!On behalf of the Board and staff of the Vermont School Boards Insurance Trust (VSBIT), I am pleased to present our Annual Report for the year ended June 30, 2017.

One of the joys of preparing an annual report is that it gives us an opportunity to look back and highlight the many accomplishments and successes we have had over the past year. This report is a true testament to the exceptional work that VSBIT is doing on behalf of the School Districts in the State of Vermont. Thank you for taking the time to review our Annual Report.

VSBIT is self-funded and receives no tax or other support of any kind. I hope you will agree that VSBIT is providing outstanding and timely services to its members. We are not resting on our laurels, but we are planning to work hard for our members in 2018 and beyond.

I would like to acknowledge the other members of the VSBIT Board of Directors for their contribution to carrying out VSBIT’s mission and to the VSBIT staff for their hard work and dedication.

President’s Message

VSBIT is a non-profit cooperative pool that provides an alternative to traditional insurance in a variety of areas for member school districts. We are focused on proactively managing risk, saving Vermont schools time and money so they can focus on educating Vermont students.

VSBIT’s Unemployment and Multi-Line membership programs are the primary means VSBIT provides services to member school districts.

VSBIT’s Multi-Line program continues to expand its loss control activities and provide a high level of service in the adjusting of claims that occur. See page 10 for more information.

VSBIT Unemployment program is outlined on page 9. VSBIT staff provide periodic trainings to support school staff in effectively managing unemployment claims and hearings.

VSBIT also provides general risk management support through our School Management Resource Center (SMRC). The SMRC provides workshops and trainings through VSBIT U and the Risk Management Series for school leaders, see pages 12 & 13.

In addition, the SMRC collaborates with the AOE and VSBA in the development and updating of a Harassment, Hazing and Bullying Toolkit; with the VSBA in the development of required and recommended school policies; and with the VSBA and VSA to assist schools in navigating through the implementation of Act 46 by providing support and resources. VSBIT has a keen interest in strong educational systems that are well-positioned to proactively manage the various risks facing Vermont schools. To this end, the Act 46 Collaborative Project is supporting merging districts in achieving the goals set forth in the Act: increased educational opportunities for students, increased operational efficiencies and savings for taxpayers.

SECURITY INSPECTIONSOur security consultant will come to your school and identify potential security risks and hazards that face your school and provide recommendations to make your school a safer place for all.

PLAYGROUND INSPECTIONSOne of our certified playground safety inspectors will visit your playground and provide a report with safety recom-mendations and findings.

GYM/FITNESS ROOM INSPECTIONWe will come to your school and identify potential hazards in your gym/fitness room. In addition to discussing best practices we will also provide guidance on proper equip-ment selection, layout, and maintenance.

EMPLOYEE SAFETY TRAININGS WORKERS COMPENSATIONWORKERS’ COMP 101A “basic training” for principals & administrators.

LIFTING/BACK SAFETYThis is an interactive session with a physical therapist that teach-es appropriate lifting techniques and body mechanics.

ERGONOMIC ASSESSMENTSThis is an interactive session with an ergonomic specialist that discusses proper body mechanics and culminates with individual work station evaluations.

DE-ESCALATIONGeared towards paraprofessionals, this session is lead by a school psychologist and assists staff in recognizing escalating behaviors in students and the appropriate techniques to avoid restraint situations.

FOOD SERVICEA training for kitchen staff to avoid injuries due to slips, trips, & falls, cuts, burns, and lifting.

EMPLOYMENT PRACTICES TRAININGS DO'S & DON'TS OF EMPLOYMENT INVESTIGATIONSVSBIT legal counsel discusses when an investigation should occur and by whom. The materials identify what rules govern the investigator, witnesses, complainants, and the accused. Strategies for obtaining reliable information to support and doc-ument any decisions made and how the evidence will be used in the context of litigation and/or arbitration will be discussed.

WRONGFUL TERMINATIONVSBIT legal counsel provides guidance to administrators on proper techniques and documentation during this process.

