SUMMARY

Ii mpleimienitinig thc Vietnamese Communist Party's policy on the national

industrialization and modernization program, Electricity of Vietnam (EVN) has

established the project "System Efficiency, Improvement, Equitization and

Renewable Project (SEIER)" (3680-VN) financed by World Bank (WB). One of its

component is Dung Quat 220kV substation project with permanent land acquisition

is 27,749 mi2 . The substation is intended to construct on rice-field land nearby the

existing 110kV Dung Quat substation under Binh Thuan Commune, Binh Son

District, Quang Ngai Province

The Dung Quat 220kV substation is constructed for the purpose of supplying

power for Dung Quat industrial zone, mainly for Industrial Zone in the East and

Van Tuong city from the national power network and increasing the reliability in

power supply and power quality in the region.

1. Policy framework

The RAP project is established based on Decree 197/2004/ND-CP dated

December 3, 2004 of the Government regarding the compensation, resettlement

support when the State takes back the land; Decree 188/2004/ND-CP dated

November 16, 2004 of the Government regarding the method to determine the land

price and the price framework of land kinds; Decree 181/2004/ND-CP of the

Government regarding the implementation of Land Law, etc... and guideline on

RAP establishment of WB (the policy framework of unvoluntary resettlement OD

4.30). According to this policy, PAPs are people, households, entities with or

without juridical personality for their assets on project impacted land and

inventoried before the cut-off-date (September 25 h, 2004) are compensated

according to the Government's regulations.

2. Project impacts

The project causes impacts to the followings:

- P'ermanent land acquisition for construction of the substation and access

- Causing damage to paddy 24,998m2

- Results of project data collection show that there are 37 houselholds with

1 77 persons having impacted agricultural land

- No affect to cultural relics area, preservation area, pagoda and sensitive areas

- No ethnic minority household among impacted households.

- Dung Quat 220kV substation is expected to be constructed on rice-field

land, no impact to houses and land tenure, so no househould have to remove their

house.

- There are 5 impacted households over 25% area of agricultural land among

impacted households.

During public consultation process, project impacted households were agreed

to select the compensation procedure on land and assets in cash (impacted HHs over

25% land area included).

3. Compensation policy

The ending date of survey is September 2 51h, 2004. The price for making

compensation on land, assets and crops is based on the compensation unit price of

Quang Ngai Province.

All impacted households are entitled according to the policy framework and

Vietnam Decrees. Up till now, the survey result and damage inventory shows that

no remarkable impacts to people, the community and the public assets. As a result,

it is unnecessary to have economical recovery measures.

4. Public consultation

PAPs consultation to get feedback comments will restrict the contradictions and

delay when implementing the project. The resettlement plan will be implemented

following to the reference comments from the authorities and people in order to

maximize their participation in the resettlement plan and implementation as well as

socio-economical benefits. The authorities and people are consulted in substation

location, the resettlement policy, implementation of RAP and grievance mechanism.

During project implemiientation. grievances of impacted people will be solves

based on Vietnam lawv. All grievances will be solved equitably and the grievances

procedures will be guided by related authorities. The griever will pay no cost for

this grievance.

CPPMB and the local authority are responsible for monitoring the RAP

implementation process. In addition, an independent consulting agency will be

assigned to supervise independently and appraise the compensation and resettlement

implementation process in accordance wvith the policy stated in this dossier. This

agency can be selected and awarded the contract by the PMB after the approved

resettlement plan or selected and awarded the contract by WB. The supervising

activities are implemented from the beginning of project implementation stage. This

independent supervising agency will report to PMB or W1B about its results of

supervising activities.

6. Management organization

CPPMB is the project coordinating unit and cooperates with other agencies such

as the People's Committee of Quang Ngai Province, Power Company of Quang

Ngai Province and WB in implementing detailed works of project, especially the

RAP implementation plan.

9. Information dissemination

The draft RAP will be disclosed in Quang Ngai Province and the Information

Development Center of WB (VDC) at premises of 63 Ly Thai To Street, Ha Noi

City. CPPMB will send copies of entitlement statement form to the authority's Binh

Son District. All feedbacks from the local authority and people are considered and

supplemented into the RAP.

CHAPTER I

GENERAL INTRODUCTION

1.1 THE BASIS OF THE REPORT

The RAP report of Dung Quat 220kV substation project is set up with the

following basis:

+ The Master Plan of Viet Nam Power Network Development for the period

of 2001- 2010 taking into consideration the prospects till 2020 settled by Energy

Institute on January 2000, and revised project of the Master Plan of Viet Nam

Power Network Development in phase of 2001-2010 with considering up to 2020

prepared by Energy Institute on October, 2002.

+ Supplemental Report of Rehabilitation Planning and Power Network

Development of Dung Quat Industrial Park in the stage of 2002-2005 with

considering up to 2010 made by Institute of Energy on February, 2003.

+ Decision No.164/QD-EVN-TD dated January 1 9h, 2005 of EVN about the

aprroval of Feasibility Study Report of Dung Quat 220kV substation project.

+ Decision No.1752/QD-EVN-TD dated June 24h, 2004 of EVN about the

aprroval of Feasibility Study Report of Doc Soi - Dung Quat 220kV transmission

line project.

+ Decision No.554 EVN/DL3-8 dated January 315t, 2005 of Power Company

No.3 about the aprroval of technical design of the project Dung Quat Port 1 10kV

substation and transmission line connected to the substation.

+ Notice No.2328/UB dated November 27h, 2003 of People's Committee of

Quang Ngai Province about the agreement on the substation site for Dung Quat

220kV substation.

