to be abnormal. (2) Determine compliance as specified in Sec. 155.3(b). (3) If the quality of catsup falls below the standard prescribed in paragraphs (b) (1) and (2) of this section, the label shall bear the general statement of substandard quality specified in Sec. 130.14(a) of

This is the eighth issue of the United States Standards for Grades of Canned Tomatoespublished in the FEDERAL REGISTER of March 14, 1990 (55 FR 9412) to becomeeffective April 13, 1990.

Voluntary U.S. grade standards are issued under the authority of the AgriculturalMarketing Act of 1946, which provides for the development of official U.S. grades todesignate different levels of quality. These grade standards are available for use byproducers, suppliers, buyers, and consumers. As in the case of other standards for gradesof processed fruits and vegetables, these standards are designed to facilitate orderlymarketing by providing a convenient basis for buying and selling, for establishing qualitycontrol programs, and for determining loan values.

The standards also serve as a basis for the inspection and grading of commodities by theFederal inspection service, the only activity authorized to approve the designation of U.S.grades as referenced in the standards, as provided under the Agricultural Marketing Actof 1946. This service available as on-line (in-plant) or lot inspection and grading of allprocessed fruit and vegetable products, is offered to interested parties, upon application,on a fee-for-service basis. The verification of some specific recommendations,requirements or tolerances contained in the standards can be accomplished only by theuse of on-line inspection procedures. In all instances, a grade can be assigned based onfinal product factors or characteristics.

In addition to the U.S. grade standards, grading manuals or instructions for inspection ofseveral processed fruits and vegetables are available upon request for a nominal fee.These manuals or instructions contain detailed interpretations of the grade standards andprovide step-by-step procedures for grading the product.

Grade standards are issued by the Department after careful consideration of all data andviews submitted, and the Department welcomes suggestions which might aid in improvingthe standards in future revisions. Comments may be submitted to, and copies of standardsand grading manuals obtained from:

§52.5161 Product description.

The products to which these standards apply are defined in the Standards of Identityissued under the Federal Food, Drug, and Cosmetic Act as:

(a) Canned tomatoes (21 CFR 155.190); and

(b) Canned stewed tomatoes (21 CFR 155.190).

§52.5162 Styles.

(a) Whole means tomatoes, peeled or unpeeled, of any size that aresubstantially whole or almost whole.

(b) Sliced means tomatoes, peeled or unpeeled, that have been cut into unitsof approximately uniform thickness.

(c) Halves means tomatoes, peeled or unpeeled, that have been cut into twoapproximately equal halves.

(d) Wedges means tomatoes, peeled or unpeeled, that have been cut intoapproximate quarters or wedge-shaped sectors.

(e) Diced means tomatoes, peeled or unpeeled, that have been cut intoapproximate cube-shaped units.

§52.5163 Type of pack.

Regular pack means tomatoes packed in a medium consisting of tomato juice, tomatopuree, or tomato paste.

§52.5164 Definitions of terms.

(a) Character means the degree of firmness normally found when tomatoeshave been processed using good manufacturing practices as defined in 21CFR Part 110. Canned and stewed tomatoes that, when fully cooked, areexcessively soft or mushy are considered to lack character. Excessively softis further defined for all styles and means that the unit may disintegrate uponhandling, has evidence of sloughing (erosion of the tomato tissue) or hasragged edges, and has lost ability to retain shape. For the purposes of thesegrade standards, character is classified as good, reasonably good and fairlygood. There is no substandard classification for the quality factor ofcharacter.

(1) Good character in whole, halves, wedges, or sliced tomatoes isdefined as tomatoes in which not more than 15 percent by count areexcessively soft or mushy. Good character in diced tomatoes isdefined as diced tomatoes in which not more than 15 percent byweight are excessively soft or mushy.

(2) Reasonably good character in whole, halves, wedges, or slicedtomatoes is defined as tomatoes in which not more than 25 percentby count are excessively soft or mushy. Reasonably good characterin diced tomatoes is defined as diced tomatoes in which not morethan 25 percent by weight are excessively soft or mushy.

