CONSTITUTIONAL RULES

1 Name1.1. The name of the Association shall be the Liverpool and District Swimming

and Water Polo Association hereinafter called the Association.

2. Definition2.1. The Liverpool and District Swimming and Water Polo Association area shall

be:-2.1.1. The geographical area of a radius of twenty miles from Liverpool

Town Hall.2.1.2. The Crown Dependency of the Isle of Man.2.1.3. Clubs in North Wales who are affiliated to the Welsh Amateur

Swimming Association and have received dispensation from that Association and from the Amateur Swimming Association North West Region to compete in the Region.

3. Aims3.1. The Aims of the Association shall be to:-

3.1.1. Carry out the aims and objectives of the Amateur Swimming Association, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association falling within the jurisdiction of the Association.

3.1.2. Obey and enforce the laws, rules, regulations and rulings of the Amateur Swimming Association, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association within its jurisdiction.

3.1.3. Manage the sport of swimming throughout the Association.3.1.4. Promote and encourage the knowledge and the practice of the

disciplines of Swimming, Diving, Synchronised Swimming and Water Polo by means of championships and competitions.

3.1.5. Develop the sport of swimming in each aquatic discipline in all ways possible.

3.1.6. Produce and implement policies to carry out other activities relevant to the Association.

3.1.7. Raise public awareness of the sport and stimulate public opinion in favour of providing suitable accommodation and facilities.

4. Objectives4.1. In the furtherance of the aims of the Association the following objectives

shall be undertaken:-4.1.1. The Association is committed to treat everyone equally within the

context of their activity, regardless of age, sex, ethnic origin, religion or political persuasion.

4.1.2. The Association shall implement the Amateur Swimming Association Equal Opportunities policy.

4.1.3. All persons, clubs, associations, organisations and leagues affiliated to the Association shall consent to be bound whilst engaged in any Association activity by the Amateur Swimming Association Code of Ethics, the Amateur Swimming Association Laws and Regulations relating to Child Safeguarding and those parts of the Amateur Swimming Association Judicial Laws, Regulations and procedures necessary for their implementation.

4.1.4. All persons, clubs, associations, organisations and leagues affiliated to the Association whilst engaged in activities under the jurisdiction of the Association shall be subject to all the constraints and privileges of the Amateur Swimming Association Judicial Laws and Regulations.

4.2. The business affairs of the Association shall at all times be conducted in accordance with the Laws and Regulations of the Amateur Swimming Association the Judicial Laws and Regulations and the Technical Rules of the Amateur Swimming Association and in particular:-4.2.1. All members of the Association shall be members of a club, body,

organisation, association or league affiliated to the Association.4.2.2. All competing members shall be members of the club or other

organisation they represent 4.2.3. All competing members shall be eligible competitors as defined in

the Amateur Swimming Association Laws and Regulations.4.2.4. All competitors shall comply with the Championship conditions of

the Association and the Amateur Swimming Association.

4.3. To promote and develop the aquatic disciplines of Diving, Swimming, Synchronised Swimming and Water Polo through the implementation of:-4.3.1. An Association Development Plan.4.3.2. Partnership agreements with appropriate bodies, organisations, and

external agencies.

4.4. By virtue of the affiliation of the Association to the Amateur Swimming Association North West Region all members of the Association shall acknowledge that they are subject to the laws, rules, regulations and constitutions of:-4.4.1. The Lancashire County Water Polo and Swimming Association.4.4.2. The Amateur Swimming Association North West Region.4.4.3. The Amateur Swimming Association, to include the Amateur

Swimming Association / Institute of Swimming Code of Ethics.4.4.4. The British Swimming Doping Control Rules and Protocols and

the British Swimming Disciplinary Code.4.4.5. FINA the world governing body for the sport of swimming and all

its disciplines, together with the Governing Body Rules.

4.5. In the event that there shall be a conflict between any rule or by-law of the Association and any Governing Body Rules then the relevant Governing Body Rules shall prevail.

5. Powers and Responsibilities of the Association5.1. In general the Association shall:-

5.1.1 Manage the sport of swimming throughout the Association subject to the strategic direction of the Amateur Swimming Association, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association.

5.1.2. Observe, obey and enforce the Laws and Regulations and the Judicial Laws and Regulations as well as the technical rules of the swimming disciplines of FINA and the Amateur Swimming Association, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association within its jurisdiction.

5.1.3. Follow and implement the resolutions, decisions and rulings of the Amateur Swimming Association Council, the Amateur Swimming Association Group Board, the Amateur Swimming Association Sport Governing Board, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association and ensure they are followed within its jurisdiction.

5.1.4. Be accountable to the Amateur Swimming Association, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association for the proper discharge of its duties and functions.

5.1.5. Produce, maintain and implement such plans based on strategic criteria set by the Amateur Swimming Association, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association and in such a form as they may from time to time require.

5.1.6. Make available to the Amateur Swimming Association, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association such information and reports as they may require, at a time and in a format specified by them.

5.1.7. Elect the requisite number of delegates to the Council Meeting and any Special Council Meeting of the Lancashire County Water Polo and Swimming Association and any other body, organisation, or association to which the Association is affiliated as required.

5.1.8. Produce and issue as required Constitutional Rules for the Association and operate on the basis of an appropriate constitution which shall:-5.1.8.1. Be issued and reviewed from time to time by the

Amateur Swimming Association and the Amateur Swimming Association North West Region.

5.1.8.2. Contain any mandatory provisions in respect of any parts of the governance and administration of the Association received from the Amateur Swimming Association, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association.

- 92 -5.1.8.3. Contain recommended provisions in respect of the other

parts of the governance and administration of the Association and any other matter appertaining to the Association received from the Amateur Swimming Association, the Amateur Swimming Association North West Region and the Lancashire County Water Polo and Swimming Association.

5.1.9. Have the power to expel a member when, in its opinion, it would not be in the interests of the Association for the club, organisation, association, body, league or alliance to remain a member.

5.1.10. Comply with the requirements and procedures of the Amateur Swimming Association Judicial Laws and Regulations for handling internal disputes as the same may be revised from time to time

5.1.11. Pass any submission or complaint that is an alleged infringement of Amateur Swimming Association Laws and Regulations to the Amateur Swimming Association for consideration by the Amateur Swimming Association.

5.2. In relation to its administration and Finance the Association shall:-5.2.1. Determine the uses to which its funds are allocated within the

strategic criteria set by the Amateur Swimming Association, the Amateur Swimming Association North West Region, the Lancashire County Water Polo and Swimming Association and the Association.

5.2.2. As required, set up and implement a Business Plan including a budget indicating the source of the required funding and how it will be spent, based on the strategic criteria set by the Amateur Swimming Association, the Amateur Swimming Association North West Region, the Lancashire County Water Polo and Swimming Association and the Association.

5.2.3. As required, set up and implement a Development Plan based on the strategic criteria set by the Amateur Swimming Association, the Amateur Swimming Association North West Region, the Lancashire County Water Polo and Swimming Association and the Association.

5.2.4 Have the authority to set the competition fees for each discipline based on a recommendation received from each discipline subcommittee

5.2.5. Administer, as required, the operation and membership process and the collection and transfer, where applicable, of fees for the Association.

5.3. In relation to its Accountability the Association shall:-5.3.1. As required from time to time, submit its Business and

Development Plans to the organisations to which it is affiliated or their nominated agents for information and approval.

5.3.2. Keep accounts showing its income and expenditure against the budget set in its Business Plan and a balance sheet

- 9 -5.3.3. As required from time to time report to the organisations to which

it is affiliated, in such a form as they may require on its:-5.3.3.1. Activities and any issues arising there from5.3.3.2. Financial Statements5.3.3.3. Performance against its Development Plan

6. Affiliation and Membership6.1. The total membership of the Association shall not normally be limited. If

however the Executive Committee considers that there is good reason to impose any limit from time to time the Executive Committee shall put forward appropriate proposals for consideration at an Annual or a Special meeting of the Council of the Association. The members of the Council shall have the right to recommend to the Executive Committee that limits should be placed on or removed from total membership, or any category of membership.

6.2. The Association shall affiliate:-6.2.1. Those clubs who are affiliated to the Amateur Swimming

Association and to the Amateur Swimming Association North West Region who have their headquarters within a radius of twenty miles of Liverpool Town Hall.

6.2.2. Those clubs who are affiliated to the Welsh Amateur Swimming Association who have been granted dispensation by the Amateur Swimming Association North West Region and by the Welsh Amateur Swimming Association.

6.2.3. Those clubs who have their headquarters on the Crown Dependency of the Isle of Man who have been granted dispensation by the Amateur Swimming Association North West Region.

6.2.4. Associated organisations affiliated to the Amateur Swimming Association and to the Amateur Swimming Association North West Region.

