Preface

In 2011, the ADB-financed Project Preparatory Technical Assistance (PPTA) consultants assisted the Northern Power Project Management Board (NPPMB) to prepare Resettlement Plans (RPs) for the following two subprojects based on feasibility studies for 500kV/220kV Bac Ninh 2 – Pho Noi Transmission line and 500kV Pho Noi Substation, which were both approved by ADB.

The PPTA consultants also prepared a Resettlement Policy Framework to guide in the implementation.

The loan agreement of the Power transmission Investment Program - Loan No. 2848 has been signed on 10th February 2012. NPPMB will implement 2 subprojects are:

- 500kV Pho Noi Substation

- 500kV/220kV Bac Ninh 2 – Pho Noi transmission line

To assist in achieving social safeguard compliance, NPPMB proposes to engage one local social consultant, part-time working with 16 person-months, starting from September, 2013. Based on the Consultant’s contract, I’m responsible for 02 subprojects, including: 500kV/220kV Bac Ninh 2 – Pho Noi Transmission line and 500kV Pho Noi Substation.

The Inception Report is based on the Consultancy Services Contract for LIC- social signed in September, 2013 between Northern Power Project Management Board (NPPMB) and Mr. Nguyen Manh Truong for Northern Transmission Line project. Project is funded by ADB (Credit No.2848-VIE).

Main contents of the Inception Report are:

1. Summary status of the subprojects related to compensation activities;

2. Propose the detailed implementation plan of assignments including the personnel arrangement and construction schedule preparation;

To develop the report, the Consultant has worked with the NPPMB to understand shortcomings as well as the project implementation, conducted site surveys in project provinces of Hung Yen and Bac Ninh.

The Inception Report, after being approved, will provide guidelines and play as a basic framework for the implementation of LIC Contract.

PART I. OVERVIEW

A. Overview

1. This Inception report presents assignment, content and work-plan of resettlement expert for Northern Transmission Line Project - Credit No. 2848 - VIE, funded by ADB. This work-plan is prepared based on TOR provided by NPPMB to implement consultant activities and this is one of regular reports during 16 months.

2. The objective of inception report aims to outline the work-plan during stage 2 and outputs. The methodology is in accordance with resettlement policy framework (RPF) approved by ADB and Government of Vietnam. This inception report will be used by Consultant, ADB, NPPMB.

B. Description of the Subprojects in first tranche

3. There are 4 Subprojects included in the tranche 1 of the Multi tranche Financing Facility: Power Transmission Investment Program (the Facility) that finances part of the National Power Transmission Corporation’s (NPT) medium-term power transmission expansion program in Viet Nam. The first tranche will finance 4 subprojects: (i) 500KV/220 kV Pho Noi substation; (ii) 500 kV/220 kV Pho Noi – Bac Ninh 2 transmission line; (iii) 220 kV Phu My 2 substation; (iv) 220 kV Song May – Uyen Hung transmission line. Of which, the Northern Power Project Management Board (NPPMB) of two subprojects of 500KV/220 kV Pho Noi substation; (ii) 500 kV/220 kV Pho Noi – Bac Ninh 2 transmission line.

4. The Subprojects will also finance non-physical actions including (i) consulting services for (a) procurement, construction supervision and management, and implementation of social safeguards, (b) on the job-training for preparing and implementing resettlement and ethnic minority development plans, environmental impact assessment and management plans for subsequent financing tranches, (ii) an independent monitoring agency to monitor effective implementation of social safeguards, and (iii) an independent monitoring consultant as a third-party member for the review of draft bidding documents and to participate in the evaluation of bids and thus, guarantee that affiliation of an eligible bidder with Ministry of Industry and Trade (MOIT) / Viet Nam Electricity (EVN) will not affect the integrity and fairness of the competitive bidding process.

C. Assignments of Consultant

5. To assist in achieving social safeguard compliance NPPMB proposes to engage one local social implementation consultant for 02 subprojects, part-time working for 16 person-months, starting from September, 2013.

