VIRGINIA: At a regular meeting of the Tazewell County School Board held at the Tazewell County Career and Technical Student Center on April 14, 2014 at 5:00 p.m. PRESENT: David Woodard, Chairman Jimmy Jones, Vice-Chairman H.S. Meyer, Division Superintendent Vicki Bailey, Clerk Alan McGraw, School Board Attorney Pursuant to Section 2.2-3711 of the Code of Virginia, motion was made by Mr. Jones, seconded by Mr. Caudill and passed to convene to a closed session for the following specific purposes: Personnel – Discussion, consideration, or interviews of prospective candidates for employment; assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of specific public officers, appointees or employees as authorized by Section 2.2-3711 A 1 of the Code of Virginia. Pursuant to Section 2.2-3711 of the Code of Virginia, motion was made by Mr. Jones, seconded by Mr. Caudill and passed to convene to a closed session for the following specific purposes:

Personnel – Discussion, consideration, or interviews of prospective candidates for employment; assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of specific public officers, appointees or employees as authorized by Section 2.2-3711 A 1 of the Code of Virginia.

Students – Discussion or consideration of admission or disciplinary matters concerning a student(s) as authorized by Section 2.2-3711 A 2 of the Code of Virginia.

The Tazewell County School Board voted unanimously to move to closed session. The Board returned to open session. In accordance with the Freedom of Information Act, a roll call vote was taken in which all members affirmed that only public business matters lawfully exempted from open meetings, as identified in the motion for closed session, were heard, discussed, or considered by the Board. Chairman Woodard called the meeting to order at 6:39 p.m. and called for a moment of silence. Dr. Meyer said a prayer, and Mr. Jones led the Pledge of Allegiance. Mr. Jones made a motion to add the following items under New Business: letter “G” VACORP Property Safety Assessment Report and letter “H” Graham Middle School Chiller and Boiler Replacement. Mrs. Moir seconded the motion and the Board unanimously approved. Approval of Agenda Mr. Jones made a motion to approve the agenda as amended. Mrs. Moir seconded the motion and the Board unanimously approved. Recognitions and Instructional Focus A. John O’Neal, Graham High School Principal, presented the following recognitions:

Graham High School Wrestling Team, State Champions – Mr. O’Neal introduced Coach Tim Woodward. Mr. Woodward introduced the assistant coach, Ben Fritz, and presented the team members to the Board: Hunter Cook (Senior) – 4th in state; Kyshon Lee (Junior) – 3rd in state; Jon Jennings (Senior) – 4th in state; Dylan Cook (Junior) State Champion.

Graham High School Forensics, State Champions – Mr. O’Neal introduced Tom Helton as the Forensic Coach. Mr. Helton told the Board Sarah Moxley and Madison Flick were named State Forensic Champions in Serious Duo Interpretation. Mr. Helton introduced Ms. Flick, and told the Board Ms. Moxley was unable to attend because of another commitment.

Board members congratulated the Graham High School students for their accomplishments. B. Kimberly Ringstaff, Principal of Richlands High School, presented the following

recognitions: RHS Band – Mrs. Ringstaff recognized Bruce Miller as Richlands High School Band

Director, and Olivia Lawson, RHS Band Student, for being chosen for the Virginia All State Band & Orchestra.

RHS Wind Ensemble - Under the direction of Bruce Miller, the RHS Wind Ensemble participated in the Virginia Band & Orchestra Directors Association District 7 Concert Band Assessment and received all superior ratings for stage assessment and a superior rating on sight reading assessment. Richlands was one of five high schools in the region to receive all superior ratings.

RHS Choir – Mrs. Ringstaff recognized Mr. Terry Hall, RHS Choir Director. Tivia Boardwine, Michael Brown, Rebekah Cox, Summer Day, Charley Dupree, Ashton Hicks, Adrianna Hodges, Caitlin Hunt, Micaiah Rowe, Courtney Shelton, Brianna Simmons, Kayla Stevens and Chrissy Stinson made All District Choir. Caitlin Hunt also made the All Virginia Chorus.