HARASSMENT & BULLYINGVSBIT legal counsel provides guidance to administrators on the reporting guidelines and proper procedures for handling these types of issues.

FMLAOur HR consultant reviews the Federal FMLA and State of Ver-mont Parental and Family Leave Act and how they work in conjunction with Workers' Compensation, Collective Bargain-ing Agreements, and other leave provisions.

The School Management Resource Center was established in 1998 to further VSBIT’s non-profit mission to support Vermont public schools regardless of membership in a VSBIT program. We continue to explore areas where our assistance can make a meaningful difference.

SMRC continues to focus on supporting VT schools in the areas of Facility Operations and Human Resources doing so now with the support of VSBIT’s Multi-Line Program staff.

How is SMRC helping VT schools?

Policy Support:

We work with the Vermont School Boards Association through VEPS [Vermont Education Policy Service] to provide schools model policies to meet legal requirements.

Facility Operations:

We assist schools in the area of facility operations. Staff are available to provide resources, or on-site inspections, with assistance being geared towards helping Vermont schools efficiently manage and address issues that arise. This can be especially helpful for schools that do not have their own facility directors.

VSBIT U:

VSBIT U was founded with the express purpose of offering training specifically designed for school leaders. Each session is designed to assist schools with identifying potential issues early on so they can be addressed appropriately, thereby saving your school valuable time and money and allowing you to focus on your educational mission. Additional information can be found in the VSBIT U section of this report.

Development of a Risk Management Series:

This four-day program, offered in FY 16 and FY 17, is designed for superintendents and their administrative teams.

The program's design includes an in-depth review and analysis of Vermont legal cases by participants, problem solving, legal and regulatory frameworks associated with these topics, administrative support and accountability, as well as the review of policy implications.

The intent behind the program is to provide increased leader education in the prevention, and proper processing, of risk management issues. As you are well aware, these issues can be time consuming and costly relative to finances, individual and institutional credibility, school and community culture, and focus on student learning.

Statewide Initiatives:

VSBIT collaborated with the Agency of Education and the Vermont School Boards Association to update and combine the required hazing, harassment and bullying policies. This work resulted in a revised AOE policy and associated procedures. VSBIT then developed a comprehensive toolkit, available on its website, to guide schools on how to comply with allegations of hazing, harassment and bullying. This tool kit was updated this past year and will continue to be revised as needed.

VSBIT, VSA and VSBA formed the Act 46 Collaborative to provide school district board members and personnel with access to comprehensive, well-coordinated and well-delivered information, resources and expertise useful in their efforts to respond to the opportunities and requirements laid out in Act 46. A Project Coordinator was hired to provide this service, in collaboration with the AOE.

Over the past year, the Collaborative has engaged with the District Management Group to provide professional development opportunities and coaching to merging districts. This work is designed to assist the new districts in meeting the goals of Act 46: increasing educational opportunities for students, increasing operational efficiencies, and reducing the pressure on taxpayers.

Unemployment Program Summary

The VSBIT Unemployment Program began as the initial program of the Trust in 1978 with 61 districts participating and has since grown to 200 members in 2016-2017.

In 2016-2017 1,082 claims were filed as compared to 1,425 in the previous year. Actual dollars paid decreased by 11.6%. Of the 1,082 claims filed, 656 were “chargeable regardless of separation”* and 446 were due to “lack of work”. Of the 1,082 claims filed, 46% were protested. Of these protested claims, 89% received favorable decisions for the school districts resulting in a total of $1,066,180 being removed from potential claims liability.

VSBIT did not change its rate structure in 2016-2017. Rates range from .10%-1.92% plus a high risk adjustment factor for those districts that had paid claims in excess of $1,000 above their contribution over a three year period. VSBIT rates continue to compare favorably to the State rates, which range from 1% - 8.4%. VSBIT continues to apply its rates to the first $8,000 in wages per employee while the State now taxes the first $17,300.

