BACKGROUNDThe U.S. Army Corps of Engineers (USACE), through its staff and contractors, providesquality, responsive engineering and construction services to the Army and the Nation.
USACE missions include civil works, military construction, environmental restoration, andsupport to other agencies.
The civil works program encompasses flood control, navigation, shore erosion, and recreation facilities.
The military construction program supports the Army, most of the Air Force, and certain other Department of Defense (DoD) agencies.
USACE performs environmental restoration work for the Army, DoD, EnvironmentalProtection Agency, Department of Energy and several other agencies.
USACE also provides design and construction management services for non-DoD Federal agencies, state and local governments, and foreign governments.

A majority of the planning, engineering, design and surveying and mapping services forthese programs is acquired by contract with private Architect-Engineer (A-E) firms. USACEis one of the largest Federal buyers of A-E services.
Use of A-E services is beneficial/required when…- The designs include highly specialized disciplines that are not available within USACE- USACE in-house capability cannot design in timeframe required
A-E services required by Federal agencies are procured under the Brooks A-E Act and the procedures in Part 36 of the Federal Acquisition Regulation (FAR).
The Brooks Act requires the public announcement of requirements for A-E services (withsome exceptions provided by other statutes); selection of the most highly qualified firmsbased on demonstrated competence and professional qualifications; and the negotiation ofa fair and reasonable price, starting with the highest qualified firm.
Hence, the selection of A-E contractors is focused on qualifications, and not thelowest price.

Veterans First Contracting Program - the Program, which gives preference to SDVOSBs and VOSBs, was created by 38 U.S.C. 8127 and 8128 and implemented by VA in 2009.
2016 Supreme Court (SCOTUS) Decision • Prior to the decision, VA believed and two lower courts agreed, that
the Program did not apply when placing orders under FAR subpart 8.4, the Federal Supply Schedule (FSS).
• The SCOTUS decision overruled the lower courts and decided that the Program does apply to FSS orders and is mandatory not discretionary.

Rule of Two – The process whereby a contracting officer of the VA, “shall award contracts on the basis of competition restricted to small business concerns owned and controlled by veterans if the contracting officer has a reasonable expectation that two or more small business concerns owned and controlled by veterans will submit offers and that the award can be made at a fair and reasonable price that offers best value to the United States.”
Market Research - Must be conducted to support the Government’s acquisition strategy.

Impact: CFM anticipates that the Rule of Two decision will not have a significant impact on Construction procurements, but there is the potential for a noticeable increase in awards to SDVOSB/VOSBs for A/E and other services.
Certification Requirement: In order to compete for awards under the Veterans First Contracting Program, eligible SDVOSBs/VOSBs must first be verified by the Center for Verification and Evaluation (CVE).

Sole Source Authority for SDVOSB/VOSB
Authority: Public Law 38 USC 8127 and VAAR 819.7007(b) and 7008(b) “Sole source authority for SDVOSB and VOSB”, provide the Contracting Officer (CO) authority to make sole source awards up to $5 million based on his/her own discretion, provided the concern can be determined responsible and the award can be made at a fair and reasonable price.
Restrictions: A restriction for sole source currently exists within an internal Procurement Policy Memorandum (PPM) that is being modified to align with the authorizations found in 38 USC 8127 and the VAAR.

VA USACE Partnership
The Department of Veterans Affairs Expiring Authorities Act of 2015 requires VA to enter into an agreement with a non-Department Federal Entity to provide design and construction management services for all construction projects with a total estimated cost over $100 million (Super Construction Projects).
VA has entered into a agreement with the US Army Corps of Engineers (USACE) for VA CFM Major Construction Program to serve as construction agent for projects over $100 Million.

VHA Non-Recurring Maintenance Program
Overview– Individual infrastructure repair projects typically involving building envelope,
building utility systems, site utility work and roads, medical equipment site prep, or interior renovations.
– Total project costs may be in the $25,000 to $10 million range; pure infrastructure projects (i.e. boiler plants, chiller plants, steam distribution systems, etc.) may exceed that range.
– Projects are developed locally by VHA medical centers in coordination with their respective Network Office (VISN).
– Contract requirements solicited by respective VHA Network Contracting Offices (NCOs).
– Majority of NRM design accomplished via multi-year ID/IQs solicited by NCO.
Funding– Projects are funded locally through the VHA medical center.

annual unserviced rent) leases and complex build-to-suit leases; VHA leasing officials in regional offices procure all other leases
– Build-to-suit vs. Existing Space– Contracting opportunities as lessor; limited due diligence– Large, prospectus-level leases (over $1M in rent) are typically procured
by CFM, and leases under $1M in rent are typically procured by VHA local or regional Contracting Officers.
Funding– Projects are funded through VHA’s operating funds. – Rent obligated annually and paid monthly in arrears.– VA pays a lump sum at construction completion to cover the VA-specific

rent. – VA lessors typically consist of a developer-lessor, who partners with an architect and
a construction contractor to deliver the built-out leased space.– Prospectus-level leases are typically build-to-suit, while smaller leases are typically
leases of existing space.

Public-Private Partnerships
CHIP-IN ACT • The “CHIP IN for Vets Act of 2016” (H.R. 5099) authorizes VA to carry out
a pilot program of five partnership agreements to build new facilitiescombining VA and donor funding.
• The first pilot, the Omaha ACC, will combine $56 million of VA funds with $28 million in donated funds to complete the estimated $84 million project.
• VA will be soon be releasing a Request for Information seeking partners for the four remaining authorized pilots.
Historic Reuse Program• VA has authority to outlease or exchange historic facilities by partnering
with the private sector to develop the properties for reuse in a manner consistent with the VA’s obligation to maintain historic assets.
• VA is conducting a pilot historic reuse project in Sausalito, CA and is exploring additional opportunities nationwide.
