Executive Summary
Bid proposals for the following:
SCADA Software and Integration Services.
Discussion
This proposal is for the purchase of SCADA Software and Integration Services for City of West Plains Electric, Water,
and Sewer systems. During this year Council approved budget for a SCADA system in Public Works. This SCADA
system will replace the two current systems that are in operation.
Currently the Water SCADA is running on Windows 7 and has been unable to receive updates for the past two years. If
this system does fail, we will lose years’ worth of data and control of the water treatment plant, water towers, and booster
stations within the system.
The Electric Department, approximately four years ago, migrated to Wonderware SCADA. However, for two years now
the system has not operated correctly, and we have had difficulties in customer service with the implementor and the
software company.
Sewer currently has an antiquated phone system and an audible alarm system but no SCADA system in operation. We are
completely reliant on a phone message that sometimes works and or neighbors of the lift stations from the audible alarms.
Since staff is seeing significant upgrades to the three systems in the coming years the recommendation to proceed with a
new SCADA that could monitor all three systems and not to have separate vendors running each utility SCADA was
made. During this research an RFQ and RFP processes were used in conjunction with Toth and Associates. Attached is
their recommendation and the proposal.
Fiscal Impact
The total SCADA project was budgeted at $425,000 and is split between all three utilities in the Capital Outlay Budget.
The software and integration services are proposed at this time at a total of $155,750.00. $28,800 of this cost is a support
package for the next four years bringing the cost to $126,950 for the total first year proposal plus integration. This section
of the project was budgeted to be $144,000.

Dear Jeff,
Proposals were received and opened at the Engineer's office on Thursday, September 9, 2021, for the equipment referenced above. The results of the bid opening are summarized on the enclosed Bid Summary.
Proposals were evaluated based on the follow ing criteria: price, customer reference testimony, simplicity of implementation, and number of users within the local region. Proposal cost was evaluated for initial implementation (1-year cost) and projected mid-term maintenance (S-year cost ).
Based on these criteria, we recommend that the City of West Plains purchase the SCADA Software, Integration Services, and Five (5) years of Gold Level Software Support from Open Systems International, Inc. {OSI), with a 5-year cost of $155,750.00. A copy of that proposal is also enclosed for your reference.
The estimated cost budgeted for th is portion of the overal l SCADA project scope was approximately $144,000.00. This budget was developed based on t he first-year installation cost of the SCADA platform. The recommended purchase price exceeds t his budget amount because it includes an additional four (4) years of the Gold Support Package, totaling $28,800.

Vendor proposes to furnish software as specified below and in accordance with the terms and
conditions established in this Proposal, $CADA Specifications, and OMS Specifications herein.
The proposed price for the equipment is as follows:

provide references within the states of Arkansas, Oklahoma, and Kansas, lfflve
references are not available within these states, Vendor may provide references within
the rest of the United States.
g. List of clarifications and/or exceptions to the specifications.
2. Prices quoted herein are firm provided the Owner accepts the proposal within sixty (60) days from
the date of the Proposal.
3. Prices listed do not include any amount for taxes that may be imposed by any taxing authority for
the sale, use or purchase of the equipment. If any such tax amount is applicable, the amount shall
be added to the purchase prices and will be paid by the Owner.

