ADVICE FORTRAVELLERSLocal Safety Advice and EmergencyContact DetailsBefore engaging in sports or leisure activitiescovered under this Policy, You should ensure thatall reasonable local safety advice has beenobtained and is followed. This includes obtainingdetails of local emergency mountain/search andrescue services and taking such details with You.ACE Assistance will provide all reasonablemedical and repatriation assistance services asdetailed in this Policy and will work with localrescue services. It is not responsible for anysearch and rescue or mountain rescue i.e. therecovery of Persons Insured from mountains,remote areas or other similar locations.

It is Your responsibility to make all arrangementswith the relevant mountain rescue organisation (orequivalent rescue organisations/mountainguides/local authorities or other public or privateorganisations) responsible for retrieval from themountains, remote locations or any similarenvironment where injury, illness or incapacityarises. In the event of illness, injury or incapacityarising whilst engaging in sports or leisureactivities covered under this Policy, inmountainous, remote or similar locations, You orone of Your party need to make direct contactwith the relevant rescue organisation(s), toarrange rescue and transport to a suitablemedical facility. ACE Assistance should not becontacted to arrange rescue as they are not ableto provide this service.

Once rescue has been arranged ACE Assistanceshould be notified at the earliest practicableopportunity and will take over responsibility forcase management once You have arrived at asuitable medical facility.

ACE Assistance will then be able to provide Youwith the services detailed under “MedicalAssistance and Referral Services” on page 14.

EHIC If You are travelling to Europe, You should obtaina European Health Insurance Card (EHIC) andtake it with You when You travel.

Waiver of Medical ExcessIf You have a valid claim for medical expensesunder this Policy, which is reduced by Your� using an EHIC; or � taking advantage of a reciprocal healthagreement with Your Home Country; or

� using Your private medical insurance at thepoint of treatment, We will NOT deduct theExcess.

Your Policy and Policy ScheduleThis is Your Travel Insurance Policy Document.Your Policy Document and Policy Schedule set outthe terms of Your contract with Us and contain fulldetails of � what is covered;� what is not covered;� the conditions that apply;� how to get medical assistance� how to make a Claim.Please:� check them carefully to ensure that the coverprovided meets Your needs;

Persons CoveredTo be covered under this Policy, You MUST:1. on the date You purchase cover, be under 70years of age in respect of the Travel productonly, or under 80 years of age for the Trek,Rock or Alpine & Ski (unless We have agreedin writing to provide cover beyond this age andYou have paid the appropriate additionalpremium due)

2. be continually A. resident in the United Kingdom, Jersey orthe Republic of Ireland; and

B. registered with a Doctor practising in theUnited Kingdom, Jersey or the Republic ofIreland;

C. a BMC/MCofS/MI member (or a member ofan affiliated club) or the Partner or Child ofa member who is also covered under thisPolicy;

throughout the Period of Insurance;3. at the time You applied for this Policy, havebeen able to make the statements We askedYou to make, and which appear in Your PolicySchedule under the Section entitled “Yourdeclaration to Us”.

4. not be partaking in any kind of research, surveyor ecological work, unless it is first agreed andacknowledged in writing by Us.

5. not be involved in any work as support staff; amarshall or as part of a medical team, unless itis first agreed and acknowledged in writing byUs.

6. not be receiving sponsorship; support orfinancial remuneration from a company ororganisation, unless it is first agreed andacknowledged in writing by Us.

7. not be travelling on a trip where the mainpurpose of that trip is to supply services directlyconnected to your occupation or profession,unless it is first agreed and acknowledged inwriting by Us.

ChildrenChildren will only be covered under a Multi TripPolicy when1. they are travelling with an adult named under

Persons Insured on the Policy Schedule; or2. travelling with and under the supervision ofanother adult Insured under a BMC TravelInsurance Policy, who is responsible for theircare for the length of the Journey.

Journeys Covered The type of Policy You have, Single Trip or MultiTrip, is shown on the Policy Schedule.

1. Single Trip PolicyA Single Trip Policy covers a Journey duringthe Period of Insurance that takes placeentirely within the Area of Travel stated in thePolicy Schedule.

2. Multi Trip PolicyA Multi Trip Policy covers all Journeys duringthe Period of Insurance provided they meetthe following conditions:A. each Journey MUST take place entirelywithin the Area of Travel stated in the PolicySchedule.

B. No single Journey Abroad exceeds the Maximum Duration Any One JourneyAbroad stated in the Policy Schedule.

C. You do not exceed the Total Number of

Days Abroad stated in the Policy Schedule.D. each Journey in Your Home Countryincludes at least 1 night spent in paidaccommodation that is booked before theJourney begins; or if the sole purpose of the trip is to take part in a sport or leisureactivity for which You have bought coverunder one of the Optional Sports andLeisure Activities Extensions under this Policy.

Journeys Not CoveredWe will not cover any Journey: � for which You have failed to purchaseinsurance cover for the entire duration of Yourtrip, or that has not started in Your HomeCountry, or which is a one way trip that doesnot end in Your Home Country or any part ofa Journey which is outside of the Area ofTravel stated in the Policy Schedule.

� that involves You travelling specifically toobtain medical, dental or cosmetic treatment

� where sports or activities are the main focus of,or form a significant proportion of YourJourney (unless You have bought cover underthe appropriate Optional Sports and ActivitiesExtension).

� where the primary purpose is to:1. set or break a speed, distance, enduranceor other record;

2. to participate in a commercial film,documentary or other programme; or

3. to test a product unless this has beendeclared in advance to Us and We haveagreed in writing to provide cover for suchactivities.

� that is solely a pleasure cruise, unless declaredto Us in advance and We have agreed inwriting to cover such Journey.

� that involves business or work of anydescription, unless declared to Us in advanceand We have agreed in writing to cover suchJourney.

� where, on the date it is booked (orcommencement of the Period of Insurance iflater), You or Your Travelling Companionare aware of any reason why it might becancelled or Curtailed, or any othercircumstance that could reasonably beexpected to result in a Claim under this Policy

� where Your destination is an area where theForeign and Commonwealth Office orDepartment of Internal Affairs has advised

against ‘all travel’; or that part of any Journeywhich involves travel within an area where theForeign and Commonwealth Office orDepartment of Internal Affairs has advisedagainst ‘all travel’ (all cover under this Policywill cease immediately if You enter such area,will recommence immediately when You leavesuch area and excludes any claims arisingdirectly or indirectly out of or in connectionwith any event or circumstances which occur insuch area). If You are not sure whether there isa travel warning for Your destination, pleasecheck their website www.gov.uk/foreign-travel-advice or www.dfa.ie/travel/traveladvice (Tel: + 353 (0) 1 408 2000)

The Cover ProvidedThe Cover You have bought is shown in YourPolicy Schedule.

Your Policy Schedule shows the maximum amountWe will pay under each Section, and whether Youhave bought cover under an Optional Sports andActivities Extension and/or the ProfessionalExtension.

All cover Sections provide cover for JourneysAbroad. If You have bought a Multi Trip Policy(or a Single Trip Policy for a Journey within YourHome Country), the following Sections alsoprovide cover for Journeys within Your HomeCountry:

Section 1. Cancellation; andSection 4. Personal Property; andSection 6. Money; and Section 7. Personal Accident; and Section 8. Curtailment; andSection 9. Personal Liability; andSection 15. Hijack; and

if You have bought cover under an OptionalSports and Activities Extension and/or theProfessional Extension, it will also provide coverfor Journeys within Your Home Country.

When You Are Covered 1. Cancellation cover under Section 1 beginswhen a Journey is booked, if this Policy is inforce at the time of booking, or from the Dateand Time Stated in the Policy Schedule, if later,and ends when You leave Home to commenceYour Journey.

2. Insurance cover under all other Sectionsoperates for a Journey that takes place duringthe Period of Insurance and includes traveldirectly to and from Your Home providedYour return Home is completed within 24hours of YourA. return to Your Home Country; orB. departure from pre-booked accommodationfollowing a Journey within Your HomeCountry.

When Cover Will End Automatically 1. Single Trip PoliciesAll cover will end when the Period ofInsurance ends, or when You return to YourHome at the end of Your Journey, or 24hours after You return to Your Home Countryat the end of Your Journey, whichever occursfirst. This includes where You temporarily returnto Your Home Country for any reason beforereturning overseas to continue Your originaltrip. Where this happens, You will havecommenced a new Journey. You must contactUs to arrange additional cover after havingreturned to Your Home Country or You willnot have any cover for the second part of Yourtrip.

2. Multi Trip PoliciesA. Your cover will end on the first date Yourpremium is due after Your 80th birthday (orany later date until which We have agreedin writing to provide cover and You havepaid the appropriate additional premium)

B. Cover for Children will end on the first datepremium is due after their 18th birthday orwhen any of the following occur, if earlier: � Your cover ends; or � Your Child gets married; or� Your Child stops being dependent on

You.