6. According to TOR, detailed duties of the local social implementation consultant include the followings:

The provide guidance to the NPPMB on the documents which need to be prepared following ADB’s requirements.

Carry-out awareness rising and capacity building to the NPPMB and local planning and implementation agencies on ADB’s social safeguard requirements and procedures in general, on the 2848 VIE social policy frameworks in particular and some new subprojects.

Update RPs and submit to ADB for approval.

Provide guidance and supervise the local planning and implementing agencies on implementation of social safeguard issues following the ADB’s policy and the project policy frameworks.

Review documents to confirm with the NPPMB required standard of report prepared by consultants.

Prepare and implement are the corrective action plans following the due diligence reports, monitoring reports, mission findings and others.

Advise NPPMB when social impacts happening by contractor are not being effectively managed.

Provide a coordinated approach to social impact management for the projects.

Supervise the implementation of project social safeguard policies of local planning and implementation agencies in general, of corrective action plans of NPPMB in particular.

Prepare the progress reports and supervision reports to submit quarterly to the NPPMB and to ADB.

D. Implementation Duration

7. The work is expected to start from September, 2013 with a 16-month period.

PART II. APPROACH & METHODOLOGY

A. Approach

8. The Consultant will assist the PMU to monitor, and manage the implementation of the RAP for sub-projects phase 1, including: preparation of Due Diligence Report, updated RP; preparation detail measurement survey (DMS) and prepare reports for the implementation of safeguard policy to comply with ADB policies.

B. Information Collection Method

a) The Consultant will combine both qualitative and quantitative methods.

b) The instrument of quantitative method is the questionnaires (as attached).

The instrument of qualitative method is the questionnaires for APs to check the implementation of RAP and find out arising issues related to the implementation of safeguard (if any)

Organize community consultation meeting, group discussion and in-depth interview.

Tables and charts of secondary information on social economy, affected households, land area and affected properties (refer to the attached tables) and the minutes of consultation meeting.

c) Information and database supply resources:

9. The main sources of information must be assessable in the field trip as follows:

NPPMB.

Project affected Persons (PAPs)

District compensation and resettlement committee, Communes/ wards

Design consultants in the sub-project provinces

10. Besides the four above-mentioned sources of information, LIC may add information when participating in the community meetings, the meetings to discuss the implementation RAP and measures to restore living standard, or through the investigation of affected households at site.

d) Information Collection Method:

11. Collection and analysis of secondary documents:

At the Consultant’s office:

(i) Study documents relating to the project compensation and site clearance such as the ADB Safeguard Policy Statement (SPS 2009) was approved by the ADB Board of Directors on 20 July 2009 and became effective on January 2010; Land Law 2003, Decree No.197, guiding the compensation and site

clearance, Decree No.181, and Decree No.188, etc.

(ii) Study the socio-economic situation updated in the project areas to determine the households’ livelihoods in an effort to support the preparation of survey questionnaires and the establishment of living restoration measures for households

(iii) Study other relevant documents.

At NPPMB office:

(i) Review documents provided by the NPPMB

(ii) Research and discuss measures to restore people’s living standard and identify appropriate measures.

Collection of quantitative information is based on the available questionnaires (Survey Questionnaire):

(i) Information is collected based on the designed questionnaires. These questionnaires are designed suitably with the information collection methods in each project district and commune.

Focus Group Discussion, in-depth Interview: including guidelines for group discussion and in-depth interview

12. The method of Focus Group Discussion will be applied to add more quantitative information. The main contents of the group discussions/ in-depth interviews are:

a) Awareness of the community on the compensation and site clearance; Identify the livelihood of the community;

b) Obstacles and difficulties in the resettlement (if any);

c) Evaluate the involvement of local authorities and communities in the RAP preparation and implementation.

d) People’s expectations on resettlement as well as establishing and recommending measures to restore their lives.

e) Objects of survey and consultation.

