In pursuanceof the power conferredupon it by the abovementionedAct, theCouncil of the abovementionedMunicipality herebyrecordshavingresolvedon28 August 1990, to make and submit for confirmation by the Governor thefollowing by-laws.
1. The By-laws of the City of Gosnellsrelating to the Establishment,Maintenance and Equipment of Bush Fire Brigades, publishedin the GovernmentGazetteof 9 December1949, is hereby revoked.
Definitions
2. "clerk" or "clerk of the council" meansa town clerk, or a shire clerk as thecaserequires.
"council" meansthe executivebody of a municipality.
"act" meansthe Bush Fires Act 1954.
"Bush Fine Brigade" means a Bush Fire Brigade for the time beingregisteredin a registerkept pursuantto section 41 of the act,
"brigade" meansthe Bush Fire Brigade.Establishmentof Brigade
3. a Council may by resolution organise, establish,maintain and equip abush fire brigade in accordancewith the provisions of the Bush FiresAct 1954, and Regulationsthereunder,andthebrigadeshall be formedin accordancewith these by-laws; and namedCity of Gosnells BushFire Brigade.
b The bush fine brigade shall be established for the whole of theMunicipality on for any specifiedarea thereof, but shall not duplicatethe role of the WesternAustralian Fire Brigade Board.
Appointment of Officers
4. The Bush Fire Brigade shall duly elect as determinedby the Constitution ofthe Brigade, a Captain, a First Lieutenant, a SecondLieutenant, Secretary,Treasurer,as officers of the brigadeand who, in the Council’s opinion havethenecessaryqualification and knowledgeof the District required in such capacities.
5. Upon appointment,the Brigade Captainshall be responsiblefor the custodyand maintenancein good order and condition of all equipmentand appliancesacquiredby the Council for the purpose of the brigade.

6. The Council retains the expressauthority to appoint, determineandrestrictthe powersof Bush Fire Control Officers. Such appointmentto be in accordancewith the requirementsof thedistrict and may prescribean areaoverwhich thebush fire control officer shall havejurisdiction.
Duties of Officers
7. The dutiesof all officers appointedundertheseby-laws shall be asstipulatedin the provisionsof the Bush Fines Act 1954 and eachofficer so appointedshallbe supplied with a copy of the Act and Regulations.The Captainshall havefullcontrol oven the membersof the brigade.Whilst engagedin fire suppressionthemost Senior Qualified Memberof the brigade presentat the fire shall exerciseall the powersand duties of a Bush Fire Control Officer.
Membershipof Brigade8. a The membershipof the bushfire brigade shall consistof-
i active fire fighting memberswho have passedthe appropriatemedical examinationand;
ii active members,who shall not participatein the fighting of firesbut who hold an appointedposition within the Brigade and forwhom a medical examination shall not be a prerequisite formembershipand;
iii associatemember,who shall not participatein the fighting of finesand for whom a medical examination shall not be a prerequisitefor membership.
b Fire fighting membersshall be thosepersons,being membersof eithersex and being eighteen 18 yearsof age and over who are willing torender service when possible at any bush fire and who sign anundertaking in the form contained in the First Schedule to theseby-laws.
c The enrolmentof personsas fine fighting membersshall in every casebe subject to the approval of the Council, or the clerk where suchdelegation is given by Policy determination.
d An annualjoining feemay be requiredupon endorsementof applicationof all membersand moneys raised will be incorporated into Brigadegeneralrevenue.This fee will be reviewedannually by the Brigadeatits Annual GeneralMeeting for-

By-laws relating to theestablishment,maintenanceandequipmentof BushFineBrigadesappearingin the GovernmentGazetteon 3 January1941 as amendedfor the Woodanilling RoadBoard are hereby revoked.
Establishment of Brigade
1. a By resolution,the Council may establish,maintain andequip a BushFire Brigade under the provisions of the Bush Fires Act 1954 andRegulationsthereunder,theBrigade shall beformedin accordancewiththeseby-laws; anda nameshall be givento theBrigade. Details of theBrigade and its officers shall be enteredin the registerof Bush FireBrigadesheld by the Council.
b A Bush Fire Brigade may be establishedfor the whole of the Shire orfor any specified areathereof.
Appointmentof Officers2. The Council shall appoint a captain, a first lieutenant,a secondlieutenantand such additional lieutenantsas it shall deemnecessaryto act as officers ofthe Brigade.
