In the UAE, investors are given the opportunity to claim Residency whenthey setup a company within the jurisdiction. Since an Onshorecompany requires a local Emirati partner, the next best option is tosetup a company in one of the Free Zone, which allow foreigners (nonEmiratis) to own 100% of their Free Zone company.

Establishing a UAE Free Zone company is straightforward and, oncesetup, the owner can apply and obtain an Investor Visa granting them a3 year Residency.

The only requirement is that the Visa holder visits the UAE at least every180 days. There is no minimum stay required.

In most Free Zones there are no funded capitalization requirements forthe Free Zone Companies and no requirement for any minimum activity.

OFFICE TYPES AND VISA ELIGIBILITY:

• In completing the setup of a Free Zone company, the authorities oblige the businessto demonstrate that they have taken a professional real estate hosting, by renting acertain type of facility – Flexi Desk, Flexi Office or Physical office.

• Each type of facility offers a respective number of Investor Visas. Flexi Desks usuallyallow for 2-3 Investor Visas. Additional number of visas will require a larger realestate commitment.

• Validity of the Residency Visa is from 2-3 years depending on the jurisdiction.

What is a UAE Free Zone ?

• Isolated lands or settings, which have a special Tax, Customs and Import regime andare governed by their own distinct framework of regulations (with the exception ofUAE Criminal Law).

• The UAE has 45 Free Zones across all seven Emirates. Free Zones can be broadlycategorized as Sea Port Free Zones, Airport Free Zones and Mainland Free Zones. Anoperating license is issued for specific “activities”.

• Foreign owners can own 100% of their UAE Free Zone Company.

Once the Free Zone Company has been established , werecommend that the client, who will claim Fiscal Residency inthe UAE based on the above arrangement, seek a residentialsolution to support their proof of Tax Residency in the UAE.
