  • For the first time, TMCEC began a new academic year exclusively online (see page 3 for important details). Despite the pandemic, TMCEC aims to have as few cancelled or rescheduled events as possible. Technology will help us achieve this goal.

    TMCEC virtual learning will continue through at least February 28, 2021. Like the first two regional seminars of AY21, the Regional Judges and Clerks Seminars originally planned to be in-person in San Antonio, Galveston, and Houston will now be held virtually. Registration is open now for those events.

    VIRTUAL REGIONAL SEMINARS FOR JUDGES AND CLERKS

    When it comes to education, the pandemic has necessitated adaptation and change. But not everything has changed. TMCEC continues to conduct regional schools for judges and clerks.

    TMCEC Regional Seminars remain one of the best ways for judges and clerks to obtain their education hours. Texas is a big state (268,820 square miles). For more than 30 years, regional seminars have played a central role in how TMCEC provides continuing education to judges and clerks in cities of all sizes throughout the state. Like we said in the Fall Academic Schedule, each regional seminar will feature a common curriculum.

    However, each will also have a distinct and original regional flair, making it a one-of-a-kind event. We will be tailoring the online regional seminars scheduled in January and February to judges and clerks in South-Central Texas, the Gulf Coast, and the Houston Metro area. We will survey court personnel about concerns specific to those regions

    that we can address and discuss at the seminars. Regardless of what part of Texas your court is in, you can register for any of these online events. If you are unavailable on those dates, there is no cause for concern. Judges and clerks will have multiple opportunities throughout the academic year to attend a “live” regional seminar (whether online or in-person).

    VIRTUAL LOW VOLUME COURT SEMINAR

    After a 10-year hiatus, the Marfa Low Volume Court Seminar in February received high praise from judges and clerks. While we hoped to bring the seminar to South Texas, we are excited to bring the experience online to low volume courts across the state. The first virtual low volume seminar in November was a huge success. Another installment will be held virtually on January 27-29, 2021. Enrollment for this special event is limited. Register now. See details on page 7.

    LEVEL III ASSESSMENT CLINIC

    Those interested in becoming a Certified Municipal Court Clerk (CMCC), must attend a four-day, 24-hour Assessment Clinic sponsored by TMCEC. This year’s clinic is designed as a virtual workshop which emphasizes development of skills in court management and human resources. The clinic will be held virtually on January 25-28, 2021.

  • FROM THE CENTERAY 21 is off to a great start! As a reminder, because of the challenges of meeting planning amidst a pandemic, this academic year TMCEC plans to publish quarterly TMCEC academic schedules. Behold, the second installment, the document you are reading: AY 2021 Winter TMCEC Academic Schedule (January 1, 2021 – February 28, 2021). Online registration is now open for the events detailed in this schedule!

    The safety of participants, faculty, and staff remains a top priority at the Texas Municipal Courts Education Center. After carefully considering federal and state health guidelines and the potential for promoting the spread of COVID-19, in July 2020 TMCEC halted all in-person events. Exclusively virtual learning will continue through at least February 28, 2021.

    Despite the operational challenges posed by COVID-19, TMCEC continues to meet the needs of its constituents. With a new organizational focus on efficiency, sustainability, and collaboration, TMCEC is leveraging technology to diversify educational opportunities for judges and court support personnel as they navigate the new normal caused by the pandemic.

    TMCEC pioneered the use of webinars in Texas judicial education long before the onset of the pandemic. Since July, we have brought a similar pioneering spirit to distance learning. Last summer, in a span of only six weeks, using a combination of synchronous and asynchronous instruction and different virtual conference platforms, TMCEC hosted eight virtual statewide conferences. We extended that success into the fall with the first ever Virtual Regional Seminars for judges and clerks in East Texas and Central Texas.

    While we hope to resume in-person training in 2021, we are content to continue blazing a new path in distance learning. Regardless if it is in-person or online training, TMCEC is committed to providing unique and effective learning opportunities for judges and court personnel.

    Commitment and participation at these virtual events is still vital for a successful learning experience. It is important for cities and courts to understand that TMCEC virtual events, like in-person events, require time away from the regular duties of judges and court personnel. Travel is not required; undivided attention, however, is essential.

    Please plan to complete your requisite hours online. Do not wait for in-person training to resume in AY 21. Even when it is safe to resume in-person training, for logistical, public health, and other reasons, TMCEC will not be able to immediately resume large-scale training events offered prior to COVID-19. Accordingly, even when we can begin transitioning back to in-person training, technology will be key to safely accommodate the comparatively large volume of judges and court support personnel depending on TMCEC for continuing education.

    One last thing. Building on lessons learned since the pandemic began, in AY 21, TMCEC is takinga “no retreat, no surrender” approach to scheduled events. Our goal in AY 21 is to avoid canceling or rescheduling events. To promote certainty even during uncertain times, scheduled events that cannot be held in-person because of COVID-19 will be offered as a live, synchronous virtual seminar on the same scheduled dates.

