Bolivia, France, Federal Republic of Germany, Netherlands and United States of America:amendment to document A/CONF.13/C.5/L.15

Substitute the following for the two numbered paragraphsin part I I :

"Access to the sea for States having no sea coast" 1 . In order to enjoy the freedom of the seas on equalterms with coastal States, States having no sea coast mayhave free access to the sea. To this end a State situatedbetween the sea and a State having no sea coast shall bycommon agreement with the latter and in conformity withexisting international conventions accord

"(a) To the State having no sea coast, on a basis ofreciprocity, free transit through its territory, and

" (b) To ships flying the flag of that State treatmentequal to that accorded to its own ships, or to the ships ofany other States, as regards access to sea ports and theuse of such ports."2. A State situated between the sea and a State havingno sea coast shall settle, by mutual agreement with thelatter, and taking into account the rights of the coastalState or State of transit and the special conditions of theState having no sea coast, all matters relating to freedomof transit and equal treatment in ports, in case such Statesare not already parties to existing international conven-tions."

RECOMMENDATIONS OF THE FIFTH COMMITTEE TO THE CONFERENCE

(A/C0NF.13/L.U, section XI)

The Fifth Committee recommends that the Conferenceshould:

Draft the articles to be adopted by the Conference on thebasis of the International Law Commission text, articles15, 27 and 28, to read as follows (the proposed additionsare italicized):

Article 15, paragraph 1

" Subject to the provisions of the present rules, shipsof all States, whether coastal or not, shall enjoy the rightof innocent passage through the territorial sea."

Article 27

"The high seas being open to all nations, no Statemay validly purport to subject any part of them to its

sovereignty. Freedom of the high seas comprises, interalia, both for coastal and non-coastal States :

(1) Freedom of navigation;(2) . . .(3) . . .(4) . . ."

Article 28

"Every State, whether coastal or not, has the rightto sail ships under its flag on the high seas."

Insert the following new article at an appropriate placein one of the conventions to be adopted by the Conference :

"Access to the sea for States having no sea-coast

"Article...

" 1 . In order to enjoy the freedom of the seas on equalterms with coastal States, States having no sea-coastshould have free access to the sea. To this end Statessituated between the sea and a State having no sea-coastshall by common agreement with the latter and in con-formity with existing international conventions accord :

" (a) To the State having no sea-coast, on a basis ofreciprocity, free transit through their territory; and
