When he went there and opened the door, his friends were there to greet him. He had been the victim of a practical joke. R train riders received some“ferry” good news on Wednes-day.

The temporary ferry serviceinstituted at the Brooklyn ArmyTerminal earlier this month toaccommodate R train riderswho were inconvenienced bythe closure of the MontagueStreet tunnel won’t end onLabor Day, as had originallybeen expected.

Instead, the Brooklyn-to-Wall Street ferry will operateuntil January, according to locallawmakers who announced theextension on Wednesday. TheBrooklyn Army Terminal is justone stop on the ferry, which ac-tually begins from Rockaway.

The American Society forthe Prevention of Cruelty to An-imals and the New York CityPolice Department (NYPD) onWednesday announced anagreement by which the NYPDwill take the lead role in re-sponding to animal cruelty com-plaints within the city.

The ASPCA, which playedthe lead role until now, will as-

sist law enforcement officials byproviding forensic evaluations,medical treatment, behavior as-sessment, legal support, housingand placement.

The program will begin onSept. 1 with a pilot program inthe Bronx and will expand toBrooklyn in early 2014. In themeantime, animal crueltycomplaints in Brooklyn willcontinue to be handled byagents from the ASPCA’sHuman Law Enforcement De-partment.

The ASPCA has voluntari-ly enforced New York Stateanimal cruelty laws in the fiveboroughs since the organiza-tion was founded in 1866.However, according to theASPCA, “The modern reali-ties of New York City life callfor a new approach — onethat will provide broader pro-tection for the city’s animals.”

Sid Bernstein, Who BroughtBeatles to New York, Dies

Sid Bernstein, the musicpromoter who produced acts atthe Brooklyn Paramount beforehe masterminded the Beatles’historic concerts at Shea Stadi-um and Carnegie Hall, diedWednesday at 95.

Bernstein’s daughter, CaseyDeutsch, said that he died in hissleep at Lenox Hill Hospital.She cited no specific illness,and said he died of naturalcauses.

For decades, the squat, flop-py-haired Bernstein excelledlike few others at being every-

where and knowing everybody.He worked with Judy Garland,Duke Ellington and RayCharles; promoted Dion,Bobby Darin and ChubbyChecker; and managed EsyMorales, the Rascals and Or-nette Coleman. He was an earlybacker of ABBA, setting up theSwedish group’s first Americanappearances.

Bernstein, who grew up inManhattan, began to book mu-sical acts into local venues inhigh school and later ran a ball-room in Brooklyn that featuredsuch Latin stars as Morales,Tito Puente and MarcelinoGuera.

Brooklynites Abroad: The Curious Case of Kilimanjaro

The last thing I expected af-ter climbing Mt. Kilimanjaro was to spend July 4th in a hospital bed. In the Amsterdam airport. With food poi-soning. My five minutes in the tar-mac ambulance were novel, but they took me away from where I wanted to be – on that KLM flight bound for New York City. And while I have to blame the goat cheese tartlette I ate for dinner in Delft, Netherlands, that was by far the least shocking thing I’d done in my two weeks abroad.

Just days before, I had stood on the so-called Roof of Africa, 19,341 feet above sea level, sobbing as my teammates and I crumpled in a triumphant bear hug. Spent and slightly delirious, too cold even to change the lens on my camera, I could only pose for a group pho-to. Sunrise across the glaciers was stunning, but the wind was relent-less and my head was beginning the slow pound of altitude sickness.

One team member vomited. On the way back down, I’d never wished so hard for an easy way out

– an inflatable slide, maybe, or a he-licopter – anything but the three hours spent skating and slipping down gravel and dirt, poles flail-ing, stomach churning, knees buck-ling. It seemed like the descent was harder than the climb, or maybe it was just the sorry state we were in. This part of the Kili experience was nothing like I’d imagined.

When my five teammates and I sat in our mess tent that night, fondly slurping our last soup on the moun-tain, finally rid of the headaches and the fears, the summit itself seemed strangely unimportant. That we’d reached it was essential. More mem-orable, though, were the breathtak-ing camps we’d stayed at along the Lemosho route, the enormous full moon rising over the mountain, the Milky Way and the glittering lights of Moshi, Tanzania, far below. Most days, the clouds had spread in a foamy sea beneath us, adding to the thrilling effect that we were walking on the edge of the earth.

We’d trekked through unfor-gettable rainforest, moorland, al-pine desert, and tundra. We’d been teased by ravens, regarded curiously by monkeys. We had learned to sing in Swahili with our guides. We had learned to love the dirt that became part of our hands. Every day, we pu-rified our rations of water, and ev-ery night we peed into bottles in the safety of our tents. We knew far

too much about each other’s men-strual cycles, nightmares, bowel movements, and gas. Living in high intensity, close-proximity quarters for eight days, we were bound to share certain intimacies.

But that’s precisely the kind of detail you don’t anticipate from the comfort of home. Over the brief couple months I had to plan for this trip, I’d focused on writing and fundraising for the two charities our climb was meant to benefit. Un-der the name of Project Elevation, our team – five women from New Orleans and myself, from Brook-lyn – attempted to raise $20,000. In the end, we reached half our goal. And while I was tempted to be dis-appointed by the total, I recognized that’s $10,000 that two very wor-thy charities didn’t have before we started. In that sense, and in our successful summit trek, our project was a complete success.

And if standing on top of the tallest free-standing mountain in the world was slightly under-whelming, it’s only because the rest

of the trip was so startlingly remark-able. I’m grateful my body held up as long as it did. Coming down from the mountain, I suffered only two bruised toes. Things didn’t fall apart until we reached the city. During post-trek celebrations, someone danced across my left big toe and my walk turned into a limp. I fell off a see-saw which led to an after-noon getting X-rays of my back in a Moshi hospital. I collected so many mosquito bites while waiting for my flight out of the airport that I ap-peared to have contracted chicken pox. Then, of course, there was the food poisoning acquired during my long layover in the Netherlands, my near black-out on the plane, the am-bulance, the injection, the soup and the tea, and finally the new flight home—five hours later. I’d never been so happy to flop into the back of a Yellow Cab as I was at JFK that night.

When it took my luggage four days to catch up to me at my apart-ment in Brooklyn, for once, I wasn’t surprised.

Anne Jackson was born inMillvale, a hill town locatednear Pittsburgh, Pennsylvaniaon September 3, 1926, theyoungest of three daughtersof John Jackson, a Croatianimmigrant barber, and theformer Stella Germain Mur-ray, an Irish-Catholic from acoal-mining family. The fam-ily moved to Brooklyn whileAnne was still a child. Theylived in a secluded areaknown as Old Mill Landingwhich is less than a mileaway from neighboringBrownsville. The familymoved once again, to a tene-ment in East New York.

While growing up inBrooklyn, Anne became amovie fanatic. She was a nat-ural mimic, and she loved toimpersonate her favoritestars. At the age of eleven,Jackson won an amateur tal-ent contest at a local Brook-lyn theatre for her imperson-ations of Charles Laughton,Spencer Tracy, KatherineHepburn and Shirley Temple.Once, after seeing a SonjaHenie movie, she strapped onher roller skates (ice being inshort supply) and torethrough her neighborhoodstreets. She dubbed herselfthe “Queen of Ball Bear-ings.” At Franklin K. LaneHigh School Anne performedcomic monologues for theschool assembly. After gradu-ation Anne worked as an in-surance tracer, elevator oper-ator, and salesgirl in a choco-late shop. She took dramalessons and started audition-ing for Broadway roles. In1946 she met her future hus-band, another Brooklynite,actor Eli Wallach.

