The objectives of the Waste, Recycling and Garden Organics Code of Practice are to: provide an environment where activity

related to kerbside waste, recycling and garden organics complement the safety and amenity of the community;

reducing the environmental impact related to waste management; and

provide for the administration of Council’s powers and functions.The objectives of the Livestock Code of

Practice are to: ensure the safety of the public, farmers and

stock on Council-controlled roads; prevent damage to the road structure and its

environs; and promote the conservation of flora and fauna

on roadside land.The changes to the proposed General Local

Law clauses have been listed in the Community Impact Statement. The main changes to all PARTS are:

The format of the proposed General Local Law has been changed to meet the ministerial guidelines. The structure has been modified in places to bring related areas together and achieve consistency with the protocol for clause numbering. A new clause has been added to guide issuing conditional permits. The incorporated documents are now listed in one area. Expression has been improved with several clauses reworded to plain English.

Law headings have been amended to better explain what the law is for or what problem it is addressing. Some headings have been expanded and sub-headings created so that the purpose for the local law is clearer. This requirement will make it easier for the community to understand why a law is required. Duplications of power have been removed as required by the guidelines. PART 2 ROADS AND MUNICPAL PLACES

There are new provisions for declaring outdoor smoke-free areas.PART 3 ENVIRONMENT

The requirement for a permit to camp at Aysons Reserve has been altered to allow camping for two nights without a permit. The restrictions over long-term camping on the reserve have been retained.

(g) make other minor corrections to punctuation and formatting(h) update the penalties fixed for infringements in the Principal Local Law as a consequence of the

land;− the storage of boats, trailers, caravans or vehicles in a dilapidated state on roads or

Council land;− road restrictions;− consumption of alcohol and possession of alcohol in unsealed containers;− the use of wheeled toys on Council land;− parking of vehicles in any parking area on Council land contrary to any sign associated

with the parking area;− the sale of goods or services on roads and Council land or using roads and Council

land for commercial purposes;− the erection or use on any land of temporary structures or buildings for the sale of

goods, and the sale of goods from such a structure;− distribution of handbills, place cards, notices, advertisements, books, pamphlets,

goods, gifts or samples on roads or Council land;− street parties;− the type and number of animals that can be kept on any land, including the manner in

which they are kept;− noise and smell from animals;− animal excrement;− the feeding of animals;− the behaviour of dogs;− the use of Council’s waste collection service;− the use of Council’s street litter bins;

1. TitleThese Regulations may be cited as the Crown Land (Reserves) (Frankston Nature Conservation Reserve) Regulations 2015.

2. ObjectivesThe objectives of these Regulations are to provide for:(a) the care, protection and management of the Frankston Nature Conservation Reserve;

and(b) the preservation of good order in the Frankston Nature Conservation Reserve; and(c) the conditions under which any services or facilities may be used in the Frankston

Nature Conservation Reserve; and(d) the safety of persons in the Frankston Nature Conservation Reserve or any part of the

reserve; and(e) the issuing of permits in relation to activities in the Frankston Nature Conservation

Reserve.3. Authorising provision

These Regulations are made under section 13 of the Crown Land (Reserves) Act 1978.4. Commencement

These Regulations come into operation on the day on which they are published in the Government Gazette.

5. ExpiryThese Regulations expire on the day that is 10 years after the day on which they come into operation.

accommodation;‘committee of management’ means the committee of management appointed to manage, maintain, control and improve the Frankston Nature Conservation Reserve by the minister responsible for the Act;‘contractor’ includes any sub-contractor or employee of a contractor or sub-contractor;‘fauna’ means any animal or part of an animal that is indigenous to Victoria;‘fire’ includes a barbecue that uses solid, liquid or gaseous fuel;‘firearm’ has the same meaning as in the Firearms Act 1996;‘firewood’ means dead plant material not attached to a standing plant including a shrub or tree;‘fish’ has the same meaning as in the Fisheries Act 1995;‘flora’ means a plant indigenous to Victoria or part of such a plant in any stage of biological development, whether the plant or part of the plant is vascular or non-vascular and whether alive or dead;‘Frankston Nature Conservation Reserve’ means the land referred to in Division 27 of Part 1 of the Fifth Schedule of the Act;‘indigenousfish’ includes any kind or species of fish indigenous to Victoria;‘Secretary’ means the body corporate established by Part 2 of the Conservation, Forests and Lands Act 1987;‘the Act’ means the Crown Land (Reserves) Act 1978;‘vehicle’ has the same meaning as in the Road Safety Act 1986;‘vessel’ has the same meaning as in the Marine Act 1988.

