HOW TO USE YOUR WARRANTY This section will help you understand which items in your home are covered under the Two-Year Limited Warranty and which items are not. Items not covered under the warranty (NON-WARRANTY items) are the OWNER'S responsibility. Additionally, this section contains maintenance tips that will help you maintain the performance of your home. ______________________________________________________________________________ HOW TO SUBMIT A CLAIM Before making a Warranty Claim Request or contacting DJK Custom Homes, Inc., use the warranty guide to verify each claim. Follow the simple steps below. STEP 1: VERIFY THE BUILDER'S RESPONSIBILITY Before contacting DJK Custom Homes, Inc. with your warranty items, you must verify that your BUILDER is responsible to perform your request. To verify BUILDER responsibility please:

Look in the Warranty Guide's "Table Of Contents". Locate the area your specific claim falls under.

- Example: Drywall, Electric, Plumbing, etc. STEP 2: DETERMINE THE BUILDER'S RESPONSIBILITY

Read through the specific section concerning your warranty request. Determine if your BUILDER is responsible.

NEW HOME ORIENTATION AND PRE-CLOSING WALK-THROUGH Prior to closing or occupancy, you and a representative of DJK CUSTOM HOMES, INC. will conduct an Orientation and Pre-closing Walk-Through Inspection of the home and property. OUR RESPONSIBILITIES

A DJK Custom Homes, Inc. representative will tour your home with you, noting areas of concern on the New Home Orientation Pre-closing Walk-Through Form. Our representative will also conduct a new home orientation by demonstrating and educating you on specific components of your new home. For example, the representative will show you the locations of your electric box, water shut-off valves, reset on the garbage disposal and many other functions within your home. During the walk-through, your representative will list any defects and specific issues on the New Home Orientation Pre-closing Walk-Through Inspection Form. Your DJK Custom Homes, Inc. representative will discuss this form with you in its entirety.

PLEASE NOTE:

During the Orientation and Walk-Through, your DJK Custom Homes, Inc. representative will “tag and note” areas of concern that do not meet local or national standards. Inspection standards such as normal lighting, required viewing distances and heights will be enforced.

YOUR RESPONSIBILITIES

Pay particular attention during your walk-through to the specific items noted on the New Home Orientation Pre-closing Walk-Through Form. Each defect or specific issue will be reviewed by DJK Custom Homes, Inc. and approved or rejected in accordance with your contract as well as building codes and standards. A copy of this completed form will be left with you after the walk-through. A sample of the New Home Orientation Pre-closing Walk-Through Form is on the following page.

_____________________________________________________________ SECTION II WARRANTY COVERAGE AND CONDITIONS

This DJK Custom Homes, Inc. Two-Year Limited Warranty, only covers items specifically described herein and that are actually delivered within the term of the warranty to DJK Custom Homes, Inc. within two years of the commencement date stated above and according to the procedures in Section V- Warranty Performance. 10 YEAR STRUCTURAL WARRANTY

We warrant that for a period of ten (10) years after the closing, that the home will be free of major structural defects. For purposes of this Limited Warranty, a major structural defect is defined as actual physical damage to one or more of the load bearing segments of the home causing the failure of the major structural components, which affects its load bearing function to the degree that it materially affects the physical safety of the occupants of the home as defined by the Construction/Warranty Standards. Load bearing components of the home deemed to have major structural defect potential include the following: roof framing members (rafters and trusses), floor framing members (joists and trusses), bearing walls, bearing columns, lintels, load bearing beams and foundation systems and footings. We will repair or replace such items to restore their load bearing functions, as designed, and make such other repairs as needed to return the home to safe living conditions and habitability.

This DJK Custom Homes, Inc. Two-Year Limited Warranty is extended to the Homeowner(s) named above, hereinafter, individually and collectively referred to as OWNER who is/are the initial OWNER(s) of the home built by DJK Custom Homes, Inc. This DJK Custom Homes, Inc. Two-Year Limited Warranty is NOT transferable to subsequent OWNER(s) of the home.

DJK Custom Homes, Inc. warrants solely to the OWNER, subject to the standards stated herein (specifically including but not limited to the non-warranty conditions contained in SECTION III of this DJK Custom Homes, Inc. Two-Year Limited Warranty), that for the term of this DJK Custom Homes, Inc. Two-Year Limited Warranty, as described above, the home will be free of the defects noted in this Warranty as DJK Custom Homes, Inc.’s responsibility.

APPLIANCES - ATTICS ___________________________________ SECTION II APPLIANCES ________________________________________________________________

It is important to read and follow all manufacturers’ requirements for each appliance in your home. It is your responsibility to report any problem with any located appliances directly to the appliance service representative. The phone number is usually in the lower corner of the back page of the appliance OWNER’S manual.

LIMITED WARRANTY

You will more than likely receive all appliances warranties during your New Home Orientation. The appliances are warranted directly to you in accordance with the terms and conditions of the written warranties supplied by the manufacturer. Mail the warranty registration cards directly to the manufacturer.

MANUFACTURER'S SERVICE

If you have a problem with one of your appliances, call the customer service number listed in the manufacturer’s warranty. Be ready to supply the following information:

- Date of Closing of your Home. - Description of the problem. - The serial and model numbers of appliance (typically found on a metal plate on the side

or bottom of each individual appliance). ATTICS ___________________________________________________________

Attic ventilation through the roof and soffits is required by building codes. A lack of ventilation in an attic can cause heat to build up, which accelerates wood deterioration.

Annually check the caulking around vent pipes, ventilators and fan unites. Re-caulk these

areas when needed DJK CUSTOM HOMES, INC. is not responsible for any alterations made to the

ventilation system by the OWNER. DJK CUSTOM HOMES, INC. will provide a ventilation area in the attic as required by the

approved building code specifications. Down ventilation is unacceptable. DJK CUSTOM HOMES, INC. will meet appropriate building code specifications.

When performing any tasks in your attic, you should use extreme caution.

DO NOT step off the top of the joists onto the drywall ceiling or insulation. This can result in

personal injury and/or damage to the ceiling below. Always use a light when working in the attic. Clip or fasten tools and materials to your belt or keep them in a pouch. Retrieving dropped

items from blown insulation is difficult.

BLACKTOP - CABINETS __________________________________ SECTION II BLACKTOP __________________________________________________________________

Annually, the blacktop, including the edges and cracks, should be sealed with and industry-approved sealer.

YOU ARE RESPONSIBLE FOR:

Depressions or cracks caused by heavy equipment, moving vans, school busses, garbage trucks, delivery vehicles and automobiles.

Surface damage resulting from chemicals or solvents causing the breakdown of the bituminous mixture that surrounds the aggregate in blacktop.

“Turn marks” created by vehicle wheels stopping or turning. Hot weather conditions combined with new pavement can cause these “turn marks”. Asphalt becomes more resistant to turn marks with age.

DJK CUSTOM HOMES, INC. WILL CORRECT:

Cracks exceeding ½ inch hot rubberized asphalt to suitable cold caulking material. All finish repairs should be feathered and smoothed. Color variations are to be

expected. DJK Custom Homes, Inc. assumes no responsibility whatsoever in matching color or texture.

Check with a local asphalt contractor for the best sealer and application recommendation. Improper use of products can kill grass and plants that are next to the surface being sealed. Cover skin and eyes when using any type of sealer. CABINETS ___________________________________________________________________

Cabinets constructed of wood, wood products, or composite materials exhibit natural variations in grain, texture, and color. While darker finishes may blend the variations more than a lighter finish, all finishes will change with products such as Lemon Oil, Liquid Gold, and Old English Furniture Polish. Follow the product’s directions. In most cases, a color change due to aging isn’t noticeable. The amount of light your cabinets are exposed to can change the color of your cabinets are exposed to can change the color of your cabinets.

All cabinets and vanities in your home are affected by changes in temperature, humidity and moisture. They will contract or expand as the weather changes, especially cabinet and vanity doors. Keep the temperature and humidity level in your new home consistent to minimize contracting and expansion. Cabinets may contract and leave a gap next to the wall area.

CABINETS - CAULKING __________________________________ SECTION II

As needed, tighten cabinet and vanity hardware, as it will loosen with repeated use. Check your hinges at least once a year for proper alignment and tightness. Use proper tools to make necessary adjustments.

Cabinet doors and drawer faces should not warp to exceed 1/4 inch, as measured from the face frame to the point of furthermost warp-age, with the door or drawer front in the closed position, provided consistent levels of humidity have been maintained.

Both cabinet and drawer faces should be properly adjusted to open and close smoothly at closing.

DJK CUSTOM HOMES, INC. will take corrective action as necessary to meet the standard.

Cracks and gaps in doors or drawer faces will be filled by DJK Custom Homes, Inc., only if light is visible through the crack or gap.

Gaps next to the wall area of the cabinet that exceed ¼ inch can be covered with scribe. Keep stained cabinets in good condition by applying lemon oil once a month. Washing

stained cabinets with water or cleaning paraffin based spray wax could damage the luster of the finish.

Touch up scratches on stained cabinets with a wood tone touch-up crayon available at most hardware stores.

Clean painted cabinets with a mild detergent on a damp, soft cloth. Smooth a sluggish drawer glide with a small amount of silicone spray. Protect drawer glides by keeping the drawers closed when not in use.

DJK CUSTOM HOMES, INC IS NOT RESPONSIBLE FOR:

Variations in color or stain finishes or fillers used to make repairs Exact match of wood grain, colors, or discontinued styles or supplies. Paint or stain gaps caused by movement of panels. Shrinkage caused by excessive humidity levels.

CAULKING __________________________________________________________________

Caulking is used in your home to create a tight seal against moisture, damage, dust, dirt, insects and air. Properly installed caulking will shrink due to contraction and expansion of the product and the material that the caulking is applied to.

EXTERIOR CAULKING:

Regularly check caulking on the exterior of your home - Re-caulk if caulking is not sticking to a surface, cracks, or falls out when touched.

Remove the old caulking and clean the area before adding new caulking. Check the: - Cracks in driveways, sidewalks and patios - Foundation cracks - Around pet door entrances - Access door to a crawl space - Underneath door thresholds and around windows

CABINETS - CAULKING __________________________________ SECTION II - Around mail slots - At joints, seams or leaks in gutters and downspouts

At the time of closing, joints and cracks in exterior wall surfaces and around exterior should be properly caulked to exclude the entry of water.

If you’re re-caulking joints in your fireplace brick, or around flues and chimneys, use a heat-resistant caulk for safety purposes. You may want to use expandable foam around sillcocks, gas piping, and air conditioning lines as it works as both insulation and a sealing agent. INTERIOR CAULKING:

Interior caulking includes: Sinks Tubs Showers Countertops Cabinets Walls Interior Openings Splashboards Cracks in Foundation Window Frames Door Frames Baseboards Crown Molding Around Shower Door Tracks Around Toilets and Faucets Around Fireplace Brick

Regularly check caulking in the interior of your home. Re-caulk if caulking isn’t sticking to a surface, or if it cracks and falls out when touched. Remove the loose caulking and clean the area before adding new caulking. At the time of closing, joints and cracks in your home’s interior should be properly caulked where appropriate. Before caulking metal, glass and plastic interior surfaces, they should be cleaned with a solvent such as isopropyl alcohol. Before you start, read the solvent safety instructions. Make sure you wipe the solvent off the surface before it air dries.

CAULKING IN GENERAL:

DJK Custom Homes, Inc. will apply the initial caulking to your new home where required.

CAULKING - CONCRETE _________________________________ SECTION II There are four basic types of caulking – oil base, silicone, butyl and acrylic latex. It’s

important to use the correct caulking for each specific area. Talk to a professional, or hardware salesperson to find the best type of caulking for the specific area you’re working on.

Silicone caulk is the most weather resistant type of caulk and works best in areas where water is present, i.e. sinks and countertops. Silicone caulk works extremely well on wood, metal, brick and adheres to both water and oil based paint. Silicone typically doesn’t accept paint finishes. It is available in a variety of different colors.

Latex caulk is used in areas that require painting the caulk, i.e. counter backsplash. TIPS FOR CAULKING

Buy the best. Spend a few extra dollars for the best grade caulk. Bargain caulk takes longer to dry, is harder to apply, does not look nice and generally does not last as long as quality caulk.

Consult with a professional or hardware salesperson as to which type of caulking best suits the needs of specific interior areas.

- Remember that silicone caulking works best in an area where water is present—such as where a sink meets the countertop

- Latex caulking works best for an area that needs painting—such as where a countertop backsplash meets the wall.

Store caulk in a cool, dry place. It is sensitive to heat even in its tube or cartridge. Practice caulking before you attempt to caulk a highly visible area.

- If you go too slowly, the caulking will over fill the crack. - If you go too fast, the caulking will have gaps. - If the caulking looks uneven, use either water or thinner on your fingertip (depending

if the caulking is oil or latex based) and run your finger down the caulk joint smoothing the line.

For the best results. Caulk on a warm day. Cold weather can prevent caulking from adhering, and hot weather may close the joints.

When removing old caulking, use a putty knife to scrape off/out the old caulking. - When working on concrete, stone and brick, use a wire brush to remove the old

caulking and to clean the area. - If a gap develops where the chimney passes through the attic, fill it with insulation

instead of caulking. CONCRETE __________________________________________________________________

Concrete is a hard, white-to-grayish material used for driveways, sidewalks, patios, basements, garage floors and foundations. Because concrete will absorb such things as petroleum-based products, solvents and paints, it is recommended to use a surface sealer on your concrete. Liquid can seep into concrete from either the top or the bottom. Cement is created with a finely pulverized mixture of clay and limestone, or other ingredients. When mixed with other materials such as sand, gravel and water, cement will set itself into what we know as concrete.

CONCRETE _______________________________________________ SECTION II

Efflorescence is a normal condition in concrete and is specifically not covered under this Limited Warranty.

EXTERIOR CONCRETE

Exterior concrete includes driveways, sidewalks, patios, retaining walls, basement walls, foundation, stoops and steps, and garage floors. DJK Custom Homes, Inc. assumes no responsibility for driveways, walkways, patios, boundary walls, window well walls or floors, retaining walls, and bulkheads (except where boundary walls, retaining walls and bulkheads are necessary for the structure stability of a covered building), damage to or defects in concrete floors of basements. It may take some time for your basement floors to fully cure. A dehumidifier in the basement will help the curing process. The garage floor and driveway; should be cleaned by sweeping. Hosing them off with water can cause additional settling.

CRACKS

Repair cracks as soon as you notice them with waterproof concrete caulk to prevent moisture from penetrating to the soil. The caulk will not perfectly match the concrete.

Although flatwork concrete is generally constructed with expansion and contraction joints to minimize cracking, some cracks will occur.

Do not park or drive heavy vehicles on your driveway. Cracking and settling of attached garage floors, slabs, patio slabs, driveways and sidewalks

is specifically not covered under this Limited Warranty STAINS

Use stain remover immediately to remove or lessen the appearance of stains. DRAINAGE

Check that water is draining away from the exterior concrete and foundation. Water should not collect or saturate the ground beside your concrete. Landscaping should allow water to drain away from the exterior flat concrete surfaces. Proper drainage around the foundation is important. Water that seeps through basement

Stoops should not settle, heave, or separate in excess of 1 inch in relation to the house structure.

- No cracks, except cracks less than ½ inch in width, are acceptable in structurally attached concrete stoops and steps. DJK Custom Homes, Inc. will patch as necessary to close gaps from pulling away stoops or close cracks in excess of ½ inch.

- Separation of brick or masonry edging from concrete slabs or steps in excess of ½ inch shall be filled. DJK Custom Homes, Inc. may fill crack with material similar to caulking.

- Fill material is not guaranteed to match existing original materials. DJK Custom Homes, Inc. shall reset any loose or displaced masonry.

 DJK Custom Homes, Inc. will patch cracks in concrete Basement Walls that exceed ¼ inch if infiltration of water exists Standing water on stoops is not uncommon and is not covered by this Limited Warranty. Don’t wash your exterior concrete with cold water from an outside faucet when temperatures

are high and the sun has been shining on the concrete. The change in temperature can damage the surface bond.

OWNER is responsible for the maintenance of all joint materials between concrete slabs during the term of this Limited Warranty. Joint materials between slabs are explicitly not covered under this Limited Warranty.

INTERIOR CONCRETE

Interior concrete includes basement floors, basement walls, foundation walls, and crawl space walls.

CRACKS

Repair cracks as soon as you notice them with waterproof concrete caulk to vent moisture from penetrating to the soil. The caulk will not perfectly match the concrete. It is a fact, cracks will occur in flatwork concrete.

Although flatwork concrete is generally constructed with expansion and contraction joints to minimize cracking some cracks will occur.

STAINS

Use a stain remover immediately to remove or lessen the appearance of stains.

Concrete slabs within the structure may move and settle. This movement may cause cracks and voids in the slab.

- Cracks in concrete floors are normal. - Cracks exceeding ½ inch width or 3/16 inch in vertical displacement are considered

excessive. - If cracking is within the above stated standards, no corrective action is necessary.

FOUNDATION WALLS

Cracks in basement or foundation walls are not unusual. Cracks exceeding 1/8 inch are considered excessive. DJK Custom Homes, Inc. will repair any cracks resulting in the actual trickling of water. Surface patching is acceptable for non-structural cracks. In addition to other provisions hereof, filling is specifically acceptable for settlement, joints,

cracks, chips and breakage. Concrete floors in basements or floors designed for habitability should not have pits,

depressions or areas of unevenness that would prevent their use as finished sub-floors. CONCRETE IN GENERAL

DJK Custom Homes, Inc. is not responsible for deterioration caused by weather, salt, road deicing materials, chemicals, mechanical implements or other factors beyond DJK Custom Homes, Inc.’s control. Hosing your concrete down at a thawing period will help prolong the surface of your concrete. Sealing your concrete driveway each year will also help prolong the surface of your concrete

COUNTERTOPS ______________________________________________________________

LAMINANT

Laminate countertops are generally made from a thin layer of plastic laminate material applied over a composite surface. Laminate material is heat and scratch-resistant, but is not heat- or scratch-proof

Keep moisture from reaching the wood underneath the laminate to prevent warping.

- Fluctuations in temperature and humidity will cause some cracks to open between the countertops and the wall.

- These cracks are normal and should be re-caulked. Refer to "Caulking" section of this warranty booklet.

Limit heat and moisture to your laminated countertop. - When exposed to these elements, the glue used to attach the laminate may

liquefy causing material to separate. - In addition, prolonged exposure to the sun may cause fading of laminate (and

painted) countertops.

Rubber drain mats can trap moisture beneath them, causing the laminated plastic to warp and blister.

- Lift the mat and dry the surface as needed. Keep a watchful eye on caulking around the edge of your countertop and between

countertops and the sink, checking it monthly. - If there is a gap, re-caulk right away to prevent moisture from seeping into

the gap Protect your countertops by always using a cutting board during food preparation.

- To avoid damage to the laminate surface, always set hot pans on trivets or hot pads.

Use only a damp cloth to clean any residue on your countertops. - Abrasive cleaners and steel wool cleaning pads can damage and dull the

surface. Keep wrinkled clothes on the ironing board and cigarettes in an ashtray. Both ironing

on your countertop and setting a lit cigarette on your countertop can cause extensive damage.