+ Economic Contract is signed between Central Power ProjectsManagement Board and PECC4.

1.2 PRINCIPLES AND OBJECTIVES

This report is set up with the purpose:

+ Study on policies of compensation, resettlement for households having land

acquisition for construction of the Dung Quast 220kV substation according to Viet

Nam laws and WB guidelines.

+Propose the alternatives of compensation, resettlement and the most efficient

way of implementation to the households having affected area. Ensuring that all

PAPs will be compensated for their losses and provided with rehabilitation measures

to assist them to improve, or at least maintain their pre-project living standards and

income earning capacity.

+ Help to choose the right design alternative, reduce the degree of damage at

the implementation of project and ensure the most economic and social advantages

of the project

+ Carry out to make livelihood-socio-economic damage survey of the project

area as well as working with the relevant authorities about compensation,

resettlement policies for affected households. The investigation work and collection

of data are mainly concentrated on the site of installation of substation.

The principle objective of the policy framework of unvoluntary resettlementOD 4.30) is:

All PAP's residing, working, doing business, at least maintain, their pre-

project living standards and income earning capacity as of the date of the baseline

surveys are entitled to be provided with rehabilitation measures sufficient to assist

them to improve. Lack of legal rights to the assets lost will not bar the PAP from

entitlement to such rehabilitation measures.

During RAP preparation, Decrees and Circulars of Vietnamese Government

such as Decree 197/2004/ND-CP, Decree 181/2004/ND-CP, Decree 188/2004/ND-

CP, etc..and Decisions about compensation unit price issued by The peoples'

committees of provinces are applied. The entitlement policy in this RAP are

suggested as follows:

+ Apply a compensation rate according to the market price or replacement

cost: Compensation of land and crops (short-day crops) at market price.

Compensation of house and trees (long-day tree) at conversion price

+ All affected properties are legible from the cut-off-date (September 25tIX

2004). The affected households who have been registered will be compensated.

This RAP will be valid after GOV's and WB's approval.

1.3 VALIDITY OF RAP IMPLEMENTATION

Resettlement and compensation program for PAPs, policy and provisions on

resettlement and compensation entitlement in RAP will be applied after approval of

WB and Vietnamese Government.

Before implementing resettlement and compensation program, the project

owner and local authorities should check and revise the applied compensation costs

in this report. If there is any compensation unit price non-conforming at the time of

program implementation, the local authorities and Resettlement and Compensation

Board (RCB) need to revise them to ensure sufficient compensation payment for

PAPs according to principles stated in RAP.

Survey data in this report base on investigation report in the phase of

feasibility study of the project and update them as per the approved alternative.

1.4 DESCRIPTION OF THE PROJECT

1.4.1 Project location

The 220kV Dung Quat substation is intended to construct on rice-field land

nearby the existing 110kV Dung Quat substation under Binh Thuan Commune,

Binh Son District, Quang Ngai Province with total area of 27,749m2. The

geographical situation is as follows:

- North adjacent to land area for planted rice

- South adjacent to existing 110kV Dung Quat substation

- East adjacent to wild hill land

- West adjacent to inter-district pathway and populated area

1.4.2 Project characteristics

* Voltage and capacity: The substation is dcsigned with tw o transformers

220/110/22kV-125MVA. One transformer 220/ l0/22kV-125MVA will he installed

in this phase. The 22kV voltage level is not use.

* Single line scheme:

- 220kV side: Apply the scheme "Double busbar system with transfer bus,

bus-section circuit breaker in combination with bus coupling breaker". The

configuration "two transmission lines - one transformer" will be applied in this

phase. The 220kV switchgear shall be outdoor.

- 110kV side: Apply the scheme"Double busbar system with transfer bus,

bus-section circuit breaker in combination with bus coupling breaker". The l lOkV

switchgear shall be outdoor.

* Main transformer:

- Type: 3-phases, outdoor - autotransformer

- Voltage level: 225 ± 8x1.25%/121/24kV

- Capacity: 125MVA

- Ratio of capacity: 125/125/30%.

* Main electrical equipments:

- 220kV circuit breaker

- 220kV disconnector switch

- 220kV current transformer.

- 220kV voltage transformer

- 11 OkV circuit breaker.

- 11 OkV disconnector switch.

- 11 OkV current transformer.

- 11 OkV voltage transformer.

- 110, 220kV surge arresters

* Control-protection and measuring system:

The control and supervisory system of Dung Quat 220kV substation is

controlled by computer according to 4 levels:

* Level 1: Control centers (NLDC and CRLDC)

* Level 2: Station level

* Level 3: Bav lcvel

* Level 4: Equipment level

Protection relay uses digital type with outlet to connect to station computer

and SCADA/EMS system.

Control system at station level shall be of indoor; the protection and control

system at bay level will be outdoor. The protection and control equipments are

linked by the 1OOMbps Ethemet network.

* Service power supply:

- 380/220VAC power supply.

- 220VDC power supply.

* Communication and SCADA systems.

The optical communication equipment SDH/STM-4 is synchronously

equipped, supplement STM-4 card for existing optical transmission equipment at

Doc Soi 500kV substation to set up the optical communication route STM - 4

between Doc Soi 500kV substation and Dung Quat 220kV substation. The PCM

multiplexer and teleprotection equipment are newly equipped.

The SCADA system is controlled by computer; 01 connecting gateway is

equipped to link the National Load Dispatch Centre and Central Load Dispatch

Centre according to the standard IEC 60870-5-101.

* Earthing and lightning systems .