13. Participants of the group discussions comprise local authorities, households living in the project areas, especially paying attention to displaced households, severely affected cases, vulnerable groups (women, elder and families deserving for the revolution etc.).

14. Expectedly, the community consultancies and group discussions will be conducted in commune scale of each subproject; each commune will have about 20-30 households participated (depending on the number of affected or benefited households of each project area). The public consultancy meetings will be organized to check the accuracy and suitability of the implementation of compensation activities; find out arising issues (if any) and propose timely solution for them

15. Observation method:

Apart from the mentioned methods of information collection, the Consultant will apply

direct observation method at site for socio-economic issues of APs and communities

and types of housing in the project locations, levels and scope of influence,

observation of locations where the subprojects are implemented to preliminarily

assess such issues regarding vulnerable groups as worships, supernatural power

places, tombs, historical relics, national parks, conservation areas (if any), etc.

16. Data analyzing and reporting:

a) Data analyzing: The collected data and information will be analyzed according to each subproject, affected area, resettlement area, impact level, effect duration and kinds of impact.

b) Database saving: The Consultant will save the information in such a way that it can be updated and compared regularly. The instrument for analyzing and processing data will be the software SPSS for Window, Excel...

PART 3. IMPLEMENTED ACTIVTIES

17. According to the Schedule defined in the TOR, the activities of LIC are expected to start in September, 2013 in part-time manner during 16 working months. It can be seeable that the subprojects are not built and deployed at the same time but along the length of time. Therefore, the activity plan described below is defined as a sample model and plan for each subproject. Here are the sequential steps of works that LIC expects to deploy the above activities:

A. Document Study and Review

In technical proposal describes the fundamentals of the work as stated in the Terms

of Reference. It is based on the proposed approach and methodology to create a

detailed and completed plan. After the consultancy contract is signed, LIC will direct

exchange and discuss with the NPPMB to better understand the work requirements

and contents to add and modify our plans (if necessary). The documents provided by

the NPPMB as mentioned in detail in the Terms of Reference are also important

materials for our planning.

After having information fully updated and programs agreed with the NPPMB, LIC

will proceed to collect the relevant documents and study the design proposals of

each subproject to propose/build a corrective plan of (i) land acquisition and

resettlement, (ii) impacts on ethnic minority groups (if any), gender and impacts on

vulnerable groups (if any). The study will be based on the following approaches:

Directly review and study the FS to minimize impacts and/or develop mitigation measures (if they affect the land acquisition and resettlement, environment and the ethnic minority groups etc.).

Work closely with the resettlement specialists, Consultants to exchange ideas and make unification comments.

Develop a site survey programs to check the authenticity and relevance of the preliminary assessments of the impacts on land acquisition, environment and ethnic minority groups, which have been provided in due diligence, RP reports.

18. Preparation of Inception Report: After signing the contract, LIC will start the inception report and submit to the NPPMB an official plan by the end of October, 2013. The contents of this report will include the approach and methodology of LIC for assignment implementation; implemented activities of LIC in September, 2013, next steps of LIC for 2nd Quarterly report.

19. Besides, LIC syntheses and updates the profile of compensation and resettlement activities for subprojects and provides this data for NPPMB, so that NPPMB prepares a 1st quarterly report and submit to ADB.

B. Survey at field

20. In addition to activities at office, The consultant will carry out activities at field to survey socio-economic (SES), information propagation and dissemination, community consultation and other activities etc. to serve collecting information and propose to prepare of updated RP or DDR based on actual implementation of compensation.

21. The following specific tasks of The consultant includes: :

Assignment 1: Support institution and capacity building

In first stage, the Consultant supports NPPMB to develop an organization responsible for implementation land acquisition and site clearance for project;

Develop a training program on capacity building for NPPMB staff and requirement for safeguard policy mentioned in RP and EMDP of sub-projects, in particular and ADB’s requirements in general.

Assignment 2: Support to organize community consultation and information

disclosure

The Consultant will prepare templates, including contents, work-plan and methodology for Community consultation and information disclosure.

