A HOME BUSINESS

This weekly circular item is provided to inform Councillors of DA16/1006 lodged with Council on 18 October 2016. Site Description The subject site Lot 3 DP 244410, 63 Old Kangaloon Road Robertson, is 10.89 hectares in area is located on the western side of Old Kangaloon Road, to the west of Robertson Village (Attachment 1). Proposed Development DA16/1006 sought development consent for proposed extraction of water to be transferred by tanker for bottling off site, as a “home business” at Lot 3 DP244410 , 63 Old Kangaloon Road Robertson. Permissibility The site is zoned E3 Environmental Management under Wingecarribee Local Environmental Plan 2010. The proposed use is not considered to be a home business, and is therefore prohibited. Determination The DA was assessed in accordance with section 79C of the Environmental Planning and Assessment Act 1979. The proposed extraction of water for bottling off site use is not considered to be a home business as defined under Wingecarribee Local Environmental Plan 2010 and is therefore not permissible. The uses permitted with consent within the E3 Environmental Management zone are restricted to:

Agricultural produce industries; Airstrips; Aquaculture; Bed and breakfast accommodation; Cellar door premises; Community facilities; Dairies (pasture-based); Dual occupancies (attached); Dwelling houses; Eco-tourist facilities; Environmental facilities; Farm buildings; Farm stay accommodation; Flood mitigation works; Health consulting rooms; Helipads; Home businesses; Horticulture; Information and education facilities; Places of public worship; Recreation areas; Recreation facilities (outdoor); Roads; Roadside stalls; Secondary dwellings; Signage; Viticulture; Water storage facilities.

The proposed development for water extraction for offsite bottling does not comply with the definition of any of these permitted uses. The proposed extraction of water for bottling off site is a commercial use which is not permissible within the E3 zone, and is therefore contrary to the existing DPI/Office of Water

approval 10WA118789 which states that “Water taken under a domestic and stock right cannot be used for irrigating fodder crops for stock, washing down in a dairy or machinery shed, intensive livestock operations (such as feedlots, piggeries or battery chickens), aquaculture or for commercial purposes (including caravan parks or large-scale bed and breakfast accommodation) other than for the personal use of the proprietors”. Therefore, the DA was refused on 18 November 2016, as the proposal comprised a prohibited use within the E3 Environmental Management zone under the LEP. This weekly circular item is provided to inform Councillors of DA16/1015 lodged with Council on 20 October 2016. Site Description The subject site Lot 1 DP 34845, 99 Lackey Road Moss Vale, is 8956.85sqm and is located on the north western corner of the Lackey Road / Lytton Road intersection (Attachment 1). The site contains an existing industrial building of approximately 1824sqm which is proposed to be retained and extended. Proposed Development Development Application 16/1015 seeks development consent to extend the existing industrial building by 1325.67 square metres to the ground floor and 157.92 square metres to the first floor area (Attachment 2). The existing building is used for the production of aluminium goods and powder coated aluminium items. Permissibility The site is zoned IN1 General Industrial under Wingecarribee Local Environmental Plan 2010. The proposed extension is permissible within zone. Determination Process The proposed extension to the existing industrial building has been neighbour notified to surrounding properties. No submissions have been received. The application has been referred to Water NSW, in accordance with State Environmental Planning Policy (Sydney Drinking Water Catchment) 2011. No comments have yet been received from Water NSW. The Development Application will be assessed in accordance with S.79C of the Environmental Planning & Assessment Act 1979, to determine whether the proposed extension warrants approval or refusal. The application shall be determined under delegated authority, unless it is requested by a Councillor that the application be determined by full Council. 101 LOT SUBDIVISION

