Two Competing Models of Criminal Justice

– Emphasizes some guilty offenders will be found innocent to reduce likelihood of convicting an innocent person

– Sometimes necessary to sacrifice some degree of public safety in order to guarantee basic personal freedoms

– Advocates limited police powers with the highest evidentiary standard possible

Public Order Model

Public Order Model Wants greater police powers while curtailing some criminal

defendants rights

Believes the most important function of the CJsystem is repression of crime

Believe that procedural issues involving the accused are secondary to the need to protect society

Believes the collective rights of society take precedence over the rights of an individual