RHS FCCLA – Mrs. Ringstaff recognized Beth Goforth, FCCLA Advisor, recipient of the Kathleen Buchanan A & A in the Classroom Award. She also recognized RHS student, Alyssa Osborne, who was elected State FCCLA Vice President of Programs. Mrs. Ringstaff also told the Board the RHS FCCLA Chapter gained another Outstanding Gold Chapter Award for the 14th consecutive year, and gained seven national program awards for projects done in school.

RHS Senior Livestock Team – Mrs. Ringstaff recognized Kip Kirby, FFA Advisor, and the RHS Senior Livestock team members Kyrstin Day, Autumn Chaffins, Melanie Barnett and Taylor Matney. The team won first place at the Appalachian

Area FFA Spring Rally. Taylor Matney was named 2014 Virginia Farm Bureau State Ambassador at the Annual Women’s Conference in Norfolk.

RHS Model General Assembly – Mrs. Ringstaff introduced Amy Warner, MGA Advisor and RHS student, Mark Sahyouni. Mr. Sahyouni was elected to serve as the 2015 Attorney General for Model General Assembly.

RHS Robotics Team – Mrs. Ringstaff introduced Brandon Honaker, Robotics Team Coach, April Quesenberry, Upward Bound Director, and team members Cameron Cole, Brittany Fields, David Godbey, Chris Johnson, Jordan Lester, Jordan Lloyd, Makayla Mitchell, Haley Morrow, and Dillon Rose. The Robotics Team competed in the Super Regional Championship and placed second out of 72 teams from all states in the northeast. They also set a United States record for the highest score by any team this season. The team will compete at the World Championship in St. Louis later this month.

RHS Scholastic Bowl Team – Mrs. Ringstaff introduced Chris Hale, team coach, and team members Caleb Cruey, Jack Patton-Smith, Kyle Stiltner, Kendra Humphrey, Mark Sahyouni, Victoria Whited, Lauren McGlothlin and Dillon Rose. The RHS Scholastic Bowl team earned 3rd place in the Honaker Invitational tournament with Caleb Cruey and Jack Patton Smith both earning individual honors. At the Conference 39 Tournament at SWCC, the team earned a 2nd place finish. At the 2A West Regional Tournament, the team earned a 2nd place finish. At the f2A state tournament, the team earned a 4th place finish.

RHS Student, Brittany Allen – Mrs. Ringstaff introduced Dennis Palmer, Girls’ Basketball Coach and RHS Senior, Brittany Allen. During the 2013-2014 basketball season, Brittany Allen, a four year starter shattered the school scoring record held for 31 years finishing with 1,825 career points. Brittany was chosen to the First Team Virginia High School Coaches Association all state team, the Southern Empire conference Co-Player of the year, and earned first team all-region for the third straight year. She was also selected the 2014 Pocahontas Coal Association/Bluefield Daily Telegraph Player of the year.

Board members congratulated the Richlands High School students for their accomplishments.

C. David Bockes, Principal of Tazewell High School presented the following recognitions:

Tazewell High School DECA – Donna Ramey, DECA Advisor, recognized the following THS DECA winners: Craig Poskas, Michaelle Hash, and Charlie Reynolds for Financial Literacy Promotion; Kyle Ruble, Dakota Crouse, Nick Elkins, Nathan Cregar and Alex Carlson for Promotion of entrepreneurship; Sarah Reedy for entrepreneurship Franchise Business; Lyndsie Asbury for entrepreneurship Franchise Business and Destinee Coleman and Onnika Turley for Operation Research. These students will be going to the International Career Development Conference in Atlanta, Georgia.

Tazewell High School FBLA – Mary Mullins and Vickie Muncey, FBLA Sponsors, introduced the THS FBLA winners. (SEE ATTACHED LIST) Students eligible to participate in the National Conference will travel to Nashville, Tennessee in June.

