Background:
• On July 8, 2020, Herriman City passed Resolution R28-2020 requesting that UDOT tradeits existing access to a remnant parcel along Mountain View Corridor from 12600 Southfor a new access that aligns with Herriman City’s General Plan for the future “MillerCrossing.”
• According to Herriman City, the trade would advance economic development in the City,and is "in the best interest of the City."
• The proposed trade of one access for another would ensure UDOT’s remainder property isnot diminished in value.
• The new access to be provided to UDOT would align with the Herriman City GeneralPlan, furthering connectivity and circulation in and around the 12600 South intersectionwith Mountain View Corridor.
• The new access to be provided to UDOT would help fulfill UDOT’s commitment in its2010 Cooperative Agreement to provide future City streets with access to Mountain ViewCorridor at designated locations in Herriman City.

HERRIMAN, UTAH RESOLUTION NO. R28-2020
A RESOLUTION OF THE CITY COUNCIL OF HERRIMAN DECLARING THE
ACQUISITION OF CERTAIN REAL PROPERTY TO BE IN THE BEST INTEREST OF THE CITY
WHEREAS, the Herriman City Council (“Council”) met in regular meeting on July 8, 2020 to discuss, among other things, the purchase or exchange of certain real property located in Herriman City (the “City”); and WHEREAS, the Utah Department of Transportation (“UDOT”) is the current owner of that certain real property at issue (the “UDOT Property”) as shown in yellow in the attached Exhibit A; and
WHEREAS, the UDOT Property provides access to other real property owned by UDOT and abuts other real property currently owned by the City (the “Surrounding Property”) as more accurately depicted in the attached Exhibit A; and WHEREAS, the City is interested in acquiring the UDOT Property in order to advance economic development within the City and, more particularly, on the Surrounding Property; and WHEREAS, in exchange for the UDOT Property, the City is willing to grant UDOT an access easement (the “Proposed Easement”) to the other property owned by UDOT which Proposed Easement is depicted in cyan in the attached Exhibit A; and WHEREAS, the Proposed Easement (Exhibit D) access off of Herriman Main Street provides UDOT with a more direct and efficient acces to UDOT’s other property identified in Exhibit A and better conforms with Herriman’s adopted engineering standards; and WHEREAS, Herriman’s general plan includes the construction of a 80’ wide collector road to be constructed at Herriman’s cost to run from Herriman Main Street to Mountain View Corridor, the right-in / right-out point of which has been pre-approved by UDOT, and which road would roughly follow the layout depicted in cyan on Ehxibit A and is depicted in the site plan on Exhibit C; and WHEREAS, the acquisition of the UDOT Property, and the planned uses thereof, would further the current and planned transportation infrastructure surrounding Mountain View Corridor including access to arterial and other roads throughout the City; and WHEREAS, the Surrounding Property is currently zoned Auto Mall Special District (“AMSD”), as shown in the attached Exhibit B, which is designed to concentrate new and used automobile sales, and related products and services, within a master-planned commercial development, as shown in the attached Exhibit C; and
