The Agency i n exercise o f the powers coiiferi-ed on i t by the Waste Water Discharge (Authorisation) Regulations 2007, as aiiiended, for the reasons Irereinafter set out, hereby granls this waste water discharge liceiice to Irish Water, as by virtuC of Section l7(4) o f the Water Services (No. 2) Act 2013 the relevant application i s deemed to have been inade by Irish Water, in respect of the agglomeration as specified in Parr I Schedule of Discharges Lice17.sed o f the attached licence subject to Conditions, as set out i n the schedules attached liereto.

INTRODUCTION

This introduction i s not part ol'tlie licence and does not purport to be a legal interpretation of the licence.

The liceiice sets out in detail the conditions iiiider which lrisli Water w i l l control and manage tlie waste water discharges from tlie agglomeration covered by this licence.

The WWTI' was designed to cater for a poptilation equivalent (p.e.) o f 2,800. Tlie application documentation indicates that the p.e. being served by tlie WWTP is 4,380. l l i e influent to tlie wastewater treatment plant is primarily domestic wastewater. The sewage system in Mooncoin is a combined system.

Tlie W W I W provides tertiary treatment. The plant consists o f the fo l lowing unit processes: iiilet works, screenings, weir to storm tank, forward l e d tank, 2 No. SBR tanks, sludge holding tank and phosphorus removal.

l h e legislation governing this licence relates specifically to, and i s restricted to, the regulation and control o f waste water discharges from the agglomeration. Therefore any odour or noise isstie tliat may be associated with tlie waste water works including tlie treatment plant cannot be addressed by this licence.

DECISION & REASONS FOR THE DECISION

Tlie Environmental Protection Agency is satislied, on the basis o f tlie information available, that subject to compliance wi th tlie conditions of this licence, any discharges from the agglomeration sei-ved by tlie waste water works wil l comply with and wi l l not contravene any o f tlie requirements o f Regtilation 6 o f the Waste Water Discharge (Authorisation) Regulations 2007, as amended.

In reaching this decision tlie Environmental Protection Agency has had regard to tlie requirements and objectives o f Regtilation 6 o f the Regiilations and l ias considered the application and supporting documeiitatioii received from the applicant, a submission received from another party and the report o f its inspector.

A screening for Appropriate Assessment was undertaken l o assess, iii view o f best scientific knowledge and [lie coiiservatioii objectives o f tlie site, if tlie activity, individually or in combination wi t l i otlier plans or projects i s likely to liave a significant effect on a European Site(s). 111 tliis coiitext, particular attention was paid to tlie European site a t l a w e r River Suir SAC and tlie Agency considered, for the reiisoiis set out below, that tlie activity is not directly connected with or necessary to (lie inanagemelit ol' tlie site as a European Site and that it cannot be excluded, 011 tlie basis o f objective scientitic inl"ormation following screening under this Regulation, tliat tlie activity, individually or in combination with otlier plans or projects, w i l l have a significant effect 011 a Europeaii site and accordingly determined that an Appropriate Assessment of the activity is required, and for this reason determined to require the applicant to subniit a Natura Inipact Statement. A biological sampling assessiiieiit was undertaken by a Consultant Ecologist in Apr i l 2009 (on behalf of the applicant) at two sites in tlie Middle Suir Estuary, tipstream and downstream o f tlie Mooncoin WW1'1' primary discliarge location. Tlie similarity o f tlie macroinvertebrate

Also, monitoring results show that the receiving water is in conipliatice both upstream aiid downsti-earn of the primat-y discharge with the physico-chemical standards set for good status in the European Coniinunities Environmental Objectives (Surface Water) Regulations 2009, as amended and therefore the receiving water i s currently i iot showing significant evidence of an impact 1.1-om the Mooncoin agglomeration.

Furthermore. Schedule A: Discliarges & Discharge Monitoring, of the licence specifies the ELVs to which the discharge l'rom tlie Mooncoin agglomeration i i i i t s t conform. These ELVs w i l l ensure conipliance with the Eut-opean Communities 13nviroiimental Objectives (Surface Water) Kegulations 2009, as amended aiid are aimed at providing a high degree of protection to tlie receiving water body. Monitoring o f tlie discharges i s required to take place as per this schedule o f the licence.

I This liceiice is for t l ie purposes 01‘ Waste Water Discharge licensing under tlie Waste Water Discharge (Authorisation) Regulations 2007, as amended, only and nothing in h i s licence shall he construed as negating the licensee’s statutory obligations or requirenients under any other enactments or regdations.

The agglomeration is the area outlined in red on Drawing No. KK-WWDL-2OX-B.I.1 o f the application. Any reference in this licence to agglomeration shall mean the area t l im outlined iii red.

The discharge(s) to waters from tlie waste water works shall be restricted to those listed and described in Schedule A: Di.schurge.s und Di.scharge Mr,ni/oring, of this licence and shall be as set out iii the licence application or as modified under Condition I .6 o f this licence and suh.ject to the conditions of t l i is licence.