Anne, known forher sure interpretivesense and her comicrealism, carved outa niche for herselfas a versatile char-acter actress with analmost unlimitedrange. Anne is described as beingan animated conversational-ist. When asked the in-evitable question about thelong lasting marriage to EliWallach, she once replied:“Eli and I are lucky. We seemto have in a very modestsense the same talent quota.And a similar idea abouthome life and marriage...We’re fairly independent aspeople, stubborn as people[and] we hold on to our ownidentities.” Anne’s autobiog-

On June 14, 1998 this one-time “Queen of Ball Bear-ings” was named “Queen ofBrooklyn.” Her husband of50 years, Eli Wallach, wasnamed “King of Brooklyn.”The ceremonies, sponsoredby Brooklyn Union as part ofthe annual “Welcome Back toBrooklyn” celebration, weremarred by heavy rains, butAnne and Eli took theirthrones in the glow of the af-fection that all Brooklyniteshave for them.

At the evening gala diner,Queen Anne entertained thecrowd with her imperson-ation of Shirley Temple. Un-fortunately there was nottime for Kate Hepburn.

Brooklyn-Built Ship Circumnavigates the Globe

SHENANDOAH CAUGHT IN THE(UP)DRAFT. On September 3, 1925 the U.S.naval dirigible Shenandoah, which had set outfrom Lakehurst, NJ on September 2, bound forSt. Paul, MN, was torn to pieces in a thundersquall while traveling over Ava, OH. Fourteencrew members were killed, twenty-eight sur-vived. The ZR-1 dirigible had made her firstopen-hour flight on September 4, 1923, under the command of Com-mander F. R. McCrary. The $2 million airship, patterned after the Ger-man L-49, was constructed in 1919. Her 680-foot hull was made ofDuralumin, an aluminum alloy; her tanks were filled with helium,making her the first dirigible to use this gas. Leaving her hangar atLakehurst, New Jersey on October 7, 1924, the Shenandoah crossedthe country, completing a 9,317-mile journey in nineteen days. Themuch-criticized flight of September 2-3, 1925, commanded by Lt.Commander Zachary Lansdown, ended in disaster when the ship wascaught in a violent updraft. She broke in two.

A court of inquiry concluded that the airship crashed because of“large, unbalanced, external, aerodynamic forces arising from high ve-

locity air currents.” A telling probe of the acci-dent was hampered by souvenir hounds, whoswarmed over the remains of the once-great dir-igible, picking her clean of dead men’s effects,as well as parts of her wrecked structure. Thismaterial was never made available for examina-tion. The Ohio American Legion finally sent outarmed detachments to guard the remains of the

ship. Souvenir hunters became so bold at one point that the legion-naires had to fire at them to drive them off. Lamented the ChicagoEvening Post: “The sole complaint that we lodge against the legion-naires is that they did not shoot straight.”

Pioneer aviator Laurence La Tourette Driggs commented on the air-ship: “When the heavy winds blew, she could neither leave nor enterher hangar. When ordinary storms broke about her, she was in peril.When no mooring mast was handy, she required 500 men to catch herand hold her to earth. When rain drops clung to her envelope, shefeared to attempt landing under their weight until they evaporated.When every condition was favorable, she sailed through the skies ma-jestically ...”

Keep Social Security Off the Table

President Obama’s proposal to restrict the growth of Social Security by changing annual cost-of-living adjustments (COLAs) from the present Con-sumer Price Index (CPI) to a Chained Consumer Price Index represents a disingenuous departure from his earlier position to hold fast on Social Se-curity. Such a proposal itself would have little effect on either Social Securi-ty benefits or on the long-term Social Security Trust Fund needed to satisfy future beneficiary claims. The Congressional Budget Office recently esti-mated that a chained CPI (CPI/U) “would increase, on average, by 3 percent-age points more slowly per year than will the existing CPI,” and that Social Security’s total outlays would “decline by 4 percent, from currently sched-uled outlays.” This option, CBO estimated, would improve the 75-year trust fund balance by only 0.2 percentage points of GDP and would extend the trust fund exhaustion date by four years at the most. (CBO, 2010)

The real hazard in the president’s proposal comes from Including Social Security in deficit reduction negotiations for at least two reasons. First, So-cial Security is not part of the deficit. In fact, it may be the only federal pro-gram with a surplus in its Trust Fund. Clearly, there have been confusions about how to account for surpluses in the fund. Congress approved the use of a “unified” budget by including Social Security Trust Fund operations in the 1974 budget process, and accounting for Social Security taxing, spend-ing and its reserves has bounced back and forth: off-budget from 1935-1968; on-budget from 1969-1985; off-budget from 1986-1990, for all purposes except computing the deficit; and off-budget for all purposes since 1990. Even be-fore President Bush proposed “privatizing” Social Security, Republican law-makers have been trying to appropriate these government-held funds.

There is a second, more compelling danger from the president’s propos-al to change the COLA. Such a proposal only confuses and compounds So-cial Security’s long-range problem. Social Security is solvent for at least 20 years under current legislation, but the growing number of beneficiaries on the one hand, and the shrinking number of workers relative to Social Securi-ty beneficiaries will only continue to exacerbate Social Security’s long-range problems. Ever since its beginning, financing Social Security has been con-troversial, and over the years Congress has agreed to incremental changes in its financial and benefit structure, only to discover that additional incremen-tal changes quickly are needed. President Obama’s willingness to include So-cial Security in debt negotiations simply re-opens longstanding funding dis-putes before there is sufficient intelligence available to guide a debate over the present nature of Social Security and how it must be financed.

We need to keep in mind that today Social Security provides financial benefit to more 50 million people, over 18 percent of the population, that only 70 percent of those beneficiaries are retired workers, that more children receive Social Security payments than children who receive public welfare, and that Social Security’s redistributive formula has kept 40 percent of the el-derly who would otherwise be poor out of poverty. Social Security is no lon-ger our grandmother’s retirement program. It has become a comprehensive social insurance program, and until this reality is seriously explored, political-ly expedient proposals like changing the COLA are useless and damage Social Security’s credibility. A changed CPI? Dangerous political candy.

Tragedy and Humor Collide In New Historical Novel

Flies to Whatless Boys” (Akashic Books) shifts seamlessly between centuries. In 1845 London, an engi-neer, philosopher, philanthropist, and bold-faced charlatan, John Adol-phus Etzler, has invented machines “powered by the immense forces of Mother Nature” that he thinks will transform the division of labor and free all men. He forms a collective called the Tropical Emigration So-ciety (TES), and recruits a variety of London citizens to take his machines and his misguided ideas to form a proto-socialist, utopian community in the British colony of Trinidad.

Among his recruits is a young boy (and the book’s narrator) named Willy. As TES begins its overseas voyage to Trinidad, Etzler recedes quickly to the backdrop, and Willy’s tale takes precedence—in particular his head-over-heels fall for the enthralling and wise Marguerite Whitechurch. Coming from the gentry, Marguerite is a world away from Willy’s laboring class. Speech also divides them, as Marguerite lacks vocal cords—she communicates with Willy in writing. As the voyage contin-ues, and their love for one anoth-er strengthens, Willy and Margue-rite prove themselves to be true socialists, their actions and adven-tures standing in stark contrast to Etzler’s disconnected theories.