Coordinate with NPPMB, carry out community consultation and information disclosure on requirements and others requirements mentioned in RP/EMDP in accordance with ADB’s policies.

Assignment 3: Support to prepare DMS and make compensation, allowance and

resettlement documents

Support NPPMB to develop a template on DMS and survey methodology;

The Consultant will carry out coordination with CARBs to ensure the implementation of RP and EMDP timely. Ensure to monitor and manage the implementation of RP and EMDP of subprojects, including technical and implementation guidance for DMS implementation and preparation of compensation option with close consultation of ADB’s social specialists.

Assignment 4: General coordination

Support NPPMB to develop internal monitoring samples, develop quarterly internal monitoring reports, semi-annual and yearly reports;

Propose and develop an independent grievance committee, at the same time, he/she is a member of the committee. At the starting stage, coordinate with stakeholders to develop a operation regulation of grievance committee and submit to stakeholders for appraisal and approval;

The Consultant assists NPPPMB in the implementation of all resettlement activities and supervises external monitoring agency’s activities. Support NPPMB and CARBs to monitor quality of external monitoring agency for

resettlement and manage consultant contract related to the progress rate of project, the quality, the volume and the report testing.

22. Besides, the national safeguard specialists assist NPPMB and CARBs to control social safeguard policies to ensure effectively relevant activities and mitigate potential impacts on local people and maximum potential benefits (if any)

C. Prepare outputs

23. After monthly work plan is approved by the competent authorities, the last step of the LIC is the preparation of quarterly reports to update the progress rate of project implementation (including the progress rate of compensation activities, shortcoming, satisfaction of DPs, infrastructure condition of resettlement sites), provide support and find out solutions for shortcomings (if any).

Results of current status survey reports:

I. 500KV/220 kV Pho Noi substation Sub-project:

24. During the preparation of the project, PPTA consultant compiled a resettlement report for 500KV/220 kV Pho Noi substation subproject. Summary data of the RP is shown below:

Introduction

The 500 kV Pho Noi substation and connections is one of projects that Northern Power Project Management Board (NPPMB) is requesting for financing within the ADB Guarantee Project. The project area is located mainly in Van Lam district, Hung Yen province (whole substation) and partial area is located in two provinces of Hai Duong and Bac Ninh (connections).

Scope of Land Acquisition and Resettlement:

The project will cause impacts as follows:

- Permanent land acquisition for substation, access road and tower foundations.

- Relocation of houses, structures.

- Cutting trees, crops.

- Limitation to land use and other houses/structures in ROW.

- Other cutting of trees, crops in temporary acquired land during construction phase.

The IOL carried out in Jan. 2010 and July 2011 identified 528 affected and has estimated that about 361,066 m2 of land will be acquired for the project, in which: 200,653 m2 (324 AHs) of land be permanently acquired for substation, access road, tower foundations and 160,413 m2 (202 AHs) of land be temporarily acquired for ROW. Productive land, such as rice paddies, fish pond, vegetable gardens, orchards, accounts for 89,04% (approx 321,491 m2) of all affected lands. Non-

productive land, such as residential land and other land (irrigation land), accounts for 10,96% or about 39,575 m2 of land.

A total of 526 households and 02 institutions (Viet Hung and Luong Tai Commune People's Committees) are impacted by project due to land acquisition, in which, the number of households impacted by substation is 314 and number of households impacted by ROW is 214. Among those impacted in ROW, there are 6 households impacted with structures and houses. Types of houses and structures in ROW is houses grade 4, houses grade 3. In addition, trees with commercial value will also be affected (about 105 fruit trees by the project). The IOL also identified that there are 37,720m2 of transportation and irrigation land to be affected by the implementation of the project.

The IOL also identified that there is no ethnic minority group affected by the implementation of the project.

25. Regarding the compensation, site clearance, the Compensation Division of NPPMB will be responsible for carrying out the compensation, assistance and resettlement for the subproject. Presently, the measurement and inventory have not been implemented since Hung Yen Provincial People’s Committee has not made any land acquisition decision.

