    Background and Summary of Proposal The Blue Mountain Broadcasting Association has proposed to convert an existing 7,400 square foot building at 1470 Wallula Avenue into a studio and offices for Blue Mountain Television. Blue Mountain Television is a not-for-profit organization in the 29th year of providing free television broadcast programming to the Walla Walla Valley. Previously, the radio station shared broadcasting space at Walla Walla University in College Place. The interior of the church sanctuary will be modified for use a television studio. A 100-foot free-standing tower would be installed behind the building; the proposed location of the tower is shown on the submitted site plan (Exhibit 3). The church building was constructed in 2010-2012 under a Conditional Use Permit granted for the Cornerstone Missionary Baptist Church by the Hearing Examiner in 2009 (see Exhibit 12). The subject Conditional Use Permit application (CUP19-002) was submitted to Walla Walla County on May 31, 2019 (Exhibit 2). Recommendation Staff recommends that the Hearing Examiner approve the Conditional Use Permit with the recommended conditions listed on Page 6. General Information

    Critical Areas: The property is within two mapped critical areas: Geologically Hazardous Area (seismic hazard area with moderate to high liquefaction susceptibility) and Critical Aquifer Recharge Area (CARA). There are not expected to be any significant impacts to critical areas as a result of this proposal that cannot be mitigated by the requirements of the County’s Critical Area Ordinance (CAO) – WWCC Chapter 18.08.

    Transportation and Land Use Access: The site is accessed via two existing driveways from Wallula Avenue, the east driveway is 18-feet wide and for entering only. The west driveway is 24-feet wide and allows entry and exit. No changes to access were proposed by the applicant. Neighborhood and Project Area Characteristics: The property is approximately 3.18-acres and located about 250-feet south of Mill Creek. Land uses in the vicinity are rural in character, with residential and agricultural and scattered commercial uses. Traffic Generation: The proposed well building is not expected to generate any traffic impacts. According to the SEPA Environmental Checklist (Exhibit 4), the project will generate 4-10 trips per day. This is significantly more trips that allowed via the conditional use permit issued for the Cornerstone Baptist Church which planned for 20 peak traffic volume on Sunday mornings and Wednesday evenings (Exhibit 12: Finding 3). Cultural Resources: The Washington State Department of Archaeology and Historic Preservation (DAHP) has recommended that the applicant be required to have a professional archaeology monitor the project area during excavation for the installation of the antenna tower. Utilities Stormwater: The project will not generate significant amounts of new impervious surfaces. The paved parking lot and buildings shown on the site plan (Exhibit 3) exist, only the tower will be constructed as part of this project. The applicant will be required to comply with Walla Walla County’s stormwater regulations as applicable; the Public Works Department enforces these regulations and has not submitted any comments regarding potential stormwater impacts. The PWD will complete final stormwater review via the building permit process. Wastewater Disposal: The site is served by a 1,000-gallon on-site septic system and 300-foot drainfield which are shown on the submitted site plan (Exhibit 3). Water: The site is served by an existing well. SEPA Environmental Review and Notice of Application On October 15, 2019, a Notice of Application (Exhibit 7) was issued via the optional SEPA Determination of Non-Significance (ODNS) process with a 14-day comment period. On November 22, 2019, a Final SEPA Determination of Non-Significance (DNS) was issued by the Director of the Walla Walla County SEPA Responsible Official (Exhibit 8). No appeals of the SEPA determination have been filed. The Notice of Application and DNS were distributed to consulting agencies by email. Public Hearing Notice The Walla Walla County Community Development Department issued a Notice of Public Hearing on November 29, 2019 (Exhibit 9). This notice was published in the Walla Walla Union Bulletin on

    November 29th and on the Walla Walla County website on November 21st. The notice was also mailed to property owners within 500 feet of the site on November 21st. Public Comments No public comments have been received. Agency Comments As documented in Exhibit 7, CUP application materials were distributed by the County to the follow agencies:

    Walla Walla Valley Metropolitan Planning Organization (WWVMPO) Confederated Tribes of the Umatilla Indian Reservation (CTUIR) Walla Walla County Public Works Department (PWD) Walla Walla County Building Official/Fire Marshal Walla Walla County Environmental Health Walla Walla County Building Official/Fire Walla Walla County Conservation District Walla Walla County Sheriff Washington State Department of Archaeology and Historic Preservation (DAHP) Washington State Department of Ecology (Ecology) Washington State Department of Fish and Wildlife (WDFW) Washington State Department of Transportation (DOT) Fire District No. 4 Port of Walla Walla Walla Walla Public Schools

    The following agencies responded to the notices with comments.