The purpose of this Weekly Circular is to inform Councillors of a development application which seeks consent to undertake the fifth stage of Darraby, a residential subdivision at Broughton Street, Moss Vale. Site Description The site is known as Lots 122, 123 and 118 DP1218966, located off Broughton Street, Vale View Avenue and Darraby Drive, Moss Vale (Attachment 1). The original property was an urban release site which was rezoned under the Wingecarribee Local Environmental Plan 2010. A master plan for the site has been prepared by the developer in consultation with council officers. Currently the site is partially developed with 5 subdivision approvals already having been issued for a total of 210 residential lots. 117 of these lots have been registered and dwellings are either constructed or under construction on the majority of these lots. Residential development of similar lots exists to the north along Broughton Street and to the East in Baker Street. The site is bounded by the Mt Broughton Golf and Country Club and the Great Southern Railway to the South and the adjoining lot to the west is mostly cleared agricultural land with one dwelling. Proposed Development On 2 November 2016, DA16/1068 was lodged with Council seeking consent to subdivide the land into 99 new residential lots, a drainage reserve, provision of a sewer pump station, a public reserve and associated road construction and infrastructure The proposed Stage 5 subdivision of Darraby can be found at Attachment 2. Permissibility The site is zoned R2 Low Density Residential under the Wingecarribee Local Environmental Plan 2010. Clause 2.6 of the LEP permits subdivision but only with development consent. The minimum lot size identified for this locality of Moss Vale is 500sqm. As all parcels of land are greater than this, the development complies with clause 4.1 of the LEP

An assessment against the applicable controls in the Moss Vale DCP shall be undertaken at the time of assessment.

Determination Process The application has been notified to adjoining and adjacent landowners with the notification period concluding on 5 December 2016. At the time of drafting, one submission from the public had been received, raising concerns with population increases, that it differs from the original proposal and traffic issues at the North Street / Argyle Street intersection. The application has been internally referred to Council’s Development Engineer, and Contributions Planner. No comments have been received to date. The application has been externally referred to Water NSW, Office of Environment and Heritage (OEH) and the NSW Rural Fire Service. A response has been received from OEH requesting additional information as follows:

Site Description The subject site being Lot 3 DP10008, 6 Drapers Road Willow Vale, is 20.46 hectares in area is located on the western side of Drapers Rd, to the to the north of Parkes Road (Attachment 1). Proposed Development Development Application 16/1003 seeks consent for a 5 lot subdivision at Lot 3 DP10008, 6 Drapers Road Willow Vale. Proposed lot sizes are 4000sqm to 4360sqm in area (refer Attachment 2). Permissibility The site is zoned R5 Large Lot Residential under Wingecarribee Local Environmental Plan 2010. A minimum 4000sqm lot size applies to the site. The proposed subdivision is permissible within the zone and is compliant with clause 4.1 of the LEP. Determination Process The proposed 5 lot subdivision has been neighbour notified to surrounding properties. No submissions have been received. The application has been referred to Water NSW, who raise no objection to the proposed subdivision, subject to conditions. The application has also been referred to Rural Fire Service, who raise no objection to the proposed subdivision, subject to conditions. Council’s mapping system indicates that the site contains Southern Highlands Shale Woodland Endangered Ecological Community. A Flora and Fauna report has been submitted with the Development Application, which is being considered in the assessment of the proposal in accordance with section 79C of the Environmental Planning and Assessment Act 1979. The application shall be determined under delegated authority, unless it is requested by a Councillor that the application be determined by full Council. A Development Application 16/1078 was lodged with Council on the 7/11/2016 for a development at Lot 3 DP 1212578, No. 3 Railway Parade Wingello for the construction of four bedroom single storey dwelling. The proposed dwelling consists of shipping container style modules with external cladding finish, pad footing construction with colourbond roofing and has a footprint of approximately 201 sq.m. The subject allotment is zoned R2 and dwellings are permissible within the zone. The subject application is on neighbour notification until 30/11/2016. SUBJECT: DEVELOPMENT APPLICATION FOR TOURIST AND VISITOR