(3) Fairly good character in whole, halves, wedges, or sliced tomatoesis defined as tomatoes in which more than 25 percent by count areexcessively soft or mushy. Fairly good character in diced tomatoesis defined as diced tomatoes in which more than 25 percent by weightare excessively soft or mushy.

(b) Color.

(1) USDA Tomato Red means the color of an USDA approved plasticcolor comparator.

(2) Minimum Red for Canned Tomatoes means the equivalent of anyof the colors produced by blending the combinations of the followingMunsell Color discs of equal diameter when placed as indicated.

Red - Munsell 5 R 2.6/13 (glossy finish) Yellow - Munsell 2.5 YR 5/12 (glossy finish) Black - Munsell N 1/ (glossy finish) Grey - Munsell N 4 (mat finish)

(i) The discs are placed so that one-third of the area of the Reddisc, and not more than one third of the area of the Yellowdisc, are exposed. The exposed areas of the Black and Graydiscs make up the remainder of the area.

(ii) To determine U.S. Grade C Color for canned and stewedtomatoes, apply the test for strength and redness of coloroutlined in 21 CFR 155.190 (b).

(c) Defects refer to objectionable core material, tomato peel, extraneousvegetable material (EVM), blemished areas, and discolored portions thataffect the appearance and eating quality of the product as further describedbelow.

(1) Blemished areas are abnormal areas on the tomatoes which contraststrongly in color and/or texture with normal tomato tissue. Blemished areasmay show objectionable discoloration ranging from light to dark discoloration.Blemished areas include but are not limited to scarred, raised, scabby tissue;darkened, tough areas which remain around the core area; internal orexternal dark tissue around blossom ends of the tomatoes; or any otherareas that are objectionable or unsightly.

(2) Discolored portions are imperfections of the tomato tissue whichmay not be of strong contrasting color with respect to the tomatotissue but which detract slightly from the appearance of the product.Examples include sunburned areas, internal browning or tobaccomosaic, cloudy spots or ghost spots.

(3) Extraneous vegetable material (EVM) is vegetable material that isnot harmful and includes, but is not limited to, whole or parts of stems,calyx bracts, tomato leaves or portions thereof, sprouted seeds, andother similar vegetable material which may not be part of the tomatoplant.

(4) Objectionable core material is tomato material associated with thecore of the tomato which detracts from the appearance or edibility ofthe product and includes tough fibers and tough or slightly discoloredtomato tissue.

(5) Peel means the loose or attached skin of the tomato.

(d) Drained tomatoes means all of the tomato material that remains on thesieve after draining as prescribed in 21 CFR 155.190.

(e) Flavor and odor.

(1) Normal flavor and odor means a typical characteristic flavor andodor of mature tomatoes.

(2) Off-flavor and off-odor means any flavor or odor other than typicalcharacteristic flavor and odor of mature tomatoes that isobjectionable.

(f) Whole or almost whole, for whole style only, regardless of size, means that:

(1) The contour of the tomato is not materially affected by coring,trimming, or other means;

(2) The tomato may be cracked or split but not to the extent that there ismaterial loss of seeds or placenta (gelatinous mass filling the seedcavity); and

(3) The tomato units may be restored to their approximate original shapeduring handling.

§52.5165 Fill of container.

The standard of fill of container for canned tomatoes [21 CFR 155.190 (c)] requires thatthe product occupy not less than 90 percent of the water capacity of the container.

§52.5166 Minimum drained weight averages.

(a) The average minimum drained weight requirements for U.S. Grades arelisted in Table I in §52.5170.

(b) The drained weight must not be less than 50 percent of the weight of waterrequired to fill the container.

(c) The minimum drained weight averages are based on equalization of theproduct 15 days or more after the product has been canned.

(d) The method for ascertaining drained weight for all styles of canned and

stewed tomatoes is found in 21 CFR 155.190 except that the U.S. StandardNumber 8 circular sieve is used in lieu of a U.S. Standard Number 2 circularsieve for "sliced" and "diced" styles of canned and stewed tomatoes.