Tazewell High School Green T’s – Randy Cordle, THS Choir Director, introduced the following: All District Choir – Heather Allison, Emily Butcher, Hunter Edwards, Rachel Patterson, Rachel Sullivan, Courtney Mitchem, Savanna Miller, Santanna Miller, Kylie Waddle, Breanna Gillespie, Brianna Tabor, Andrew Collier, Curtis Ingram,

Tazewell High School Forensics – Cindy Young, THS Forensic Coach, introduced the following: Regional Forensic Winners – Ashlyn Muncy and Caitlan Cline (3rd Regional Serious Duo) and Tanner Hieatt (State Champion Story Telling)

Board members congratulated the Tazewell High School students for their accomplishments. D. Deidra Hill introduced the Middle School Spelling Bee Winners and Regional Spelling Bee

Winners. (SEE ATTACHED LIST) After introducing all of the Spelling Bee Winners, Ms. Hill congratulated Richlands Middle School for winning the Brain Game Competition. Board members congratulated the students for their accomplishments.

E. Dr. Chris Stacy, Principal of TCCTC/Supervisor of Technology, introduced the Skills USA

2014 Virginia State Championship Winners and their instructors. (SEE ATTACHED LIST) Board members congratulated the students for their accomplishments.

F. Christine Kinser, Assistant Superintendent, introduced the Teachers of the Year for Tazewell

County Public Schools as follows: Elementary – Martha Jessee, Cedar Bluff Elementary and Ann Keene, Tazewell Elementary; Middle School – Debra Hatfield, Graham Middle; and High School – Mike Howington, Tazewell County Career & Technical Center. Board members congratulated the teachers for and thanked them for their dedication.

Board Focus

A. Alan McGraw, School Board Attorney, gave a presentation on Legal Aspects of School

Board Meetings. (SEE ATTACHED POWERPOINT PRESENTATION) Hearing of Citizens and Employees, 7:00 p.m. Caleb Cruey, Richlands High School Student Liaison to the School Board, addressed the Board about Eagle Scouts being able to wear honor cords during graduation. An initiative was started this year in the Breaks District to have all high schools in this district allow Eagle Scouts to wear honor cords during graduation. Mr. Cruey told the Board the rank of Eagle Scout is a great accomplishment and asked that the Board allow them to wear the honor cords. Mr. Cruey told the Board Richlands High School has three graduates who have achieved this honor. Chairman Woodard asked Christine Kinser, Assistant Superintendent, to work on this request. Lori Hypes, Tazewell Middle School Science Teacher, spoke about middle school students who do not want to perform in the classroom. She expressed her concern with students who simply refuse to do work in the classroom. Teachers are at a loss as to how to motivate these students. Mrs. Hypes asked the Board to think about this problem and offer suggestions. Lori Hypes, Graham High School English Teacher, spoke about relationships in conjunction with the recent morale survey teachers were asked to complete. She told the Board that several questions in the survey asked about morale and what could be changed to better Tazewell County Public Schools. Ms. Hypes told the Board her answer to that question would be communications. She indicated the audio upload on the School Board website is empty and there are no records of

the meetings. Ms. Hypes told the Board in order for a teacher to find out what new items have been discussed and what new policies have been implemented, they must read the local papers, watch a television newscast or ask a colleague who has attended the meeting. She also discussed multiple forums held in each community asking students and parents to share ideas for improvement. While this was a terrific idea, Ms. Hypes said there were no forums held for teachers. With all the emphasis on education, she asked why teachers are not asked how to help improve and why Tazewell County is not utilizing its best asset, the classroom teacher. Ms. Hypes said the first step toward improving Tazewell County is to have an honest conversation with teachers, to listen, and to open lines of communication. Unfinished Business A. Last Day of School, End of Year Teacher Work Day, and the End of the Extended School

Day – Christine Kinser, Assistant Superintendent, told the School Board she has calculated instructional hours and minutes throughout the year and would ask that April 16, 2014 be the last day of extended schedule with the normal school day resuming April 22, 2014. Mrs. Kinser asked that the last day of school be May 29, 2014 (with no early release) and the end of year teacher work day be May 30, 2014. She also told the Board that the Career and Technical graduation will be on May 29, 2014.

Mr. Jones made a motion that the normal school day resume on April 22, 2014, the last day

of school be May 29, 2014 and the end of year teacher work day be May 30, 2014. Mr. Dennis seconded the motion and the Board unanimously approved.