4. Certificate o·f Compliance with 34.600 RSMo. (Anti-Discrimination Against Israel Act). Pursuant to
Missouri Revised Statute Sections 34.600 et., seq., a Vendor must provide a written certification of
compliance with the Anti-Discrimination Against Israel Act, RSMo. 34.600 et. seq., that the
contractor is not currently engaged in and shall not, for the duration of the contract, engage in a
boycott of goods or services from the State of Israel; companies doing business in or with Israel or
authorized by, licensed by, or organized under the laws of the State of Israel; or persons or entities
doing business in the State of Israel. This section shall not apply to contracts with a total potential
value of less than one hundred thousand dollars or to vendors with fewer than ten employees.
5. Prevailing Wage: IF TOTAL BID IS $75,000.00 OR MORE, THEN STATE PREVAILING WAGE APPLIES TO
THIS PROJECT. The successful bidder will pay prevailing wages as determined by the Division of
Labor Standards. Wage Order No, 28 is included in packet along with Affidavit of Compliance with
the Prevailing Wage Law, and it is to be submitted once project is complete.
6. Obligation of Bidder: At the time of the opening of bids, each bidder will be presumed to have
inspected the site and to have read and to be thoroughly familiar with the plans and contract
documents (including all addenda). The failure or omission of any bidder to examine any form,
instrument or document shall in no way relieve any bidder from any obligation in respect or his bid.
a. Bidders are informed that pursuant to Section 285.530, RS Mo, as a condition of the
award of any contract in excess of five thousand dollars ($5000), the successful bidder
shall, by sworn affidavit and provision of documentation, affirm its enrollment and
participation if a federal work authorization program with respect to the employees
working in connection to the contracted services. Successful bidders shall also sign an
affidavit affirming that it does not knowingly employ any person who is an unauthorized
alien in connection to the contracted services.
7. Safety Standards and Accident Prevention: With respect to all work performed under this contract,
the Vendor shall:
a. Comply with the safety standards provisions of applicable laws, building and
construction codes, and the "Manual of Accident Prevention in Construction" published
by the Associated Contractors of America, the requirements of the Occupational Safety
and Health Act of 1970 (Public Law 91-596), and the requirements of Title 29 of the
Code of Federal Regulations, Section 1518 as published in the "Federal Register",
Volume 36, No. 75, Saturday, April 17, 1971.
b. Exercise every precaution at all times for the prevention of accidents and the protection
of persons (including employees) and property.
c. Maintain at his office or other well-known place at the job site, all articles necessary for
giving first aid to the injured, and shall make arrangements for the immediate removal
to a hospital or a doctor's care of persons (including employees), who may be injured on
the job site. In no case shall employees be permitted to work at a job site before the

employer has made a standing arrangement for removal of injured persons to a hospital
or a doctor's care.
d. Bidders are informed that the project is subject to the requirements of Section 292.675,
RS Mo, which requires all contractors or subcontractors doing work on the project to
provide, and require Its on-site employees to complete, a ten (10) hour course in
construction safety and health approved by the Occupational Safety and Health
Administration ("OSHA") or a similar program approved by the Missouri Department of
Labor and Industrial Relations which Is at least as stringent as an approved OSHA
program. On-site employees found on the worksite without documentation of the
required training shall have twenty (20) days to produce such documentation.
a. A bid guarantee from each bidder equivalent to ten percent of the bid price. The bid
guarantee shall consist of a firm commitment such as a bid bond (RUS Form 307),
certified check, or other negotiable Instrument accompanying a bid as assurance that
the bidder will, upon acceptance of his bid, execute such contractual documents as may
be required within the time specified,
b. A performance bond (RUS Form 168b) on the part of the vendor for 100 percent of the
contract price. A performance bond is one executed in connection with a contract to
secure fulfillment of all the vendor's obligations under such contract.
c. A payment bond (RUS Form 168b)on the part of the vendor for 100 percent of the
contract price. A payment bond Is one executed in connection with a contract to assure
payment as required by law of all persons supplying labor and material in the execution
of the work provided for in the contract.
9. Insurance
a. The Vendor shall purchase and maintain such insurance as will protect it from claims set
forth below which may arise out of, or result from, the Vendor's execution of the work,
whether such execution be by the Vendor, or by anyone directly or indirectly emplbyed
by any of them, or by anyone for whose acts any of them may be liable:
i. Claims under workmen's compensation, disability benefit and other similar
employee benefit acts.
ii. Claims for damages because of bodily Injury, occupational sickness or disease,
or death of employee.
iii. Claims for damages because of bodily injury, sickness or disease, or death of any
person other than employees.