3. Membersof theBrigadeshall electa personto actasSecretaryto theBrigadeand shall inform the Council accordingly.4. The Council may appoint an equipmentofficer who shall be responsibleforthe custody and maintenancein good order andcondition of all equipmentandappliancesacquiredby the Council for the purposeof the brigade.Suchofficermay station such equipmentat a depot approvedby the captain.
Powers and Duties of Officers5. The powersand duties of all officers appointedundertheseby-laws shall beas laid down in the provisions of the Bush Fires Act 1954 and eachofficer soappointedshall be suppliedwith a copy of the Act andRegulations.
Membershipof Brigade6. 1 The membershipof a BushFire Brigade may consistof the following-
a subscribingmembers;andb fire fighting members;
2 Subscribingmembersshall be those persons,who being interestedinforwarding theobjects of thebrigade,pay an annualsubscriptionto thefunds of the Brigade at the following rates.i owner or occupier of land within the brigade area-minimum
subscription of $1.00.ii other persons-minimumsubscriptionof $1.00.
3 Fire fighting membersshall be thosepersons,beingablebodied personsover 15 yearswho are willing to renderserviceat any bushfire whencalled upon; andwho sign an undertakingin the form containedin theFirst Scheduleto these by-laws.
4 No fees or subscriptionsshall be payableby fire fighting membersandthe enrolment of persons as such members shall in every case besubject to the approvalof the Council.
5 A subscribingmembershall be eligible for enrolmentas a fire fightingmember.

In pursuanceof the powers conferredupon it by the abovementionedAct andof all other powersenablingit the Council of the abovementionedMunicipalityherebyrecordshaving resolvedon the 24thday of September1990 to makeandsubmit for confirmation by His Excellency the Governor,the following by-law.
PART 1-CITATION AND APPLICATION OF BY-LAWS AND REVOCATIONS1. CitationThis by-law may be cited as "Shire of Swan Parking By-Law" and shall comeinto operationupon publication in the GovernmentGazetteand shall apply andoperatewithin the part of the district referredto in the First Schedule.2. RepealThe following by-laws are herebyrevoked:
a the RemovalandDisposalof ObstructingAnimalsandVehiclesBy-Lawpublishedin the GovernmentGazetteon 8 November,1962;
b the By-Law Relatingto ParkingFacilitiespublishedin the GovernmentGazetteon 30 September,1977; and
c clause20 to 23 inclusive of the By-Law Relatingto StreetLawns andGardenspublishedin the GovernmentGazette on 7 August, 1981.
3. Interpretation3 1 In this by-law, unlessthe context otherwiserequires:
"Act" meansthe Local GovernmentAct, 1960;"animal" meansany animal other than a dog;
"Authorised Officer" meansin respectof any Part of this by-law the clerkor a ranger or other officer of the Shire of Swan authorisedby theCouncil to administerthat Part;
"AuthorisedPerson"meansthe clerk or an Authorised Officer, or any otherpersonappointedin writing by theclerk asan AuthorisedPersonunderthis by-law;
"built-up area"meansthe territory continuousto andincluding any road-a on which there is provision for lighting by meansof street
lamps; or
b which is built up with structuresdevotedto business,industryor dwelling housesat intervals of less than 100 metresfor adistanceof one half kilometre or more; or
c beyond a sign indicating "BUILT-UP AREA" erectedat theroadsideto facedriversapproachinga developmentconsistingof dwelling houses,or businessor industrial structures;
"bicycle" meansany two wheeledor threewheeledvehicle that is designedto be propelledsolely by humanpower;
"carriageway" meansevery part of* a street used or intended for use byvehiclesand includeskerbs;
"clerk" meansthe Shire Clerk for the time being of the Shire of Swan andincludes,in the absenceof the Shire Clerk, the Deputy or Acting ShireClerk of the Council;
"commercialvehicle" has the samemeaningas the term "Motor Wagon" inthe First Scheduleof the RoadTraffic Act, 1974;

"Council" meansthe council of the Shire of Swan;
"District" meansthe municipal district of the Shire of Swan;
"footpath" meansa path usedby, or set asideor intendedfor use by bothpedestriansand cyclists, but not vehiclesof any other kind;
"gardens" means any part of a street planted developed or treated,otherwisethan as a lawn, with any tree, plant or shrub;
"intersection" meansthe areacontainedwithin the prolongationor connection of the lateral boundariesof two streetsthat meetoneanotherat,or approximatelyat, right angles, or the areawithin which vehicles,travelling by, on or from different streetsthat meetat any otherangle,may comeinto conflict;
‘junction" meansthatpart of a streetcomprisedwithin imaginarystraightlines at right anglesto the abuttedstreetcommencingfrom the pointsof transectionof the street alignmentsof the street with the streetalignmentsof the land which abutsthereon. If the street alignmentsare curved at any corner then the point of transectionis the point atwhich those streetalignmentswould meetif straight;