When they arrive at Port of Spain, Willy must part from Mar-guerite and travel with the men of TES to build the society’s future home—in a remote swamp, only accessible by boat, called Chagu-abarriga. Far from realizing their leader’s dreams of a tropical para-dise, the pioneers never even get a chance to unpack their Satellite, Etzler’s “self-powered” machine that will mow down the rainforest and plant their first crops. With-in weeks the majority of them are stricken with the “Black Vomit.” And now they’re trapped, without a boat to return to civilization.

Willy and his father—togeth-

er with their helpmate, an African named John—make a last-ditch at-tempt to refurbish a schooner that has washed up. But before the ship can be launched Willy’s father con-tracts the dreaded disease, moving the story towards its heroic, trag-ic conclusion: Willy’s account of transporting his father out of the jungle on a makeshift stretcher car-ried by himself, John, and two War-rahoon Indians. For a day and a night they haul him over the moun-tains of the Northern Range, across the breadth of Trinidad, back to Port of Spain and his family, only to spend his final few hours with them. This epic trek also brings fif-teen-year-old Willy to the most try-ing decision of his life—whether to return to England with Marguerite, or become the head of his family in their new home.

Antoni’s tragic historical nov-el, accented with West Indian ca-dence and captivating humor, pro-vides an unforgettable glimpse into nineteenth-century Trinidad & Tobago.

Downtown Construction Wave Resumes, Bringing New Residential Units to 13,000, Needing SchoolsBegun 2004, Stalled in 2008, Growth Now Brings New Condos and Rentals

Give us a school to call our own.That’s the rallying cry of a group

of parents living in newly built apartments in Downtown Brooklyn – who fear a fresh surge of residen-tial development in the neighbor-hood will cause acute overcrowd-ing of existing public elementary schools within five years.

“The neighborhood is being built so quickly,” said Chris Young of Downtown Brooklyn School Solutions. “It needs a heart.

“A school to serve Downtown Brooklyn residents could bring the community together,” said Young, whose group is working to win the support of local politicians and city agencies for its campaign to get a grade school built.

Since business-centric Down-town Brooklyn was rezoned for re-development in 2004, more than 5,000 apartments have been built there – and now a new wave of con-struction will bring an additional 8,000-plus units, Young said.

Young, a television producer who moved to the neighborhood with his wife and then-infant child three and a half years ago, has done meticulous research on development projects both planned and underway.

By his calculations, an additional 2,600 children who are likely to attend public grade school will live in the neighborhood by 2018. He used a for-mula devised by the city Department of Education’s School Construction Authority to estimate that number.

Yet the city Department of Edu-cation has no plan to create a new elementary school for the neighbor-hood, though there’s room for only about 400 new students in the ex-

isting schools for which Downtown Brooklyn is currently zoned.

The population surge wasn’t an-ticipated in the city environmental impact study done for the 2004 re-zoning; it predicted just 979 new res-idential units would be constructed.

“We were sold a neighborhood that wasn’t ready for families,” said Young, who lives with his family in the BellTel Lofts on Bridge Street.

“Nobody thought about who would be moving in. It could have been singles. It could have been retir-ees. What happened is families came.”

There’s a telling indication that the neighborhood already has a growing number of very young kids, Young said. Day-care operator Bright Horizons leased space at two loca-tions, in the BellTel Lofts and at 345 Adams St., and opened preschools.

Young, who lived in Fort Greene before moving to the landmarked Art Deco condo building, was look-ing for a more spacious home with room to raise a child.

“We didn’t think about a school then,” he said. “When you’ve got an infant, schools are not on your radar.”

His group, which is an associ-ation of more than 150 neighbor-hood families, is running a petition drive through its website, www.do-broschools.org – which also has an interactive map identifying Down-town Brooklyn residential projects large and small.

Young met last week with School Construction Authority president Lorraine Grillo and other agency reps, to make a case for including funds for a Downtown Brooklyn elementa-ry school in the SCA’s upcoming five-year capital plan.

They were receptive, he said – but a big obstacle is finding a site,

which is difficult given the rapid pace at which Downtown Brooklyn is being redeveloped, he said.

His group hopes to convince a developer with a still-vacant site to include a shell for an elementa-ry school in building plans, in ex-change for tax breaks or additional buildable square feet.

An open letter posted Aug. 4 on the group’s website calls on owners of nine specific Down-town Brooklyn development sites to consider doing so. It also targets Tom and Fred Elghanayan of TF Cornerstone, who are tearing down the parking garage at 276-300 Livingston St. to build a huge apartment complex – and looking to buy Brooklyn Com-munity Services’ building next door to enlarge their site, as Eye on Real Estate recently reported.

Rather than cold-call the devel-opers, Young plans to ask Down-town Brooklyn Partnership presi-dent Tucker Reed to help contact them. Reed was vacationing and couldn’t be reached for comment, a spokeswoman said.

“Somebody ought to step up,” Helen Lee, who’s involved with Downtown Brooklyn School Solu-tions, said of the developers with empty construction sites. “We’re not asking for a hand-out. It could be a win-win for everyone.”

Lee and her husband bought an apartment at the Toren on Myrtle Av-enue in 2011 when she was pregnant, knowing there was no elementary school in Downtown Brooklyn. She resolved then that she would get in-volved in advocating for a school for the neighborhood.

“We can’t just sit back and wait for things to happen,” said Lee, who’s a digital marketing strategist at Google.

The couple had been living in a one-bedroom apartment at 1 Han-son Place and wanted to find anoth-er home with equally good access to subways. Also, they preferred a new-ly built apartment, ready to move into, over a fixer-upper in a neigh-borhood with good schools such as Brooklyn Heights, Park Slope or

Carroll Gardens.As an aside, now that she lives

in the Toren, she gives a thumbs-up to the car-free green space at Metro-Tech, which is a short walk away. Af-ter work, the place is a magnet for moms and little kids. Her son, now 2 years old, rides his scooter there.

In May, Downtown Brooklyn School Solutions’ testimony was heard at a Community Board 2 ed-ucation committee meeting. A re-searcher for CB2 presented a study at that meeting that concluded the neighborhood needs one or more elementary schools.

Over the summer, CB2 hand-ed in its statement of needs to the Department of City Planning. The

board’s district manager, Robert Per-ris, sent us an excerpt from it that notes there is no public elementary school in Downtown Brooklyn.

“It has become apparent that an elementary school may be need-ed in Downtown in the near future to accommodate the new and grow-ing residential population, which includes a significant number of families with elementary aged chil-dren,” it reads.

In September, CB2 will hold a public hearing to prepare its register of budget priorities, which is used to advise the city. Perris suggested Young should speak at the meeting.

Other city neighborhoods under-going rapid residential development, like the Williamsburg-Greenpoint waterfront, are getting new public elementary schools, Young said.

Brownstoner.com, which has posted two stories about Down-town Brooklyn School Solutions, noted that a charter school that can accommodate up to 300 students is opening at 80 Willoughby St.

But the new Brooklyn Prospect Charter School won’t erase the threat of overcrowding at schools that now serve Downtown Brooklyn residents, Young told Eye on Real Estate.

“It helps and it hurts,” said Young, explaining that Downtown Brooklyn kids must compete in a lottery with children from other neighborhoods for seats at the school. This year, none of the kids from BellTel Lofts who tried to get into the school won ad-mittance, he said.

THE NEW WAVE OF CONSTRUCTION

The surging residential devel-opment that Downtown Brooklyn School Solutions is tracking got off to a rocky start, as real estate watch-ers well remember.