- Earthing system: Pile and bar types are used; and at the same link to the

earthing system of existing Dung Quat 11OkV substation. The earthing piles are

used copper galvanizing steel with 022 type, 3m length. The earthing bars are used

stranded copper conductor M95. The connection between the piles and conductors

or conductors and conductors are used CadWeld.

- Lightning system: Lightning arrester and lightning rod are installed on the

portal poles of 220kV and 11 OkV switchgears.

* Lighting system:

Control room's lighting system: The 40MW neon lamp is used for Nvorking

and 100W incandescent lamp, exploded- protection type is used for in fault.

Outdoor lighting system:

- Lighting system for 220kV, 110;kV switchgears are used 500W flood-light

installing on the independent lighting pole.

- Control room's lighting system used 250MW high-pressure mercury lamp

installing at control room.

- Lighting system around the substation used 75W sphere lamp installing on

the towers with height of 3.4m. The lamp towers is installed distant of Im from the

substation fence and about 25-35m putting one lamp tower.

* Water drainage - supply system and fire extinguishing:.

- Water supply system: including 01 drilling well, water pump, 02 water

tanks and water pipline made by galvanizing steel.

- Water drainage system: including one PVC pipeline and collecting wells.

- Fire extinguishing system: To observe the regulated requirements, the fire

extinguishing system shall be of floating system including 01 pumping station in

emergency case, 02 water tanks with 100m3 capacity, pipeline and foam fire

extinguishers. As for transformer used fixed spray water platform; The fire

extinguishers and fire-fighting tools are fully equipped in the substation such as

CO2 vessel, basin, hook, sand, oil gathering reservoir for break-down.

* Construction solutions:

- Total land acquisition area of the whole project: 27,749m2.

- Skeleton of substation's base leveling used skeleton base of the existing

Dung Quat 1 10kV substation; the average skeleton is 8.68m, the substation base is

mainly soil filling.

- Transformer's foundation, gantry tower, equipment supports: Reinforced

concrete

- Gantry tower, arms, equipment supports: Hot dip galvanizing figural steel

- Control cable trenchies: UJsing ditch of burried cable. the walls and bottom

are made of concrete cast on site, the inside of suspension rack, the width of trench

is 0.4 - 0.6metres.

- Road inside the substation wvith width of 3m and 4m: Concrete

- Road ouside the substation with width of 4m: Concrete

- Control house: Structure of one storey, dimension 12m x 30m2, height of wall

to ceiling 4.2m. Main bearing force structure made of all-block reinforced concrete,

wall by brick, the tower's foundation by reinforced concrete, the wall foundation by

hewn stone.

- Shifting house for operation workers: including 07 rooms, the area of each

room is not over 30m2, total construction area is not over 370m2, total land

acquisition area of house and access road (including embankment slope) is 778m2.

- House with no upstairs, main bearing force structure made of all-block

reinforced concrete, wall by brick, the tower's foundation by reinforced concrete,

the wall foundation by hewn stone, house roof made by reinforced concrete with

colour-tin-roofed.

At present, there is one section of 22kV line locates on the proposed site of

Dung Quat 220kV substation. For this reason, this line section must be move out of

the substation location.

- Starting point of moved line section: Feeder bay 476 of 110/22kV Dung

Quat substation.

- Ending point: New construction tower on Binh Thuan line distant of 15m

from Binh Thuan 1 substation.

- Voltage level: 22kV.

- Number of circuit: 1 circuit

- Length of the line: 421m whereas there are 237m overhead line and 184m

underground line.

- Conductor: ACKr -120mm2 is used for O/H line and underground cable

used conductor LPE -24kV-3x240mm 2

1.5 PROJECT IMPACTS ON LAND AND ASSETS

- Permanent land acquisition land to construct the substation and access road to

the substation is 27,749m2.

- Dung Quat 220kV substation is expected to be constructed on on rice-field

land, so no impact to houses and land tenure, only affect to the agricultural land.

Whereas:

+ Land area for planting rice with 2 crops :24,998m2.

+ Land area of irrigation canal : 2,751 2 .

1.6 PROJECT IMPACTS MITIGATION MEASURES

Selection of substation location: For the investigation and design of

substation must conform to the followed requirements:

+ Conforming to Power Network Planning and socio-economic conditions of

* Project Management Board (PMB)

Central Power Projects Management Board is reponsible to EVN for directing

the whole project including the implementation of RAP from impact survey,inventory, making plans for RAP implementation. Main tasks of PMB will be:

+ Making Master Plan, management and supervision of land clearanceimplementation to ensure full determination of relating PAPs, set out satisfiedentitlements as per land clearance policy.

This is a project with loan from World Bank so the legal grounds applied will

be a combination of Vietnam and WB policies.

a. The Legal Documents of the Government of Vietnam

The Constitution of Vietnam, 1992 confirms the right of citizens to own a

house and to protect the ownership of the house.

According to Vietnam Law on land passed by National Assembly Term XI,

Session IV on November 26h, 2003 and come into force from July Ist, 2004.

b. World Bank Policy on Involuntary Resettlement (OD 4.30)

* The primary objective of this policy is to ensure that PAPs who have lost

assets are compensated at replacement cost and are provided with recovery

measures to help them improve better or at least maintain their standard of life and

their income capacity as in pre-project conditions.