    Washington State Department of Archaeology and Historic Preservation (DAHP) – see Exhibit 10. Washington State Department of Ecology (Ecology) – see Exhibit 11.

    Comprehensive Plan

    Pursuant to Walla Walla County Code Section 17.40.020(E), all proposed conditional use permits for sites located in the County shall be reviewed to ensure compatibility with the Walla Walla County Comprehensive Plan. Below is a selection of applicable Comprehensive Plan statements, goals and policies from the Rural and Resource Lands Element (Chapter 6).

    Goal RL 2. “Plan rural areas for a diversity of living and working situations that will provide

    residents with an opportunity to make economic and lifestyle choices.”

    Policy RL-2 “Allow limited new development that is consistent with the current rural

    character of the County.”

    Policy RL-24 “Within the Rural Residential 5 land use designation, recognize existing development patterns along arterials and in rural nodes and provide for infill or redevelopment in those areas.”

    Response: The proposed radio station use is an appropriate use within the RR-5 zone and this project will allow for redevelopment of a vacant site requiring minimal site improvements.

    Applicable Statutes/Codes Under WWCC 17.16.014, ‘Radio and Television Broadcasting Stations and Towers’ are classified as a conditional use in the RR-5 zoning district; this use is not defined in WWCC Chapter 17.08.

    Development Conditions (WWCC 17.16.014(G)(3)

    A footnote in the Permitted Uses Table (WWCC 17.16.014) identifies five development conditions for radio and television broadcasting towers:

    a. The applicant shall demonstrate that the selected tower design is as visually unobtrusive as

    possible, considering technical, engineering, economic or other constraints.

    b. The tower shall be painted silver or the galvanized finish be retained on towers less than

    two hundred feet or unless otherwise required by the FAA.

    c. Appropriate landscaping may be required and/or fencing and signage for radiation.

    d. No nighttime lighting of the tower may take place unless required by the FAA.

    e. The tower shall meet the minimum front yard setback for the district in which it is located

    or twenty percent of its height, whichever is greater and be set back from the side and rear

    property lines equal to twenty percent of its height.

    Chapter 17.40, Conditional Uses

    Section 17.40.020 states that a conditional use permit shall be approved, approved with conditions, or denied based on the following criteria. A. That the use will not endanger the public health or safety;

    Conclusion: The proposal will have to meet all applicable local, state, and federal safety standards; no comments from local or State agencies were submitted indicating that the facility will endanger the public health or safety.

    B. That the use will not generate significant nuisance conditions such as noise, dust, glare, vibration; Conclusion: Staff concludes that the project will not generate significant nuisance conditions. While temporary noise, dust, and vibrations will be present during installation of the tower, temporary erosion and sediment control measures during construction will help mitigate many of these impacts. In the developed condition, the radio station is expected to generate less traffic, noise and other nuisance conditions than the previous use (church).

    C. That the use meets all required conditions and standards set forth in the district where it proposes to locate; Conclusion: A Conditional Use Permit (CUP) is required in the RR-5 zone for all radio and television broadcasting stations. The proposed tower is compliant with the setback standards in WWCC 17.18.020 (30-foot minimum) and WWCC 17.16.017(G)(e) (20-foot minimum).

    D. That the location and character of the use is compatible and consistent with the character of the area in which it is to be located; Conclusion: The proposed use is within an area marked by rural residential properties and agricultural uses. The location and character of the use is compatible and consistent with the character of the area. The project will utilize an existing vacant facility adding only one structure, a radio tower. Peak traffic will be lower than the previous use (a church).

    E. That the use is in conformance with the Comprehensive Plan; and Conclusion: Staff concludes that the use is in conformance with the Comprehensive Plan. As described above, the proposed use furthers multiple policies and goals of the Comprehensive Plan related to rural land uses.

