Title or Subject: Medicaid State Plan Amendment (SPA) 19-0002.

Effective Date: January 1, 2019.Description: The health care authority intends to submit

medicaid SPA 19-0002 in order to maintain standards for medicaid programs that are based on the federal benefit rate (FBR). The annual FBR amount is based in part on cost-of-living adjustment, which increased by 2.8 percent for calen-dar year 2019.

Due to an increase in FBR, income and resource eligibil-ity standards for medicaid programs that are based on FBR must also increase in accordance with federal requirements. This SPA is expected to have no impact on annual aggregate expenditures.

A copy of SPA 19-0002 is available for review. The health care authority would appreciate any input or concerns regarding this SPA. To request a copy of the SPA, you may contact the agency in your county listed in the table or the person named below. If the court does not find, or a court has not previously found, probable cause, the accused shall be released without conditions.

(o) Bail in Criminal Offense Cases—Mandatory Appearance.

(1) Except as provided in subsection (2) or (3) below, when required to reasonably assure appearance in court, bail for a person arrested for a misdemeanor shall be $500 and for a gross misdemeanor shall be $1,000. In an individual case and after hearing the court for good cause recited in a written order may set a different bail amount.

(2) A court may adopt a local rule requiring that persons subjected to custodial arrest for a certain class of offenses be held until they have appeared before a judge.

(3) Pursuant to RCW 10.31.100, a police officer shall arrest and keep in custody, until release by a judicial officer on bail, personal recognizance, or court order, a person with-out a warrant when the officer has probable cause to believe that the person has violated RCW 46.61.502 (Driving Under the Influence) or RCW 46.61.504 (Physical Control of a Vehicle Under the Influence) or an equivalent local ordi-nance and the police officer: (i) has knowledge that the per-son has a prior offense as defined in RCW 46.61.5055 within 10 years; or (ii) has knowledge, based on a review of the information available to the officer at the time of arrest, that the person is charged with or is awaiting arraignment for an offense that would qualify as a prior offense as defined in RCW 46.61.5055 if it were a conviction.

NOTE: A police officer is not required to keep a person in custody if the person requires immediate medical attention and is admitted to a hospital.

(e) Statement of Arrangements. A statement of arrangements should be filed contemporaneously with the notice of appeal or within 7 days after discretionary review is accepted. The party seeking review should arrange for the transcription of an original and one copy of the verbatim report of proceedings. If the proceeding being reviewed was recorded electronically, transcription of the recordings shall be completed by a court-approved transcriber in accordance with the procedures developed by the Administrative Office of the Courts. An indigent party should provide the court reporter, transcriber, or court administrator a copy of the order of indigency. A non-indigent party should arrange for payment for the transcription of the report.

The party seeking review must file with the trial and appellate courts and serve the statement of arrangements on all parties of record and all named court reporters and file proof of service with the appellate court. The party must indi-cate the date that the report of proceedings was ordered, the financial arrangements which have been made for payment of transcription costs, the name of each court reporter or other person authorized to prepare the report of proceedings who will be preparing a transcript, the hearing dates, and the trial court judge. If the party seeking review does not intend to provide a report of proceedings, a statement to that effect should be filed in lieu of a statement of arrangements and served on all parties of record.

(g) Designation and Filing of Clerk's Papers. The party seeking review should file a designation of clerk's papers with the trial and appellate courts contemporaneously with the notice of appeal or within 7 days after discretionary review is accepted. In appeals under this rule, the entire trial court file shall be designated as clerk's papers to be transmit-ted to the appellate court. All of the exhibits filed in the trial court shall also be designated and transmitted to the appellate court. When discretionary review is granted under this rule, the contents of the clerk's papers shall be governed by RAP 9.6(b). In cases appropriate for consolidation under subsec-tion (d) of this rule, a designation of clerk's papers need only request the preparation of a single trial court file. The clerk shall prepare and transmit the clerk's papers as set forth in rules 9.7 and 9.8, except that a copy of the clerk's papers and the exhibits shall be provided to appellate counsel. Rule 1.11. The term "personally and substantially" signifies that a judge who was a member of a multimember court, and thereafter left judicial office to practice law, is not prohibited from representing a client in a matter pending in the court, but in which the former judge did not participate. So also the fact that a former judge exercised administrative responsibility in a court does not prevent the former judge from acting as a lawyer in a matter where the judge had previously exercised remote or incidental administrative responsibility that did not affect the merits. Compare the Comment to Rule 1.11. The term "adjudicative officer" includes such officials as judges pro tempore, referees, special masters, hearing officers and other parajudicial officers, and also lawyers who serve as part-time judges. (2) Requirements. An applicant under this rule must:(A) Have been admitted to practice law in another U.S.

state, territory, or the District of Columbia;(B) Hold a J.D. or LL.B. degree from a law school

approved by the Council of the Section of Legal Education and Admissions to the Bar of the American Bar Association at the time the applicant matriculated or graduated;

(C) Establish that the applicant is currently a member in good standing in all jurisdictions where admitted;

(D) Establish that the applicant is not currently subject to attorney discipline or the subject of a pending disciplinary matter in any jurisdiction;

(E) Establish that the applicant possesses the character and fitness to practice law in this jurisdiction;

(F) Reside, or intend within the next six months to reside, in this jurisdiction as a spouse of a member of the United States Uniformed Services;

(G) Not have failed this jurisdiction's bar examination within five years of the date of filing an application under this rule;

(H) Not have been previously denied admission to the practice of law in this jurisdiction; and

(I) Certify that the applicant has read and is familiar with this jurisdiction's Rules of Professional Conduct;

(J) Complete the WSBA sponsored reinstatement course within one year from the date of admission.