If a Journey continues beyond the expiry date ofthis Policy or a Journey has been booked whichbegins after the expiry date of this Policy You mustrenew Your Policy or buy a new Policy if You wishcover to continue. If You do not renew Your Policyor buy a new Policy, the remaining period of theJourney or any future Journey which has beenbooked will not be covered after the expiry dateof this Policy.

Automatic Extension of the Period of InsuranceIf You cannot return Home from a Journey beforeYour cover ends, Your Policy will automatically beextended at no extra charge for:� up to 14 days if any Public Transport inwhich You are booked to travel as a ticket-holding passenger is unexpectedly delayed,cancelled or Curtailed because of adverseweather, industrial action, or mechanicalbreakdown.

� up to 30 days (or any longer period agreed byUs in writing before this automatic extensionexpires) if You cannot return Home Due To:1. You being injured or becoming ill or beingquarantined during a Journey

2. You being required to stay on medicaladvice with another Person Insured namedon Your Policy Schedule who is injured orbecomes ill or is quarantined during aJourney

Health Declaration and Change of HealthPlease read the following carefully as it may affectthe cover We provide and Your ability to Claimunder Your Policy.

At the time You applied for this Policy, You madethe statements We asked You to make, and whichappear in Your Policy Schedule under the Sectionentitled “Your declaration to Us”. These includedstatements relating to the health of each PersonInsured under this Policy.

If You have a Multi Trip Policy, We also told Youthat You need to be able to confirm thesestatements before You book any Journey, andthat if You can't, You must contact Us.If a Person Insured’s health changes after Youmade these statements and You can no longermake them, You MUST let Us know immediately if: � You have reason to believe that Your Journeymay need to be cancelled or Curtailed; or

� a Doctor has advised You or any other PersonInsured against travelling or You believewould do so if his/her advice was sought; or

� You or any other Person Insured has anymedical condition for which You or they havereceived a terminal prognosis; or

� You have a Multi Trip Policy which expiresbefore Your departure date;

Provided Your Journey was booked before thechange of health occurred, You may have a validcancellation Claim if You have to cancel YourJourney, or We cannot provide the cover Yourequire.

If You have a Multi Trip Policy and book a newJourney without telling Us that You cannot makethese statements, We will not cover any ClaimDue To any Person Insured’s change of health. IfYou tell Us about a Person Insured’s change ofhealth We will tell You if We can provide cover forany Claim Due To their change of health, and ifso, whether any additional premium is required oradditional terms apply. If We agree to cover anyClaim Due To a Person Insured’s change ofhealth, We will confirm this in writing.

If You do not let Us know about a PersonInsured’s change of health, You may not have thecover You need and it may invalidate Your Policyor reduce the amount of any Cancellation Claim.

Health Exclusions1. Exclusions relating to Your health and thehealth of other Persons Insured:This Policy contains exclusions relating to Yourhealth and the health of other Persons Insured.These appear under the General Exclusions.

2. Exclusions relating to the health of any personon which Your Journey depends. This Policy contains exclusions relating to thehealth of any person on which Your Journeydepends. These exclusions appear under the � Cancellation Section; and� Curtailment Section.

Reciprocal Health Agreements andWaiver of Excess

If You intend to travel to:1. Europe (all EU countries plus Iceland,Liechtenstein, Norway and Switzerland); and A. You should obtain a European HealthInsurance Card (EHIC) and take it with Youwhen You travel. This will allow You tobenefit from the reciprocal healtharrangements, which exist with thesecountries.

B. are resident in Jersey, You may be entitled tomedical treatment at a lower cost or free ofcharge in some countries. You can checkthis with the Social Security Department(contact details below).

2. AustraliaYou MUST register with Medicare if Yourequire medical treatment in Australia. Sometreatment charges may be partially refunded bythe Medicare scheme. You must make YourClaim while You are still in the country.

If You do not, We may reject Your Claim orreduce the amount We pay You.

3. Other countries outside the European EconomicAreaYou may be entitled to free healthcare if Youare travelling to other countries outside theEuropean Economic Area (EEA) provided thatthe country in question has a reciprocalhealthcare arrangement with Your HomeCountry.

If You have a valid Claim for Medical Expensesunder this Policy, which is reduced by Your� using an EHIC; or � taking advantage of a reciprocal healthagreement with Your Home Country; or

� using Your private medical insurance at thepoint of treatment, We will NOT deduct theExcess.

Sports and Leisure ActivitiesCovered Automatically You are automatically covered when participatingin any of the sports and activities listed below,during Your Journey, subject to any provisions,limitations or exclusions noted by the relevantsport or activity and provided that:

� You participate on a recreational basis only� You have not been advised by a Doctoragainst participating in such sport or activity;

� You wear the recommended/recognised safetyequipment and;

� You follow safety procedures, rules andregulations as specified by the activityorganisers/providers; and

� It is not the main focus of, or does not form asignificant proportion of, Your Journey.

Optional Sports and LeisureActivities ExtensionsIf an Optional Sports and Leisure ActivitiesExtension is shown as covered on Your PolicySchedule the above list is extended to include theappropriate Sports and Leisure Activities subject toany provisions, limitations or exclusions noted bythe relevant sport or activity and provided that:� You participate on a recreational basis only� You have not been advised by a Doctoragainst participating in such sport or activity;

� You wear the recommended/recognised safetyequipment and;

� You follow safety procedures, rules andregulations as specified by the activityorganisers/providers.

Extension 1. Trek - Altitude Limit 5,000metres above sea level

Making a Claim

In the event that You need to make a Claim under this Policy

1. If You are injured or become ill Abroad andneed:A. hospital in patient treatment, specialisttreatment, medical tests, scans or to bebrought back to Your Home Country:

You MUST contact ACE Assistanceimmediately on:

If ACE Assistance are not contacted, We mayhave the option of rejecting Your Claim orreducing its payment.

B. medical treatment other than under A.above:You MUST follow the procedure detailedunder Condition 3: All other Claims. Youcan make use of the services provided byACE Assistance, as appropriate (these aredetailed on Page 14 of this Policy).

C. medical treatment in Australia:You MUST follow the appropriate proceduredetailed under A or B above. You MUSTalso register with Medicare. Some treatmentcharges may be partially refunded by theMedicare scheme and You must make YourClaim while You are still in the country).

If You do not, We may reject Your Claim orreduce the amount We pay You.

2. Search and RescueContact the relevant authorities as per theadvice under the Local Safety Advice andEmergency Contact Details on page 4.

3. All other ClaimsYou MUST notify Us immediately by telephone,or in writing within 30 days of becoming awareof anything likely to result in a Claim.

A personal representative can do this for Youif You cannot.

Reporting Lost, Stolen or DamagedProperty1. Lost or stolen Personal Property, Money,passport or driving licence You MUST notify the local police as soon aspossible after discovery and � if lost or stolen from a hotel, You MUSTnotify hotel management; and

� if Money lost or stolen includes traveller’scheques, You MUST notify the local branchor agent of the issuing company; and

� provide Us with a copy of the originalwritten reports.

2. Personal Property lost, stolen or damagedwhilst in the custody of an airline or othercarrier.

You MUST notify the airline or other carrier inwriting within 24 hours of discovery andprovide Us with a copy of the original writtenreports.

Complying with Special ConditionsYou MUST comply with the Special Conditionsdetailed in the relevant Section of this Policy.

Other Insurance If there is another insurance Policy in force(whether in Your name or otherwise) at the time ofany incident which results in a Claim under thispolicy which does (or would but for the existenceof this Policy) cover the same loss, damage,expense or liability, We will not pay more thanOur proportionate share of such Claim. Thiscondition shall not apply to any Claim underSection 7 Personal Accident or Section 9 PersonalLiability.

Supplying Details & DocumentsYou MUST supply at Your own expense anyinformation, evidence and receipts We requireincluding medical certificates signed by a Doctor,police reports and other reports.

Your Duty to Avoid or Minimise a ClaimYou and each Person Insured must take ordinaryand reasonable care to safeguard against loss,damage, Accident, injury or illness as though Youwere not insured. If We believe You or anyPerson Insured have not taken reasonable careof property, the Claim may not be paid. The itemsinsured under this Policy must be maintained ingood condition.

Protecting PropertyYou MUST take all reasonable steps to protect anyitem or property from further loss or damage andto recover any lost or stolen article.

InterestWe will not pay interest on any benefit payableunder this Policy unless payment has beenunreasonably delayed by Us following receipt ofall the required certificates, information andevidence necessary to support the Claim.

Sending Us Legal DocumentsYou MUST send Us any original writ, summons,legal process or other correspondence received inconnection with a Claim immediately it isreceived and without answering it.