    F. That the use will be supported by adequate public facilities or services. Conclusion: The use is supported by adequate public facilities, including power, gas, and telephone.

    Recommended Conditions of Approval 1. Pursuant to Walla Walla County Code Section 17.40.025, the action for which the conditional

    use permit is required shall begin within one year of approval unless extended for up to one year by the Director. Failure to begin such action within the time limits specified shall void approval of the conditional use.

    2. Before construction, the applicant must first obtain any / other associated permit(s) or approvals required by the County or any other governmental agency or regulatory authority with jurisdiction over a particular aspect of the project. Any conditions of approval or requirements imposed as part of such permits or approvals shall be are hereby incorporated as Conditions of Approval for this permit.

    3. Pursuant to Walla Walla County Code Section 14.13.110, at any time during the life of the permit, the Community Development Department Director may ask the Hearing Examiner to revoke the permit if the project is not in compliance with any of the conditions of approval and/or required permits.

    4. Future changes in operations, plans, or additions will require an amendment, approved by the County’s Hearing Examiner, to the conditional use permit pursuant to Walla Walla County Code Section 14.03.050.

    5. The site is located within an area with a “high potential for archaeological resources.” The applicant shall comply with the recommendations of the Washington State Department of Archaeology and Historic Preservation (Exhibit 10) and conduct tribal consultation and cultural resource monitoring as requested by DAHP and/or the tribes.

    6. Exterior lighting shall be directed and shielded in a manner which minimizes its visibility at the site's boundaries. Exterior lighting shall not be used in such a manner that it produces glare on public streets and neighboring residential properties. Nighttime lighting of the tower is prohibited unless required by the FAA.

    7. The applicant must comply with all requirements of WWCC Chapter 18.08, Critical Area Protection, for any portion of the project within a critical area or a critical area buffer. Prior to building permit issuance, the applicant must obtain a critical areas permit.

    ATTN:  Lauren Prentice Principal Planner Walla Walla County Community Development Dept  Blue Mountain Broadcasting Association has purchased the building and property at 1470 Wallula Avenue, Walla Walla County, and filed various applications noting the need for installing an 80 foot tall self‐supporting communications tower to be located behind the northeast corner of the existing building.  This tower will be relocated from its present position at SonBridge Community Center in College Place.  There are numerous tall trees in the vicinity of the Wallula Avenue site, and it has become clear that an additional 20 feet of height would greatly benefit us in meeting our current and future communication needs.  The tower manufacturer has informed me that the underground base is designed to easily handle a tower of up to 120 feet, so adding 20 feet to the top of the existing 80 foot tower would cause no safety concerns.  Blue Mountain Broadcasting Association hereby requests a modification to our various checklists and applications to note that the tower height will be 100 feet instead of the original 80 feet as indicated.  The tower footprint will remain the same and only the top section will be extended upward 20 feet.  The underground base will meet or exceed the specified requirements for the proposed tower.  Thank you for your consideration in approving this modification and in granting a conditional use permit for the site.  We are working with the tower manufacturer in securing updated plans and tower details so we can apply for a building permit specific to the tower installation.  If you have any questions, please call me at  509‐240‐3974.  Thank you sincerely,  Jim  James Forsyth Blue Mountain Broadcasting Association 1200 SE 12th Street, Ste. 2 College Place, WA  99324 tel:  509‐529‐9149

    Directly under the tower there will be a deep underground concrete base that the tower legs are bolted to just above ground level.  Each tower leg will be cad‐weld bonded to an engineered grounding system that also is directlly under the tower, as recommended by the tower manufacturer and the FCC.  There are no underground utilities involved.  All excavation is immediately beneath the tower and goes approximately ten feet deep beneath the ground surface and ten feet diameter.  If you need more information, please let me know.

A desktop review of our Statewide Predictive Model has identified the proposed project area as having high potential for archaeological resources. Further, the scale of the proposed ground disturbing actions would destroy any archaeological resources present. Therefore, we recommend that a professional archaeologist monitor the project area during excavation for the installation of the antenna tower. We also recommend consultation with the concerned Tribes' cultural committees and staff regarding cultural resource issues.