* The policy framework is established based on the principles and objectives,

selection criteria for PAPs, entitlements, legal framework and institutions, mode of

rehabilitation and compensation, the participation of people. Furthermore,

procedures of grievance will be guided in the process of compensation, resettlement

and rehabilitation for PAPs.

c. Comparison between Government of Vietnam and World Bank

Approaches

* There are a number of ways in which the approaches of the Vietnam

Government - both in policy and practice - are compatible with World Bank

guidelines so that PAPs can have legitimate entitlemencts. The most important

compatibilities are:

Vietna-n has a process wvhereby most people wvithout legal land rights may

meet conditions of legalization and receive compensation for losses.

* Permanent residents are provided with options that include relocation to an

improved site, or cash, or a combination of the two.

* Resettlement sites offer not only better-improved infrastructure and services

but also represent a higher standard of living.

* Allowances are provided to help the PAPs in the transition period and there

is an institutional structure through which people are informed, can negotiate

compensation, and can appeal.

Differences between the approaches and measures that need to be addressed

within the program also exist. However, in this context, procedures exist within

National and City governments that allow the granting of waivers of domestic law

on specific projects that may be in conflict with that of the funding agency.

d. Required Waivers

In order to meet the requirements of the World Bank OD4.30 on Involuntary

Resettlement a number of articles in various Vietnamese laws and regulations which

do not ensure compensation at replacement cost or set eligibility provisions which

do not extend the right to rehabilitation and or assistance to households without

proper land paper, will be waived.

* Price of Land for Calculation of Compensation

According to Vietnam regulations, the calculation of land price for

compensation will be based on Decree 188/2004/ND-CP, Decree 181/2004/ND-CP,

etc and Circulars No.1 16/2004/TT-BTC, No.1 14/2004/TT-BTC.

To ensure that the objectives of the project resettlement policy are met, unit

price for land compensation established by the People's Committee of Phu Yen

Province will be adjusted to meet at replacement costs.

The Item 4, Article 2 of Decree 17/2001/ND-CP dated May 04, 2001 to

guide on the ODA management stipulates that "in the case of the international

CHAPTER 3

ENTITLEMENT POLICY

3.1 DEFINITION OF ELIGIBILITY AND LIMITATION TO ELIGIBILITY

Project Affected Persons (PAPs) including people confirmed by data collected

from the survey and investigation process as follows:

- PAPs have land or cultivalted land which are partially or totally affected

(temporarily or permanently) by the project.

- PAPs have crops (annual and perennial) and trees which are partially or

totally affected by the project.

- Encroachers who settled into the proposed affected area after the cut-off date

(September 25h, 2004) will have no entitlement to compensation and resettlement.

They will be required to demolish their structure and cut the trees or harvest their

crops for land clearance to the project. In the case necessary, they will be forced to

be removed out of the proposed project area. Nevertheless, they do not have to pay

any fine or sanction.

3.2 RESETTLEMENT AND COMPENSATION PRINCIPLES

The compensation and resettlement plan is established based on fundamental

principles, i.e conforming to laws, decrees, policies regulated by Vietnamese

Government and WB's guidelines consisting of:

1. Acquisition of land and other assets, and resettlement of people will be

minimized as much as possible.

2. All PAP's residing, working, doing business or cultivating land in right of

way (ROW) of transmission line, surrounding areas of tower foundation,

the substation areas, in the service roads under the project as of the date of

the baseline surveys are entitled to be provided with rehabilitation

measures sufficient to assist them to improve or at least maintain their pre-

project living standards, income earning capacity and production levels.

3. The rehabilitation measures to be provided are: (i) compensation at

replacement cost, without deduction for depreciation or salvage materials for

houses and other structures; (ii) agricultural land for land of equal

productive capacity acceptable to the PAPs or in cash at replacement cost

according to PAP's choice ; (iii) replacement of residential/premise land of

equal size acceptable to the PAPs or in cash at replacement cost according to

PAP's choice ; and (iv) transfer and subsistence allowances.

4. Location of resettlement and relocation should be as close as possible to

existing residential area of PAPs.

5. The resettlement transition period will be minimized and the rehabilitation

means will be provided to the PAPs not over one month prior to the

expected start-up date of works in the respective Project site.

6. Plans for acquisition of land and other assets and provision of rehabilitation

measures will be carried out in consultation with the PAPs, to ensure

minimal disturbance. Entitlements will be provided to PAPs not over one

month prior to the expected start-up date of works in the respective Project

site.

7. The standard of life, the infrastructure of community must be maintained or

improved better than their prior place.

8. Financial and physical resources for resettlement and rehabilitation will be

made available and as where and when required.

9. Institutional arrangements will ensure effective and timely design, planning,

consultation and implementation of RAP.

10. Effective and timely supervision, monitoring and evaluation of the

implementation of RAP will be carried out.

3.3 ELIGIBILITY TO COMPENSATION ENTITLEMENT

Legitimate PAPs are all the affected households and institutions included in

dcmonstratc with other means that prior to RAP cut-off date they owned, rented or

used land, and properties associated Nvith land as defined in 3.1 item

3.4 ENTITLEMENT POLICY

PAP's will be entitled to the following types of rehabilitation and assistance measures:

* PAP's losing agricultural land and crops

(i) The general mechanism for compensation of lost agricultural

land will be through provision of "land for land" arrangements of

equal productive capacity, satisfactory to the PAP.

However, if the PAP prefers to receive cash compensation then

the following applies:

- if the portion of the land to be lost represents 25% or less

than 25% of the total area of the landholding, and the

remaining land is still a viable economic holding, cash

compensation, at full replacement cost, may be provided to

the PAP; or

- if more than 25% of a villager's agricultural land is

acquired and the remaining holding is not viable then the

Project will acquire the entire landholding and provide

cash compensation at full replacement cost.