"kerb" meansand includesthe constructedborder or edgeof the portion ofa road paved for the use of vehicular traffic where any constructedborder exists at the edgeof the pavedroadwhether any footpathhasbeen constructedor not;
"lawn" meansany partof a streetwhich is plantedonly with grassandwithany treeor shrub planedby the Council;
"member of the Police Force" means a member of the Police Force ofWesternAustralia;
"Minister" meansthe Minister for Local Government;
"Municipality" meansthe municipality of the Shire of Swan;
"No ParkingArea" meansa portion of a carriagewaythat lies-a betweentwo consecutivewhite signsinscribedwith the words,
"No Parking", in red lettering, and each with an arrowpointing generally towards the other of them; or
b betweena white sign, inscribedwith the words "No Parking",in red lettering, and a deadend or an areain which parkingis prohibited and that lies in the generaldirection indicatedby an arrow inscribedon the sign;
"No StandingArea" meansa portion of a carriageway-a betweentwo consecutivewhite signsinscribedwith the words,
"No Standing", in red lettering, and each with an arrowpointing generally towards the other of them; or
b betweena white sign inscribedwith the words, "No Standing",in red lettering, and a deadend or an areain which standingis prohibited and that lies in the generaldirection indicatedby an arrow inscribedon the sign;
"obstruct" meansto interfere with or impedeor hinder the passingof anyvehicle or personand "obstruction" hasa correspondingmeaning;
"omnibus" meansa motor vehicle equippedto carry more than eight 8adult passengers;
"owner" where used in relation to a vehicle has the meaninggiven to theterm in the RoadTraffic Act 1974 and whereused in relation to landhas the meaninggiven to the term in the Act;
"park" means to permit a vehicle, whether attended or not, to remainstationary,exceptfor the purposeof avoiding conflict with othertraffic,or complying with the provisionsof any law, or of immediatelytakingup or setting down personsor goods;
"parking area"meansa portion of a carriageway-a betweentwo consecutivewhite signs, inscribedwith the words
‘parking’ in green lettering, each with an arrow pointinggenerally towards the other of them; or
b extendingfrom a white sign inscribedwith the word "Parking"in green lettering in the general direction indicated by anarrow inscribedon the sign, to any other sign inscribed withthe words "No Parking" or "No Standing", in red lettering, orto a dead end or an areain which the parking or standingofvehiclesis prohibited andis that half of thecarriagewayof theroadnearestto the sign;

"parking facilities" includes land, buildings, shelters,meteredzones, metered spaces,signs, notices, and other facilities open to the public,generally,for the parking of vehicleswith or without charge;
"parking region" meansthe portion of the District constituteda parkingregion for the purpose of this by-law as referred to in the FirstSchedule.
"parking stall" meansa sectionor part of a streetor parking station whichis markedor definedby painted lines or by metallic studsor meanssimilar to those, for the purposeof indicating where a vehicle maystandor beparked,whetheron paymentof a fee or chargeor otherwise,but doesnot include a meteredspace;
"person" and words applying to any personor individual include a bodycorporateand in the plural a group of personsand a club, associationor other body of persons;
"property line" meansa lateral boundaryof the road reserveof a street;
"public place" includesa street,way andplacewhich the public are allowedto use whetherthe street,way or placeis or is not on privateproperty.It shall also include parklands,squares,reserves,beachesand otherlands set apart for the use and enjoyment of the inhabitantsof theDistrict and includesall lands vested in or under the care, control ormanagementof the Shire of Swan;
"reserve" meansa public reserveas defined in the Act;"sign" meansa traffic sign, mark, structureor deviceunderthe carecontrol
or managementof the Council placed or erectedon or near a streetorwithin a parking station or reservefor the purpose of prohibiting,regulating,guiding or directing the standingor parking of vehicles;
"specified place" meansa yard or other piece of land set aside or used bythe Council as a place to which obstructing trespassingor offendingvehicles may be removed;
"stand" in relation to a vehicle meansto stop a vehicle and permit it toremainstationary,exceptfor the purposeof avoiding conflict with othertraffic or of complying with the provisions of any law;
"street" includes-
a highway, anda thoroughfare;which-the public are allowed to use;
and includes every part of the highway or thoroughfare, and otherthings including bridges and culverts, appurtenantto it;
"street verge" meansevery part of a street other than the carriagewaythereof
"vehicle" includesevery conveyance,not being a train, boat, aircraft, orwheelchairand every object capableof being propelled or drawn onwheelsor tracks by any means.
