U.S. Public Housing Authority Policies Restricting or Prohibiting Smoking

This list represents communities with smokefree policies for Publicly-Owned Multi-Unit Housing, the majority of which are adopted by a Public Housing Authority (PHA). All PHAs are required by the U.S. Department of Housing and Urban Development (HUD) to have a 100% smokefree policy in place for all public housing properties as of July 31, 2018. While PHAs should now have smokefree policies, only those whose policies ANRF has obtained and analyzed appear on this list. Prior to the adoption of HUD’s mandate, hundreds of PHAs had already adopted a smokefree policy. Learn more about HUD’s smokefree rule. PHA policies cover all or specified public housing properties. Public housing is a category of housing that is owned by the PHA. Smokefree policies may include additional PHA-funded properties, such as mixed-finance and project-based properties. However, PHA policies do not regulate smoking in privately-owned subsidized properties, such as properties accepting Housing Choice Vouchers (Section 8). The table also lists some communities that have adopted laws/resolutions that require other types of affordable housing owned by the municipality to be smokefree. State/Territory Laws and Policies Prohibiting Smoking in Multi-Unit Housing

Delaware: The Delaware State Housing Authority prohibits smoking in all units of all buildings it owns and manages as of 10/1/2013. Hawaii: Hawaii prohibits smoking in all units of all buildings under the jurisdiction of the Hawaii Public Housing Authority as of 6/16/2014. The Hawaii Housing Finance and Development Corporation requires that all new and sold/renovated properties that receive tax credits through their program have a smokefree policy as of 2015. Guam: The Guam Housing and Urban Renewal Authority prohibits smoking in all 750 units of public housing as of July 2018. Maine: MaineHousing, the State Housing Authority, requires that smoking be prohibited in all units of all buildings built and financed by the state’s Low Income Housing Tax Credit program as of 2013. Montana: The Montana Board of Housing requires buildings that receive tax credits through their program have a smokefree policy as of 2016. New Hampshire: The New Hampshire Housing Finance Authority requires buildings that receive tax credits through their program have a smokefree policy as of 2017. North Carolina: The North Carolina Housing Finance Agency requires buildings that receive tax credits through their program have a smokefree policy as of 2015.

Washington: The Washington State Housing Trust Fund requires that affordable housing projects receiving funding must adhere to the Evergreen Sustainable Development Standard, which requires all properties to have a smokefree policy as of 2016.

Definitions and Explanatory Notes:

Publicly-owned housing refers to properties that are owned or operated by a local or state government agency, typically called a Public Housing Authority or Agency (PHA). All public housing authorities are required by the U.S. Department of Housing and Urban Development (HUD) to have a 100% smokefree policy in place for all public housing properties as of July 31, 2018. PHA policies cover all or specified public housing properties. Public housing is a category of housing that is owned by the PHA. Smokefree policies may include additional PHA-funded properties, such as mixed-finance and project-based properties. However, PHA policies do not regulate smoking in privately-owned subsidized properties, such as properties accepting Housing Choice Vouchers (Section 8). The table also lists some communities that have adopted laws/resolutions that require other types of affordable housing owned by the municipality to be smokefree. All Units Currently Smokefree?:

Yes: 100% of units of all specified types of publicly-owned multi-unit buildings are required to be smokefree. Includes existing and future buildings.

Some: 100% of units in some specified types of publicly-owned multi-unit buildings are required to be smokefree. Often, these policies prohibit smoking in all newly occupied buildings or newly leased units, but either do not address smoking in existing buildings or only apply to a certain percent of units in existing buildings.

No: No buildings are required to be 100% be smokefree now or in the future. These laws may prohibit smoking in only a certain percent of units in existing and future buildings, or permit current residents to continue smoking in the building (“grandfathering” clause).

Percent of Units Currently Smokefree:

The percent of specified publicly-owned housing that is currently required to be smokefree:

100%: All units in specified publicly-owned housing must be smokefree.

N/S = Not Specified: The law does not specify the percent of units currently required to be smokefree or the percent of units currently required to be smokefree cannot determined by how the policy is written, such as: applying only to new multi-unit buildings but not to existing multi-unit buildings or designating at certain percentage of units as nonsmoking or limiting smoking to certain buildings or permitting current residents to continue to smoke indefinitely.
