N ew York residents exposed to dangerous debrisfrom the Sept. 11, 2001, attacks on the WorldTrade Center sued the Environmental Pro-tection Agency (EPA) March 10 saying the fed-

eral agency cleared the way for people to return to theirhomes, businesses and schools before it was safe forthem to go back.

The suit, which seeks class-action status, was filed bypeople who live, work or attend school near the site.They claim EPA has a legal responsibility for overseeingthe cleanup of the disaster area but failed to do so.

JAIL FOR JUDGES The “Jail for Judges” organization hasbeen saying it, all lawyers know it,and most ordinary people suspect it.There’s a study now that proves thattoo many judges are biased andunfair—read “crooked.” The U.S.Chamber of Commerce for LegalReform says that biased judges arecosting every American $809 eachyear. The worst state is Mississippi,Mercifully, the District of Columbiaisn’t even listed—only the 50 statesare. California is number 46. Theleast dishonest judges are in

TEACHERS UNION PROBED The National Education Association(NEA), the nation’s largest teachersunion, admitted that the LaborDepartment and Internal RevenueService are investigating whether itproperly reported millions of dollarsin political spending. The union hasa long history of spending millions ofdollars on causes regardless of thewishes of its 2.7 million dues payers.Labor Secretary Elaine Chao saidNEA’s reporting has been “virtuallymeaningless.” She said reports haveclaimed $3.9 million in “sundryexpenses” and $63 million in “grantsto state and local affiliates for jointprojects” with no further details.

GAMBLING ADDICTIONNot too long ago gambling was con-sidered immoral and even illegal.Then, our “enlightened” politiciansdecided that state-sponsored gam-bling was a good way to “painlessly”raise more money to spend, and thelottery mania started. Now, it isbecoming apparent that gambling isaddictive to some. One case in point:Virginia Ormanian, of Wyandotte,Mich. Ms. Ormanian lost most of herretirement savings last year playingslot machines at Detroit’s three legalcasinos. She knew she was a gam-bling addict and said she had a con-tract with the casinos not to admither. But the casinos let her in, and shelost all her money. Now she wants itback, so she has decided to sue thecasinos.

COURT CLOUTS SCOUTSThe Supreme Court declined, with-out comment, to hear an appeal bythe Boy Scouts of America of a lowercourt ruling barring the organizationfrom sharing in the proceeds of aConnecticut-run charity because of

the Scouts’ ban on homosexuals. Thelower court cited the Scouts’ “dis-crimination” against homosexuals.“Charities still permitted to partici-pate . . . include gay and lesbiangroups which discriminatorily limitservice to a particular sex, ethnicgroup or age group,” the Scouts saidin a statement released after the highcourt’s denial of certiorari.

A rgentina has managed to reach a compromise in itsongoing stare-down with the InternationalMonetary Fund (IMF) amid growing pressure fromthe country’s creditors and the multilateral agency’s

own bullying tactics. The beleaguered South American nation, which only two

years ago suffered the worst economic collapse in its history,acquiesced to repay the IMF some $3.1 billion mere hoursbefore the loan’s March 9 deadline. The payment was madeon condition that the fund approves its second review of athree-year standby credit granted to Argentina in September.

According to Sen. Cristina Fernandez, wife of ArgentinePresident Nestor Kirchner, the IMF “respected everythingthat we asked for.”

Kirchner had refused to budge to IMF pressure forArgentina to repay the credit as well as accept a number ofstringent conditions in its ongoing talks to renegotiate some$94.3 billion in defaulted bonds held by private investors.Considering how more than 50 percent of Argentina’s 38million population lives in poverty and national unemploy-ment runs at an official 20 percent, additional demands dolittle to help the country’s economy regain its footing. Inspite of the present situation, Argentina’s GDP grew by morethan 8 percent in 2003.

The IMF is presently calling for a so-called “debt resched-uling acceptability principle” where Argentina’s debt repay-ment offer is to be accepted by a minimum of 80 percent ofthe country’s creditors. Argentina is being represented inrenegotiation talks by Merrill Lynch, Barclays Capital, andUBS Investment Bank. Conspicuous by their absence areother institutions such as Bank of Boston or Citibank, whichwere reportedly shunned earlier in the selection processgiven an ongoing probe into the banks’ alleged funneling ofbillions of dollars abroad just a few days before the country’sfinancial collapse in December 2001.

Foremost in the mind of IMF Deputy Managing DirectorAnne Krueger, one of Argentina’s most acerbic critics, was themoney that the country directly owes to the fund.Argentina’s IMF debt accounts for nearly 15 percent of the$106 billion in outstanding loans owed to the fund by bor-rowing countries worldwide. More than the frustrated hopesof Argentina’s other creditors, the IMF was worried abouthow defaulting to the fund would affect the multilateralagency’s own credit rating.

Along with its $94.3 billion debt to private bondholders,Argentina owes nearly $85 billion more in public debt. Thelatter obligation includes some $25 billion in bonds that

were actually issued long after the country’s economic melt-down and default, leaving analysts to wonder where were theIMF and other patron saints of the financial system to mon-itor the new operations.

There is, however, a likely reason why investors and spec-ulators have so far ignored the words of the IMF’s head hon-chos and the editorial page of The Wall Street Journal tellingthem that Argentina is not to be trusted as a debtor. Theyprobably know that in the end they will extract a hefty prof-it out of Argentina just like many speculators did duringBrazil’s debt renegotiation process a few years ago. The oper-ation will not take much more effort than waiting for theIMF or the World Bank to exert the right pressure or lure thelocal authorities with the promise of more loans.

In the meantime, Argentina’s creditors have resorted tonew ways of persuading the Kirchner administration tocough up the money they demand, including filing lawsuitsin U.S. courts.

The unprecedented scenario in which a U.S. court getsdragged into a financial conflict between foreign nations andinternational bankers and speculators has nonethelessproved to be an effective tool for bondholders. Only onMarch 6, Manhattan federal judge Thomas Griesa ruled infavor of a group of 44 creditors holding some $20 million inArgentinean bonds to be paid from Argentina’s assetsabroad. Griesa also confirmed a previous sentence orderingthe freezing of two U.S. accounts holding $11.5 millionowned by a former Argentine postal service operator. SeveralNew York-based law firms are reportedly lining up to filenew lawsuits in favor of other claimants, including promi-nent European investment funds.

The money is, however, short change compared to the$725 million in Argentine debt held by U.S. billionaireKenneth Dart and which, in accordance to a landmark rul-ing by Griesa in September, should be fully paid by theSouth American nation. Dart is the heir of a U.S. foam cup

fortune, and owns a significant amount of the bondholder-owned debt through his investment vehicle EM Ltd. The lat-ter is one of several agencies which Argentine FinanceMinister Roberto Lavagna, among others, has called “vulturefunds.” Kirchner has privately complained how a significantamount of the defaulted Argentine bonds has ended up inthe hands of so-called vulture funds, which paid an average20 cents to the dollar for them.

What Dart is asking the Argentine government to do,however, is what he himself refused to in 1994, when herenounced his U.S. citizenship in order to avoid paying taxesthat according to Internal Revenue Service records amount-ed to $21.7 million that year as well as $34.5 million in1993.

Dart’s maneuvers taint the motives of smaller investorswho simply fell for the hype about Argentina allegedly beinga wise investment that financial establishment organs suchas The Wall Street Journal reported on during the 1990s.

“Invincible” is how the Austrian press now describesthe nationalist, populist Joerg Haider, who won ahealthy victory—after being dismissed by the mediaand condemned by the European Union.

The pundits and pollsters had predicted he would lose,and the European Union deemed him unfit to be in gov-ernment, yet when the votes were counted it was abundant-ly clear that Haider, “one of Europe’s most prominent right-ist populists,” remains “a dominant force” in Austrian poli-tics, according to reports in the European press.