Things You MUST NOT DoYou MUST NOT do the following without Ourwritten agreement:1. Admit liabilityadmit liability, or offer or promise to make anypayment; or

2. Dispose of itemssell or otherwise dispose of any item orproperty for which a Claim is being made, orabandon any item or property to Us.

Recognising Our Rights You and each Person Insured must recogniseOur right to:1. Pay, repair or replacechoose either to pay the amount of a Claim(less any Excess and up to any Policy limit) orrepair, replace or reinstate any item orproperty that is damaged, lost or stolen;

2. Inspect & dispose of itemsinspect and take possession of any item orproperty for which a Claim is being made and handle any salvage in a reasonablemanner;

3. Handle a Claim in Your nametake over and deal with the defence orsettlement of any Claim in his or her name andkeep any amount recovered;

4. Pay in sterlingsettle all Claims in pounds sterling;

5. Be reimbursed promptlybe reimbursed within 30 days for any costs or expenses that are not insured under thisPolicy, which We pay to You or on Yourbehalf;

6. Receive medical certificatesbe supplied at Your expense with appropriateoriginal medical certificates where requiredbefore paying a Claim.

7. Carry out medical examinationsrequest and carry out a medical examinationand insist on a post-mortem examination, if the law allows Us to ask for one, at Ourexpense.

Dishonesty and Fraudulent Claims We will not be liable to pay a Claim and maycancel the Policy immediately in either of thefollowing circumstances 1. Dishonestyif a Claim is in any way dishonest; or

2. Fraudif You, any other Person Insured or anyone

acting on Your or their behalf, uses fraudulentmeans to benefit under this Policy.

Paying Claims1. DeathA. If You are 18 years old or over, We will paythe Claim to Your estate and the receiptgiven to Us by Your personalrepresentatives shall be a full discharge ofall liability by Us in respect of the Claim.

B. If You are aged under 18 years andcovered under this Policy as the Partner ofa Person Insured, We will pay any Claimfor Accidental death to Your Partner. In allother circumstances We will pay any Claimfor Accidental death to Your Parent orLegal Guardian. Your Partner’s or Parentor Legal Guardian’s receipt shall be a fulldischarge of all liability by Us in respect ofthe Claim.

2. All other ClaimsA If You are 18 years or over, We will pay the

Claim to You and Your receipt shall be afull discharge of all liability by Us in respectof the Claim.

B. If You are aged under 18 years andcovered under this Policy as the Partner ofa Person Insured, We will pay the Claimto Your Partner for Your benefit. In all othercircumstances We will pay the appropriatebenefit amount to Your Parent or LegalGuardian for Your benefit. Your Partner’sor Parent or Legal Guardian’s receiptshall be a full discharge of all liability by Usin respect of the Claim.

1. Medical Assistance and ReferralServices

If You are injured or become ill Abroad YouMUST contact ACE Assistance immediately if You need hospital in patient treatment, specialisttreatment, medical tests, scans or to be broughtback to the Your Home Country.

If You cannot do this Yourself, You MUST arrangefor a personal representative to do this for You. If this is not possible because Yourcondition is serious, You or Your personalrepresentative MUST contact ACE Assistanceas soon as possible.

In all other circumstances You are entitled to usethe services of ACE Assistance detailed below, as appropriate.

ACE Assistance - Medical Assistance and ReferralServices can help with A. Payment of bills - if You are admitted to hospital

Abroad, the hospital or attending Doctor(s)will be contacted and payment of their fees upto the Policy limits may be guaranteed so thatYou do not have to make the payment fromYour own funds.

B. Being brought back to Your Home Country - ifthe Doctor appointed by ACE Assistancebelieves treatment in Your Home Country ispreferable, transfer may be arranged byregular scheduled transport services, or by airor road ambulance services if more urgenttreatment and/or specialist care is requiredduring the Journey.

C. Provision of medical advice – I. if You require emergency consultation ortreatment Abroad, ACE Assistance willprovide the names and addresses of localDoctors, hospitals, clinics and dentists, andits panel of Doctors will provide telephonemedical advice.

II. if necessary ACE Assistance will make

D. Unsupervised Children - if a Child is leftunsupervised on a trip Abroad because You orYour Partner (if shown as insured on the PolicySchedule) is hospitalised or incapacitated, ACEAssistance may organise his or her return Home,including a suitable escort when necessary.

Please note that whilst You will not be charged foradvice or assistance, You will be responsible forpaying fees and charges for services provided toYou if they are not covered as part of a validClaim under this Policy.

2. Personal Assistance Services� The services under this Section are provided by

ACE Assistance are only available during aJourney Abroad.

� These are non-insured facilitation servicesmaking use of ACE Assistance’s wideexperience and contacts. Any costs incurrede.g. for drug replacements must be reimbursedto ACE Assistance unless they form part of asuccessful Claim under an appropriate Sectionof this Policy.

ACE Assistance - Personal Assistance Services canhelp with A. Transfer of emergency fundsTransfer of emergency funds up to £250 per tripif access to normal financial/bankingarrangements are not available locally. In orderto reimburse ACE Assistance You mustauthorise ACE Assistance to debit Your creditor charge card with the amount of the transfer,or make alternative arrangements to deposit thefunds in ACE Assistance’s account in theUnited Kingdom. If the emergency transfer isneeded Due To theft or loss of personal money,a Claim may be made under the Policy.

B. Message relayTransmission of urgent messages to relatives orbusiness associates if medical or travelproblems disrupt a Journey travel schedule.

C. Drug replacementAssistance with the following: I. replacement of lost drugs or other essentialmedication, or lost or broken prescriptionglasses or contact lenses, which You cannotget Abroad.

II. sourcing and delivery of compatible bloodsupplies. ACE Assistance will not pay forthe replacement costs of any item or the

costs of sourcing and delivering bloodsupplies.

D. Tracing lost Personal PropertyTracing and re-delivery of Personal Propertythat has been lost or misdirected in transit if thecarrier has failed to resolve the problem. (Pleasenote: You must produce written confirmation ofthe loss from the carrier, for example an airlinewould provide a document known as a propertyirregularity report).

E. Replacement travel documentsAssistance with the replacement of lost or stolentickets and travel documents, and referral tosuitable travel offices. ACE Assistance will notpay for any item.

F. Lost credit, debit, payment, pre-payment andcharge cards Giving advice on how to contact theappropriate card issuers if credit debit,payment, pre-payment and/or charge cards arelost or stolen. Data Protection legislationprevents ACE Assistance from contacting thecard issuers directly.

G. Emergency translation facility A translation service if the local provider of anassistance service does not speak English.

H. Legal helpReferral to a local English-speaking Lawyer,Embassy or Consulate if legal advice is needed,and arrangement of payment of reasonableemergency legal expenses or bail, against aguarantee of repayment.

I. Children at HomeMedical advice and monitoring, until You orYour Partner return Home, if a Child who hasbeen left in Your Home Country becomes ill orsuffers injury.

GENERAL EXCLUSIONS(Exclusions that apply to the whole Policy)

We will not be liable to make any payment underthis Policy where 1. Eligibility

You do not meet the eligibility criteria detailedunder “Persons Covered” on Page 6 of thisPolicy

2. Children travelling alone under a Multi Trip PolicyYou are a Child covered under a Multi Trippolicy travelling or booked to travel without anadult Person Insured named on the Policy

Schedule or travelling without being under thesupervision of another adult Insured under aBMC Travel Insurance Policy, who isresponsible for Your care for the length of theJourney.

3. Journeys not covered Your Journey is described under “JourneysNot Covered”, on Page 6 of this Policy.

4. any Claim is Due To: A. Excluded medical conditions orcircumstancesany medical condition detailed in the PolicySchedule under “Your declaration to Us”which existed at the time this Policy waspurchased, unless it has been declared toUs and We have agreed in writing toprovide cover for it.

B. Change of healtha change of health or where the cost of anyClaim is increased Due To a change ofhealth if the Person Insured has notfollowed the procedure detailed under“Health Declaration and Change of Health”on Page 8 of this Policy.

C. Not taking medication or treatment a medical condition for which a PersonInsured chose not to take medication orother recommended treatment as prescribedor directed by a Doctor.

D. Tropical disease where not vaccinatedany Claim Due To a tropical diseasewhere the Person Insured has not had thevaccinations or taken the medicationrecommended by the World HealthOrganisation or required by the authoritiesin the country being visited, unless theyhave written confirmation from a Doctorthat they should not be vaccinated or takethe medication, on medical grounds.

E. Anxiety, stress, depression, phobia, mentalor nervous disordera Person Insured suffering from anyanxiety state, stress, depression, or anyphobia or mental or nervous disorder, thatwas diagnosed before the Period ofInsurance commenced or Your Journeywas booked (whichever is later).

