Suicide Clause We won’t cover a client’s claim if their death is in any way linked to a deliberate attempt to end their own life (suicide) in the first two years of their policy’s start date or reinstatement.

Your death or the death of any of your dependants is self-inflicted or is due to suicide or assisted suicide and occurs within two years of cover commencing or reinstatement of your policy

Your death or the death of any of your dependants is due to suicide and occurs within 2 years of cover commencing or reinstatement of your policy When restarting the benefit; a new 2-year period will apply. If the insured life increases the benefit amount, a new 2-year period will apply to the increased portion from the date of the increase.

Sanlam Life will not admit a claim if death is caused by suicide, also during insanity, committed within 24 months after cover for the benefit has started, or after the policy has been re-instated after an earlier lapse. If the cover amount is increased, other than through benefit growth, this period will apply to the increase in the cover amount from the date of alteration. The person or entity who claims the benefit must prove that the life insured did not commit suicide.

Suicide Clause on Replacement If a client’s BrightRock policy will replace an existing life insurance policy with a two-year suicide exclusion, we’ll take this into account. We’ll give the client the benefit of the period for which they’ve already had cover.

Reinstatement period Clients’ full cover reinstates immediately

The clients’ full severe illness benefits will only reinstate after 14 days.

After the 14-day survival period following a claim event, the benefit amount for events that are totally unrelated, in the opinion of Hollard Life, to the condition or event for which the claim had been paid will automatically reinstate to the benefit amount immediately prior to the claim payment. The benefit amount for condition or event claimed for will not reinstate except for the Comprehensive Critical Illness where, after 100% of the benefit amount has been paid in respect of a condition or event, the benefit amount for events that are related to that event will automatically reinstate 90 days after the claim event on the following basis: » Claim prior to 75th birthday: 25% of the original benefit amount plus any benefit increases » Claims on or after 75th birthday: 15% of the original benefit amount plus any benefit increases

Once you have had a claim admitted, you may only qualify for another claim in the following circumstances:

your condition worsens, or you suffer a related claim and now qualify for a higher percentage pay-out level. The benefit that you will receive will take into account the proportion of the benefit already paid. A maximum of 100% of your sum assured will be paid for related conditions.

You suffer a new condition which is totally unrelated to the previous claims which have already been admitted.

We calculate the claim amount as the percentage pay-out multiplied by the benefitamount. We will not reduce the benefit amount by the claim amount. We will pay a subsequent claim in the same category only if the claim event is more severe than previous claims in the same category.

If we have admitted a claim, we will not reduce the cover amount of this benefit for the life insured by the claim amount. However, we will not allow claims involving any one organ, system or body part, or related group of organs, systems or body parts, to exceed 100% of the cover amount, except if the causes for the claims are totally unrelated according to the opinion of our Chief Medical Officer.

Extended Leave Periods A client’s cover will stay in place while they are on special leave, for a maximum period of 12 months. Special leave is when a client is away from work for an extended period of time and not earning a salary. This could include unemployment, extended study or maternity leave, a sabbatical or a period when the client is between placements within the same institution, for example if they are in government service.

Discovery Life will allow a maximum sabbatical term of six months every three years.

If you are not performing your nominated occupation for three consecutive months before your claim. Note that this requirement does not apply to clients who are on Sabbatical, or those who returned to work following a period of retrenchment, at the time of claim.

The Occupational Disability Benefit is only payable provided that the life insures has been gainfully employed for a period of not less than six months before the onset of the disability.

FURTHER COMMENTS

In addition to these general exclusions and specific exclusions set out under the Life Assured details there are also specific exclusions relating to each benefit selected as well as specific amounts payable depending on the severity levels of illness. disability or impairment or the type of illness. Please read through the material information relating to smoker status, occupation, education. income. health and medical history provided including the declarations made on application which was taken into account on agreement of the policy terms and conditions.