Post-rezoning projects hit a wall during the economic downturn that kicked off in 2008. Some devel-opers slowed or stopped construc-tion; some slashed the prices of their condo offerings; some turned condo buildings wholly or partly into rentals.

Now, heading into fall 2013, buildings from that first wave of residential construction are an inte-gral part of the landscape, from the borough’s tallest residential tower, the Brooklyner, at 111 Lawrence St., to massive, mid-rise Brooklyn Gold at Gold and Tillary Streets.

We recent-ly checked the status of several proj-ects in other locations:

* 388 Bridge St.: The Stahl Orga-nization’s skyscraper will usurp the Brooklyner as the borough’s tallest residential building – at least until AvalonBay’s project across the street at 100 Willoughby St. is constructed.

The 590-foot Bridge Street tower is topped out, and gleaming glass cov-ered the facade of all but the bottom floors when we stopped by there. The hum of construction machinery was evidence of contractors hard at work behind the construction fencing.

There will be 234 rental apart-ments and 144 condos in the 53-sto-ry building. There will be multiple temporary certificates of occupan-cy for different parts of the proper-ty, with the rental portion likely fin-ished in January, Stahl co-president Gregg Wolpert told Eye on Real Es-tate. He thinks a rental office for the market-rate apartments will open by the end of October. So how pric-ey will they be?

“I can’t talk about rents; we’re final-izing them right now,” he said. Nor can he speak about the condo prices be-cause the state Attorney General’s of-fice hasn’t approved the offering plan.

There will be LED lighting to create a “crown” at the top of the building, with wind turbines pro-viding the power to keep it glow-ing, Wolpert said.

AvalonBay’s tower will be just a hair's-breadth taller: “The roof eleva-tion is technically 591 feet,” a com-pany spokesman said in an email.

“Not to knock AvalonBay – they’re very good builders,” Wolpert countered. “But [100 Willoughby] won’t be built to the same stan-dards as our building. It shouldn’t be. It’s a rental.”

Stahl’s tower was designed to be all-condo, with higher ceilings – in-cluding 11-foot ceilings in its pent-houses – an upscale gym from Park Avenue called the Manhattan Athlet-ic Club and a “luxury lobby,” he said.

The building has up to 50,000 square feet of retail space, and some big-box tenants have taken a look, said Diana Boutross of Winick Re-alty Group, who is doing the mar-keting. Other prospects that have shown interest are “food uses” large and small, such as restaurants and markets, plus health industry ten-ants and private schools.

Asking rents are $100 per square foot on the ground floor, $50 on the second floor and $30 on the third and fourth floors, she said.

* 100 Willoughby St.: Real es-tate-obsessed readers take note: AvalonBay’s spokesman said 100 Willoughby is the address the devel-oper is using now for this project. It is also referred to as 88 Willoughby St. or Avalon Willoughby West.

A deep hole has been dug at the site, and we saw a parked bulldoz-er and a small group of workers tot-ing things around when we peeked through a tiny observation window in the fence.

Construction started last week and will be done in roughly three years, with first apartments ready for occupancy in June or July 2015, the AvalonBay spokesman said. There will be 826 rental apartments, he noted; 860 were originally planned.

The spokesman sent us a com-ment from Martin Piazzola, senior vice president for development, about the competition to be Brook-lyn’s tallest residential building.

“When we were designing our building, we really didn’t focus on how tall 388 Bridge St. would be,” Piazzola said. “We just wanted to design the best building we could for the site.”

* 66 Rockwell Place: The exte-rior of this tower on the corner of Fulton Street and Rockwell Place is nearly done but needs to have the glass facade installed on its top and bottom floors. A small bit of front-age at 29 Flatbush Ave. – which is the address the previous owners used for the project – is covered in a construction shroud.

The building is 457 feet tall and will have 327 rental apartments, de-veloper Dermot Co.’s website indi-cates. A placeholder website has been created for marketing the rentals, but there’s no information posted on it.

* 313 Gold St.: The day we visited, two base floors and 20 tower floors were up out of the ground at this project. The sound of workers’ ham-mering was audible on the other side of Flatbush Avenue Extension.

The project is often referred to as Oro 2 because it was conceived as a sister building for the Oro, the Gold Street tower right across the street.

The 313 Gold St. building will be 35 stories tall and have 208 apart-ments, according to city Buildings Department documents. The origi-

nal developer sold the site last year to Brooklyn Princess LLC. Mortgage records indicate Kevin Lalezarian is the LLC’s managing member; he is an owner of development firm Lalezarian Associates in Lake Suc-cess, Long Island.

He didn’t return our call for comment on the project.

* 81 Fleet Place: We saw a bri-gade of bulldozers digging in the dirt at this site where mayoral candidate John Catsimatidis’ company Red Ap-ple Real Estate is constructing a 205-unit, 15-story rental building. The proj-ect will be done at the end of next year and the rental process will prob-ably start in 2015, Red Apple exec Bob Zorn told Eye on Real Estate.

There will be a rooftop area for all the tenants to share, and some units will have their own rooftop patios, he said.

“Daily needs tenants” like day care centers, coffee bars and food markets are showing interest in the retail space planned for 81 Fleet, said Boutross of Winick Realty Group.

Red Apple owns two develop-

ment sites on either side of 81 Fleet. A spring 2014 ground-breaking is an-ticipated at 180 Myrtle Ave. for a 215-unit rental building, Zorn said. That site is between 81 Fleet and the An-drea, a completed Red Apple apart-ment house.

At the other site, 86 Fleet Place, the game plan is to start work in 2015 on a 400,000-square-foot tower – probably a combination of rentals and condos. The site is next to the Toren.

“Our view is that there is consid-erable demand for reasonably priced condos down the road,” he said.

He doesn’t know what will be considered a reasonable price range by then.

Downtown Brooklyn School Solu-tions put Red Apple’s vacant lots on its list of sites where they wish develop-ers would consider including an ele-mentary school in their design plans.

“Would we take a look at it? Of course,” Zorn said when told of the parent group’s idea. “Do I have a clue if it would work? I don’t know. One has to spend some time and evaluate.”

The high number of apartments under construction in the neighbor-hood makes him think, though.

“The math seems compelling,” he said. “That many apartments with children – it is a need the city is going to have to meet.”

Brooklyn Book Festival to Commence With Series

Of ‘Bookend’ EventsOver 60 Lit Events Staged

Across Brooklyn, Sept. 16-22 On Thursday, Brooklyn Borough President Mar-

ty Markowitz and the Brooklyn Literary Council an-nounced the “Bookends” programming to be held throughout the borough from September 16th until the 22nd, leading up to eighth annual Brooklyn Book Festival, supported by AT&T, on Sunday, Sep-tember 22, 2013, from 10:00 a.m. until 6:00 p.m.

These unique literary-themed events, all free or low-cost to attendees, include film screenings, par-ties, literary games and author appearances; they will be held at clubs, bookstores, parks, theaters and libraries across Brooklyn. Authors range from the iconic Edwidge Danticat and E.L. Doctorow to the hip Jennifer Gilmore and Ron Sheffield, as well as a 15-year-old author, Tori Nighthawk.

“What better way to begin our Brooklyn Book Festival than with a ‘Bookend’ or two?” said Bor-ough President Markowitz. “These events are won-derful celebrations of Brooklyn’s rich literary cul-ture, where the magic of books literal-ly jump ‘off the page’ and into local fun-filled venues. For fans young and old, no matter what your reading in-terest, there will be stories to tell from this year’s ‘Bookends’!”