B. Property License for Dean Slate Property – David Beavers, Supervisor of Buildings and

Grounds, asked the Board to give Dean and Ruby Slate a license to use a 8 x 70 foot section of property at Cedar Buff Elementary School. The license is needed in order for the Slates to be able to exit their house in case of an emergency. Mrs. Moir made a motion that the Tazewell County School Board authorize the Board Chair to execute a property license across Tazewell County School Board property located in Cedar Bluff to Olen Dean Slate and Ruby Mae Slate. Mr. Jones seconded the motion and the Board unanimously approved.

C. Lion’s Club Agreement for 2014-2015 Concession Stand for Tazewell High School Football

Games - David Beavers, Supervisor of Buildings and Grounds, told the Board that he and Dr. Meyer met with Keith Sheets of the Tazewell Lions Club. They have agreed to allow the Lions Club to use Tazewell Elementary cafeteria and the kitchen for the concessions until a permanent solution can be worked out. Mr. Caudill asked if the division would be providing custodians for this. Mr. Beavers indicated custodians and a cook for the kitchen must be provided. Mr. Beavers told the Board he asked the Lions Club to pay for the services of the custodians and cook, but he was told the Lions Club did not approve that request. Mr. Caudill said according to the contract the school division has to provide the Lions Club with a place for the concession stand, but the contract does not state we have to provide employees (custodian/cook). Dr. Meyer stated she did not feel the contract says custodial services have to be provided. Mr. Caudill also asked if it was true that Tazewell High School has not received the funds agreed upon for the last two years. Dr. Meyer indicated that is true and told the Board the Lions Club has been advised to get those funds to Tazewell High School as quickly as possible. Dr. Meyer indicated she would contact the Lions Club again and ask that they pay this immediately. Mr. Caudill stated he did not feel like the school system should provide the custodian and cook. Dr. Meyer told the Board another option would be to require the Lions Club to fill out a Use of Facilities form, which

requires the user to pay for custodian services. Dr. Meyer and Mr. Beavers will schedule another meeting with Mr. Sheets of the Lions Club and report back to the Board in May.

D. e-Learning Backpack Initiative for Tazewell High School - Dr. Chris Stacy, Principal,

TCCTC and Supervisor of Technology, asked the Board for permission to proceed with the purchase of the tablets for Tazewell High School that have been presented at the last few meetings. Mr. Jones made a motion that the Tazewell County School Board authorize the School Division to proceed with participation in the Virginia Department of Education e-Learning Backpack Initiative and the purchase of tablets and accessories to be used for ninth grade students at Tazewell High School. Mr. Dennis seconded the motion and the Board unanimously approved.

E. Morale Survey Results - James Kade, Supervisor of Human Resources, presented the results

of the morale survey via PowerPoint presentation. (SEE ATTACHED) The survey was answered by 54% of teachers. Both Mr. Kade and Dr. Meyer said that was a great return for a first survey. Mrs. Moir indicated that was only about half of the teacher population, and asked if there was a way to do the surveys without asking such personal questions at the beginning. She felt the personal questions are what cause teachers to hesitate to answer because that makes them more easily identifiable. Chairman Woodard said he had spoken with a few teachers with concerns with the personal questions who said they did not feel like they could answer honestly, because they could be easily identified. He also asked if some of the personal questions could be taken out to show that we are not interested in who they are, just in their answers. Dr. Meyer told the Board the survey was initially done to gain perspective of who would be responding to the survey. The assumption was there would be different responses for different departments. It could be important to be able to pull answers from specific departments and be able to work with issues and concerns from those teachers. Dr. Meyer assured staff that no one was going into the survey and digging out any one teacher’s responses. The data is to be used to see what the different area teachers are saying to us to help us more effectively address issues that are more pertinent to them in the classroom and in their jobs. Dr. Meyer told the Board that the data would be wiped out once it is pulled and printed. Mrs. Moir said she did not feel there would be much response unless the personal information is taken out. Dr. Meyer said teachers will be working with principals on the survey results to address issues pertinent to the building and they will be working that into the improvement plans. Principals and central office staff will work together to bring the Board a division perspective on what needs to be done to make improvement. Dr. Meyer said surveys are normally done on a two year schedule, but the Board can decide if they want this to be on a yearly or bi-yearly basis.