Steam from your dishwasher can cause swelling and de-lamination. - Let the dishwasher cool down before opening the door. - You can also prevent moisture damage by applying silicone spray to the

underside of the countertop directly over the dishwasher. You can also prevent moisture damage by applying silicone spray to the underside of

the countertop directly over the dishwasher. - De-lamination should not occur under normal conditions and use. - DJK Custom Homes, Inc. is not responsible for moisture-induced de-

lamination. Laminated countertops typically will have one or more discernible seams.

DJK Custom Homes, Inc. will take corrective action as necessary to meet the standard.

- Filler is an acceptable remedy to repair gaps in seams.

CULTURED MARBLE AND GRANITE Cultured marble countertops are made of crushed marble and high strength polyester resins that are molded and polished to form a strong durable finish. They are not heat, scratch or stain-proof. Granite is natural stone. Granite is in slab-form. It is manufactured to wood templates. Measurements are taken directly from installed cabinets.

Only warm water should be used in a cultured marble or granite sink. - Running only hot water may cause cracking around the drain.

Do not place cigarettes or other hot objects on countertops. - Heat, hot objects or cigarettes can cause permanent damage to

countertops. Clean marble and granite with a mild liquid cleanser on a soft sponge.

- Do not use an abrasive cleanser, as it will cause scratching and dulling.

standard.  

CORIAN

Corian is a type of highly durable man-made marble. With proper care, a Corian countertop can remain as beautiful as the day it was installed. Although Corian withstands heat better than most countertop surfaces, caution must be used to protect it. Do not set hot pans directly on your countertops.

- Some electrical appliances such as frying pans and crock-pits can cause damage to the surface.

- Always use a hot pad or trivet with rubber feet to protect your countertop. Although Corian is impact resistant, avoid striking or cutting on the surface with

heavy or pointed objects. Avoid exposure to strong chemicals such as paint removers, metal cleaners, oven

cleaners, acetone (nail polish remover), and acid drain cleaners. - If any of these come in contact with your countertop surface quickly flush the

surface with soapy water. Countertops should be installed without chips or gouges. Edges should be smooth

and even. Where backsplash joints occur at corners, the top edges should be even with 1/16th

inch unless the nature of the countertop covering dictates otherwise. DJK Custom Homes, Inc. will take corrective action as necessary to meet the

standard. DO NOT use a countertop as an ironing board or ashtray. If the surface of your cultured marble countertops begins to dull after several years,

apply some automotive wax and buff to restore the shine. If you accidently damage your Corian, you can remove minor cutes and scratches.

- Depending on the finish type (matte, stain, semi-gloss, or high-gloss) scratches and cuts can be sanded away using 180 to 600 grit sandpaper (very, very fine), then buffing with a white polishing compound and low-speed polisher. Finish with a countertop wax.

MARBLE

Marble can be permanently stained. - Marble should be sealed with a natural stone penetrating sealer on an annual

basis. - Products such as vinegar can etch the surface.

Consult with your local marble distributor for the best sealer and tips to maintain.

Popular alternatives to patios, decks are versatile home additions that are constructed according to local building code. Most decks are made from pressure-treated wood. “Pressure-treated” means that the lumber is processed to force preservatives deep into the fibers of the board, giving the wood better resistance to decay and termites. Pressure-treated wood appears greenish or yellowish in color when new, but soon turns a silver gray color when exposed to the elements. This is a natural process of pressure-treated wood. Even though it is likely that the lumber used to construct your deck has been pressure- treated, you must take the initiative to protect your deck. Most soft woods that are used to build decks, i.e. cedar and redwood, are mildew resistant by nature. However, periodically it will be necessary to cover the outside of the wood with a sealant to prolong the life of the wood. Sealant will also protect your deck wood from water damage. When water enters the wood and then dries out, it causes the wood to expand and contract. Check with a professional as to which waterproof sealant will work best on your deck.

It is recommended that you wait four to six months to seal a new deck to allow time for the wood to cure.

Seal your deck early in the spring for the best results. Wood shrinkage will cause loose boards and nails to rise up.

- Periodically check your deck for loose nails or screws. - Re-nail or screw loose boards that have been affected by expansion and

contraction. - Avoid using the same nail hole.

Clean out the spaces between deck boards on a regular basis. - If debris and leaves gather between boards, it can lead to wood rot.

Periodically check that all deck components stay securely fastened. - Check support posts, steps, railing, etc. - Deck railings are not designed for people to sit on.

The maintenance of a deck is solely the OWNER’S responsibility. The pressure-treated lumber used in your deck is covered by a manufacturer’s limited

warranty. All structural members in a wood deck shall be sized and fasteners spaced according

to building codes, National Forest and Paper Association span tables or a higher guideline agreed upon before construction by the OWNER and the BUILDER.

At the time the job is accepted, splits, warps and cups in wood decking boards shall not exceed the allowances established by the official grading rules issued by the agency responsible for the lumber species used for the deck boards, including but not limited to Southern Pine Inspection Bureau, Western Wood Products Association, West Coast Lumber Inspection Bureau, Redwood Inspection Service and Northeastern Lumber Manufacturers Association.

- Some checking, splitting and cracking in exterior lumber are inevitable, even when a deck is new.

To check the deck for sealant, pour a glass of water onto the wood. - If the surface turns noticeably darker, the wood needs to be resealed. - If the water beads up, the surface of your deck is still protected.

Before applying sealant, sweep away leaves and remove materials between the boards.

- Do not eat or drink while using preservatives. Keep excessive weight off your deck.

- Do not place children’s swimming pools or hot tubs on your deck without design reinforcement.

If the deck becomes discolored and dark, you most likely have a case of mildew. - Remove mildew with a stiff brush dipped in a mixture of warm water and

strong household detergent. - Work a small area at a time, and then rinse the deck with a mop. - Make sure the spaces between the boards are clear to let water drain

properly. - For a large deck use a power washer to clean it once or twice a year instead

of scrubbing it by hand. Wear safety goggles and gloves when working with any of these products or equipment.

Do not allow foliage to grow extremely close to your deck. - This can lead to minimized air movement and drainage around your deck.

DOORS ____________________________________________________________________________

EXTERIOR DOORS

Exterior doors include entry, patio, sliding glass, overhead garage, and all other exterior doors.

Exterior doors can be metal, fiberglass, composite material, or solid wood. The finish depends on the material.

Doors guarantee a certain amount of privacy and noise reduction. Exterior doors function as a guard against the elements.

Doors are usually made in a thickness of 1 1/8 inches, 1 3/8 inches, or 1 3/4 inches, and stock door heights are 6 feet-8 inches and 7 feet-0 inches. Door width varies depending on location and purpose.

The doorframe (jamb) is the unit that the door closes against and from which the door is hung. Door “hardware” refers to hinges, knobs, pins, latches, locks, etc.

Exterior doors must keep the weather out and be sturdy for security. Wooden exterior doors will be susceptible to moisture damage and other elements, and must remain protected.

DJK Custom Homes, Inc. will only address dents, indentations or mars on steel doors if noted during the New Home Orientation. Dents, indentations or mars on steel doors following occupancy or closing are non-warranty.

WEATHER STRIPPING

Check weather stripping around doors on a regular basis to make sure the seal is secure.

Adjust Metal / Fiberglass doors threshold to keep the door sealed properly.

WARPING

Moisture penetration causes warping. Make sure that all edges and the panels are sealed and the surface is properly

varnished or painted. If a door is slightly warped, keep it latched as much as possible. Often the door will

return to normal. FINISHES

It is recommended that exterior doors be refinished at least once a year. Stained doors with a lacquer finish may weather faster than a painted door. One option is to install storm doors to provide greater protection against the

elements.

HARDWARE

Polish solid brass doorknobs and other hardware at least twice a year to keep their finishes from tarnishing.

Check with a professional for the best polish to use. Non-brass hardware will tarnish if the protective coating is damaged.

OVERHEAD GARAGE DOOR

Apply a light gauge, oil (30 weight) to the track, rollers, hinges, pulleys and springs for smooth operation.

Over-lubricating can cause oil to drip on cars or floor. Check to make sure the nuts and bolts are tight.

PATIO DOORS

Keep tracks clean and free of debris. Use a silicone spray on the tracks for smooth operation.

PANELED DOORS

Paneled doors have what is commonly called “floating panels.” It is common for these panels to show edges that the stain or paint has not covered as the panel moves.

DJK Custom Homes, Inc. will repair split door panels that allow light to be visible or allow the weather to get through the panels.

Use a storm door to reduce heating and cooling costs and minimize dust/debris in windy areas.

INTERIOR DOORS

Interior doors are usually made from wood or composite material and are generally “hollow core”, or “solid core”. These doors are either stained or painted. Interior doors include: passage, privacy, bi-fold, closet, pocket, and any other style

doors. Interior doors, whether wood or composite materials are subject to the natural

characteristics of wood, such as expanding, contracting, shrinking and warping. Interior doors, usually hollow core, can be affected by humidity changes due to use

of showers, dishwashers, humidifiers and forced air furnaces. - It is normal for interior doors to stick or warp due to various weather

conditions. - Winter heating can cause warping due to decreased moisture content. - Summer humidity can cause swelling and sticking. - As the seasons change, some minor adjustments of interior doors may be

necessary.

DJK Custom Homes, Inc. will undercut doors that drag on carpet if DJK Custom Homes, Inc. and OWNER understood that carpet, was planned to be installed as a floor finish by DJK Custom Homes, Inc. However, if carpet selected by OWNER has an excessive high pile, the OWNER is responsible for any additional door undercutting.

DJK Custom Homes, Inc. shall make the necessary adjustments or replace door if passage doors from room to room that have openings between the bottom of the door and the floor finish material that is in excess of 1 1/2 inches. Closet doors should not have openings in excess of 2 inches.

Bi-fold doors should slide properly on their tracks at the time of closing. Pocket doors should not rub in their pockets during normal operation. DJK Custom Homes, Inc. will take corrective action as necessary to meet the

standard once the first year of occupancy. To fix a sticking door, fold a piece of fine sandpaper around a wooden block, and

sand the edges. - Apply the proper finish to the door.

Apply a small amount of lubricant at a time to sticking overhead garage door hardware, do so in moderation.

- Over lubricating can drip oil on your cars and garage floor. Rub a lead pencil or graphite lubricant on squeaky door hinge. Teach children not to swing or hang on doors or doorknobs, as it will work the

hardware loose. Discourage slamming doors.

- This can damage doors and may create cracks in the wall.

WARPING Keep the humidity levels in your home consistent to help prevent warping. If a door is slightly warped, keep it latched as much as possible. Often the door will

return to normal.

STICKING

Sticking can be caused by too much moisture in the wood or by uneven door alignment.

Paint, varnish and/or seal the edge after sanding to reduce sticking. Check to make sure the hinge screws are tight and holding properly. Keep bi-fold, pocket and sliding doors from sticking by keeping the tracks free of dirt

and debris. As needed, lubricate tracks and hinges with a silicone spray for smooth operation.

HARDWARE

Lubricate door locks with graphite or other waterproof lubricant (like W-D 40) at least twice a year. Don’t use oil; it will gum up the locks.

Polish solid brass doorknobs and other hardware at least twice a year to keep finishes from tarnishing.

Wipe non-brass hardware with clean cloth. Hardware that is not solid brass will tarnish if the protective coating is damaged.

SCRATCHES

Repair scratches or gouges by filling them in with stick shellac, available at hardware stores.

Rub the stick along the damaged spot; let it blend with the door. Treat the spot with furniture polish.

ELECTRICAL SYSTEM ________________________________________________________

The electrical system in your home has been installed by a licensed electrical contractor; in accordance with all applicable codes. The codes are in place to ensure a safe operating electrical system for normal residential use.

ELECTRICAL LINES

Keep branches, shrubbery and trees clear of overhead electrical lines leading to your home.

UNDERGROUND CABLES

Underground cables are generally buried deep enough that digging will not affect them. But before you dig, it is a good idea to call your local utility service for the location of buried cables.

ELECTRICAL SYSTEM ___________________________________ SECTION II CIRCUIT BREAKERS

Circuit breakers are the safety valve of your electrical system. The master circuit breaker cuts off the electricity system to the entire home.

Breakers are located in the main electrical panel and protect wiring and appliances by turning off (tripping) if the circuit is overloaded. However, the addition of large appliances such as a second refrigerator, and some small appliances may trip the circuit.

Give careful consideration when adding or upgrading equipment that may overload the capacity of your system.

When working on anything electric, shut off electricity to your home at the master switch.

IF ANY OUTLET ISN'T WORKING:

Check to see if it is, controlled by the wall switch. Check the circuit breakers to see if any are tripped. Reset circuit breakers by switching the breaker to the full “off,” then to full “on.”

Just switching a tripped breaker to “on” will not restore service. If the outlet still doesn’t supply electricity, call a professional electrician.

IF A CIRCUIT BREAKER CONTINUES TO TRIP OFF:

Unplug all items connected to it and reset it to “on”. If the circuit stays on it is an indication that one of the items you unplugged is

defective. Check each item. If a circuit trips when nothing is connected to it, call a professional electrician.

GROUND FAULT INTERRUPTER (GFI)

GFI circuit breakers are on some kitchen, bathroom, garage, and outside receptacles.

These breakers are designed to trip at the slightest sign of moisture contact. Test the GFI reset button on circuit breakers once a month. This will trip the

circuit. Press the reset button to return service. If a GFI circuit trips during normal use, it may be an indication of a defective

appliance. A heavy appliance such as freezer may trip the GFI breaker. If you plug a

refrigerator or freezer into a GFI controlled outlet, it’s possible that the breaker will trip the freezer contents will be ruined. DJK Custom Homes, Inc. is not responsible for spoiled food.

Meters are installed by, your local utility company. The billing amount is based on the total kilowatt-hours used as measured by the

meter. Call the customer service department of the local power company with any

questions about billings.

FIXTURES

To check light fixtures that are not working, make sure the bulb is screwed in tightly.

Use a second bulb to assure that the bulb isn’t burned-out or broken. Occasionally check to make sure your fixtures are tightly mounted.

- Remove and clean decorative gloves or other styles with enclosed bulbs, as needed.

- Replace any cracked globes to avoid the fixture from falling. - Do not exceed the recommended wattage of fixtures. It’s usually

stamped on the fixture. - A higher than recommended wattage can burn the wiring or ignite a fire.

Clean interior and exterior of solid brass fixtures with a brass cleaner to avoid tarnish.

- Hardware, which is not solid brass, will tarnish if the protective coating is damaged.

POWER FAILURE

In the event of a complete power failure, determine if your neighbors have power. If they do not, call the local power company.

If the failure is only in your home, check the master switch and circuit breakers. If one circuit breaker continues to trip, make sure circuits are not overloaded. If power will not stay on, report to DJK Custom Homes, Inc.

EXTERIOR LIGHTING

Never work on exterior light fixtures or change bulbs in damp weather. Outdoor lighting requires safe handling. Plug outdoor lights and lights in trees into a ground fault interrupter (GFI) circuit. Any extension cord used outside needs to be outdoor rated and in good condition. Plug the cord in a GFI circuit.

ELECTRICAL SYSTEM - EXTERIORS ___________________ SECTION II INTERIOR LIGHTING

Lights may flicker for an instant when your furnace or air conditioner starts. The furnace or air conditioner requires a large amount of electricity to start. The electricity current returns to normal as soon as the system starts. This is normal and not an electrical problem.

The electrical wiring should be capable of carrying the designated load for normal residential use to your electrical box.

- DJK Custom Homes, Inc. will meet the standard set by electrical code requirements.

All switches, fixtures and outlets on interior and exterior lights should operate as intended.

Ground fault interrupters (GFI) are sensitive safety devices installed into the electrical system to provide protection against electrical shock. These sensitive devices can be tripped very easily. Tripping is expected. DJK Custom Homes, Inc. installs ground fault interrupters in accordance with the approved electrical code.

- DJK Custom Homes, Inc. is not responsible unless the tripping is due to faulty installation. If this is the case, DJK Custom Homes, Inc. will take corrective action as necessary to meet the required electrical code standard.

Exposure to weather or use of abrasive cleaners may cause brass to tarnish on your interior and exterior light fixtures.

- DJK Custom Homes, Inc. will only take corrective action as necessary if tarnishing is noted prior to the time of closing or occupancy.

Light bulbs are specifically not covered by this Limited Warranty. If an electrician is called to your home for repairs and a burned out light bulb is the problem, the OWNER will be charged for the cost of the service call.

Surges in electrical systems are normal and unavoidable. - If you own sensitive equipment, you may want to buy a surge protector.

They are available at most hardware and electronics stores. Don’t plug any light or appliance into an extension cord that’s smaller in

diameter than the cord attached to the devise. The cord could overheat and cause a fire.

If there are children in the home, cover unused outlets with safety covers. Teach children not to touch electrical outlets or fixtures.

If your neighborhood experiences a power outage, unplug appliances, TVs, stereos, and other similar items to protect them from a possible electrical surge when power is restored.

MASONRY

Brick and stone have a reputation for durability and low maintenance. - Minor chipping, cracking, or mortar shrinkage is normal and should not

cause concern. - Since no two bricks or stone are exactly the same, variations in size, color,

and placement are to be expected. Occasionally, a white powdery substance may appear on masonry. This water-

soluble salt, known as efflorescence; is caused by alkali salts bleeding out of the brick or block.

- This is a normal occurrence and does not indicate that there are any problems with the product.

- Efflorescence can be removed even though it will usually disappear over time.

- Masonry can be cleaned with water and a stiff brush. After several years, brick or stone may require tuck-pointing, which is repairing

the mortar between the brick or stone. Do not allow ivy or any other ground cover to grow on brick or stone, walls. The

tentacle-like roots of the ivy will work their way into tiny masonry cracks, promoting deterioration. Trim any encroaching foliage.

Keep the “weep holes” located at the bottom of brick and stone, walls open. If they get plugged or sealed, water can build pressure against the wall.

To retain the natural appearance of brick or stone, you can apply a coat of clear silicone finish or water-repellent solution to prevent water from being absorbed into the brick.

Ask a professional masonry contractor for the best product to use on your masonry. Small cracks are common in mortar joints of masonry construction. Cracks

larger than 1/4 inch in width are considered excessive. DJK Custom Homes, Inc. will repair cracks in excess of 1/4 inch by tuck-pointing

or patching. - These repairs should be made toward the end of the warranty period to

permit normal settling and allow the home to stabilize. DJK Custom Homes, Inc. is not responsible for color variations in the original

mortar or when making repairs.

VINYL SIDING

Vinyl siding gives the exterior of your new home the look of wood but with less maintenance.

Vinyl siding does expand and contract as the temperatures changes. - “Waviness” is considered normal with vinyl siding and cannot be

prevented. Most manufacturers guarantee against rusting, peeling, blistering or flaking under

normal conditions.

EXTERIORS _______________________________________________ SECTION II Before you begin any maintenance task, refer to your manufacturer’s warranty for

specific coverage of your vinyl siding. If your vinyl siding is moderately dirty, wash it with water from the garden hose.