There will be numerous literary trivia sessions, special author readings and interactive events that intersect books with food, art, music, movies, sports, history, animals and more. Hands-on oppor-tunities include photography workshops, open mic sessions, literary improvisation and a book pitch contest.

“One of the biggest areas of growth for the festi-val in the past few years has been with our Bookend events, which have added many layers of depth to our programming,” said Johnny Temple, the chair of the Brooklyn Literary Council. “We’ve always prided ourselves on how the Brooklyn Book Fes-tival offers something for everyone, and our Book-end events seal this deal by providing many addi-tional venues, many additional authors, and many additional audiences to what is now widely recog-nized as one of the very best literary events in the United States.”

Dan Zanes and Eliza-beth Mitchell had only been playing for about 10 minutes when the stage was invaded.

The first to appear was a stuffed lamb. Then a cud-dly dinosaur. Then all hell broke loose and kids on tip-toes were putting all sorts of beloved stuffed animals — and a collection of 19 neatly organized My Little Ponys — on the lip of the stage to get a better listen.

“Did they buy tickets?” Zanes happily teased from be-hind a guitar on New York Uni-versity’s Skirball Center stage on Saturday. “Actually, ponies and dinosaurs get in for free.”

If most concerts these days are about twerking and pyrotechnics, a Zanes con-

cert usually involves some gentle choo-choo dancing in the aisles, world beats and teddy bears. Plus, it’s often over by noon — that’s when the target audience naps.

“We have wild dance par-ties before lunch,” he says in an interview a day before the concert. “Who else is going to say that, right? I don’t care how many records you’ve sold: Who’s having the dance parties before lunch?”

Zanes, a rail-thin, bushy-haired Grammy Award win-ner whom People magazine has called the “crown prince of contemporary kid’s mu-sic,” is a former member of the 1980s band The Del Fuegos who turned to chil-dren’s music after the birth of his daughter and never looked back, building a ca-

reer with infectious sounds from all over the world.

Zanes’ globe-trotting mu-sic appetite ranges from ele-ments of Tunisian Sufi, the Louisiana bayou, Appalachia, the Caribbean and South Af-rica to making a CD com-pletely in Spanish. He likes to call what he does “21st-cen-tury, all-ages, handmade so-cial music,” but everyone else calls them kiddie songs.

“I accept it. But I don’t think of it as children’s mu-sic,” he says in his comfortable two-story Brooklyn home nes-tled in a diverse neighborhood populated by Bangladeshi and Pakistani immigrants. “This is really music for everybody to sink their teeth into.”

Since his debut album, “Rocket Ship Beach,” in 2000, Zanes has recorded with all

sorts of musicians, includ-ing Debbie Harry, Sheryl Crow, Natalie Merchant, Lou Reed, Ziggy Marley and Phil-ip Glass. This month marks a new CD collaboration with Mitchell, also a giant among the nap set. To parents, the teaming up of Zanes and

Mitchell is virtually akin to Paul McCartney and John Lennon working together.

In “Turn, Turn, Turn,” Zanes and Mitchell team up with Daniel and Storey Lit-tleton — her husband and daughter — to create gentle folk tunes. Five are Zanes’ orig-

inals, and there are also several traditional songs such as “Sail Away Ladies,” ‘’Train Is A-Com-ing” and “Wim Wam Waddle.”

The songs came easily when the four sat in Zanes’ living room for three days this spring to pick out songs for the CD, which was record-ed upstate near Woodstock, N.Y. A tour will hit Illinois, New Jersey, New York, Penn-sylvania and Massachusetts this fall.

“Songs were just flying out,” he says. “We just drink from the same well. We all love music and I think we love the idea of bringing some of these songs some-times kicking and screaming into the 21st century.”

He and Mitchell have been friends since they met at a maternity shop in SoHo when his album came out, and they’ve long wanted to record together. As a sign of how in synch they were, both showed up with a list of the same obscure songs, in-cluding “My Creole Belle.”

Kings Inn To Deal With ‘Difficult’ EBT ChallengesKicking off its 13th season of of-

fering creative, often dramatic, CLE programs, on Sept. 24, the Kings County American Inn of Court will tackle one of the thorniest issues faced by trial lawyers, to wit: deal-ing with the “difficult” if not “im-possible” adversary at a deposition.

The new president of the Kings Inn is Justice Ellen Spodek. Direct-ing the deposition drama will be Inn president-elect Dave Chidekel, work-ing with a talented team including, but not limited to, President Spodek, Justice Lawrence Knipel, Kings Civ-il Administrative Judge; Justice Carl Landicino, Federal Judge Wil-liam Kuntz, John Lonuzzi, a former Brooklyn Bar president; Joy Campan-elli, a court attorney; Theresa Ciccot-to, a court attorney and top trial law-yers Andrea Hill, William Gentile and Serena Blanchard.

Director Chidekel is known for

his imaginative presentations and has been urging his colleagues to rec-ollect true stories featuring the “diffi-cult” and “impossible” EBT adversary. One situation sure to come up is the deposition wherein all ‘"objectionable" questions must be handled over the (cell) phone with the presiding judge.

But occasionally a beleaguered barrister may choose instant retreat over a judicial comeuppance, we can reliably relate.

One story being passed on to attor-ney Chidekel dealt with an opponent who suddenly yanked his client out of the far-from-complete court-ordered deposition, telling him to “leave, leave now!” His reluctant and poorly pre-pared witness had been summoned from his upstate New York home. (The escaping attorney later confided – as the case was being settled – that he was willing to risk a rapid depar-ture and the wrath of the judge, rath-er than endure further damaging testi-mony by his own client.)

But what should the examining attorney do? Act, act fast, he con-cluded. Quickly, the questioning at-torney rose, insisting that the court reporter, her high heels clicking, ac-company him to record the actual “chase” through the hall, Then, in the descending elevator and out of the 32 Court St. building, he final-ly proclaimed to the stenographer, “Let the record reflect that attor-ney [blank] is now fleeing 32 Court St. with his client and both are run-ning toward the subway at the cor-ner of Court and Montague...”

Some Kings Inn Skits Are Now Legendary

The Kings Inn was founded al-most 13 years ago by a group consist-ing of Justice Marsha Steinhardt and then-Justices Gerard Rosenberg, Abra-ham Gerges and Edward Rappaport.

Over the last 13 years, Inn mem-bers have performed scores of skits

calculated to represent challenges lawyers face on a day-to-day basis.

These presentations, by the way, are never boring since the skits are often framed with popular fig-ures (e.g., when Justice Rosenberg played Larry King, red suspend-ers, horn-rimmed glasses and all, or when Justice Gerges presided over a parable as Chicken Little with the appropriate headpiece)

Other current officers include Counselor Justice Arthur Schack, Treasurer Justice Miriam Cyrulnik and Secretary Jon Besunder. The executive director is Jeff Feldman, while Lucy Disalvo serves as inn ad-ministrator.

BBA Panels Explore Medicare And Delve

Stop-and-Frisk Done Due to Court Decision?Some lawyers are puzzled over

a portion of the new law against the NYPD’s stop-and-frisk practices.

Most barristers and others we talked with were in agreement about better (equal) protection of the rights of young minority men.

Still vague in the minds of many critics of the legislation – passed over the angry veto of May-or Michael Bloomberg – is the new cause of action based on the vic-tim’s perception.

What the puzzling portion – fashioned by Federal Judge Sarah Scheindlin -- seems to say is that if you think you’re being profiled, you can sue the offending police officer.