*In these instances, the school district was not the separating employer, but the employee had worked for thedistrict during the base period (the previous five quarters), therefore the school is partially responsible for paying the claim.

With the addition of Rutland City and St. Johnsbury, the Multi-Line Program has grown to encompass 52 of Vermont’s supervisory unions and stand-alone school districts as of June 30, 2017. The sole function of this member owned, non-profit program is to serve the needs of Vermont schools while providing long term stability and affordability. You can't get more local than the Multi-Line Program. We know Vermont schools!

Operations We acknowledge Don Morrill and his years of service in making the Multi-Line Program what it is today. Transitioning from his role as Manager of Risk Service, Tim Vincent was appointed the Program Manager in April 2017. To better serve our membership, an underwriting coordinator as well as two claims adjusters and a claims assistant were added to the Multi-Line staff.

Risk Management Our risk management team was extremely busy visiting schools this year. There were 163 visits to schools with the most popular offerings being Playground Inspections (64), Security Audits (37), and Building Safety Audits (34).

Focusing on workers compensation claims, the risk management team, along with our underwriting coordinator, developed targeted risk management reports outlining specific causes of loss for each member location. Meetings were then set up with members to formulate plans of action to reduce these losses.

Member Services

�Grant Programs - 74 grants were awarded totaling $361,091! ! Safety Assistance $7,500 (additional $2,500 if a result of audits/inspections)

Human Resources $2,500 Legal Consultation $2,500 School Risk Management Scholarship $1,000! !

�Inspections - 163 inspections to help make your schools safer and more secure! We performed Building Safety Audits, School Security Audits, Playground Inspections, Ergonomic Evaluations, and Gym/Fitness Room Inspections.

�Trainings - 40 on-site trainings occurred at member locations this year! The Employment Related Practices and Hazing, Harassment & Bullying trainings offered by VSBIT legal counsel continued to be our most popular on-site trainings. We also provided a number of Workers Compensation 101 trainings to member admin teams.

�HR Help - 118 HR issues addressed by VSBIT’s legal counsel and/or HR Consultant! This is almost a 100% increase from the 63 issues we addressed in FY16.

For FY17, VSBIT U continued to provide series of core classes specifically designed with school administrators and management in mind. The goal of each VSBIT U session is to help schools identify potential issues early so they can be addressed appropriately, saving the school valuable time and money thus allowing it to focus on its educational mission.

There were 13 course offerings this year with 439 individuals who attended the courses in all. Human Resources remained a staple of the core curriculum with our two-part HR Tune Up, ADA/FMLA Deep Dive, and Employee Leave sessions having strong attendance. Added to the VSBIT curriculum this year were offerings regarding Hazing Harassment & Bullying, Unemployment, as well as certificate programs for both Workers’ Compensation & Occupational Health and Safety.

Hazing, Harassment & Bullying for Designees

These sessions provided an overview of the Vermont Agency of Education Model Procedures and Policies for the Prevention of Harassment, Hazing and Bullying. The content is an in depth treatment of both the policy definitions, the process for responding to information of potential HHB violations and investigations to determine policy violations. This training was designed to provide a comprehensive overview of the definitions and process for administrators, designees and/or investigators responding to notice of policy violations in cases of inappropriate student conduct.

Unemployment: Best Practices, Hearings and Regulatory

This course taught participants how to prepare and present a winning case before the VT Department of Labor as well as providing a detailed overview of the unemployment process. Participants also learned about Equifax’s role in unemployment claims and services available to members.

Certificate Programs

Workers Compensation Certificate Program- This two day course provided attendees with information and best practices in regards to the prevention of workplace injuries, initial reporting and investigations, as well as the school’s role in each stage of the claim’s process.

Occupational Health & Safety 10 Hour Training Certification- This three day course provided participants with the ability to identify, abate and prevent job related hazards. It also taught attendees about employer responsibilities and workers’ rights.
