HAVASEC.222.PROCESSFORADOPTION.

(a)GENERALREQUIREMENTFORNOTICEANDCOMMENT.—Consistentwiththerequirementsofthissection,thefinaladoptionofthevoluntaryvotingsystemguidelines(ormodificationofsuchaguideline)shallbecarriedoutbytheCommission inamannerthatprovidesforeachofthefollowing:(1)PublicationofnoticeoftheproposedguidelinesintheFederalRegister.(2)Anopportunityforpubliccommentontheproposedguidelines.(3)Anopportunityforapublichearingontherecord.(4)PublicationofthefinalguidelinesintheFederalRegister

(1)CONSIDERATIONOFRECOMMENDATIONSOFDEVELOPMENTCOMMITTEE.—Indeveloping thevoluntaryvotingsystemguidelines andmodificationsofsuchguidelines underthissection,H.R.3295—19theExecutiveDirectoroftheCommissionshalltakeintoconsiderationtherecommendationsprovidedbytheTechnicalGuidelinesDevelopmentCommitteeundersection221.(2)BOARDOFADVISORS.—TheExecutiveDirectoroftheCommissionshallsubmittheguidelinesproposedtobeadoptedunderthispart(oranymodificationstosuchguidelines)totheBoardofAdvisors.(3)STANDARDSBOARD.—TheExecutiveDirectoroftheCommissionshallsubmittheguidelinesproposedtobeadoptedunderthispart(oranymodificationstosuchguidelines)totheExecutiveBoardoftheStandardsBoard,whichshallreviewtheguidelines (ormodifications)andforwarditsrecommendations totheStandardsBoard.

(d)FINALADOPTION.(1)INGENERAL.—Avoluntaryvotingsystemguidelinedescribedinsubsection(b)(ormodificationofsuchaguideline)shallnotbeconsideredtobefinallyadoptedbytheCommissionunlesstheCommissionvotestoapprovethefinaladoptionoftheguideline(ormodification),takingintoconsiderationthecommentsandrecommendationssubmittedbytheBoardofAdvisorsandtheStandardsBoardundersubsection(c).

(2)MINIMUMPERIODFORCONSIDERATIONOFCOMMENTSANDRECOMMENDATIONS.—TheCommissionmaynotvoteonthefinaladoptionofaguidelinedescribedinsubsection(b)(ormodificationofsuchaguideline)untiltheexpirationofthe90-dayperiodwhichbeginsonthedatetheExecutiveDirectoroftheCommissionsubmitstheproposedguideline(ormodification)totheBoardofAdvisorsandtheStandardsBoardundersubsection(b).