It enables the new cause but of-fers no financial benefit to the vic-tim. However, it does provide for at-torney’s fees and costs which, some believe, could lead to a rash of ac-tions against hundreds of police of-ficers.

The ACLU unsurprisingly ap-proves of this concept, but its de-tractors see it doing more to stir up litigation than to afford more re-spect for young minority men on our city streets.

Did Bloomberg’s Stubbornness

Doom Stop-and-Frisk?Many who believe stop-and-

frisk has been an effective crime deterrent blame Mayor Bloomberg for not having done more to refine stop-and-frisk in order to remove any part of the practice that might be unconstitutional.

“Bloomberg knew that if the deci-sion went against him, there was the likelihood of a court-appointed mon-itor coming in and adding another lawyer of bureaucracy” one barrister

told us.” He wanted everything and now – unless this decision is reversed – he’s left with a mess to deal with as his term is about to end.”

Indeed, Commissioner Ray Kelly has offered numbers that strongly champion his and Mayor Bloomberg’s position.

He recently wrote that “stop-and-frisk has saved 7,383 lives -- and if his-tory is a guide, they are largely the lives of young men of color,” adding that “murders are down 29 percent so far this year from 2012’s 50-year low.

“As a city, we have to face the re-ality that New York’ s minority com-munities experience a dispropor-tionate share of violent crime,” he wrote. “To ignore that fact would be a form of discrimination in itself.”

There has to be a better way to achieve these results, but wheth-er Judge Scheindlin’s specific ruling accomplishes that goal remains to be seen.

Quinn Hits a Trifecta With Newspapers

Common political wisdom these days is that editorial endorse-ments of candidates don’t count for

much. Even though these newspa-pers have their own web sites cal-culated to develop a broader reader-ship than the pure paper versions, the backing of a candidate is not considered to be enough to tilt the scales in that candidate’s favor.

Also part of the traditional polit-ical playbook – the exception that proves the rule -- is a belief that edi-torial support of the venerated New York Times of a candidate running in a Manhattan Democratic prima-ry can be critical and maybe even cinch the race.

On the other hand, what we may have just witnessed may be different, namely their endorse-ment of Council Speaker Christine Quinn, by our three major newspa-pers: the Times, the News and the Post. A virtual Quinn trifecta!

By now political experts have measured the impact of this multi-ple expression of favor from these newspapers, which reach millions of readers in this city every day.

A Quinnipiac survey taken be-fore the endorsements showed Public Advocate Bill de Blasio was notably in front of Quinn in a sur-vey of Democratic voters.

De Blasio Surges, Voters Go Negative On QuinnThe later Quinnipiac survey

out this week, however, had de Bla-sio making substantial gains over Quinn. Her supporters said this sur-vey was taken before the impact of her triple endorsement could be ful-ly appreciated.

To Ms. Quinn’s dismay, an even later survey came out that sent shock waves throughout her cam-paign. Not only did the Times/Sie-na poll show de Blasio beating her 32 to 17, it also revealed that 47 per cent of “likely Democratic voters” view Ms. Quinn unfavorably.

Edging Quinn in the latest poll was candidate William Thompson, the former comptroller, with 18 per cent. Thompson’s relative gain over Quinn moves him into sec-ond place, suggesting that the two-way Democratic runoff could see Thompson vs. De Blasio.

Quinn has been criticized by these same newspapers for often seeming to serve as the puppet of outgoing Mayor Bloomberg. Detrac-tors suggested that she made a “deal with the devil” when she agreed to change municipal two-term limits to push a third term for Bloomberg.

Far Right Now in FearOf ‘Liberal’ Supreme Court?

Maybe it’s because Fox Newsbelieved its own slanted coverage aswell as the misleading data producedby GOP-biased pollsters (forinstance, Gallup, which had MittRomney beating President Obamaby four to five ‘points’). Or, perhapsit’s been so flummoxed ever sinceelection night that people out thereon the far right have yet to meaning-fully react to the future of the U.S.Supreme Court if the president getsto select one or more members of thathighest bench.

Except for an occasional outburstfrom Bill O’Reilly or RushLimbaugh, the Murdoch conglomer-ate has yet to foretell — ominouslyas its wont — what will happen to theU.S. Supreme Court now that thisDemocratic chief executive has fourmore years to name new justices whocould move the top court from centerright to center or even center left.

Most of Fox airtime thus far hasgone to a continuously enraged Sen.John McCain, whose soaring hostil-ity against U.N. Ambassador SusanRice — over her reading of unclassi-fied yet misleading material on theBenghazi murders — is sad to see.

Even with Fox on their side 24/7,the far right may ultimately be con-fronted with a Supreme Court more

Obama could be the first to replace orname a majority of Supreme Courtjustices since the untroubled eight-year term of Republican PresidentDwight Eisenhower (who also omi-nously warned us of the growth mili-tary-industrial complex that nowrules much of Washington.)

While Justice Ginsberg is 79 andin ill health and Justice Breyer is 74,court observers note that JusticeScalia, the strict Constitutional con-structionist, is 76, and so is the right-leaning but “swing” Justice Kennedy.It’s become a grim waiting game.

President Obama has alreadynamed two liberals — JusticesKagan and Sotomayor — and theactuarial tables seem to indicate thathe could do the same should eitherScalia or Kennedy leave the bench.

Citizens United Is NowA Billionaire’s Club

While an identifiable bloc ofwoman voters sided with PresidentObama to prevent the possible over-ruling of Roe v. Wade, election-savvy Democrats and moderateRepublicans know that the only wayto stop the pouring of billions of dol-lars into political campaigns is to doaway with the infamous CitizensUnited (read Billionaires United)case.

Some expected a chastisedRepublican Congress to becomemore malleable and cooperative withDemocrats, especially on the ‘fiscalcliff’ issue. But they are working outtheir grief by using our U.N. ambas-sador as a punching bag.

This brutal behavior may be ini-tially therapeutic but ultimately itwill hurt them even more withwomen and minorities.

Dem. Felder ‘Joins’ GOPIn The Albany Senate

Democrats may rule — sort of —in Washington, but here in New York,it seems Republicans can win evenwhen they apparently lose. Case inpoint is the decision by formerDemocratic Councilman SimchaFelder to go over to the Republicancaucus in Albany.

A few years back, a couple ofsleazy Democratic senators “soldout” to the Republicans in a GOPSenate takeover, but ended up havingtrouble with the law. But SimchaFelder is anything but a sleaze —he’s bright, determined, a politicalsavant, a protege and a longtime allyof powerful Assemblyman DovHikind.

This all comes as no surprise.Felder supported the national GOP

ticket and urged his thousands ofdedicated Senate backers to vote forhim on the Conservative line all theway up to and including MittRomney and Paul Ryan. Democratsweren’t happy with his switch. But,rest assured, State ConservativeChair Mike Long and KingsConservative Chair Gerry Kassar,both Brooklynites, appreciate hisboost to their elective ballot line.

Working with a hard corps of ded-icated right-thinking workers such aslocal leader Fran Vella Marrone,Chairs Long and Kassar have main-tained a strong conservative politicalwing of the state party by patientlyreaching out to like-minded voters.Simcha Felder knows this, has dealtwith all of them as neighbors and fel-low community organizers over theyears and believes he was doing theright thing for his senatorial districtby going over to the AlbanyRepublicans.

Another guy who has to bepleased with Felder’s decision is R-C. Sen. Marty Golden who easilywon re-election over Democrat NickGounardes. Golden is one of themost influential Republicans inAlbany. He’s been quiet on theFelder switch, and though he’s nottalking about strategy there’s a goodchance his party will lure enoughDemocrats to their side to win con-trol of the upper chamber.