- Use a soft bristled, long handled brush to gently clean the siding. For heavy-duty cleaning, wash it with a solution of water and household detergent.

- Use 1/3 cup of detergent to one gallon of water. To minimize streaking, wash from the bottom to the top.

- Immediately rinse the surfaces thoroughly with water from the hose. - Avoid vigorous rubbing to prevent glossy areas over the finish.

Mildew, which appears as black spots, can grow on vinyl siding. Remove it using the solution listed below:

- One-third cup detergent. - One quart sodium hypo chloride 5% solution (Clorox is an example). - Three quarts of water.

CAUTION:

Stronger concentrations of cleaners can cause damage to the vinyl finish. Rinse the surface thoroughly with clear water immediately after cleaning. Protect your eyes and skin from the solution. In all cases follow the manufacturer’s instructions. Avoid the use of abrasive cleaners on vinyl siding. Use mineral water to remove foreign substances such as tar and caulking. Apply the mineral water (in reasonable amounts) directly to the substance, and then rinse the area with water immediately after cleaning.

ALUMINIM SIDING

Aluminum siding may be cleaned with a hard spray of water from a garden hose. - If the siding requires heavy-duty cleaning, use a solution of water and non-

abrasive household cleanser. Wash with a sponge.

FIBER CEMENT SIDING

Refer to your manufacturer’s instructions for cleaning, repainting and caulking.

WOOD SIDING

Refer to your manufacturer’s instructions for cleaning, re-staining, repainting, and caulking wood siding.

The easiest way to clean wood shake siding is to brush it with a stiff-bristled brush on a warm dry day.

Use putty on joints between siding boards and caulk any open seal joints. Do not allow vegetation, especially vines, to grow on the siding.

- Vegetation growing between joints may cause deterioration. - Moisture from trees and shrubs planted too close to siding may cause rot.

Paints applied over raw woods such as rough cedar may bleed allowing characteristics of the wood to show through. This is common and DJK Custom Homes, Inc. will take no steps to correct it.

Exterior siding should not delaminate or deteriorate if handled and installed in accordance with manufacturer’s specifications.

Natural wood sidings can be expected to weather and change color as they age. DJK Custom Homes, Inc. will take corrective action as necessary during the first

year warranty, unless de-lamination or deterioration is caused by OWNER’S neglect to maintain siding properly.

DJK Custom Homes, Inc. is not responsible for match in color and/or texture in the repaired area or for any newly painted surfaces that do not match the original surface in color.

Siding bows exceeding 1/2 inch in 32 inches are considered excessive. - DJK Custom Homes, Inc. will take corrective action as necessary to correct

lap siding with bows exceeding the performance standard. DJK Custom Homes, Inc. will match the existing siding as closely as possible.

- DJK Custom Homes, Inc. is not responsible for slight color variations. Visible siding end gaps wider than 3/16 inch are considered excessive.

- DJK Custom Homes, Inc. will take corrective action as necessary to meet the performance by providing joint covers or by caulking the gap.

If the siding is painted, DJK Custom Homes, Inc. will paint the new caulking or cover.

- DJK Custom Homes, Inc. is not responsible of color match. Some waviness in siding is to be expected because of bows in studs.

- Joint separations in siding exceeding 3/16 inch are considered excessive. - DJK Custom Homes, Inc. will caulk or repair siding as necessary to fill the

joint. DJK Custom Homes, Inc. is not responsible for the repaired area matching the

original siding precisely. Stain acts as a moisturizer and keeps wood sidings from cracking.

- It is recommended that your wood siding be stained at least once a year. - Check your manufacturer’s specific instructions for staining and painting. - Select quality stain and paint and do not over-paint. - Thick layers of paint will crack and peel.

STUCCO AND CEMENTIVE FINISHING

Stucco is a brittle cement product that is a durable home finish. Stucco and synthetic stucco (such as Dryvit) finishes are subject to expansion and contraction. Minor hairline cracks in the outer layer of stucco or cementive finishing are considered normal occurrence and not a deficiency. Inspect the exterior surfaces of your home annually. Avoid spraying water onto stucco and/or cementive finishing surfaces. It can cause

permanent damage to the surfaces. A white powdery substance, called efflorescence, may accumulate on stucco or

cementive finishing. It is a natural phenomenon and cannot be prevented. - Efflorescence can be removed by scrubbing with a stiff brush and strong

vinegar. -

- Ask a hardware salesperson for recommendations for commercial products that remove efflorescence.

DJK Custom Homes, Inc. will repair stucco or cementive finishing cracks that exceed 1/8 inch in width once during the warranty period.

- These repairs should be made toward the end of the first year of occupancy to permit normal settling of your home.

The finish coating shall not separate from the base on an exterior wall. DJK Custom Homes, Inc. shall repair areas where coating has separated from the base, although DJK Custom Homes, Inc. is not responsible for failure to match color or texture due to nature of materials.

DJK Custom Homes, Inc. is not responsible for slight color variation in the original stucco application or in any repair work.

Defects that are a result of characteristics common to stucco and cementive finishing, such as but not limited to fading, chalking, peeling, checking or cracking due to sunlight, drying or curing, are specifically not covered by this Limited Warranty.

Paint touch-ups to stucco and cementive finishing repairs often do not match due to the natural and uncontrollable deterioration of the original paint over time.

- DJK Custom Homes, Inc. is not responsible for paint touch-ups to stucco and/or cementive finishing match.

FIREPLACES _______________________________________________________________________

A fireplace is not intended to be the sole source of heat in your home. In fact, only ten-percent (10%) of the heat generated from a fireplace stays in your living area. The other ninety percent (90%), including warm air from the home that the fire draws from combustion, goes up the chimney. With these energy-wise tips, you may want to consider using your fireplace as a luxury instead of a necessity. DJK Custom Homes, Inc. will lead you through the operational procedures during your New Home Orientation

Refer to and follow the manufacturer’s instructions. Except for cleaning and very minor repairs, it is recommended that a professional

fireplace or chimney company handle all fireplace inspections and repairs. Before you light the first fire in the fireplace, buy a grate to hold firewood inside the

fireplace. There should be at least 3 inches between the front of the grate and the fireplace

opening. Fireplace tools for stoking fire and removing cool ashes are recommended for safety

and convenience. Open the damper before you light the fire.

- Smoke in the room indicates that the damper is not fully open. - When the fireplace is not in use, keep the damper closed to prevent air drafts. - Periodically check the damper to make sure it opens and closes properly.

Make the first five fires small and slow burning. - Building extremely hot, raging fires in a new fireplace may cause the lining

to crack.

Avoid burning freshly cut wood. The type of wood you burn and frequency of fires will determine how often your fireplace and chimney needs cleaning. Burning seasoned hardwood, such as oak and apple, will help to cut down on soot build-up.

- Place the largest logs to the rear of the grate when building a fire for the best results.

- Split any logs that are 6 inches or larger in diameter. With a gas vent, open the gas control valve slightly when ready to start a fire.

- Use long matches or an extended lighter to ignite the gas. There may be a short delay between turning on the gas valve and flame ignition.

- This is normal and does not indicate a malfunction. After the gas is burning, adjust the valve for desired setting for gas log set or if

you’re using natural wood, turn the valve off once the logs are lit. - For best results and safety read and follow manufacturer’s instructions.

Glass doors or screens can minimize damage should there be flying sparks. Glass doors will decrease the amount of warm air that is drawn from your home for combustion.

If your home has a slate fireplace hearth, clean it with a damp rag and mild soap. - Furniture polish, used lightly, can restore the sheen to slate.

As needed, remove cooled ashes from the fireplace pit. On a regular basis, this will help eliminate a smoky smell in your home.

- Let ashes cool for a minimum of 48 hours after a fire before removing them. - Use the cooled ash as a fertilizer for your lawn, flowerbeds or trees.

It is recommended that a professional chimney company clean soot and creosote from the chimney.

- Soot and creosote, a hard, tar-like substance released from wood through combustion, can ignite and burn fiercely.

You may want to have a professional inspect your fireplace on an annual basis. You should have a spark guard located over the top of your chimney to trap sparks

and keep wildlife out. Check it annually for soot build-up and have it cleaned as needed by a professional. Chimney caps and rain guards should be kept in good condition in order to keep

moisture from entering your chimney. As needed, have them checked for rust and corrosion.

As time goes by you may want to have a chimney flashing checked to make sure it is properly attached.

Fireplace linings may become discolored as a result of normal use. - No corrective action is needed.

Fireplaces may develop small cracks due to temperature changes and other factors. - No corrective action is needed.

DJK Custom Homes, Inc. shall repair by pointing or patching all masonry cracks that exceed 1/4 inch in width. DJK Custom Homes, Inc. is not responsible for matching color or texture of pointing or patching material to existing mortar.

Some minor dripping of water down the flue may occur during prolonged rains. - Excessive leakage when it rains is unacceptable. If this is the case, DJK

Custom Homes, Inc. will take corrective action. Newly built fireplace chimneys may separate slightly from the main structure.

- For separation in excess of 1/2 inch in 10 feet, DJK Custom Homes, Inc. will take corrective action as necessary.

- Caulking is an acceptable correction. A properly designed and constructed fireplace and chimney should draw properly.

- High winds may cause temporary negative draft situations. - Obstructions such as tree branches that are too close to the chimney may

cause negative drafts. - In order to create an effective draft, some houses may need to have a window

opened slightly. - DJK Custom Homes, Inc. will take corrective action as necessary to meet

the standard only if a negative draft is due to design and construction

FLOOR COVERINGS _______________________________________________________________

CARPETING

Efforts are made to limit the number of seams and to place the seams as unobtrusively as possible; however, seaming is unavoidable. After the installation of new carpet, you will notice excess yard on the carpet surface. This is normal and will subside within a few months after repeated vacuuming.

Refer to manufacturer's recommendations on the care for your carpet. It is recommended that you have your carpet professionally cleaned at least once a

year to lengthen the life of your carpet. The frequency of cleaning depends on the type of yarn, color, and how much traffic

the room receives. If you choose to clean the carpet yourself, review the manufacturer's

recommendations so that the method used does not void the warranty. Vacuum at least once a week.

- In heavy traffic areas, it is recommended that carpet be vacuumed three to four times per week.

- An upright vacuum with beater bar works best. - Empty the vacuum cleaner bag when it becomes two-thirds full for best

pickup results. - Occasionally, vacuum against the grain of the pile to remove dirt and to help

raise the carpet’s nap. Spills and stains should be removed with a lint-less white cloth.

- Always blot; never rub. - Semi-solids can be removed with a rounded spoon. - Before using a stain remover, refer to manufacturer’s recommendations and

pre-test by applying several drops of the stain remover to an inconspicuous area, such as in a closet.

Pushing the furniture may stretch the carpet and cause “ripples”. - Lift furniture to move it. - Move furniture an inch or two every couple of weeks so it doesn’t always

push down on the same fibers.

- Molding and thresholds that hold carpeting down must be kept firmly in place.

Excessive sunlight may cause carpet to fade. Use window coverings to reduce the effect of sunlight on carpeting.

Keep clean entry mats at every entrance to reduce tracked-in-soil. Watch the furniture movers you hire. Dragging of their feet, pushing furniture or

sliding boxes can all stretch your carpet. - If your carpet shows ripples or ridges after the movers have completed their

work, contact the moving company immediately. Carpet has a tendency to loosen in damp weather and tighten again in dry weather.

- This stretching is normal and is specifically not covered by DJK Custom Homes, Inc.’s Two-Year Limited Warranty.

Wall to wall carpeting installed as the primary floor covering, when stretched and secured properly, should not come up, become loose, separate or stretch excessively at its points of attachment at the time of closing.

DJK Custom Homes, Inc. will take corrective action as necessary for stains or spots noted during your New Home Orientation.

DJK Custom Homes, Inc. is not responsible for dye lot variations if replacements are made.

HARDWOOD

Some shrinkage or warp-age of hardwood floors may occur, especially around heat vents or heat producing appliances. If your wood floors become wet repeatedly, or are soaked through even once, warping could occur. Moisture, tracked in on wet shoes, also causes a filmy, white surface on hardwood floors. Moving heavy furniture can cause scratching; dropping heavy objects can cause dimples. Heavy traffic areas are likely to show a dulling of the finish over time. Refer to your manufacturer’s recommendations for proper care of your hardwood floors. You are responsible for routine maintenance is the primary goal with hardwood floors for the life of your home. Wood floors will respond noticeably to changes in humidity levels. Seasonal changes will cause the wood to expand or contract. A humidifier, used according to manufacturer’s instructions, will help, but will not completely eliminate this natural reaction of wood. If damp or rainy weather causes a slight expansion in your hardwood floors, the

boards may rub together, creating a squeak. - Powdered graphite between the boards will usually help the squeaking.

Use floor protectors on furniture legs to avoid scratches and indentations. Use extreme caution when moving furniture. Use mats at outside door entrances and area rugs to protect your floors from moisture

and dirt. Do not use rubber, foam or plastic backed mats as they can discolor the wood.

Sweep or vacuum on a daily basis or as needed. Never use a wet mop or sponge mop on hardwood floors; only use a cotton mop on

hardwood floors with a polyurethane finish.

When the floor becomes soiled check with your installer or manufacturer for cleaning recommendations.

Over time, with normal use, polyurethane finished floors may need to be re-coated by a qualified contractor.

Waxing or the use of such products as Murphy’s Oil Soap is neither necessary nor recommended for polyurethane finished floors.

- If you use such products, it is very difficult to re-coat the floor. - Preventive maintenance and regular cleaning should maintain the desired

luster. - You may occasionally use Pledge to enhance luster. However, use any

polish in moderation as it can cause the floor to become slick. Wipe all spills immediately.

- For dried spills, use a slightly damp cloth with vinegar and warm water solution.

Gaps between wood floorboards should not exceed 1/8 inch in width. - DJK Custom Homes, Inc. will take corrective action as necessary to meet

the standard for gaps appearing within warranty period, unless the settlement gaps are due to normal seasonal fluctuation.

- DJK Custom Homes, Inc. will fill only the adjoining floorboards in the affected area.

Cups in strip oak floorboards should not exceed 1/8 inch in depth in a 3 inches maximum span measured perpendicular to the long axis of the board.

- DJK Custom Homes, Inc. will take corrective action as necessary to meet the standard prior to the closing or occupancy.

- DJK Custom Homes, Inc. is not responsible for cupping caused by exposure to moisture beyond DJK Custom Homes, Inc.’s control.

- DJK Custom Homes, Inc. is not responsible for variations in color, stains, finishes or fillers.

Clean wood floors with a dry dust mop. - Damp mopping (damp, not wet) should be done only on well-sealed floors. - As a general rule of thumb, the less moisture applied to the surface of a wood

floor, the better. If possible, limit the amount of direct sunlight, with blinds or curtains, on wood

paneling to reduce fading.

LINOLEUM, VINYL, RUBBER, ASPHALT - RESILIENT FLOORS RESILIENT FLOORS

Resilient floors include linoleum, vinyl, rubber and asphalt. Measures have been taken by DJK Custom Homes, Inc. to minimize the possibility of ridges and seams showing through resilient floor coverings. However, some ridges and seaming is unavoidable. Clean loose dirt, dust and crumbs with a broom, dust mop or vacuum on a basis. Wipe spills with a dry cloth. If a spot dries, use a damp cloth or mop.

Occasionally damp mop resilient floors. Excessive water can penetrate seams, causing flooring to lift and curl.

Refer to the manufacturer’s instructions for proper care. Most resilient flooring is “no wax”, which means it has a clear, tough coating on the surface. Even this surface will scuff or become dull over time.

Restore original shine with and acrylic finish, rather than a paste wax or solvent-based polishes.

Use floor protectors on furniture legs to avoid scratches, indentations, tears and wrinkles.

Use extreme caution when moving appliances and furniture. Asphalt compounds tracked in on shoes may permanently stain resilient flooring. Use mats at doors to minimize tracking. Be aware that some foam, plastic or rubber backed mats may discolor resilient

floors over time. Raised nail heads are a result of movements of the floor joist caused by natural

shrinkage and deflection. - If a nail “pop” becomes visible through resilient flooring, place a block of

wood over it and hit the wood with a hammer to reset the nail. If nail “pops” break the surface of resilient flooring, DJK Custom Homes, Inc. will

take corrective action as necessary. - At DJK Custom Homes, Inc.’s option, DJK Custom Homes, Inc. will

repair or replace resilient floor covering in the affected area. - DJK Custom Homes, Inc. is not responsible for discontinued patterns or

color variation in the floor covering. Resilient flooring should not lift, bubble nor detach under normal use.

- DJK Custom Homes, Inc. will take corrective action as necessary to meet the standard. However, DJK Custom Homes, Inc. must be notified within three days of loss of adhesion in order to make proper repairs.

- DJK Custom Homes, Inc. is not responsible for discontinued patterns or variations in color of the resilient flooring, nor for problems caused by OWNER’S neglect or abuse.

Readily apparent depressions or ridges exceeding 1/8 inch are considered excessive. - The ridge of depression measurement is taken with the gap at one end of a 6-

inch straight edge placed over the depression or ridge, with three inches of the straight edge held tightly to the floor on one side of the defect.

- DJK Custom Homes Inc. will take corrective action as necessary to meet the standard one time during the warranty term.

Seams or shrinkage gaps should not exceed 1/16inch width in resilient floor covering joints. Where dissimilar materials come together, a gap should not exceed 1/8 inch.

- DJK Custom Homes, Inc. will take corrective action as necessary in order to meet the standard. However, DJK Custom Homes, Inc. must be notified within three days of shrinkage in order to make proper repair.

FLOOR COVERINGS - H.V.A.C ___________________________ SECTION II

TILE, BRICK, MARBLE, AND STONE

Ceramic and marble tiles are durable and decorative. Cracks in grouting of ceramic tile joints are common due to normal shrinkage conditions. Shade and/or color variation is inherent in all fired clay products and grout. Marble is a product of nature and will have variations in coloring and vein lines. It is natural for slight separations to occur where tile grout meets another material, such as along the edge of the bathtub. Grout between tiles may crack. Tub and tile caulk can be used to seal this separation.

Seal as soon as possible as missing or cracked grout allows water to seep under the

tile to the flooring beneath. Vacuum tile, brick, marble and stone floors as needed. Occasional mopping with

warm water (in moderation) may be appropriate. - Refer to the manufacturer’s recommendations. - Abrasive cleaners should not be used on tile or marble floors as they may

scratch the surfaces. Tile, brick, marble and stone flooring should not loosen.

- DJK Custom Homes, Inc. will take corrective action as necessary to meet the standard, unless the defects were caused by the OWNER’S actions or negligence.

Cracks in grouting of ceramic tile joints are common due to normal shrinkage conditions.

- DJK Custom Homes, Inc. will take corrective action to repair cracks that are 1/8 inch or greater as necessary ONE TIME within the warranty term.

- DJK Custom Homes, Inc. is not responsible for discontinued patterns in tile or discontinued grout color or color matches.