Haider’s decisive victory in the regional parliamentaryelection in Carinthia on March 7 stunned Austria’s politi-cal elite, according to the left-leaning Guardian, and un-doubtedly frustrated Europe’s unelected socialist commis-

sioners in Brussels.“Haider’s back,” Werner Beutelmeyer of the Market Insti-

tute polling organization said and predicted that he wouldbe “stronger than ever” on the Austrian political scene.

Voter turnout was high, about 78 percent, and when the334,000 paper ballots were handcounted, nearly 43 percentof them went to Haider and his Freedom Party of Austria(FPO). The Socialist Party trailed 4 points behind Haider,and the conservative People’s Party had less than 12 percentsupport.

Although the voters were deciding on the regional par-liament, the election was seen as a plebiscite on Haider, thegovernor of Carinthia, and his anti-immigration, anti-European Union policies. As the Austrian press reported,the results of the plebiscite were beyond doubt.

“Haider’s claim on the leadership is beyond question,”the leading Der Standard wrote. Austria’s leading tabloid,Kronen Zeitung, wrote: “Haider’s glorious return can’t be pre-vented after this staggering victory.”

Profil, a news magazine, had only one word on the coverwith the smiling Haider: “Invincible.”

As “one of Europe’s most prominent rightist populists,”Haider’s success may boost other populist parties in Euro-pean Union elections in June, The Financial Times wrote.

Haider’s victory was a defeat for Austria’s ChancellorWolfgang Schuessel and his People’s Party. The FPO andPeople’s Party have ruled Austria as members of a coali-

tion since 2000.“Mr. Schüssel has always told the European People’s

Party that by forming a coalition with the Freedom Party hebecame the ‘dragon slayer’—he was able to keep a check onMr. Haider—but since Sunday that no longer rings true,”Profil wrote. “The dragon lives.”

Haider, who has been attacked for speaking to Nazi vet-erans and accused of being anti-Semitic, said: “I regret noth-ing and see no reason to change my political agenda. Forspeaking out plainly you are attacked by your politicalopponents. Then, two or three years later, they suddenlyagree with you.”

Haider’s victory comes on the heels of recent electionsin Greece, where the rightist New Democracy Party oustedthe Socialists in parliament elections in early March. Thevictory of the newly elected prime minister, Costas Cara-manlis, was attributed to running on a platform calling forsmaller government, less bureaucracy and less taxes. ★

A nthony L. Hargis, a western regional editor forAFP, has long been active in the freedom move-ment, as both an activist and a writer, and, assuch, has been a thorn in the side of the estab-

lishment. In particular, he objects to the federal individ-ual income tax as it is applied to the citizens of the 50“sovereign” states, and argues that the income tax is actu-ally unconstitutional.

Currently Hargis is battling the U.S. government overhis “warehouse banking” operation, which providesclients with an alternative to the Federal Reserve System.Federal officials claim his bank was used to hide transac-tions and help clients to evade income taxes.

“The promoters and operators of so-called warehousebanks claim to offer financial privacy,” Eileen J. O’Con-nor, assistant attorney general for the Justice Depart-ment’s tax division, said in a statement issued by thedepartment. “What they are actually offering is a ticket totrouble for themselves and their customers when thatprivacy leads to tax fraud.”

The suit, filed in U.S. district court in Santa Ana, Calif.,alleges Hargis used Internet advertising to promote a

fraudulent system aimed at hiding income and assetsfrom tax authorities. The ads contended that federalincome taxes were unconstitutional and pitched ware-house banking as an alternative to being “enslaved” bythe “bandits of mankind,” according to the complaint.

But Hargis says the government has been trying toforce his company, ALH & Co., to turn over all its records,which he feels would violate his customers’ right to pri-vacy and his own rights under the Fifth Amendment.

He met twice with the IRS in 2003 and told the agencyhe had never engaged in the acts it accused him of, in-cluding promotion of abusive tax shelters and prepara-tion of fraudulent tax returns.

The IRS insisted it had evidence he had done so.Hargis said he asked that they show him the evidence, buthe said officials refused to show any evidence.

Hargis has set in motion a lawsuit to compel them toproduce their evidence, if it exists. That suit is still inprogress.

The government, he says, has summonsed him to pro-duce records that have never existed.

Hargis attended another meeting with IRS officials onFeb. 12, but refused to produce records. The governmentthen made a motion to the court to have Hargis incarcer-ated until he produces records.

Hargis said that the government has released informa-tion to the media that claims he was involved in the pastwith a Ponzi scheme and another scam. However, saysHargis, his only involvement was the fact that those scam-mers had used his bank. Furthermore, he said that, atthose times, he cooperated with the authorities to putthese confidence men in jail—a fact that was missing from

a recent news article in The Los Angeles Times. The function of his bank, according to Hargis, is not to

hide assets but to enable Americans to quit supportingthe “cannibalization“ of future generations via theFederal Reserve.

It is not records the government seeks, says the embat-tled patriot, but his destruction. If they only wanted hisrecords, he notes, they could have executed a search war-rant. “Instead,” he says, “the government issued a sum-mons that was impossible to comply with, or thatrequired me to commit perjury.”

A fter suffering almost 25 percent of all U.S. man-ufacturing jobs lost in the last three years,Michigan is now saddled with a $1 billiondeficit, the largest in its history. And to add to the

state’s woes, Electrolux-AB recently announced the clo-sure of its Greenville refrigerator manufacturing plantnear Grand Rapids, laying off 2,700 workers.

The administration of Gov. Jennifer Granholm (D)hurriedly put together a massive incentive package of tax-payer-financed formulas to persuade Electrolux, a Swe-dish-owned company, to stay. But it was to no avail. Thecompany, while a few of its jobs might head to the slight-ly greener pastures of southern U.S. states, has decided tomove most of the refrigerator-making jobs to Mexico.

Granholm even offered Electrolux a one-time incen-tive and tax credit program worth up to $121 million,including a so-called “Renaissance Zone” that wouldhave allowed the company to operate virtually free ofstate and local taxes for up to 20 years. But for Electrolux,keeping the production of Kenmore, Gibson, WhiteWestinghouse and Kelvinator refrigerators in Michiganpaled in comparison to an $81 million profit the com-pany said it would make every year by paying Mexicanworkers and avoiding Social Security, mandatory insur-ance and other benefits mandated by Washington.

Michigan’s plight has convinced its people and politi-cians that something drastic needs to be done to stem the

flood of jobs out of the state. In a meeting with tool anddie makers and die casters last fall, State Rep. Neal Nitzproposed a taxpayer-supported care package that includ-ed state aid in the form of grants, increased tax credits, alimited number of virtually tax-free “recovery zones,” andimproved depreciation on industrial machinery. He

pointed out that the loss of manufacturing jobs was sap-ping the state’s budget. With fewer people working atmiddle-class wage levels, there was a drop in state incometax withholdings, and fewer people taking home a sizablepaycheck. In addition there were fewer purchases and aloss in sales tax revenue.

While Granholm, and many in the state government,have argued that the problem should be addressed large-ly at the state level, others have countered that it is a fed-eral issue.

When Electrolux confirmed the rumors that it wasleaving Greenville, Mike Huckleberry, owner of Huckle-berry’s Restaurant in downtown Greenville, and knownto his friends as “Huck,” decided to take matters into hisown hands. He supplied customers to his bar and grillwith placemats carrying his message:

“Dear Politicians. In spite of continued raises andperks for yourselves you have allowed NAFTA and unfairworld trade policies to take their toll on hardworkingAmericans, their families and the communities they livein . . . as well as our great country.”

The placemats caused such a stir that when the Michi-gan Democratic Caucuses passed through the state, joblosses became an issue, and he was interviewed by televi-sion networks and national newspapers.

Huck’s first consignment of placemats were signed byhundreds of concerned citizens and will soon be sent tothe local U.S. congressman—Republican and NAFTA sup-porter, Dave Camp.

Fired with success, Huck created another placematdesign that showcases a copy of a scathing letter he wroteto the editor of his local newspaper. Signatures on thissecond placemat number in the thousands.

