Pre-Commercial Procurement actions aim to encourage public procurement ofresearch, development and validation of new solutions that can bring significantquality and efficiency improvements in areas of public interest, whilst openingmarket opportunities for industry and researchers active in Europe. It provides EUfunding for a group of procurers (‘buyers group’) to undertake together one jointPCP procurement, so that there is one joint call for tender, one joint evaluation ofoffers and a lead procurer awarding the R&D service contracts in the name and onbehalf of the buyers group.

The solution sought lies beyond the state-of-the-art and there is no available solutionon the market yet. R&D is needed to de-risk technology, still competing solutionapproaches to compare and still too risky to commit to go for large scale deployment.The Public Sector procures R&D to get new solutions developed and tested throughPre-Commercial Procurement (PCP)

Why European cooperation on PCP-PPI?

• Every year, over 250,000 public authorities in the EU spend around 14%of GDP (c. €2 trillion) on the purchase of services, works and supplies

• Public authorities are the main purchasing bodies in many domains:energy, transport, waste management, health and education

• The public procurement has the potential to boost our economies:more jobs, growth and overall to create an economy that is moreinnovative, resource and energy-efficient, and socially-inclusive

• A modern, well-managed and efficient procurement is fundamental toprovide high quality public services

• Improving public procurement can yield big savings: a 1% efficiencygain would correspond to €20 billion per year in savings

• Suppliers: interested in public sector as “first customer” for innovative EGNSS products

• Growing impact/ importance of innovation procurement in Horizon 2020

• Increased use of innovation procurement instruments in ICT, security,transport, health etc.

• 2019: PCP/PPI calls in a value of 83 €m

Sole participants can be also eligible if the minimum conditions are met by the legal entities forming the soleparticipant (e.g. central purchasing bodies, European Research Infrastructure Consortia, European Groupings ofTerritorial Cooperation)

Public procurers are contracting authorities or contracting entities as defined bythe EU public procurement directives

Reimbursement rate direct costs: Max 90% of eligible costs for PCP actions

Eligible direct costs to carry out eligible activities defined in WP include:

- Price of the R&D services (PCP) procured (if procurement conducted in compliance with requirements in Annex E WP)

- Eligible coordination and networking activities

- May include in-kind contributions (e.g. third parties putting resources at disposal of beneficiaries e.g. for testing of solutions)

- VAT is an eligible cost unless for beneficiaries that can deduct it

Requested reimbursement for coordination and networking activities can comprise max 30% (for PCP) of total requested grant

Plus 25% for indirect costs. But, no indirect costs on the price of the PCP procurement or on 3rd

party resources not used at the beneficiary premises

Pre-financing: Yes, 1st pre-financing at start project for costs for preparation

stage, 2nd pre-financing before execution stage for rest of costs (incl. call for tender)

In their proposal, consortium shall have already identified one concrete procurement need as proposed focus for the PCP that is identified as acommon challenge in the innovation plans of the buyers group and requires R&D!

One lead procurer awarding all contracts in the name and on behalf of all procurers in buyers group

Each winning tenderer gets: 1 framework agreement to participate in thePCP+ one specific contract per PCP phase (solution design, prototyping, testing)

One joint total budget (grouping financial commitments of all procurers in buyers group) from which all R&D providers are paid

But, actual payments can be carried out centralised ordistributed

Either all R&D providers paid by the lead procurer

Or each R&D provider paid pro rata by each procurer in the buyers group according to the share of each procurer's contribution to the commonpot

Also supervising suppliers and testing of solutions can be centralised or distributed