6.2.5. Corporate organisations.6.2.6. Local Associations and Leagues.

6.3 Applications for Affiliation shall be:-6.3.1 Limited to one application per year6.3.2 Proposed by one affiliated organisation and seconded by a different

affiliated organisation and provide such information as requested by the Association

6.3.3 Considered and agreed or otherwise at a meeting of the Council6.3.4 Circulated to all affiliated clubs and organisations by the Hon

Secretary not less than twenty one days prior to the Council meeting at which the application is to be considered

6.3.5 Approved by a majority of two thirds of those present and voting.

6.4. The membership of the Association shall consist of:-6.4.1 Clubs that are affiliated in accordance with Rule 6.3.

- 90 -6.4.2 Life Members who shall be elected at the Annual Council Meeting

on a recommendation made by the Executive Committee in recognition of outstanding services rendered to the Association. Life Members who shall be members of the Council and of the Executive Committee, shall be entitled to attend, speak and vote at general meetings of the membership, shall be entitled to hold office, to make nominations for office and to submit proposals and resolutions for consideration at a general meeting of the membership but shall not be counted in establishing if a quorum is present at a General meetings of the membership or of the Executive Committee

6.4.3 Past Presidents who shall be members of the Council and of the Executive Committee shall be entitled to attend, speak and vote at general meetings of the membership, shall be entitled to hold office, to make nominations for office and to submit proposals and resolutions for consideration at a general meeting of the membership but shall not be counted in establishing if a quorum is present at general meetings of the membership or of the Executive Committee

6.4.4 Individual post holders shall consist of President, President Elect Association Officers, Executive Committee members and other designated post holders, as decided, from time to time by the Council or the Executive Committee. All holders of individual posts shall be members of an ASA affiliated club and shall be not less than 18 years of age. Individual post holders shall be members of Council and the Executive Committee shall have the right to attend and speak at general meetings of the membership, to hold office, to make nominations for office and to submit resolutions and proposals for consideration at a general meeting of the membership. Individual post holders shall be counted in deciding if a quorum is present at the general meetings of the membership or of the Executive Committee

6.4.5 Individuals granted temporary membership by the ASA by virtue of their participation in a specific event organised by the League in conjunction with a club, body, association, organisation or league under the provisions of the Amateur Swimming Association Regulation on temporary membership. Temporary Members shall not be entitled to vote at general meetings of the membership, to hold office, to make nominations for office, to submit proposals and resolutions for consideration at a general meeting of the

membership. They shall be entitled to attend a general meeting of the membership but not speak unless by invitation of the Chairman of the meeting.

6.4.6 Persons who have been granted individual membership of the Association by the Executive Committee on an annual basis, who are non competitors provided the Amateur Swimming Association membership fee has been paid and they are not less than eighteen years of age. Individual members shall be entitled to attend and

- 11 -vote at general meetings of the membership, to hold office, to make nominations for office and to submit resolutions and proposals for consideration at a general meeting of the membership,

6.4.7 Individuals who have been granted Honorary Membership of the Association by the Executive Committee for such a period as the Executive Committee shall decide. Such members shall be members of an affiliated club and hence of the Amateur Swimming Association, shall be not less than eighteen years of age. Honorary Members shall be entitled to attend and speak at general meetings of the membership but shall not be entitled to hold office, to make nominations for office or to submit proposals and resolutions for consideration at a general meeting of the membership.

6.5 The Association shall not refuse an application for membership on discriminatory grounds, whether in relation to ethnic origin, age, sex, religion, disability, political persuasion or sexual orientation. The Association may refuse membership only for good and sufficient cause, such as conduct or character likely to bring the Association or the sport into disrepute or being unable to achieve the required performance entry standards laid down and provided by the Association to the applicant for membership.

6.6 The Association shall be required to give reasons for the refusal of any application for membership. Any Organisation refused membership may seek a review of this decision before a Review Panel appointed by the Executive Committee comprised of not less than three members and not more than five members, who may or may not be members of the Executive Committee. The Review Panel shall wherever practicable include one independent member. The Organisation refused membership shall be entitled to make representations to the Review Panel. The procedures for review shall be at the discretion of the Review Panel whose decision shall be final and binding.

6.7 All membership shall be renewed on an annual basis through the process of

reapplication not later than 1st February each year.

7. Suspension and Resignation7.1. Any organisation not having paid its annual return of membership to the

Amateur Swimming Association and suspended by the Amateur Swimming Association shall not be allowed to take part in any activities of the

Association for the period of the suspension in accordance with Amateur Swimming Association Laws and Regulations.

7.2. A club, body, association, organisation or league wishing to resign from the Association shall give notice to that effect in writing before 1st February to the Secretary or it shall be held responsible for its Association affiliation fee for the current year.

- 88 -7.3 Where the membership of a Club or other organisation is terminated in

accordance with Rule 7.2 the Club or organisation shall be informed in writing or by electronic means that the Club or organisation is no longer a member of the Association.

8. Expulsion and Other Disciplinary Action8.1. If a complaint or dispute that involves a breach of Amateur Swimming

Association Law or Regulation is received by the Association or is generated by the Association it shall be submitted to the Amateur Swimming Association for consideration under the Judicial Laws and Regulations of the Amateur Swimming Association.

8.2. The Executive Committee shall have the power to expel an individual member, club, body, organisation, association or league when, in its opinion, it would not be in the interests of the Association to retain the membership of the individual member, club, body, organisation, association or league. The Association in exercising this power shall comply with the provisions of Rule 8.4 and Rule 8.5 below.

8.3. Upon expulsion the former member shall not be entitled to have any part of the annual membership fee or any other fees refunded and must return any Association trophy or trophies held forthwith.

8.4. In the case of an internal dispute it shall adopt and comply with the requirements and procedures of the Judicial Rules and Regulations for handling Internal Disputes as the same may be revised from time to time.

8.5. A member may not be expelled or, subject to Rule 8.7 below, be made the subject of any other penalty unless the panel hearing the dispute shall by a two thirds majority vote in favour of the expulsion, or other penalty imposed upon the member.

8.6. The Officers of the Association, or any other person to whom the Executive Committee shall delegate this power, may temporarily suspend or exclude a member from particular activities of the Association, when in their opinion, such action is in the interests of the Association. Where such action is taken the incident or matter will be dealt with in accordance with the appropriate Judicial Laws and Regulations.

8.7. The Officials in charge of a particular event shall be responsible for the discipline at that event. If any further action is required this is to be referred to the Internal Disputes procedures as laid down in the Amateur Swimming Association Judicial Laws and Regulations.

9. Finance9.1. The financial year of the Association shall be the period commencing on 1st

September and ending on 31st August. Any change to the financial year shall require the approval of the Council.

- 13 -9.2. The Executive Committee shall, as they see fit, decide the amount of the

annual affiliation fee and any other fees for the next operating year.

9.3. The annual affiliation fee for each club, body, association, organisation or league shall be due on joining the Association and thereafter on 1st February of each year.

9.4. All monies payable to the Association shall be received by the Treasurer and deposited in a bank account in the name of the Association. No sum shall be drawn from the account except by cheque or by electronic means or online and sanctioned by two of the three designated signatories as decided by the Executive Committee.

9.5. The income and property of the Association shall be applied only in furtherance of the aims and objectives of the Association and no part thereof shall be paid by way of bonus, dividend or profit to any members of the Association or to an external agency.

9.6. The Treasurer shall record the financial transactions of the Association in such a manner, as the Executive Committee think is appropriate.

9.7. The Executive Committee shall have the power to set the level of payment of remuneration and expenses to any officer, member, employee or other such person for services rendered to the Association.

10. Governance10.1. There shall be three levels of government of the Association

10.1.1. The Council10.1.2. The Executive Committee10.1.3. The Standing Technical Committees and other Committees,

Officers and Association Co-ordinators

10.2. A person who is not a member of a club, body, association, organisation or league affiliated to the Association shall not be permitted to be nominated, elected or appointed as a delegate, Executive Committee member, Officer, Co-ordinator, Advisor or to any other position which carries the right to vote at any level of government of the Association.

11. Officers

11.1. The Officers of the Association shall be the President, the President Elect, the Secretary and the Treasurer.

12.2. Representation to Council12.2.1. Clubs

Each club affiliated to the Association shall be entitled to representation at Council by two delegates.

12.2.2. OthersAny affiliated body, association, organisation or league shall be entitled to representation at Council by one delegate.

12.3. Delegates12.3.1. A delegate shall be appointed by the club, body, association,

organisation or league they represent.12.3.2. The Secretary of the club, body, association, organisation or

league, or other person authorised so to do, shall notify the Secretary of the Association that the delegate is a bone fide member of the club, body, association, organisation or league and has been duly appointed a delegate to any Meeting of the Council.

12.3.3. A delegate shall be permitted one vote only irrespective of the number of organisations the person may represent at Council.

12.3.4. Proxy voting shall not be allowed at any Meeting of the Council.

13. Responsibilities of Council13.1. The Council shall have responsibility to:-

13.1.1. Deal with any matters of governance according to the rules of the Association.

13.1.2. Oversee the work of the Executive Committee and to receive its reports and accounts.

13.1.3. Abide by the standing orders for its conduct.13.1.4. Consider and decide on any proposed additions or alterations to, or

deletions from the constitutional rules.13.1.5. Keep full and accurate minutes of its meetings.