On placemat 2, he wrote: “Why can’t corporationsthat produce offshore sell their products and services inthe countries where they were produced? Does an Ameri-can worker deserve more than a bowl of soup and a crustof bread at the end of the day? Who will corporations sellto when American jobs are gone? Why is ‘tariff’ consid-ered a bad word by many of these same legislators? Is itwrong to protect our country against unfair world tradepolicies?”

Asked about agricultural issues, he had this to say:“American farmers can’t use certain chemicals on theircrops because of health concerns, yet foreign countriescan, and with our trade policies they are allowed to selltheir crops in America. What is fair and healthy aboutthat?”

To people in Michigan, Huck helped focus the need fora federal solution to job losses. Even critics acknowledgethat U.S. trade policy authority, in Article 1, Sect. 8 of theU.S. Constitution, is vested in the House of Represen-

tatives. It was, they will argue, irresponsibly and unconsti-tutionally given away when Congress voted in 1994 toapprove another round of the General Agreement on Tar-iffs and Trade and entered into the newly minted WorldTrade Organization, to which that trade authority wastransferred.

Economists have claimed that under internationaltrade rules, the federal government continues to favor theimportation of cheap goods that enter the nation tariff-free, thereby denying itself a significant source of revenuefrom the tariffs. In an unending cycle, the absence of tar-iffs provides more incentive for manufacturers to moveoperations overseas or to Mexico, since labor costs and allother production costs end up in the price of products.

Moving production to cheap labor markets is onlyprofitable if there’s no American tariff standing in the wayto equalize low foreign labor costs with high Americanlabor costs.

Economists say there are no easy solutions, but oneglaring problem is that the federal government hasimposed hundreds of thousands of regulations ondomestic producers along with stifling taxes. Add to that,the incentive programs created through the OverseasPrivate Investment Corporation and the Export ImportBank—both of which aid companies that want to set upshop overseas and arrange for American taxpayers tocover their losses if an investment goes sour. Then youhave a recipe for disaster.

The Granholm administration seems to be followingHuck’s lead, but only to a point. Granholm plans to joingovernors from at least two other states hit hard by joblosses at a series of events April 27 in Washington. A newsrelease states that these events will “focus on the need forchanges at the federal level to keep the U.S. competitive

and create and retain more manufacturing jobs.”Meetings with Bush administration and congressional

leaders are planned by Granholm, who will be joined byGovs. Ed Rendell of Pennsylvania and Jim Doyle ofWisconsin. Granholm claims that the silence from theBush administration on job losses has been “deafening.”But while it’s encouraging that she is passionately takingthe lead on this issue and focusing the concerns voiced byMichigan business and labor leaders on federal policy,there’s a cause for pause.

In her call for a “level playing field” in the manufac-turing sector, Granholm has stated that, “internationalregulations are not adequately enforced by the federalgovernment, which is negatively impacting the competi-tiveness of the U.S. manufacturing base.”

Some economists have taken note of the fact that shesaid “international” regulations need to be enforcedwhen the Constitution has vested the elected nationallegislature with all authority on trade policy, both domes-tic and between nations. Granholm could be, wittingly ornot, conferring more legitimacy on the authority of theWTO and its unelected bureaucracy to “do a better job”of regulating trade on an international basis. Is that real-ly a good idea?

Former GM executive and author Gus Stelzer has per-haps said it best:

“Tariffs on imports would go a long way toward pay-ing for our federal government, and our industries thatgenerate tax revenue and good wages would be runningagain, with the result that we could reduce or eliminatethe income tax.” ★

T he Senate has approved legislation that would stopfederal contractors from using taxpayer dollars toship jobs overseas. The bill was attached to legisla-tion intended to restructure corporate taxes and end

rising trade sanctions on U.S. goods sold in Europe. Theamendment was approved 70-26 on March 2.

“Our nation’s chief export should not be jobs for for-eign workers,” said Sen. Christopher Dodd (D-Conn.), who sponsored the bill. If signedinto law, the ban would prevent gov-ernment contractors from movingoffshore work that had been donein the United States, stop federalprocurement of some goods andservices from overseas and requirestate governments to certify thatfederal funds they receive will notgo offshore.

While a Senate vote on thefinal bill is expected momen-tarily, its future in the House isuncertain. The pending House ver-sion of the legislation makes no mentionof the offshoring issue. A House-Senateconference will have to negotiate the finallegislation, and both chambers will have tovote again.

While the jobs-saving measure is obvi-ously good news for American workers,the motivation behind the formulationof the bill is that it was dictated by theEuropean Union (EU). On com-plaints by the EU, the World TradeOrganization ruled in January 2002against a section of the U.S. tax code that gives exportersbreaks on overseas sales and leases, calling them an illegalsubsidy.

The EU started the sanctions, authorized by the WTO rul-ing, at 5 percent and plans to raise them by 1 percent amonth for a year, unless the subsidies are repealed. The EUtariffs affect 1,608 products. Senators passed the bill in aneffort to head off the EU’s planned tariffs.DRAFT BILLS PENDING

Congress could be preparing the public mind for rein-statement of the draft, which was abolished by PresidentRichard Nixon in 1974. Nothing will happen this year—especially with an election—but the issue may become“ripe” when a new Congress is seated in January. All pendingbills will die at the end of the 107th Congress and must beintroduced again. But the presence of these bills sends achilling message.

U.S. troops are being bled dry in Afghanistan and Iraqand are deployed in more than 100 nations worldwide. TheNational Guard and Reserve units are serving around theworld at levels not seen since World War II.

Both bills (S. 89 and H.R. 163) require two years of either

military or civilian service “in furtherance of nationaldefense and homeland security” for all men and womenages 18 to 26. Those who object on religious grounds can beassigned civilian duty or non-combat military roles.

Sen. Ernest Hollings (D-S.C.) introduced the Senate ver-sion although he is retiring and won’t be around

when the issue is addressed next year. TheHouse version was introduced by Rep. CharlesRangel (D-N.Y.), a combat hero in Korea anda strong opponent of the invasion of Iraq.Rangel was joined by a flock of Democraticdoves: Jim McDermott (Wash.), John

Conyers (Mich.), John Lewis (Ga.), FortneyStark (Calif.) and Neil Abercrombie (Hawaii).

DRUG RE-IMPORTATION PUSHEDFive senators have stealthily acted to win avote on drug re-importation legislation in a

move likely to prompt an intense lobby-ing fight between the pharmaceuticalindustry and consumer advocates.

With no fanfare, Sens. ByronDorgan (D-N.D.), John McCain (R-Ariz.), Tom Daschle (D-S.D.),Olympia Snowe (R-Me.) and DebbieStabenow (D-Mich.) quietly offeredtheir bill Feb. 25.

Although drug re-importation isa major public health issue, the sena-

tors chose not to hold a press confer-ence, which is routine, or even issue a

press release. Dorgan did not speak on theSenate floor when he introduced the legisla-tion, which is also routine.

Their legislation would allow for drug re-importation from facilities approved by theFood and Drug Administration (FDA) in 24

industrialized nations. Because these coun-tries impose price limits, drugs are up to 50 percent cheaperthan the same drugs sold domestically.

Their silence appears to be part of a strategy employed byadvocates of re-importation to force a vote. The Hill, a jour-nal devoted to covering Congress, reported on a bipartisanmeeting among senators and House members on how tosecure a vote. Claiming that the drug industry is watchingtheir every move, they declined to discuss their strategy.

The House last year passed a drug re-importation bill over

the objections of Speaker Dennis Hastert (R-Ill.) andPresident Bush. The Senate bill is identical, and if passedwithout change, it would go straight to the White House.

Dorgan ducked procedural hurdles that require new billsto be referred to committees by sending his proposal (S.2137) to the Senate desk. Senate rules allow the bill to becalled up at any time once it is at the desk. Re-importationlegislation normally would be referred to the Senate Health,Education, Labor and Pensions Committee. Chairman JuddGregg (R-N.H.) has refused to move re-importation legisla-tion.