F. Excluded sports and activities You taking part in any of the followingwhile on a Journey:I. any sports or activities not specificallycovered under “Sports and LeisureActivities Covered Automatically” or

under any Optional Sports and LeisureActivities Extension for which You havebought cover, as shown on Your PolicySchedule

II. any sports or activities in a professionalcapacity or for financial reward or gain– provided that this exclusion will notapply to activities covered under the“Professional Extension” if, the PolicySchedule shows that You have boughtthe Professional Extension.

III. competitive winter sports IV. air travel unless You are travelling as afare paying passenger ina. a fixed wing aircraft which isprovided by a licensed airline or aircharter company; or

b. professionally operated air transport(other than as described under Itema. above), flown by a qualified person, where: i. it is specifically covered as anactivity under “Sports and LeisureActivities Covered Automatically”or under any Optional Sports and Leisure Activities Extension forwhich You have bought cover, asshown on Your Policy Schedule;or

ii. it is necessary to enable You totravel to an area inaccessible bya fixed wing aircraft to engage inan activity covered under thisPolicy.

V. business or work of any descriptionother than where covered under the“Professional Extension” or whereotherwise declared to and accepted byUs in writing .

G. Currencycurrency exchange.

H. Illegal actsany illegal act by You.

I. Misuse of alcohol/drugsI. Your misuse of alcohol or solvents; or ingesting drugs except for drugs which are properly prescribed; or

II. Your driving a vehicle of any kind whilstthe alcohol level in Your blood exceeds the legal limit of the country where Youare driving.

J. Suicide/self-injuryI. Your suicide, attempted suicide ordeliberate self-inflicted injury regardless

K. RadiationI. ionising radiation or contamination byradioactivity from any nuclear fuel orfrom any nuclear waste resulting fromthe combustion of nuclear fuel; or

II. the radioactive, toxic, explosive or otherhazardous properties of any explosivenuclear assembly or nuclear componentof such assembly.

L. Sonic wavespressure waves from aircraft and otherairborne devices travelling at sonic orsupersonic speeds.

M.WarWar or any act of War whether War isdeclared or not.

N. Financial Failureany loss or expense arising directly orindirectly or in connection with the financialfailure of a tour operator, travel agent,cruise line, ferry operator, airline,accommodation provider, transportation,coach or train provider, or excursion andticketing operator.

O. Withdrawal of Licencethe withdrawal of any operating licencefrom a transport, tour or accommodationprovider.

5. Loss, damage, injury expense or liability arisesdirectly or indirectly out of or in connectionwith any event or circumstances which occurwhilst You are travelling within an area wherethe Foreign and Commonwealth Office orDepartment of Foreign Affairs has advisedagainst ‘all travel’.

COVERSECTION 1. CANCELLATION

What is coveredWe will refund Your unused travel and/oraccommodation costs (and instructor and coursefees, ski hire, ski school and ski lift passes,provided that the appropriate Optional Sports andLeisure Activities Extension is shown as covered onthe Policy Schedule) up to the amount stated in thePolicy Schedule which You have paid or are

contracted to pay and which cannot be recoveredfrom any other source if it becomes necessary tocancel a Journey Due To: 1. You, Your Travelling Companion orsomeone You have arranged to stay with onJourney; A. dying; orB. being seriously injured; or C. suffering sudden illness; orD. suffering from complications in pregnancy(as diagnosed by a Doctor or specialist inobstetrics); or

E. being compulsorily quarantined on theorders of a treating Doctor;

provided that such cancellation is confirmed asmedically necessary by the treating Doctor.

2. You or Your Travelling Companion beinginjured to such an extent that You or they areunable to safely participate in a sport oractivity for which You or they are coveredunder a BMC Travel insurance Policy under anOptional Sports and Leisure ActivitiesExtension, participating in which was theprimary purpose of the Journey; provided thatsuch cancellation is confirmed as medicallynecessary by the treating Doctor.

3. Your or Your Travelling Companion’sImmediate Family Member or CloseBusiness Colleague; A. dying; orB. being seriously injured; or C. suffering sudden and serious illness; orD. suffering from complications in pregnancy(as diagnosed by a Doctor or specialist inobstetrics)

provided that such cancellation is confirmed asmedically necessary by a Doctor.

4. the compulsory jury service or subpoena ofYou or Your Travelling Companion.

5. You or Your Travelling Companion beingmade redundant and registered asunemployed.

6. serious fire, storm or flood damage to YourHome or Your Travelling Companion’shome; provided that such damage occurswithin the 7 days immediately prior tocommencement of Your Journey.

7. the police requiring You or Your TravellingCompanion’s presence following a burglaryor attempted burglary at Your Home or YourTravelling Companion’s Home.

What is not covered1. Any Claim Due ToA. any serious, chronic or recurring medicalcondition diagnosed before Your Journeywas booked (or commencement of thePeriod of Insurance if later), and whichcould result in Your having to cancel YourJourney, affecting I. Your Travelling Companion, unless heor she a. is a Person Insured under this oranother BMC Travel InsurancePolicy; and

b. has declared that medical conditionand We have agreed in writing tocover it;

II. any other person upon whom YourJourney depends.

B. jury service or subpoena if You or YourTravelling Companion are called as anexpert witness or where Your or theiroccupation would normally require a courtattendance;

C. redundancy where You or Your TravellingCompanion: I. were unemployed or knew that You orthey may become unemployed, at thetime the Journey was booked;

II. are voluntarily made redundant or maderedundant as a result of misconduct orfollowing resignation;

III. are self- employed or a contract worker;D. any adverse financial situation causing Youto cancel Your Journey;

E. Your or Your Travelling Companiondeciding that You do no not want to travel.

2. Any loss, charge or expense due to:A. a delay in notifying the tour operator, travelagent, or transport or accommodationprovider that it is necessary to cancel abooking;

B. prohibitive regulations by the government ofany country;

3. Any charge or expense paid for with, or settledusing, any kind of promotional voucher orpoints, timeshare, Journey property bond orJourney points scheme, or any Claim formanagement fees, maintenance costs orexchange fees in relation to timeshares orsimilar arrangements.

4. Any Claim arising after You have left YourHome to commence Your Journey.

5. The Excess

SECTION 2. MEDICAL ANDADDITIONAL EXPENSES

Cover under this Section only applies to JourneysAbroad.

What is coveredIf during a Journey Abroad You1. are injured; or 2. become ill (including complications inpregnancy as diagnosed by a Doctor orspecialist in obstetrics, provided that if You aretravelling between 28 and 35 weeks pregnantYou obtained written confirmation from aregistered medical practitioner of Your fitnessto travel no earlier than 5 days prior to thecommencement of Your Journey Abroad), We will pay up to the amount stated in thePolicy Schedule for:A. Medical Expenses All reasonable costs that it is medicallynecessary to incur outside of Your HomeCountry forI. hospital, ambulance surgical or otherdiagnostic or remedial treatment, givenor prescribed by a Doctor, and includingcharges for staying in a hospital.

II. emergency dental treatment for the reliefof pain only.

III. physiotherapy.IV. air ambulance/medical evacuation,where medically necessary andsupported with evidence of suchnecessity.

B. Emergency Repatriation Expenses All reasonable costs that it is medicallynecessary for ACE Assistance to incur toreturn You Home; or to move You to themost suitable hospital in Your HomeCountry; if it is medically necessary to doso.

C. Travel ExpensesAll necessary and reasonableaccommodation (room only) and travelexpenses incurred with the consent of ACEAssistance, if it is medically necessary forYou to stay Abroad after Your scheduleddate of return to Your Home Country, andincluding travel costs, back to Your HomeCountry if You cannot use Your originalreturn ticket.

D. Accompanying Traveller ExpensesAll necessary and reasonableaccommodation (room only) and travel

expenses incurred with the consent of ACEAssistance, by any one other person ifrequired on medical advice to accompanyYou or to escort a Child Home.

E. Cremation, Burial, Transportation andRecovery Charges If You die AbroadI. cremation or burial charges in thecountry in which You die; or

II. transportation charges for returningYour body or ashes back to Your HomeCountry,

III. recovery of Your body from a knownlocation or where approval for recoveryof Your body has been given by Us andindependent experts appointed throughthe BMC.

F. Search and Rescue ExpensesIf You are reported as missing Abroad andit becomes necessary for the rescue orpolice authorities to instigate a search andrescue operation where;I. it is known or believed that You mayhave sustained injury or become ill; or

II. weather or safety conditions are suchthat it becomes necessary to do so inorder to prevent You from sustaininginjury or becoming ill;

We will pay the necessary and reasonablecosts incurred by and/or levied byrecognised rescue or police authorities insearching for You and for bringing You toa place of safety (Please note theinformation regarding rescue services andYour responsibility under the Local SafetyAdvice and Emergency Contact Details onPage 4).