3 2 Unless otherwisedefinedherein the terms and expressionsused in thisby-law shall have the meaningsgiven to them in the Act including, withoutlimiting the generality of the foregoing, s.231 of the Act, and if any term orexpressionsis not defined in the Act, it shall have the meaninggiven to it inthe RoadTraffic Act, 1974 the First Schedulethereofor the RoadTraffic Code1975. In the caseof any conflict, the definitions in the Act andin this by-lawshall prevail in that order.
3 3 In this by-law a referenceto the Council having the powerto do somethingin its discretion or a referenceto the Council forming an opinion prior to thedoing of anything shall be deemed to include a reference to any person,committee or body to whom the Council hasdelegatedthe power or the doingof the thing exercising such discretion or forming such opinion.
PART 2-ACTIVITIES ON STREETSAND PUBLIC PLACES
4. Street Verges4 1 A personshall not:
a standa vehicle or permit a vehicle to stand so that any part of thevehicle is on the verge of any part of a street, provided that theprohibition in this paragraphshall not applyto theoccupierof premiseson land adjacentto the relevantpart of the street vergeor to apersonauthorisedby the occupierof thosepremisesto standa vehicle on thatvergeunlessby a sign adjacentor referrableto that vergethe standingof vehicles on that vergeis prohibited. Nothing in this paragraphshallauthoriseany personto standany portion of a vehicle on or over afootpath;

b 1 park a commercial vehicle having a tare weight or load capacitythree3 tonnesor more or a caravan,omnibus or trailer designedadaptedor used for industrial or commercialpurposeson a streetvergefor more than four 4 hoursconsecutivelyor for more thanfour 4 hours in a day unless in between each period that thecommercialvehicle or caravan,omnibus or trailer is parked on thestreetverge it hasbeenremovedfrom the streetverge for at leasttwo 2 hours;
2 the prohibition in this paragraphshall only apply to vergeparkingwithin a built-up area;
3 the prohibition in this paragraphshall not apply to a builder orcontractor other than an owner-builder, parking a commercialvehicleor trailer on thestreet vergewherehe is currently engagedin building work on land abutting that streetverge.
c on a street verge, service or clean any vehicle;d exposea vehicle for saleon a street verge or carriageway;
e on a street vergerepair any vehicle other than the minimum repairsnecessaryto enablethe vehicle to be moved to a place other than thestreet;
f notwithstandingthegeneralityof paragrapha drive or standa vehicleor animal for any purpose on any lawn or garden in a street vergeunlesswith the consentof the owner or occupierof the land abuttingthat part of the streetverge. Such consentshall not authorisestandingof a vehicleon the streetvergeif the standingof vehicleson that vergeis prohibited by a sign adjacentor referrableto the verge;
g stand a vehicle or permit a vehicle to stand on a street verge orcarriagewayso that any portion of thevehicle is within 6 metresof theprojectionof thenearerproperty line of a secondstreetintersectingthefirst mentionedstreet on the side on which the vehicle is standing.
4 2 For the purposesof this clause, the verge of any part of a street inrelation to an occupierof premiseson land adjacentto that vergemeansthatpart of thestreet which lies betweena boundaryof thosepremisesandnearestedgeof the carriagewayof that street.5. Activities needingpermission5 1 A personshall not, without the permission of the Council in writingcommit any of the following acts:-
a leaveavehicleor anypart of a vehiclein a public placeso as to obstructany portion of that place;
b causeany obstructionto or preventvehiclesor personshaving the freeunhindereduseof any street, way or footpath;
c park a vehicle on a public reservefor the purpose of conducting abusiness.