7. Application of certain regulations(1) These Regulations do not apply to any of the following persons when acting in the

course of that person’s duties:(a) a member of the police force; or(b) an employee or representative of Melbourne Water; or (c) an authorised officer; or(d) a person appointed as a member of the committee of management; or(e) a contractor, volunteer or other person carrying out any work for or acting on the

authority or instruction of the Secretary or the committee of management; or(f) a person dealing with a fire, flood or other emergency.

(2) A person acting in accordance with a lease, licence, tenancy, permit or authority granted or issued under the Act, or an agreement entered into under the Act, or an Act relating to Frankston Nature Conservation Reserve, is not subject to these Regulations, to the extent that the activities authorised by that lease, licence, tenancy, permit, authority or agreement are inconsistent with these Regulations.

PART 2 AREAS SET ASIDE IN FRANKSTON NATURE CONSERVATION RESERVE8. Areas where access is prohibited

(1) Access to areas within the Frankston Nature Conservation Reserve is prohibited where set aside for:(a) the protection or management of flora and fauna, or geological,

geomorphological, archaeological, cultural or historic features or values; or(b) the planting of trees, shrubs, grass or other vegetation; or(c) the re-establishment of vegetation; or(d) the reclamation of land; or(e) the protection of buildings, facilities or other assets; or(f) reasons of public safety.

(2) Signs or notices must be erected or displayed indicating the areas set aside under sub-regulation (1) to which access is prohibited and the purpose for which the area is set aside.

(3) A person must not enter an area in Frankston Nature Conservation Reserve set aside under sub-regulation (1) to which access is prohibited and for which a sign or notice has been erected or displayed in accordance with sub-regulation (2).

9. Vehicles are prohibitedVehicles, with the exception of emergency service vehicles and vehicles entering the reserve for a management purpose, are prohibited from the reserve.

PART 3 GENERAL CONTROLS10. Interfering with animals

(1) A person must not, in Frankston Nature Conservation Reserve:(a) disturb, harass, remove, hunt, capture, take, kill or injure or otherwise destroy

or interfere with any fauna or other animal; or(b) destroy, disturb or interfere with the nest, bower, display mound, lair or burrow

of any fauna or other animal.(2) Sub-regulation (1) does not apply to a person who:

(a) holds a permit to engage in an activity referred to in sub-regulation (1); and(b) is acting in accordance with the permit.

(3) A person must not, in Frankston Nature Conservation Reserve, feed, offer food or offer any object as food to any fauna or other animal, where the animal is not lawfully brought into the reserve.

11. Protecting vegetation(1) A person must not, in Frankston Nature Conservation Reserve, cut, fell, pick, remove,

take, destroy or damage any flora or other vegetation, whether alive or dead.(2) Sub-regulation (1) does not apply to a person who:

(a) holds a permit to engage in an activity referred to in sub-regulation (1); and(b) is acting in accordance with the permit.

12. Introducing vegetationA person must not, in Frankston Nature Conservation Reserve, knowingly bring in, plant or introduce any seed, tree, shrub, fern, algae or other vegetation, or any part of any tree, shrub, fern, algae or other vegetation.

13. Interfering with rocks, natural objects or features(1) A person must not, in Frankston Nature Conservation Reserve, intentionally damage,

deface, remove or otherwise interfere with any rock, or similar natural object, or geomorphological feature.