F. Approval of Three Options for Health Insurance – James Kade, Supervisor of Human

Resources, asked the Board for approval to offer employees three options (Key Advantage 500, Key Advantage 1000 and High Deductible) of health insurance. (SEE ATTACHED) Mr. Jones made a motion that the Tazewell County School Board approve employees be allowed to choose one of three (3) health care options for the 2014-2015 school year. The motion died for lack of a second. Mr. Kade told the Board by the end of the month he has to let the carrier know which plan the division wants. The recommendation of three health care options is being presented because under the affordable care act, if the division has a premium that costs more than 9.5% of an employee’s income, we could be faced with a penalty for that person. Mr. Jones again made a motion that the Tazewell County School Board approve employees be allowed to choose one of three (3) health care options for the

2014-2015 school year, emphasizing that employees can choose whichever option they want. Mrs. Moir seconded the motion and the Board unanimously approved.

G. Teacher Wage Schedule Follow-Up - James Kade, Supervisor of Human Resources,

presented information to the Board on recent meetings with teachers regarding the impact of general wage increases (GWI’s) versus wage step increases. (SEE ATTACHED) The new schedules moved the wage schedules up so employees were actually getting money sooner; however, it had not been addressed that step increases have not been given. Step increases have not been given in several years. After a lengthy discussion, Chairman Woodard stated he felt there was still confusion and it would be best to form a group including teachers affected by the salary scale change, Mr. Kade, a finance person, and possibly a School Board member to work on this issue. Dr. Meyer indicated the information Mr. Kade passed out could be posted the next day for teachers to see. Chairman Woodard asked Mr. Kade to take care of getting the group together. Dr. Meyer stated a committee is needed to look at all salary scales, not just teacher salary scales, to accommodate the funding we now receive. She told the Board that funding is only set a year at a time and caution should be taken in adding reoccurring costs to the budget. Dr. Meyer said she felt the reason this scale was looked at several years ago was because funding was becoming an issue and the division could no longer give the raise and the step with the funding that was coming in.

New Business A. Code VA Computer Science Initiative – Tom Lester of Richlands introduced Chris Dovi,

representative for Code VA. Mr. Lester met Mr. Dovi in Richmond and asked that he contact Dr. Meyer with Code VA information. Mr. Dovi gave a PowerPoint presentation. (SEE ATTACHED) Dr. Meyer told the Board that Tazewell County has been selected as the rural division to participate in this program, so our students will be the first to have this opportunity. There are seven teachers in the division who have expressed interest in this program and that this falls into helping expand CTE offerings for students. Chairman Woodard asked when the Board approved this. Dr. Meyer indicated if the Board would like to approve this, they could do so. Code VA courses fall into acceptable courses that we can do. Dr. Meyer will obtain the outline of the courses and bring that back in May for Board approval.

B. First Review for Revisions of Employee Dress Code Policy, GA-R.1 - Christine Kinser,

Assistant Superintendent, presented the first read of revisions to the dress code policy. (SEE ATTACHED) Chairman Woodard asked Mrs. Kinser to present revisions to this policy after several employees approached him with thoughts of loosening the dress code. Chairman Woodard wanted to add that the superintendent be allowed to designate jean days system-wide, with thoughts of charging a dollar to raise funds when a county foundation is formed. Chairman Woodard also stated there are many jobs that require men to wear ties, but the pay is much more than a beginning teacher’s salary. He also feels ties have potential to be dangerous in situations, especially when teachers break up fights. Mr. Jones stated he is opposed to loosening the policy. He does not have a problem with designated jean days, but does not feel ties should be eliminated. Mrs. Moir said when she substituted; ties were the number one thing she received complaints about. Male teachers feel like the dress code is unfair because women can pretty much dress how they want, yet men have to wear the tie. Mrs. Moir stated she agrees with Chairman Woodard and feels the dress code needs to be made more equitable. Mr. Caudill made a motion that the Tazewell County School Board approve policy GA-R.1, Employee Dress Code, as a first read. Mrs. Moir seconded the

motion, and the Board voted as follows: Roll Call Vote: Mr. Caudill – Aye, Mr. Dennis – Aye, Mr. Jones – Nay, Mrs. Moir – Aye, Chairman Woodard – Aye. Motion passed 4-1.