Clip snagged carpet fibers with manicure scissors, don’t pull. Check your manufacturer’s recommendations for touching up scratches or gouges on

wood floors. Some manufacturers offer special touch-up kit. If you have to move furniture or appliances across resilient flooring, try placing a

thick towel beneath the appliance or furniture, then sliding. - You may also try laying a piece of heavy cardboard or plywood on the floor

and “walking” the appliance across it. Should your resilient flooring become torn or gouged, some manufacturers offer

seam-coating kits. Refer to your manufacturer’s instructions for repair. HEATING, AIR CONDITIONING, AND VENTILATION _______________________________

Carefully read and follow the manufacturer’s instructions for care and use. Regular maintenance of your furnace will reduce energy costs and prolong the life of your furnace. Your heating system was designed with a furnished home in mind. If you move in and have not yet acquired all of your draperies and furnishings, your home may seem cooler than you expect. THERMOSTAT

Thermostats are calibrated to plus or minus 5 degrees Fahrenheit. When the thermostat registers a lower temperature than the temperature setting

selected, the furnace will come on automatically. Setting the thermostat at a higher temperature will not heat your home faster. Temperatures normally vary from floor to floor and even room-to-room in a

home, especially when it is very cold outside. In extremely cold weather, the furnace will cycle on and off more frequently and

for shorter periods of time. Dust your thermostat as needed to keep it lint and dust free.

REGISTERS

The registers help regulate the flow of air throughout the home. Adjust the registers for your family’s comfort and lifestyle. Once adjusted, the registers and thermostat will work together to maintain the

desired temperature. The OWNER is responsible for adjusting dampers and registers. Do not let furniture, window coverings or other objects block register airflow. Vacuum and dust registers as needed.

 FILTERS

Furnace filters should be inspected regularly, cleaned, or replaced as necessary. Dirty filters result in reduced efficiency and higher operating costs. If your system has disposable filters, replace them at least every two months

during the heating season. Permanent filter may be vacuumed or tapped to loosed dirt, then washed with

warm water and a mild detergent. We DO NOT recommend using lifetime filters.

COMBUSTION AIR VENTS  

Furnaces installed in basements use combustion air vents to supply outside air to the furnace.

Do not block or cover the combustion air vent. The supply of oxygen is vital to the safe and efficient operation of the furnace.

As the heating system operates, it is normal to hear some popping and pinging sounds. These sounds are the natural result of ductwork heating and cooling in response to the airflow. There is no necessary maintenance for this situation.

HUMIDIFIER

If your furnace has been installed with a humidifier, refer to the manufacturer’s instructions on care and use. Follow the instructions carefully.

Your heating system should be capable of producing an inside temperature of 70 degrees Fahrenheit under local outdoor winter conditions as specified in the ASHRAE HANDBOOK, except in vaulted areas, in the center of each room and at a height of 5 feet above the floor. Federal, state, or local energy codes shall supersede this standard where such codes have been locally adopted.

The heating system must be allowed at least 72 hours to reach 70 degrees Fahrenheit.

If your heating system does not provide the requited temperatures, DJK Custom Homes, Inc. will take corrective actions as necessary.

A booming noise caused by “oil canning” is not acceptable. - DJK Custom Homes, Inc. will take corrective action as necessary.

Although the heating system is not a “sealed system,” the ductwork should remain attached and securely fastened.

- If it becomes unattached during the warranty term, DJK Custom Homes, Inc. will take corrective action as necessary.

Turn on your furnace for a trial run early in the fall. - If there is a problem that requires a professional technician, it is much

more convenient to discover it before cold weather. When a heating system has not been used for an extended period of time, you

may smell a mild odor when the furnace kicks on. - The odor, caused by dust that has settled in the ducts, should disappear. - If you have a gas furnace and smell gas odor, call the gas company

immediately. If the system will not start, try the following:

- Set the thermostat at HEAT and check the temperature setting. - Check the breaker at the electrical panel. The switch should be in the

ON position. - If your furnace has a pilot light, check to see that the pilot light is on. If

it is not on, check your manufacturer’s instructions for lighting instructions or call the gas company.

- Your furnace should have an ON/OFF blower switch. It looks like a regular light switch and should be in the ON position. (If your furnace is a high efficiency furnace, there is no pilot light and no ON/OFF switch.)

safety switch will not allow the furnace to start. - If your furnace operates with an electrical ignition, turn the thermostat to

OFF and then back to ON. This allows the system to reset the ignition. If the system does not start, call the installing contractor.

AIR CONDITIONING SYSTEM

The size (tonnage) of your air conditioning system has been specified according to your home’s floor plan, total window area and solar orientation. The system is designed to produce an inside temperature of 78 degrees Fahrenheit while cooling, as measured in the center of each room at a height of 5 feet above the floor, under local conditions as specified in the ASHRAE HANDBOOK. DJK Custom Homes, Inc. will explain the operation of your air conditioning system at your New Home Orientation. Carefully read and follow the manufacturer’s instructions on care and use.

Air conditioning can add comfort to you home. If used improperly or run inefficiently, it can result in wasted energy. Regular maintenance of your air conditioning system will save energy dollars. CLOSED SYSTEM

A closed system continually recycles and cools the interior air until the desired temperature is reached.

Outside air disrupts the cycle. Shield the inside of your home from direct and indirect sunlight during the time

you are running the air conditioner. Close windows, drapes, blinds and shutters for best efficiency

THERMOSTAT

Thermostats are calibrated to plus or minus 5 degrees Fahrenheit. When thermostat registers a higher temperature setting than the temperature

setting you selected, your conditioning will come on automatically. Setting the thermostat at a lower temperature will not cool your home any faster. If you turn up the air conditioning in an attempt to cool a home faster, you will

use more energy than necessary. The cooling process only begins when you set the thermostat. For example, if you come home at 6 p.m. on a day when the outside temperature

is 90 degrees Fahrenheit and set your thermostat to 75 degrees Fahrenheit, the air conditioning process will begin, but will take longer to cool the house.

During the day, the furniture, walls and carpet have absorbed heat. It is recommended that you set the thermostat at a moderate temperature in the morning to achieve the most efficient evening cooling.

COMPRESSOR

The main operating unit (compressor) is usually located outside. Keep vegetation from growing around or on the compressor. During cooling season, periodically check the compressor’s housing to make

sure that leaves or grass do not block the vents. Keep the condensation line free of grass clippings and dirt to avoid clogging. Refer to the manufacturer’s specific instructions on cleaning.

COOLANT/REFRIGERANT

If your air conditioning system blows warm air, either the compressor is not sufficiently charged or it may have a refrigerant leak. In either case, call DJK Custom Homes, Inc. (To add refrigerant to the system, the outside temperature must be 70 degrees Fahrenheit or higher).

The cooling system should be capable of maintaining a temperature of 78 degrees Fahrenheit, as measured in the center of the room at a height of 5 feet above the floor, under local outside conditions as specified in the ASHRAE HANDBOOK.

For homes with a single system application, the allowable tolerances between floors will not exceed 7 degrees Fahrenheit.

Federal or local energy codes shall supersede this standard where such codes have been adopted locally.

Where outside temperatures exceed 93 degrees Fahrenheit, a differential of 15 degrees Fahrenheit will be acceptable.

DJK Custom Homes, Inc. will take corrective action so that temperature conditions are in accordance with specifications.

DJK Custom Homes, Inc. will take corrective action if refrigerant lines leak during the term of this warranty.

- The condensation lines will clog under normal use. - It is DJK Custom Homes, Inc. responsibility to provide

unobstructed condensation lines at the time of closing. Thereafter, this is the OWNER’S maintenance responsibility.

Prior to warmer months, turn on the air conditioning system for a trial run. If the system won’t start, try the following:

- Set the thermostat to COOL and check the temperature setting. - Check the breakers at the electrical panel, one for the furnace (air

handler) and one for the 220-volt unit (condenser). Make sure they are both switched ON.

- The front panel should be secure. If it is not tight, the safety switch will not allow the fan to start.

- The power switch beside the unit should be switched ON. The switch looks like a regular light switch.

- If the compressor does not run, turn the thermostat to OFF, then back to ON. This will reset the overload protector and allow the compressor to start after a time-off period. However, if the system does not start after an hour, call DJK Custom Homes, Inc.

When air conditioning season ends, cover the outside unit to protect it from the weather.

If your furnace system has a humidifier, turn it off when using the air conditioning.

- If the humidifier is left on, the additional moisture may cause a freeze up of the cooling system.

VENTILATION - ATTICS, CRAWL SPACES, AND VENTS  

Condensation may occur wherever warm, moist air inside the house comes in contact with a colder surface such as a window. If window condensation is excessive, providing ventilation can reduce it.

Moisture is in the air in your home through cooking, bathing, showering, laundering and humidifiers. The amount of moisture varies substantially from household to household. One home may have excessive humidity while the home next door has normal humidity. The difference in humidity depends on the OWNER’S living habits and ventilation practices and is not related to construction factors.

Attic ventilation through the roof or siding is required by building codes and cannot be omitted. Check any windows in the attic to make sure they operate correctly. There are foundation vents in a crawl space that can be opened and closed

from the outside. - Keep these vents fully open all summer.

- In the winter, close the vents and pull the insulation over the opening.

- After they are closed, check the burner of your furnace. If the flame is too red, open one vent slightly. This is very important and should be checked carefully at the beginning of winter and then periodically.

DJK Custom Homes, Inc. is not responsible for problems that may occur from OWNER alterations to the original system.

Occasionally, driving rain or snow will infiltrate the vents, causing spotting on the ceiling.

- DJK Custom Homes, Inc. is not responsible for such weather damage.

Attics and crawl spaces should have a natural ventilation area as required by the approved building code specifications.

DJK Custom Homes Inc. will provide adequate ventilation. DJK Custom Homes, Inc. shall install adequate ventilation in crawl spaces

to avoid damage to supporting members or insulation due to moisture accumulation. Certain conditions may cause condensation in crawl spaces that cannot be eliminated by ventilation and/or vapor barrier. DJK Custom Homes, Inc. is not responsible for pooling water that may exist due to open vents or excessive rainfall conditions.

DJK Custom Homes, Inc. shall vent exhaust fans to prevent damage to supporting members or insulation.

Buy disposable filters in large quantities for convenience during the heating season. Change filters at least every two months.

Keep garage doors closed to prevent heat from escaping during the winter months.

WATER HEATER ____________________________________________________________

Refer to manufacturer’s information pamphlet regarding temperature setting, lighting the pilot light, energy tips, cleaning and drainage instructions.

Condensation inside your new water heater will often cause a small drip on the burner flame. This causes no harm and will usually disappear in a short time.

Review and follow the manufacturer’s timetable and instructions for draining several gallons of water from the bottom of the water heater.

Draining helps prevent a build-up of chemical deposits, prolongs the life of the tank,

and saves money. If you live in an area that has hard water, you may want to add a water softener to

reduce the need for more frequent draining. If recovery of hot water is slow, the temperature setting is most likely too low. The recommended temperature settings for everyday use are “normal” on gas models

and 140 degrees Fahrenheit on electric models. Be careful not to set the temperature of the water heater too high, as scalding may result.

If you do not have hot water, check to see if the pilot light is lit. If the pilot light is out Remove the door on the front bottom of the heater and re-light.

Follow the manufacturer’s instructions (found either in the pamphlet or posted on the side of the heater).

Never light a gas pilot or turn on power to an electric model when the heater tank is empty.

- Always turn off gas or electricity before shutting off the cold water supply. - If you are going to be away from your home for an extended period of time,

set the temperature to its lowest point and leave the pilot light on. The area around the gas-fired water heater should be vacuumed as needed to prevent

dust from interfering with the flame combustion. - Do not use the top of your gas-fired heater as a storage space. - Do not store combustible items, such as oily rags, clothing, brooms or dust

mops, near your water heater. They may interfere with airflow and become a fire hazard.

DJK Custom Homes, Inc. will provide you with the manufacturer’s limited warranty for your hot water heater.

Water heater “blankets” or “wraps” are available to further increase the energy efficiency of you water heater. Be sure to check with your specific manufacturer’s instructions regarding such a product and its use with your model of water heater

INSULATION SYSTEM ________________________________________________________

The insulation system in your home is designed to meet the requirements of your state and/or local energy code. Insulation separates spaces in your home from outside air. Insulation is referred to with an “R-value”. The R-value is the level of resistance provided by the insulation to any transfer of heat or cold. The total R-value may vary depending on the insulated area.

The area of greatest heat loss is through your ceiling and roof. A higher R-value is used in these areas. Crawl spaces have insulation under the first floor system.

The effectiveness of blown insulation is enhanced by an even distribution. If you do any work in your attic, the last step should be to check that you did not disturb the smoothness of the insulation. (Extreme caution should be taken when moving about in the attic. Do not step on drywall ceilings; personal injury or damage to drywall can result).

Inspect attics and crawl spaces on a seasonal basis to make sure the insulation has remained in place. If it has been moved in any way, it may result in air filtration. Crawl space vents should be kept fully open except during periods of cold weather.

Inspect the exterior of your home (see caulking) each season for separation or deterioration of caulking. Re-caulk as necessary in order to provide proper protection for your home. Check your weather stripping around all windows and doors on a regular basis to make sure the seal is secure; replace as necessary. The OWNER always has the option to install storm doors to provide greater protection against the elements.

Insulation  should  be  installed  in  accordance  with  applicable  energy  and  building  code  requirements.

- If  the  insulation  amount  does  not  meet  the  requirements  at  closing,  DJK  Custom  Homes,  Inc.  will  take  corrective  action.

While  some  infiltration  around  doors  and  windows  is  normal,  poorly  fitted  weather  stripping  at  the  time  of  closing  is  unacceptable.

- DJK  Custom  Homes,  Inc.  will  take  corrective  action  as  necessary. INTERIOR CONSTRUCTION____________________________________________________

CERAMIC TILE

Ceramic tile is durable, decorative and requires relatively little maintenance. Although the tile itself is impenetrable to water, the grouted joints between the tiles can absorb water. Grouting between your tiles will crack and loosen due to normal conditions of shrinkage, contraction and expansion.

Follow the manufacturer’s directions for proper application of silicone caulk to repair separation in areas where tile joints other materials such as countertops, tubs, wood trim, etc.

This is a normal occurrence and should be remedied as soon as possible to prevent water from seeping into the tiled area.

Tiles may separate from the area directly next to the tub or shower due to normal shrinkage and settling.

- These tiles may be re-secured with “tub caulk” or premixed grout. Follow the manufacturer’s directions.

Sweep or vacuum your tiled floors often to prevent dirt from building up in grouted areas.

Should grouting become discolored over time, you may buy grout cleansers and whiteners at most hardware stores. Follow the manufacturer’s instructions for application.

Regular cleaning of tiled areas and grout is recommended. - Use a damp sponge or rag and a non-abrasive cleaner. - You can use dishwasher crystals, which will not leave a heavy deposit on

the grout. Rinse thoroughly. - If necessary, use a stiff brush to clean grouting. This type of cleaning

will help to prevent discoloration and mildew build-up. Place furniture on protective pads instead of dragging items over your tile floors. Always take caution to protect tile from scratches and chips.

Ceramic tile should not become loose.

Grout patching materials used by DJK Custom Homes, Inc. to repair or replace tile grout is the sole determination of DJK Custom Homes, Inc.

DRYWALL

Drywall is also referred to as gypsum wallboard or sheetrock. Drywall sheets are screwed to wooden framing members. The joints and corners are taped and coated with several coats of joint compound. Outside corners are reinforced with “corner beads” before joint compound is applied to them. The joint compound areas are sanded smooth. Some drywall surfaces may have a textured finish called “stippling”. While your new home is drying and settling, slight imperfections due to shrinkage and settlement may appear in your drywall. Cracks, nail pops and seam lines are common occurrences and easily repairable.

After your new home has had adequate time to settle and dry (usually 12

months), you may use spackling or joint compound to repair blemished areas. - Spackling and joint compound are available at hardware stores. Follow

the manufacturer’s instructions for application. Hairline cracks can usually be repaired with a coat of paint. Larger cracks may

be repaired with spackling. Follow the manufacturer’s instructions for spackling application.

After applying the spackling, sand the area, and then re-touch with paint. Try “feathering” the paint to more closely match the original roller pattern.

If minor damage occurs, such as dents, nicks or holes, drywall is easy to repair. Use joint compound or spackling.

When your home’s wooden framing members respond to changes in humidity, nail pops can occur.

- If the nails are visible, but tight, reset the protruding nail into the drywall. - If the nail is visible, but loose, remove it and insert a new nail a few

inches from the spot where the old nail popped out. In either case, cover the nail with spackling, sand and finish.

Drywall tape may split due to the settling and drying. - Cut and pull off the loose tape. - Sand the area, and use a wide putty knife to apply joint compound. - Work the new tape into the compound. - Apply another layer of compound, sand and re-touch with paint.

Special care should be given to prevent excessive amounts of moisture from coming in contact with drywall. Moisture can cause drywall joints to separate. Any leaks or sources of moisture should be dealt with immediately to prevent damage.

Keep furniture from being pushed into walls and teach children not to use walls as any part of their play activity.

DJK Custom Homes, Inc. will take corrective action as necessary to meet the standard only if the areas are listed during you New Home Orientation.

DJK Custom Homes, Inc. will touchup any nail pops and cracks one time at 11months only, repainting after touchups is the responsibility of the Homeowner.

DJK Custom Homes, Inc. is not responsible for color or texture variations in the touch-up or repair areas.

Slight imperfections such as nail pops, seam lines, and cracks are common in drywall installation. However, obvious defects of poor workmanship resulting in blisters in tape or excess compound on joints, trowel marks and cracked beads are not acceptable. Nail “pops”, blisters and other such blemishes that are readily visible from a distance of 6 feet under normal lighting conditions must be noted during the New Home Orientation or prior to closing of the home. Nail pops, slight imperfections, seam lines and hairline drywall cracks are specifically not covered under this WARRANTY after the initial 11 month touchup and are the sole responsibility of the OWNER.

If your finished walls or ceilings have visible cracks that exceed 1/16 inch in width, DJK Custom Homes, Inc. will take corrective action as necessary only once during the warranty term.

DJK Custom Homes, Inc. shall fill cracks that exceed 1/16 inch in width on any plaster walls or ceilings. DJK Custom Homes, Inc. is not responsible for matching color or texture of patched areas with surrounding original material or surface coatings.

DJK Custom Homes, Inc. shall repair blisters in drywall tape, fill cracked corner beads or exposed corner beads ONE TIME ONLY during the term of the Limited Warranty. DJK Custom Homes, Inc. is not responsible for matching color, texture or finish of original finish coatings or textures.

DJK Custom Homes, Inc. is not responsible for repainting after 1 time touchup.

DJK Custom Homes, Inc. is not required to paint. All interior walls will have slight variances on their finished surfaces. Bowing of

walls should not detract from or blemish the walls finished surface. Allowable structural deflections are governed by the approved building code specifications, however, bowing greater than 3/8 inch out of plumb for any 32 inches in any 8 foot vertical measurement is considered unacceptable. DJK Custom Homes, Inc. will take corrective action to meet the standard.