  • The Waiver ProcessIf a judge is unable to complete the mandatory 16 hours of judicial education within the academic year (September 1, 2020 - August 31, 2021), he or she may request a waiver from the Municipal Courts Education Committee. A form to make this request can be obtained from TMCEC (800.252.3718) or online. The Committee typically reviews requests for waivers in September after the end of the academic year. If an emergency situation has occurred and is well-documented in the request for a waiver, the Committee may grant a conditional waiver that will require the judge to attend two conferences (one at his or her own expense) in the next year. Only in rare cases is an unconditional waiver granted. If a waiver is denied, the judge’s name is sent to the State Commission on Judicial Conduct. With all the programs being held this year, it is unlikely that the Committee will view requests for either unconditional or conditional waivers with any leniency.

    Judicial Education is still mandatory and more important than ever. According to the Rules of Judicial Education, all municipal judges (both attorney and non-attorney) must complete a minimum of 16 hours of judicial education every year. Newly appointed or elected attorney judges must satisfy their 16-hour requirements by attending an entire TMCEC regional conference within one year from appointment or election and another TMCEC regional conference in its entirety the following year. To qualify as an attorney judge, you must be licensed by the State Bar of Texas. Newly appointed or elected non-attorney judges must, within one year of the date of appointment or election, complete 32 hours of continuing judicial education from TMCEC before attending an entire regional conference the next year. After judges have completed at least two years of required judicial education through TMCEC, municipal judges must complete eight hours of judicial education through continuous in-person presentation from TMCEC, but may complete the remaining eight hours (often called flex-time) through in-person presentations, approved online education, or any combination of approved in-person events and online education (but see below for changes to the Rules of Judicial Education during the COVID-19 state of disaster).

    The TMCEC academic year is September 1, 2020 through August 31, 2021. Judges who have been on the bench longer than one year must attend an approved program once per year for judicial education credit regardless of birth date or date of appointment. This is a different reporting year than the State Bar’s Minimum Continuing Legal Education (MCLE) rules for attorneys, which are based on birth date.

    On March 30, 2020 the Court of Criminal Appeals issued an emergency order suspending all sections of the Rules of Judicial Education that require live, continuous hours of judicial education that would prevent a judge from completing his or her hours during the disaster.

    Here is a summary of the order:• All municipal judges are still required to complete 16 hours of judicial education by August 31, 2021.• Normally, each judge would need to satisfy at least eight of those hours (or all 16 for a judge completing a

    first or second year of education) through live, continuous training. Now, however, all 16 hours can be com-pleted by electronic means until thirty days after the Governor lifts the Declaration of State of Disaster.

    • The order only suspended required live, continuous training. It did not expand the list of approved online providers. (TMCEC is the only approved provider of online education for municipal judges.)

  • The Texas Legislature, the Court of Criminal Appeals, and the Texas Municipal Courts Association recognize the importance of training and allocating funds for the continuing education of municipal court personnel. Although annual court clerk education is not currently required by the state, TMCEC is pleased to offer court personnel the following winter virtual programs to enhance education and professionalism in procedural justice in Texas. See important notice on virtual conferencing on page 2.

    VIRTUAL REGIONAL CLERKS SEMINARSThe regional seminars feature sessions addressing a wide range of both legal and practical court issues. Participants can earn up to 16 hours of clerk certification credit. The seminars provide a foundation for building clerks’ knowledge of municipal court practices through courses related to judicial ethics, court processes, state reporting, and legislative issues. These programs help to promote a better understanding of the justice system and the laws that municipal courts must uphold.

    Note that court clerks may attend one TMCEC regional conference each academic year. The academic year runs from September 1, 2020 through August 31, 2021. If space is available, court clerks may attend more than one program at their own expense. The registration fee is $100.     LEVEL III ASSESSMENT CLINICThe purpose of the Level III Assessment Clinic is to build mastery and confidence in performance of management duties and become better prepared for providing efficient oversight of court operations. Participants can expect to practice collaborative problem solving, presentations, and public speaking. This clinic may only be taken once. Since the program began in 1997, 123 clerks have achieved Level III Certification, and 84% remain active within the certification program!

    To accomplish these goals, the program is typically limited to 30 or fewer participants. Participants areencouraged to make self-assessments of their own management and human resources skills. The virtual clinic is scheduled for:

    VIRTUAL LOW VOLUME COURT SEMINARAfter a 10-year hiatus, TMCEC relaunched one of our most popular seminar formats in 2020: the Low Volume Court Seminar! This seminar will be held online January 27-29, 2021.

    In 1999, TMCEC began offering a series of continuing education programs for non-attorney judges and their clerks. The Low Volume Court Seminar series offers opportunities for judges and clerks to collectively examine issues and problems commonly experienced in smaller courts that adjudicate fewer cases (i.e., low-volume courts).