But this time, Dorgan kept his bill at the desk. SenateMajority Leader Bill Frist (R-Tenn.) and Majority Whip MitchMcConnell (R-Ky.) promptly objected. Aides said theirobjections moved Dorgan’s bill from the desk to the calen-dar, where it can be called up for a vote if it is determined tobe germane to legislation on the Senate floor.

Senate Finance Committee Chairman Chuck Grassley (R-Iowa), a key legislator on health care matters, would supporta Canada-only re-importation bill. It is unclear, however, ifhe would support the Dorgan bill.

The pharmaceutical industry argues that the safety of re-imported drugs cannot be guaranteed. It is unclear, however,how brand-name medicines become tainted when shippedto Canada and back in the same package. The Dorgan billwould require imported drugs to be packaged and shippedusing counterfeit-resistant technologies.

The industry has also argued that high prices are neces-sary to fund research, which requires heavy financial invest-ments for years in the long road from development and tri-als to the marketplace. But because other countries imposeprice limits, Americans are now required to bear the finan-cial burden of research for the entire world. Re-importationadvocates suggest the industry should tell these nations,mostly prosperous, industrialized countries, they will paythe same price as Americans or do without. Such price lim-its would be short-lived, supporters of the Dorgan bill argue.NAFTA RELIEF FOR TRUCKERS

Sen. Max Baucus (D-Mont.) has introduced legislation toprovide the same relief for truckers who lose jobs or workinghours because of NAFTA as displaced manufacturing work-ers receive.

His bill (S. 2157) amends the Trade Act of 1974 to ex-pand the Trade Adjustment Assistance program to includetruckers and has been referred to the Senate FinanceCommittee. Baucus has 17 co-sponsors.

“We only give benefits to workers who make things,”Baucus said. “This bill provides benefits . . . to workers wholose their jobs because his employer loses routes to aMexican domiciled trucking company [sic].”

The Supreme Court is to decide whether a federal envi-ronmental impact statement is required before Mexicantrucks operate beyond the U.S. commercial zones. This couldhave significant impact because many Mexican trucks fail tomeet U.S. clean fuel standards, and many are unsafe. ★

F or years, the central planners at the FederalReserve* have assured us that inflation is dor-mant, if not dead. Federal Reserve Governor BenBernanke, during a recent speech in Washington,

took pains to emphasize that inflation is “under verygood control.” But considering the relentless increase inthe money supply engineered by the Fed over the lastdecade, one wonders whether Bernanke, Chairman AlanGreenspan and company protest too much.

Austrian-school economists demonstrate that trueinflation is monetary inflation. True inflation thereforecan be measured by an increase in the money supply.Greenspan and Fed policymakers have more than dou-bled the M3 money supply in less than 10 years. WhileTreasury printing presses can print unlimited dollars,there are natural limits to economic growth. This flood ofnewly minted U.S. currency can only increase consumerprices in the long term, as more and more dollars chaseavailable goods and services.

Lew Rockwell, president of the Ludwig von MisesInstitute, explains that Federal Reserve governors are inca-pable of telling us the truth about inflation for a very sim-ple reason—they’re the ones causing it:

The Federal Reserve always promises that it’s work-ing to bring down inflation, but as Murray N. Rothbardshows, it never does. Since the Fed came into being, thedollar’s value has plummeted to less than a penny, andeven at a 3 percent inflation rate, prices will tend todouble every 25 years. . . . The Fed wants to cover itscrimes by appearing more successful at “battling infla-tion.” What the Fed doesn’t want to talk about is thereal cause of inflation: not greedy consumers, avari-cious workers, or price-gouging corporations, but thecentral bank itself, and its power and practice of creat-ing money out of thin air.

The Treasury Department parrots the Fed line thatconsumer prices, as measured by the consumer price

index (CPI), are under control. But even some Keynesianeconomists admit that CPI grossly understates true infla-tion. The most glaring problem is that CPI excludes hous-ing prices, instead tracking rents. The Fed’s easy creditpolicies have created an artificial mortgage boom,enabling many Americans who would not have met cred-it standards 30 years ago to buy houses. So demand forrentals has diminished, causing rental housing prices todrop and distorting the CPI downward. However, every-one knows the cost of purchasing a home has increased

dramatically in the last 10 years. Home prices in manyregions have more than doubled in just five years. Soprice inflation certainly is alive and well when it comes tothe largest purchase most Americans make.

The prices of many other goods and services, includingmedical care and energy, also have increased substantial-ly in the past decade. Commodity prices in particularhave risen recently. In fact, broad indexes show com-modities have risen 49 percent since last spring. The priceof gold, steel, lumber, coal, lead, soybeans, corn and ricehave all spiked over the past year. When raw materialsand basic consumables rise in price, all of us feel theeffects in our pocketbooks.

Greenspan may dismiss commodities as mere “physi-cal” assets in his vision of an increasingly “conceptual”economy, but the markets are showing their preferencefor hard assets over fiat dollars and dollar-denominatedequities. ★

The European Union has retaliated against theUnited States for providing $4 billion in taxbreaks to major corporations, including Boeingand Microsoft. Now, over 1,600 U.S. productsare facing EU sanctions, beginning with a five-percent duty increase, rising to 17 percent over

the next year.The escalation of this latest trade war began when the

Bush administration failed to revoke its tax breaks despite aclear mandate from the World Trade Organization, whichdeclared the tax breaks illegal.INCREASINGLY DISENCHANTED

Trade between the EU and the United States amounts to$1 trillion annually, but the EU has become increasingly dis-enchanted with Washington’s “free trade” policies that haveincluded $700 million in subsidies to U.S. producers of steel,ball bearings, seafood, pasta and other products.

Last year, in a showdown with the EU and Asia over U.S.tariffs on steel imports, the Bush administration, much tothe consternation of the steel industry in states likeMichigan, backed down and scrapped the tariffs.

The latest news is that, following the scrapping of the pro-tective measures, the price of steel around the world hasspiked, which has affected everything from housing con-struction to bridge repairs.

This time, the WTO stepped in after the EU made it clearthat illegal tax breaks to U.S. corporations would lead to abigger trade war and there appeared to be little action on thepart of the Congress to enact legislation to end the tax incen-tives.HONOR ITS OBLIGATIONS

The White House responded to the EU’s decision by stat-ing that it would honor its obligations to the WTO. In otherwords, it would not react adversely to the EU strategy for fearof expanding the present trade dispute. Instead, it would askCongress to quickly enact legislation to end the tax breaks.However, the Ways and Means Committee, which has beendrafting legislation, does not have enough votes to repeal the

benefits to U.S. companies.The result is that 1,608 U.S. companies in the EU’s firing

line will face tariffs against their products.Products affected include: jewelry, soybeans, sunflower

seeds, orange juice, sporting equipment, textiles, and heavymachinery and construction equipment.

The EU says it is phasing in its sanctions and will cancelthem if the Congress repeals U.S. tax breaks before 2006. Inthat event, the cost to U.S. exporters on the sanctions’ listwould only be approximately $666 million.

However, economists believe a weak dollar could havethe effect of reducing the impact of the sanctions. ★

been condemned by the State Department in the federalagency’s own “Country Reports” of human rights abuses.In particular, the State Department has defined pro-longed sleep deprivation and exposure to cold as exam-ples of maltreatment and torture—the types of tech-niques now used by CIA and military interrogators inspecial detention facilities like the one at Bagram airbasein Afghanistan.

The report complains that HRW investigators weredenied access to a heavily guarded CIA compound in theAriana Chowk district of Kabul, the Afghan capital. Forty-foot high walls, razor wire and guard towers surround thecompound.

“The CIA also controls a separate detention and inter-rogation facility at Bagram airbase, though this has neverbeen officially acknowledged by the U.S. government.Little is known about who is detained there, for howlong, conditions of detention or grounds for release ortransfer,” claim the report’s authors.