(ii) PAP's will be compensated for the loss of standing crops and fruit

or industrial trees at market price. Productive trees will be

compensated at replacement cost. Fruit trees will be compensated

for the remaining harvests.

(iii) PAP's whose land is temporarily taken by the works under the

each sub-Project will be compensated for their loss of income,

standing crops and for the cost of soil restoration and damaged

infrastructure. Land will be rehabilitated after the project

construction by PMB.

Pursuant to Decree 1 97/2004/ND-CP issued by the GOV concerning

compensation, resettlement support for recovered land by GOV, then PAPs will be

supported as follows:

- As per Article 28: Restoration allowance

Households, people directly make agricultural production, when being

recovered more than 30% area of assigned agricultural land, will be supported for

stabilizing the life within 3 months without relocation and within 6 months with

relocation; in case relocate in areas with difficult or especially difficult socio-

economical conditions then the support time is maximum of 12 months. The support

level in cash for one person per month equivalent to 30 kg of rice calculated as per

the average price in local region.

When the GOV recovers land of economical entities, registered business

households and causes business pausing, the maximum support level is 30% of an

annual income after tax, according to the average income of three subsequent years

before confirmed by the tax agency. The support level in details are regulated by

Provincial PC in accordance with the local reality.

- As per Article 29: Support for changing the career and creating employment

Households, people directly make agricultural production, when being

recovered more than 30% area of assigned agricultural land, will be supported for

changing the career for people in the age of labour. The support level in details areregulated by Provincial PC in accordance with the local reality.

- As per Article 31: Support level when recovering the public land ofcommunes, wards or towns

- Other support such as beside the support regulated in Articles 27, 28, 29,

30 and 31 of Decree 197/2004/ND-CP, pursuant to the local actual situation, the

Chairman of Provincial PC decides the other support measures to ensure the life andproduction stabilization for people who were recovered the land; in special cases,

this will be submitted to the Prime Minister for decision.

CHAPTER 4

CENSUS AND SOCIO-ECONOMIC SURVEYS &

THE PROJECT IMPACTS

4.1 SOCIO-ECONOMIC CONDITIONS OF PROJECT AREA

The natural land surface of Quang Ngai Province is 51,352 km2 , the population

counted to December 31 th, 2002 is of 1,244,814 people. For administration

organization, there are 1 80 communes (wards, townlets), 13 districts and 01 town.

Quang Ngai town is the political economic and cultural center of the province.

The National Road IA of 98km length runs from North to South of Quang

Ngai Province together with traffic roads disposed evenly on the whole province,

connecting areas of materials, industrial zones, plain with the mountainous area,

serving the transport,. exchange goods between province with other regions in the

whole country. There is system of sea ports such as Dung Quat and Sa Ky,

especially Dung Quat deep water port, sooner and later, will be one of the important

gates to the sea of areas of Central, Western Highlands Provinces, Laos and

Cambodia via the National Road No.24. In the future, Quang Ngai Province will

have Van Tuong City, industrial zones such as Tinh Phong, Dung Quat contiguous

with Chu Lai open economical zone, etc...

Quang Ngai Province have famous historical monument such as tunnels of

Dam Toai, combat achievement of Van Tuong, etc... and many beauty spots as

huge foot, the cape of Ba Lang An,.. .. In recent years, Province has rehabilitated and

embellished these vestiges aming to attract the tourists inside and outside country.

* Project impacted area (Binh Son District)

- Total natural area of Binh Son District is 46,538.6 ha in which agricultural

land area is of 17,585.6 ha; forestry land area is of 9,107.2 ha; special use land area

is 4,574 ha; residential land area is of 854 ha; unused land is of 14,159.2 ha and rear

& grow land area of 258.6 ha.

- Total population of Binh Son District in 2002 is 176,286 people, the

population density is 378 persons per square kilometer

Main characteristics of major economical sectors of Bin/h Soni District in 2002:

+ Agricultue, Forestry anid Auqaproduct: Life of people in these productive

sectors has much good change. agricultural production value increases compared

with the last year, and economical structure of agriculture and countryside has right

direction transfer (i.e decreasing agricultural rate, increasing rate of forestry, fish-

breeding and rear & grow).

Development direction of agriculture and countryside economical structure:

rapidly put technological science advances into agricultural and forestry production

(rehabilitation and upgrading the existing water reservancy system, apply

technological science in selecting breed for cropplants and rearing animals, put

machines into production, etc...). Especially in catching fishes and rear & grow

aquatic product, it needs investment in purchasing off-shore ships and boats and

apply strictly to process of rear & grow aquatic product as per industrial direction.

Area of artificial forest in 05 years from 1998 to 2002 is of 1,155 ha and

3,640,000 trees. Estimated to 2002, the households and units have managed 9,107.2

ha forest

+ Industrial sector: The province has paid attention to develop some

advantageous industrial sector such as: the industry of processing agriculture,

forestry, aquiculture related to development of material zone, high development of

construction material industry beside many preferential policies for enterprises

investing capital industrial zone.

The development direction in few years is to give priority to depth investment,

renovation of technology equipment, increase quality and decrease cost price of

products.

4.2 PROJECT IMPACTS

Categories of Project impacts:

Safe corridor for the substation is defined on the Decree No.106/2005/ND-

CP issued August 17th, 2005 by the GOV regulates in detail and guidelines to

implement some articles of Power Sector Law on the protection of the high voltage

networks.