In closing, a query for politicalbuffs: how many votes did Felderand the Romney-Ryan team win onthe Conservative lines in his senato-rial district? How many Democraticvotes did Felder receive? Maybe ourastute online colleague Gatemouth inRoom 8 can tell us.

Judges’ Retirement Age To Go to NYS Voters

This November election, NewYork voters will have an opportu-nity to decide whether or not statejudges are allowed to remain onthe bench past the age of 70.

The current rules governingjudgeships mandate that judgesmust retire once they reach 70.Elected justices, however, are per-mitted to seek three extensions oftwo years each. These extensionsthus allow justices to serve untilthey are 76, barring any physicalor mental disabilities.

Unlike elected justices, judgeswho are appointed to the bench,such as judges on the Court ofAppeals, are required to retireonce they turn 70 years of age.

“The current requirement thatcertain judges must retire at 70 andothers at 76 is an outdated rule thatwas created at a time when the life

expectancy of the population wasmuch lower than it is today,” Hon.Barry Kamins, Brooklyn SupremeCourt justice and administrativejudge for criminal matters for theSecond Judicial District, told theBrooklyn Daily Eagle.

With advancements in medicaltechnology and an awareness ofdiet and exercise, people are livinglonger lives. A report issued by theWorld Health Organization esti-mates that the life expectancy forindividuals in high-income coun-tries, such as the United States, is80 years of age. United StatesSupreme Court Justice John PaulStevens, who retired from thebench at the age of 90, mused to aWashington reporter that “he mayhave jumped the gun a little,” withhis retirement.

In January, AssemblywomanHelene Weinstein (D-Flatlands/Sheepshead Bay) sponsored an

amendment to the New York StateConstitution that would extend thejudicial retirement age to 80.

The proposed amendment,titled “Increasing Age UntilWhich Certain State Judges CanServe,” would allow Court ofAppeals judges to remain on thebench until the age of 80 andgrant state Supreme Court jus-tices the opportunity to seek five,two-year term extensions past theage of 70.

“We have experienced andenthusiastic judges who are eagerto remain on the bench and whocould contribute so much to thecourt system,” Kamins said.“They should not be forced toretire because of a rule that hasno relevancy in the 21st century.”

For the first time, a judge ruledthat a non-prostitution chargeagainst a victim of human traffick-ing could be dismissed withoutprior approval from the DistrictAttorney’s Office.

In 2000 and 2003, LG was con-victed and sentenced on charges ofprostitution and possession of aweapon. LG asserted that thecriminal acts were a result of heryears of forced prostitution andasked that the charges be vacated.

LG, a Brooklyn native, becamea ward of the state following hergrandmother’s death in 1994. Atthe age of 12, while at a fosterhome in Brownsville, LG wasapproached by an older man, iden-tified in court papers as “A,” andescorted to his home, where otherunderage girls were kept. Heintroduced LG to a world of pros-titution.

By the time LG was 14, shehad used by four pimps and hadbeen forced to travel to AtlanticCity, Washington, D.C., andFlorida to perform sexual acts. Shewas arrested repeatedly on prosti-tution charges and in 2003, at theage of 17, she was arrested for car-rying a knife.

LG contended that because “Ihad already been raped by clientsand was terrified of it happeningagain. Every time I went out I wasscared of being raped or killed,”the knife was for protection. Atthe age of 18, LG took a coura-geous step and returned to a fosterplacement agency that placed herwith a family in Staten Island to,according to court papers,“…keep her away from Brooklyn,

where she did not feel safe…”In 2010, New York became the

first state in the country to allow vic-tims of human trafficking to vacateprior convictions, which resultedfrom their experience as sex slaves.In order to take advantage of thislaw, the defendant has to show thathe or she was a trafficking victim atthe time of the challenged arrest andthat the defendant’s participation inthe crime that lead to his/her arrestwas a result of being trafficked.

No Definition of ‘SexTrafficking Victim’

Queens Criminal Court JudgeToko Serita noted in her ruling thatwhile New York does not have a def-inition for “sex trafficking victim,”the crime of sex traffic is spelled outin the New York Penal Law. A per-son is guilty of sex trafficking ifhe/she “intentionally advances orprofits from prostitution” by usingmethods of “force or coercion toinstill a fear in the trafficked victimto compel her to engage in or contin-ue to engage in prostitution.”

While New York state law doesnot posses a true definition of a sextrafficking victim, Serita reasonedthat an individual who is forced towork as a prostitute for a pimp —apimp who would be guilty of sextrafficking under New York PenalLaw — is a victim of a sex traffick-er, and thus a sex trafficking victim.

Serita held that “LG hasdemonstrated that she was clearlya victim of sex trafficking underthe relevant state sex traffickingstatute because of her traffickers’use of force and fear to compel herparticipation in prostitution.”

Having been deemed a sextrafficking victim, Serita orderedthat LG’s prostitution charge bevacated, which the prosecution didnot contest.

Weapons Possession ChargeThe prosecution did, however,

assert that the weapons possessioncharge was not a result of LG’s sta-tus as a sex trafficking victim andtherefore not eligible for vacaturunder New York law, which onlyallows for prostitution offenses toqualify.

Serita asserted that while thepossession of a knife is not a prosti-tution offense, it is a prostitution-related offense. LG possessed apocketknife for protection “on thestreets where she was forced towork under dangerous conditionsbecause she had been raped andkidnapped in the past,” Seritawrote. “Her conviction for criminalweapons possession was clearly theresult of her having been traf-ficked,” he continued, and thereforethe charge of weapons possessioncould be considered a prostitution-related offense and eligible for

Office has announced that real estate attorneyEduard Fridman of Brooklyn has pleadedguilty to securities fraud.

Fridman admitted in state Supreme Courtin Manhattan to forging six condominiumplan acceptance letters from the AttorneyGeneral’s Real Estate Finance Bureau and fil-ing certain of them with the New York CityDepartment of Finance.

The forged documents allowed Fridman’sclients, the condo developers, to sell apart-ments to the public while evading theAttorney General’s regulatory oversight.

Under an agreed-upon plea deal, Fridman,36, will surrender his law license and pay thestate $100,000 in civil penalties, fees andcosts. In addition, Fridman has accepted a per-manent injunction from working in the securi-ties or condominium businesses in New Yorkand faces five years’ probation.

“It’s shocking that a member of the barwould forge the signatures of attorneys in myoffice to fraudulently sell condominiums tothe public,” Attorney General Schneidermansaid. “The real estate lawyers and profession-als in my office are here to protect condo-minium and co-op buyers from fraud, and itwill remain our priority to prosecuteunscrupulous lawyers like Fridman whoundermine the public trust with false filingsand forgeries.”

Fridman, pleaded guilty before New YorkSupreme Court Justice Melissa C. Jackson toone count of felony securities fraud, a Class Efelony, under New York’s securities law. Bylaw, an attorney who commits a felony in NewYork is automatically disbarred for a period ofat least seven years.

Fridman admitted to forging the six letterspurported to be issued by four assistant attor-neys general working in the Real EstateFinance Bureau. He submitted three of the for-geries to the Department of Finance in order toestablish tax lots for the apartments that were tobe sold to the public. It is unlawful for a devel-oper to market or sell condominiums in NewYork without a condominium plan acceptanceletter issued by the bureau.