A former high-level Taliban official, once held there,told HRW that the CIA flew major al Qaeda suspects intothe base for interrogation. One of them was KhalidSheikh Mohammed, allegedly suspected of being one ofthe masterminds behind the Sept. 11, 2001 attacks.

Over 1,000 people have been detained in Afghanistansince March 2002, and most have been released withindays, if not weeks. While acknowledging that recentimprovements may have been made in detention facili-ties like Bagram, HRW says it is difficult to be certain ofthe facts.

What is not in doubt, according to HRW, is that dead-ly force has been used in operations to detain suspects,who have later been mistreated in a fashion that amountsto torture.

The report points out that in June 2003 President Bushdenied that the United States used torture. However,independent observers have been consistently deniedaccess to detention centers. In contrast, the InternationalRed Cross has been allowed into some facilities but it isprohibited from discussing or publicly publishing itsfindings.

Brad Adams, executive director of the Asia division ofHRW, says it is time for the United States to take action:

“This stonewalling must stop. The U.S. is obliged toinvestigate and prosecute those who have violated thelaw. There is no sign that serious investigations are takingplace. Abusive governments across the world can nowpoint to the U.S. forces in Afghanistan and say: ‘If theycan abuse human rights and get away with it, why can’twe?’ ”

HRW noted that its investigators received “credible”reports that detainees were treated harshly after theUnited States set up the Bagram airbase facility in late2001. In particular, the HRW report referred to the expe-rience of two detainees who were interrogated at Bagram,then transferred to Guantanamo and subsequentlyreleased:

A t a time when the Bush administration is talk-ing about democracy in Iraq, many Iraqiwomen feel they have been shortchanged.There is growing concern there that new provi-

sions enacted by Iraqi authorities will have the effect ofrolling back women’s rights that had been guaranteedunder the previous government.

Some of the rights Iraqi women enjoyed under for-mer Iraqi leader Saddam Hussein’s rule have not beenprotected by the country’s new interim “constitution.”

In the “constitution,” known as the TransitionalAdministrative Law, there are no provisions ensuringequal status for women in respect to marriage, child cus-tody and inheritance rights. Women who marry non-Iraqis will not be entitled to confer citizenship on thechildren of those marriages.

The lack of clear provisions to give women equal sta-tus in the social and family spheres was obscured by themuch-heralded announcement that the interim “consti-tution” recommended that women should have 25 per-cent of the seats in any new assembly. However, thepromise of a political role for women without equal sta-tus and protection under the law has been condemned

by international women’s rights groups.LaShawn Jefferson of the Women’s Rights Division

of Human Rights Watch says the Iraqi constitutionalprocess has “gotten off to a weak start,” and it appearsthat secular family law is about to be handed over toreligious control without an international outcry.

Under Saddam, family law ignored Islamic opposi-tion to divorce and granted women equal status in childcustody battles. Now, in Resolution 137 of the newinterim “constitution”—framed with the help of theUnited States—divorce and inheritance rights have beenplaced under Islamic religious control as a concession toShiite leaders, who want the eventual implementationof sharia (Islamic law) when a permanent constitutionis written next year.

“We are with you in spirit,” Condoleezza Ricedeclared in a satellite address to Iraqi women last year.But, after the introduction of the interim document,many women see Rice’s promise as hollow. Suddenly,the liberation of Iraq has led to a diminution of the pro-tections women enjoyed under Saddam’s Baath Partysecular system.

Since the overthrow of Saddam, many observers say,women have suffered the greatest hardships there. Priorto the war, over 70 percent of working women were

employed in public sector jobs. However, with the col-lapse of the old Iraqi government, most of them arenow unemployed, as are most female college graduates.

And, despite the claims of the Bush administration,electricity and sanitation have not markedly improved,making life difficult for everyone. There is also the seri-ous issue of rising levels of criminal activity, making ithazardous for women to leave their homes unescorted.

The future for Iraqi women looks bleak because ofthe growing influence of religious authorities. Contraryto reports that the interim “constitution” diluted thepower of Islam in the legislative sphere, sharia is beingimplemented in many cities, including parts of Baghdadand Najaf. Under the noses of the U.S. military, it’s beenreported that enforcers from Jaish al Madhi—a vigilanteforce within the Shiite Badr Brigade militia—are impos-ing strict sharia rules.

In “underground” sharia courts, Shiite mullahs arepassing sentence on people for owning liquor storesand for drunkenness and on women for having extra-marital affairs and not wearing Islamic garb.

The mullahs are also sitting in judgment in divorceand custody battles, relying on Islamic laws that favormen. The enforcers carry out sentencing that ofteninvolves beatings and whippings. ★

interpreters, yelled at the detainees from behind thelight.”

Two other detainees confirmed to a New York Timesreporter that they were shackled naked and made tostand, while being deprived of sleep and beaten. Thetreatment then continued for weeks. Similar claims weremade to a reporter with the Associated Press, includingthe allegation that some detainees were kept in freezingcells and doused with cold water.

In March 2003, Roger King a U.S. military spokesmanat Bagram, admitted that sleep deprivation—wakeningdetainees every 15 minutes and forcing them to stand forprolonged periods—reduced inhibition and resistance toquestioning.

The HRW report claims that several U.S. officials pri-vately acknowledged that those techniques were used.They also admitted that detainees were made to kneel forhours, wearing hoods or spray-painted goggles.

Also in March 2003, a U.S. official told a New YorkTimes reporter that the al Qaeda suspect, Omar Faruq,was subjected to techniques that were “not quite torturebut as close as you can get.”

Faruq was kept in a cell with fluctuating temperatures,ranging from 100 to 10 degrees Fahrenheit.

It was also stated by the same unnamed official thatthe alleged al Qaeda mastermind Abu Zubaydah wastaken to Bagram airbase after he was shot three timeswhile being captured in Pakistan. At Bagram, interroga-tors manipulated his levels of pain medication whenquestioning him.

A photojournalist, who accompanied U.S. SpecialForces and 82nd Airborne troops in operations in easternAfghanistan in July 2002, later spoke to HRW about hisexperiences and said that Kandahar was referred to by thetroops as “Camp Slappy.”

“U.S. forces would threaten uncooperative personsencountered during raids, suggesting they would be sentthere: ‘we tell them they can cooperate or go to CampSlappy.’ ”

Afghan allies who conduct operations alongside U.S.troops are singled out by HRW for their systematic abus-es against people detained in the country.

“Human Rights Watch is extremely concerned about

the treatment of the hundreds of Afghans alleged to befrom the Taliban, held under the auspices of the Afghanmilitary and intelligence authorities. In past reports,HRW has documented numerous cases of torture, beat-ings and other mistreatment of persons. Recently, therehave been credible reports from human rights monitorsin Kandahar that ‘Taliban prisoners’ are repeatedly andseverely beaten by Afghan soldiers holding them.”

Afghan warlord Abdul Rashid Dostum, a member ofthe Hamid Karzai government, still holds approximately1,000 prisoners—alleged Taliban and foreign fighters—in the northern city of Shiberghan. According to HRWmonitors in the capital, Kabul, CIA and U.S. militaryinterrogators have access to those prisoners and have

resisted efforts by the Afghan and Pakistani governmentsto screen the prisoners for possible release.

UN monitors who have visited some of the Afghandetention facilities have complained about the use of tor-ture and the fact that the CIA and U.S. military knowwhat goes on in Afghan-controlled detention camps.

The HRW report is particularly scathing about the fail-ure of the U.S. to provide answers about the deaths ofthree detainees in two U.S. detention facilities.

According to a death certificate by a military patholo-gist at Bagram airbase, one of the detainees, a 22-year-oldman, died from “blunt force injuries to lower extremitiescomplicating coronary artery disease.” Another detaineeat Bagram, Mullah Habibullah, aged 30, died from a pul-monary embolism (blood clot in the lungs) due to bluntforce injury to the legs. The third fatality occurred at a

facility in Kunar Province in June last year, but U.S. mili-tary officials have refused to reveal the cause of death.