ACCOMMODATION, FUNCTION CENTRE, CAFÉ, BAR AND

HELIPAD

The purpose of this Weekly Circular is to inform Councillors of a development application which seeks consent to construct tourist and visitor accommodation, a function centre, café, bar and helipad at 42 Oldbury Road, Sutton Forest, being Southern Highland Wines. Site Description The site is known as Part Lot 1 DP 10658, being 42 Oldbury Road, Sutton Forest (Attachment 1) being approximately 32.23ha in size. The subject property Southern Highland Wines is located on the western periphery of the adjacent town of Moss Vale. The property can be approached via travelling east on the Illawarra Highway from the direction of Sutton Forest after leaving the Hume Highway or alternatively when travelling in a westerly direction along the Illawarra Highway a short distance following departure from Moss Vale. Access to the property is via Oldbury Road which terminates in an oblique T-intersection with the Illawarra Highway at the location. There is no direct vehicular access to the property from the Illawarra Highway and all visitors to the site must enter via the main entrance gate located to Oldbury Road. The location is in proximity to commercial and retail services available within the township of Moss Vale, yet is located within a scenic rural context. The site topography is gently undulating and the existing and. Buildings located within the site are presently clustered and within the vicinity of a small knoll as detailed on the site plan accompanying the development proposal. Proposed Development On 9 November 2016, DA16/1100 was lodged with Council seeking consent to construct a variety of tourist accommodation buildings and associated facilities. These comprise:

a multi-purpose single storey function hall and associated car parking area,

a 1 and 2 storey hotel building containing 51 rooms, breakfast room and reception wrapped about a central courtyard area,

two x 2 storey villa buildings containing 2 bedroom units totalling 16 bedrooms per building (total 32 bedrooms),

two x 2 storey semi-detached villa buildings each containing two x 4 bedroom units (total 16 bedrooms),

one 2 storey villa building containing 6 bedrooms, associated car parking spaces and a plaza,

swimming pool, adjacent cafe and bar building,

purpose built day spa building,

a helipad,

two single storey serviced apartment buildings totalling 5 units (4 x 1 bedroom and 1 x 2 bedroom apartments).

A numerical breakdown of the development is provided below:

179 car parking spaces in addition to those currently provided onsite are calculated as required by the traffic consultant engaged to assess the proposal. The consultant however concludes that the RMS Guide to Traffic Generating Developments allows for a slight reduction where function rooms and a restaurant are combined with accommodation, on the assumption that the restaurant will not always be at seating capacity. Taking this reduction into account, the consultant recommends a reduced figure of 162 spaces to be provided for in addition to the 79 spaces (inclusive of 4 disabled) already provided for onsite. Provision is made for a total of 177 car parking spaces in addition to the existing on-site parking. Perspectives and site plan of the proposal can be found at Attachment 2. As this development application has a capital investment value over $20 million, this application is to be presented to the Joint Regional Planning Panel for determination (Schedule 4A of the Environmental Planning and Assessment Act 1979). The capital investment value has been identified as $23 million. Permissibility The site is zoned SP3 Tourist under the Wingecarribee Local Environmental Plan 2010 and in this zone, tourist and visitor accommodation, a function centre, food and drink premises and a helipad are permissible with development consent. The proposed development is consistent with the objectives of the zone which are:

To provide for a variety of tourist-oriented development and related uses.

To ensure that development is sympathetic with the rural setting and landscape features of the site and minimises impact on the scenic values of nearby development and land use activity.

Assessment Timeline The application shall be advertised to adjoining and adjacent landowners and landowners along Oldbury Road up to Windella Road, with the notification period concluding on 11 January 2017. The notification period has been extended taking into consideration public holidays and newspaper printing schedules. The application has been externally referred to:

Water NSW for concurrence under State Environmental Planning Policy (Sydney Drinking Water Catchment) 2011;

NSW Roads and Maritime Service for their General Terms of Approval as the development is identified as ‘traffic generating’ under State Environmental Planning Policy (Infrastructure) 2007; and

NSW Department of Primary Industries – Water for their General Terms of Approval as the development would be within 40m of a watercourse and therefore requires a Controlled Activity Approval under section 91 of the Water Management Act 2000.

The application has been internally referred to Council’s Accredited Certifier, Development Engineer, Environmental Health Officer and Contributions Planner. Comments from the Accredited Certifier have requested additional information regarding the provision of an Access Report, a Building Code of Australia (BCA) Report, a Noise Study that incorporates assessment of the Function Centre component of the application, and a Part J Report (required under the BCA). This deferral request has been sent to the applicant for consideration. No other responses from internal referrals have been received to date. The application shall be determined under delegated authority, unless it is requested by a Councillor that the application be determined by full Council.