5 2 A vehicle parked in any portion of a public place wherein that vehiclemay not lawfully be parked is deemedby that fact alone to be causing anobstruction.6. Discretion6 1 The Council may under this Part in its discretiongive or refuseto giveany permissionor give any permissionsubject to such conditions as it thinksfit.
6 2 Where permission has been granted by the Council under this Partsubjectto conditions,the personto whom thepermissionhasbeengrantedshallensure that the conditions are observedat all times. If any condition is notobservedthat personcommits an offence against this by-law and the Councilmay by written notice cancelthe permission.7. Infringement NoticeAn infringementnotice in respectof an offenceunderclauses4 1 and5 1 maybe given undersection 669D in accordancewith Part 7 of this by-law.
PART 3-REMOVAL OF ANIMALS, VEI-IICLES AND OTHER THINGS8. In public places8 1 The provisionsof this clauseshall not affect the operationof Part XX ofthe Act.
8 2 Subject to the provisionsof subclause8 3 a personshall not permit ananimal to remainunattendedin a public place.8 3 An animal may be securedin any portion of a public place whereinanimalsmay lawfully be securedbut only if securedfor a period not exceedingeight 8 hours unlessthe consentin writing of the clerk is obtained.

8 4 Wherean AuthorisedPersonor a memberof the Police Force finds ananimal or vehicle left in a public place,contraryto the provisionsof this by-lawthat personmay removethe animal or vehicletherefromand shall thereupon-
a in the caseof an animal, place it in a public pound and deal with itaccordingto law;
b in the caseof a vehicle, place it in a specifiedplace.
PART 4-SHOPPING TROLLEYS9. SeizureSubject to the provisionsof the Act, the Council may seizeany shoppingtrolleywhich hasbeenleft unattendedfor a period in excessof 30 minutesin any streetor way or other public place so as to obstructany portion thereof.10. Recovery of Shopping Trolley
10 1 The owner or owner’s representativemay recover a seizedshoppingtrolley from custodyby paying to the clerk:
a thecost incurredby the Council in removingthe shoppingtrolley to theplace where it is stored; or
b the sum specified in Schedule5, whichever is the greater.10 2 Wherethe owner of the shoppingtrolley is known the clerk shall causewritten notification of the seizureof the sameto be forwarded to the owner orthe owner’s representativein or nearest to the District and the owner orrepresentativeshall be given not less than fourteen 14 days’ notice withinwhich to recoverthe trolley.10 3 If the owner of the shoppingtrolley is not known the clerk shall exhibiton a notice board at the Council Chambersa notice describing the shoppingtrolley and the place at which it was seizedand the place at which it is beingkept, and unless the shopping trolley is sooner recovered shall keep thenotification exhibited for a period of not less than fourteen14 days.11. DisposalA shoppingtrolley seized by Council under clause9 which is not recoveredbythe owner or any other person lawfully entitled thereto within fourteen 14daysafter thenoticereferredto in the precedingclausehasbeenexhibited, maybe disposedof in such mannerand undersuch conditionsas the Council maydeem fit.12. Application of Proceedsof SaleThe proceedsof sale of any such shopping trolley shall be dealt with in themannerprovided in clause37.
PART 5-STANDING AND PARKING GENERALLY13. Erection of Signs to RegulateParking13 1 Subject to subsection231 3 of the Act, a discretionary authority isconferredon the Council by resolution to constitute, determineand vary, andalso indicate by signs, from time to time-
prohibitions, andregulations and restrictions of parking and standing of vehicles of aspecifiedclassor of specifiedclassesin all streetsor specifiedstreetsor inspecifiedparts of streetsor reservesat all times or specified times,
but that discretionaryauthority shall not be exercisedin a mannerinconsistentwith the provisions of this by-law.13 2 Whereunderthis by-law the standingor parking of vehiclesin a streetis prohibited, regulated or restricted by a sign erectedby or under the carecontrol and managementof the Council then the sign shall for the purposesofthis by-law apply to that part of the street which-
a lies beyond the sign or in the position or direction indicatedby it; or
b lies betweenthe sign and the next sign beyond it; andc is that side of the carriagewayof the streetnearestthe sign.
