Think Simply

BOOM itPeople have misunderstood the term goals of this administration. They are all up in arms over increased programs and spending.

Think simply! You come home and you have a big mess in your front room. A huge pile. You must sort and expand this pile to get control of it. With the end result being a cleaner home and steamlined duties for the future. That is ALL the man is doing. Sorting through the pile of crap handed him, putting groups in charge of overseeing that the pile is addressed with the end result being a leaner, more efficient government in the next 4 years.

BOOM itWhat do you think of this text someone sent to me:It was once said that a black man would be president "When pigs fly." Indeed, 100 days into Obama's presidentcy "swine flu."

I admit initially I was a bit shocked & offended by it. Upon further reflection, it is very clever to me. I say this because at it's root, it reflects the affirmation of possibilies.

BOOM itFollowing up on a conversation in another topic, speculation here in Minnesota is rife over when the Mn Supreme Court finally rules. Here is a pretty good guess, courtesy of MinnPost.com:

Coleman-Franken appeal: Make your best guess, as Minnesota Supreme Court expert predicts Decision Day

Las Vegas bookmakers haven't posted it yet, but Peter Knapp has set the "over-under" line for when the Minnesota Supreme Court will issue its decision on the Norm Coleman-Al Franken case.

It is June 18. By 6 p.m.

Take it to the bank. (Maybe.)

With Coleman's lawyers set to file their appeal brief today with the state Supreme Court, Knapp weighed in. He is the William Mitchell College of Law professor who is the world's most diligent observer of the state Supreme Court and its inner workings.

Knapp charts decisions. He notes decision turnarounds. He analyzes dissents. The guy might even know how often they send their robes to the dry cleaner.

"In typical civil and criminal cases, the court usually issues its opinions within three to five months," he said, "but there are cases in which the opinions come down eight or nine months after argument. Dissents usually occasion delay."

Would the Coleman appeal produce a unanimous decision from the five judges sitting on it?

What's your guess? Mine is unlikely.

The "over-under" is the number below or above a predicted score or benchmark. Thus, if gambling were legal in Minnesota, the under bettor would take June 17 and the over bettor June 19.

Why June 18?A few things: recent election-linked cases have moved relatively swiftly through the state's highest court; June 18 is a Thursday, and the Supreme Court's decisions are, generally, announced on Thursdays.

Peter KnappAnother thing: Knapp is guessing, in an educated way, of course.

"Election cases are an exception," he said. "The court usually issues its opinion within weeks of the oral argument."

In one election case that had to do with the wording of an initiative on a ballot, the Supreme Court actually issued an order in one day.

It said, more or less, "We know which way we're headed, let's not wait any longer," Knapp said. Then, a few weeks later a full opinion came down the pike.

Knapp said the Supremes are unlikely to act that swiftly on Coleman's appeal because, really, there's no election on the horizon.

"There isn't any hard and fast deadline," Knapp said.

Still, the Supreme Court's actions in the recount cases have been, relatively speaking, swift.

Take Franken's action earlier this year when he asked for his election certificate even before the end of the election contest trial.

Franken's lawyers filed their motion on Jan. 13. The court acted quickly and set a hearing for Feb. 5. A ruling came down a month later. That is breakneck speed … in Supreme Court time.

Earlier still, during the recount, on the matter of how to count rejected absentee ballots, Coleman's side sought a temporary injunction from the Supreme Court. Coleman filed papers on Dec. 15, the court rapidly heard arguments on Dec. 17 and had an order by Dec. 18.

Wham. Bam.

Don't expect that here, Knapp said. Not at all.

Remember, this isn't the only case on the Supreme Court's calendar. For May, the justices already have 13 cases listed for oral argument.

And, as Knapp noted, unlike many recount geeks out there, they haven't been glued to their computer screens watching the video stream of the election contest trial.

I'm told the transcript of the trial is sure to exceed 6,000 pages. In theory, the justices – or their clerks – will read all of those pages to guide them through the facts of the case.

And then there is the gravity of this case, or any state Supreme Court case. Judges aren't writing for today, Knapp said. "They're writing a decision for every single lawyer and every single judge. They think of themselves as writing for the future. That means every single word has got to be edited, revised and conform to what their decision states the law to be."

