Titled: Australian Chornobyl Children's Relief Foundation (hyperlink).

I find it totally extra-ordinary that to this day, despite my detailing of the evidence

and the published “retraction”, certain sectors of the Ukrainian community are still

behaving as if both Mrs. Irena Krasulak and Fr. V. Wolochy are guilty of some

imagined offence and refuse to accept the truth. The court totally exonerated them

from the accusations made against them, as evidenced by the public “retraction

notices” that were placed in the various newspapers.

In my quest to discover the truth of why Mrs. Irena Krasulak and Fr. V. Wolochy

were so devastatingly denigrated, humiliated and belittled, culminating in many

people in the community ignoring, discriminating and ostracising them; all as

detailed in the above newsletter, I once again waded through the 40 kg of evidence

relied on in Court and during the “Discovery” process, where both parties were given

the opportunity to examine each other’s evidence, I believe I discovered the catalyst

which led to and started all of this nonsense; that is, the alleged unscheduled,

unauthorised and unlawful Australian Chornobyl Children’s Relief Foundation

(ACCRF) meeting “Agenda and Minutes of that Meeting of the 14 October 2003.”

I am mindful of the Defamation Act 2005 (Vic) which states, in part:

“ to ensure that the law of defamation does not place unreasonable limits

on freedom of expression and, in particular, on the publication and

discussion of matters of public interest and importance…”

I believe that the following information is in the “public interest and

importance” to the Ukrainian Community.

I hope that I never see or hear of such a meeting ever again

AGENDA AND MINUTES OF MEETING DATED 14 OCTOBER 2003

AGENDA

1. An examination of the “Calling of the Meeting” of the ACCRF as per the Agenda.

NOTE:

a) In accordance with ACCRF Constitution, Clause 11.1, it states that:

“The Secretary of the Foundation” is the only person authorised to call a meeting of the

Committee.

b) The Secretary categorically stated in “Court” documentation that he did not call the

meeting of 14 October 2003 and further stating it was an unlawful meeting.

2. The “unlawful and unscheduled” Committee Meeting opened 9.00pm; NOTE:

I find the meeting time being highly irregular and unusual given that previous meetings were scheduled at 7.30 pm.

3. The Minutes of the Meeting list the attendees (refer attached) as:

i. Christine Merunovich,

ii. Julie Wenhlowskyj,

iii. Joe Fiamengo,

iv. Marta Semkiw,

v. Taras Kogut and

vi. Andrew Kogut.

NOTE:

a) Mr. Miroslav (Ross) Merunovich is not listed as attending.

b) Both, Mrs. Irena Krasulak (President) and Fr. V. Wolochy (The Secretary) were NOT

advised of the meeting.

c) The Meeting was held at No. 1 Gale Street, Brunswick East, the business premises of

Quadtec Laser Technologies; one of the owners being Miroslav (Ross) Merunovich.

d) Normally, meetings were held at the Ukrainian Hall, Essendon.

4. The First “Motion” was put:

“Motion put forward that Myroslav Merunovich be co-opted to the current committee meeting

without voting rights. Should a vacancy arise, the committee may vote to fill that vacancy – it

was a unanimous decision.”

NOTE:

a) Mr. Miroslav (Ross) Merunovich was not listed as an attendee – yet he was at the

meeting.

b) Mr. Miroslav (Ross) Merunovich is not even a member of the ACCRF and should have

NOT been at that meeting and NOT even permitted to be an observer.

c) There were NO VACANCIES on the Committee, as both Mrs. Irena Krasulak (President)

and Fr. V. Wolochy (Secretary) were still members of the Committee.

d) Mr. Miroslav (Ross) Merunovich was NOT an elected member of the Committee.

5. “The committee decided that in the absence of the Secretary, the Vice President should take

the Minutes, therefore a unanimous decision was to elect Mr. Myroslav (Ross) Merunovich as

the Chairperson for the meeting”

NOTE:

a) In accordance with the ACCRF Constitution Clause 6 (a), it states:

“The President or in his absence, the Vice President preside over the meeting”.

b) The evidence at hand indicates that Mr. Myroslav (Ross) Merunovich was not a member

of the ACCRF at this time. This has been confirmed by the Secretary / Membership Officer

– Fr. V. Wolochy.