Investigation and statistic of project impacts are carried out from 2004. results

of surveys is as followvs:

- Permanent acquisition land for construction of the substation is 27,749 rn

Whereas:

+ Acquisition land area of substation and access road to the substation

: 26,177m 2

+ Acquisition land area of watching house in shifts and access road to the

house . 778 m2

+ Land area of irrigation canal : 794m 2

- Categories of impacted land: The substation area is intended to be

constructed on rice-field land, so land loss is mainly agricultural land.

Total agricultural land area occupied . 27,749 m2

Whereas:

+ Land area for planting rice with 2 crops : 24,998m2

+ Land area of irrigation canal . 2,751 m2

- Affected trees are wet rice

- In the construction site of Dung Quat 220kV substation, there are 37

households with 177 persons having impacted agricultural land. No impact to

houses and land tenure, so no househoulds have to remove their house.

CHAPTER 5

PUBLIC PARTICIPATION AND CONSULTATION

5.1 Objectives of information campaign and consultation program

Information dissemination to consultation with and participation of the

affected people and involved agencies (i) reduce the potential for conflicts (ii)

minimize the risk of project delays and (iii) enable the project to design the

resettlement and rehabilitation program as a comprehensive development program

to fit the needs and priorities of the affected people thereby maximizing the

economic and social benefits of the project investment.

The objectives of the Public Information Campaign and PAP Consultation

Program are as follows:

* To share fully information about the proposed project its components and

its activities with the affected people.

* To obtain the cooperation and participation of the affected people and

communities required to be undertaken for resettlement planning and

implementation.

* To ensure transparency in all activities related to land recovering,

compensation, resettlement and rehabilitation for PAPs.

* To obtain information about the needs and priorities of the affected people

as well as information about their reaction/feedback to proposed policies and

activities. PAPs will be entitled to participate in different stages during the process

of investigation, survey, RAP preparation and implementation. They will be invited

to participate in meetings organized by the owner and local authorities in order to

offer opinions on replacement alternatives, entitlement policies, listening to

procedures, process of grievance implementation, responsibility of competent

institutions and responsibility of PAPs during the process of RAP implementation.

5.2 INFORMATION CAMPAIGN, PAPs & AGENCY CONSULTATION

There are two phases of the public information campaign and RAP

consultation:

Plhase 1:

During RAP planning and survey, make interviews with PAPs for theirexpectation and selection of compensation measures. During the process of

-~ -investigation, make coordination with local authorities for agreement on substationsite selection.

Plhase 2:

After RAP's approval, PMB and local authorities will organize meetingswith PAPs to announce information of project, compensation policy andentitlement, replacement solutions, allowances, subsidy mentioned in RAP plan.

To ensure that PAPs, their representatives and local governments of theaffected areas fully understand on the details of RAP, PMB will also announce to allPAPs the compensation and rehabilitation policy applied in the project beforemaking compensation and resettlement payment for PAPs.The RIB will contain information on the followings.

- Project description.

- Project objectives

- Implementation schedule

- Project impacts

- Entitlements policy for the project affected people- Institutions are responsible for resettlement

- Specific entitlements of PAPs

- Description of the detailed impact of the project on the specifichousehold- Compensation rates for each type of impact- Legality and Eligibility to compensation

5.3 INFORMATION DISSEMINATION AND PAP's CONSULTATION

According to policy applied in this project, all PAPs are entitled to projectinformation, entitlement to compensation. All PAPs have the right to take part inRAP implementation to ensure that they enjoy proper compensation.FS on Dung Quat 22OkV substation

PAPs, officially informed the participants of the project purposes. PAPs will be

asked for their opinions, their options for compensation modes.

The first time:

It is expected to organize before carrying out the compensation payment works

with the above mentioned content, but the compensation policy is pressed in order

to take advantage of PAP's participation, ensure the fair and adequacy of inventory

and survey work

Participants are:

- Representative of PMB

- Representative of Resettlement Committee of Quang Ngai Province

- Representative of District PC, Resettlement Committee of Binh Son District

- Representative of Binh Thuan Commune

- PAPs or their representatives

The second time:

It is expected to organize before resettlement and compensation payment,

with the same content of the 1st time but compensation policy and schedule are

pressed to ensure the fair and give favorable condition for site clearance work.

- Representative of Resettlement Committee of Quang Ngai Province

- Representative of District PC, Resettlement Committee of Binh Son District

- Representative of Binh Thuan Commune

multi-media means such as newspapers. television, local radio station about the

project such as the stages of project development, information on RAP and project

impact on the community in the project area.

CHAPTER 6

GRIEVANCE AND APPEALS

The main objective of RAP implementation is to ensure the fair andadequacy during compensation payment for PAPs. The resettlement andcompensation program should satisfy both parts: Owner and PAPs. Grievances andcomplaints related to Project Owner and PAPs during RAP implementation. Tosolve them timely and effectively, relevant institutions such as PMB, ResettlementCommittees of Phu Hoa District and Phu Yen Province need to respond to thecomplaints of the PAPs speedily and sensibly, avoid project delays and difficulty forPAPs. The solution should be agreed by PAPs

During the project implementation, PAP's complaints and grievances will bedealt with according to the regulation of Vietnamese laws. PAPs raising complaints

will be treated fairly and guided by related agencies on the order, procedures and

complaints of RAP, in addition no fee will be paid for their complaints.

Since the entire resettlement and rehabilitation program is being carried outwith the participation of the PAPs. However, to ensure that the PAPs have avenues

for redressing their grievances related to any aspect of compensation andresettlement, detailed procedures of redresses of grievances have been established

for the project. The mechanism is designed to be easy, transparent and fair.