13.2. The Council shall at the Annual Council Meeting appoint from time to time:-13.2.1. One independent financial examiner, as required, who shall not be

a member of the Executive Committee or a member of the family of a member of the Executive Committee.

- 15 -13.3. At the Annual Council Meeting elect the following, each of whom shall be a

member of a club, body, association, organisation or league affiliated to the Association and shall be not less than eighteen years of age:-13.3.1. The President13.3.2. The Life Members13.3.3. The President Elect13.3.4. The Secretary13.3.5. The Treasurer13.3.6. The Water Polo Secretary13.3.7. The Age Group Secretary13.3.8. Not more than 10 members of the Executive Committee

13.4. The Council may:-13.4.1. Discuss any matters that are relevant and pass resolutions and

orders concerning them.13.4.2. Appoint a special committee to consider and report upon any

matter. The number of members of the committee and a quorum shall be determined by the Council. The Officers of the Association shall be ex officio members of any such committee unless the Council dictates otherwise.

13.4.3. On the recommendation of the Executive Committee elect as a Life Member an individual whose services to the Association would justify such recognition.

13.4.4. At an Annual Council Meeting or at a Special Council Meeting, delegate the whole, or any part of its powers, to the Executive Committee.

14. Annual Meetings of Council14.1. Chairman

14.1.1. The Chairman at all meetings of the Council shall be the President if he is present. If the Chairman is absent, or unable to act or declines to act the most immediate Past President shall act as chairman. If a chairman is still not available the Council shall elect a chairman from its members present.

14.1.2. The Chairman shall:-14.1.2.1. Have unlimited authority upon any question of order.

14.1.2.2. Be, for the purpose of the Council meeting, the sole interpreter of the rules governing the Council.

14.1.2.3. Have a deliberative and a casting vote.

14.2. Secretary14.2.1. The Secretary shall be responsible for providing each affiliated

club, body, association, organisation or league and each member of the Executive committee notice in writing or by electronic means:-14.2.1.1. of the date time and place of the Annual Council

Meeting or of a Special Council Meeting and in the case of the Annual Council Meeting the closing date for the receipt of any resolutions, proposals or

14.2.1.2. of the resolutions to be proposed, at least fourteen days before the date of the Annual Council Meeting or of a Special Council Meeting.

14.2.1.3. in the case of the Annual Council Meeting a copy of the Annual Report, a list of the nominees for the Officers and the Executive Committee posts and a copy of the examined accounts.

14.2.2. The Secretary, or in the absence of the Secretary a member of, and selected by, the Executive Committee shall take the minutes of the meeting.

14.3 Quorum14.3.1 The quorum for any meeting of Council shall be ten members

entitled to attend and vote at the meeting, which must contain not less than one Officer of the Association.

14.3.2 Having called a Council Meeting, it may only proceed to business if the correct quorum of members is present within thirty minutes after the time fixed for the meeting; otherwise, the meeting shall be adjourned to the same time in the following week save that the adjourned meeting may proceed to business whatever the number of members present.

14.3.3 At the reconvened meeting the same agenda as published for the initial meeting shall be used

14.4. Motions14.4.1. A proposal for consideration at the Annual Council Meeting which

does not embody a proposal to change a Constitutional Rule of the Association, may be submitted:-14.4.1.1. By the Executive Committee14.4.1.2. By a member of Council

14.4.1.3. By a club, body, association, organisation or league affiliated to the Association.

14.4.2. All nominations for election to the Executive Committee, other Officers and named positions of the Association shall be submitted to the Secretary in writing or by electronic means not later than twenty eight days before the date of the meeting. The submission shall contain the name of the nominee, the proposer and the seconder along with a statement that the nominee is willing to stand and the proposer and seconder are willing to support the nomination

14.4.3. In all cases where multiple nominations are received for the same office or for membership of the Executive Committee and it is necessary to hold a ballot, the Secretary shall call for a Curriculum Vita for each person involved in the ballot. The Curriculum Vitae are to be circulated with the papers for the Annual Council Meeting.

- 17 -14.4.4. Nominations for election to the position of Life Member shall be

made to the Annual Council Meeting by the Executive Committee.14.4.5. Proposals and resolutions received in accordance with this section

shall be submitted in writing or by electronic means to the Secretary not less than twenty eight days prior to the date of the Annual Council Meeting or any Special meeting of Council.

14.4.6. Proposals and resolutions received in accordance with this section shall be sent to clubs, bodies, associations, organisations and leagues entitled to be represented at the Annual Council Meeting, a Special meeting of Council not less than fourteen days before the meeting of Council.

14.4.7. A motion of which due notice has not been given may not be discussed or voted upon unless sanctioned by the Chairman and two thirds of the members present and voting and provided it does not involve a change to the Constitutional Rules of the Association.

14.4.8. Approval of the Annual Report other than those items where due notice has been given to amend, add or reject, shall be proposed en block by the Chairman and put to the vote without debate.

14.5. Procedures at the Annual and Special Meetings of Council 14.5.1. All business for an Annual Council Meeting or of a Special

Council Meeting shall be printed on the agenda and no other motion shall be discussed therein except:-14.5.1.1. To record the name of the Chairman of the meeting, if

other than the President.14.5.1.2. To record the name of the Secretary of the meeting, if

other than the Secretary.14.5.1.3. For adjournment14.5.1.4. For leave to withdraw a motion14.5.1.5. For a vote of thanks14.5.1.6. For persons other than Members of Council to withdraw

14.5.2. Every motion shall be proposed and seconded

14.5.3. Resolutions that emanate from the Executive Committee shall be proposed by a member of the Executive Committee while those that emanate from a standing order or other committee shall be proposed by the Secretary of that committee. If the committee secretary is not a member of Council the proposal shall be made formally from the Chair and immediately afterwards the committee secretary, or a substitute, shall be allowed to speak in support of the resolution.

14.5.4. Any amendment shall be disposed of before another amendment is considered. The Chairman may accept, without notice, verbal amendments that do not affect substantially the nature of the proposal under discussion.

14.5.5. A proposal to change the Constitutional Rules of the Association shall be carried only if at least two thirds of those present and voting are in favour.

- 82 - All other proposals, including amendments to proposals whether to

change a Constitutional Rule of the Asociation or otherwise, shall require a simple majority of those members present and voting.

14.6. Voting14.6.1. Unless the Chairman directs otherwise, voting on all motions or

amendments shall be by a show of hands or delegates cards.14.6.2. Each member present and entitled to vote, with the exception of the

Chairman, or acting Chairman for the meeting, shall have one vote and a simple majority shall pass any resolution. In the event of an equality of votes the Chairman, or the acting Chairman for that meeting, shall have a casting vote.

14.6.3. Voting on elections shall be by secret ballot and any ballot paper containing more votes than the number required shall be void.

14.6.4. Completed voting papers shall be collected by the tellers as directed by the Chairman.

14.6.5. The Chairman shall appoint two tellers to count the votes from persons present at the meeting who shall not be members of Council.

14.6.6. The result of each ballot shall be announced by the Chairman during the meeting and the Chairman shall indicate the number of votes cast for each candidate and the number of spoiled ballot papers.

14.6.7. Any discrepancy or irregularity found after the conclusion of the meeting shall be dealt with by the Executive Committee which may disqualify votes with the validity of which it is not satisfied. The revised result and the reasons for the disqualification of any vote shall be published and circulated to affiliated clubs.

14.7. Changes to Association Constitutional Rules14.7.1. Any proposal to change a Constitutional Rule of the Association

shall only be considered at the Annual Council Meeting or at a

Special Council Meeting called for that purpose. The Council shall consider and decide only the principles and intention of the proposal. The Executive Committee shall appoint a group of people to draft the wording of the changes to the Rules to implement the principles and intentions approved by Council. The Executive Committee shall approve the changes to the Rules and submit them where necessary to the Amateur Swimming Association North West Region for its consideration and approval.

14.7.2. Any changes to the Constitutional Rules of the Association shall become effective upon approval by the Amateur Swimming Association North West Region Management Board or at a specific later date as determined by the Council.

14.7.3. A proposal to change a Constitutional Rule of the Association shall only be considered at a meeting of the Council if it has been:-

- 19 -14.7.3.1. Made by the Executive Committee at a meeting held

before 31st October and appears in the minutes of that meeting and is received by the Secretary in writing or by electronic means not less than twenty eight days before the date of the Council meeting

14.7.3.2. Made by a committee appointed by the Council or by the Executive Committee and appears in the minutes of that committee that have been approved by the Executive Committee before the 31st October and is received by the Secretary in writing or by electronic means not less than twenty eight days before the date of the Council meeting..

14.7.3.3. Made by a member of Council, a club, body, association, organisation or league affiliated to the Association and has reached the Association Secretary by a date not less than twenty eight days prior to the Council meeting.

14.7.3.4. Made as a matter of urgency, approved by the Executive Committee, sent to the clubs, bodies, associations, organisations or leagues affiliated to the Association at least fourteen days before the Council Meeting and approved as a suitable matter for consideration by Council by at least two thirds of the delegates present and voting.