(e) Meeting drained weight averages. A lot of canned tomatoes is consideredas meeting the minimum drained weight averages if the following criteria aremet:

(1) The average of the drained weights from all the containers in thesample meets the average drained weight in Table I in §52.5170.

(2) The drained weights from the individual containers which do not meetthe minimum are:

(i) For No. 2 1/2 can size and smaller, all styles except diced:not more than 0.7 ounce lower than the minimum average.

(ii) For No. 2 1/2 can size and smaller, diced style: not more than0.5 ounce lower than the minimum average.

(iii) For No. 10 cans, all styles: not more than 2.0 ounces belowthe minimum average; and

(3) The number of containers in the sample which do not meet the requirementsof paragraph (e)(2) of this section, does not exceed the acceptance numberprescribed for the sample size in 7 CFR 52.38, Table I.

§52.5167 Sample unit sizes.

(a) For "whole", "halves", and "wedges" styles, the sample unit size is theamount of product specified to be used for inspection in 7 CFR 52.38,Table 1.

(b) For "sliced" and "diced" styles, the sample unit size is the same as indicatedin paragraph (a) of this section EXCEPT in containers Number 10 (No. 10)can size and larger, an optional sample unit size of 32 ounces per container(drained weight) is permitted.

§52.5168 Grades.

(a) U.S. Grade A is the quality of canned tomatoes that meets the applicablerequirements of Tables I, II, III, IV, and V of §52.5170, and scores not lessthan 90 points.

(b) U.S. Grade B is the quality of canned tomatoes that meets the applicablerequirements of Tables I, II, III, IV, and V of §52.5170, and scores not lessthan 80 points.

(c) U.S. Grade C is the quality of canned tomatoes that meets the applicablerequirements of Tables I, II, III, IV, and V of §52.5170, and scores not lessthan 70 points.

(d) Substandard is the quality of canned tomatoes that fails the requirementsfor U.S. Grade C.

This is the Sixth issue of the United States Standards for Grades of Canned Tomato Puree(Tomato Pulp) published in the FEDERAL REGISTER of April 14, 1978, (43 FR 15610)to become effective May 1, 1978. This issue supersedes the fifth issue, which have beenin effect since February 25, 1970.

Voluntary U.S. grade standards are issued under the authority of the AgriculturalMarketing Act of 1946, which provides for the development of official U.S. grades todesignate different levels of quality. These grade standards are available for use byproducers, suppliers, buyers, and consumers. As in the case of other standards for gradesof processed fruits and vegetables, these standards are designed to facilitate orderlymarketing by providing a convenient basis for buying and selling, for establishing qualitycontrol programs, and for determining loan values.

The standards also serve as a basis for the inspection and grading of commodities by theFederal inspection service, the only activity authorized to approve the designation of U.S.grades as referenced in the standards, as provided under the Agricultural Marketing Actof 1946. This service, available as on-line (in-plant) or lot inspection and grading of allprocessed fruit and vegetable products, is offered to interested parties, upon application,on a fee-for-service basis. The verification of some specific recommendations,requirements, or tolerances contained in the standards can be accomplished only by theuse of on-line inspection procedures. In all instances, a grade can be assigned based onfinal product factors or characteristics.

In addition to the U.S. grade standards, grading manuals or instructions for inspection ofseveral processed fruits and vegetables are available upon request for a nominalfee. These manuals or instructions contain detailed interpretations of the grade standardsand provide step-by-step procedures for grading the product.

Grade standards are issues by the Department after careful consideration of all data andviews submitted, and the Department welcomes suggestions which might aid in improvingthe standards in future revisions. Comments may be submitted to, and copies of standardsand grading manuals obtained from:

§52.5081 Product description.

(a) Tomato Puree (or Tomato Pulp), hereinafter referred to as Tomato Puree,is the clean sound, wholesome product as defined in the Standard of Identityfor Tomato Puree (Tomato Pulp) (21 CFR 155.192), issued pursuant to theFederal Food, Drug, and Cosmetic Act.

§52.5082 Concentration.

(a) The degree of concentration is not considered a factor of quality for thepurposes of these standards, but tomato puree contains not less than 8percent, but less than 24 percent of natural tomato soluble solids.

