    Next Phase of Vacant Building

    Initiative

    The City Attorneys Office has identified the next

    six buildings for the second phase of its Vacant

    Building Code enforcement initiative .

    Each of the six buildings identified is locatedwithin the Central Business District.

    During the first phase of the clean-up,

    which began in early Fall 2008, Code

    and Fire department inspectorsidentified seven unoccupied

    properties with the most significant

    violations.

    City Elicits Voluntary Compliance

    Through the efforts of the City

    Attorneys Office, five of the

    initial seven buildings were

    brought into compliance

    without litigation.

    1604 Main Street

    Owner refused to entered RepairAgreement. Property sold to anotherentity who completed repairs to bringproperty into voluntary complianceOctober 2009.

    1902 Commerce Street

    Property is in substantial compliance.

    Owner is progressing under terms ofRepair Agreement.

    1954 Commerce Street

    Property is in substantial compliance.Owner is progressing under terms ofRepair Agreement.

    211 Ervay Street

    Owners have made repairs to bringproperty up to Code. Awaiting finalinspection and release from Firedepartment.

    1712 Commerce Street

    Owner entered Repair Agreement withthe COD. Awaiting final inspection andrelease from Fire department.

    1607 Main Street

    Owner refused to enter into Repair

    Agreement. CAO filed suit July 2009.

    Parties entered into an Agreed Temporary

    Injunction. Property sold to another entity

    who completed repairs. Trial set for March

    2010 .

    508 Park

    CAO filed suit on July 1, 2009. Owner has

    secured the property, abated asbestos and

    removed debris and fire hazards from the

    property. There are many violations

    outstanding and the remaining repairs will

    be costly. Property is located in a historicdistrict and owner is not likely to get

    authority to demolish the building. The

    Citys Economic Development department

    has been working with third parties to

    develop the entire City block at this

    location. Final trial scheduled for June

    2010.