14.7.3.5. Mandated by a change to either an Amateur Swimming Association Law or the Rules of the Amateur Swimming Association North West Region.

14.7.3.6. Included in a resolution or request for a Special Meeting of Council.

14.7.3.7. Referred to the Executive Committee, unless emanating from it. The Executive Committee shall indicate its support or opposition and may propose amendments,

which shall be included on the agenda of the Council Meeting.

14.7.3.8. Included on the agenda of the Council Meeting.14.7.4. Every proposal to change a Constitutional Rule of the Association

and / or amend it shall be proposed and seconded separately and shall be open for discussion by any delegate with or without prior indication of intent.

14.7.5. An amendment to any proposal to change a Constitutional Rule of the Association may be proposed by any member of Council, supported by another member as a seconder, and shall reach the Secretary of the Association not less than twenty eight days prior to the Council meeting.

14.7.6. A schedule of all such amendments shall be sent to the clubs, bodies, associations, organisations and leagues entitled to be represented at Council at least fourteen days prior to the date of the Council meeting at which they are to be considered.

- 80 -14.7.7. If any addition, alteration or deletion from either an Amateur

Swimming Association Law or Regulation or a Rule of the Amateur Swimming Association North West Region causes an Association Rule to conflict with it, the Executive Committee shall be authorised to change the Association Rule to conform to it. Any such changes shall be notified to the next Annual Council Meeting following the change of Rule.

14.8. Annual Meeting of Council14.8.1. The Association shall have one scheduled meeting of Council each

year.14.8.2. The Annual Council Meeting of the Association shall be held in the

month of December.14.8.3. The Executive Committee shall fix the date, the time and the venue

of the Council Meeting, which shall be notified to clubs, bodies, associations, organisations and leagues with the notice convening the meeting.

14.8.4 Only in the event of exceptional circumstances shall a meeting of Council be postponed by the Executive Committee once the date, time and venue has been fixed and advised to members. A postponed meeting of Council shall normally be re-convened on a date within one month of the original date and a minimum of seven days advance notice given to the members of the rescheduled date, time and venue. At this meeting, the same agenda as originally issued shall be used.

14.8.5 If a Council meeting commences but is adjourned for want of time or for other good reasons the members present at the meeting will be notified there and then of the adjourned date if practicable. If not and the matter is adjourned for more than fourteen days all members shall receive seven days notice in writing or by electronic

means of the adjourned meeting; otherwise only those who attend the original meeting will be notified of the date.

14.8.6 Any adjourned Council meeting must be re-convened and business completed within two months of the adjournment.

14.8.7 In any event no more than fifteen months shall elapse between any two consecutive Annual Council Meetings.

14.8.8. The purpose of the Annual Council Meeting is to transact the following business:-14.8.8.1. To receive and comment on the Annual Report of the

activities of the Association during the previous year as presented by the Secretary.

14.8.8.2. The Annual Report shall include the reports of the Executive Committee, the Standing and Technical Sub Committees or other committee, as decided by the Executive Committee and responsible for the activities of the Association during the previous year.

- 21 -14.8.8.3. To receive and consider, the accounts of the

Association for the previous year, the report on the accounts by the independent Financial Examiner and the Treasurers report as to the financial position of the Association.

14.8.8.4. To elect the President, the President Elect, the Officers and the other members of the Executive Committee who shall retire from office at the Annual Council Meeting each year, but shall be eligible for re-election with the exception of the President.

14.8.8.5. To elect Life Members as required.14.8.8.6. To appoint the independent Financial Examiner.14.8.8.7. To decide on proposed changes to the Constitutional

Rules14.8.8.8 To decide on any other resolution that may be duly

submitted in accordance with Rule 14.3 and Rule 14.6.

14.8.8.9. To present Association awards as required.

15. Special Meetings of Council15.1. A Special Meeting of Council shall be called at any time by:-

15.1.1. A resolution of the Council carried at any meeting of the Council.15.1.2. An order of the Executive Committee.15.1.3. A requisition in writing, received by the Secretary, signed on

behalf of not less than sixteen different clubs, bodies, associations, organisations or leagues. Each signatory to the request is to be an officer of the club, body, association, organisation or league. The request shall state the purpose for which the meeting is required and the resolutions proposed.

15.2. The Secretary shall notify the membership of the arrangements for holding a Special Meeting of Council within twenty eight days of the receipt of a requisition to call the meeting.

15.3. Not less than fourteen days notice of a Special meeting shall be given to all affiliated clubs, bodies, associations, organisations and leagues. The notice shall specify the object of the meeting. The date, the venue and the time of such a meeting shall be at the discretion of the Executive Committee but must be held within two months of the receipt by the Secretary of the request to hold the meeting.

15.4. No business shall be discussed at such a meeting other than that prescribed by the Council, the Executive Committee or that stated in the request for the meeting, as the case may be.

15.5. Quorum15.5.1 The quorum for the any Special Meeting shall be ten members

entitled to attend and vote at the meeting, which must contain not less than one Officer of the Association.

- 78 -15.5.2 Having called a Special General Meeting, it may only proceed to

business if the correct quorum of members is present within thirty minutes after the time fixed for the meeting; otherwise, the meeting if convened at the requisition of the members shall be dissolved; if convened by the direction of the Council or the Executive Committee it shall be adjourned to the same time in the following week save that the adjourned meeting may proceed to business whatever the number of members present.

15.5.3 At the re-convened meeting the same agenda as published for the initial meeting shall be used

16. Executive Committee16.1. Membership

16.1.1. The Executive Committee shall comprise the following:-16.1.1.1. The President16.1.1.2. The Life Members16.1.1.3. The Past Presidents16.1.1.4. The President Elect16.1.1.5. The Secretary16.1.1.6. The Treasurer16.1.1.7. The Championship Secretary16.1.1.8 The Water Polo Secretary16.1.1.9. 10 elected members

16.1.2. All members of the Executive Committee must be members of an affiliated club, association, organisation or league and must be not less than eighteen years of age.

16.1.3. The Executive Committee members, with the exception of the Life Members, the Past Presidents and the appointed members shall be proposed, seconded and elected by ballot at the Annual Council Meeting each year and shall remain in office until their successors

are elected at the next Annual Council Meeting. Retiring members of the Executive Committee shall be eligible for re-election with the exception of the President.

16.1.4. The Executive Committee may fill any vacancy occurring by resignation or by any other means.

16.1.5. In addition to the members so elected, the Executive Committee may co-opt a maximum of three further members of the Association, who shall serve until the next Annual Council Meeting. Co-opted members shall not be entitled to vote at the meetings of the Executive Committee and shall not be counted in establishing whether a quorum is present. Co-opted members shall be not less than eighteen years of age.

16.1.6. In the event of any member of the Executive Committee with the exception of the Life Members, the Past Presidents, the President and the President Elect of the Association not attending three consecutive Executive Committee meetings, it shall be considered equivalent to their resignation and the Executive Committee shall proceed to fill the vacancy, unless the Executive Committee are satisfied that such absence is unavoidable and have notice of same.

- 23 -16.1.7. The Executive Committee shall have authority to invite such other

persons as deemed necessary for any specific purpose who may speak but not vote.

16.2. Meetings16.2.1. Meetings of the Executive Committee shall be held not less than

six times per year save where the Executive Committee itself shall, by a simple majority, resolve not to meet but there shall be not less than four meetings of the Executive Committee per year.

16.2.2. The President and the Secretary shall have discretion to call further meetings of the Executive Committee if they consider it to be in the interests of the Association.

16.2.3. The Secretary shall give all members of the Executive Committee not less than ten days notice, in writing or by electronic means, of an Executive Committee meeting.

16.2.4. The President or in the absence of the President, the most immediate Past President, shall act as Chairman of meetings of the Executive Committee.

16.2.5. Decisions of the Executive Committee shall be made by a simple majority of the votes cast. Each member present, with the exception of the President, or the acting Chairman for that meeting, shall have one vote. In the event of equality of votes the President, or the acting Chairman for that meeting, shall have a casting vote.

16.2.6. The Secretary, or in the absence of the Secretary a member of the Executive Committee, shall take the minutes of the meeting.

16.3. Quorum16.3.1. The quorum for an Executive Committee meeting shall be not less

than a simple majority of the members entitled to attend and vote, to include not less than one Officer.

16.3.2. In the event that a quorum is not present within thirty minutes of the published starting time, a meeting shall stand adjourned but shall normally be re-convened on a date within one month of the original date or in exceptional circumstances on a date as may be determined by the President and a minimum of seven days advance notice given to the members of the rescheduled date, time and venue. If a quorum is not present at the adjourned meeting then those Committee members attending may act for the purpose of calling a Special General meeting of the membership

16.3.3 At the rescheduled meeting the same agenda as originally issued shall be used.

16.4. Powers and Responsibilities16.4.1. The responsibilities of the Executive Committee shall include but

16.4.1.2. Carry out any other specific duty given to it by the Council.

16.4.1.3. Have day to day management of the affairs of the Association including but not being limited to, the oversight of the production of any plans of the Association for the approval of Council and for submission to the Amateur Swimming Association, to the Amateur Swimming Association North West Region and to the Lancashire County Water Polo and Swimming Association as required, together with their implementation, monitoring and evaluation.

