Copyright

Copy right is a legal obligation that makes it unlawful to copy, misuse, sell, alter and display someone else’s property that they have already produced. For instance, music videos, CDs, DVDs or art works that can be copied by someone else made by a specialist. However, if it is stated otherwise in a contract, the author or creator of a work can keep hold of the copyright. The information can only be used if the author or creator of a work releases the copyright.

Give specific examples how did these constraints affect your work for Unit 5.

Pre- production

When planning my work before the production process I needed cutaways, which I researched on YouTube. I have found some video footage that looked like an original footage, which I required and were relevant to my documentary. But, I was aware of the copyright issues and did not use it for my documentary as it was illegal and the footage did appear professional and formal. Instead, I filmed my own original cutaways, which were better quality and framing wise.

I planned to use some cutaways from YouTube, which I could easily download on Clip converter but I didn’t as I knew that I would breach as a documentary producer the Copyright codes of professional conduct.

However, I knew I was unable to produce my own sexually explicit music videos as I did not have the extended resources and characters. I was fully acknowledged by the fact that this would be a problem with copyright issues but I had no alternatives. It was a threat from the SWOT chart that I did not have any control over.

Production

For all the archive footage that I have used from Google and YouTube I have included Copyright notes on all the YouTube music videos and Google images that are used in my documentary.

This was very essential as it made me acknowledge that copying sources from internet, which belongs to other people is illegal and unfair.

In my production stage, I have made it clear in every single archive footage that I have used that it belongs either to YouTube or Google.

But, my documentary is only used for educational purposes only and it is not going to be published on TV and I do not misuse my documentary in any way.

Post- production

In unit 5 for the post-production of my documentary, I uploaded my video footage on YouTube and Blogger with a message that made it clear that ’’I do not own the video and that it is used for educational purposes only’’.

Likewise, in every YouTube music video I have included a message saying where I have obtained the music videos from. For instance, ’’This music video is obtained from YouTube’’.

This connotes that the message will make it clear that I am aware that the videos are copied from YouTube but I do not sell my documentary or misuse the content of the sexually explicit music videos in my documentary.

Again, it is for educational purposes only. If I was a professional documentary producer I would get sued because I haven’t made my own original sexually explicit music videos. (See Unit 5 for evidence).

Consent Consent is asking or providing permission to someone for many purposes. This is

important as people’s wishes have to be considered and mainly professionals cannot do anything against other people’s wishes that they work for.

Give specific examples how did these constraints affect your work for Unit 5.

I have produced consent letter especially for my interviewees to ask for their permission

whether I could use them for my documentary.

In addition, the emails that I have got from Sadiq Khan’s assistant are a form of consent

for giving me permission to film Mr. Khan and use his video

footage for my documentary. Likewise, Keera, Mrs. Lattimore

and the three Vox Pops have all given me permission by

allowing me to film them. It’s important to mention, that before

I actually decided to film my interviewees and Vox Pops

I have asked for their permission that video footage is being

published on Blogger and YouTube.

Privacy Privacy is basically the condition of being or having concealed or hidden right and needs. This also connotes not having to talk

about or have your personal matters or issues leaked out in the public, which could cause scandal for most important people such as celebrities.

Give specific examples how did these constraints affect your work for Unit 5.

I took the matter of privacy serious in my documentary as I have used a personal picture of Keera, Mrs. Lattimore and Sadiq Khan but I have asked their permission for it so that they are aware of it.

For my interview with Mr. Sadiq Khan, I ensured that I send his assistant the questions that I will be asking him prior my interview with him in order for them to read through my questions in advance. In case, Mr. Khan may not feel comfortable with my questions he can tell me in advance to not ask him to protect his privacy and also to ensure no privacy is breached.

However, for all my questions that I have asked my interviewees and Vox Pops throughout my documentary I have asked them relevant and topical questions, which covered the issues raised in my documentary and that did not breach their comfort zone and that were not too personal.

For instance, I have not asked Keera how she feels that she is not easily recognized as a female but rather a male. Does she feel embarrassed?

These inappropriate questions could cause offence and make the

Interviewee feel uncomfortable as they would have to talk about their personal thoughts and feelings

on camera which also caused humiliation.

This would be completely against my professional practice as a documentary producer and it would breach boundaries of privacy.

But I altered my questions by reading them again and ensuring that the

questions are relevant, understandable and whether the questions

are answerable? Yet also, I limited down my questions to 5 questions so that

the interview doesn’t go on for long.

Libel The term libel suggests a false publication of someone that is in writing, print, signs or

pictures, which damages a person’s reputation and status. For instance, the magazine of Star showed below.

Give specific examples how did these constraints affect your work for Unit 5.

This concept meant that I cannot use defamatory terminology about someone.

Even though, the topic of my documentary was about sexually explicit music videos I did not state anywhere or made obvious through my video footages that the females who were allowing their bodies to be used for entertainment for men and females that they were ’’Sluts’’ or I didn’t say anything inappropriate that was libel to the characters in the documentary.

Another example, is that I have not used Sadiq Khan’s footage to mock him or did not do something inappropriate with his picture or video footage in my documentary.

This would be completely unacceptable, unprofessional and libel. For instance, calling him names or labelling my interviewees.

The main evidence for not being libel and biased is by providing a

range of polarized opinions to my intended target audience in my

documentary.

Trespass The term trespass is the act of entering unlawfully on someone else's property

without consent.

Give specific examples how did these constraints affect your work for Unit 5.

Yet also, I have made consent letters for the permission to use the picture of the location of Tooting Hub and Lambeth College for my archive footage in my documentary.

I was assisted by Sadiq Khan’s assistant when I entered the building where Sadiq Khan’s office was located. I did not trespass the building without consent as it was illegal and forbidden to do so. The entrance had high security measures to prevent any intruders from coming into the building and carrying out illegal activities.

I did have my confirmation details that was from Sadiq Khan’s assistant to show the guards at the entrance that I am allowed to enter the building.

This would be a serious offence if I did trespass.

However, with my other interviews and Vox Pops I had no problem

with not being able to enter the location that I planned to film in.
