Two Rivers tasted success at the 2018 KPMG Sydney Royal Wine Show presentation dinner held in Sydney last Thursday night. This year marked the 192nd year of the show with a record 2,332 entries from 369 exhibitors from all over Australia. Two Rivers capped off an incredible evening taking home four trophies along with three gold and six bronze medals.

Upper Hunter Community Services and BHP Mount Arthur Coal, who won the Community Excellence Award for ‘Strengthening Community Resilience through Partnership’ at NSW Minerals Council’s Health, Safety and Environment Community Awards. As part of BHP’s commitment to the local community, the Community Capacity Project (CCB) was developed as a four-year $1.14 million partnership between BHP and UHCS. The collaboration has helped several local and regional organisations by connecting them with the appropriate community agency or service, providing them with a meeting space within the UHCS building and assisting them with event planning, networking and grant applications.

New Legislation: Family and Domestic Violence leave now applies in Modern Awards.
From 1 August 2018 all employees covered by Modern Awards will have access to a new form of leave: Leave to deal with Family and Domestic Violence. The new entitlement has arisen from long running proceedings in the 4 Yearly Review in which Australian Business Lawyers & Advisors played the leading role on behalf of employers. The finalisation of the new entitlement follows the Fair Work Commission’s decision in July 2017 to reject the ACTU’s claim for 10 days paid leave. The new entitlement will be to 5 days unpaid leave accessible where an employee: a) is experiencing family and domestic violence; and b) needs to do something to deal with the impact of the family and domestic violence; and c) it is impractical for the employee to do that thing outside their ordinary hours of work. This could include, by way of example, making arrangements for their safety or the safety of a family member (including relocation), attending urgent court hearings, or accessing police services.

Landmark Federal Court decision affecting casual employment in all industries. A recent Federal Court decision in Workpac Pty Ltd v Skene will have wide-ranging implications for the employment of casual employees across Australia. The primary consequences arising from the decision are that:
1. Regardless of the provisions that apply to a workforce under awards or enterprise agreements, if an
employee has a regular and predictable pattern of work with an expectation of ongoing engagements, they
are likely to be permanent as opposed to casual.
2. Where an employee commences employment with irregular hours under a casual contract, the casual
can morph into a permanent employee during the course of the employment relationship, notwithstanding
that the parties continue to describe the relationship as casual. As a result of the decision, a large number of employees currently described by employers as ‘casuals’ could in fact be permanent. The impact of the decision could be substantial for a number of employers. Regular or long term casuals who are indeed permanent will automatically become entitled to: • paid annual and personal leave (accumulating for each year of their service); • notice of termination; and • redundancy entitlements.

Following the success of the inaugural Cultural Spectacular held in Singleton in 2017, MACH Energy are one again proud to sponsor the 2018 Muswellbrook Cultural Spectacular. This FREE event is an initiative of the Aboriginal Community Development Fund (ACDF) and MACH Energy and will be held on Saturday 15th September from 2pm at the Muswellbrook Showground.