16.4.1.4. Appoint any officers, officials, co-ordinators and members of the Standing and other committees, not elected by the Council.

16.4.1.5. Monitor and evaluate the work of the Standing and other committees and any other person appointed to a specific task within the Association, including the production of full and accurate minutes of their meetings and reports of their activities.

16.4.1.6. Maintain appropriate channels of communication with the clubs, bodies, associations, organisations, leagues and individuals.

16.4.2. The Executive Committee shall:-16.4.2.1. Determine any question arising as to the correct

interpretation of any of these rules, or any other question not herein provided for.

16.4.2.2. Set the affiliation fee in line with the budget.16.4.2.3. On a recommendation received from the discipline

subcommittees set the level of competition and championship fees in line with the budget.

16.4.2.4. Determine who shall be the authorised signatories of the accounts of the Association.

16.4.2.5. Ensure that full and accurate minutes of its meetings are kept.

16.4.2.6. At its first meeting after the Annual Council Meeting appoint the members of the Standing Committees for, Development, Swimming, Water Polo, Synchronised Swimming and Diving, each of whom shall be a member of a club affiliated to the Association and shall be not less than eighteen years of age.

16.4.2.7. At its first meeting after the Annual Council Meeting appoint from amongst its own members Association Representatives to the :-16.4.2.7.1 A delegate to the Lancashire County

- 74 -16.4.2.9. Have the power to authorise the payment of

remuneration, expenses or grants for services to the Association received from any:-16.4.2.9.1. Officer, Committee member, Co-

ordinator or official of the Association.

16.4.2.9.2. Other person or persons as decided by the Executive Committee or Council.

16.4.2.9.3. External agents as part of a partnership agreement.

16.4.2.10. Draw up and implement with immediate effect a change of the Constitutional Rules of the Association if they are in conflict with any addition, alteration to, or deletion from, an Amateur Swimming Association Law or Regulation, a Rule of the Amateur Swimming Association North West Region or the Lancashire County Water Polo and Swimming Association.

16.4.2.11. Determine the terms of reference of any sub-committee or working group.

16.4.2.12. Be accountable to the Council of the Association and report to it at such times and in such a form as it may require.

16.5. The Executive Committee may16.5.1. Fill any vacancy occurring on the Executive Committee, after

due notice.

16.5.2. Contract and set up partnership agreements with outside agencies in support and furtherance of the aims and objectives of the Association.

16.5.3. Appoint a special committee to consider and report on any matter, the number of and appointment of the members of the committee and a quorum to be determined by the Executive Committee.

16.5.4. Discharge, by a two thirds majority of those present and voting for any breach of, and under the provisions of, the Amateur Swimming Association Code of Conduct for Volunteers, any volunteer person from any elected or appointed office or position and replace them.

16.5.5. At its discretion, discharge any Standing or other committee and elect a new one in its place.

16.5.6. From time to time appoint from among its members such other committees or working groups as it may consider necessary and may delegate to them such powers and duties as the Executive Committee may determine.

16.6. The Executive Committee shall be governed by the following standing orders:-16.6.1. If the President is unable or unwilling to act as Chairman at a

meeting the most immediate Past President and then the most immediate Past Presidents in order of holding office who are in attendance at the meeting shall be invited to take the chair. If a Chairman is still not available the members present at the meeting shall elect a Chairman from their members and he shall be entitled to act in all respects as if he were the Chairman.

16.6.2. The Chairman shall have unlimited authority upon every question of order at each meeting of the Executive Committee and for the purpose of any meeting shall be the sole interpreter of the rules governing the Executive Committee.

16.6.3. The minutes of the previous meeting as circulated shall be considered as the first substantive item on the agenda.

16.6.4. The minutes of any Standing or other committees and reports of officers or other individuals shall not be considered unless they have been circulated with the agenda, unless the Chairman and the members of the Executive Committee agree by a two thirds majority that it will not prejudice the good governance of the Association to do so. Any minutes or other reports that have not been circulated with the Agenda for the meeting shall be deferred to the next meeting of the Committee.

16.6.5. Every motion shall be proposed and seconded.16.6.6. Any amendment shall be disposed of before another amendment

is considered. The Chairman may accept, without notice, verbal

amendments that do not affect substantially the nature of a proposal under discussion.

16.6.7. All proposals, including amendments to proposals shall require a simple majority of those members present and voting unless otherwise specified in these rules.

16.6.8. The Chairman shall have a deliberative and a casting vote.16.6.9. Unless the Chairman decides otherwise, voting on all motions or

amendments shall be by a show of hands.16.6.10. Meetings of the Executive Committee shall not be open to the

public.16.6.11. The minutes of the Executive Committee shall be circulated to

each member of the Executive Committee only.16.6.12. The members of the Executive Committee shall be indemnified

by the members of the Association against all liabilities properly incurred by them in the management of the affairs of the Association.

17. Independent Financial Examiner17.1. One independent Financial Examiner shall be appointed at the Annual

Council Meeting, who shall not be a member of the Executive Committee nor related to any member of the Executive Committee. He shall examine the annual statement of the accounts and the balance sheet and shall certify the same before they are circulated to affiliated members.

- 72 -18. Standing Committees18.1. Standing committees shall be formed for, Development, Swimming, Diving,

Synchronised Swimming and Water Polo.18.1.1. Composition

Each Standing committee shall consist of members as indicated in its terms of reference.

18.1.2. Ex officio MembersThe President, the President Elect, the Secretary and Treasurer of the Association shall be Ex-officio members of all Standing or other Committees, or as otherwise specified by the Council, or in the terms of reference of such a committee. The Ex officio members shall be allowed to speak but not vote and shall not be counted in deciding if a quorum is present

18.1.3. AppointmentThe Executive Committee shall appoint the members of each Standing committee.

18.2. Provisions applicable to Standing and other Committees18.2.1. Standing Orders

18.2.1.1. The meeting of every committee shall be private and no report of its proceedings shall be made to any outside body.

18.2.1.2. In case of emergency any action or decision taken by any Standing or other committee must have prior approval of the President, the Secretary and the Treasurer.

18.2.1.3. Except in cases of emergency no decisions of any Standing or other committee shall be binding upon the Executive Committee until considered and voted upon by the Executive Committee.

18.2.1.4. All Standing and other committees shall periodically report their proceedings to the Executive Committee and shall conduct their business in accordance with the directions of the Executive Committee.

18.2.2. QuorumThe quorum for each Standing committee or other Committee shall be laid down in the terms of reference for that Committee. Any ex-officio, co-opted or invited members shall not be taken into account when determining the quorum of a committee but those with a vote, attending a meeting, shall be included in the number of members present required to satisfy the quorum.

18.2.3. Co-optionAny Standing or other committee shall have the power to co-opt members, for any special purpose, without the power to vote.

18.2.4 InvitationsA Standing Committee shall have authority to invite to meetings of that Committee such other persons as deemed necessary for any specific purpose who may speak but not vote.

- 29 -18.2.5. Substitutes

In the absence of the Chairman and / or the Secretary of any Standing or other committee a member of the committee chosen by a majority of the members present and voting shall act as the Chairman or Secretary as required, for that meeting.

18.2.8. MinutesEach Standing or other committee shall keep full and accurate minutes of its meetings. The minutes of all such meetings or a report of the activities and business conducted by the Committee, as decided by the Executive Committee, shall be submitted for approval to the Executive Committee.

18.2.9. Duties and Responsibilities of a Standing CommitteeUnless stated otherwise the duties of a Standing Committee shall include but not be limited to:-18.2.9.1. Managing the Championships and Competitions of

the Association for the discipline concerned.18.2.9.2. Appoint Officials for the Association Championships

and other competitions as necessary.18.2.9.3. Select Association representatives and nominate

competitors and officials for representative teams as required.

18.2.9.4. To make recommendations to the Executive Committee as required for Association awards.

18.2.9.5. Review the relevant section of the Development Plan of the Association on a regular basis and make periodic reports to the Executive Committee on the progress made against the Development Plan for the discipline.

26. Championship Conditions26.1. The championship conditions for all the Association events shall not be

considered part of the Constitutional Rules for the purpose of these rules. The championship and competition conditions will be considered by the relevant Standing committee and referred to the Executive Committee which shall have full power to approve any changes.

27. Interpretation of Rules27.1. In the event of any question arising as to the correct interpretation of the

Constitution or the Rules of the Association or any other question not herein provided for, such question shall be referred to the Executive committee, whose decision shall be final.

- 68 -28. Dissolution28.1. A resolution to dissolve the Association shall only be proposed at a Council

Meeting and shall be carried by a majority of at least three quarters of the members present and eligible to vote.

28.2. The dissolution shall have effect from the date of the resolution and members of the Executive Committee shall be responsible for the winding up of the assets and liabilities of the Association.

28.3. Any property remaining after the discharge of the debts and liabilities of the Association shall be given to a charity or charities or other non profit making organisation having aims and objectives similar to those of the Association for the furtherance of such aims and objectives as determined by the last Executive Committee.