The other three letters were sent to hisclients. Rather than submitting proper plans tothe Attorney General’s Office, Fridman forgedthe acceptance letters in order to create theappearance that they were in complete com-pliance with the law.

The forged documents relate to the fol-lowing condominiums in Brooklyn: 282 TroyAve., 26 and 28 Bay 50th St., 137 St. NicholasAve. and 2830 West 16th St.

Fridman’s scheme was discovered inDecember 2012, when one of the develop-ments changed hands and the counsel for thenew developer submitted one of the forgeriesto the bureau. Fridman’s forgeries weredesigned to create 88 illegal residential condounits. Eleven of these units were sold, andAttorney General Schneiderman’s office hastaken corrective measures to ensure thathomeowners in these developments still havelegal title to their apartments.

NY Court Upholds Vilar’s SentenceBy Larry Neumeister

A federal appeals court upheld the conviction of an opera-loving philanthro-pist convicted of a multimil-lion-dollar fraud but ordered him resentenced Friday.

The 2nd U.S. Circuit Court of Appeals in Manhat-tan left unclear whether Al-berto Vilar, 72, will remain free on bail.

His lawyer, Vivian She-vitz, said she was disappoint-ed. “But to the extent that the court has pointed the way to further litigation we will pur-sue it,” she said.

In upholding the convic-tion of Vilar and his co-de-fendant, Gary Alan Tanaka, a three-judge appeals panel dismissed claims they were tried unfairly.

It said a resentencing was warranted because a re-cent Supreme Court ruling raised questions as to wheth-er a loss estimated by a low-er-court judge at between $20 million and $50 million should include investments purchased overseas. A lower calculation could result in a lower sentence.

Convicted in 2008, Vilar was sentenced to nine years and Tanaka to five years in prison.

The court said Vilar and Tanaka promised investors their money would be invest-ed in high-quality, short-term deposits including U.S. Trea-sury bills, but then put their money in technology and biotechnology stocks that col-lapsed in value when the dot-com bubble burst in fall 2000.

Before the collapse, the Cuban-born Vilar was de-scribed by Forbes magazine as worth about $950 million after he earned hundreds of millions of dollars on invest-ments in the stock boom of the 1990s. He spent some of the money making dona-tions of as much as $225 mil-lion to opera houses.

Before his arrest, Vilar helped to manage up to $9 billion in investments. He gave generously to music companies and they recip-rocated with various hon-ors. His rich and powerful friends largely vanished af-ter his arrest. The Metropoli-tan Opera took his name off its grand tier, the Royal Op-era at Covent Garden in Lon-don removed his surname from its Floral Hall and the Salzburg Festival in Austria stripped his picture from its programs.

Owners of Fraudulent Mr. Softee Trucks Are Sued in Brooklyn Federal Court

Owners of suspected fake Mister Softee ice cream trucks are being asked to ex-plain themselves in Brooklyn Federal Court.

The Mister Softee brand is a federally protected trade-mark and the company pro-vides franchises to various entities and individuals for the exclusive right to sell ice cream in a signature Mister Softee truck.

Four trucks have been spotted on the streets of Queens that the company al-leges are unlawfully utilizing and benefiting from the Mis-ter Softee brand.

According to court papers, lawful Mister Softee trucks are white with blue trim bor-ders and blue wheels. The wording “The Very Best” ap-pears above the name “Mister Softee” in red cursive print. Franchised trucks also con-tain a distinctive cartoon logo depicting a soft ice cream cone with a smiley face and bow tie.

The suspected infring-ing vehicles are also white

with blue trim borders. Many contain decals made to resemble Mister Soft-ee insignia and other items that are “confusingly similar to the one[s] used by Mister Softee franchises,” the law-suit asserts.

“Mister Softee is a well-known brand, especially in New York,” Jeffrey Zucker, lawyer for the Mister Softee company, told the Brooklyn Daily Eagle. “People want to

copy it and get a free ride on the trademark.”

The suspected offend-ing vehicles were looked into after complaints were forwarded to Zucker’s of-fice. “We get calls from members of the public re-garding possible infringing trucks,” Zucker explained. “We first hire private inves-tigators to check out the complaint. Then we write a letter advising the truck

owner that they are infring-ing on a trademark and de-mand that they cease and deist. More times than not, the truck owner ignores the cease and desist letter, and a lawsuit is then filed.”

The present suit con-tends that persons who vio-late trademark law and use the Mister Softee brand to sell ice cream without per-mission harm not only the Mister Softee brand but also the consuming public.

“Ice cream is a milk-based product. Therefore, proper

guidelines and requirements need to be followed in order to ensure products are stored and dispensed in accordance to health standards,” said Zucker. Depots throughout New York, including Brook-lyn, are staffed with Mister Softee inspectors.

Infringing trucks, on the other hand, are not under the supervision of the Mis-ter Softee company and are therefore not subject to the extensive inspection of a li-censed Mister Softee truck, the lawsuit argues.

The ultimate goal of the trademark lawsuit is to force the suspected infringers to remove all connection to Mister Softee from their ice cream trucks.

“We just want them to paint their trucks over and remove any and all reference to Mister Softee,” Zucker stat-ed. Mister Softee also is seek-ing attorneys’ fees.

Although this was not re-quested, Mister Softee is enti-tled, if the suit is successful, to receive the triple the amount of profits that the offending trucks made while using the Mister Softee trademark.

Mister Softee is a fami-ly-owned business and has owned its trademark since 1956. “There is nothing wrong with competition,” Zucker noted. “Just compete under your own name.”

time writers ask for sug-gestions on helping their children return safely to school. Below are some safety tips to discuss with your children, as well as in-formation about my office’s Crime Prevention Divi-sion, which offers our Legal Lives Program in elemen-tary schools throughout Brooklyn. Additional edu-cational programs offered include workshops that ad-dress drunk driving, bul-lying, internet safety and gang awareness.• Use a buddy system whenever possible while traveling to school.• Avoid displaying mon-ey, jewelry and electronic equipment.• Keep keys separate from your knapsack, preferably in your pocket. If your bag is lost or stolen, the thief will not have access to your home.• Minimize the amount of money, credit cards and valuables that you carry, and only take items that are necessary for the day, divid-

ing money between your book bag and pockets.• Stay alert in crowded sit-uations such as subways and buses, keeping your possessions in front of you.• When traveling on sub-ways, ride in the conduc-tor’s car if possible.• Report any incident that may occur to authorities immediately.

Also, staff members from my office’s Crime Pre-vention Division conduct training sessions for prin-cipals, teachers, parents and students to recognize the signs of bullying and to take corrective action to stop or preempt it. Bullying typically consists of phys-ical abuse or threats, ver-bal taunting, or encourag-ing other students to shun a particular person.

My office also offers a program where members of our staff visit elemen-tary schools throughout Brooklyn to educate fifth-grade students about the criminal justice system as part of our Legal Lives Pro-gram. Prosecutors and sup-port staff from my office work together with judg-es and teachers to instruct

students about the law and its role in their lives. Legal Lives was founded in 1990 in response to a drastic in-crease in drug-related and bias crimes.

The program involves weekly interactive lessons; take home lessons, a ra-dio show and mock trials. Students are taught about a variety of topics includ-ing internet safety, drugs, drinking and driving, hate crimes, gun possession, do-mestic violence, shoplift-ing and violence. Lessons in the curriculum examine the facts of the actual cas-es. Students role-play the facts of the cases, respond to questions that are relat-ed to the crimes, learn ele-ments of the law pertinent to their age group, and par-ticipate in mock trials.