(b) The following designations of concentration may be used in connection withthese standards for the applicable natural tomato soluble solids group:

NATURAL TOMATO SOLUBLE SOLIDS

Extra heavy concentration. 15.0 percent or more, but less than 24.0percent.

Heavy concentration. 11.3 percent or more, but less than 15.0percent.

Medium concentration. 10.2 percent or more, but less than 11.3percent.

Light concentration. 8 percent or more, but less than 10.2percent.

§52.5083 Texture.

(a) General. Texture is the degree of fineness or coarseness of the product.Texture is classified when the product is diluted with water, when necessary,to between 8 percent and 9 percent, inclusive, of natural tomato solublesolids.

(b) Kind of texture.

(1) Fine texture means smooth uniform finish.

(2) Coarse texture means a coarse, slightly granular finish.

§52.5084 Grades.

(a) U.S. Grade A is the quality of tomato puree that:

(1) has a good flavor and odor;

(2) has a good color;

(3) is practically free from defects; and

(4) scores not less than 90 points when scored in accordance with thescoring system outlined in this subpart.

(b) U.S. Grade C is the quality of tomato puree that:

(1) has at least a fairly good flavor and odor;

(2) has at least a fairly good color;

(3) is at least fairly free from defects; and

(4) scores not less than 80 points when scores in accordance with thescoring system outlined in this subpart.

(c) Substandard is the grade of tomato puree that fails to meet therequirements of U. S. Grade C.

§52.5085 Recommended fill of container.

It is recommended that container of tomato puree be filled as full as practicable withoutimpairment of quality.

§52.5086 Determining the grade of a sample unit.

(a) General. The grade of a sample unit of tomato puree is determined byconsidering the factor of flavor and odor which is not scored, the ratings forthe factors of color and defects which are scored, the total score, and thelimiting rules which apply.

(b) Factors not rated by score points.

(1) Flavor and odor.

(i) The flavor and odor of the product is determined on undilutedsamples and also after dilution with water to between 8 percentand 9 percent, inclusive, of natural tomato soluble solids.

(ii) Good flavor and odor means a distinct tomato puree flavorcharacteristics of ripe, good quality tomatoes and inclusive ofsalt which may be added. Such flavor and odor may be nomore than slightly affected by any one or combination of thefollowing: stems, sepals, leaves, crushed seeds, cores; byimmature, soured, or overripe tomatoes; from the effects ofunsatisfactory preparation, processing, or storage; or from anyother factor not specifically mentioned.

(iii) Fairly good flavor and odor means a characteristic tomatopuree flavor and inclusive of salt which may be added. Suchflavor and odor may be affected, but not to a serious degree,by any one or combination of the following: stems, sepals,leaves, or crushed seeds, cores; by immature, soured oroverripe tomatoes; from the effects of unsatisfactorypreparation, processing, or storage; or from any other factornot specifically mentioned.

(iv) Off flavor and odor means tomato puree flavor that fails tomeet the requirements of fairly good flavor and odor or whichhas a flavor and/or odor which is seriously objectionable.

(c) Factors rated by score points. The relative importance of each scoringfactor is expressed numerically on the scale of 100. The maximum numberof points that may be given each factor is:

§52.5087 Determining the rating for the factors which are scored.

The essential variations within each factor which is scored are so described that the valuemay be determined numerically. The numerical range within each factor is inclusive. (Forexample, 45 to 50 points means 45, 46, 47, 48, 49, or 50 points.)

§52.5088 Color.

(a) General. The amount if red in tomato puree is determined by comparing thecolor of the product, diluted, if necessary, with water to between 8.0 percentand 8.6 percent, inclusive, of natural tomato soluble solids (N.T.S.S.), withthat produced by spinning a combination of the following Munsell color discs:

Disc 1 - Red (5R 2.6/13) (glossy finish).

Disc 2 - Yellow (2.5YR 5/12) (glossy finish).

Disc 3 - Black (N1) (glossy finish).

Disc 4 - Grey (N4) (mat finish).