AMATEUR SWIMMING ASSOCIATION LAWS AND REGULATIONS

INTERNAL DISPUTES

1. Affiliated Body Rights and ResponsibilitiesThe rights and responsibilities of a club or affiliated body in terms of its discipline, its internal dispute procedures and the sanctions it can impose are given in Amateur Swimming Association Regulation 281 which specifies:-

281 Affiliated Body Discipline and Internal Dispute Procedures281.1. For a breach of its own rules, an affiliated club or body may:

281.1.1. Apply sanctions to a member relating to activities wholly within its own jurisdiction up to and including suspension from any or all of them

281.1.2. Expel a member, provided that before doing so it informs the member of the alleged offence and gives him a reasonable opportunity to defend himself against the charge. If the alleged offence is also a breach of Amateur Swimming Association Law or Regulations the club or body shall not deal with it but may make a complaint under the Judicial Laws and Regulations.

281.2. A club or body may expel from membership and or / refuse to renew the membership of any member who has been suspended according to Regulation 109 or Regulation 241 provided that any such expulsion or initial fefusal shall not be lawful after twelve months immediately following the end of the suspension.

281.3. Each club shall include in its rules provisions specifying the procedures to be carried out to handle internal club disputes.

281.4. Any such provisions shall comply with the Amateur Swimming Association Recommended Club Constitution and the accompying Guidance Notes.

2. Complaint to the Amateur Swimming AssociationAny dispute that involves an allegation of a breach of Amateur Swimming Association Lew must be submitted to the Amateur Swimming Association and dealt with as a complaint under the condition of Amateur Swimming Association Regulation 150.4 and Amateur Swimming Association Regulation 281.1.2. Amateur Swimming Association Judicial Regulation 102 deals with the circumstance of a complaint made to the Amateur Swimming Association. It provides the necessary explanation that defines a complaint, the grounds on which a complaint can be made, who can make a complaint and the procedure to be used.

- 66 -102 Complaints

102.1. A complaint is a formal expression of dissatisfaction with the actions or behaviour of any person, including an individual or a club, or other body, or organisation or with alleged unfair practice in connection with the sport.

3. Internal DisputesWhen a dispute arises between two or more members of the same club, body or organisation it must be handled using the Internal Disputes procedure specified in the Constitutional Rules of the affiliated body and the following Amateur Swimming Association Judicial Regulations 150 to 155.150 General

150.1. The primary objective of the Regulations in this section is to set out ways by which a just outcome of an internal dispute between the members of a club, organisation, association or body may be secured as expeditiously as possible.

150.2. An internal club dispute is a dispute involving an alleged breach of the club’s rules, between two or more club members, any or none of whom may be an officer of the club, or one or more club members and one or more employees of the club (the parties).

150.3. If a dispute cannot be resolved fairly and amicably between the parties concerned, and does not involve a breach of Amateur Swimming Association Law, it may be dealt with under the relevant provisions of Regulation 281 which deal with club rights and responsibilities.

150.4. Any dispute which involves an allegation that there has been a breach of Amateur Swimming Association Law by a member must be dealt with as a Complaint under Regulation 102 and the other relevant Regulations.

150.5. If the dispute involves an allegation against a paid employee of the club the issue must be dealt with under the terms of his contract of employment.

150.6. A failure by a club or any of the parties to comply with these Regulations 150 to 155 inclusive shall be grounds for a complaint under Regulation 102.

150.7. Organisations, associations or bodies affiliated to the Amateur Swimming Association shall conform with such parts of Regulations 150 to 155 inclusive as may reasonably be applied to them, in all respects as if they were a club.

151. Sequence of Steps to Deal with a Dispute151.1. The parties shall use any reasonable means to settle the

issues between them informally and amicably

- 35 -151.2. If such a resolution cannot be achieved, the dispute shall

be referred to the chairman of the club committee or, if he is party to the dispute, to another officer of the club who is not a party who within seven days of the reference shall appoint an inderpendent person to act as a mediator between the parties. The mediator may be a member of the club or a member of another club affiliated to the Amateur Swimming Association

151.3. If the mediator is unable to bring about a satisfactory settlement within twenty one days, the club committee shall within a further fourteen days appoint a panel (the panel) to determine the dispute.

151.3.1. The panel shall consist of three persons who have not been involved in the dispute, either from the members of the club, if this is not possible or desirable, from the members of any other club affiliated to the Amateur Swimming Association

151.3.2. The parties shall be given the opportunity to object to any of the members of the panel at least seven days before the scheduled date of any hearing. The club committee shall consider any such objections, decide whether they are justified and act accordingly.

152. Procedures before a Hearing152.1. The panel members shall appoint one of their numbers to

act as the Chairman and either appoint another number, or alternatively appoint an additional person without any other powers, to act as the clerk of the hearing.

152.2. The Chairman of the panel shall arrange the date of the hearing and notify the parties of the arrangements at least fourteen days in advance of the date set. The notified date shall not be changed unless one or more of the parties has a compelling reason for not being able to attend on the notified day or time.

153. Procedures at a Hearing153.1. The procedure shall be flexible and it shall be the

responsibility of the Chairman of the panel to ensure the orderly and effective conduct of the hearing.

153.2. The panel shall not be bound by the judicial rules of the courts of England and Wales's governing procedure or the admissibility of evidence provided that the hearing is conducted in a fair and orderly manner and that each party is given a reasonable opportunity to give and call evidence, address the panel and present his case. The Chairman shall have the discretion to limit the number of witnesses that could otherwise have been called

- 64 -153.3. Witnessess shall normally be provided with an area outside

the hearing room and not not take any part in the hearing other than giving evidence and responding to questions.

153.4. The parties shall be informed of their right to make a complaint under Regulation 102 if they are dissatisfied with the conduct of the hearing or the grounds upon which the decision was made or if they consider any sanction imposed to be disproportionate.

154. Procedure after a Hearing

154.1. The panel shall come to a decision as soon as reasonably practicable after the hearing and if possible announce its findings and decisions orally to the parties.

154.2. Notwithstanding anything in Regulation 154.1 the Chairman shall notify the parties and, if the club was not a party to the dispute, the club secretary in writing of its findings and decisions within five days of the hearing.

155. Considerations Regarding Children155.1. Any person under the age of eighteen (a child) who is a

party to a dispute or who has been called as a witness shall normally be accompanied by a parent, a person with parental responsibility or a suitable adult. The Chairman shall have the sole discretion as to whether a child is permitted to present or defend a case or be questioned as a witness and may order that the child be assisted or represented by an adult.

155.2. The Chairman shall give due consideration to any child attending a hearing as a party to a dispute or to give evidence and in particular:155.2.1. No child aged fourteen or under shall normally

be expected to attend a hearing to give evidence in person. His evidence shall normally be given as a written statement with the assistance of a club welfare officer or other person acceptable to the child and parent. Questions and responses may be relayed by a panel member. If the child appears distressed the panel shall rely only on the written evidence:

155.2.2. A child over the age of fourteen shall only attend a hearing as a party to the dispute or to give evidence in person provided he wishes to, and the Chairman has consulted with the parent and child and is satisfied that they both understand the nature of the hearing and what will happen and that the child is competent to attend.

- 37 -155.2.3. If there is a disagreement between parent and /

or child and the Chairman on any of the considerations above, the Chairman shall consider requesting advice from the Independent Child Protection Officer via the Amateur Swimming Association Legal Department.

155.3. During the hearing, a child who is expected to give evidence in person and his accompanying adult(s) shall be required to attend only those parts of the hearing which are

necessary for him to give his evidence and shall be provided with a separate waiting area with no contact with any of the (other) parties.

155.4. After the hearing the Chairman shall inform the parent of the panel’s findings and decisions and shall discuss whether he or the parent shall inform the child.

- 62 -SWIMMING CHAMPIONSHIPS

1. The Liverpool and District combined Age Group and Swimming Championships shall be open to all members of clubs affiliated to the Liverpool and District Swimming and Water Polo Association.

2. The Championships shall take place annually on dates and at venues agreed by the Executive Committee.

3. Entrance fees shall be as determined by the Executive Committee.

4. All entries must be made upon the official entry form of the Association to reach the Championship Secretary accompanied by a consolidated fee, at least twenty one clear days before the date of the first competition.

5. A competitor may represent one club only in the combined Age Group and Swimming Championships in the year of competition. The competition year shall be 1st January to 31st December.

6. The Open Championship shall be awarded to the fastest swimmer or team in each event. A trophy, if one has been allocated to the event, shall be awarded to the winner,6.1. The Individual Age Group Championship shall be awarded to the fastest

swimmer in each event in each of the following age groups:- 9 years in the year of competition10 years in the year of competition11 years in the year of competition12 years in the year of competition13 years in the year of competition14 years in the year of competition15 years in the year of competition16 years in the year of competition17 years and over in the year of competition

6.2. Further awards will be made to those swimmers or teams who are placed second and third in each designated Age Group. Such awards shall be as determined by the Executive Committee.