PAINT

Painting is basically cosmetic and there are a lot of options in materials and methods. DJK Custom Homes, Inc. has painted all walls and ceilings with a flat latex paint and all trim with a semi-gloss latex paint. The paint in your new home requires “curing”. Take special care in the first 30 days of occupancy not to mar the walls in any way. Make gentle cleaning of painted areas part of your regular maintenance routine to prevent dirt, mildew and fungus, and to prolong the life of your interior paint

Clean with a soft sponge and soapy water. Do not scrub. Hairline separations in painted woodwork are normal and are the

OWNER’S responsibility to maintain.

IF THE INTERIOR TRIM IS COVERED IN A FLAT LATEX:

Clean  with  a  soft  sponge  and  a  very  mild  detergent  such  as  Soilax. Use  a  light  washing  motion,  never  a  scrubbing  motion.     Scrubbing   flat   paint  with  or  without  detergents  will   break  down   the  paint  

film,  causing  what  looks  like  a  dirt  smudge.  

Do not clean any interior painted surface with an abrasive cleaner, scouring pads or brushes. This can cause extensive damage. DJK Custom Homes, Inc. will give you samples of your interior paint at your New Home Orientation. If you perform any paint touch-ups, be aware that the touch-up may not match the surrounding area exactly, even if the same paint mix is used.

When touching-up, use a small brush and apply the paint only to the blemished area.

For stain touch-ups, Old English Furniture Polish and Scratch Cover, is easy to use and blends with the wood grain. Follow the directions on the label for application.

Occasionally check painted areas where caulk is present. Due to natural contraction and expansion, the paint and/or caulk may shrink.

Remove any old caulk and re-caulk the area. Ask a hardware professional what type of caulk best suits the area.

Touch-up the area with the appropriate paint after caulk has sufficiently dried.

Hairline cracks and separations in painted trim are normal and are the OWNER’S responsibility to maintain.

Paints applied over raw woods such as rough cedar may bleed through allowing characteristics of the wood to show through the paint.

- This is common and DJK Custom Homes, Inc. will take no corrective steps to correct it.

Mildew or fungus will form on a painted surface. - Mildew or fungus formation is a condition DJK Custom Homes,

Inc. cannot control and is considered an OWNER maintenance responsibility.

Interior paint should be applied in a manner sufficient to visually cover the walls, ceilings and trim surfaces where specified.

DJK Custom Homes, Inc. will re-touch walls, ceilings or trim surfaces as noted at the New Home Orientation.

All interior trim caulking and painting of painted woodwork is the OWNER’S responsibility except for those separations that exceed 1/8 inch.

Excessive knot and wood stains that bleed through the paint on interior surfaces is considered a deficiency and DJK Custom Homes, Inc. shall seal affected area where bleeding of knots and stains appear. DJK Custom Homes, Inc. is not responsible for matching paint color or texture of affected area to original finish of adjacent areas.

Natural finish of interior woodwork that deteriorates during the term of the Limited Warranty is not considered a deficiency and DJK Custom Homes, Inc. and is the responsibility of the OWNER.

DJK Custom Homes, Inc. shall remove paint splatters only when noted during the New Home Orientation Pre-closing Walk-Through and listed on the appropriate New Home Orientation Pre-closing Walk-Through Forms.

WALL COVERINGS

Wallpaper is installed according to the manufacturer’s recommendations in terms of type of paste and hanging instructions. DJK Custom Homes, Inc. has taken care to install the wallpaper in a way that allows the seams to be as inconspicuous as possible, but seams cannot be invisible. Some seams are more readily visible than others, depending on the wallpaper color, pattern and material

Clean wallpaper carefully. Delicate papers damage easily.

- Use only damp sponge and do not saturate your wallpaper. - If more heavy duty cleaning is required, use a mixture of water and a

mild detergent, but always refer to your manufacturer’s instructions prior to attempting any type of cleaning of wallpaper.

Occasionally wallpaper seams may loosen or curl due to humidity within the home.

- You may reattach the seams with a wallpaper adhesive, and then gently roll.

- Be sure to wipe away all excess adhesive from the wallpaper with a clean damp sponge.

- Always refer to the manufacturer’s instructions for the correct type of adhesive prior to attempting to apply glue to your wallpaper.

The peeling of any wallpaper is considered unacceptable. - DJK Custom Homes, Inc. will take corrective action for peeling

wallpaper that is noted during your New Home Orientation. DJK Custom Homes, Inc. is not responsible for minor mismatching in

pattern or color or seam gaps, which are not noted at your New Home Orientation.

DJK Custom Homes, Inc. is not responsible for discontinued patterns or colors when replacing defective wallpaper.

PANELING

Paneling is a relatively low-maintenance item. Paneling is composed of prefabricated panels of individual boards and planks of wood with other

furniture polish over the affected area. Natural finishes on interior woodwork, such as paneling, should not

deteriorate during the first year of ownership but may with wear and tear. - DJK Custom Homes, Inc. will NOT warranty against wear and

tear. - DJK Custom Homes Inc. repairs are not guaranteed in matching

color or wood grain. Consider installing doorstops at the floor line as a way to protect the wall

from contact with door handles or knobs. Wallpapered corners in high traffic areas may loosen.

- Consider purchasing protective plastic corner guards for such areas. LANDSCAPING _____________________________________________________________________

Properly maintained landscaping can enhance and protect your property. While DJK Custom Homes, Inc. aims to preserve as many trees as possible on your lot, the topography must sometimes be altered due to building lines, sewer and/or septic tank requirements, drainage easements and terrain. Exact house placement, location of driveway and all tree clearings are solely DJK Custom Homes, Inc. decision. After closing, all landscaping elements of your new home, including sod, straw and seeded areas, existing and new trees and shrubs are entirely the responsibility of the OWNER. Follow the care and maintenance suggestions detailed herein to help assure successful growth and health of any vegetation around your home. If you have additional questions about the best types of vegetation to plant, consult with your local nursery. To form the foundation of your home, DJK Custom Homes, Inc. excavates into the earth. After the foundation walls are complete, the area around them is back-filled with earth. Since this area is not as compact as undisturbed ground, water can penetrate to the foundation if care is not taken. If water is allowed to penetrate to the foundation, it can result in cracks in foundation walls and wet basements. Proper installation and maintenance of your landscaping can prevent these problems. Typically, the grade around your home should slope 1 inch in the first 10 inches, tapering to a two-percent (2%) slope. Some settling will occur, especially after heavy rains or snow. If you alter the slope DJK Custom Homes, Inc. has created when you plant, YOU MAY VOID YOUR WARRANTY. Graded ground left un-landscaped too long will erode. Correcting erosion of grade due to waiting to landscape is the OWNER’S responsibility.

LANDSCAPING ___________________________________________ SECTION II Check with your local building department prior to designing and/or installing any landscaping or making changes in an established design. If you have a local Homeowners association, check their guidelines and/or requirements prior to landscaping or making changes. It is recommended that you plan your entire landscape, even if you only plan to plant in one area for the time being. Mark the spots that you plan to plant with stakes and string. Live with these marked spots for a few days before planting to make sure it is what you want.

Carefully consider the planting materials you choose. Try to landscape in a way that minimizes the demand for water. Xeriscaping (low water maintenance landscaping) means using plants that are indigenous to your area. Information on Xeriscaping is available at most local nurseries. Xeriscaping saves on water, reduces water bills, protects the environment and reduces moisture that could reach your foundation.

Consider that the sun affects both your heating and cooling bills. Shade trees planted in the right area can drastically reduce utility bills. Choose plants with regard to your local climate. Group plants with similar needs for water, sun and space.

While trees, shrubs and other plants are used to define borders, try to allow a generous distance between your home and any plants; and between sprinkler heads. Allow 10 feet between your home and trees so root growth doesn’t disturb your foundation. Consider the size of mature trees and shrubs. Ask a nursery professional how fast the plants will grow, if the leaves will drop and if the plants will produce any berries that might stain.

You may want to use solid tree fertilizer spikes to add nutrients to your trees. Fertilizing spikes are available at most nurseries.

You may want to support young trees with stakes and wires. Generally, these should be left in place for one year, and then removed. You may occasionally need to tighten the wires. Inspect your trees on an annual basis. Make sure that any dead limbs are removed. Prune your tree limbs with sharp shears. Any overhanging branches should be trimmed before they cause damage to roofs, gutters, siding, etc. Remove any dead trees promptly. Trim shrubs and hedges monthly during growing season. Do not allow shrubs to become overgrown. Overgrowth can encourage decay around your foundation and siding. Water new shrubs, every 3 to 4 days. In early spring, mulch can be applied around trees, shrubs and flowerbeds. Make sure that the mulch does not hinder water drainage from those areas. Edging around rock or bark beds should not block the free flow of water away from your house.

Take precautions as winter approaches to protect your plants from freezing. Before the weather turns extremely cold, give your shrubs a good watering. Protect young evergreens with screens or covers.

Regularly check your downspouts to make sure they are aimed away from your foundation.

LAWN CARE

Your new lawn requires a great deal of care in order for the grass to thrive. If your new lawn is seeded, you will most likely need to re-seed your lawn several times during the first year of occupancy in order to get a good stand of grass. This is an OWNER’S responsibility.

Most new lawns require watering on a daily basis for 3 to 5 weeks, depending upon germination. Soak your lawn to a depth of four to five inches (equivalent to approximately one inch of rainfall) for a period of thirty minutes (30) to one hour (1). IN most cases, drainage swales do not follow property boundaries. DJK Custom Homes, Inc. will not alter drainage patterns to suit individual landscape plans. Be aware that rototilling will alter drainage swales. Always rototill parallel to the swales rather than across them. You may apply appropriate fertilizer, weed and pest control. Investigate organic compounds for further protection of the environment. Apply fertilizer to a new lawn at approximately the same time your grass needs its first mowing. Weed control is available in both pre-emergent and post-emergent processes. Do not use pre-emergent weed control within four months after seeding.

Some soils require lime to reduce acidity. Take a sample to your County’s Cooperative Extension Service. Indicate on the sample what type of grass is planted in your yard. Your sample will be analyzed at no charge and results will be mailed to you within three weeks.

Once your lawn is lush, you will need to mow it regularly. Mowing your lawn in a timely fashion (usually once a week during the growing season) will allow your lawn to thrive. Check with local seed or sod suppliers to determine the best mowing height for your type of lawn. Cutting the grass too short creates a shallow root system. Alternate mowing directions to keep the grass growing upright and to keep the soil from becoming compacted. Never attempt to mow a wet lawn. Keep mower blades sharp to prevent pulling and shredding of the grass tips. Edge your lawn with a trimmer to keep grass from encroaching on driveways, patios and sidewalks. Encroaching grass will harbor moisture that may damage concrete. If grass roots work their way into small cracks, these cracks can become larger.

Water your lawn early in the morning for best results. If you have a sprinkler system, heads should be directed away from the home. When needed, water the lawn. Watering lightly and too frequently allows shallow roots to develop. Too much water can also harm grass. Check with a seed or sod supplier in your area for the best method of watering your particular grass.

Rake leaves from your lawn in the fall in order to allow good air circulation to your lawn.

Standing or ponding water may remain for up to 48 hours after the rain ceases and is not warrantable or preventable.

No grading determination shall be made if frost or snow is present on the ground or if the ground is saturated.

DJK Custom Homes, Inc. is not responsible for leaks caused by improper landscaping or the OWNER’S failure to maintain proper grades.

The OWNER should check on the grading status at the time of closing. DJK Custom Homes, Inc. is not responsible for weather-induced damage to non-

landscaped yards after the final grade or after the closing date, whichever comes last.

After closing, all landscaping elements of your new home, including sod, strawed and seeded areas, existing and new trees and shrubs are entirely the responsibility of the OWNER.

Changes in the level of the underground water table that were not reasonably foreseeable at the time of construction of the home; subsidence or soil movement which was not reasonably predictable through reasonable soil testing or other geological investigation at the time of construction, or for which compensation is otherwise provided by legislation or which is covered by other insurance or public funds to the extent that such compensation is paid by such other providers.

DJK Custom Homes, Inc. is not responsible for soil erosion due to Acts of God or other conditions beyond DJK Custom Homes, Inc. control.

The possibility of standing water after an unusually heavy rainfall should be anticipated and is not to be considered a deficiency.

Trees and large bushes that existed at the time of closing or occupancy of the home or those added by OWNER after occupancy or those that subsequently die are excluded from this Limited Warranty.

The crawl space should be graded and drained properly to prevent water from accumulating in the crawl space area.

- DJK Custom Homes, Inc. is responsible for providing proper grading and drainage of crawl space areas.

- DJK Custom Homes, Inc. will take corrective action as necessary to meet the standard.

Due to weather conditions, the final grade may not be established at the time of closing.

- When conditions permit, DJK Custom Homes, Inc. will be responsible for completing the grading work.

Backfilled areas around the foundation should not interfere with drainage away from your home. If these areas settle in a way that interferes with drainage, DJK Custom Homes, Inc. will provide you with fill dirt ONE TIME ONLY during the warranty term.

Maintaining positive drainage away from the home is the OWNER’S responsibility.

- DJK Custom Homes, Inc. has option to place fill dirt on city approach portion of driveway or any other suitable area as designed by DJK Custom Homes, Inc.

- Site Drainage under this Limited Warranty is explicitly limited to grades within 10 feet and swales within 20 feet of the foundation of the home.

- DJK Custom Homes, Inc. will fill ONE TIME ONLY during the term of this Limited Warranty any utility trenches that settle in excess of 6 inches from the finish grade established by DJK Custom Homes, Inc.

- The OWNER shall be responsible for any trees, grass, shrubs, or lawn sprinkler systems affected by placement of such fill.

Landscaped areas that are disturbed during repair work are considered a deficiency under this Limited Warranty and DJK Custom Homes, Inc. shall restore grades, seed and landscape to meet original condition. DJK Custom Homes, Inc. is not responsible for grassed or landscaped areas, which are damaged by others, including any work performed by public or private utility companies.

LANDSCAPING - MOLD __________________________________ SECTION II

Z Mold occurs naturally in the environment, and it is necessary for the natural decomposition of plant and other organic material. Mold spreads by means of microscopic spores borne on the wind, and is found everywhere life can be supported. Residential home construction is not, and cannot be, designed to exclude mold spores. If the growing conditions are right, mold can grow in your home. Most homeowners are familiar with mold growth in the form of bread mold, and mold that can grow on bathroom tile. In order to grow, mold requires a food source. This might be supplied by items found in the home, such as fabrics, carpet or even wallpaper, or by building materials, such as drywall, wood and insulation, to name a few. Also, mold growth requires a temperate climate. The best growth occurs at temperatures between 40 degrees Fahrenheit and 100 degrees Fahrenheit. Finally, mold growth requires moisture. Moisture is the only mold growth factor that can be controlled in a residential setting. By minimizing moisture, a homeowner can reduce or eliminate mold growth. Moisture in the home can have many causes. Spills, leaks, overflows, condensation, and high humidity are common sources of home moisture. Good housekeeping and home maintenance practices are essential in the effort to prevent or eliminate mold growth. If moisture is allowed to remain on the growth medium, mold can develop within 24 to 48 hours. OWNER must take positive steps to reduce or eliminate the occurrence of mold growth in the home, and thereby minimize any possible adverse effects that may be caused by mold. These steps include the following:

i. Inspect for leaks on a regular basis. Look for discoloration or wet spots. Contact DJK

Custom Homes, Inc. immediately upon the discovery of a leak. Inspect condensation pans (refrigerators and air conditioners) for mold growth. Take particular notice of any musty odors, and any visible signs of mold.

ii. Before bringing items into your home, check for signs of mold. Potted plants (roots and soil), furnishings or stored clothing and bedding material, as well as many other household goods, could already contain mold growth.

iii. Regular vacuuming and cleaning will help will help reduce mold levels. Mild bleach solutions and most tile cleaners are effective in eliminating and preventing mold.

iv. Keep the humidity in the home low. Vent clothes dryers to the outdoors. Ventilate kitchens and bathrooms by opening the windows, by using exhaust fans, or by running the air conditioning to remove excess moisture in the air, and to facilitate evaporation of water from wet surfaces.

v. Promptly clean up spills, condensation and other sources of moisture. Thoroughly dry any wet surfaces or material. Do not let water pool or stand in your home. Promptly replace any materials that cannot be thoroughly dried.

Notwithstanding the size of the job, most clean-up projects for eliminating harmful mold employ four methods. The actual method or combination of methods used will depend on the contaminated materials at issue and the severity of the contamination. The four clean-up methods generally employed are:

MOLD - PLUMBING _______________________________________ SECTION II

i. Wet Vacuum: Where water has accumulated on floors, on carpets, or on hard (non-porous) surfaces, a wet vacuum should be used to remove it.

ii. Damp Wipe: Non-porous materials (like metal, glass and plastic) and semi-porous materials (like wood and concrete) should be wiped down with water and detergent and then dried.

iii. Remove Damaged Materials from Home: Porous building materials (like ceiling tiles, insulation and wallboard) that are contaminated and cannot be saved must be removed and discarded. To avoid contaminating the entire house, these items should be wrapped in plastic before being removed from the room where they are found. The debris can be thrown in the garbage (no special precautions are necessary once the debris has been removed from the home).

iv. HEPA (High-Efficiency Particulate Air) Vacuum: After wet or contaminated materials have been dried or removed, the entire area should be thoroughly vacuumed. The debris should be placed in a sealed plastic bag and removed from the home. The debris can be thrown in the garbage (no special precautions are necessary once the debris has been removed from the home).

If you have any questions regarding mold, or eliminating mold, contact DJK Custom Homes, Inc. prior to conducting any mold remediation procedures to prevent spoliation of mold evidence. Upon receiving notification from the Homeowner regarding a possible mold concern, DJK Custom Homes, Inc. will perform a site investigation, data collection, sampling and testing. Dependent upon the water source which caused the mold, and the type of mold discovered, DJK Custom Homes, Inc. will determine from the results of the inspection, data and testing the appropriate action, if any, that will be taken to remedy the situation.

PLUMBING ________________________________________________________________________

The plumbing system in your home consists of all water supply and drain lines, septic system (if applicable) and plumbing fixtures. A professional installed the plumbing in your home. Any plumbing problem should be repaired immediately by contacting DJK Custom Homes, Inc. SEPTIC SYSTEM

DJK Custom Homes, Inc. will inform you if your home is a part of a municipal sewer system or if it uses a septic system for household waste. With proper care and maintenance, septic tanks are as satisfactorily as sewers. Regular maintenance of a septic system can prevent inconvenience and extensive repairs.

If you do have a septic system, DJK Custom Homes, Inc. will show you its location, and its drainage area during your New Home Orientation. Check with your local health department for cleaning and disposal recommendations. Inspect your septic tank and the drainage area at least once a year. The frequency of septic tank cleanings varies depending on tank size, daily sewage intake and the number of people it serves.