So far, officials from Central Command and theArmy’s Criminal Investigation Command have statedthat there is an ongoing investigation into the two deathsat the Bagram base, but no information is available onthe third casualty in Kunar.TORTURE AROUND THE WORLD

The interrogation tactics outlined in the HRW reportaccord with those used by many armies in wartime andespecially in counterinsurgency conflicts. The Britisharmy pioneered similar interrogation methods duringcolonial “emergencies” in Kenya, Aden and Cyprus. In1970, a unit from the British army’s Intelligence Wing atAshford subjected 12 detainees in Northern Ireland tohooding, sleep deprivation and white noise. The HumanRights Court in Strasbourg later reviewed the episodeand, while condemning the British Army, stopped shortof defining the interrogation methods as torture—prefer-ring terms like inhumane, degrading and ill treatment.

The Geneva Convention in Article 3 condemns what itcalls “outrages upon personal dignity, in particularhumiliating and degrading treatment.”

The Fundamental Guarantees under the 1977Protocol 1 of the Convention prohibit torture of allkinds, whether physical or mental.

According to HRW, the prolonged shackling ofdetainees breaches international conventions and canamount to torture.

“Prolonged sleep deprivation and exposure to coldmay also violate international law prohibitions againstmistreatment and amount to torture,” states the HRWreport into U.S. methods in Afghanistan.

It is unlikely the United States will find itself beforeany international court or tribunal, say observers, as inter-national laws governing the illegality of certain types ofdetention and interrogation techniques have not alwaysbeen clear.

It was to avoid U.S. forces being tried for war crimesthat the Bush administration, unlike their British coun-terparts, refused to acknowledge the authority of theinternational criminal court at The Hague when its exis-tence was ratified by the Treaty of Rome in 2002. ★

Following Romero’s luncheon address, combat veter-ans made the same point to reporters in more emphat-ic terms.

“If captured, I hoped to be treated in accordance withthe Geneva Conventions,” said Michael McPhearson, aveteran of Gulf War I and member of Veterans for Peace.“I took comfort in my belief that the U.S. was dedicatedto following the conventions. Today, soldiers cannottake comfort in our treatment of POWs. They mustwonder whether, if captured, they will be treated as‘enemy combatants.’ ”

Soldiers “are particularly threatened by U.S. govern-ment policies and actions,” said Ellen Barfield, a veteranand vice president of Veterans for Peace. “U.S. secrecyabout foreign detainees could threaten the safety of U.S.soldiers who may be captured in future conflicts.”

Hostile foreign governments “would have no reasonto observe international law” thanks to U.S. policy, shesaid. “This compromises the safety of not only U.S. serv-

ice members, but also civilian Americans.”“That is why former judges and diplomats, POWs,

veterans and human rights groups are all protesting thedetentions in briefs filed with the Supreme Court,”Romero said in his address.

“Precisely because we expect the terrorist threat to bewith us for a long time, we must take extra precautionsto safeguard our liberties,” he said. “What are we fight-ing for if not the values of freedom, liberty, equality andtolerance?”MOMENTUM BUILDING

Momentum for liberty is building, he said. “Two hundred and 60 communities in 38 states—as

well as the entire state legislatures of Alaska, Hawaii andVermont—have adopted resolutions in support of the‘safe and free’ message,” Romero said. “These commu-nities represent an extraordinarily diverse group ofAmericans—more than 45 million people from smalltowns such as North Pole, Alaska and Carrboro, N.C.,all the way to large metropolitan areas like Los Angeles,

Chicago and New York City.“The supporters of these efforts are conservatives, lib-

erals, moderates and independents—people concernedabout the impact of decisions and actions the govern-ment is taking with serious consequences for their per-sonal freedom of expression, association, and—mostimportantly—the freedom to be left alone in their indi-vidual pursuit of life, liberty and happiness,” he said.

A similar momentum is building in Congress, hesaid. There is a bipartisan group of 15 senators that sup-port the “Security and Freedom Ensured (SAFE) Act”that “is aimed at bringing provisions of the Patriot Actin line with the Constitution,” Romero said. The origi-nal co-sponsors, Sens. Larry Craig (R-Idaho) andRichard Durbin (D-Ill.), are “rarely on the same side ofan issue” but “share a concern over protecting liberty.”

In private comments before his speech, Romeroexpressed pleasure at the support from such “conserva-tives” as former Rep. Bob Barr (R-Ga.) and independentnewspapers such as American Free Press. ★

inspectors prior to the war and by U.S. inspection teamsafter the war have failed to find a single banned weaponin Iraq.

“They believed the intelligence rather than the inspec-tors, and unfortunately the inspectors were right,” Blixsaid. “There was not sufficient critical thinking. I even goso far as to say it was like a witch-hunt.”

The intelligence that was used by the U.S. and Britishgovernments to justify the war against Iraq turned out tobe wrong, Blix said.

“They were so convinced that there were witches inIraq that every black cat became proof of it,” he said. “Thetendency was to view any evidence in a more serious lightthan was the reality.

“There should have been a bit more patience,” Blixsaid. “If the inspections had gone [on] for a couple moremonths, then I think Mr. Blair and others would haverealized that many pieces of intelligence which theyrelied upon were not valid.”

Britain’s former Foreign Secretary Sir Malcolm Rifkindaccused Prime Minister Tony Blair of “gross misuse” ofthe intelligence services in order to wage war against Iraq.“It is now clear that he took Britain into war on a falseprospectus, and the Iraq war will, rightly, haunt Blair forthe rest of his premiership,” Rifkind wrote in England’sThe Independent.

Under The Independent’s March 5 headline “Iraq warwas illegal,” Blix said, “I don’t buy the argument the warwas legalized by the Iraqi violation of earlier resolutions.”According to Blix, an international lawyer and formerhead of the International Atomic Energy Agency (IAEA),the “ownership” of the UN resolutions pertaining to Iraqrested with the entire 15-member Security Council, andnot with individual states.

“The Security Council could have authorized it, but Ido not think it was right for individual members to doso,” said Blix.

Security Council Resolution 1441, passed inNovember 2002, required the regime of Saddam Husseinto comply with UN weapons inspectors but made clearthat no further action could be taken without theapproval of the UN. Iraq had complied with UN weaponsinspectors prior to being invaded by U.S. and Britishforces.

Before the Anglo-American invasion of Iraq lastMarch, Blix and Mohamed El Baradei, head of the IAEA,said that in four months of searching, they had found noevidence of any weapons of mass destruction or pro-grams to build them. Blix and El Baradei told the SecurityCouncil that more time was needed to make a definitiveconclusion.

The British government knew that a second resolutionwas necessary to justify the planned invasion. A memofrom Britain’s Foreign Office to the Foreign Affairs SelectCommittee on March 17, 2003, “made clear that therewas no ‘automaticity’ in Resolution 1441 to justify war.”

In Blix’s recently published book, Disarming Iraq: TheSearch for Weapons of Mass Destruction, Blix describeshow on March 6, 2003, the day before his final report tothe Security Council, U.S. Assistant Secretary of StateJohn Wolf “tossed photographs of a drone and a clusterbomb on my table” and “in a rather discourteous tone”asked why Blix did not conclude that the photographswere evidence that Iraq was in violation of Security

Council resolutions.Blix told the press that he suspected that his UN office

and home in New York had been bugged. The photo-graphs that Wolf had were obtained through an intelli-gence agency, he said.

“He should not have had them,” Blix said. “I askedhim how he got them, and he would not tell me, and Isaid I resented that.

“It could have been some staff belonging to us thathanded them to the Americans. I don’t think it is verylikely, but it could have happened,” Blix said. “It couldalso be that they managed to break into the secure faxand got it that way.”

Both the drone and the cluster bomb had been exam-ined by UN inspectors and determined to be inconclusiveor “scrap from the past,” Blix wrote.