That explains why, in most cases, without such a spotlight, it takes the three to five months.

Knapp isn't privy to the entire process of how the justices write-by-committee, but in his research and in his reading of how the U.S. Supreme Court operates, he can conjecture.

He suspects the writing process on this Coleman appeal won't begin until after the oral arguments in this case, which won't be heard until June 1.

Then, the judges will conference and check out where each of them stands. (Remember, Chief Justice Eric Magnuson and Associate Justice G. Barry Anderson have recused themselves because of their earlier State Canvassing Board service.)

Presumably, Associate Justice Alan Page, the most senior of the five, will assign someone in the majority to write an opinion. That opinion, which will take a while to write, will get circulated among the five.

Others will fiddle, tweak and add. And if there's a dissent, that document will begin to circulate. The majority will respond to that written dissent. The dissent will further mold the majority's view.

Knapp was stunned when he heard partisans and others complaining that the Supreme Court set June 1 for the hearing date … a full six weeks after Coleman filed his motion for appeal.

"People said, 'It doesn't look like they're handling this quickly,' " Knapp said. "I said, 'Yeah, they are!' "

Those wheels of justice and, what Norm Coleman calls the task of "getting it right," take a while to turn.

Knapp does allow that Arlen Specter's recent decision to jump political parties could affect his over-under analysis, what with Franken potentially becoming the 60th Democratic senator.

The pressure building on the judges – already sizable – has grown because of the stakes.

"If I were betting, I might take the over," Knapp said of his own over-under.

Still, circle Thursday, June 18. Or call your legal bookie. The good professor knows his stuff.

"Paul and his family were killed in a plane crash." I felt my own tears well up.

It is rare for a politician to be so loved by their constituency. But Paul and Sheila Wellstone elicited that kind of love. See he truly did fight for the very least of us, and put himself fully into that work. Years later, you can drive around and still see the Wellstone signs in people's yards and in their windows, and the stickers on the cars. A popular bumper sticker around town now says, "What would Wellstone Do?" Al Franken is a good enough guy and I supported him. But Paul Wellstone was one of a kind. I miss him terribly.

I too remember that day, just like the day JFK was taken from us. I was cooking that afternoon when I got a call to turn the TV on! I got the chills (as I am right now AGAIN). Paul may have been a presidential candidate or VP, by now, if it had not been for that tragic moment.

I BELIEVE Al Franken will do the State on MN VERY proud.

ATLANTA, April 28 (UPI) -- There have been no U.S swine flu fatalities so far, but since January more than 13,000 people have died of complications from seasonal flu, officials said.

The Centers for Disease Control and Prevention's weekly report said no fewer than 800 flu-related deaths were reported in any week between Jan. 1-April 18, the most recent week for which figures were available, CNN reported Tuesday. Seasonal flu is expected to keep killing hundreds of people every week for the rest of the year.

BOOM itArlen Spector has jumped ship and is now a Republican. That will permit him to move back to more moderate votes. When Al Franken takes his seat in June there will be a 60 vote majority. This is a very good day for Democrats.

Too many political factors locally are going to force that. 78% of Minnesotans want Coleman to withdraw now, and after the Minnesota Supreme Court rules assuming they don't send it back to a lower court, the future political hopes of both Governor Pawlenty and Norm Coleman will be in jeopardy.

And no, he won't vote with the Democrats all the time. Neither will some of our other blue dogs. But I have noted he has been very unhappy for several years with the box the Repubs have put him in. He also will be beholding to his Dem benefactors when campaign time rolls around. I think he will be akin to a Lieberman Democrat and I can live with that. Obama himself is very moderate and that makes it easier to support the Dem agenda. Okay, not the employee fairness act, but most everything else.