(Note A) Reference against violation of criminal law.The reference to the consumption of alcohol, narcotics and/or other substances and any illegal participation in riot, insurrection may not be stated as a listed general exclusion by all insurers. However, the alternative exclusion clause for the violation of any criminal law may still be enforced where such acts in are said to be against public policy and not permitted by Law. However, the subject matter of these clauses are still fundamentally different in obligation. Consumption (or the excessive consumption) of alcohol or other substances may not necessarily be illegal or used for an illegal purpose but the contract is enforced by a warranty condition that the act (consumption) be specifically excluded with no obligations payable thereunder for breach. (Note B) Reference against hazardous pursuit and/or risky activities In some cases, hazardous pursuits are completely excluded, while in other cases only regular participation would result in an exclusion. The latest trend towards notification needed only at the start of policy not thereafter is commendable. In most cases there is a definitive list, but with the proviso that this is not exhaustive list. However, a definitive list does provide the advisor with a record of pursuits that are deemed hazardous by the insurer. In the instances where no list is provided, or the insurer determines at their discretion what they deem to be a “hazardous pursuit”, then the decision is purely subjective. Regardless the advisors need to ensure that they remain constantly updated. (Note C) Optimal treatment and/or Maximum medical improvement Adherence to recognised medical protocols may not be stated as a listed general exclusion by all insurers. However, the term “optimal treatment” to obtain maximum medical improvement appears in many instances in the form of a promissory warranty in the policy wording (i.e. a statement about future facts or about facts that will continue to be true throughout the term of the policy) The insureds refusal and/or non-adherence of the conventional medical protocols in favour of unrecog-nised complementary and/or alternative treatment (considered experimental) would be considered a breach of such a warranty despite the fact that such treatments may be growing in public popularity. Examples of optimal treatment exclusions or clauses that need to be considered prior to embarking on any alternative medical treatment:

Caveat ReviewParticular attention must be paid to the insurers precise clauses under the applicable stated benefit (i.e. it’s not sufficient to differentiate just between injury or illness) Any many instances reference to these clauses are applied as a whole or in part to specific conditions under the disability and critical illness type benefits.

If a client becomes ill or injured, they must get medical treatment as soon as possible to qualify for a claim against their BrightRock policy. They must fully comply with their doctor’s advice and finish their full treatment regime. If they don’t seek and receive optimal treatment and fail to comply with their treatment, the claim will be invalid.

Exceptions:BrightRock does not insist on optimal treatment for a condition to qualify for an additional expense needs claim on the policy.

All changes reflected in Appendix 4 (Discovery Disability Benefits) must be permanent despite treatment according to recognised medical protocols. These new life changing events must have occurred since the date of commencement of the policy.The diagnosis of the disease causing the impairment must be confirmed by an appropriate specialist. A specialist is a medical practitioner registered as such with the Health Professionals Council of South Africa.

No specific reference other than in the actual disability benefit definition:

“Totally and irreversibly (not correctable by treatment or operation”

that has stabilised sufficiently over a period of time to allow optimal tissue repair and is unlikely to change in spite of further medical or surgical treatment.

The insured life must undergo reasonable optimal treatment and we will determine his functional impairment after he has reached (reasonable)maximal medical improvement. At this stage a specialist that we have approved must declare the functional impairment total, permanent and continuous for the foreseeable future

The functional impairment, and permanence thereof, will be evaluated only after the life insured has undergone optimal, reasonable treatment, based on generally accepted medical protocols for treatment of the condition in question at the time of the claim. Treatment undergone, as well as future treatment, will be taken into account

(Note D) Mental and back disorders:Sanlam includes all mental and back disorders. but the client has an option to exclude certain mental conditions and mechanical back pain at a discount of about 30%. This option is suitable for clients who suffer from existing back and mental condi-tions that normally may lead to the disability benefit being declined.

(Note E) Force Majeure Events beyond Insurers controlRegardless of whether a contract contains a force majeure clause, or not where performance under a contract is objectively impossible at the time of claim the insurer can approach the courts to set aside their obligation under the contract either temporarily or permanently. Without a force majeure clause, the principles of ‘supervening impossibility of performance’ apply, which require proof that performance under the contract to be objectively impossible. Insurers that have defined Force majeure clauses stipulated in their contracts are in a better position in court to seek relief under these stipulated provisions of the clause should a force majeure event occur.

Example of the clause used by Liberty:Should Liberty be prevented from carrying out any of its obligations in terms of this policy because of Force Majeure, Liberty will notify the Policyholder/Beneficiaries of the circumstances and nature of the Force Majeure as well as the estimated duration and extent to which Liberty’s performance is made impossible. Under such circumstances, Liberty’s obligations under the Policy will be suspended until the circumstances causing the Force Majeure ends and Liberty will not be liable to the Policyholder/Beneficiaries for any damages whatsoever caused to the Policyholder/Beneficiaries due to Liberty’s inability to perform its obligations in terms of the Policy. Force Majeure includes, acts of God, acts of the State or Government, excep-tionally adverse natural disasters, riot, insurrection, sanctions, sabotage, terrorism, political or civil disturbance, war, boycotts, embargo, strikes, lock-out, shortages of labour or materials, material delays in public transport or any similar circumstances beyond the reasonable control of Liberty.