The procedures are as follows:

Complaints and grievances related to any aspect of RAP's, including thedetermined area and price of the lost assets, will be handled as follows:

First step:

If any person is aggrieved by any aspect of the resettlement and rehabilitation

program, he/she can lodge an oral or written grievance with commune authorities.

Commune People's Committee will resolve the issue within fifteen days from thedate it receive the complaint.

If any aggrieved person is not satisfied with the decision in stage 1. he/she

can bring the complaint to the District People's Committee (DPC) or District

Resettlement Committee (DRC) within fifteen days from the date of the receipt of

the decision in stage 1. The District People's Committee (DRC) or District

Resettlement Committee (DRC) uvill reach a decision on the complaint within

fifteen days.

Third step:

If the PAP is still not satisfied with the decision at district level, he/she can

appeal to the Provincial People's Committee (PCC) or Provincial Resettlement

Committee (PRC) within 15 days of receiving the decision of the DPC or DRC. The

Provincial People's Committee (PRC) or Provincial Resettlement Committee (CRC)

will reach a decision on the complaint within fifteen days.

Fourth step:

If the PAP is not satisfied with the decision of the Provincial level, the case may

be submitted for consideration by the District Court within 15 days of receiving the

decision of the PPC or PRC.

PAP's will be exempted from all administrative and legal fees.

Coercion for site clearance can not be applied while PAPs are waiting for

solving the complaints.

In case an oral compliant is made, it will be written on paper by the commune

and processed. Commune People's Committee will resolve the issue within 02

weeks.

In case of PAPs are illiterate persons, they can make an oral complaint with

the representatives of affected households and their representatives will record all

queries to submit to authority levels.

Every authority level will resolve the complaints as per the time regulated

above.

The disputes are organized publicly and implemented in accordance with law.

Detailed procedures for redress of grievances and appeal process shown publicized

among the PAPs during participation meetings and also in the offices of RBs.

CHAPTER 7

MONITORING & SUPERVISION

Implementation of RAPs will be regularly supervised and monitored b) therespective PCs/PMB in coordination with the respective District and CommunesPeoples' Committees and Communes. The findings will be recorded in quarterlyreports to be furnished to EVN or MOI.

7.1. INTERNAL MONITORING & SUPERVISION

Internal supervision and monitoring include the following activities:- Verify that the baseline information of all PAP's has been carried out and

that the valuation of assets lost or damaged, and the provision of compensation,resettlement and other rehabilitation entitlements has been carried out in accordancewith the provisions of this Policy Framework and the respective RAP.

- Oversee that the Inventories and RAP's are implemented as designed andapproved.

- Verify that funds for implementing the Inventories and RAP's are providedto the respective PMBs at local level (provincial/district) in a timely manner and inamounts sufficient for their purposes, and that such funds are used by the respectivePMB's in accordance with the provisions of RAP.

- Record all grievances and their resolution and ensure that complaints are dealtwith in a timely manner.

7.2. Independent monitoring

An independent agency or individual consultant will be retained by PMB ofthe MOI and EVN to periodically carry out external monitoring and evaluation of theimplementation of RAP's. The independent agencies will be academic or researchinstitutions, non-Governmental Organizations (NGO) or independent consultingfirms, all with qualified and experienced staff and terms of reference acceptable to theWorld Bank.

In addition to verifying the infornation furnished in the internal supervisionand monitoring reports of the respective PMBs, the external monitoring agency willUS on Dung Quat 220kV substation

visit a sample of 20% of household PAPs in each relevant province six montlhs aftereach RAP implementation to:

- Determinie whether the procedures for PAPs participation and delivery ofcompensation and other rehabilitation entitlements has been done in accordance withthis Policy Framework and RAP.

- Assess if the Policy Framework objective of enhancement or at leastrestoration of living standards and income levels of PAPs have been met.

- Gather qualitative indications of the social and economic impact of Projectimplementation on the PAPs.

- Suggest modification in the implementation procedures of RAPs, as the casemay be, to achieve the principles and objectives of this Policy Framework.

IMPLEMENTATION ORGANIZATION ON

COMPENSATION AND RESETTLEMENT PLAN

8.1. MEASURES FOR THE PROJECT IMPLEMENTATION

8.1.1. Announcement to PAPs

All PAPs shall be thorough informed about the rights and policies of RAPincluding entitlement policies, rate of compensation for every type of impact, theactive participation right in land acquisition process, complaint and grievance. RAP

information will be prepared by PMB and announced to all PAPs or informed at themeetings in province, district and commune levels; on television, radio, newspaper,

hung in public places such as administrative quarters of communes and schools.

Public announcement tasks shall be implemented immediately after EVN andWEB's approval of project is obtained. The information announced consists of:

+ Schedule of project implementation

+ Eligibility and non-eligibility to compensation and resettlement

+ The compensation principle: only make compensation for households usingland before inventory making and the official announcement about land acquisition

of State.

8.1.2. Compensation deadlines

The project impacts conclude households with areas of agricultural landaffected permanently. PAPs agreed to receive compensation amount so the RAP iscarried out in package to PAPs. Compensation payment for land, assets, paddy andcrops; land delivery for resettlement should be done at least 02 months before theproject land acquisition.

PAPs will receive subsidies at the beginning of months and after theirreceiving, they will have to transfer land for Site Clearance Board at least onemonth before construction time.

8.2. RAP implementation process

implementation.

Basic actions of the project

Action 1:

After RAP approved, PMB hires qualified agency for independent

monitoring, this agency must be approved by EVN and WB

Action 2:

Provincial authorities and PMB are required to supply Resettlement

Committees with fully costs and declare the tasks for RAP implementation.