7. All events, except for the 100 metres open championship, shall be decided on the declared heat winner principle. The 100 metres open championship shall be decided by a final of the fastest six or eight swimmers depending on the number of lanes in the pool. All heats shall be graduated with the fastest swimmers in the last heat from times submitted on the entry forms. A swimmer failing to submit an entry time will be placed in the earliest appropriate heat.

8. The Championship Secretary shall maintain a record of all results achieved in the combined Age Group and Swimming Championships.

- 39 -9. The championships shall be held in pools of 25 metres, or 50 metres in length.

10. In the event of a dead heat additional awards shall be given. In events where there is a trophy the clubs or individuals concerned shall hold the trophy jointly.

11. In team events each club shall be entitled to enter more than one team.

12. In team events a completed team sheet shall be handed in to the Referee thirty minutes prior to the event taking place.

13. The team selected to represent the Association in the Inter Association Age Group Competition shall be selected in accordance with the conditions governing that competition.

14. by them shall be decided by the Executive Committee.

Disability Competitors

1. The general conditions for the Liverpool and District Swimming and Water

Polo Association Age Group and Swimming Championships shall apply to disability competitors except where varied by any of the following conditions

2. Swimmers with the indicated classifications will be accepted for the following events:-2.1. Freestyle 50m 100m (S1 to S14): 200M (S1 to S5): 400m (S6 to S14) 2.2. Backstroke 50m (S1 to S5): 100m (S6 to S14)2.3. Butterfly 50m (S2 to S7): 100m (S8 to S14)2.4. Breaststroke 50m (SB1 to SB3): 100m (SB4 to SB9 and SB11 to SB14)2.5. Individual Medley 200m (SM5 to SM14)

3. All competitors must:-3.1. Hold a valid British Swimming Functional Ability Card or a valid

Certificate of Disability issued by the Amateur Swimming Association at the time of entry.

3.2. TheFunctional Ability Card or the Certificate of Disability must be presented to the referee before the start of the race in which the competitor is entered. Failure to do so will result in the swimmer being liable to disqualification for non-compliance with the rules for a particular stroke.

4. Qualifying times for swimmers with a Functional Ability Card have been set in accordance with British Swimming Guidelines

5. Personal Care Attendants / Coaches will be permitted for swimmers in the following classes:- 5.1. S1, S2, S3, S4 and S11

5.2. All coaches, chaperones and personal care attendants must conform with the Amateur Swimming Association Child Protection Procedures

6. Competition format:-6.1. The competition format will be based on disability inclusion within the

able bodied programme6.2. All swimmers will be seeded in the heats according to their entry times6.3. Disability competitors will be included within the results for their age

group6.4. There will be no separate disability results.

- 41 -PRESIDENTS CUP COMPETITION

1. The Presidents Cup Competition shall be held between September and December. The competition will be held at the Everton Park Sports Centre.

2. The age groups for the competition are 13yrs, 14yrs, 15yrs, 16yrs and over.

Ages as at the 31st December in the year of the competition. 10yr, 11yr and 12yr olds cannot compete in this competition.

3. A swimmer must be a member of the club they represent by the 1st July in the year of the competition and may only represent one club in this competition during the period of 1st July to 30th June.

4. A team register of swimmers who will be used in any of the three galas is to be submitted (Name and Date of Birth). Team sheets are to be handed in prior to the start of each round and the final.

5. Swimmers may compete in a maximum of three individual events, not more than two in their own age group and with not more than one individual event in a higher age group.

6. Swimmers may compete in any number of relays in their own age group or a higher age group with the exception of the Mixed Cannon Relay. Swimmers may not compete in a lower age group.

7. Each club may enter one team only in the competition.

8. The competition consists of two rounds and a final, with the top eight teams competing in the final.

9. The final will be based on the total gala points after rounds one and two. Gala points will be awarded by using the times from both sessions, the team with the fastest time overall will gain maximum gala points.

10. Each team is to provide one judge and one timekeeper for each round and the final.

11. The registration fee to be decided by the Liverpool and District Swimming and Water Polo Association.

12. The final event is a Mixed Cannon 8 x 1 (1Boy and 1 Girl from each age group)

13. In the Mixed Cannon Relay swimmers will not be permitted to swim up in a higher age group in this event.

1. All swimming officials must be registered and licenced with the Amateur Swimming Association

2. A list of the current registered and licenced swimming officials for the

Association can be found in the Amateur Swimming Association North West Region handbook.

- 43 -DIVING CHAMPIONSHIPS

1. The Liverpool and District Diving Championships are open to bona fide first claim members of clubs affiliated to the Liverpool and District Swimming and Water Polo Association.

2. The Championships shall take place annually on dates agreed by the Executive Committee and at venues approved by the Council.

3. Entrance fees shall be as determined by the Annual General Meeting.

4. Entries must be made on the official form of the Association to reach the Secretary of the Diving Committee accompanied by the fee at least fourteen clear days before the date of the competition.

5. Springboards and depth of water must conform to ASA conditions a ten per cent variance of these measurements is permitted.

6. Whenever possible boards shall be available to competitors for not less than one week before the advertised date of the Championships.

7. Officials shall be appointed by the Diving Committee and shall consist of a Referee (who shall be in charge of the event) and three or five Judges plus a Recorder.

8. Dives shall be executed and judged in accordance with ASA conditions and practice.

9. Standard Certificates will be awarded to competitors who gain the required number of points as decided by the Diving Committee.

10. A competitor will perform three dives, one from each of three different groups, plus three voluntary dives, from either the one metre or the three metre springboard.

11. A competitor must ensure his or her list of dives on the official recording sheet is handed to the Recorder not less than half hour before the start of the competition.

12. The first three competitors in the Championships shall receive Association awards.

13. Prizes shall consist of a trophy and Association awards of such value as shall be determined by the Executive Committee.

14. The Secretary of the Diving committee shall maintain a record book of points recorded on the result forms of all Championships and competitions.

record points and the standard points on the competition form.

16. Any competitor failing to comply with any of the foregoing conditions to be disqualified and to forfeit any fee he or she may have paid.

17. The Executive Committee has the power to vary any of the above conditions prior to the date of closing of entries should any dispute or question arise that the foregoing conditions do not provide.

- 45 -SYNCHRONISED SWIMMING CHAMPIONSHIPS

1. The Liverpool and District Synchronised Swimming Championships are open to all members of clubs who are affiliated to the Liverpool and District Swimming and Water Polo Association.

2. The Championships shall take place annually on dates and at venues agreed by the Executive Committee.

3. Entrance fees shall be as determined by the Executive Committee.

4. Entries must reach the Secretary of the Synchronised Swimming Committee accompanied by the fee at least fourteen clear days before the date of the competition.

5. Officials shall be appointed by the Synchronised Swimming Committee.

6. The order of appearance shall be decided by draw, made by the Secretary of the Synchronised Swimming committee at the time of the closing of entries.

7. A Novice is one who has not previously entered a Liverpool and District Synchronised Swimming Competition and who has no higher than Grade 1 of the ASA Award Scheme.

8. The Novice competition shall be a free team routine. The Grade 2 shall be a technical solo. Grades 3 / 4 shall be a technical duet. The required elements for the above technical routines to be decided by the Synchronised Swimming Committee. Grades 5 / 6 as FINA required elements in the technical solo routine.

9. Each club may enter one team only in the novice event, three duets in the Grade 3 / 5 event and three solos in the Grade 2 event and Grades 5 / 6 event.

10. Competitors in the first three places in each event shall receive Association awards.

11. Music shall be recorded at the beginning of side one of a new cassette tape and labelled in accordance with Amateur Swimming Association P.P.L. rules. Competitors are responsible for labelling cassettes with the name and the section of the competition and for handing them to the sound centre controller before the commencement of the competition.

12. Costumes must conform to current Amateur Swimming Association regulations in respect of costumes.

13. Any competitor failing to comply with any of the foregoing conditions shall be disqualified and forfeit any fee they may have paid.

- 46 -AWARD OF MERIT

It was resolved at the Council Meeting held on the 9th January 1909, that an Award of Merit be inaugurated to be bestowed upon members of clubs affiliated to the Association as a regard for gallantry in rescuing (or attempting to rescue) persons from drowning.

1. The award which shall be in four classes to take the form of:-1.1. 1st Class Gold Medal1.2. 2nd Class Gold Centred Silver Medal1.3. 3rd Class Silver Medal1.4. 4th Class Certificate

5. Where a competitor represents more than one club in the same discipline in the same year that competitor may not score points in the competition.

6. The total number of points obtained by the clubs from each of the Championships shall be added together and on the completion of the Championships the club obtaining the highest number of points shall be declared the winner. Should there be an equal number of points the clubs concerned shall hold the trophy jointly.

7. An Association Certificate shall be awarded to the winner and the runner up each year.

GEORGE GALLIE MEMORIAL AWARD

It was resolved at the Annual Council Meeting dated 10th September 1987 that ‘A George Gallie Water Polo Player of the Year Award’ be inaugurated to perpetuate the memory of the late George Gallie.