Such comparison is made under a diffused light source of approximately 250 foot-candle(candela) intensity and having a spectral quality approximating that of daylight under amoderately overcast sky, and a color temperature of 7,500 degrees Kelvin + 200 degrees.With the light source directly over the disc and product, observation is made at an angleof 45 degrees and at a distance of 12 or more inches from the product.

(b) Availability of color reference. The colors referred to in this section areavailable from the approved supplier under license from the U.S. Departmentof Agriculture:

(c) Use of electric color meters.

(1) Values that may be used for conversion to a numerical score pointcolor evaluation of the product, may be determined by any electroniccolor meter system approved by the United States Department ofAgriculture. Such values may be determined by electronic colormeters only on tomato puree that has a concentration of, or may bediluted with water to, 8.5 percent (+ 0.1 percent) natural tomatosoluble solids (N. T. S. S.).

(2) The values derived with the approved electronic color meter systemshall be resolvable into a calculated numerical score point by use ofany appropriate conversion formula that has been approved by theUSDA.

(d) Grade "A" classification.

(1) Tomato puree that has a good color may be given a score of 45 to 50points. Good color means a bright, typical, red tomato puree color.Such color when the product of the proper concentration andobserved as specified in this section, is as red as, or more red than,that produced by spinning the Munsell color discs in the followingcombinations or an equivalent of such composite color:

65 percent of the area of Disc 1;

21 percent of the area of Disc 2; and

14 percent of the area of either Disc 3 or Disc 4; or

7 percent of the area of Disc 3 and 7 percent of the areaof Disc 4, whichever most nearly matches theappearance of the sample.

(2) Any calculated numerical score of 45 points, for a product shall beequivalent to a visually evaluated color score of 45 points producedunder the conditions specified in paragraph (d) (1) of this section.Proportionately higher calculated numerical scores or visuallyassigned score points may be assigned to products of properconcentration which show more redness.

(e) Grade "C" classification.

(1) Tomato puree that has at least a fairly good color may be given ascore of 40 to 44 points. Tomato puree that falls into thisclassification shall not be graded above U.S. Grade C, regardless ofthe total score for the product ( this is a limiting rule). Fairly goodcolor means a typical red tomato puree color which may be slightlydull or may have a slight yellow, yellow-orange, or brownish cast.Such color, when the product is of proper concentration and observedas specified in this section, is as red as, or more red than, thatproduced by spinning the Munsell color discs in the followingcombinations or an equivalent of such composite color:

53 percent of the area of Disc 1;

28 percent of the area of Disc 2;

19 percent of the area of either Disc 3 or Disc 4; or

9-1/2 percent of the area of Disc 3 and 9-1/2 percent ofthe area of Disc 4, whichever most nearly matches theappearance of the sample.

(2) Any calculated numerical score of 40 points for a product of theproper concentration, shall be equivalent to a visually evaluated colorscore of 40 points produced under the conditions specified inparagraph (e) (1) of this section. Proportionately higher calculatednumerical scores or visually assigned score points may be assignedto products of proper concentration which show more redness.

(f) "Substandard" classification. Tomato puree that fails to meet therequirements of paragraph (e) of this section may be given a score of 0 to 39points and shall not be graded above Substandard regardless of the totalscore for the product ( this is a limiting rule).

§52.5089 Defects.

(a) General. This factor is concerned with the degree of freedom from defectssuch as dark specks or scale-like particles, seeds or objectionable tomatoparticles of seeds, objectionable tomato peel, harmless extraneous material,or any other similar substances.

(b) Grade "A" classification. Tomato puree that is practically free from defectsmay be given a score of 45 to 50 points. Practically free from defectsmeans that any defects present do not more than slightly affect theappearance or usability of the product.

(c) Grade "C" classification. Tomato puree that is fairly free from defects maybe given a score of 40 to 44 points. Tomato puree that falls into thisclassification shall not be graded above U.S. Grade C, regardless of the totalscore for the product (this is a limiting rule). Fairly free from defects meansthat any defect present may be noticeable but are not so large, so numerous,nor of such contrasting color or nature as to seriously affect the appearanceor usability of the product.