Action 3:

District Resettlement Committees carry out the Detail Measurement Survey

of affected assets and socio-economic conditions, determining the compensation

unit price and if necessary, checking and readjusting it in order to make

compensation at market price and conversion price.

Action 4:

Immediately the ends of final inventory survey, Resettlement Committees

of Districts will inspect and define the official number of PAPs, impacted properties

and total compensation amount for PAPs.

Action 5:

Resettlement Committees will officially announce the RAP policy, schedule

of project implementation and information for RAP to PAPs at public meetings

including issues related to compensation, resettlement and land clearance.

Action 6:

It is suggested to give priority to compensation payment for households with

permanent impacts, assisting them in transferring the production mode and

During the project implementation, Independent and Internal MonitoringInstitutions will supervise/ monitor all actions of RAP implementation, at the sametime giving proposals, discussions or report the changes during projectimplementation as well as suggest solutions.

8.3. RAP implementation schedule

RAP will be implemented as per the schedule established to ensure the siteclearance work and schedule on project construction.

Payment of rehabilitation and fumishing of other restoration/assistanceentitlements is made in cash.

Organizational arrangement

Power companies and Quang Ngai Province will arrange full experiencedstaffs to ensure that RAP will be implemented smoothly as per the acceptedschedule.

COST AND BUDGETS

9.1. BUDGETS

Budget for RAP implementation will be from the self-financed capital andloans from WB. EVN entrusted Central Power Projects Management Board

(CPPMB) with management and directing project's activities as well as projectfinance management.

CPPMB has coordinated with the province, district, department of Financeand Goods Price, Resettlement Committee at all levels to implement compensation

payment.

9.2. DETERMINING THE COMPENSATION PRICE

Compensation cost estimate for temporary and permanent impacted houses,

structures, agricultural land, forestry land, cultivated land, trees and crops based on:

- Decree No.197/2004/ND-CP issued by GOV on December 3rd, 2004

regulates compensation, resettlement support for recovered land by GOV.

- The Government Decree No.188/2004/ND-CP issued November 16'h,

2004 by the GOV on the stipulation of method to determine the land price

and the frame for the price of land types.

- Decision No.19/2005/QD-UB issued February 7th, 2005 by the People's

Committee of Quang Ngai Province regulates compensation, resettlement

support for recovered land by GOV applied on the area of Quang Ngai

Province.

- Decision No.31/2005/QD-UB issued March 7"h, 2005 by the People's

Committee of Quang Ngai Province on the stipulation of the price of land

types, road classification, position of non-agricultural land on the area of

Quang Ngai Province.

- The compensation unit prices of permanent acquisition land are applied

according to the Decision No. 3 1/2005/QD-UB issued March 71'1, 2005 by

the People's Committee of Quang Ngai Province on the stipulation of the

price of land types, road classification, position of non-agricultural landon the area of Quang Ngai Province.

Compensation unit price for permanent acquisition land: 26,000 VND/m2

9.2.2 Compensation price for trees and crops

The compensation unit prices for trees and crops in ROW are appliedaccording to the Decision No.19/2005/QD-UB issued February 7th, 2005 by thePeople's Committee of Quang Ngai Province regulates compensation, resettlementsupport for recovered land by GOV applied on the area of Quang Ngai Province.

Compensation unit price for paddy and crops: 2000 VND/m2

9.3. COMPENSATION COST ESTIMATE

9.3.1. Cost for RAP establishment

Cost for RAP establishment consists of:

- Preparation work: cost for document study, translation, preparation of

forms for socio-economic survey and PAPs'inventory.

- Site survey work: work with local authority for detailed measurement

survey (DMS) of PAPs and collecting compensation price list.

- Summarize data for establishment of report and RAP report.

- Making Reports at Quang Ngai Province, PMB and EVN

Survey work is carried out in two stages: Preliminary stage and DetailedMeasurement Survey.

9.3.2. Compensation cost

Based on the impacted area of land and crops and extent of impacts(described in the previous chapters), compensation costs of the project including of:

9.3.3 Management cost

Management cost consists of:

- Cost for staff of PMB and Compensation Committees includes in: physical

basis, salary and allowance for administration organization. Organizations of

Compensation Committees will be concurrently having many works during

the project implementation, only some members will be contracted to work

regularly.

- Cost for meetings, information notification to PAPs or their representatives.

- Total management cost is estimated at about 1 % of total cost of compensation

for project impacts as defined in items 9.3.2

9.3.4 Supervision cost

When carry out the project, PMB will signed a contract with independent

monitoring institution(s). Total supervision cost is estimated at about 2% of total

cost of compensation and RAP preparation as defined in item 9.3.1. and 9.3.2.

CONCLUSION AND PROPOSALS

10.1. Conclusion

After investigation, summing up data on damages in the susbtation

construction, consulting opinions of the relevant local authorities and community of

affected households. Through the making of RAP, we have the following

conclusions:

* Investment for work construction is necessary in order to meet the

requirements for stable and reliable power supply for Dung Quat Industrial Zone in

the East and Van Tuong City in future.

* The site of 220kV Dung Quat substation is situated on land area for planted

rice, so the compensation and land clearance works are carried out conveniently.

10.2. Proposals

* The CPPMB will propagate the deep and broad information on the project

by multi-media system, etc... to the habitants in order to minimize the negative

impact of individuals profiting from the standpoint, investment policy of the

government.

* The CPPMB, Resettlement Committee and Compensation Committee have

to inspect closely the execution of compensation and land clearance works in

preparation of work execution.

* Appointment of a standing team to solve in time the complaints and claims

of affected households.