C. Purchase of School Buses - George Godbey, Supervisor of Transportation / Food Service,

asked the Board to approve the purchase of two buses in the amount of $173,498.00. Funds are in the current budget ($187,517.00) for that purpose. Mr. Jones made a motion that the Tazewell County School Board approve the purchase of two school buses totaling $173,498.00 from funds in the 2013-14 school budget. Mr. Dennis seconded the motion, and the Board unanimously approved.

D. Budget Amendment, Stem Grant in the amount $5,000 - Janet Brown, Financial Consultant,

told the Board a teacher from Richlands Middle School, Christina Eads, applied for the Stem Grant. This is a pilot program for science, technology, engineering and math, and is paid to the teacher as a bonus. Mrs. Brown asked for the Board’s approval to add this to the current budget. Mr. Dennis made a motion that the Tazewell County School Board approve the budget amendment for the Stem Grant in the amount of $5,000.00. Mrs. Moir seconded the motion, and the Board unanimously approved.

E. May 12, 2014 School Board Meeting moved to Abb’s Valley Elementary for 50 Year

Celebration – David Woodard, Board Chairman, asked that the Board move the May regular School Board meeting to Abb’s Valley Elementary to celebrate the 50th anniversary of the school. Mr. Jones made a motion that the Tazewell County School Board approve moving the May 12, 2014 School Board meeting to Abb’s Valley Elementary School. Mrs. Moir seconded the motion and the Board unanimously approved.

F. Approval of the 2014-2015 School Budget – Dr. Michaelene Meyer, Division

Superintendent asked Mrs. Brown to give the Board an update on the work the committee did to address the parameters the Board set for eliminating items from the budget. Mrs. Brown told the Board budgets have been a challenge all over the state this year. She said the committee made suggestions and recommendations for her to implement in the budget to bring back a level of expenditures that would be more acceptable to the Board of Supervisors. Mrs. Brown presented the revised budget via PowerPoint presentation and handouts. (SEE ATTACHED) In discussing ITRT positions, Mrs. Brown gave the Board Standards of Quality (SOQ) information showing these positions are required and funded by the State. Chairman Woodard stated the reason we did not have those positions is because following the SACS/CASI accreditation process, the Board was told these positions were not needed. He told Mrs. Brown that it appears from her research the Board was misled. Mrs. Brown said the Code is very clear that these positions have to be held by certified teachers. Mr. Dennis stated that in the new budget the three ITRT positions are included, the Reading Specialist and the Math Specialist are included, but questioned if the two new gifted positions are included. Mrs. Brown confirmed those positions are in the budget. These two positions were not in the budget last year, but they were in the initial budget that was presented in March. He asked if there were any other new positions in the budget that the Board has not been told about. Mrs. Brown indicated were no other new positions. Mr. Dennis questioned if there were any positions being eliminated that were not because of retirement or resignation. Mrs. Brown said the only positions being removed were employees who are retiring voluntarily and do not have to be replaced. Mr. Dennis also questioned if there are any aide positions being eliminated or being asked to reapply. Mrs. Brown said they were all the same as they were last year. Mr. Jones asked if the budget included anything Mr. Kade had talked about tonight, and Mrs. Brown indicated it did not.