Cleaning a septic tank requires special knowledge and tools; it is not recommended as a “do-it-yourself” project. Your local health department may help you locate a professional to perform this service. As warm weather causes bacterial action to increase, septic tanks should be cleaned in the spring. The waste material should be disposed of in a manner approved by your local health department. Periodic pumping of the septic tank between cleanings is considered an OWNER responsibility. The need for pumping is considered normal and is not considered a deficiency. Again, it is recommended that you use a professional to perform this service, as it requires special tools and knowledge. Ask your professional to recommend a pumping timetable for your usage. Failure to pump when necessary may result in septic tank overflow. Septic tank overflow can be extremely damaging to your septic drainage system. Review with your family what products and items of household waste should not be introduced into the septic system. Do not allow petroleum products, paint thinner, solvents, harsh chemicals, cleaning fluids, dyes, excessive amounts of bleach, cigarettes, sanitary napkins, plastics, or grease to enter the septic system. (Instruct family members to wipe as much grease as possible from cooking pans before submerging them into soapy water in the sink). Avoid using drain cleaners and high-foaming detergents if you have a septic system. These substances will kill natural bacteria needed by the system to break down regular waste. Use non-phosphate cleaners and biodegradable laundry soaps. If you have a garbage disposal, do not grind large amounts of vegetable and fruit matter as it may cause the need for more frequent cleaning of the septic tank. Vehicles should not be allowed to drive or park over septic tanks or disposal areas.

The OWNER is responsible for septic tank maintenance for the life of the home.

DJK Custom Homes, Inc. is responsible for the installation of an operational system.

DJK Custom Homes, Inc. is not responsible for malfunctions that occur through OWNER negligence or abuse, or from conditions that are beyond DJK Customs Homes, Inc.’s control.

The following items are considered OWNER negligence and are excluded from this warranty coverage:

Connection of a sump pump, roof drains or backwash from a soft water conditioner to the system.

Placing non-biodegradable items in the system. Use of any harsh chemicals, grease or cleaning agents, and excessive

amounts of bleach or drain cleaners. Use of garbage disposals not supplied by DJK Custom Homes, Inc. Placement of impenetrable surfaces over the disposal area.

The septic system should be capable of properly handling flow of household effluent.

The septic system should be designed and installed in compliance with state, county and local code regulations.

WATER SUPPLY, DRAIN LINES, AND FIXTURES

The plumbing system and fixtures in your home have been installed by a licensed plumbing contractor and meet all applicable requirements and plumbing standards in your area.

FREEZING

If you decide to finish your basement, care should be taken to insure that the plumping lines are not isolated from the heating source without insulation being added.

If your home is heated at a normal level, pipes should not freeze. Heat should be set at a minimum of 65 degrees Fahrenheit when you’re away from home during winter months. Garage doors should be kept closed to protect pipes. Outside faucets are generally “freeze proof,” but in order for this feature to be effective, hoses must be removed after each use.

If a hose is left attached, the water remaining in the hose may freeze, expanding back into the pipe and causing a break. Any such break is the OWNER’S responsibility.

COLD WEATHER HINTS

During  periods  of  extremely  cold  weather,  let  hot  and  cold  faucets  drip. Close  the  vents  and  access  doors  to  your  crawl  space. Keep  your  garage  doors  closed. Open  your  kitchen  and  bathroom  cabinets  to  expose  pipes  to  house  heat. Disconnect  garden  hoses  from  spigots. Outside  spigots  have  shut  off  valves  inside  your  home.    Be  sure  to  turn  these  

off  curing  cold  weather.

LEAKS

If there is a leak in any area of your home, shut the water off at the corresponding shut off valve.

Each sink and toilet in your home has a shut off for its water supply. DJK Custom Homes, Inc. will point out the location of the main water shut

off during your New Home Orientation.

For leaks outside your home, the water must be turned off at the meter.

Contact your local water department immediately.

If you do need to shut off the main water valve, be sure that the power source for your hot water heater is turned off to prevent overheating. If there is water leaking from underneath your sink, it is likely that there is a loose plumbing fitting. Check the coupling on the drainpipes. If it is loose, tighten as needed. If there is a drip from a shut-valve, there is most likely a loose packing nut.

Open the valve all the way and gently tighten the packing nut with pliers.

The sound of water rushing through the walls is a normal occurrence. The sound occurs as water drains through the pipes and does not indicate a leak. If you find water stains on a ceiling of a room beneath a shower or tub, water may be leaking through at the caulking or grouting. Repair the caulking or grouting above the leak as needed. Be sure to close the door to the shower completely. Failure to do so may

result in water saturation of the bathroom floor or carpet.

Showerheads and faucets are designed for water conservation as required by local building code. The pressure may be lower than in older models. If a showerhead or faucet is leaking, check to see if the washers or seals are worn. Replace the washers or seals, if needed. If leaks of any type persist after you attempt to contain or stop them, call

DJK Custom Homes, Inc. immediately.

NOISE

Pipes make noises for a variety of reasons, including a worn washer, a loose part in a faucet or steam in a hot water pipe. Correct the condition immediately to avoid vibrations in the pipes that can

cause fittings to loosen and leak.  

FAUCETS

The aerator is located at the mouth of the faucet. An aerator adds air to the water to reduce splashing and conserve water. If the water flow is reduced at the faucet, it is likely that the aerator is clogged.

Aerators should be cleaned every three to four months to prevent the build-up of deposits.

Unscrew the aerator, rinse it and its parts (washers and screens) and replace in sequence on your faucet.

If you have a laundry room tub, the faucet does have an aerator. This allows the tub faucet to be equipped with a hose.

If you do not have hot and/or cold water coming out of a faucet, check to see if the water shut-offs under the sink are in the “on” position.

Dripping faucets may be repaired by turning off the water at the shut-off valve under the sink.

Remove the faucet stem and change the washer. Re-install the faucet stem.

Disconnect hoses from outside faucets in cold weather to prevent freezing and/or bursting of pipes.

CLOGS If your washing machine, dishwasher or any appliance that uses water appears to be leaking, check to see if the drain is clogged. Sometimes even a partially clogged drain can cause an over flow in the appliance. Improper use of your garbage disposal can cause plumbing clogs.

Use plenty of water when running the disposal. When disposing of grease, the cold water congeals it and allows the

disposal blades to chop it up effectively. - If you use hot water, the grease remains a liquid, then cools and

solidifies in the plumbing lines. - Allow the water to run a minimum of 15 seconds after you turn

off the disposal.

Most garbage disposals have a re-set button that works like a circuit breaker. If the disposal is overloaded, it will turn itself off.

If this happens, turn the switch to “off”, ensuring that the power to the disposal is off.

Using great caution, remove the substance clogging the disposal. Wait three minutes, and then push the re-set button.

- Turn the switch to “on”. - If the disposal does not start, check to see if you tripped the

circuit breaker.

If you have not tripped the breaker and the disposal still doesn’t work, use a plumber’s snake (for sale or rent at hardware stores).

- Turn the handle of the snake in the same direction when removing it as you did to insert it.

- That technique will keep anything attached to the snake from coming loose before you remove it.

If you use a commercial drain cleaner, always use a funnel to protect the sink from discoloration and the drain ring from chemical damage. Protect your eyes, hands and clothing. If you have a septic system, do not use drain cleaners. Contact DJK Custom Homes, Inc. if clogs are not removed easily.

SINKS

If there is a bad odor coming from a sink, the drain may have become completely dry. Water in the “U-shaped” drain trap creates a barrier, which prevents sewer gases and airborne bacteria from coming back into your home. Run water regularly through all drains to create a constant barrier. If you accidentally drop a small piece of jewelry down the sink drain, the U-shaped trap under the sink can be removed.

Place a pail under the trap to catch water. When re-installing the U-shaped pipe, be sure to tighten as needed to

prevent a leak.

As needed, clean the plunger drain stopper found in bathroom sinks by loosening the nut under the sink at the back, pulling out the rod attachment to the plunger and lifting the stopper out of the sink. Clean and return the mechanism to its original position.

TOILETS

The flush mechanism inside a toilet tank is relatively simple. There is a ball cock that regulates the filling of the tank and a flush valve that releases the water from the tank to the toilet bowl and then closes. Individual parts may wear out and need to be replaced. Ultra-low flow toilet, required by plumbing code, saves dollars on your water bill. However, you may notice some of the following differences:

The  water  level  in  the  toilet  is  much  lower  than  in  older  toilets. Due  to  the  lower  water  level,  toilets  may  require  some  frequent  

cleaning  to  prevent  “rings”. On  occasion,  the  toilet  may  need  to  be  flushed  more  than  once.

PLUMBING ________________________________________________ SECTION II Care should be taken not to flush anything that will clog the toilet. Baby wipes, sanitary napkins, dental floss, hair, grease and paper towels are a few of the items that can cause the toilet to clog.

 If your toilet backs-up and/or overflows, there is most likely an obstruction in the line.

Turn the toilet intake valve off and plunge the toilet. Work the plunger up and down to build up pressure in the pipe.

- If a plunger does not free the clog, use a coil spring auger (available for sale or rent at most hardware stores).

- A plumber’s snake is not the appropriate tool for a clogged toilet. - Insert the auger so that the point goes up into the trap. - Turning the auger’s handle will break up the blockage or catch it

so it can be removed.

If your toilet makes a loud noise when flushed, it is likely that the ball cock in the water tank is not working properly. Replace the ball cock as necessary. If your toilet runs constantly, this generally means that the water level in the water tank is too high.

Gently adjust the float arm in the water tank downward so that the water level does not flow into the overflow tube.

It the problem persists, adjust the chain that attaches the flush to the rubber seal at the bottom of the tank so that it fits securely over the tank’s water channel.

If black residue rubs off the seal when it is handled, it should be replaced.

If the water chamber seems to be leaking, the dripping may be coming from condensation on the outside of the tank.

- In this case, you may want to use a cloth tank cover.

WHIRLPOOL OR JETTED TUBS

If your home has a whirlpool tub, read the manufacturer’s instructions and follow these guidelines:

Do  not  block  any  of  the  outlets. Fill  the  tub  so  that  the  water  is  at  least  3  inches  above  the  outlets.    If  

you  operate  the  motor  without  the  outlets  being  completely  immersed,  the  seal  will  burn  and  leaking  will  occur.

There  is  usually  a  ground  fault  interrupter  (GFI)  for  safe  operation  of  your  tub.    Electrical  shorts,  power  surges  and  storms  may  cause  the  breaker  to  trip.    If  your  tub  does  not  operate,  check  the  breaker  to  reset  as  needed.

Your  tub  has  a  small  grill  that  serves  as  a  water  return.    Keep  the  grill  free  of  objects  that  block  the  water  flow.

Depending  on  the  frequency  of  use,  your  tub  should  be  purged  at  three  to  four  month  intervals  to  eliminate  build-­‐up  in  the  airflow  system.    Follow  the  manufacturer’s  instructions.

Use  a  spray,  foam  cleaner  to  cleanse  the  tub  surfaces.    Abrasive  cleansers  will  scratch  the  tub.

CARE AND CLEANING OF FIXTURES

             Follow the manufacturer’s directions for care and cleaning of all fixtures.

TOILETS

Any commercial cleaner may be used to clean your toilet, but do not mix cleaners, especially bleach.

Do not use any kind of drop-in continual cleaner. PORCELAIN

Porcelain, enamel can be damaged by a sharp blow from a heavy object. It can also be scratched.

Cover the bottom of the bathtub with newspaper before standing in the tub with shoes on.

Porcelain (bathtubs, kitchen and bathroom sinks) should be cleaned with a non-abrasive household cleaner.

Use warm water and sponge. Be careful not to leave anything containing acid, such as tea bags, in

porcelain sinks.

FIBERGLASS

Abrasive cleaners (Comet, Ajax) will remove the shiny finish from fiberglass, leaving behind a porous surface that is difficult to maintain.

Use a foam-cleaner on fiberglass. To keep the shine and help prevent soap scum build-up on the walls and

sides of a bathtub, you may want to use car wax. Do not wax the bottom of a bathtub as it can become dangerously slick. To remove soap scum, make a paste of baking soda and cool water;

apply the paste to the entire surface of the unit. Allow it to fizz a few hours, and then rinse with warm water.

MARBLE OR MAN-MADE MARBLE

Do not use abrasive cleaners on marble or man-made marble, as it will cause damage to the surface.

the marble.

STAINLESS STEEL

Stainless steel sinks require regular maintenance to enhance their shine and luster.

Clean stainless steel sinks with non-abrasive household cleaner, warm water and a sponge.

Discoloration, pitting and rust can be caused by wet sponges, clothing, cleaning pads and rubber mats left in a stainless steel sink.

Do not use scouring pads or steel wool on stainless steel sinks. Rinse your stainless steel sink well or towel dry after using a liquid

detergent as the detergent may contain chemical additives, which will affect the original shine of the finish if left to dry in the sink.

Towel drying will also help eliminate water spotting on the sink.

FIXTURES

Clean plumbing fixtures with a soft sponge and soapy water only. Polish with a dry cloth. Products containing ammonia may tarnish or create black spots on

fixtures and bathroom mirrors.

GOLD/ANTIQUE BRASS

Fixtures with gold or antique brass accents should not be cleaned with an abrasive cleaner.

Use mild detergent and water. Solid brass fixtures should be cared for with a quality brass cleaner,

available at most hardware stores. Brass-coated fixtures should be cleaned with a mild detergent to prevent

damage to the protective coating.

Leakage due to worn washers or seals is the OWNER'S responsibility.

There will be noise emitting from the water pipe system due to the flow of water.

- This is considered normal. - DJK Custom Homes, Inc. is not responsible for and cannot

remove these noises. Condensation on piping does not constitute leakage and is not covered. DJK Custom Homes, Inc. is not responsible for sewers, fixtures and

drains that are clogged through the OWNER’S negligence. - When OWNER negligence is the cause, the OWNER is

responsible for all repair costs.

- DJK Custom Homes, Inc. is not responsible for clogged toilets. Drain, waste, vent or water pipes should be adequately protected to

prevent freezing, as required by local applicable codes, during normally anticipated cold weather, and as defined by the ASHREA HANDBOOK.

- DJK Custom Homes, Inc. is responsible for meeting the applicable code.

DJK Custom Homes, Inc. is responsible for all service connections to municipal water mains and private supplies.

Private systems should be designed and installed with all applicable building, plumbing and health codes.

If your water system fails to deliver water due to defective workmanship or materials, DJK Custom Homes, Inc. will take corrective action as necessary.

DJK Custom Homes, Inc. is not responsible for conditions beyond DJK Custom Homes, Inc.’s control.

No valve or faucet should leak due to defects in materials or workmanship.

- DJK Custom Homes, Inc. will take corrective action to stop the leakage, unless it is due to worn washers or a worn seal.

Fixtures, appliances or fittings should comply with the manufacturer’s standards.

- DJK Custom Homes, Inc. will take corrective action as necessary to replace any fixture or fitting, which is outside of the specified and accepted standards as defined by the manufacturer.

No leaks should exist in any soil, waste vent or water pipe. - DJK Custom Homes, Inc. will take corrective action to

eliminate leakage, unless freezing pipes causes the leakage. Sewers, fixtures and drains should operate properly. When defective construction is the cause, DJK Custom Homes, Inc.

will take corrective action. DJK Custom Homes, Inc. will take corrective action to repair chips or

cracks that are noted during your New Home Orientation only/ Labeling each water shut-off valve with a shipping or luggage tag may

come in handy in the case of an emergency. A regular application of washing soda (sodium carbonate, not baking

soda) flushed with hot water will prevent the build-up of grease and scum in a kitchen sink.

To restore the luster to stainless steel, apply a small amount of mineral oil with a soft cloth, then wipe dry.

GUTTERS, DOWNSPOUTS, FLASHING, AND VALLEYS Keep your gutters and downspouts clear of any debris, including leaves, tree limbs, balls and other objects. If your gutters and downspouts are cluttered with debris, the water drainage system will not function properly, eventually causing leaks. Be aware that even when gutters are unobstructed, it is possible that small amounts of water will stand in them immediately after a rain. Clean the excess snow from downspouts as soon as possible to allow the gutter to drain. Check your gutters and downspouts for loose nails on an annual basis. Normal contraction and expansion may cause nails to work loose. Replace any loose nails. Occasionally check to make sure that all of your downspouts are pointed away from your home. If a downspout is turned toward your home, water may form a pond at the foundation, eventually causing foundation leaks. Also, make sure that your downspouts are not directing water into any rock, bark or flower beds so that water is not dammed behind the edging materials. If you have splash blocks occasionally check to make sure that they are positioned directly under the downspout. If your downspouts have underground drains, make sure they remain unobstructed and sloping to ensure proper drainage. Keep the valleys clean, as a build-up of leaves and debris can create a natural dam. The flow of water can result in roof leakage. It is the OWNER’S responsibility to keep gutters and downspouts free of leaves and debris, which can cause excessive overflow.

Flashing, valleys, gutters and downspouts must not leak, but gutters may overflow during heavy rain.

- DJK Custom Homes, Inc. will take corrective action as necessary to meet the standard, except when leakage and excessive overflow is due to OWNER’S negligence.

When a gutter is unobstructed by debris, the water level should not exceed ½ inch. Industry practice is to install gutters approximately level without pitch. Consequently, it is entirely possible that small amounts of water (up to ½ inch) will stand in certain sections of your gutters immediately after rain.

ROOF INSPECTION

It is recommended that you limit walking on your roof, especially when the shingles are wet, as this is extremely dangerous. Although periodic inspections of your roof, chimney, caulking around vents etc. are necessary, excessive foot traffic on your roof can damage the shingles. It is best to call a professional for any roof repairs.

ROOFING AND GUTTERS ________________________________ SECTION II As time goes by, you may need to repair or replace shingles. It is highly recommended that you contact a professional roofing contractor to make the repairs, as special tools and knowledge are required. This also applies to any tile roofing repairs.

After severe storms, make a visual inspection of your roof for damage. This can be done by surveying your roof, while standing on a ladder, but be careful not to lean the ladder against any gutters. You can also view your roof from a neighbor’s second, story window. If you find any storm damage to your roof, call your HOMEOWNER’S insurance company immediately.

The best time to make any roof repairs is during warm, dry weather.

Water should drain from a flat built-up roof, with minimum collection, except for minor “ponding”.

- DJK Custom Homes, Inc. will take corrective action as necessary to assure proper drainage.

Roofing shingles and/or roof tiles are warranted to be free of defects in material and workmanship for one year after closing.

- DJK Custom Homes, Inc. will take corrective action to meet the standard as necessary, except when damages are due to winds exceeding 30 mph in velocity, leaks and subsequent damage are due to ice build-up on a roof, leaks and subsequent damage are due to any attachment or installation through the shingles not installed by DJK Custom Homes, Inc., and leaks are due to valleys not being kept free of debris.

LEAKS

Try to pinpoint the exact location of a roof leak in order to simplify the repair process.

If you find a leak at a joint between sections of a gutter, caulk the inside joint using a commercial gutter caulking compound.

- Ask a hardware salesperson for the best type of caulking to use. Roof leaks cannot be repaired during rains or when ice or snow is on the

roofing materials. During prolonged cold spells, ice build-up is likely to occur at the eaves of a

roof. This condition occurs when snow and ice accumulate and gutters and downspouts freeze.

Repairs cannot be made at night or during abnormal working hours. Roof flashing should not leak under normal, anticipated conditions, except

when the cause is determined to be from severe weather conditions such as ice build-up.

- If there is leakage under normal anticipated conditions, DJK Custom Homes, Inc. will take corrective action as necessary to meet the standard.