1. The award to be made annually by the Liverpool and District Swimming and Water Polo Association on the recommendation of the Executive Committee.

2. The award shall be made to a player who has given outstanding service at, National, District, County, Local Association or Club level.

3. Nominations may be made by:-3.1. Any affiliated club3.2. Any member of an affiliated club3.3. An Official of the Association

4. The nominations to be submitted to the Liverpool and District Swimming and Water Polo Association Water Polo Secretary with details by the 1st November each year.

record of all results recorded in the Championships.

15. Any matter arising from the foregoing conditions or any matter not provided by them shall be decided by the Executive Committee.

- 47 -WATER POLO CHAMPIONSHIPS

1. Water Polo Competitions General Conditions1.1. The Water Polo Committee shall recommend to the Executive Committee

by 1st January each year1.1.1. The water polo competitions and championships it wishes to

provide during the next competition period1.1.2. The age group for each competition it wishes to provide

1.2. All competitions shall be open to clubs affiliated to the Liverpool and District Swimming and Water Polo Association who shall be entitled to enter teams in each league competition.

1.3. The competitions shall take place annually between the 1st March and the 15th November

1.4. The entry fee for each competition shall be determined by the Executive Committee on a recommendation received from the Water Polo Committee submitted not later than 1st January in the year of the competition

1.5. Competition entries must be in writing or by electronic means and received by the Water Polo Secretary not later than 1st January each year stating the starting time and the name and location of the pool in which the club is to compete

1.6. Teams shall consist of bona fide members: 1.6.1. Whose name and ASA Registration number for each separate

competition shall be duly registered with the Water Polo Secretary by the 1st February and who shall be on the Amateur Swimming Asswociation club list of members and shall not be entered by any other club in the competition

1.6.2. Late registration of members after 1st February shall be accepted by the Water Polo Secretary if the members are on the Amateur Swimming Association list of club members prior to the date of submission of the application for registration and before the first match the person can play

1.6.3. In the case of entry into an age group competition the date of birth will be stated on the registration forms and certified by the club

1.7. Any team which includes an ineligible person who has taken part shall be liable to a fine of £5:00 the question of any points involved to be decided by the Water Polo Committee

2. Water Polo League Competitions2.1.Fixtures shall be arranged as follows:

2.1.1. All fixtures are to be made at a fixtures meeting called for that purpose. The completed list must be handed to the Water Polo

Secretary on the date of the fixtures meeting

1. An annual competition open to all clubs affiliated to the Liverpool and District Swimming and Water Polo Association.

2. The competition shall be confined to the following Championships:-2.1. The Swimming Championships2.2. The Water Polo Championships2.3. The Diving Championships2.4. The Synchronised Swimming Championships

3. All events shall be eligible for points

4. 4.1. In the swimming championships competition points shall be awarded in each age group of each event in the following manner:- 4.1.1. First 6 points Fourth 3 points4.1.2. Second 5 points Fifth 2 points4.1.3. Third 4 points Sixth 1 point

4.2. At the completion of the swimming championships clubs will be ranked in order according to the number of competition points gained. The club with the largest number of competition points will be placed first. The highest placed six clubs will be allocated Memorial Trophy

points in the following manner:-

- 53 -3.9. Any player excluded in accordance with:

3.9.1. WP 21.9 Misconduct including the use of foul language violence or persistent foul play etc (exclusion with substitution)

3.9.2. WP 21.10 Act of brutality against an opponent (exclusion without substitution)

3.9.3. WP 21.11 Refusal of obedience to, or show of disrespect for, a referee or official (exclusion with substitution)

Shall be excluded from taking part in the tournament

3.10. An Association Award shall be given to each player of the winning team and to each player in the second placed team for each tournament taken separately

3.11. Any dispute or question not provided for in the rules shall be decided by the Executive Committee

- 52 -2.1.2. Any competing club failing to send a delegate to the fixtures

meeting shall be liable to a fine not exceeding £20:002.1.3. No fixture may be re-arranged without prior permission from the

Water Polo Secretary and this will not be granted unless the proposed new date of the fixture which has been mutually agreed is submitted at the time of application. The date must be confirmed in writing or by electronic means to the Water Polo Secretary by both clubs within seven days of application

2.1.4. Any club failing to comply with these conditions shall be liable to forfeit the points involved

2.2. For the start of a match being delayed:2.2.1. Beyond fifteen minutes of the officially notified time the

offending club shall be liable to a fine not exceeding £5:00. Beyond thirty minutes of the officially notified starting time the match may be cancelled by either the non offending club, by the referee if only one is present, or by both referees

2.2.2. If the match is cancelled under the above circumstances a report shall be sent to the Water Polo Secretary by the referees and the Secretary of each club

2.3. Home clubs must notify the match referees (2) and the visiting team of the starting time and venue at least seven days prior to the fixture and where there is a change of time or venue from that published at the fixtures meetingthe Water Polo Secretary must also be notified

2.4. Any club failing to fulfil its engagements without giving seven days notice to the opposing team, to the match officials and to the Water Polo Secretary shall at the discretion of the Water Polo Committee br liable to:2.4.1 Make arrangements for having the match re-arranged at a venue

specified by the Water Polo Committee2.4.2. Reimburse any reasonable expenses incurred by the non

offending club as proposed by the Water Polo Committee and agreed by the Executive Committee

2.4.3. A fine up to a maximum of £10:002.4.4. Forfeit the points.

2.5. Home and away matches shall normally be played between all clubs in each league competition unless exceptional circumstances prevent this and the Water Polo Committee have agreed to the revised arrangement

2.6. In each match two points shall be awarded for a win and one point for a draw

2.7. An Association Award shall be given to the winning club in each league competition. A runner up award shall be given when more than six teams compete

- 49 -2.8. In the event of a tie between two or more teams the order of precedence

shall be decided as follows:2.8.1. The result of the matches played between the teams with the

team gaining the highest number of points taking precedence2.8.2. If a decision is not reached the team with the highest number of

goals scored in the matches played between the teams shall take precedence

2.8.3. If a decision is not reached the team with the lowest number of goals conceded in the matches between the teams shall take precedence

2.8.4. If a decision is not reached then lots shall be drawn between the teams for the order of precedence

2.9. Each club shall pay its own travelling expenses, the home club to pay the officials expenses and notify the league Secretary of the amount paid by an entry on the match result sheet. The officials expenses will be paid from the Association Officials Expenses Account to which each club will contribute equally in each season in any one division

2.10. Should one referee fail to appear for a match the referee and the two captains shall by mutual agreement:2.10.1. Appoint another referee from the official list of referees or2.10.2. Appoint any other referee2.10.3. If these conditions cannot be met then the original referee

shall officiate. No delay is to be permitted to the official starting time to await the arrival of a second refgeree

2.10.4. If a match is started with one referee and a second referee becomes available in time for the normal start of the second period of the game then the last three periods of the game shall be conducted with two referees

2.11. Should both referees fail to appear and the captains fail to agree upon a suitable replacement referee, the game may be postponed and each club shall bear its own expenses as if the game had been played

2.12. The entries shall be divided into divisions2.12.1. By the Water Polo Committee at the fixtures meeting with a

maximum of ten clubs in any one division2.12.2. At the end of each season the lowest placed club in each

division shall be relegated to the next lowest division. The lowest placed club in the lowest division shall be eligible for re-election to that division

2.12.3. At the end of each season the winning club in each division shall be promoted to the next highest available division

2.13. For a club with more than one team in the league the following

conditions shall apply:

2.13.1. Each team shall be identified individually

- 50 -2.13.2. Each team shall register a separate set of players for the team

with the Water Polo Secretary as appropriate in line with the required registration date

2.13.3. Players shall not be allowed to move from one team to another during the period of the season

2.14. The duration of all league fixtures shall be as determined in FINA Rules and in compliance with any dispensation imposed from time to time by the National Governing Body

3. Water Polo Tournament Conditions3.1. For a club with more than one team in a tournament the following

conditions shall apply:3.1.1. Each team entered shall be identified individually for each

competition3.1.2. Each team shall register a separate set of players for the team

with the Water Polo Secretary as appropriate in line with the required registration date

3.1.3. Players shall not be allowed to move from one team to another during the period of the tournament

3.1.4. Players may be registered for different teams for different tournaments

3.2. Teams shall consist of members whose names and addresses shall be registered with the Water Polo Secretary by 1st February in accordance with the General Championship Conditions

3.3. The Water Polo Committee shall set a separate time, date and venue of each tournament individually. This constraint shall not prevent more than one tournament being played on the same day at the same venue

3.4. The Water Polo Committee to decide on the number and membership of any groups according to the number of entries

3.5. Two referees to be in charge of all matches

3.6. Expenses of staging the tournament to be met by the Association

3.7. Any club failing to fulfil its tournament engagements without giving seven days notice to the Water Polo Secretary shall be liable to a fine not exceeding £10:00

3.8. Any team which includes an ineligible player who has taken part shall be liable to a fine of £10:00. The question of any points involved and any necessary re-organisation of the competition to be decided by the tournament Director on behalf of the Water Polo Committee
