COUNCIL HOUSE SALES
The 1987 Housing (Scotland) Act extends tenants Right to Buy their Council homes. As a result of the Housing (Scotland) Act 2001, substantial changes were made to the Right to Buy. These changes came into force on 30th September, 2002 but the rights of tenants remaining in their existing homes are unaffected. The table shows the number of properties sold by the Council in this period.

Comments and Complaints/Ombudsman System
All official comments or complaints received which relate to Chief Executive Services are investigated and reported (these are noted below as 1st or second stage complaints).
Where it is not possible for a complaint issue to be resolved within the Service to which it refers, the Chief Executive will conduct a separate review of the circumstances with the ail of resolving the issue (identified below as 3rd stage complaints).
If a complainer remains unhappy with the way an issue has been dealt with after the above stages, the matter can be referred to the Scottish Public Services Ombudsman's Office (the SPSO).
The SPSO provides a free, accessible independent and responsive complaints review system across public services in Scotland. When a complaint has been made against Clackmannanshire Council to the Ombudsman, the Council are invited to comment on the matter.

Licensing (Scotland) Act 2005
The next Board meeting will take place on 10 March. Business scheduled is as follows :
1976 Act - 1 regular extension and 2 occasional extension applications
- 2 preliminary hearings to decide whether to hold hearings to consider suspension of licence
Board Clerks and administrative staff are working on development of application forms and procedures for variations /transfers of premises licences.
Board Clerks/administrative staff are liaising with Development Quality, Building Standards and Environmental Services colleagues to develop procedures and answer queries concerning section 50 certificates. These are certificates regarding the planning, building standards and food hygiene status of premises for which an application for a new premises licence is made.
Clerks and administrative staff are to make a presentation on the main features of the 2005 Act for the benefit of Development Quality, Building Standards and Environmental Services colleagues. Date TBC.
The Licensing Standards Officer has continued to be very busy throughout the period covered by this report meeting with club representatives to assist them with completion of their premises licence applications. All clubs managed to lodge an application by the closing date of 16 January.
The position following the last date for lodging applications for a premises licence by existing premises (16.1.09) is as follows :
Existing licences - 139
Number not applying - 29 (21.3%) (Scottish average - 20%)
Reasons for not applying - Financial burden; excluded premises (petrol station); change of use from licensed premises; premises no longer selling alcohol; licence not required in terms of new Act; forgot to lodge in time (at least 2 of these have now applied for a new premises licence).

Civic Events
Administration and Legal Services are responsible for organising civic receptions and hospitality provided by Provost Derek Stewart. The Council is aware of many special occasions that will be officially commemorated and celebrated, but from time to time local groups, organisations and others contact the Council to suggest an occasion that might be worthy of being honoured through a celebration.