VENTILATION

The required vents and louvers installed in your attic are a safeguard against structural damage to your roof. Proper ventilation prevents the build-up of excess heat in warm months and trapped condensation in winter months, both of which can lead to roof and wooden rafter damage. Infiltration of rain or snow depends on the force and direction of the wind. DJK Custom Homes, Inc. is not responsible for force and/or direction of driving rain and snow, if rain or snow is in excess of one inch in any given 24-hour period. Attic vents and/or louvers must be provided to properly ventilate the house.    

SPRINKLERS, BUBBLERS, AND DRIP SYSTEMS _________________________________

The OWNER is responsible for any damage to heads by vandals or mower. The OWNER assumes responsibility of sprinkler heads, bubbler heads and distribution tubing of drip systems after 90 days, from closing or occupancy, unless the OWNER can show improper workmanship by DJK Custom Homes, Inc.

Installation of additional lines for sprinkler systems is the responsibility of the OWNER.

DJK Custom Homes, Inc. shall supply a properly functioning system. Heads should be placed to cover area intended with water pressure and volume available. Trenches should be filled and compacted. Heads not working properly should be replaced if defective during first 90 days.

SUMP PUMPS ________________________________________________________________

Sump pumps are usually installed in locations that do have sufficient gravity fall to drain storm or sanitary sewers. Often, a sump pump is installed in a crock or large bucket where a rise in water levels triggers its operation. The sump pump system pumps water to a predetermined point where gravity can take over the drainage process.

Sump pump warranties, are provided by the manufacturer. To ensure proper operation, the sump pump must be cleaned and maintained regularly. The OWNER is responsible for periodic cleaning, maintenance, and replacement as

necessary. We strongly recommend that you check pump during all rain falls. DJK Custom Homes, Inc. is responsible only for the proper installation of the sump

pump, and the initial crock or bucket cleaning. DJK Custom Homes, Inc. is NOT responsible for any damaged caused by a defective

sump pump.

Ancient Romans were the first to use glass in windows to absorb solar heat. Windows now come in all sizes and shapes and provide heat, light and ventilation. Glass in windows can be single-pane or double-pane, clear or frosted. Window frames can be made of wood, metal, vinyl or a combination of materials. Some windows are operable, and some are for aesthetic purposes only. BROKEN GLASS

Cracked or broken glass and damaged screens not noted prior to closing or occupancy is the OWNER’S responsibility.

Repair broken glass as quickly as possible to prevent energy loss and infiltration. It is recommended that a professional glass company re-glaze (replace the glass).

CONDENSATION

Condensation is a result of high humidity within your home and low temperatures outside. It is a common occurrence and doesn’t necessarily indicate a defect in the window.

If you use a humidifier, follow the manufacturer’s instructions closely. The humidity level within the home largely controlled by your family’s lifestyle.

WEATHER STRIPPING

Check your weather stripping on a regular basis to make sure the seal is secure. Weather stripping guards against the elements and cuts down on condensation.

Usually heavy or driving rains may cause minor seepage at the bottom of a window.

CAULKING

Regularly check window frames for deterioration of caulking. Caulk cracks to prevent moisture damage to the window.

STICKING

If a window sticks, or requires excessive force to open or close it, rub the channel with a piece of paraffin or candle wax.

It can also be sprayed with W-D 40 or a silicone lubricant.

HARDWARE

As needed, check your window hardware to make sure it works properly. Windows should lock securely for security and protection from the elements.

Over time, the springs inside a window track may lose some tension, causing the top sash to slide down when the window is unlocked.

To correct the tension, remove the sash and tighten the adjustment screw.

All wood window parts that do not have a vinyl covering and are exposed to the elements should be coated with paint or a wood preservative to protect them from moisture damage.

Wood frames should be painted when the house trim is painted. The joints where the sides of the window frame meet the window need particular

attention. Treat wood storm windows the same as regular wood windows. Aluminum, vinyl-clad wood, and vinyl windows do not need painting.

- The aluminum can be allowed to oxidize (turn gray), which will protect it from the elements.

Windows wells are specifically not covered by this limited warranty. Some air infiltration around windows is normal, especially during high winds. DJK Custom Homes, Inc. is not responsible for dripping skylights from condensation. Metal, wood and plastic windows should operate with no greater operating force than that

described in the manufacturers specifications at the time of closing or occupancy. Double Hung windows are permitted to move within a 2-inch tolerance up or down

when put in an open position. DJK Custom Homes, Inc. shall adjust any excessive movement during the term of this Limited Warranty.

Poorly fitted weather stripping is not acceptable. - OWNER always has the option to install storm windows to provide greater

protection against the elements. Windows and skylights should not leak under normal conditions. DJK Custom Homes, Inc. shall take corrective action to repair or replace any window

hardware that does not properly lock or perform its intended purpose. DJK Custom Homes, Inc. shall take corrective action to adjust or replace storm

windows and screens, when installed by DJK Custom Homes, Inc., which do not operate or fit properly to provide protection for which they are intended ONE TIME ONLY during the term of this Limited Warranty.

No daylight shall be visible around frame when windows are closed. DJK Custom Homes, Inc. shall repair to meet this guideline if daylight is visible when window is closed. Some air infiltration is usually noticeable around doors and windows, especially during high winds, and is not considered a deficiency.

Residential aluminum, double and single-hung, vertical-sliding windows require a maximum operating force of 35 pounds.

Aluminum, horizontal-sliding windows and wood frame windows of all types require a maximum operating force of 25 pounds.

DJK Custom Homes, Inc. will take corrective action as necessary to meet this standard ONE TIME ONLY within the first year warranty.

Double-paned glass should not form condensation between the panes. DJK Custom Homes, Inc. will correct as necessary if the seal between the double –pane

glass is broken under normal use within the warranty term. Clean aluminum window surfaces with warm, clean water once a month.

Keep bottom window channels and weep holes free of dirt and debris. Lightly soiled glass can be cleaned with a commercial cleaner containing ammonia, or

with 1 cup of vinegar to a gallon of water. Heavily soiled glass can be cleaned with a solution of 1 tablespoon, household ammonia

to a quart of warm water. Aluminum frames around a skylight can be cleaned with warm water.

- If the skylight has a painted metal finish, check it annually, touching up any bare spots with paint recommended by the manufacturer.

To clean a plastic skylight, use a mixture of mild detergent and water. - Apply solution with a soft cloth and rinse well with clear water. - To prevent water spots, blot with a chamois.

Be careful not to bend window frames or perforated screen when removing screens for cleaning or storing

Label each screen when it is removed. Clean screens with a soft-bristle brush, sudsy cleanser and warm water. Rinse with a light spray from the garden hose, then let dry. Corrosion on aluminum screens can be cleaned with a light rub of steel wool. Coat the frames with household wax to keep them clean and shiny.

WOOD _____________________________________________________________________________

FLOOR SQUEAKS

Floor squeaks are often temporary conditions common to new home construction. As your new home settles, floor squeaks may stop. Floor squeaks not caused by de-lamination or loose sub floor are specifically not covered under this warranty.

Wood flooring is extremely durable when it is properly installed and maintained. It is important that the wood’s surface pores remain sealed to keep out moisture and other foreign agents.

To ensure the proper seal, periodically treat the floor with several protective layers of wax, shellac, varnish, lacquer, or hard polyurethane.

In between each sealing, your wood flooring will need little other special treatment.

- Dusting and cleaning will keep it fresh looking. - (Refer to “Flooring” for more details on caring for your hardwood

floors). Loose sub-flooring is unacceptable. DJK Custom Homes, Inc. will fasten any loose sub-floors or take other

corrective action to eliminate squeaking to the extent possible within reasonable repair capability without removing floor finishes.

Exterior sheathing and sub-flooring, which delaminates or swells on the finished side in which a finish material has been applied is considered a deficiency and

DJK Custom Homes, Inc. shall repair or replace as required. Replacement of the finish material, when necessary, is not guaranteed to match in texture or color to the original finish material.

UNEVEN WOOD FLOORS

Follow the care and sealing recommendations for wood floors to maximize the life of your uncovered hardwood floor and prevent warping and swelling. Warping and swelling can adversely affect the level of your wood floors.

DJK Custom Homes, Inc. will repair an uneven wood floor if it is more than 3/8 inch higher or lower than any other point on the surface within 20 feet, or proportional multiples of the preceding dimensions.

- Allowable floor and ceiling joist deflections are governed by the approved building code.

DJK Custom Homes, Inc. shall repair to meet the Guidelines of this Limited Warranty by correcting any wood floor that has a 1/4inch ridge or depression within any 32inch measurement.

QUALITY OF INTERIOR TRIM WORKMANSHIP

Interior wood trim gives your home a finished look. It can be installed wherever different construction materials intersect: along joints, corners, doorframes, windows and other built-in house features. Wood trim is also functional. It serves as a guard, holds down edges of paneling, carpeting and linoleum, and when used as a chair rail, it prevents chairs from scraping the walls. Wood trim is decorative, durable and relatively maintenance free.

Dust, dirt, fingerprints and splashes should be removed with an all-purpose household cleaner or a commercial wood cleaner.

Avoid using harsh abrasive cleaners that might scratch or mar the surface.

To prevent wood paneling and trim from drying out and discoloring, treat it with a moisturizing polish, much the same as you would use on fine wood furniture.

Over time, it is only natural that a scratch or gouge will appear in your wood trim.

These slight damages can be filled in with a crayon stick, shellac in a color that closely matches; your paneling or trim.

Fill nail holes, scratches, gouges, and miter joints by rubbing the crayon back and forth over the imperfections or use a caulking recommended by a hardware store professional.

- Remove the excess shellac with a clean cloth. - Buff lightly and apply a moisturizing wood.

DJK Custom Homes, Inc. should repair any joints in moldings or joints between moldings and adjacent surfaces where there is a gap exceeding 1/8 inch in width in the first year only.

Caulking or nailing of trim is considered an acceptable method to eliminate the gap.

DJK Custom Homes, Inc. is not responsible for exact color match.

DETERIORATION OF VARNISH OR LACQUER FINISHES

After your first year of residence in your new home, you will need to periodically refinish your interior wood trim surfaces that have been varnished or lacquered depending upon use.

FINISHED WOOD - EXTERIOR

Inspect your exterior trim annually to ensure it is tight and secure. Make sure the trim is re-painted as needed. Periodically, apply roofing cement or caulk to all flashing joints around vertical protrusions such as chimneys, stacks, vents, antennas and other attachments. Varnish-type finishes used on exterior wood surfaces of your home may deteriorate rapidly and are not covered by the warranty.

DJK Custom Homes, Inc. should repair any joints between exterior trim elements, with the exception of natural wood siding, that exceed 1/8 inch during the first year term of this warranty.

- Caulking is acceptable. In all cases, exterior trim should be capable of performing its function while

withstanding the natural elements. DJK Custom Homes, Inc. is not responsible for matching the finish or color of

the finished wood. DJK Custom Homes, Inc. shall take corrective action to repair or replace any

interior trim, which has hammer marks that are readily visible from a distance of 6 feet under normal lighting conditions. DJK Custom Homes, Inc. shall fill hammer marks and refinish or replace affected trim to meet the standards of this Limited Warranty. Refinished or replaced areas are not guaranteed to match surrounding areas in color, texture or wood graining.

Filled nail holes shall not be readily visible from a distance of 6 feet under normal lighting conditions. DJK Custom Homes, Inc. shall fill nail holes where required; however, varnish, paint, stain or touch-up areas are not guaranteed to match original finish materials or coatings. Nail holes in unfinished rooms do not have to be filled.

Joints between exterior trim elements and siding or masonry, which are in excess of 1/4 inch, shall be caulked. Exterior trim abutting masonry siding shall be capable of performing its function to exclude the elements. Touch-up of finish coatings where required are not guaranteed to match in color or texture between dissimilar materials.

SPLIT EXTERIOR TRIM BOARDS  

Small hairline-type cracks in your exterior trim boards are only natural since wood is porous and absorbs moisture.

DJK Custom Homes, Inc. should immediately repair splits wider than 1/8 inch with permanent filler during the first year term of this warranty.

All splits in wood, after the expiration of this warranty, are the OWNER’S responsibility.

DJK Custom Homes, Inc. is not responsible for matching the finish or color of the trim.

BOWED AND TWISTED EXTERIOR TRIM BOARDS

Bowed, twisted wood should be repaired immediately.

DJK Custom Homes, Inc. will repair bows and twists in your exterior trim that exceeds 5/16 inch in an 8-foot section during the first year term of the Warranty.

Deformed boards should be fastened or replaced. DJK Custom Homes, Inc. shall repair or replace as required unfilled, splits

exceeding 3/8 inch in width on any beam or post exceeding 2 ½ inches or greater in thickness. Caulking or other similar material used by DJK Custom Homes, Inc. is not guaranteed to match in color or texture of original wood beam or post.

DJK Custom Homes, Inc. is not responsible for matching the finish or color of the replaced or repaired boards.

FRAMED WALLS

Exterior and Interior framed walls or ceilings bowed in excess of ½ inch within a 32 inch horizontal measurement or ½ inch within any 8 foot vertical measurement shall be corrected to meet the specific guidelines of this Limited Warranty. Wood frame walls that are more than 3/8 inch out of plumb for any 8-foot measurement shall be corrected by DJK Custom Homes, Inc. to meet the guidelines of this Limited Warranty. The diagonal of a triangle with sides of 12 feet and 16 feet along the edges of the floor shall be 20 feet plus or minus ½ inch. DJK Custom Homes, Inc. shall make necessary modifications to comply with local construction standards.

NON-WARRANTED CONDITIONS This Limited Warranty covers only those items specifically described in Section II above: Warranty Coverage and Conditions.

I. THERE ARE NOT EXPRESS WARRANTIES COVERING THE HOME OR THE PROPERTY ON WHICH IT IS LOCATED; EXCEPT AS SPECIFICALLY PROVIDED HEREIN, AND TO THE FULLEST EXTENT PERMITTED BY LAW THE BUILDER SHALL NOT BE RESPONSIBLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES RELATING TO OR RESULTING FROM ANY DAMAGE TO OR DEFECT IN SAID HOME OR THE PROPERTY ON WHICH IT IS LOCATED. HOWEVER, NOTHING CONTAINED HEREIN SHALL LIMIT ANY OF THE OWNER’S RIGHTS BY VIRTUE OF APPLICABLE FEDERAL OR STATE LAWS. NOTHING CONTAINED HEREIN SHALL LIMIT ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE THAT MAY APPLY TO THIS TRANSACTION.

II. SPECIFIC DESCRIPTION OF CERTAIN NON-WARRANTED ITEMS

i. Section III is designed to help the OWNER better understand some of the changes and

maintenance items that may occur in the home during the first year or so of occupancy, and also to more specifically describe and explain certain items which are not covered by this Limited Warranty.

ii. Failure to include any item in Section III, or to specifically exclude any item that is not actually covered by this Limited Warranty, shall not create any presumption or implication whatever that the item is covered by this Limited Warranty.

III. GENERAL COMMENT

i. The home will require more maintenance and care than most products since it is made of many different components, each with their/its own special characteristics. Furthermore, like other products made by humans a home is not perfect. The home will show some minor flaws and unforeseeable defects, and it may require some adjustments and touching up.

IV. MANUFACTURER'S WARRANTIES

i. Certain items that are not covered by this Limited Warranty may be covered by manufacturer’s warranties. Those manufacturer’s warranties are listed in Section IV of this Limited Warranty.

ii. Any rights of the OWNER, under those warranties, are only provided; by the manufacturers. DJK Custom Homes, Inc. does not assume any of the obligations under those manufacturer’s warranties.

SPECIFIC NON-WARRANTED CONDITIONS

In addition to all of the limitations on the coverage of this Limited Warranty, the following items are specifically not covered:

1. Any change in the drainage pattern of the lot due to landscaping, installation of patio or

service walks, or other reasons, should be done in a manner, which will retain proper drainage slope. DJK Custom Homes, Inc. assumes no responsibility whatsoever for the grading or stagnant pool formation if the established pattern is altered. Furthermore pooling water on lots that are not equipped with a storm drain at the perimeter of the lot is not covered by this Limited Warranty.

2. Concrete-foundations, walks, drives, patios, etc., can develop hairline cracks not affecting the

structural integrity of the home. There is no known method of eliminating this condition, which is caused by characteristics of expansion and contraction. It does not affect the strength of the home and is not a condition, covered by this Limited Warranty. Only cracks specifically described in Section II shall be warranted.

3. Masonry and mortar can develop cracks due to shrinkage in either the mortar or brick. This

is normal and should not be considered a defect. It is not covered by this; Limited Warranty, except as specifically described in Section II.

4. During prolonged cold spells, ice build-up is likely to occur at the eaves and valleys of the

roof. This condition occurs when snow and ice accumulate and gutters and down spouts freeze. Prevention of ice build-up is specifically not warranted. Leaks as a result of ice build-up are also specifically not warranted.

5. Attic vents and/or louvers must be provided in order to properly ventilate the home. This

Limited Warranty does not cover leaks due to snow or rain driven into the attic through louvers or vents.

6. The manufacturer’s warranty on your roof covers materials only and does not cover the cost

of labor. Limited Warranty claims for any defects in materials will be handled with the manufacturer. DJK Custom Homes, Inc. shall specifically not be responsible for any damages caused by walking on the roof or installing a TV antenna or other appliance on a roof.

7. Any damage or defects resulting from Acts of God are not warranted and should be

handled through the OWNER’S hazard insurance carrier.

8. (a) Most bricks will discolor due to the elements, rain run-off, weathering and bleaching. The color of bricks is specifically not warranted. (b) Heat from fire will alter the color and finish of fireplace bricks, which are specifically not warranted. (c) Heat and flames from “roaring” fires will cause cracking of firebricks and mortar joints. These cracks are specifically not warranted.

9. Exterior and interior caulking, caulking in bathtubs, shower stalls and ceramic tile surfaces will crack or bleed somewhat in the months after installation. This is normal and is not warranted except as specifically described in Section II.

10. Wood will sometimes crack or “spread apart” due to the drying process. This is most often

caused by the heat inside the home or the exposure to the sun on the outside. This is normal and is considered a maintenance item to be cared for by the OWNER and is specifically not warranted.

11. There is no way to eliminate all floor squeaks. DJK Custom Homes, Inc. is specifically not

responsible for eliminating all floor squeaks. Generally, floor squeaks will appear and disappear over time with changes in the weather. Floor squeaks are specifically not warranted.

12. Windows will collect condensation on interior surfaces when extreme temperature differences

and high humidity levels are present. Condensation is usually the result of climatic/humidity conditions created by the OWNER within the home. Unless directly attributed to faulty installation, window condensation is a result of a condition beyond DJK Custom Homes, Inc.’s control and is specifically not warranted. Window “chatter” associated with wind conditions is normal and is also specifically not warranted under the conditions of this Limited Warranty.

13. Broken glass or mirrors, which are not noted on the New Home Orientation form prior to closing or occupancy of the home will not be warranted.

14. Drywall (sheetrock) will sometimes develop nail pops or settlement cracks. This is a normal part of the drying-out process and an item that can easily be handled by the OWNER with spackling during normal redecorating. Except as specifically provided in Section II, drywall (sheetrock) cracks, nail pops, seams, joints, corners, etc., are specifically not warranted.