Mrs. Brown told the Board she had tried her best to clean up the budget and put people in the correct places. If an employee works at more than one school, she now has that person’s salary broken down between the schools. She stated she could not attest to where the monies were last year. Based on what was recommended by the Board, supervisors and principals, she knows she has put people in those categories. Mr. Dennis wanted to verify that there had been no new positions added to central office, because in looking at the budget, it looks like there is an increase. He asked if this was because some of the current employees are listed in other categories (such as finance) and not listed as central office, and Mrs. Brown indicated that was correct. Mr. Jones asked about adding a footnote to the budget that will be presented to the Board of Supervisors with the additional money Mr. Kade talked about for the teachers moved to the new salary scale. Chairman Woodard stated the group that will be formed to work on the teacher salary scale issue needs to meet first to decide exactly what needs to be done, so there really is not a number to add as a footnote at this time. Mr. Kade said that was true. Chairman Woodard said the budget needed to be approved and presented to the Board of Supervisors tomorrow. Mr. Caudill asked about the two proposals for the pay raises. One proposal was $887 across the Board pay raise to everyone and one was a 2% pay raise to everyone. Mrs. Brown said teachers (certified) were receiving $875 because they had asked for a lump sum rather than a percentage. According to Mr. Kade’s calculations, the $875 averaged out to a 2% increase. All other positions (classified) were given a 2% raise. Mrs. Brown told the Board there is a chance the composite index will go higher, which means our funding could be less. Since a budget has not been adopted by the State, there could be changes that have to be made. Mrs. Moir questioned the raises stating teachers felt it was not fair because central office staff are already making so much more than teachers. Mrs. Brown indicated that all central office instructional staff will be receiving the $875 increase, not the 2%, because they are certified employees. Chairman Woodard made a motion that the Tazewell County School Board approve the Tazewell County Public School 2014-2015 Budget as presented as amended for submission to the governing body. Mr. Dennis seconded the motion and the Board voted as follows: Roll Call Vote: Mr. Caudill – Nay, Mr. Dennis – Aye, Mr. Jones – Aye, Mrs. Moir – Aye, Chairman Woodard – Aye. Motion passed 4-1.

G. VA CORP Property Assessment Report – David Beavers, Supervisor of Buildings and

Grounds, shared with the Board the audit report performed by VACORP and highlighted several recommendations that are of importance in meeting the expectations outlined in the insurance agreement for the upcoming school year. (SEE ATTACHED)

H. Graham Middle School Chiller and Boiler Replacement – David Beavers, Supervisor of

Buildings and Grounds, presented information related to the continued deterioration of the boilers and chiller at Graham Middle School. Recent problems have led to his investigation of potential replacement. The estimated cost is $630,000 for replacements. Mr. Beavers told the Board we can piggyback an RFP from another school. He also mentioned this would be the perfect time for replacement with school ending and summer to finish the work. Mr. Dennis indicated he wants to do what we need to do, but needs to know where the money is coming from. The Board asked that this be brought back to the May School Board meeting.

B. School Nutrition Program, Federal Program Administrative Review, April 29 – May 1, 2014

– Dr. Meyer told the Board Mr. Godbey and his staff are prepared for the review.

C. National Teacher Appreciation Week, May 5-9, 2014 – Dr. Meyer said she felt there would be many good things going on in the schools expressing appreciation for our teachers.

D. National School Nurse Day, May 7, 2014 – Dr. Meyer called attention to this special day of recognition for our school nurses.

E. VSBA President’s Statewide Tour and VSBA Spring Regional Forum, Tazewell County Public Schools - May 8, 2014 – Dr. Meyer told the Board that in conjunction with the VSBA Spring Regional Forum being hosted by Tazewell County, the VSBA President will be visiting schools on May 8th. Once a schedule is established, Dr. Meyer will send it to Board members.

The Board returned to open session at 11:42 p.m. In accordance with the Freedom of Information Act, a roll call vote was taken in which Mrs. Moir, Mr. Caudill and Chairman Woodard affirmed that only public business matters lawfully exempted from open meetings, as identified in the motion for closed session, were heard, discussed, or considered by the Board. Nature, Defined.“…a Body Corporate and Politic…“

A “body corporate” is a legal entity (Remember, private corporations are considered “artificial persons.”), and a “body politic” is a civil division of the state for purposes of governmental administration. So, a school board is a governmental entity, much like a private corporation , but with a public function.

A Brief History of Virginia School Boards

Though Thomas Jefferson proposed (unsuccessfully) the establishment of a state system of free public education in 1779, his vision was not realized until passage of the “Underwood Constitution” of 1869, which created a system of magisterial district school boards. It was not until 1922 that the “County Unit Law” abolished the magisterial district school boards and replaced them with the county school board system we have today.

What Is, And What Isn’t…A Meeting Under F.O.I.A.?

The Tazewell County School Board is meeting when:- it sits physically, or through telephonic or video equipment as a

body, or as an informal assembly of 3 or more members, wherever held, with or without minutes being taken, whether or not votes are cast, where the business of the public body is being discussed or transacted.