Jafar Dhia Jafar, the “father of Iraq’s nuclear program,”spoke publicly for the first time about Iraqi weapons pro-grams on March 8 in Beirut. Jafar said UN inspectors had“reached total conviction” that Iraq was free of nuclearweapons. Pressure from the U.S. government, however,prevented Blix from being more forthright with theSecurity Council, Jafar said.

“Reports of the United Nations [inspectors] to the Se-curity Council should have been clear and courageous,”the Iraqi scientist said.

Jafar presented a paper co-written with Noman SaadEddin al-Noaimi, the former director-general of Iraq’snuclear program, at a three-day conference on the reper-cussions of the invasion of Iraq organized by the Beirut-based Center for Arab Unity Studies.

“Saddam Hussein issued orders in July 1991 for thedestruction of all banned weapons, in addition to the sys-tems to produce them. It was carried out by the SpecialRepublican Guard forces,” the Iraqi scientists wrote.

“We can confirm with absolute certainty that Iraq nolonger possessed any weapons of mass destruction afterits unilateral destruction of all its components in thesummer of 1991, and did not resume any such activitybecause it no longer had the foundations to resume suchactivity,” they wrote. ★

W henever American consumers shop at thelocal Wal-Mart they may think they are get-ting the best bargains around, but thosecheap prices come at a cost to the U.S. econ-

omy and American workers.Wal-Mart is no longer the company that Sam Walton

built with his “Made in America” pledge to his customers. Today, in order to comply with truth in advertising,

the mega-company should advertise its wares as “Made inChina.” In fact, if Wal-Mart were a country it would rankas China’s fifth largest trading market—ahead of evenGermany and Britain.

Wal-Mart is America’s biggest retailer, with annualsales of more than $245 billion.

When American consumers shop in a Wal-Mart store,however, they should keep this in mind: of a total of6,000 factories supplying goods to stock the shelves ofWal-Mart stores about 80 percent are located in China.

Here, according to Andrew Tsuei, managing director ofWal-Mart’s global procurement center in Shenzhen,China, is a clear picture of what China means to the giantretail chain: “There might be places in the world whereyou can buy cheaper, but can you get [the products] onthe ship?”

The Chinese state-owned shipping firm, COSCO,ships much of the country’s trade goods in its ships.

“If we have to look at a country that’s not politicallystable, you might not get your order on time. If you dealin a country where the currency fluctuates, every day thereis a lot of risk. China happens to have the right mix,” saidTsuei.

China, because of Wal-Mart and other globalist firms

eager to do business with it, regardless of its human rightsrecord and the fact it is putting U.S. workers out of jobs,currently enjoys a trade surplus over the U.S. of about$125 billion a year.

It is a state that is wrecking the American economy bymanipulating its currency, exploiting its workers to theedges of human endurance and competing unfairly,including stealing the design of American products with-out any thought of violation of international patent laws.

Wal-Mart’s Asia operations are coordinated out of awhite-tiled building in Shenzhen, where, according tonews reports out of China, the company manages itsdealing with such frugality that the conference tables arelinoleum covered, and the covering is so worn that theplywood of the tabletops shows through.

In addition to its Chinese links, Wal-Mart is currentlyunder investigation by federal authorities on two fronts.

The giant chain is being investigated for taking out

high-dollar life insurance policies on their employees andmaking the company the beneficiary in the event theemployee dies.

Several months ago, Wal-Mart stores across the U.S.were raided by U.S. immigration officials, who took intocustody hundreds of illegal aliens that the always-frugalcompany was using to do janitorial tasks.

The employees were, at their arraignments, ordered bythe courts to reappear for further proceedings and weresubsequently released.

Most, one source told American Free Press, never reap-peared as ordered and simply disappeared. Is anyone sur-prised?

Wal-Mart was just named one of the “100 best placesto work for Latinos” by Hispanic Magazine.

The “Made in America” days of the late Sam Waltonare obviously over and have been replaced by somethingthat is anything but American, although millions ofAmericans, as evidenced by Wal-Mart’s annual salesreports, apparently love it.

The reason is its low prices, attracting a new class ofAmericans who have lost their high-paying jobs and arenow forced to look for cheaper goods, or, as it is said,“What goes around comes around.”

Wal-Mart, obviously, knows that only too well. ★

o man thinks more highly than I do of thepatriotism, as well as abilities, of the veryworthy gentlemen who have just addressedthe House. But different men often see thesame subject in different lights; and, there-

fore, I hope it will not be thought disrespectful to thosegentlemen if, entertaining as I do opinions of a charactervery opposite to theirs, I shall speak forth my sentimentsfreely and without reserve. This is no time for ceremony.The question before the House is one of awful momentto this country. For my own part, I consider it as nothingless than a question of freedom or slavery; and in pro-portion to the magnitude of the subject ought to be thefreedom of the debate. It is only in this way that we canhope to arrive at truth, and fulfill the great responsibilitywhich we hold to God and our country. Should I keepback my opinions at such a time, through fear of givingoffense, I should consider myself as guilty of treason

toward my country and of an act of disloyalty toward theMajesty of Heaven, which I revere above all earthly kings.

I have but one lamp by which my feet are guided, andthat is the lamp of experience. I know of no way of judg-ing of the future but by the past. And judging by the past,I wish to know what there has been in the conduct of theBritish ministry for the last 10 years to justify those hopeswith which gentlemen have been pleased to solace them-selves and the House. Is it that insidious smile with whichour petition has been lately received? Trust it not, sir; itwill provide a snare to your feet. Suffer not yourselves tobe betrayed with a kiss. Ask yourselves how this graciousreception of our petition comports with those warlikepreparations which cover our waters and darken ourland. Are fleets and armies necessary to a work of loveand reconciliation? Have we shown ourselves so unwill-ing to be reconciled that force must be called in to winback our love? Let us not deceive ourselves, sir. These arethe implements of war and subjugation—the last argu-ments to which kings resort.

They tell us, sir, that we are weak—unable to cope withso formidable an adversary. But when shall we bestronger? Will it be the next week, or the next year? Will itbe when we are totally disarmed, and when a Britishguard shall be stationed in every house? Shall we gatherstrength by irresolution and inaction? Shall we acquirethe means of effectual resistance by lying supinely on ourbacks and hugging the delusive phantom of hope, untilour enemies shall have bound us hand and foot? Sir, we

are not weak if we make a proper use of those meanswhich the God of nature hath placed in our power. Themillions of people, armed in the holy cause of liberty, andin such a country as that which we possess, are invincibleby any form which our enemy can send against us. It is invain, sir, to extenuate the matter. Gentlemen may cry,peace, peace—but there is no peace. The war is actuallybegun! The next gale that sweeps from the north willbring to our ears the clash of resounding arms! Ourbrethren are already in the field! Why stand we here idle?What is it that gentlemen wish? T he Kafkaesque indictment, trial and conviction ofMartha Stewart is a devastating blow both to theU.S. legal system and to belief in the Americansocio-economic system.

Today hapless defendants are convicted not only in theabsence of criminal intent but also in the absence of statu-tory felonies.

Stewart was indicted for lying and obstructing justice.For these offenses to have any meaning, there must be acrime that she lied about and obstructed. The prosecutorspresented no such crime. Stewart was indicted and con-victed for lying and obstructing a crime when no crimehappened.

Many Americans believe that Stewart committed “insid-er trading,” because that is the disinformation her prosecu-tors used their media pimps to disseminate. The prosecu-tors would have liked to have charged Stewart with insidertrading, but could not. Stewart learned from her broker,not from a company insider, that a top executive was sell-ing shares.

Since time immemorial, many people have sold sharesfor the same reason. Brokers call and report that a stock isbeing sold when the overall market is not. That is an indi-cation that there is bad news in the market about thatstock. It is a broker’s job to advise when to hold and whento fold.

Whenever a company announces good or bad news,SEC regulators and prosecutors look to see who sold orbought stock in the period immediately preceding thenews. If they find company executives, or anyone whomthey can connect to company executives, buying or sellingprior to news, they bring a case of insider trading.