(2) Sub-regulation (1) does not apply to a person who:(a) holds a permit to engage in an activity referred to in sub-regulation (1); and(b) is acting in accordance with the permit.

14. Digging or removal of material(1) A person must not:

(a) dig or remove from Frankston Nature Conservation Reserve any gravel, shell, grit, sand, soil, rock or other similar material; or

(b) knowingly take into Frankston Nature Conservation Reserve any gravel, shell, grit, sand, soil, rock or other similar material.

(2) Sub-regulation (1) does not apply to a person who:(a) holds a permit to engage in an activity referred to in sub-regulation (1); and(b) is acting in accordance with the permit.

15 Signs and structures(1) A person must not, in Frankston Nature Conservation Reserve:

(a) remove, cut, displace, deface or interfere with any sign or structure; or(b) erect, construct or place any sign or structure.

(2) Sub-regulation (1)(b) does not apply to a person who acts in accordance with a management directive.

16. GatesA person must not leave any gate in Frankston Nature Conservation Reserve open unless the gate is already open.

17. BicyclesA person must not ride or take a bicycle into Frankston Nature Conservation Reserve.

18. SwimmingA person must not enter the water body at the Frankston Nature Conservation Reserve for the purposes of swimming or any other like activity.

19. Vessels(1) A person must not launch, land, load, unload, moor, anchor or operate a vessel whether

powered or otherwise in Frankston Nature Conservation Reserve.(2) Sub-regulation (1) does not apply to a person who:

(a) holds a permit to engage in an activity referred to in sub-regulation (1); and(b) is acting in accordance with the permit.

20. CampingA person must not camp in Frankston Nature Conservation Reserve.

21. LightingormaintainingfiresA person must not light or maintain a fire in the open air in Frankston Nature Conservation Reserve.

22. Dogs(1) A person must not bring a dog into Frankston Nature Conservation Reserve or allow

a dog to enter or to remain in the reserve.

(2) Sub-regulation (1) does not apply to a disabled person who brings a dog into Frankston Nature Conservation Reserve to assist that person with respect to that person’s disability.

(3) A person in charge of a dog in Frankston Nature Conservation Reserve in accordance with sub-regulation (2) must take reasonable steps to ensure that the dog’s excrement does not remain in the reserve.

23. HorsesA person must not ride, drive or lead a horse into Frankston Nature Conservation Reserve or allow a horse to enter or remain in the reserve.

24. Other animals(1) A person must not bring an animal into Frankston Nature Conservation Reserve or

allow any such animal under that person’s care and control to enter or remain in the reserve.

(2) A person must not allow an animal in his or her care and control to stray or wander into the reserve.

(3) Sub-regulation (1) does not apply to a disabled person who brings an animal into Frankston Nature Conservation Reserve to assist that person with respect to that person’s disability.

25. FishingA person must not fish or attempt to take fish from any part of Frankston Nature Conservation Reserve.

26. Firearms and weaponsA person must not, in Frankston Nature Conservation Reserve, possess, carry or use any firearm, bow, cross-bow, spear gun, spear or similar weapon.

27. Traps and poisons(1) A person must not, in Frankston Nature Conservation Reserve, possess, carry or use

any trap, snare, net or poison.(2) Sub-regulation (1) does not apply to a person who:

(a) holds a permit to engage in an activity referred to in sub-regulation (1); and(b) is acting in accordance with the permit.

28. Special events(1) A person must not, in Frankston Nature Conservation Reserve, conduct any sporting,

recreational or entertainment event or other organised function.(2) Sub-regulation (1) does not apply to a person who:

(a) holds a permit to engage in an activity referred to in sub-regulation (1); and(b) is acting in accordance with the permit.

29. Commercial activities(1) A person must not, in Frankston Nature Conservation Reserve:

(a) conduct a commercial activity or offer for sale or hire any article or service; or(b) distribute or display any handbill, pamphlet or advertising matter or put up or

leave any advertising placard or notice; or(c) take any photograph, film, video or audio recording for commercial purposes.