iv. Claims for damages Insured by usual personal injury liability coverage which are
sustained (1) by any person as a result of an offense directly or indirectly related
to the employment of such person by the Vendor, or (2) by any other person
and;
v. Claims for damages because of injury to or destruction of tangible property,
including loss of use resulting therefrom.
b. Certificates of Insurance and Endorsement acceptable to the Owner shall be flied with
the Owner prior to commencement of the work. Owner shall be listed as additional
insured on Certificate of Insurance as well as Endorsement showing owner is additional
insured. These Certificates and Endorsements shall contain a provision that coverages
afforded under the policies will not be cancelled unless at least fifteen (15) days prior
written notice has been given to the Owner. Minimum requirements are as follows:

The Vendor shall within fifteen (15) days after the receipt of the Notice of Award furnish the Owner
with a Performance Bond and Payment Bond in an amount at least equal to one hundred percent
(100%) of the contract price, conditioned upon the performance by the Vendor all undertakings,
covenants, terms, conditions and agreements of the contract documents, and upon the prompt
payment by the Vendor to all persons supplying labor and materials In the prosecution of the work
provided by the contract documents. Such bonds shall be executed by the Vendor and a corporate
bonding company licensed to transact such business In the state In which the work Is to be
performed. The expense of these bonds shall be borne by the Vendor. If at any time a surety on
any such bond is declared a bankrupt or loses its right to do business the state in which the work is
to be. Vendor shall within ten (10) days after notice from the Owner to do so, substitute an
acceptable bond (or bonds) In such form and sum and signed by such other surety or sureties as may
be satisfactory to the Owner. The premiums on such bond shall be paid by the Vendor. No further
payment shall be deemed due nor shall be made until the new surety or sureties shall have
furnished an acceptable bond to the Owner.
11. Business License
Vendor shall obtain a City business license. Business License fee is $30.00 per year (July 1st to June
30th). Business License Application is included for your convenience.

12. Protection of lives and health
The Vendor shall exercise proper precaution at all times for the protection of persons and property
and shall be responsible for all damages to persons or property, either on or off the site, which occur
as a result of his prosecution of the work. The safety provisions of applicable laws and building and
construction codes, in addition to specific safety and health regulations described by Chapter XIII,
Bureau of Labor Standards, Department of Labor, Part 1518, Safety and Health Regulations for
Construction, as outlined In the Federal Register, Volume 36, No. 75, Saturday, April 17, 1971. Title
29 - LABOR, shall be observed and the Vendor shall take or cause to be taken, such additional safety
and health measures as the Contracting Authority may determine to be reasonably necessary.
a. Safety Training
I. Vendor shall provide a ten (10) hour Occupational Safety and Health
Administration (OSHA) construction safety program for all employees who will
be on-site at the Project. The construction safety program shall include a course
in construction safety and health that is approved by OSHA or a similar program
approved by the Missouri Department of Labor and Industrial Relations which is
at least as stringent as an approved OSHA program as required by Section
292.675, RSMo.
13. Authorize_d Employees
Vendor acknowledges that Section285.530, RSMo, prohibits any business entity or employer from
knowingly employing, hiring for employment, or continuing to employ an unauthorized alien to
perform work within the state of Missouri. Vendor therefore covenants that it is not knowingly in
violation of subsection 1 of Section 285.530, RS Mo, and that it will not knowingly employ, hire for
employment, or continue to employ any unauthorized aliens to perform work on the Project, and
that its employees are lawfully to work in the United States.

14. The Owner and its Engineer hereby requests permission to copy and to make unrestrict ed use of any
Vendor-provided documentation, including drawings, associated with this equipment for purposes
of interfacing with its own structures and/or equ ipment. Such permission includes the right to
incorporate such documentation into the documentation of the project or facility in which the
equipment and material are used and to register documentation of t he project or facility with the
Register of Copyright. The Vendor may take exception to this requ irement in an effort to maintain
sensitive data or trade secrets, but only by written notification to the Owner for specific documents.
Documents that contain sensitive information or trade secrets shall be clearly stamped or
watermarked to indicate their restriction to the Owner. Your submission of a quotation will
constitute:
(1) your consent to this request;
(2) and your representation that you have the authority to grant such permission w ith
respect to any Vendor or manufacturer supplied documentation.
15. The Owner retains the right to accept or reject any part or al l of this Proposa l. Vendor by signing
below recognizes this right of the Owner.