G. Replacement Traveller ExpensesIf You are a member of a team and aDoctor confirms that as a direct result ofsuch injury or illness You are unable tocontinue with Your Journey, provided thatsuch injury or illness is covered under thissection of the Policy and that it is necessaryfor You to be replaced on the Journey tofulfil the main objective of the Journey, Wewill pay the economy class air fare orstandard class rail fare for a replacementtraveller to travel to the point at which Youare unable to continue Your Journey.

Special Conditions1. If You are injured or become ill You MUSTfollow the procedure detailed under ‘Making aClaim’ on page 11 of this Policy. If You do

not, We may reject Your claim or reduce theamount that We pay You. Please note that ACE and/or ACE Assistanceare not responsible for arranging orundertaking rescue services - Please refer toAdvice For Travellers" on Page 4.

2. ACE Assistance may:A. move You from one hospital to another;and/or

B. return You Home; or move You to the mostsuitable hospital in Your Home Country;at any time, if ACE Assistance believesthat it is necessary and safe to do so.

3. Additional travel and hotel expenses must beauthorised in advance by ACE Assistance.

4. All original receipts must be kept and providedto support a Claim.

5. There is an increased Excess of £500 sterlingin respect of rescue by air ambulance orhelicopter services being required from/withinNepal.

6. Applicable to Search and Rescue ExpensesA. All reasonable local safety advice has beenobtained and followed (as detailed underAdvice For Travellers on Page 4) andrescue service arrangements made beforecontacting ACE Assistance.

B. Expenses are only payable for Yourproportion of the search and rescue operation.

C. Costs will only be covered up to the pointwhen You are recovered by search andrescue or at the time when the search andrescue authorities advise that continuing thesearch is no longer viable. In the event thatYou or Your estate wish to continuesearching for You, despite the search andrescue authorities assuming or advising thatdeath has occurred, costs will only becovered up to the last point that the searchand rescue authorities were confident thatYou were still living".

D. A written statement from the appropriaterescue authorities involved in the searchand/or rescue must be obtained andprovided to Us in the event of a Claim.

What is not covered1. Any amount recoverable under a reciprocalhealthcare agreement with Your HomeCountry.

2. Any treatment or surgery or exploratory testsA. not confirmed as medically necessary; or B. not directly related to the injury or illnessthat You were admitted to hospital for

3. Surgery, medical or preventative treatmentwhich can be delayed in the opinion of theDoctor treating You until You return to YourHome Country

4. Any costs incurred following Your decision notto move hospital or return to Your HomeCountry after the date when, in the opinion ofACE Assistance, You should do so.

5. Cosmetic surgery6. Treatment or services provided by anyconvalescent or nursing home, rehabilitationcentre or health spa.

7. Any medical treatment that You travelledAbroad to obtain.

8. Medication You are taking before, and whichYou will have to continue taking during, aJourney.

9. Any medical expenses incurred in Your HomeCountry.

10.Any additional travel and accommodationexpenses incurred which have not beenauthorised in advance by ACE Assistance.

11.Accommodation and travel expenses where thetransport and/or accommodation used is of astandard superior to that of the Journey.

12.Any additional costs for single or private roomaccommodation.

13.Cremation or burial costs in Your Home Country.14.Any costs for recovering Your body, when thelocation of Your body is not known or whereapproval for recovery of Your body has notbeen given by Us and independent expertsappointed through the BMC.

15.Any amount exceeding the Aggregate Limitstated in the Policy Schedule for Search andRescue Expenses incurred in respect of any oneClaim for all Persons Insured. If the aggregate amount of Search and RescueExpenses exceeds the Aggregate Limit theamount payable for each Person Insured shallbe proportionately reduced until the total doesnot exceed such Aggregate Limit.

16.Any medical expenses incurred more than 12months after You were first injured or became ill.

17.The Excess, except where You have obtained areduction in the cost of medical expenses inEuropean Union countries by using a EuropeanHealth Insurance Card, reciprocal healthagreement or private medical insurance.

18.Any search and rescue costs for the recovery ofmortal remains after search and rescueauthorities have assumed or advised that deathhas occurred.

SECTION 3. TRAVEL DELAY

Cover under this Section only applies to JourneysAbroad.

What is coveredIf You are delayed for at least 12 hours on Youroutbound international Journey from Your HomeCountry or the final part of Your internationalreturn Journey to Your Home Country becausethe scheduled departure of Public Transport isaffected by a strike, industrial action, adverseweather, mechanical breakdown, or grounding ofan aircraft Due To mechanical or structural defect,We will either:1. pay the Travel Delay benefit stated in the PolicySchedule; or

2. if You abandon Your Journey after a delay ofat least 24 hours of the scheduled outboundinternational departure from Your HomeCountry, We will refund Your unused traveland accommodation costs (and instructor andcourse fees, ski hire, ski school and ski liftpasses, provided that the appropriate OptionalSports and Leisure Activities Extension is shownas covered on the Policy Schedule) up to theamount stated in the Policy Schedule that Youhave paid or are contracted to pay and whichcannot be recovered from any other source.

Special Conditions 1. You can only Claim under item 1 or item 2above, not both.

2. You MUSTA. check-in before the scheduled departure timeshown on Your travel itinerary; and

B. comply with the travel agent, tour operatorand transport providers contract terms; and

C. provide Us with written details from thePublic Transport operator describing thelength of, and reason for, the delay.

What is not covered1. Any Claim Due ToA. Public Transport being taken out of serviceon the instructions of a Civil AviationAuthority, Port Authority or similar authority;

B. strike or industrial action that could bereasonably expected when the Journey isbooked;

2. Any charge or expense paid for with, or settledusing, any kind of promotional voucher orpoints, timeshare, Journey property bond or

Journey points scheme, or any Claim formanagement fees, maintenance costs orexchange fees in relation to timeshares orsimilar arrangements.

3. The Excess if a Journey is abandoned.

SECTION 4. PERSONAL PROPERTY

What is covered1. Accidental loss or damage or theft.If Personal Property is accidentally lost ordamaged or is stolen during a Journey, Wewill pay Repair and Replacement Costs up tothe amount stated in the Policy Schedule.

2. Temporary Loss If Personal Property is temporarily lost ormisplaced for at least 12 hours on Youroutbound Journey by the airline or othercarrier, We will pay up to the amount stated inthe Policy Schedule to reimburse You for thecost of essential items of clothing medicationand toiletries that You have to purchase.

Special Conditions1. You MUST take reasonable care to keep Your

Personal Property safe. If Your PersonalProperty is lost or stolen You MUST take allreasonable steps to get it back.

2. Valuables MUST be kept on Your person at alltimes unless You are in an area where a lockedsafe or safety deposit box is available, andYour Valuables are securely stored in thatlocked safe or safety deposit box.

3. Loss or theft of Personal Property MUST bereported to the police (and in addition, thehotel or resort management if the loss or theftoccurs in a hotel or ski resort) as soon aspossible after discovery and We MUST beprovided with a copy of the original writtenpolice report and/or report to the hotel/skiresort management as applicable.

4. Loss, theft or damage to Personal Property inthe custody of an airline or other carrier MUSTbe reported in writing to the airline or othercarrier within 24 hours of discovery and WeMUST be provided with a copy of the originalwritten airline or carrier’s report.

5. Where Personal Property is temporarily lost ormisplaced by an airline or other carrier Wemust be provided with original writtenconfirmation from such airline or other carrieror the tour representative that the return of YourPersonal Property to You by the airline or

other carrier was delayed for at least 12 hoursafter You arrived at Your destination.

6. We will deduct any amount payable under aClaim for the purchase of essential items, fromany Claim for loss, damage or theft ofPersonal Property resulting from the samecause or event.

What is not covered1. More than the amount stated in the PolicySchedule for:A. a single item, pair or set, or part of a pair orset;

B. Hired winter sports equipment in total (if theoptional Winter Sports Extension is shownas covered on the Policy Schedule);

C. Valuables in total; 2. Loss or theft of Valuables left Unattended(unless a locked safe or safety deposit box isavailable, and Your Valuables are securelystored in that locked safe or safety depositbox).

3. Loss or theft of any Personal Property (otherthan Valuables) left Unattended unless:A. contained in I. a locked room; or II. a locked safe or safety deposit box; or III. the locked glove box or boot of a vehicleor in the luggage space at the rear of alocked estate car or hatchback under atop cover and out of view and there isevidence of forced entry; or

B. in the custody or control of an airline orother carrier; or

C. You are able to prove with documentationthat You were evacuated from a mountainas a result of You suffering a medicalemergency, and as a result of thatemergency evacuation, You were forced toabandon Your Personal Property; or

D. such Personal Property is skis and/or asnowboard which have been temporarilystored in a public ski/snowboard rack at aski resort and such temporary storage iswithin the resort‘s hours of operation.

