activities,Iagreeasfollows: Ifullyunderstandandacknowledgethatoutdoorrecreationalactivitieshave:(a)inherentrisks,dangersandhazardsandsuchexistsinmyuseofpaddlingequipmentandmyparticipationinpaddlingactivitiesandrelatedactivities;(b)myparticipationinsuchactivitiesand/oruseofsuchequipmentmayresultininjuryorillnessincluding,butnotlimitedtobodilyinjury,disease,strains,fractures,partialand/ortotalparalysis,deathorotherailmentsthatcouldcauseseriousdisability;(c)theserisksanddangersmaybecausedbythenegligenceoftheowner,employees,officersoragentsoftheUnitedStatesofAmerica,UnitedStatesForestService,StateofTennessee,TennesseeValleyAuthorityandWildwaterLtd.;thenegligenceoftheparticipants,thenegligenceofothers,accidents,breachesofcontract,theforcesofnatureorothercauses.Risksanddangersmayarisefromforeseeableorunforeseeablecausesincluding,butnotlimitedto,staffdecisionmaking,includingthatstaffmaymisjudgeterrain,weather,transportation,trailorriverroutelocation,andwaterlevel,risksoffallingoutofordrowningwhileinaraft,canoeorkayakandsuchotherrisksandhazardsanddangersthatareintegraltorecreationalactivitiesthattakeplaceinawilderness,outdoororrecreationalenvironment;and(d)andbymyparticipationintheseactivitiesand/oruseofequipment,Iherebyassumeallrisksanddangersandallresponsibilityforanylossesand/ordamages,whethercausedinwholeorinpartbythenegligenceorotherconductoftheowners,agents,officers,oremployeesoftheUnitedStatesofAmerica,UnitedStatesForestService,StateofTennessee,TennesseeValleyAuthorityandWildwaterLtd.,orbyanyotherperson.

I,onbehalfofmyself,mypersonalrepresentativesandmyheirs,herebyvoluntarilyagreetorelease,waive,discharge,holdharmless,defendandindemnifytheUnitedStatesofAmerica,UnitedStatesForestService,StateofTennessee,TennesseeValleyAuthorityandWildwaterLtd.anditsowners,agents,officersandemployeesfromanyandallclaims,actionsorlossesforbodilyinjury,propertydamage,wrongfuldeath,lossofservicesorotherwisewhichmayariseoutofmyuseofpaddlingequipmentormyparticipationinpaddlingactivities,transportation,andrelatedactivities.IspecificallyunderstandthatIamreleasing,dischargingandwaivinganyclaimsoractionsthatImayhavepresentlyorinthefutureforthenegligentactsorotherconductbytheowners,agents,officersoremployeesoftheUnitedStatesofAmerica,UnitedStatesForestService,StateofTennessee,TennesseeValleyAuthorityandWildwaterLtd.

IherebyauthorizeWildwaterLtd.anditsphotographicagentstotakeandutilizephotographsofmeforthepurposeofsale,promotionandadvertising.

IunderstandthatIandanyoneforwhomIsignasaParentorGuardianmustbeoftherequiredageof12years.

IHAVEREADTHEABOVEWAIVERANDRELEASEANDBYSIGNINGITAGREEITISMYINTENTIONTOEXEMPTANDRELIEVEWILDWATERLTD.FROMLIABILITYFORPERSONALINJURY,PROPERTYDAMAGEORWRONGFULDEATHCAUSEDBYNEGLIGENCEORANYOTHERCAUSE.