Insider trading is a creation of regulatory bureaucrats,not of statutory law. It is an undefined crime. Bureaucratshave refused to define the crime on the grounds that it is

easier to convict people of undefined crimes. Many legalscholars maintain that there is no rational reason for mak-ing insider trading into an offense.

Prosecutors knew that Stewart was friends with Im-Clone’s president and jumped to the conclusion that shewas tipped off by him. When it became clear that Stewarthad the information from her broker, the prosecutors werereluctant to let go of their celebrity target, whose demisewould boost their careers. The prosecutors decided to makea crime out of a non-crime.

Stewart recognized that they were after her with anundefined crime. Like most people in such a situation,Stewart gave them a story that they would have a hard timetwisting into insider trading.

This is the basis for her indictment for lying and ob-structing justice.

The Stewart case reminds me of the Ben Lacy case dur-ing the 1990s. Lacy was an apple juice producer who madea few mistakes filling out environmental forms over thecourse of several years. Federal prosecutors chose to inter-pret the few mistakes as comprising a conspiracy to hidethe pollution of a stream behind his plant. As the streamtested pristine, the prosecutors did not accuse him of pol-luting the stream.

If they had accused him of polluting, evidence of thelack of pollution would have collapsed their case. By accus-ing him of conspiracy, they were able to keep out of courtevidence that the stream was not polluted.

Eventually, the prosecutors had to let go of Lacy, butonly after they had ruined him financially.

The Stewart jurors should have realized that the casewas bogus when the judge threw out the main charge—that she had committed fraud by declaring her innocence.A prosecutor who would bring such a ridiculous chargeobviously had no case whatsoever.

It appears the jury convicted Steward largely on thebasis that she was white and successful. In their publicstatements, it is apparent that some of the jurors have theimpression that Stewart is part of the corporate fraud thatis believed to have caused widespread losses to sharehold-ers who are “little people.”

By failing to recognize the political persecution in frontof their noses, the Stewart jury demonstrated the extremerisks of a jury trial. The prosecutors only wanted a symbol-ic scalp and had offered Stewart a plea bargain deal—a pro-bation sentence in exchange for a plea that she made a falsestatement. Stewart, who has naively declared her belief inthe integrity of the justice system, went to trial, instead.

Stewart’s conviction has made it even less likely that aninnocent defendant will place trust in a jury. Already 95percent of felony cases are settled with a coerced plea bar-gain, because judges and juries routinely fail in their func-tion of protecting defendants from prosecutorial abuse.Time after time, innocent defendants are convicted on fab-ricated evidence, while exculpatory evidence is withheld.Based on the new DNA evidence, a large percentage of con-victed murderers and rapists have been found innocent.

Stewart’s conviction is a defeat for justice and the Ameri-can way. Prosecutors have undermined the socio-econom-ic system by sending the Marxist message that Americansbecome successful and rich by evading the rules and engag-ing in criminal behavior.

Some message for a conservative Republican adminis-tration to send. ★

America’s most precious asset is her sover-eignty. A strong, independent and freeUnited States is a country that is self-suffi-cient and not beholden to any cabal or

group for its existence. Its sovereignty is natural andreal and not some pipe dream.

Today, American military might encircles theglobe. For this action there is also some excuse—themost often used is to protect our national security—to invade or protect a foreign nation from the ene-mies of democracy and to ensure that democracybecomes deeply rooted in that country. Iraq is ashocking case in point.

The driving force behind U.S. foreign policy is thedependency upon oil. When we think of Iraq wethink of oil present and potential. The oil of Kuwaitwas a factor in the first gulf war. American forces hadto do whatever they could to keep it from fallinginto “enemy hands.”

President George W. Bush and Vice PresidentDick Cheney represent big oil interests. And the oilindustry contributes generously to the campaigns ofthose members of Congress who support withoutreservation a foreign policy, no matter how reckless,that protects the oil industry.

A strong and necessary partner in this scenario isbig banking. Not the little “banker” who works nearyou in your town, but the internationalist powerbankers who float the money for oil exploration andproduction.

The consumers, taxpayers and voters of Americamight think they have a say in the price of oil. Inreality, they are helpless to do anything about itexcept to buy it at exorbitant prices. The media, con-trolled by many of these oil interests, keep beatingthe drums for more oil exploration and a resultinggreater dependency on, and consumption of, oil. Thepeople have become cynical and go along with the bel-ligerent policy of the government when it comes to oil.

Meanwhile, President Hugo Chavez of oil-richVenezuela, a major supplier of oil for the United States,has threatened to cut off oil exports to the United States.Chavez told a cheering crowd of thousands of supporters:“Mr. Bush must know that if he gets the bad idea of try-ing to blockade Venezuela, or, even worse, of invadingVenezuela, if that happened, the people of the UnitedStates should know that not a drop of oil would reach

them from Venezuela, not a drop more.”Venezuela supplies approximately 15 percent of

America’s oil imports. In December 2003, for example,Venezuela shipped 1.32 million barrels of oil daily to theUnited States, making it the fourth-largest supplier(behind Mexico, Canada and Saudi Arabia). If Venezuelawere to turn off the pump, it would surely spell troublefor the United States.

Apparently, there will be no U.S. leaders springingfrom among our elected officials who are willing to breakthe oil monopoly any time soon. Nor will any of the

members of the plutocratic banking and oil elitists breakranks and work for the people.

What is needed and will work is a revolt from the bot-tom up, originating with the people themselves. Were thecost of producing oil and gasoline to rise to a point morethan the selling price, their game would be up.

It will be good-bye to the oil barons, good-bye to theirtoadying lackeys in Washington. When the oil monopo-lists no longer have a winning hand, their power over ourlives will collapse. Our troops will no longer be needed tofight for continued oil conquests. America will be trulyfree as the Founding Fathers intended it to be.

As for the revolt of the people, here are more details:To free themselves from the oil monopolists, the peo-

ple will turn to the land for help. They will turn to themanufacture and use of ethanol, which is made fromcrops grown in American soil. The mass production ofethanol would mean hundreds of thousands of jobs forAmericans. It would raise farm income and could virtual-ly eliminate farm subsidies.

Regarding the article “Vets Better HealthCare?” in the March 15 issue, our govern-ment has been nothing but professional liarssince the early 1930s, so just who are we tobelieve?

There are strings attached to every thing,not to mention the lies and distortions,which further compromise vet care. There isthe question of the availability of accessingcostly private medical insurance programsjust in case the “new” program falls flat onits face. Once again, vets will get the shortend of the stick.

Indiana is losing two of its popular hos-pitals very soon, converting them to clinicswhile farming major cases out to local hos-pitals. And, while transportation costs arenow so badly inflated, the VA only reimburs-es us vets a measly 12 cents a mile. It gener-ally costs many of us 75 cents a mile.

The VA cares little if we can make anappointment. If we cannot make one, we aresupposed to call them for a cancellation.However, many of us veterans can barelyafford a phone. Others are unable to walk toa pay phone three blocks away.

If only the warmongers, socialists andgreedy nerds of Washington were to stay outof costly conflicts, injury and deaths would

be minimal. Then and only then will themedical responsibilities lessen. The decreaseof medical facilities might then be feasible.

U.S. CONSTITUTION AT RISKI am a conservative Catholic and am also

politically conservative. I believe homosexualactivity is immoral. However, PresidentBush’s decision to promote a Constitutionalamendment banning gay marriage seems to

me both absurd and dangerous. For thepresident to assert that gay marriage puts theinstitution of marriage at risk is a seriousobjective error.

There are very few homosexuals in thiscountry, perhaps 2 percent, and they obvi-ously do not produce offspring. So how onEarth can homosexuals be a threat to aninstitution treasured by the overwhelminglyheterosexual majority, which has all thepower?

If there is any truly significant danger tomarriage and the family in this countrytoday it is from heterosexual activity in theform of adultery and other extramaritalforms of sex, divorce, abortion and birthcontrol.