4. Loss, theft or damage to: A. mobile phones, antiques, musical instruments,pictures, household goods, contact or corneallenses, dentures, or dental fittings, businessequipment, tools, samples or merchandise,bonds, securities or documents of any kind; or

B. sports equipment whilst being used (exceptfor ski, mountaineering, or climbingequipment not otherwise excluded which is

C. vehicles or their accessories, watercraft andancillary equipment, glass, china or similarfragile items and pedal cycles.

5. Depreciation in value, normal wear and tear,denting or scratching, damage by moth orvermin, electrical, electronic or mechanicalbreakdown, or damage Due To atmosphericor climatic conditions.

6. Delay, detention, seizure or confiscation bycustoms or other officials.

7. The Excess.

SECTION 5. LOSS OFPASSPORT/DRIVING LICENCE

Cover under this Section only applies to JourneysAbroad.

What is coveredIf Your passport (or driving licence if taken withYou) is lost destroyed or stolen while You are onJourney Abroad, We will pay up to the amountstated in the Policy Schedule to cover the cost of:1. getting any temporary replacement documentsneeded to enable You to return to Your HomeCountry including any additional travel andaccommodation (room only) costs incurred byYou or on Your behalf during Your Journey toobtain such documents;

2. the replacement passport or driving licence feepayable, provided that it remained valid for atleast 2 years at the date it was lost destroyedor stolen.

Special ConditionsLoss or theft MUST be reported to the police (andthe hotel management if the loss or theft occurs ina hotel) as soon as possible after discovery andWe MUST be provided with a copy of the originalwritten police report and report to the hotelmanagement as applicable.

What is not covered1. Loss or theft of any passport or driving licenceleft Unattended unless contained in a lockedsafe or safety deposit box.

2. Delay, detention, seizure or confiscation bycustoms or other officials.

SECTION 6. MONEY

What is coveredWe will pay up to the amount stated in the Policyschedule if Money held by You for Your ownpersonal use is lost or stolen during a Journeywhilst:1. being carried by You; or 2. left in a safe or safety deposit box.

Special Conditions1. Loss or theft MUST be reported to the police(and the hotel management if the loss or theftoccurs in a hotel) as soon as possible afterdiscovery and We MUST be provided with acopy of the original written police report andreport to the hotel management as applicable.

2. You MUST provide Us with proof of ownershipof the Money for which You are claiming. Thismay be in the form of a bank statementshowing the date and time of the applicablecash withdrawal, or any other form ofevidence that We may require.

What is not coveredWe will not pay:1. more than the amount stated in the PolicySchedule for cash;

2. for traveller’s cheques:A. unless the loss or theft is reportedimmediately to the local branch or agent ofthe issuing company; or

B. if the issuing company provides areplacement service;

3. delay, detention, seizure or confiscation bycustoms or other officials;

4. for depreciation in value or shortage Due Toany error or omission;

5. the Excess.

SECTION 7. PERSONAL ACCIDENT

What is coveredIf You suffer physical injury caused by anAccident during a Journey which within 12months directly results in Your:1. death; or2. Loss of Sight; or3. Loss of Limb; or4. Permanent Total Disability;We will pay the appropriate benefit stated in thePolicy Schedule.

Special Conditions 1. We will not pay more than one benefit for thesame physical injury.

2. If You were already disabled before theAccident or already had a condition which isgradually getting worse, We may reduce Ourpayment. Any reduced payment will be basedon Our medical assessment of the differencebetween:I. the disability after the Accident; andII. the extent to which the disability is affectedby the disability or condition before theAccident.

What is not covered1. Death, Loss of Sight, Loss of Limb or

Permanent Total Disability Due To diseaseor any physical defect, injury or illness whichexisted before the Journey.

SECTION 8. CURTAILMENT

What is coveredWe will pay 1. unused accommodation costs (and unusedinstructor and course fees, ski hire, ski schooland ski lift passes, provided that theappropriate Optional Sports and LeisureActivities Extension is shown as covered on thePolicy Schedule) which You have paid or arecontracted to pay and which cannot berecovered from any other source;

2. reasonable additional travel andaccommodation (room only) costs necessarilyincurred in Your returning Home;

up to the amount shown in the Policy Schedule, ifit becomes necessary to, Curtail a Journey andreturn to Your Home Country Due To: A. You, Your Travelling Companion orsomeone You have arranged to stay with onJourney: I. dying; orII. being seriously injured; or III. suffering sudden illness; orIV. suffering from complications in pregnancy(as diagnosed by a Doctor or specialist inobstetrics); or

V. being compulsorily quarantined on theorders of a treating Doctor;

provided that such Curtailment is confirmedas medically necessary by the treating Doctor.

B. You or Your Travelling Companion beinginjured to such an extent that You or they are

unable to safely participate in a Sport or Activityfor which You or they are covered under a BMCTravel insurance Policy under an Optional Sportsand Leisure Activities Extension, participating inwhich was the primary purpose of the Journey;provided that such Curtailment is confirmed asmedically necessary by the treating Doctor.

C. Your or Your Travelling Companion’sImmediate Family Member or CloseBusiness Colleague:I. dying; orII. being seriously injured; or III. suffering sudden and serious illness; orIV. suffering from complications in pregnancy(as diagnosed by a Doctor or specialist inobstetrics)

provided that such Curtailment is confirmedas medically necessary by the treating Doctor.

D. serious fire storm or flood damage to YourHome or Your Travelling Companion’shome; provided that such damage occurs afterYour Journey commences.

E. the police requiring You or Your TravellingCompanion’s presence following a burglaryor attempted burglary at Your Home or YourTravelling Companion’s Home.

What is not covered1. Any Claim Due ToA. any serious, chronic or recurring medicalcondition diagnosed before Your Journeywas booked (or commencement of thePeriod of Insurance if later), and whichcould result in Your having to Curtail YourJourney, affecting I. Your Travelling Companion, unless heor she a. is a Person Insured under this oranother BMC Travel Insurance Policy;and

b. has declared that medical conditionand We have agreed in writing tocover it;

II. any other person upon whom YourJourney depends.

B. any adverse financial situation causing theCurtailment of a Journey;

C. Your or Your Travelling Companions notwanting to travel or to remain on YourJourney.

2. Any loss, charge or expense Due To:A. a delay in notifying the tour operator, travelagent, or transport or accommodation

provider that it is necessary to cancel,Curtail or rearrange a booking;

B. prohibitive regulations by the government ofany country.

3. Any charge or expense paid for with, or settledusing, any kind of promotional voucher orpoints, timeshare, Journey property bond orJourney points scheme, or any Claim formanagement fees, maintenance costs orexchange fees in relation to timeshares orsimilar arrangements.

4. Accommodation and travel expenses where thetransport and/or accommodation used is of astandard superior to that of the Journey.

5. The cost of any unused pre-paid travel costs,including but not limited to Your original returnticket.

6. The Excess.

SECTION 9. PERSONAL LIABILITY

What is coveredWe will indemnify You up to the Limit of Liabilitystated in the Policy Schedule against all sumswhich You are legally liable to pay as damages inrespect of:1. accidental bodily injury (including death illnessor disease) to any person;

2. accidental loss of or damage to materialproperty;

which occurs during the Period of Insurancearising out of the Journey.

The maximum that We will pay under this sectionfor all damages as a result of any one occurrenceor series of occurrences arising directly orindirectly from one source or original cause shallbe the limit of liability stated in the PolicySchedule.

We will in addition pay Costs and Expenses. Costs and Expenses shall mean:1. all costs and expenses recoverable by anyclaimant from You;

2. all costs and expenses incurred with Ourwritten consent;

3. solicitors’ fees for representation at anycoroner’s inquest or fatal accident inquiry or inany court of summary jurisdiction

in respect of any occurrence to which this Sectionapplies – except that in respect of occurrenceshappening in or claims or legal proceedingsbrought or originating in the United States ofAmerica or Canada or any other territory within

the jurisdiction of either such country, costs andexpenses described in 1., 2. and 3. above areincluded in the limit of liability for this Section.

Special Conditions1. We may at Our sole discretion in respect ofany occurrence or occurrences covered by thisSection pay to You the limit of liabilityapplicable to such occurrence or occurrences(but deducting therefrom any sum(s) alreadypaid) or any lesser sum for which the Claim(s)arising from such occurrence(s) can be settledand We shall thereafter be under no furtherliability in respect of such occurrence(s) exceptfor the payment of costs and expenses incurredprior to the date of such payment and forwhich We may be responsible hereunder.

2. If at the time of the happening of anyoccurrence covered by this Section there is anyother existing insurance whether taken out byYou or not covering the same liability We shallnot be liable to indemnify You in respect ofsuch liability except so far as concerns anyExcess beyond the amount which would havebeen payable under such other insurance hadthis section not been effected.