15. Even the best quality paint, particularly exterior paint, can crack, chip or peel. This does not

indicate a defect in the paint or application but is most often caused by other sources, such as allowing lawn sprinklers to hit painted areas, washing down painted areas, etc. Inside, do not scrub latex painted-walls, and be aware of the newly painted walls as you are moving furniture. The best paint will be stained or chipped if it is not cared for properly. Any defects with interior painting and/or staining; that are not noted at the New Home Orientation Pre-closing Walk-Through; are not covered by this Limited Warranty. No painting is covered by this Limited Warranty; except as specifically provided in Section II.

16. Fungus and mildew can form on a painted surface if the structure is subject to abnormal

exposures, such as excessive rainfall or moisture. Often an area where no-direct sunlight occurs will be subject to these conditions. Mildew and/or fungus formation is a condition that cannot be controlled by DJK Custom Homes, Inc. and is an OWNER maintenance item and is specifically not covered by this Limited Warranty. Whether or not OWNER experiences mold growth depends largely on how OWNER manages and maintains the home. DJK Custom Homes, Inc. is not responsible for any damage caused by mold, or by some other agent, that may be associated with Homeowner maintenance or neglect, to include but not be limited to property damage, personal injury, loss of income, emotional distress, death, loss of use, loss of value, and adverse health effects, or any other effects.

17. All material that is stained will have variations in color, due to the various textures in wood. Doors that have panels will sometimes dry out and leave a crack of bare wood. This is due to weather changes and other conditions, and neither color variation nor shrinkage cracks are warranted except as specifically provided in Section II.

18. Dripping faucets, toilet adjustments and toilet seats are only covered by this Limited Warranty

to the extent described in Section II. Otherwise, they are the OWNER’S responsibility. If the plumbing is “stopped up” during the term of this Limited Warranty and the person servicing the plumbing on behalf of DJK Custom Homes, Inc. finds foreign material in the line, the OWNER will be responsible for payment in full of the service call.

19. The OWNER must take precautions to prevent freezing during severe cold weather, such as

removing outside hoses from sillcocks, leaving faucets with a slight drip, opening door cabinets under sinks, and turning off water system if the home is to be left unoccupied for extended periods during cold weather. Except as stated in Section II, frozen pipes are not warranted. Under no circumstances are sillcocks warranted.

20. The heating and air conditioning system is covered by the manufacturer’s warranty. It is the

OWNER’S responsibility to make sure that filters are kept clean and changed at least every 2 months. Failure to do so may void the Limited Warranty. It is also good policy to have the equipment serviced or checked at least once a year.

21. Air conditioner condensation lines will clog eventually under normal use. This is an OWNER

maintenance item. DJK Custom Homes, Inc. shall provide unobstructed condensation lines at the time of first occupancy only.

22. When metal is heated it expands, and when cooled it contracts. The result is “ticking” or

“crackling” within ductwork, which is generally to be expected. Except as stated in Section II, ductwork is not warranted.

23. Ground fault interrupters are sensitive safety devises installed into the electrical system to

provide protection against electrical shock. DJK Custom Homes, Inc. has installed ground fault interrupter circuits in accordance with approved electrical codes. Tripping is to be expected and is not a warranty item. Service calls to reset tripped breakers will be billed to the OWNER. Burned out light bulbs are specifically not warranted and service calls resulting in burnt out light bulbs will be billed to the OWNER.

24. Electrical junction boxes on exterior walls may produce airflow whereby the cold air can be

drawn through the outlet into the room. This problem is normal in new home construction and is not warranted.

25. The floors are not warranted for damage caused by neglect or the incidents of use. Wood, tile,

marble, linoleum and carpet all require maintenance. Floor casters are recommended to prevent scratching or chipping of wood, tile or marble. The OWNER should clean stains from carpet, wood, tile or marble immediately to prevent discoloration. Carpet has a tendency to loosen in damp weather and stretch tight again in dryer weather. Any floor covering deficiencies that are not noted on the New Home Orientation form prior to closing are not warranted.

26. Exposure to light may cause spots and/or fading on carpets and wood floors. These conditions are specifically not warranted.

27. Door panels will shrink and expand, and may expose unpainted surfaces. This is normal and

not warranted.

28. The upkeep of cosmetic aspects of the home is the OWNER’S responsibility. DJK Custom Homes, Inc. has not agreed to cover ordinary wear and tear, or other occurrences subsequent to construction that affects the condition of features in the home. Chips, scratches or mars in tile, woodwork, walls, porcelain, brick, mirrors, plumbing fixtures, marble, formica, lighting fixtures, kitchen and other appliances, doors, paneling, siding, screens, windows, carpets, vinyl floors, cabinets, etc. which are not recognized and noted at the New Home Orientation are not covered by this Limited Warranty.

29. DJK Custom Homes, Inc. accepts no responsibility for the growth of grass, shrubs or trees.

Once DJK Custom Homes, Inc. grades and sods the property, it is the responsibility of the OWNER to water and maintain the lawn and plants. DJK Custom Homes, Inc. will not re-grade the yard, nor remove or replace any shrubs, trees, or sod except for those, which are noted as diseased at The New Home Orientation. Under no circumstances is sod a warranted item.

30. Chips and cracks on surfaces of bathtubs, sinks, etc., can occur when the surface is hit with

sharp or heavy objects. DJK Custom Homes, Inc. shall not be responsible for repair of such damages unless the damage was reported to DJK Custom Homes, Inc. at the time of the New Home Orientation prior to closing or occupancy.

31. DJK Custom Homes, Inc. does not warrant, and shall not be responsible for repairing,

replacing, or correcting, any outside concrete flat work (including but not limited to driveways, walks, and patios) against cracking, flaking, scaling, spalling, pitting, discoloration, expanding, shrinkage, settling or any other problems whatsoever. With respect to all other concrete, except as specifically described in Section II, DJK Custom Homes, Inc. specifically does not warrant and shall not be responsible for repairing, replacing or correcting any cracking, flaking, scaling, spalling, pitting, discoloration, expanding, shrinkage, settling or other problems. The OWNER acknowledges that weather conditions, salt and other chemicals can have an adverse effect on concrete and that the OWNER shall be solely responsible for the proper maintenance of all concrete (specifically including but not limited to any concrete, driveway, patio and walks).

32. DJK Custom Homes, Inc. does not warrant, and shall not be responsible for, any work

performed or material supplied in accordance with any plans specifications supplied, prepared or requested by the OWNER, or by anyone on behalf of the OWNER, or for any defects caused or made worse by negligence, improper maintenance or other action by the OWNER or anyone else other than DJK Custom Homes, Inc. or DJK Custom Homes, Inc, employees, agents or subcontractors.

outbuildings which contain the plumbing, electrical, heating/cooling or ventilation systems serving the home) swimming pools and other recreational facilities; fences; landscaping (including sodding, seeding, shrubs, trees, and plantings); sprinkler systems; or any other improvements, not a part of the home.

34. Damage to real property, which is not a part of the home.

35. Bodily or personal injury, damage to personal property, or damage to any property of others.

36. Any loss or damage, which the OWNER has not taken appropriate action to minimize as

soon as possible.

37. Any defect in, or caused by material or work supplied by anyone other than DJK Custom Homes, Inc. or DJK Custom Homes, Inc. employees, agents, or subcontractors.

38. Loss of use, loss of opportunity, loss of market value, loss of rental value or any other similar

consequential loss.

39. Defects in any property, which was not included in the original home delivered for the original sales price.

40. Consequential, incidental or secondary damages.

41. Any damage to the extent it is caused or made worse by:

A. Negligence, improper maintenance or improper operation by anyone other than DJK

Custom Homes, Inc. or employees of, agents or subcontractors. B. Failure by the OWNER to give prompt and proper notice to DJK Custom Homes,

Inc. of defects. (See: SECTION V—PROCEDURE FOR WARRANTY PERFORMANCE in this Limited Warranty).

C. Loss or damage not caused by a defect in the construction of the home by DJK Custom Homes, Inc., or DJK Custom Homes, Inc.’s employees, agents or subcontractors.

D. Loss or damage externally caused including but not limited to Acts of God, riot or civil commotion, fire, explosion, smoke, water, hail, lightning, fallen trees or other objects, aircraft, vehicles, flood, rising water, mud slides, earthquakes, volcanic eruption, abuse or use of the HOME, or any part thereof, or by any other external cause.

E. Presence of, or damage from insects, birds or rodents. F. Any loss or damage, which arises while the home, is being used primarily for

nonresidential purposed. G. Any condition, which does not result in actual physical damage to the home. H. Cost of shelter, transportation, food, moving, storage, or other incidental expenses

related to relocation during repair or any other costs due to loss of use. I. Any claim reported after unreasonable delay or more than ten (10) days after the

expiration of the warranty term. J. Normal wear and tear and deterioration.

PROCEDURE FOR WARRANTY PERFORMANCE

Procedures relating to the performance under the warranty by DJK Custom Homes, Inc., and all requests for warranty service by the OWNER, shall be in accordance with Section V.

DJK Custom Homes, Inc. is the explicit Warrantor under this Limited Warranty.

NEW HOME ORIENTATION AND WARRANTY SERVICE PERFORMANCE GUIDE

I. NEW HOME ORIENTATION PRECLOSING WALK-THROUGH

i. Prior to closing or occupancy, the OWNER will conduct a NEW HOME ORIENTATION PRECLOSING WALK-THROUGH of the Home and the property on which it is located. At that time, DJK Custom Homes, Inc. shall prepare, on DJK Custom Homes, Inc. Forms a listing of all defects and specific OWNER requests. Any defect so listed will be repaired by DJK Custom Homes, Inc. If an exception occurs, the OWNER will be notified.

II. REQUEST FOR WARRANTY PERFORMANCE

i. Any request for Warranty Service must be provided IN WRITING and MUST be delivered to DJK Custom Homes, Inc. no later than the expiration of the term of this Limited Warranty as mentioned above. The OWNER’S warranty requests should be made to DJK Custom Homes, Inc. during the scheduled approximate 30 DAY and 11 MONTH punch list requests. The OWNER must use all appropriate DJK Custom Homes, Inc. forms when applicable. IT IS THE OWNER’S RESPONSIBILLITY TO CONTACT DJK CUSTOM HOMES, INC. TO SCHEDULE ANY 30 DAY and 11 MONTH PUNCHLIST REQUESTS. When the OWNER contacts DJK Custom Homes, Inc. at the appropriate 30 Day and 11 Month Request Schedules, the OWNER must provide DJK Custom Homes, Inc. with the following information:

iii. WARRANTY COMMENCEMENT DATE / CLOSING DATE iv. Specific Nature of Warranty Performance Requested

III. WARRANTY SERVICE REQUEST SCHECULE AND FORMS:

i. Subject to the foregoing, warranty service request shall be submitted to DJK Custom

Homes, Inc. on the following approximate schedule: THIRTY (30) DAYS following closing or occupancy and ELEVEN (11) MONTHS following closing or occupancy. At those times appropriate procedures will be taken by DJK Custom Homes, Inc. to correct any warranted defects in a professional manner. The work will be performed pursuant to lists prepared by the OWNER on DJK Custom Homes, Inc. designated Work Form (sample pictured on next page) and a DJK Custom Homes, Inc, representative having visited the Home if any warranty requests need to be viewed by a DJK Custom Homes, Inc Representative.

scheduled. The OWNER shall list all claims for which warranty service is requested on the Work Form provided. To expedite the scheduling and completion of the necessary work for the OWNER, CLAIMS CANNOT BE ADDED TO THE LIST once DJK Custom Homes, Inc. has performed the visitation at the OWNER’S HOME. NOT ALL PRODUCTS ARE COVERED UNDER THIS LIMITED WARRANTY FOR A TWO (2) YEAR PERIOD. THE OWNER SHOULD MAKE SURE THAT THE 11 MONTH LIST CONTAINS ALL ONE (1) YEAR WARRANTABLE CLAIMS WHEN THE LIST IS SUBMITTED. THE OWNER SHOULD MAKE SURE THAT THE 11 MONTH LIST CONTAINS ALL REQUESTED CLAIMS WHEN IT IS SUBMITTED. Your Limited WARRANTY TERM is two years and all final requests must be made by the OWNER, before the two-year expiration.

To complete the Work Form provided by DJK Custom Homes, Inc. fill in the following information:

DJK Custom Homes, Inc. understands that not all situations requiring immediate attention happen during normal working hours. Please call the office at 630-369-1953 and listen for the prompts and leave a message on either Dan or Shayne’s cell phone.

HELP US SERVE YOU BETTER - KNOW AND USE THE APPROPRIATE PROCEDURES AND PHONE NUMBER WHEN REPORTING EMERGENCY PROBLEMS.

AN EMERGENCY includes: 1. Electrical Outage 2. Electrical Sparks 3. Furnace Outage 4. Gas Leak or Outage 5. Water Leak, from any source 6. Non-Operable Exterior Entry Door or Lock

Air Conditioner Outage is not considered an emergency. Normal air-conditioning problems will be corrected during normal working hours in the order they are reported.

Please follow the appropriate steps listed in the OWNER’S Maintenance and Helpful Tips Section of this Limited Warranty below prior to reporting an emergency.

OWNER’S MAINTENANCE AND HELPFUL TIPS

HEATING AND COOLING Breaker Box

- Check for a switch that may need resetting. A tripped breaker must be turned all the way off and then back to reset.

Thermostat Setting - On models with air-conditioning, the system switch must be on “AC” and the fan

switch should be on “auto” Pilot

- If the pilot is out follow instructions on the furnace or in the manufacturer’s literature to re-light. Some furnaces have electronic ignition, if that is the case ignore C.

Gas Valve in “on” Position - This is the last step in lighting the pilot and is frequently overlooked.

Bottom Cover - Generally, the furnace fan will not operate if the bottom cover panel is not

properly closed. The bottom cover panel restrains (holds in) a sensor button indicating that the panel is closed; this is similar to the mechanics of a clothes dryer door.

Manual Switch “on” - This looks like a light switch and is located on the side of the furnace, next to the

fuse. Heat Pumps

- In the “Heat” mode, the heat pump may not supply sufficient heat BTU’s to heat the home. Switching to auxiliary heat is required.

PLUMBING, GAS OR WATER LEAKS

Gas Leaks - Gas leaks are to be reported immediately to your local GAS SERVICE

COMPANY. The reporting of this emergency to DJK Custom Homes, Inc.’s number should be secondary to the call made to your local GAS SERVICE COMPANY.

Water Shut-Off Valves - Water shut-off valves are often located behind toilets and under sinks. Use these

valves immediately when shutting down the water supply to a particular fixture or appliance.

Home Water Shut-Off - The home water supply can be shut-off supplying all water throughout the home.

This valve is normally located in the basement or crawl space of the home on the wall nearest the street.

Exterior Water Shut-Off - The City Water Service can be shut-off to eliminate all water supplied to the

home from the street. This is usually located outside in the front of the home near the street.

ELECTRICAL Breaker Box

- Always check the main breaker at the top of your breaker box before calling. GFI Switches

- Always check all GFI switches prior to calling. WATER LEAKS

Prevent Damage - Immediately collect the water entering the home by means of buckets, pans,

towels, or other means to prevent further damage from the water. Any water leak is considered an emergency and DJK Custom Homes, Inc. should be contacted immediately.

DJK Custom Homes, Inc. office.

ARBITRATION PROCESS 1. If the local Homebuilder’s Association offers an Arbitration service then DJK

Custom Homes, Inc. may choose the BUILDER’S Association to conduct the arbitration, in which case all fees of the arbitration, shall be shared equally; by the OWNER and DJK Custom Homes, Inc. unless the arbitration award apportions otherwise. If DJK Custom Homes, Inc. chooses not to utilize the Local BUILDER’S Association’s Arbitration Services then DJK Custom Homes, Inc. will choose an arbitrator that will conduct the arbitration. All fees of the arbitration shall be shared equally; by the OWNER and DJK Custom Homes, Inc, unless the arbitration award apportions otherwise.

2. The Arbitration Process will be conducted in accordance with the Limited Warranty conditions described herein and the rules and regulations of the Arbitration Service conducting the Arbitration. Upon failure of Conciliation and request for arbitration, the following sequence of events will occur.

A. OWNER may receive a Request for Arbitration Form from the APPOINTED ARBITRATOR.

B. The completed, Request for Arbitration Form must be submitted, by either party to the arbitration service office designated on the form.

C. Copies of the form must be submitted to DJK Custom Homes, Inc. D. A meeting at the home with all parties involved; will be arranged by

the Arbitration Service. E. Arbitrating Service’s decision is binding upon all parties.

The OWNER and DJK Custom Homes, Inc. shall execute such reasonable documents as may be required by the Arbitrator, including documents regarding the confidentiality of information and documents received.

MISCELLANEOUS

A. Repairs required under this Limited Warranty shall be performed in the manner and using such materials and methods as shall be considered advisable by DJK Custom Homes, Inc.

B. Repairs shall be finished or touched up to match surrounding areas as closely as practicable.

However, exact match cannot be guaranteed.

C. Notwithstanding anything else contained herein, for any problem covered by this Limited Warranty, DJK Custom Homes, Inc. in its sole discretion may repair or replace.

D. Notwithstanding anything else contained herein, DJK Custom Homes, Inc.’s total liability for

deficiencies under this Limited Warranty is limited to the purchase price of the home.

E. Steps taken to correct defects shall not act to extend the term of this Limited Warranty.

F. If DJK Custom Homes, Inc. repairs or replaces any defect covered by this Limited Warranty which is covered by any other insurance or warranty, the OWNER must, upon request by DJK Custom Homes, Inc. assign the proceeds of such insurance or the rights under such warranties to DJK Custom Homes, Inc. to the extent of the cost to DJK Custom Homes, Inc. of such repair or replacement.

G. Should any provision of this Limited Warranty be deemed unenforceable by a court of

competence jurisdiction that determination; will not affect the enforceability of the remaining provisions.

H. This Limited Warranty is to be governed by and construed in accordance with the laws of the

state of Illinois.

I. This Limited Warranty may not be modified or amended in any respect except upon written amendment signed by both DJK Custom Homes, Inc. and the OWNER.

J. This Limited Warranty contains the entire express warranty granted by DJK Custom Homes,

Inc. to the OWNER and supersedes any previous contracts or agreements or representations relating to warranties, whether oral or written. OWNER ACKNOWLEDGES THAT DJK CUSTOM HOMES, INC. HAS MADE NO REPRESENTATIONS, PROMISES, WARRANTIES OR AGREEMENTS WHATSOEVER CONCERNING THE HOME OR THE PROPERTY ON WHICH IT IS LOCATED WHICH ARE NOT STATED HEREIN.

K. OWNER acknowledges if DJK Custom Homes, Inc. chooses to repair, replace, address or

discuss the improvement of any non-warrantable condition involving in any manner the material, workmanship, supply or situation, DJK Custom Homes, Inc. is not obligated, represented, promised or committed to repair, replace, address or discuss any other non-warrantable condition thereafter.

For the purpose of this indemnification, “claims” shall mean and include any obligations, all actual and consequential damages.