The Tazewell County School Board is not meeting when:- two or more members gather at any place or function where no part

of the purpose of such gathering or attendance is the discussion or transaction of any public business, the gathering or attendance was not called or prearranged with any purpose of discussing or transacting any business of the public body, and the public business is not discussed; or

- two or more members gather at a public forum, candidate appearance, or debate, the purpose of which is to inform the electorate and not to transact public business or to hold discussions relating to the transaction of public business, even though the performance of the members individually or collectively in the conduct of public business may be a topic of discussion or debate at such public meeting.

F.O.I.A.’s Meeting Requirements-In General

If the Tazewell County School Board is meeting, it must:

-Provide notice of 3 working days prior to regular meetings, “reasonable notice” for special or emergency meetings. Notice posted at Courthouse, Office of the Board Clerk, and on TCPS site. Citizens can request personal notice, too.

-Open meeting to public.-Take and maintain minutes which state

meeting date, time and location, members present, and which summarize matters discussed, proposed, deliberated, and votes taken.

F.O.I.A. Meeting Requirements – Closed

MeetingsF.O.I.A. exempts certain subjects from the requirement

that they be considered publicly. This allows the Board to move from an open session to a closed meeting as follows:

- A motion must be made, seconded and approved by the Board stating the purpose and subject of the closed meeting along with a citation to the Code Sections allowing the closed meeting.

-In the closed meeting, the Board must stay on the topics stated in the motion, and may take straw votes on those, but only those topics.

-Upon return to open session, the Board must certify that it only discussed the motion’s stated matters.

- All votes of the Board must occur in open session.

Board Meeting Policies- The final components to consider are the policies of the

Tazewell County School Board, which in large part “track” provisions found in Virginia’s Constitution and Statutes. (Policy always yields to constitution and code when in conflict.) In some cases, neither the Constitution or the Code provides guidance, but they do authorize the Board to adopt rules.

For example: Board Policy BDDE, entitled “Rules of Order”, states “Each School Board shall establish its own rules of order and shall adopt bylaws, policies and regulations.” Regulation BBDE-R adopts the familiar Roberts Rules of Order, in addition to providing a few specific rules, which track Roberts Rules.

GA-R.1 PERSONNEL GA-R.1 School Personnel Dress The Tazewell County Division is responsible for educating children to prepare them for successful and viable roles in society. It is the responsibility of all employees to serve as role models for students and to present a positive, professional image in language, behavior, and dress. Appropriate dress is a logical means of promoting respect for authority, traditional values, and discipline. Employees will contribute to the formation of a positive, professional public image by maintaining high standards of personal appearance through appropriate dress and grooming, regardless of job category. Guidelines

1. Employee ID Tags are required to be worn and visible at all times. 2. No display of body piercing (eyebrow, nose, tongue) that is disruptive to the

teaching/learning process will be allowed. 3. No jeans or overalls of any color or fabric are permitted, except on such days as

designated by the principal or superintendent. 4. Hats are not allowed to be worn in the building. 5. Male employees are required to wear pants, a collared shirt button-up shirt, a

necktie, and appropriate footwear (no sandals or flip-flops). 6. Female employees are required to wear either pants, a skirt or a dress of an

appropriate length. Acceptable tops include shirts, blouses, or sweaters that are appropriately sized and do not expose under garments. Flip-flops are not considered to be appropriate.

All substitute workers and volunteers must comply with the dress code established for regular employees. Exceptions The principal may establish guidelines for attire on days when school is not in session or on designated special days/events (Career Day, Read Across America, Homecoming, etc.). Physical educational personnel may wear loose fitting shorts of no more than 3” above the knee during physical education hours. It is suggested that when teachers or coaches leave the physical education area, “warm-ups” or skirts should be worn over or instead of the shorts, with a collared style “golf shirt” or “warm-up” jacket. On days when physical education classes are in a classroom, teachers are required to follow regular dress code standards. Agriculture and identified Career and Technical personnel may wear blue jeans. Attire for these employees should be appropriate for the instruction being conducted and in compliance with safety requirements. Transportation, Maintenance, Custodial, Computer Technicians, Food Service, and School Health personnel should be dressed appropriately for job requirements and in compliance with safety requirements.