6. Obligation of Bidder: At the time of the opening of bids, each bidder will be presumed to have
inspected the site and to have read and to be thoroughly familiar with the plans and contract
documents (including all addenda). The failure or omission of any bidder to examine any form,
instrument or document shall in no way relieve any bidder from any obligation in respect or his
bid.
a) Bidders are informed that pursuant to Section 285.530, RSMo, as a condition of the award
of any contract in excess of five thousand dollars ($5000), the successful bidder shall, by
sworn affidavit and provision of documentation, affirm its enrollment and participation if a
federal work authorization program with respect to t he employees working in connect ion
to the contracted services. Successful bidders shall also sign an affidavit affirming that it
does not knowingly employ any person who is an unauthorizedalien in connection to the
contracted services.

7. Safety Standards and Accident Prevention: With respect to all work performed under this
contract,the Vendor shall:
a) Comply with the safety standards provisions of applicable laws, building and construction
codes, and the "Manual of Accident Prevention in Construction" published by the
Associated Contractors of America, the requirements of the Occupational Safety and
Health Act of 1970 (Public Law 91-596), and the requ irements of Title 29 of the Code of
Federal Regulations, Section 1518 as published in the "Federal Register", Volume 36, No.
75, Saturday, Apri l 17, 1971.
b) Exercise every precaution at all times for t he prevention of accidents and the protection of
persons (including employees) and property.
c) Maintain at his office or other well-known place at the job site, all articles necessary for
giving first aid to the injured, and shall make arrangements for the immediate removal to a
hospital or a doctor's care of persons (including employees), who may be injured onthe job
site. In no case shall employees be permitted to work at a job site before the employer has
made a standing arrangement for remova l of injured persons to a hosp italor a doctor's
care.
d) Bidders are informed that the project is subject to the requirements of Section 292.675,
RSMo, which requires all contractors or subcontractors doing work on the project to
provide, and require its on - site employees to complete, a ten (10) hour course in
construction safety and hea lth approved by the Occupational Safety and Health
Administration ( "OSHA" ) or a similar program approved by the Missouri Department of
Labor and Industrial Relations which is at least as stringent as an approved OSHA program.
On - site employees found on the worksite without documentation of the requ ired training
shall have twenty (20) days to produce such documentation.

8. Bonding
a. A bid guarantee from each bidder equivalent to ten percent of the bid price. The
bid guarantee shall consist of a firm commitment such as a bid bond (RUS Form
307), certified check, or other negotiable instrument accompanying a bid as
assurance that the bidder will, upon acceptance of his bid, execute such
contractual documents as maybe required within the time specified. Please refer
Volume 2 Appendix A.
b. A performance bond (RUS Form 168b) on the part of the vendor for 100 percent
of thecontract price. A performance bond is one executed in connection with a
contract to secure fulfillment of all the vendor's obligations under such contract.

c. A payment bond (RUS Form 168b) on the part of the vendor for 100 percent of the
contract price. A payment bond is one executed in connection with a contract to
assurepayment as required by law of all persons supplying labor and material in
the execution of the work provided for in the contract.
9. Insurance
a. The Vendor shall purchase and maintain such insurance as will protect it from
claims setforth below which may arise out of, or result from, the Vendor's
execution of the work, whether such execution be by the Vendor, or by anyone
directly or indirectly employed by any of them, or by anyone for whose acts any of
them may be liable:
i. Claims under workmen's compensation, disability benefit and other
simi laremployee benefit acts.
ii. Claims for damages because of bodily injury, occupational sickness or
disease,or death of employee.
iii. Claims for damages because of bodily injury, sickness or disease, or death
of any person other than employees.
iv. Claims for damages insured by usua l personal inju ry liability coverage
which are sustained (1) by any person as a result of an offense directly or
indirectly related to the employment of such person by the Vendor, or (2)
by any other person and;
v. Claims for damages because of injury to or destruction of tangible
property, including loss of use resulting therefrom.
b. Certificates of Insurance and Endorsement acceptable to the Owner shal l be filed
with the Owner prior to commencement of the work. Owner shall be listed as
additional insured on Certificate of Insurance as we ll as Endorsement showing
owner is additional insured. These Certificates and Endorsements shall conta in a
provision that coverages afforded under the policies w ill not be cancelled unless at
least fifteen (15) days prior written notice has been given to the Owner. Minimum
requirements are as follows:

10. Contract Security

The Vendor shall within fifteen (15) days after the receipt of the Notice of Award furnish the
Owner with a Performance Bond and Payment Bond in an amount at least equal to one
hundred percent (100%) of the contract price, conditioned upon the performance by the
Vendor all undertakings, covenants, terms, conditions and agreements of the contract
documents, and upon the prompt payment by the Vendor to all persons supplying labor and
materials in the prosecution of the work provided by the contract documents. Such bonds
shall be executed by the Vendor and a corporate bonding company licensed to transact such
business in the state in which the work is to be performed. The expense of these bonds sha ll
be borne by the Vendor. If at any time a surety on any such bond is declared a bankrupt or
loses its right to do business the state in which the work is to be. Vendor sha ll within ten {10)
days after notice from the Owner to do so, substitute an acceptable bond (or bonds) in such
form and sum and signed by such other surety or sureties as maybe satisfactory to the Owner.
The premiums on such bond shall be paid by the Vendor. No further payment shall be deemed
due nor shall be made until the new surety or sureties shall have furnished an acceptable bond
to the Owner.
11. Business License
Vendor shall obtain a City business license. Business License fee is $30.00 per year (July 1st to June
30th). Business License Application is included for you r convenience.

12. Protection of lives and health
The Vendor shall exercise proper precaution at all times for the protection of persons and
property and shall be responsible for all damages to persons or property, either on or off the
site, which occuras a result of his prosecution of the work. The safety provisions of applicable
laws and building and construction codes, in addition to specific safety and health regulations
described by Chapter XIII, Bureau of Labor Standards, Department of Labor, Part 1518, Safety
and Health Regulations for Construction, as outlined in the Federal Register, Volume 36, No.
75, Saturday, April 17, 1971. Title 29 - LABOR, shall be observed and the Vendor shall take or
cause to be taken, such additional safety and health measures as the Contracting Authority
may determine to be reasonably necessa ry.
a. Safety Training
i. Vendor shall provide a ten (10) hour Occupational Safety and Health
Administration (OSHA) construction safety program for all employees
who will be on-site at the Project. The construction safety program shall

13. Authorized Employees
Vendor acknowledges that Section285.530, RSMo, prohibits any business entity or
employer fromknowingly employing, hiring for employment, or continuing to employ an
unauthorized alien t o perform work within the state of Missouri. Vendor therefore
covenants that it is not knowingly inviolation of subsection 1 of Sect ion 285.530, RS Mo, and
that it will not knowingly employ, hire for employment, or continue to employ any
unauthorized aliens to perform work on the Project, andthat its employees are lawfully to
work in the United States.
14. The Owner and its Engineer hereby requests permission to copy and to make unrestricted
use of anyVendor-provided documentation, including drawings, associated with this
equipment for purposes of interfacing w ith its own structu res and/or equipment. Such
permission includes the right to incorporate such documentation into the documentation of
the project or facility in which the equipment and material are used and to register
documentation of the project or facility with the Register of Copyright. The Vendor may take
exception to this requirement in an effort to maintain sensitive data or trade secrets, but
only by written notification to the Owner for specific documents.Documents that contain
sensitive information or trade secrets shall be clearly stamped or watermarked to indicate
their restriction to the Owner. Your submiss ion of a quotation will constitute:
(1) your consent t o this request
(2) and your representation that you have the authority to grant such
permission w ith respect to any Vendor or manufacturer supplied
documentation.
