Prevost parts and Our Parts asks that the $100 per day, per item be reviewed under the following context: In order for Prevost parts to accept these terms, AC Transit would need to agree that all warranty parts used for repairs against basic warranty coverage or extended warranty coverage, as defined by contract - must use Prevost / and Our OEM parts only. Prevost parts cannot accept liability and financial risk if AC Transit procures parts from other sources and applies to warranty returns / claims. A41. Agreed

Q42. Prevost parts and Our Parts requests clarification concerning US components and from US suppliers. Our Hub PDC warehouse is in South Plainfield NJ, where we source and stock brake components used on front and rear axles as supplied by Knorr Bremse. Knorr Bremse components are produced in Germany and warehoused in NJ to support our clients. Does this meet intent of TS 8.6.5? A42. Yes. This meets the intent of this section

Q43. Records will be available for audit within Prevost Parts Sales Office - Located 2250 Point Blvd, Suite 410, Elgin IL 60123. Proprietary sourcing files, vendor information etc. will not be copied and transmitted via email, fax or other. Please confirm acceptance. A43. Confirmed

Q44. Please clarify if there is any progress payment established for the lead production vehicle. A44. Dependent on what is offered by the successful proposer in terms of both price and terms.

Q45. Please clarify which payment terms option is effective for this RFP. A45. This is an RFP. It is up to the proposer to make an advantageous offer relative to this

issue.

Q46. If payment terms option 2 is chosen by AC Transit, we request to reduce the retention to 10%. A46. This is something that would need to be addressed in your proposal. We cannot approve

or deny at this time.

Q47. For payment terms option 3, please specify the event related to the first 20% progress payment A47. This is something that would need to be addressed in your proposal. We cannot approve

Q51. "Potential dimensional/performance tests that may be included in the Configuration and Performance Review include the following: •Water test / •Water runoff test" Please clarify the difference(s) between "Water test" and "Water runoff test". A51. The water test and runoff test is listed as part of the APTA Bus Procurement Guidelines.

Part of this test will demonstrate that water does not run over the windshield during braking or passengers during entry and exit at all doors.

Q52. "Potential dimensional/performance tests that may be included in the Configuration and Performance Review include the following: •Sound/noise level test " A52. Approved

We perform a sound/noise level test on each bus during the road test to detect rattling and other suspicious noises. Also, we provide a noise level report (max dBA per bus) that has been performed on a bus with the closest configuration to AC Transit bus available at that time. Is this process acceptable to AC Transit? If not, please clarify if the noise level test (max dBA per bus) need to be performed on each lead bus only or on all buses to be delivered to AC Transit. Q53. Circular 4220.1F, Rev 4, page 13 - procurement guidelines from FTA, states guidelines associated with LD's pertaining to rolling stock delivery only. We kindly asks for AC Transit's rationale and calculation supporting $300 per day LD per bus (after 7 days of agreed upon schedule). We kindly ask $300 per day be removed, as there is no guidance from FTA or APTA concerning out of service charges and subsequent schedule to repair. A53. Denied

Q54. Fleet Defect as stated within TS 8.5.21 is 15% of fleet, per APTA guidelines 2011 - Page 206, Section WR 1.4.1 - Occurrence and Remedy "A Fleet Defect is defined as cumulative failures of twenty-five (20) percent of the same components in the same or similar application in a minimum fleet size of twelve (12) or more buses where such items are covered by warranty. A Fleet Defect shall apply only to the base warranty period in sections entitled “Complete Bus,” “Propulsion System” and “Major

Subsystems.” " We kindly asks that APTA white book specifications are used concerning fleet percentage - 20% A54. Approved

Q55. Please clarify if AC Transit will purchase only one bus model (diesel, hybrid or suburban) or if AC Transit may purchase a mixed of these bus models? A55. The District may purchase a mixture of these models. It has not been determined at this

time based on funding if we will purchase hybrid bus but want it as an option.

Q56. We understand that the inspection and approval of the lead bus means that AC Transit will make sure that the lead bus meets the contract requirements and will not request change orders for the remaining 28 production buses unless a non-compliance is found. Please confirm or clarify our understanding. A56. Refer to SP 1.1 and TS 11.6: Changes may be requested within seven (7) days after the

completion of the thirty (30) day test and issuance of the written report.

Q57. We request approval to change the whole section with section WR 1.1.3 of the APTA Standard Bus Procurement Guidelines which is the standard requirement in the Bus Industry: Body, body structure, structural elements of the suspension and engine cradle are warranted to be free from Defects and Related Defects for three years or 150,000 miles, whichever comes first. Primary load-carrying members of the bus structure, including structural elements of the suspension, are warranted against corrosion failure and/or Fatigue Failure sufficient to cause a Class 1 or Class 2 Failure for a period of 12 years or 500,000 miles, whichever comes first. A57. Approved

Q58. We request approval to delete the requirement to remove interior ceiling and side panels to perform the leak inspection. Rationale: Our water test room complies with the APTA Standard Bus Procurement Guidelines and has shown reliability. The test is performed once the bus is completed and therefore, all windows, doors are in place and after installation of the interior panels. However, we leave all access panels and base lights open in order to check for any leakage. Changing our water test installation would require an extensive review and change our manufacturing process. A58. Approved

Q67. "If any component, unit, or subsystem is repaired [...] then the component, unit, or subsystem will begin a new warranty period based on the original terms." We wish to clarify that the warranty doesn't restart and we request approval to use the APTA Standard Bus Procurement Guidelines wording : " If any component, unit or subsystem is repaired, [...] then the component, unit or subsystem shall have the unexpired warranty period of the original." We request your approval to apply the fleet defect clause only on the base warranty: Per APTA guidelines 2011 - Page 206, Section WR 1.4.1 - Occurrence and Remedy "[..] A Fleet Defect shall apply only to the base warranty period in sections entitled “Complete Bus,” “Propulsion System” and “Major Subsystems.”" A68. Q69. Since major component suppliers such as engine, transmission and HVAC do not recognize and/or participate in fleet defect clauses, we request approval to exclude them from the fleet defect clause. A69. Denied. All component suppliers need to conform to the Fleet Defect Provisions.

