A division bench of Jus- tice B P Dharmadhikari and Justice A P Bhangale ruled that a government employee not staying in the quarters de- spite its availability can be disentitled from claiming the special allowance. The bench was hearing a petition filed by the defence ministry against its employees working in the ordinance factory in Nagpur, who were staying in their own accommodation. Nagpur has surplus government accom- modation and is one of the few cities where a central govern- ment employee, who lives in his own house has to submit a “non-availability certificate” before he can ask for HRA. The government claimed that its employees, who are offered accommodation but refuse to occupy the same, would not be entitled to HRA. “HRA is not a matter of right, it is a compensatory al- lowance given by an employer towards the rental accommo- dation expenses when the gov- ernment is unable to provide suitable accommodation to its employee,” said the judges. “The employee, if he resides in his own property, may not be entitled to claim the HRA, because it is paid to central government employees to compensate them partly for the especially higher rents which they have to pay for hired or rented residential ac- commodation in big cities, but not as a source of profit,” they added. The court quashed an or- der of the central administra- tive tribunal asking the gov- ernment to pay HRA to employees who had were re- siding in their own houses. “Prima facie in our opinion, the pre-requisite for a non- availability certificate (NAC) as laid down in the office memorandum as operative in Nagpur, when central govern- ment accommodation is avail- able in surplus and the gov- ernment is required to spend huge amounts towards con- struction and maintenance (of the quarters), it is neither arbitrary nor malafide,” said the judges. According to the po- lice, the accused, who is hooked on to playing vir- tual games in cyber cafes, was recently re- fused money for the games by his mother. Ra- ju’s father expired a few years ago and his mother runs the family. Desperate for his usu- al dose of games, the boy was ready to do any- thing. That’s when he came in contact with a chain-snatcher who used to frequent the cyber cafe. The latter taught him how to snatch chains from targets, usually women. On September 1, Raju targeted a woman, Gala Shah, and snatched her chain worth Rs 56,000. However, a passer- by, who witnessed the in- cident, gave cops the de- scription of the chain- snatcher, adding that the boy was a regular near Thakurwadi chowk. On Monday night, the police laid a trap around Thakurwadi chowk and nabbed Raju. The boy has been sent to the Bhi- wandi remand home. According to section 33(10) of the existing DCR, a slum dweller is eligible for a rehabil- itation tenement with a carpet area of 269 sq ft. Unless this rule is amended, the rehabilitation plan for sector 5 cannot be final- ized, an official said. Mumbai:The state has asked the Union fi-nance ministry to investigate the allega-tions of Mahendrapal Singh Gujral whoclaimed that he was forced to trim his beardby Directorate of Revenue Intelligence(DRI) officials during interrogation.

The state has also ordered additionalchief secretary of the state minorities de-partment Thanksy Thekkekara to probethe case and submit the report within amonth. The decision was taken by state mi-norities minister Arif Naseem Khan onTuesday. Congress MLC Charan Singh Sa-pra, along with a delegation of Sikh lead-ers, met Khan in Mantralaya and expresseddispleasure over Gujral being forced totrim his beard. After the meeting, Khansaid, “Gujral claims that he was tortured bythe DRI officials and was asked to trim hisbeard. If it is true then the charges are seri-ous. As the DRI is a central governmentagency, I have written to Pranab asking theUnion minister to take appropriate action.”

“I have paid tax. But despite that I waspicked by DRI officials on June 1,” Gujralsaid. “My uncle deals in imported cars. TheDRI officials wanted my signature on astatement which implicated him. I declinedsigning the documents, following whichthey asked me to trim my beard,” he added.