Frankly I have some issues with Specter that go all the way back to the seventies when he intervened on behalf of Ira Einhorn, the guy who killed a friend of mine and stuffed her body in a trunk where they found her mummified. As a result of that intervention Einhorn skipped the country and was only brought back to serve his time a few years ago. That and his role in the Clarence

posted by Dinahlynne1 9 days ago I get daily updates on the Franken-Coleman contest and my prediction remains. I think he will be seated in mid or late June depending on the speed of the Minnesota Supreme Court. Coleman is going to do an end around with the Federal Courts but I don't think they will be interested. I also believe the Mn Supreme Court will order the governor to issue the certificate. Gov. Pawlenty has already said if the court orders him to sign it he will do so. The special tribunal who's ruling Coleman is appealing inserted such a stipulation and I think the Supremes will include it also.

You know, it has taken a long time, but the methodology and transparency makes it very difficult for Coleman to win any appeal. The recount was managed initially our DFL Secretary of State and two members of the Minnesota Supreme Court, both Republicans. The tribunal which upheld their findings and even added to Franken's lead had one DFL, one Independence, and one Republican judge hearing arguments. There was also a Minnesota Supreme Court ruling earlier that affirmed the procedures of the first two courts. Furthermore the entire process was televised locally on Uptake and you can't be more transparent than that. In both of the lower court decisions, the judges voted unanimously for Franken. The two Republican judges involved in the initial recount have recused themselves for this hearing.

All of that means a really huge likelihood of Franken being upheld. Stay tuned.

I think from a business standpoint the NETWORK had a very tough call to make, especially in light of the fact that they carry some of the top rated shows (like American Idol to name one)on TV. Their advertisers pay a hefty sum to get their ads on Fox shows, and I can imagine losing that revenue, even for one night, is a huge financial blow to their bottom line. The big three (CBS,ABC,and NBC)plus local PBS and other stations are carrying the news conference so there is ample opportunity to see it on another channel. I think we need to not read so much into this decision, lest we sound like those that do watch FOX NEWS? In my opinion it was a business decision by the network, pure and simple, not a direct attack on the President or anyone else. My humble opinion.

I believe it only further demonstrates Pres. Obama does not have the support of a significant number of Americans...I agree it may be a business decision, it always is though..... The bottom line has (at this time) outweighed a civic responsibility previously honored....

posted by Media52 9 days ago It might be interesting to note that the Fox Network affiliate in my neck of the woods has the most politically liberal/moderate news team of any of the major networks local affiliates. The most conservative is the ABC affiliate, followed by NBC, then CBS. Our Fox station is the one I usually watch for local news because they really ARE "fair and balanced," even leaning ever-so-slightly toward the left side.

Remember, Fox NEWS (the cable group that includes the village idiots we all love to hate) is a different "company" than the Fox network. Yeah, I know, they're all Fox, all owned by Rupert Murdoch -- but then so is Twentieth Century Fox (the movie company -- Star Wars, Titanic, Ice Age, X-Men Origins: Wolverine, Mrs. Doubtfire, Tom Hanks movies, etc.). Each company has its own president and they're all quite different in focus/etc.

I don't have a problem watching Fox Network shows and local news (Q13 Fox up here); I refuse to go anywhere NEAR Fox News (yeccch! I always feel like I need to hold my nose when I channel surf by it, and need de-lousing if I inadvertantly land on it longer than a second or so ... )

The Geneva convention doesn't apply because it pertains only to POWs. These were not POWs but terrorists. So, we should forget Bush's declaration of War on Terror.

But no one would have guessed pirates and pandemics being added to the mix! The way he handles unexpected problems as they arise just proves him even more intelligent and capable. He could not handle all of these crises without the right people behind him that also have our country's best interest at heart. I believe that staying on top of a problem is key rather than letting it get out of control, then trying to clean it up. It is good to hear the news all day about the "swine flu". It really keeps us informed on where cases are and what we should be doing to keep ourselves safe. I really feel much safer with Mr. Obama in the White House. I have warmed up to Joe Biden too. For some reason, I did not really like him before, don't know why, just a feeling, but I also saw the piece about him and like what he stands for, plus there is probably nobody that knows Washington better than him.

I too did not trust Biden from his past experiences in the public eye and was initially disappointed when he was chosen as a running mate. However, I do trust Obama's decisions. He is privy to information we are not and he completely understands the consequences of making decisions, weighs them carefully, and then does what is in the best interest for the common good. How novel! A president with intelligence and morals. That hasn't happened in a very long time.