What is not covered1. Indemnity for any liability:A. in respect of bodily injury to any personwho is I. under a contract of service with Youwhen such injury arises out of and in thecourse of their employment by You;

II. a member of Your family.B. assumed by You under a contract oragreement unless such liability would haveattached in the absence of such contract oragreement.

C. in respect of loss of or damage to propertyI. belonging to You;II. in Your care custody or control.However this exclusion shall not apply inrespect of loss of or damage to buildingsand their contents not belonging to buttemporarily occupied by You in the courseof the Journey.

D in respect of bodily injury loss or damagecaused directly or indirectly in connectionwith:I. the carrying on of any trade business orprofession;

II. the ownership, possession or use of

a. horse-drawn or mechanicallypropelled vehicles

b. aircraft, hovercraft or watercraft(other than manually propelledwatercraft);

c. firearms (other than sporting guns).E. arising from the occupation or ownership ofany land or building other than anybuilding temporarily occupied by You in thecourse of a Journey.

F. in respect of punitive or exemplarydamages.

2. The Excess.

SECTION 10. OVERSEAS LEGALADVICE & EXPENSES

Cover under this Section only applies to JourneysAbroad.

What is coveredIf during a Journey You sustain bodily injury orillness which is caused by a third party We willpay up to a benefit amount stated in the PolicySchedule to cover Legal Expenses arising out ofAny One Claim.

Special Conditions1. Legal Representatives must be qualified topractise in the Courts of the country where theevent giving rise to the Claim occurred orwhere the proposed defendant under thisSection is resident.

2. You have the right to select and appoint aLegal Representative of Your choice torepresent You in any legal inquiry or legalproceedings (provided any appointment of aLegal Representative is not on a contingencyfee basis, where the Legal Representativecharges a proportion of the amount recoveredas a fee). You shall provide Us with details ofthe selected Legal Representative’s nameand address. We may provide informationabout Legal Representatives in Your localarea if You ask Us to do so.

3. You MUST co-operate fully with the LegalRepresentatives and ensure that We are fullyinformed at all times in connection with anyclaim or legal proceedings for damages and orcompensation from a third party. We areentitled to obtain from the LegalRepresentatives any information, documentor advice relating to a Claim or legal

proceedings under this Insurance. On requestYou will give to the Legal Representativesany instructions necessary to ensure suchaccess.

4. Our authorisation to incur Legal Expenseswill be given if You can satisfy Us that: A. there are reasonable grounds for pursuingor defending the Claim or legalproceedings and the Legal Expenses willbe proportionate to the value of the Claimor legal proceedings; and

B. it is reasonable for Legal Expenses to beprovided in a particular case. The decisionto grant authorisation will take into accountthe opinion of the Legal Representativesas well as that of Our own advisers. If thereis a dispute, We may request, at Yourexpense, an opinion of a barrister as to themerits of the Claim or legal proceedings. Ifthe Claim is admitted, Your costs inobtaining this opinion will be covered bythis Policy.

5. If there is any dispute, other than in respect ofthe admissibility of a Claim on which Ourdecision is final, the dispute will be referred toa single arbitrator who will be either a solicitoror barrister agreed by all parties, or failingagreement, one who is nominated by thecurrent president of the appropriate LawSociety. The party against whom the decision ismade shall meet the costs of the arbitration infull. If the decision is not clearly made againsteither party the arbitrator shall have the powerto apportion costs. If the decision is made inOur favour, Your costs shall not berecoverable under the Insurance.

6. We may at Our discretion assume control atany time of any Claim or legal proceedings inYour name for damages and or compensationfrom a third party.

7. All Claims within this Section must besubmitted to Us in writing within 90 days.

8. Any Legal Expenses incurred without Ourwritten agreement shall entitle Us to withdrawcover immediately and to recover any fees orexpenses paid to You.

9. We may at Our discretion require You toobtain at Your expense an opinion of abarrister agreed by You and Us as to whetheror not there are reasonable grounds forcontinuing to pursue or defend any Claim orlegal proceedings. We will pay such expenseif the opinion indicates that there are

reasonable grounds for pursuing or defendingthe Claim or legal proceedings.

10.We may at Our discretion offer to settle acounter-claim against You which We considerto be reasonable instead of continuing anyClaim or legal proceedings for damagesand/or compensation by a third party.

11.You shall be responsible for the repayment toUs of all sums paid by Us in respect of theLegal Expenses where:A. an award of costs is made in Your favour inthe Claim or legal proceedings; or

B. costs are agreed to be paid to You as partof any settlement of the Claim or legalproceedings.

12.If a conflict of interest arises, where We arealso the insurers of the third party or proposeddefendant to the Claim or legal proceedings,You have the right to select and appoint otherLegal Representatives in accordance withCondition 2 of this Section.

13.If at Your request Legal Representativescease to continue acting for You, We shall beentitled to withdraw cover immediately oragree with You to appoint other LegalRepresentatives in accordance with the termsof this Insurance.

What is not covered1. Any Claim reported to Us more than 12months after the beginning of the incidentwhich led to the Claim.

2. Any Claim where it is Our opinion that theprospects for success in achieving areasonable settlement are insufficient and/orwhere the laws, practices and/or financialregulations of the country in which the incidentoccurred would preclude the obtaining of asatisfactory settlement or the costs of doing sowould be disproportionate to the value of theClaim.

3. Legal Expenses incurred before receivingOur prior authorisation in writing unless suchcosts would have been incurred subsequent toOur authorisation.

4. Legal Expenses incurred in connection withany criminal or wilful act.

5. Legal Expenses incurred in the defenceagainst any civil claim or legal proceedingsmade or brought against You unless as acounter claim.

6. Fines, penalties compensation or damagesimposed by a court or other authority.

7. Legal Expenses incurred for any Claim orlegal proceedings brought against:A. a tour operator, travel agent, carrier, insureror their agents where the subject matter ofthe Claim or legal proceedings is eligiblefor consideration under an ArbitrationScheme or Complaint Procedure;

B. Us or Our agents; orC. Your employer.

8. Actions between Persons Insured or pursuedin order to obtain satisfaction of a judgementor legally binding decision.

9. Legal Expenses incurred in pursuing anyClaim for compensation (either individually oras a member of a group or class action)against the manufacturer, distributor or supplierof any drug, medication or medicine.

10.Legal Expenses chargeable by the LegalRepresentatives under contingency feearrangements.

11.Legal Expenses incurred where You have:A. failed to co-operate fully with and makesure that We are fully informed at all timesin connection with any Claim or legalproceedings for damages and orcompensation from a third party; or

B. settled or withdrawn a Claim in connectionwith any Claim or legal proceedings fordamages and or compensation from a thirdparty without Our agreement. In suchcircumstances We shall be entitled towithdraw cover immediately and to recoverany fees or expenses paid.

12.Legal Expenses incurred after You have not:A. accepted an offer from a third party to settlea Claim or legal proceedings where theoffer is considered reasonable by Us; or

B. accepted an offer from Us to settle aClaim.

13.Legal Expenses which We considerunreasonable or excessive or unreasonablyincurred.

II. details from the operators of the PublicTransport used for travel of the lengthof, and reason for, the delay;

B. evidence of all the extra costs incurred.2. If You have incurred additional costs for aconnecting flight (or other form of transport) inorder to arrive at Your final point ofinternational departure on time, Our liabilityshall be limited to the lesser of the maximumsum insured, or the amount that You wouldhave incurred had you rearranged Your finalinternational departure flight.

3. There is an increased excess of £250 sterlingin respect of any claim Due To inclementweather at Lukla Airport in Nepal.

What is not covered1. Accommodation and travel expenses where thetransport and/or accommodation used is of astandard superior to that of the Journey.

2. Any Claim Due To Your not allowingsufficient time for the Journey.

3. for a missed departure caused by strike orindustrial action that could be reasonablyexpected when the Journey was booked.

SECTION 12. HOSPITAL BENEFIT

Cover under this Section only applies to JourneysAbroad.

What is coveredIf You are admitted to hospital as an in-patientduring a Journey Due To injury or illness forwhich You have a valid Claim under the medicaland additional expenses section of this Policy, Wewill pay the benefit amount stated in the PolicySchedule for each complete 24 hours that Youremain a hospital in-patient, up to the maximumamount stated in the Policy Schedule.

What is not coveredWe will not pay for time You spend in aninstitution not recognised as a hospital in thecountry of treatment.

SECTION 13. ADDITIONAL PETCARE FEES

Cover under this Section only applies to JourneysAbroad.

What is coveredIf You are injured or become ill during a JourneyAbroad, and are:1 delayed from returning to Your Home

Country as a direct result of You beingadmitted as a hospital in-patient; and/or

Special Conditions You Must:1. provide Us with a written statement from anappropriate public authority confirming thereason and nature of the disaster and how longit lasted;

2. not have known about any event that results ina Claim before leaving Your internationaldeparture point; and

3. provide Us with evidence of all the extra costsincurred.