Q70. The title "Software Escrow Account" and Sample Escrow Agreement attached to the RFP Documents are contrary to the language contained in this provision. Please confirm that no Software Escrow Account will be required as the documents subject to be contained in an escrow account are proprietary intellectual property.

Q79. Please clarify section TS 7.6.2, 62 concerning The General Orientation. The training on the General Orientation will be provided 3 times in each maintenance facilities. If the training is provided 3 times per facility, we will have 15 sessions of General orientation training to provide. In the case of 270 maintenance personnel and 7 persons per session, the training sessions would be 39 sessions. Please indicate the number of sessions to provide. A79. If each session is 2 hours long, 2 sessions per shift can be done. If only 1 session per

shift can be done, we would like to see 10 persons per session which, would allow 27 sessions total

Q80. We request approval for 8.6 in minimum ground clearance instead of 9 in. A80. Denied. This is an APTA Specification in the Bus Procurement Manual. District buses

must meet this requirement to address challenging street conditions such as speed bumps etc.

Q81. We request approval for 6.3 in minimum wheel area clearance for fixed part to the bus. A81. Wheel area clearance shall be no less than 8 in. for parts fixed to the bus body and 6 in.

specification is required.

Q84. Maximum maintained speed of 62 mph with an artic bus at GVWR. 32 mph maintained speed on a 3.5% grade Acceleration 0-45 mph: 39 seconds We have no historical data or simulation for the time to reach 0-20mph on a 5% grade. Therefore we cannot confirm compliance to the specification. A84. Denied. The vehicle must comply and the contractor must demonstrate the contract

performance standards listed in Table 1-1 of this section.

Q85. We request approval for fiberglass body panels. All exterior panels are made of composite materials bonded in place with structural adhesive. This process eliminates the need for mechanical fasteners, and prevents corrosion and the forming of stress risers. A85. Approved

Q86. We use Hubner 15.3 articulation. See RFA 86 Attachment for anti-Jacknife control description. Please confirm your acceptance. A86. Approved

Q87. Please clarify the guard specified in this section. We need more information to evaluate the function of this guard. A87. The function of this guard is to prevent the bottom of the artic bellow from scraping on the

ground.

Q88. We request approval for our 3/4in foam filled honeycomb core composite subfloor. Please refer to RFA 88 Attachment for more details. Rationale: All of our LFS are equipped with composite subfloor instead of plywood for long term durability of the passenger compartment subfloor as a standard feature A88. Approved

Q89. We request approval for Gerflor Tarabus flooring composed of PVC, fiber-glass with high quality wear inset with silicon carbide granules and non-woven textile on all the flooring surfaces (Vestibule, driver's area and passenger area). Most importantly the Tarabus NT series has superior resistance to abrasion, a static coefficient of friction >0.6 (ASTM D2047) & a thickness of (0.0885" or 2.25mm). The floor covering is bonded to the subfloor during the manufacturing process of the subfloor, eliminating any chance of water infiltration or separation. By using this process, our floor covering does not require additional trim and does not continue up the side walls, it ends straight with the floor. Yellow Integral nosing is used for step nosing. No floor covering is used on wheelhouses. Gerflor flooring has been developed, tested and has shown durability to survive heavy traffic, It is easy to maintain and provides passengers with a safe, non-slip surface, even when wet. The Tarabus collection has been developed by Gerflor specifically for buses and coaches. It is available in a variety of colors to coordinate with your interior

preferences. The floor covering is glued, fused, bonded to the composite floor according to the required installation methods; thus making the flooring sealed. The edge of the floor is sealed against infiltration of moisture. The edges are also reinforced with a polyester resin seal. All seams are filled with color matched welding cords that are brazed to make the most uniform and sealed surface. Please note that in the event of water infiltration, the urethane glue is not affected. Moreover the glue requires water to mature. A89. Denied. The District is requesting "Altro" flooring for fleet commonality.

Q90. We request approval for wheelhouses constructed to meet successfully the 2 in steel ball impact test with at least 200 ft-lb of energy without penetration & fire resistance test of the Standard Bus Procurement Guidelines (White Book) at mid axle. At the same time, the Modine open fin channel design promotes higher performance and significantly less clogging. Where the Contractor (New Flyer) fails to honor this parts guaranty or parts ordered are not received within 30 (thirty) days of the agreed upon delivery date, then the Contractor (New Flyer) shall provide to the customer, within 7 (seven) days of verbal or written request, the design and manufacturing documentation for those parts manufactured by the Contractor (New Flyer) and the original suppliers' and/or manufacturers' parts numbers, company names, addresses, telephone numbers and contact persons' names for all of the specific parts not received by the customer. Contractor's (New Flyer) design and manufacturing documentation provided to the customer shall be for its sole use in regard to the buses procured under this Contract and for no other purpose.

If further information is required in order to rebuild a bus due to a major accident, contact New Flyer Technical Services Group and they will assist with the proper information.

New Flyer does not supply window templates and/or drawings due to warranty concerns and proprietary design rights. Our glass manufacturer provides warranty for all OEM supplied glazing, and any outsourcing of glazing will void this warranty. Additionally, some window and glazing designs are of a proprietary nature, with precise specifications that cannot be replicated in the regular glass market.

The floor covering will have a 12 year parts only warranty. See attached Altro/Tarabus warranty document.