(d) "Substandard" classification. Tomato puree that fails to meet therequirements of paragraph (c) of this section may be given a score of 0 to 39points and shall not be graded above Substandard regardless of the totalscore for the product (this is a limiting rule).

§52.5090 Determining the grade of a lot.

The grade of a lot of tomato puree covered by these standards is determined by theprocedures set forth in the Regulations Governing Inspection and Certification ofProcessed Fruits and Vegetables, Processed Products Thereof, and Certain OtherProcessed Food Products (Sections §§ 52.1 to 52.83).

This is the second issue of the United States Standards for Grades of Tomato Saucepublished in the FEDERAL REGISTER October 18, 1994 (59 FR 52624) to becomeeffective November 17, 1994. This issue supersedes the first issue, as amended, whichhas been in effect since October 21, 1960.

Voluntary U.S. grade standards are issued under the authority of the AgriculturalMarketing Act of 1946, which provides for the development of official U.S. grades todesignate different levels of quality. These grade standards are available for use byproducers, suppliers, buyers, and consumers. As in the case of other standards for gradesof processed fruits and vegetables, these standards are designed to facilitate orderlymarketing by providing a convenient basis for buying and selling, for establishing qualitycontrol programs, and for determining loan values.

The standards also serve as a basis for the inspection and grading of commodities by theFederal inspection service, the only activity authorized to approve the designation of U.S.grades as referenced in the standards, as provided under the Agricultural Marketing Actof 1946. This service, available as on-line (in-plant) or lot inspection and grading of allprocessed fruit and vegetable products, is offered to interested parties, upon application,on a fee-for-service basis. The verification of some specific recommendations,requirements, or tolerances contained in the standards can be accomplished only by theuse of on-line inspection procedures. In all instances, a grade can be assigned based onfinal product factors or characteristics.

In addition to the U.S. grade standards, grading manuals or instructions for inspection ofseveral processed fruits and vegetables are available upon request for a nominalfee. These manuals or instructions contain detailed interpretations of the grade standardsand provide step-by-step procedures for grading the product.

Grade standards are issued by the Department after careful consideration of all data andviews submitted, and the Department welcomes suggestions which might aid in improvingthe standards in future revisions. Comments may be submitted to, and copies of standardsand grading manuals obtained from:

§52.2371 Product description.

Tomato sauce is the concentrated product prepared from the liquid extracted from mature,sound, whole tomatoes; the sound residue from preparing such tomatoes for canning; theresidue from partial extraction of juice; reconstituted or remanufactured tomato paste; orany combination of these ingredients to which is added salt and spices. One or morenutritive sweetening ingredients, a vinegar or vinegars, onion, garlic, or other vegetableflavoring ingredients may be added. The food is preserved by heat sterilization (canning),refrigeration, or freezing. When sealed in a container to be held at ambient temperatures,it is so processed by heat, before or after sealing, as to prevent spoilage. The refractiveindex of the tomato sauce at 20 degrees Celsius is not less than 1.3455.

§52.2372 Definitions of terms.

(a) Color means the amount of red in the tomato sauce as determined bycomparing the color of the product with that produced by spinning acombination of the following Munsell color discs:

Disc 1-Red (5R 2.6/13) (glossy finish);Disc 2-Yellow (2.5YR 5/12) (glossy finish);Disc 3-Black (N1) (glossy finish); andDisc 4-Gray (N4) (mat finish).

Any other method or device approved by the USDA which gives equivalentresults may be used.

(1) Good color means the color typical of tomato sauce that contains asmuch or more red than that produced by spinning the specifiedMunsell color discs in the following combinations or an equivalent ofsuch composite color:

65 percent of the area of Disc 1;21 percent of the area of Disc 2; and14 percent of the area of Disc 3 or Disc 4, or 7 percent of the area ofDisc 3 and 7 percent of the area of Disc 4, whichever most nearlymatches the reflectance of the tomato sauce.