(3) Procedure. WSBA may require such information from an applicant under this rule as is authorized for any applicant for admission to practice law—except any informa-tion specifically excluded by this rule-and may make such investigations, conduct such hearings, and otherwise process applications under this rule as if made pursuant to this juris-diction's rules governing application for admission without examination. Upon a showing that strict compliance with the provisions of this section would cause the applicant unneces-sary hardship, the Bar may in its discretion waive or vary the application of such provisions and permit the applicant to fur-nish other evidence in lieu thereof.

(4) Time and Manner for Admission. If after such inves-tigation as the Bar may deem appropriate, it concludes that the applicant possesses the qualifications required of all other applicants for admission to practice law in this jurisdiction, the applicant shall be licensed to practice law and enrolled as a member of the bar of this jurisdiction. WSBA shall promptly act upon any application filed under this rule.

(5) Rights and Obligations. Except as provided in this rule, attorneys licensed under this rule shall be entitled to all privileges, rights, and benefits will be subject to all duties, obligations, and responsibilities of active members of the bar of this jurisdiction, including all ethical, legal, and continuing legal education obligations.

(6) Discipline. Attorneys admitted under this rule shall be subject to the jurisdiction of the courts and agencies of this jurisdiction with respect to the laws and rules of this jurisdic-tion governing the conduct and discipline of attorneys, to the same extent as all other members of the bar of this jurisdic-tion.

(7) Fee Waiver. The requisite application fees charged by this jurisdiction will be waived for all applicants seeking admission under this rule.

(8) Termination. The license to practice law under this rule shall be limited by the earliest of the following events:

(A) The servicemember separates or retires from the United States Uniformed Services;

(B) The military spouse attorney ceases to be a depen-dent as defined by the Department of Defense (or, for the Coast Guard when it is not operating as a service in the Navy, by the Department of Homeland Security);

(C) The servicemember is permanently transferred out-side the jurisdiction pursuant to military orders, except that if the servicememeber has been assigned to an unaccompanied or remote assignment with no dependents authorized, the mil-itary spouse attorney may continue to practice pursuant to the provisions of this rule until the servicemember is assigned to a location with dependents authorized;

(D) The military spouse attorney permanently relocates to another jurisdiction for reasons other than the servicemem-ber's permanent transfer outside of the jurisdiction;

(E) The military spouse attorney is admitted to the gen-eral practice of law in Washington State under any other rule;

(F) The military spouse attorney requests termination; or(G) The military spouse attorney fails to meet annual

licensing requirements for an active member of the State Bar.In the event that any of the events listed in this paragraph

occur, the attorney licensed under this rule shall notify WSBA of the event in writing within sixty (60) days of the date upon which the event occurs and upon such notification, the license shall be terminated. If the event occurs because the servicemember is deceased or disabled, the attorney shall notify WSBA within one hundred eighty (180) days of the date upon which the event occurs.

(9) Mandatory Disclosures. Each attorney admitted to practice under this rule shall report to WSBA, within thirty (30) days:

(A) Any change in bar membership status in any juris-diction of the United States or in any foreign jurisdiction where the attorney has been admitted to the practice of law; or

(B) The imposition of any permanent or temporary pro-fessional disciplinary sanction by any federal or state court or agency.

(10) An attorney's authority to practice under this rule shall be suspended when the attorney is suspended or dis-barred in any jurisdiction of the United States, or by any fed-eral court or agency, or by any foreign nation before which the attorney has been admitted to practice.

(11) Record. WSBA shall maintain a record of all attor-neys admitted under this rule.

The Supreme Court received a request from Mr. Stephen Dowdney to amend CrR 4.1 in order to eliminate a perceived delay that results from filing felony charges in district court and the subsequent refiling of the same charge in superior court. The Supreme Court Rules Committee referred the pro-posal to interested groups including the Washington State

Bar Association Council on Public Defense (CPD) to review and provide feedback.

As a result of that review, the CPD suggested an amend-ment to CrR 3.3 as a simpler way to address the issue of delay when felony charges are filed in district court and reflied in superior court.

CrR 3.3TIME FOR TRIAL

ment date shall be the date of arraignment as determined under CrR 4.1.

Subject: Draft 1915(b) Behavioral Health Waiver Amendment.

On October 1, 2018, the health care authority (HCA) submitted an amendment to the Centers for Medicare and Medicaid Services (CMS) for the current 1915(b) behavioral health waiver. That amendment included a request to move five regions into the integrated managed care (IMC) program on January 1, 2019. However, HCA recently learned that the North Sound Regional Service Area (RSA), which encom-passes the counties of Island, San Juan, Skagit, Snohomish, and Whatcom, will not be ready for transition by this date. As a result, integration in this region will be delayed until at least April 1, 2019. As a result, HCA will submit a revised amend-ment to the current waiver that keeps the North Sound RSA in the behavioral health organization (BHO) program.

HCA will submit an updated waiver amendment to CMS to move the North Sound RSA out of the BHO program and into the IMC program once a final decision on an implemen-tation date has been made. Until the North Sound RSA moves from the BHO program to the IMC program, the North Sound BHO and the current apple health managed care organiza-tions will continue to operate as they do today.