26. It is estimated that Hung Yen Provincial People’s Committee will make decision on land acquisition for the project in December 2013. In January 2014, the Compensation Division will complete the inventory and the compensation payment to affected households will be made in 1st Quarter of 2014.

27. Similar to the above-mentioned subproject, regarding 500 kV/220 kV Pho Noi – Bac Ninh 2 transmission line Sub-project, the RP report was prepared by PPTA consultant with the summary data shown below:

II. 500 kV/220 kV Pho Noi – Bac Ninh 2 transmission line Sub-project

Introduction

The Bac Ninh 2 - Pho Noi 500/220kV transmission line is one of projects that National Power Transmission Corporation (NPT) and Northern Power Project Management Board (NPPMB) is requesting for financing from the ADB.

The Bac Ninh 2 - Pho Noi 500/220kV transmission line is built with following specifications:

- Voltage level: 500/220kV

- Starting point: the proposed Pho Noi 500kV substation

- Ending point: the proposed Bac Ninh No.2 500kV/220kV substation

- Total length of the line: 30km.

Location: the line goes through 12 communes of 5 districts in two provinces (Tien Du, Que Vo, Gia Binh, Thuan Thanh districts of Bac Ninh province and Van Lam district of Hung Yen province).

Scope of land acquisition and resettlement:

With the characteristics of the 500/220kV transmission line, the project will cause impacts as follows:

- Permanent land acquisition for tower foundations.

- Moving houses, structures in permanent required land (if any).

- Cutting trees, crops in permanent required land.

- Restricting usability of land/houses/structures in ROW for safety of the line.

- Cutting trees, crops in temporary required land for construction activities.

The identification of affected persons (APs) and inventory of losses (IOL) carried out in Jan. 2010 and July 2011, had identified a total of 1,417 households (approximately 6,023 persons) belong to 12 communes and 01 organization that may be affected by the implementation of the project.

About 40,745 m2 land will be acquired for tower foundations of the project, in which 39,587m2 land belongs to 374 AHs and 1,158m2 land belongs to 01 affected institution. All are production land such as paddy field, crop land, and aquaculture land.

About 1,080,847 m2 land will be acquired for ROW, in which 1,047,285m2 land of 1,417 AHs and 33,562m2 of 01 affected institution. Productive land, such as paddy field, crop land, and aquaculture land, accounts for 99.96 % (1,080,367 m2) of all affected lands. Non-productive land, such as residential land accounts for 0.04% (480 m2).

There are 02 households with houses in ROW. Both of houses are in grade 4 (2 units, 64m2).

In addition, crops and trees with commercial value will also be affected 1,113,706 m2 annual crops and 13,208 timber trees and 1,351 fruit-bearing trees by the project.

The IOL also identified that there is no any public facilities and ethnic minority group affected by the implementation of the project.

There are 20 severely AHs and 572 vulnerable AHs, including 120 poor AHs, 132

Female-headed households and 300 elderly AHs that need special attention for the

specific needs.

28. Regarding 500 kV/220 kV Pho Noi – Bac Ninh 2 transmission line Sub-project, the Compensation Division of NPPMB will carry out the compensation and site clearance. Presently, this firm is carrying out the measurement and inventory for preparing the compensation, assistance and resettlement document in Bac Ninh province. Namely, the inventory for 86 of 92 pole foundations has been completed, of which 73 pole foundations have been provided with the compensation options.

29. Presently, the Compensation Division of NPPMB is carrying out procedures for Bac Ninh Provincial People’s Committee to approve the land acquisition decision. Whereas Hung Yen province has not yet carried out the inventory.

30. On the basis of the RP prepared in the project preparation and TOR, LIC-social will compile updated RP reports based on data of DMS and submit to ADB during the duration of assignment implementation. Updated RP report template is shown in Annex 1

31. The consultants will work on a part-time basis in NPPMB’s offices to ensure appropriate safeguard compliance and coordination. Following table is general work plan.