(2) Reasonably good color means the color typical of tomato sauce thatcontains as much or more red than that produced by spinning thespecified Munsell color discs in the following combinations or anequivalent of such composite color:

53 percent of the area of Disc 1;28 percent of the area of Disc 2; and19 percent of the area of either Disc 3 or 4, or 9½ percent of the areaof Disc 3 and 9½ percent of the area of Disc 4, whichever most nearlymatches the reflectance of the tomato sauce.

(b) Consistency means the resistance of the tomato sauce to deformation orresistance to flow i.e., apparent viscosity and the tendency to hold its liquidportion in suspension.

(1) Good consistency means the tomato sauce is not excessively stiff,and flows not less than 4.0 cm nor more than 12.0 cm in 30 secondsat 20 degrees Celsius in the Bostwick consistometer. After placing atablespoon of tomato sauce on a shallow tray and observing theseparation of free liquid for 2 minutes, there shall be no more than 5mm (3/16 in) separation. The higher consistency tomato sauce willreceive the higher score points.

(2) Reasonably good consistency means the tomato sauce is notexcessively stiff, flows less than 4.0 cm but not less than 3.0 cm orflows more than 12.0 cm but not more than 15.0 cm in 30 seconds at20 degrees Celsius in the Bostwick consistometer. After placing atablespoon of tomato sauce on a shallow tray and observing theseparation of free liquid for 2 minutes, there shall be no more than 10mm (3/8 in) separation. Within these two ranges, tomato sauceapproaching "good consistency" will receive the higher score points.

(c) Defects mean the degree of freedom from defects such as dark brown orblack specks, whole seeds, tomato peel, core material or other similarsubstances. The specific requirements for defects are included in Table I ofSection 52.2375. This factor is evaluated by observing a layer of 100 g (3.5oz) of product which is spread over a smooth white surface area of at least968 sq cm (150 sq in).

(1) Practically free of defects means that any defects present in thesauce do not exceed the requirements for "practically free" in TableI of Section 52.2375.

(2) Reasonably free of defects means that any defects present in thesauce do not exceed the requirements for "reasonably free" in TableI of Section 52.2375.

(d) Finish.

(1) Good finish means that the product is evenly comminuted, hasuniform, smooth texture, and is free from lumps.

(2) Poor finish means that the product fails to meet the definition of"good finish."

(e) Flavor and odor means the flavor and odor characteristic of tomato sauceproduced from good quality ingredients that have been properly processed.

(1) Good flavor and odor means a good distinct flavor and odorcharacteristic of good quality ingredients. Such flavor and odor is freefrom scorching or any other objectionable flavor or odor.

(2) Reasonably good flavor and odor means a flavor and odorcharacteristic of the ingredients in which there may be slight traces ofundesirable flavor, such as scorched, bitter, or astringent flavor, butis free from objectionable off-flavors and odors.

§52.2373 Fill of container.

Except for frozen tomato sauce and tomato sauce packaged in individual serving-sizepackages containing 56.7 grams (2 ounces) or less, each container of tomato sauce shallbe filled as full as practicable without impairment of quality and shall occupy not less than90 percent of the capacity of the container.

§52.2374 Ascertaining the grade and factors of quality.

The grade of tomato sauce is ascertained by considering the factor of finish, which is notscored, and the ratings for the factors of color, consistency, defects, and flavor and odor,which are scored. The relative importance of each factor which is scored is expressednumerically on the scale of 100. The maximum number of points that may be given foreach factor is:

envase y tamaño de éstos para ser usados en la exportación. El formulario usado depende del proceso del producto. El establecimiento manufacturero puede definir el proceso de elaboración y determinar el formulario correcto que va a usar. Los formularios son: Form FDA- 2541a (para todos los métodos, excepto ácido bajo aséptico) y Form FDA-2541c (sistemas de empaque para ácido bajo aséptico). P. ¿Es necesario que el proceso de información programado sea registrado con la FDA antes de importar el producto? R. Sí, el proceso de información programado debe ser registrado con la FDA antes de ofrecer el producto para importación en los Estados Unidos. Técnicos de la FDA especializados en alimentos revisan y redactan toda la información del proceso programado conforme a la ley en lo que respecta a precisión e integridad. Esta importante actividad demanda mucho cuidado. Debido al elevado número de formularios, el proceso de redacción puede demorar varias semanas. P. ¿Puede el importador mismo registrar el proyectado proceso informativo? R. La FDA recomienda que el establecimiento procesador complete los formularios para archivar. La terminación de estos formularios requiere conocimientos de los requisitos de elaboración termal, y de la información científica relacionados con la resistencia al calor de la bacteria dañina de los alimentos. En algunos casos, usted puede desear registrar la información como representante autorizado del establecimiento. La FDA exige una carta del establecimiento elaborador, en la que autoriza a usted como su representante para archivar esta información. La carta deberá estar adjunta a los formularios y demás papeles. Antes de presentar los formularios a la FDA, por favor autorice toda la información para ser archivada. La naturaleza técnica del proceso informativo para ser archivado y la presente localización del establecimiento lejos de su oficina, hace muy importante esta comunicación .

P. El establecimiento elaborador me ha dicho que ellos presentaron a la FDA los papeles y documentos necesarios para el producto que quiero importar. ¿Por qué entonces, ha sido detenido el cargamento? R. Tecnólogos de alimentos de la FDA examinan cada proceso sometido a la aprobación de la FDA, en busca de errores o información incompleta en la documentación. Debido a la seriedad que implica información dudosa o incorrecta, los formularios son devueltos a la firma interesada para esclarecimiento y/o terminación. Hasta que las formas están en completo orden, no son consideradas ni aprobadas por la FDA. P. ¿Debo esperar de la FDA un certificado por el proceso programado que he sometido a la FDA para ser aprobado? R. No, la FDA no certifica el proceso de elaboración. El elaborador de alimentos tiene la responsabilidad de obtener los procesos programados establecidos por una entidad competente y de asegurarse que los procesos indicados son cumplidos. P.¿Hay algunos otros requisitos sobre alimentos enlatados de ácido bajo o acidificados fuera del registro de establecimientos y archivo del proceso programado? R. Sí. Los alimentos de ácido bajo enlatados y los acidificados que han sido importados, están sujetos a todos los requisitos bajo la Ley Federal de Alimentos, Drogas y Cosméticos y a El Acto Equitativo de Empaquetado y Etiquetado. Estas leyes exigen que los alimentos sean sanos, higiénicos y saludables y que las etiquetas sean honestas e informativas. La elaboración de alimentos de ácido bajo envasados, debe cumplir con los requisitos del Título 21 del Código de Regulaciones Federales, Parte 113; Reglas Prácticas en la Fabricación, Almacenamiento y Embalaje de Alimentos Humanos, (21 CFR Part 113). La elaboración de los alimentos acidificados debe cumplir con los requisitos del mismo Título, Parte 114 (21 CFR 114).

Asegúrese de ponerse en contacto con la oficina de la FDA más cercana entre las listadas en la página siguiente, para obtener información acerca del archivado del formulario FDA-701 o el formulario de aduana 3461 antes de que el envío llegue al puerto de entrada. Siendo que el formulario FDA-701 contiene información de importancia acerca de su importación, se debe tener cuidado especial y llenar correcta y completamente todas las áreas. Estas precauciones al completar los formularios, ayudará a evitar demoras en el puerto de entrada. Preste particular atención a estos detalles especiales en el formulario FDA-701 (números indican las áreas en el formulario).

6. Número del Establecimiento Envasador de Alimentos (FCE #)

Incluya el FCE # al lado del nombre del manufacturero y la dirección en el Bloque 5. La FDA asigna este número al registrar el establecimiento elaborador. Si diferentes productos elaborados están contenidos en el envío indique en el Bloque 7 el FCE # que corresponde al producto apropiado. El FCE # puede ser obtenido de los establecimientos elaboradores.

7. Descripción General de la Remisa

El número de piezas y de cajas del producto envíadas en el embarque. Lista del producto y dimensiones de cada artículo. El nombre del producto debe ser el mismo que el mencionado en los formularios archivados. Si el manufacturero no aparece en el Bloque 5, delinee el FCE # al lado de cada producto.