Question: Why did the Vice President, Mrs. Christine Merunovich, relinquish her

Constitutional position to her husband (Mr. Miroslav (Ross) Merunovich), when she should

have presided over the meeting?

Important Points 4 & 5 (above)

To “co-opt” and to further “elect as Chairperson” Myroslav Merunovich, in my personal

opinion and belief (others may have a differing opinion), was unlawful and constitutes a

“Conflict of Interest”.

I refer to the “СВІЙ ДО СВОГО Ukrainian Community Issues Newsletter titled “Time for a

Rebirths of our Ukrainian Community” dated 6 April 2016” (hyperlink)

“…it is absolutely essential to ensure that there should never be more than one

member of a family or extended family, including cousins (двоюрідний брат і

сестри) and godparents (хресні) on any committee or board in any organisation”

6. The “First Agenda” Item: “Consider the resignation of Irena Krasulak”

7. The Minutes further stated:

“As no formal resignation has been received from Mrs. Irena Krasulak to date, it has been

decided that the committee endorse the letter of the 10th October (2003) from the Vice

President asking Irena Krasulak to clarify the status of her Presidency……..”

NOTE:

i. No such letter of resignation was provided by Mrs. Irena Krasulak.

ii. In a letter to Mrs. Christine Merunovich, Mrs. Irena Krasulak stated that if she was

to resign, she would have sent the letter to the Secretary, Fr. V. Wolochy.

iii. Mrs. Irena Krasulak made it clear in that letter that she DID NOT SEND ANY

LETTER OF RESIGNATION TO ANYONE.

OBSERVATIONS:

A. Four (4) days prior to the above “unscheduled, unauthorised and unlawful” committee

meeting.

a. On 10 October 2003, Mrs. Halyna Lvivna Kalatalo, the ACCRF’s representative in

Ukraine made a written statement which, in my interpretation, appeared that someone

tried to coach her into stating that Mrs. Irena Krasulak had intentions of buying the

ACCRF’s apartment in Lviv in her own name. However, Mrs. Kalatalo stated that was

definitely not the case.

Note:

i. Mrs. Halyna Lvivna Kalatalo is Mrs. Christine Merunovich’s cousin.

ii. I have personally viewed the Title to the apartment and it was in the name of

the ACCRF.

b. On 10 October 2003, Mrs. Kalatalo, in a letter to Mrs. Irena Krasulak made the following comments:

i. “What is going on in your foundation?”

ii. “Please clarify this matter between yourself, Christine and Myron (Miroslav - Ross)

Merunovich …….”

iii. “You authorised me to act only through you…..”

iv. “…..send everything to fax number of Myron (Miroslav- Ross) Merunovich”

Comments:

i. Why was Mr. Myron (Miroslav (Ross)) Merunovich involved, as he was not even

a member of the ACCRF at the time?

ii. It appears, and is alleged, from the above letter, that Mrs. Christine Merunovich

and Mr. Miroslav (Ross) Merunovich attempted to have correspondence etc.

from Ukraine directed through them, rather than through the President, Irena

Krasulak or the Secretary.

B. Since the meeting of 14 October 2003, Fr. V. Wolochy stated in court documents that there

were a number of illegal meetings, including a Special General Meeting, as well as the

AGM.

C. There were also suggestions that Fr. V. Wolochy also tendered his resignation which he

denied in a court documents.

D. Fr. V. Wolochy stated in a court document that:

“This ‘group’ was dishonest and misled in advising the people present (at the AGM)

that Mr. I. Krasulak and I have taken money without authority”.

(Proved in court, that any moneys expended were with the committee’s authority.)

E. I have extensively read most of the ACCRF documents that were presented in the court

case and I have concluded that there were many allegations of embezzlement which

proved to be incorrect as witnessed by the publicised “retraction”.

F. So where did these embezzlement claims come from. I will leave the conclusion in the

hand of the readers.

G. But I will stress, Mrs Irena Krasulak and Fr. V. Wolochy were exonerated as witnessed by the following “retraction”.

H. The Retraction:

Should anyone wish to correct or clarify any matter raised in this article, we will oblige and give them an equal right of reply, in the same format as this article.