(2) Sub-regulation (1) does not apply to a person who:(a) holds a permit to engage in an activity referred to in sub-regulation (1); and(b) is acting in accordance with the permit.

30. Permits(1) The committee of management may issue a permit for the activities referred to in

regulations 10, 11, 13, 14, 19, 27, 28 and 29.(2) A permit issued under sub-regulation (1) authorises the holder to enter and use

Frankston Nature Conservation Reserve:(a) for the purpose specified in the permit; and(b) for the period specified in the permit; and(c) subject to any terms and conditions in respect of that entry or use determined

by the committee of management and specified in the permit.(3) A permit issued by the committee of management under these Regulations must be in

writing.(4) The holder of a permit must comply with any terms and conditions of that permit.(5) The committee of management may cancel a permit at any time:

(a) if the holder of the permit has breached the conditions of the permit or breached these Regulations; or

(b) if the continuation of the permit is likely to be detrimental to, or interfere with the management and protection of the natural environment, features or visitors in Frankston Nature Conservation Reserve.

(6) Upon cancellation of a permit under sub-regulation (5), the committee of management must cause the holder of the permit to be notified in writing of the cancellation of the permit within a reasonable time after the cancellation.

31. Directions by the committee of managementAny appointed member of the committee of management may:(a) request any person whom that member believes on reasonable grounds has contravened

these Regulations to leave the Frankston Nature Conservation Reserve or any part of the reserve; or

(b) request any person for the reason of public safety to leave Frankston Nature Conservation Reserve or any part of the reserve.

Approved Motor Bike Helmets1. Purpose

The purpose of this notice is to set out the motor bike helmets that are approved for use under the Road Safety Road Rules 2009 (in this notice referred to as the Road Rules).

2. Authorising provisionThis notice is made under Rule 407(d) of the Road Rules which states that the Corporation, by notice published in the Government Gazette, may declare a motor bike helmet to be an approved motor bike helmet for the purposes of the Road Rules.

3. CommencementThis notice comes into operation on the date of publication.

4. ExpiryThis notice expires on 9 November 2019.

5. RevocationThe notice published in Government Gazette No. G 15 on Thursday 12 April 2012 entitled ‘Approved Motor Bike Helmets’ is revoked.

6. DefinitionIn this notice –‘AS 1698-1988’ means Australian Standard AS 1698-1988 ‘Protective Helmets for Vehicle Users’, incorporating all amendments approved and published by Standards Australia;‘AS/NZS 1698:2006’ means Australian/New Zealand Standard AS/NZS 1698-2006 ‘Protective Helmets for Vehicle Users’, incorporating all amendments approved and published by Standards Australia and Standards New Zealand, or any later version of that standard;‘ECE 22.05’ means the United Nations Economic Commission for Europe (ECE) Regulation No. 22 ‘Uniform Provisions Concerning the Approval of Protective Helmets and their Visors for Drivers and Passengers of Motor Cycles and Mopeds’, incorporating the 05 series of amendments to that regulation, and any further amendments approved and published by the ECE, or any later version of that standard; and‘relevant Standard’ means:(i) AS 1698-1988; or(ii) AS/NZS 1698:2006; or(iii) ECE 22.05.

7. Approval of motor bike helmetsFor the purposes of the term ‘approved motor bike helmet’ in the Road Rules I, Anita Curnow, delegate of the Roads Corporation, approve each motor bike helmet that –(a) complies with the relevant Standard in force at the time of its manufacture in, or

importation into, Australia, as the case may be; and(b) is marked with –

(i) in the case of compliance with AS 1698:1988 or AS/NZS 1698-2006 and if manufactured in, or imported into, Australia before 1 July 2012, an official standards mark certifying compliance with either of those standards; or

(iii) in the case of compliance with ECE 22.05, an international approval mark in accordance with ECE 22.05.

The Amendment also amends Clause 21.08 to re-insert the Heidelberg Structure Plan map and remove a duplication error.