What is not covered1. Any Claim Due ToA. Your travelling against the advice of theappropriate national or local authority.

B. prohibitive regulations by the government of any country.

2. Accommodation and travel expenses where thetransport and/or accommodation used is of astandard superior to that of the Journey.

3. Any expenses that:A. You can recover from any tour operator,airline, hotel or other service provider;

B. You would normally have to pay duringYour Journey.

4. The Excess.

SECTION 15. HIJACK

What is coveredIf You are held hostage by Hijackers whilsttravelling to or from a Journey, We will pay theamount stated in the Policy Schedule for each full 24 hours You are held hostage up to the maximumbenefit stated in the Policy Schedule for eachJourney.

Special ConditionsYou MUST provide Us with written details fromthe airline or other transport operators describingthe length of the hijacking.

What is coveredWe will pay for:1. Winter sports equipment hire.up to the amount stated in the Policy Schedulefor each full 24 hour period that You need tohire replacement winter sports equipment ifYour winter sports equipment is:A. lost or broken in an accident; orB. lost or misplaced by an airline or othercarrier on the outbound Journey from YourHome Country and delayed for at least12 hours after You arrive at Yourdestination.

2. Unused ski pass ski hire or tuition feesUp to the amount stated in the Policy Schedulefor each full 24 hour period, to cover the valueof Your unused ski pass, ski hire and/or tuitionfees which You cannot recover following;A. Your injury or illness;B. loss or theft of Your ski pass.

3. Lack of snowThe amount stated in the Policy Schedule foreach full 24 hour period that You are unableto ski because there is a lack of snow in thepre-booked resort and no alternative skiingavailable;Special ConditionThis cover applies only to Journeys to adestination in:A. to the Northern Hemisphere betweenOctober 1st and April 30th the followingyear (both dates inclusive) .

B. to the Southern Hemisphere between June1st and October 31st (both datesinclusive).

4. AvalancheUp to the amount stated in the Policy Schedulefor additional and necessary travel andaccommodation costs if Your outbound orreturn Journey is delayed by an avalanche formore than 12 hours from the scheduleddeparture time on Your travel ticket.

Conditions1. A.Loss, theft or damage to winter sports

equipment in the custody of an airline or other carrier MUST be reported in writing tothe airline or other carrier within 24 hours of discovery and We MUST be provided with a copy of the original written airline orcarrier report.

B. Loss or theft of winter sports equipment inall other circumstances and loss or theft ofYour ski pass, MUST be reported to thepolice (and the hotel management if the lossor theft occurs in a hotel) as soon aspossible after discovery and We MUST beprovided with a copy of the original writtenpolice report and report to the hotelmanagement as applicable.

2. You MUST provide Us with a medicalcertificate issued by a Doctor when submittinga claim for unused ski pass, ski hire hireand/or tuition fees, as a result of Your injuryor illness.

What is not covered1. Delay, detention, seizure or confiscation bycustoms or other officials.

2. Any Claim for benefit under Avalanche coverif We pay a Claim under the Travel Delay orCatastrophe Sections of this Policy for the sameevent.

What is CoveredCover under this Policy is extended to includeMilitary Personnel or Embassy Personnel basedoutside of their Home Country at an HM Base ora British Embassy, who hold a passport fromtheir Home Country and who are otherwisenormally resident in their Home Country and areregistered with a Doctor in their Home Country.

What is not covereda. We will not cover any Journey which involvesany military duties, or other activities, eitherfunded or part funded by the armed forces.

b. We will not provide cover under Section 2.Medical and Additional Expenses for any coststhat would normally be covered by, or whichare incurred by, the medical service providedby Her Majesty’s Armed Forces.

Special Conditionsa. ACE Assistance shall at their sole discretion,have the option of repatriating the PersonInsured to their HM Base or their HomeCountry.

b. If Your HM Base is within an area where theForeign and Commonwealth Office hasadvised against 'all travel'; cover under thisPolicy will only commence for Your outboundJourney once You reach a military base,civilian bus station, coach station, airport, portor rail terminal outside of an area where theForeign and Commonwealth Office hasadvised against 'all travel'. For Your inboundJourney cover will cease when you leave amilitary base, civilian bus station, coachstation, airport, port or rail terminal to travel toan area where the Foreign and CommonwealthOffice are advising against 'all travel'. Allcover will cease immediately if You enter anarea where the Foreign and CommonwealthOffice has advised against 'all travel', andexclude any claims arising directly or indirectly

ContractThis Policy, the Policy Schedule and anyinformation provided in Your application will beread together as one contract.

Legal Interpretation & LanguageCurrent legislation allows the parties to thiscontract to choose which law is used to interpretthis Policy. You and We agree that:1. this Policy will be governed and interpreted inaccordance with the Law of England andWales and only the English Courts will havejurisdiction in any dispute; and

2. communication of and in connection with thisPolicy shall be in the English language.

Third Party RightsYou and We have agreed that it is not intendedfor any third party to this contract to have the rightto enforce the terms of this contract. You and Wecan rescind or vary the terms of this contractwithout the consent of any third party to thiscontract, who might seek to assert that they haverights under the Contracts (Rights of Third Parties)Act 1999.

Observing Policy Terms & ConditionsWe will not be liable to make any payment underthis Policy if a You or Your personalrepresentative(s) do not observe and fulfil its terms,exclusions and conditions.

MisdescriptionIf You made a representation to Us or suppliedinformation to Us that was untrue or misleadingand You knew it was: a) untrue or misleading; or b) did not care that it was untrue or misleading;or

c) inaccurate or incorrect; ord) given carelessly so that it may have altered theterms under which We accepted cover;

then We retain the right to: a) void this policy and return the premium to You;or

b) vary the terms and conditions of this policy inwriting to You; or

c) increase the premium payable by You in orderto continue the policy cover.

Material Facts & DisclosuresYou must ensure that all of the information, whichYou have provided in the Application Form, on-line, by correspondence, over the telephone, onclaim forms and in other documents is true,complete and accurate. Please note that providingincomplete, false or misleading information couldaffect the validity of this Policy and may mean thatall or part of a Claim may not be paid.

Changing Your Policy1. If You want to change Your PolicyIf You want to change Your Policy or if Yourinsurance needs or any of the information Youhave given Us changes You must telephone(and confirm in writing if We request You to doso), e-mail or write to:

We will writeto You with details at least 30 days before Wemake any changes. You will then have theoption to continue with, or to cancel the Policy.

Any change made to Your Policy will begin on thedate that the Policy Schedule issued to record thechange in cover becomes effective.

Cancelling Your PolicyIf You want to cancel Your Policy1. 14 day cancellation optionIf, for any reason, You are not satisfied withthis Policy, and You have not taken or bookeda Journey protected by the cover provided,You may, within 14 days of Your receipt of fullPolicy documentation, telephone the BMC +44(0)161 445 6111 or email:[email protected] and We will cancel it. Ifthis happens the Policy will have provided nocover and We will refund any premiums Youhave paid.

2. Cancellation after 14 days If You want to cancel Your Policy You musttelephone (and confirm in writing if We requestYou to do so), e-mail or write to the BMC. Wewill cancel it from the date Your instructionsare received or any later date You give Us.We reserve the right to charge You a premiumproportionate to the cover that has been inforce up to the date of Your cancellation, anda reasonable administration charge for anycosts incurred.

There is no premium refund available if YourJourney has already commenced (or afterYour first Journey has commenced if Youhave purchased a Multi-Trip Policy).

If We Want to Cancel Your PolicyIf We no longer wish to offer this Policy and needto cancel Your Policy We will write to You at thecurrent address We have for You. Your policycould be cancelled due to fraud, materials factsand disclosures or lack of reinsurance. We willthen cancel the Policy 30 days after the date ofOur letter. If We cancel the Policy We will refundany premium You paid for the cancelled periodprovided You have not made a Claim under thePolicy during the current Period of Insurance.

Other Taxes or CostsACE are required to notify You that other taxes orcosts may exist which are not imposed or chargedby Us.

Loss of LimbAmputation or total and permanent loss of use ofone or more hands at or above the wrist or of oneor more feet above the ankle (talo-tibial joint).

Loss of Sight1. In both eyes when Your name has been addedto the register of Blind Persons on the authorityof a qualified ophthalmic specialist;

2. In one eye when the degree of sight remainingafter correction is 3/60 or less on the SnellenScale (which means You are only able to seeat 3 feet that which You should normally beable to see at 60 feet) and We are in no doubtthat the condition is permanent and withoutexpectation of recovery.

Permanent Total DisabilityA disability which has lasted for at least 12months from which We believe You will neverrecover and which prevents You from carrying outany gainful occupation for which You are fitted byway of training, education or experience.