    Constitutional law permeates almost every aspect of our lives both inside and outside the courtroom. In AY 2021, this seminar will revisit the application of state and federal constitutional law to procedures in municipal courts. Part retrospective, part examination of all that has changed in the last decade, the seminar will include instruction about magistration, juvenile law, traffic safety issues, and a brief legislative update.

    Important Notes about the Low Volume Court Seminar:• This seminar is for non-attorney judges and clerks who have previously completed two years of training.

    Priority registration is given to judges and clerks from the same court who attend together.• This seminar is ideal for judges and clerks who are interested in gaining a better understanding of how

    constitutional law informs procedure and administration. • This seminar provides 12 hours of judicial education credit for municipal judges. However, all judges must

    complete 16 hours each year. • Enrollment is limited so register now.

    The registration fee is $100. This event does NOT offer CLE credit.

  • VIRTUAL CONFERENCE INFORMATIONVirtual Conferences: Details about each virtual seminar, including login information, will be sent to each participant in a confirmation email.

    Policy on Persons with Disabilities: TMCEC will make every effort to accommodate the needs of persons with disabilities. If you need any such accommodations, please notify TMCEC.

    Registration: Registration for all winter virtual seminars is $100. Effective September 1, 2020, registration for TMCEC events is online only (register.tmcec.com). Payment of registra-tion fees is required prior to enrollment in all seminars.

    Cancellation Policy: If you have registered for a TMCEC program and find that you are unable to attend, you must cancel at least 10 business days before the conference starts to be eligible for a refund. Otherwise, after those 10 business days, you and/or your city will be given a credit to be used on a future program. Cancel by calling TMCEC and sending in a cancellation form. If you must cancel the day before the confer-ence due to an emergency, call TMCEC. If after hours, leave a message on the answering machine at the TMCEC office.

    Transfer Policy: Registration may be transferred between court employees, for the same seminar, within three busi-ness days of the start date upon completion of a transfer form located on our website. Participants may only transfer the registration fee one time. Once transferred to another event, funds are non-refundable if the participant does not attend.

    Need-based Financial Assistance: Individual cities or courts unable to pay the registration fees may submit a request for financial assistance. Applicants must provide written docu-mentation explaining the financial hardship 60 days prior to the TMCEC event. Requests for financial assistance and docu-

    mentation sent to TMCEC, in care of the Executive Director, will be submitted to the Education Committee.

    Course Materials: For all virtual seminars, materials will be provided on the virtual platform at the time of the seminar.

    Attendance: TMCEC asks that participants attend as much of the entire conference as possible. As our programs are underwritten by public monies, this ensures the best use of public resources.

    Record of Attendance: You will be provided a link to an evaluation and record of attendance to complete at the end of each seminar. It must be completed and submitted to TMCEC with your actual attendance hours to properly reflect on your annual academic transcript. Missing or incomplete forms will cause your hours to be incorrectly recorded in your transcript.

    CLE Fees: Regional judges seminars and courses are sub-mitted to the State Bar of Texas for CLE. TMCEC regional conference courses will be submitted to the Texas Board of Legal Specialization for credit towards the continuing legal education requirements for certification and re-certification in Criminal Law. All information regarding claiming CLE credit will be given to each attorney judge at the conclusion of the conference. Judges who are attorneys and who wish to have CLE credit reported to the State Bar of Texas by TMCEC may pay a $100 fee. The fee, which is voluntary, is deposited into private funds that are used for expenditures not allowed by the Texas Court of Criminal Appeals (compensation, membership services, and the building funds). The CLE is not required to receive judicial education credit. The voluntary CLE fee can be paid during online registration.

    Judges seeking to opt out must complete an application form before they have attended an approved alternative course to ensure that the course meets the requirements. Once reviewed by the TMCEC Executive Director or General Counsel & Director of Education, a letter of approval will be sent to the judge. Upon completion of the approved course, the judge must send an af-firmation of completion or certificate documenting attendance.

    TMCEC AY21 Webinar SeriesWebinars are available live and on-demand on the Online Learning Center (OLC). Webinar participation is open to all municipal judges, clerks, court administrators, prosecutors, and juvenile case managers. Webinar participation counts for one hour of credit toward the clerk certification program. Specific webinars noted with a label on the OLC count for one hour of judicial credit (red label) and others may be submitted to the State Bar for MCLE credit for attorneys (yellow label).   • RESOURCESHelpful Organizations/ State Agencies A practical method of obtaining additional knowledge about the municipal court and judicial process is to seek assistance from experienced courts in neighboring cities. Most municipal courts will be happy to assist others in need of help. When it is safe, an on-site visit to a neighboring court while in session may be particularly beneficial, especially for new judges and other new court employees.