13 3 A personshall not-a without the authority of the Council mark, set up or exhibit a sign
purportingto be or resemblinga sign marked, set up or exhibited bythe Council under the authority of this by-law;
b remove, defaceor misusea sign or propertyerectedor providedunderthis by-law or any part thereof, or attempt to do any such act; or
c without the permission of the Council affix a board, sign, placard,noticeor other thing to or paint or write upon anypart of a sign erectedunder this by-law.

13 4 An inscription on a sign operatesand has effect accordingto its tenoranda personcontraveningthedirection of a sign commits an offenceunderthisby-law.
13 5 A sign marked, erected,establishedor displayedon or near a roadandpurporting to be a parking control sign is, in the absenceof evidenceto thecontrarypresumedto be a sign marked, erected,establishedor displayedunderthe authority of this by-law.
13 6 The first three letters of any day of the week when used on a signindicate that day of the week.13 7 A sign associatedwith a no parking area, no standingareaor parkingareaor a sign of a kind referredto in this by-law is limited in its operationandeffect in respectof days,periodsof theday, classesof persons,classesof vehicle,or circumstancesto the extent, if any, shown on the sign.14. Parking Stalls and ParkingStations
14 1 A personshall not standavehiclein a parkingstall in a streetotherwisethan-
a parallel to the kerb and as close thereto as practicable;
b wholly within the stall; andc headedin the direction of the movementof traffic on the side of the
street on which the stall is situated,but where a parking stall is setout otherwisethan parallel to the kerb theprovisions of this subclause,other than paragraphb, do not apply.
14 2 Unlessotherwisedirectedby an Authorised Persona personshall notpark a vehiclein a parkingstation otherwisethanwholly within a parking stall.14 3 a A personshall not-
i stand a vehicle so as to obstruct an entranceto, an exit from, ora roadwaywithin a parking station or beyond the limits of anydefinedparking stall within a parking station;
ii standa vehicle exceptwith the permission of the Council or anAuthorisedPersonon anypart of a parking station,whetheror notthat part is marked as a parking stall, if a sign is exhibitedprohibiting the standingof vehicles thereon;
iii standor permit a vehicle to continue standingon any part of aparking station, whetheror not that part is markedas a parkingstall, if an AuthorisedPersondirects the driver of such vehicle tomove the vehicle from that part of the parking station;
iv standor attempt to stand a vehicle in a parking stall in whichanothervehicleis standingbut this paragraphdoesnot prevent theparking of a motor cycle and a bicycle together in a stall marked
v standor permit a vehicle to continue standing in a parking stallwhich is at the time setasidefor useby commercialvehiclesunlessthevehicleis acommercialvehicleandapersonis actively engagedin loading or unloading goods to or from that vehicle;
vi standavehiclein aparking stall which is setasidefor useby busesexcept for the purposeof taking up or setting down passengerstoor from the vehicle.
b In subparagraphv of paragrapha of subclause14 3 "goods" meansan article, or collection of articles, weighing at least 14 kg and havinga volume of at least 02 cubic metres.
c A parking stall is set aside for useby commercialvehicles if there isa sign thereonor adjacenttheretomarked"Loading Zone".
15. Standing and Parking Conduct Generally
15 1 Subject to subparagraph14 a vi a personshall not standa vehicle ina street or part of a street or part of a parking station-
a which is by a sign thereonor adjacentor referrabletheretoset apartfor the standingof vehicles of a different class;or
b If by such a sign the standingof vehicles is prohibited or restrictedduring a period or periods,during that period or periods; or
c If by such a sign the standingof vehicles is permittedfor a specifiedtime, for longer than that time.
15 2 A personshall not stand a vehicle-
a in a no standingarea;
b in a parking area, except in a mannerindicatedby the inscription onthe sign or signs associatedwith the parking area;

c in a parking area, or a parking station contrary to any limitation inrespectof time, days,periods of the day, classesof personsor classesof vehicles indicatedby the inscription on the sign or signs associatedwith the area;
d in a parking stall except as provided in this by-law with referencetoparking stalls; or
e in a definedareamarked"M/C"’, unlessit is a bicycle or a motor cyclewithout a sidecar;
fi in a stall or area associatedwith a hospital, medical centre orconsultingrooms and set asideand markedas an areafor emergencyvehicles,unlessthe standingof the vehicle in that stall or areais foremergencypurposesused in connectionwith thosepremises.
15 3 A personshall not park a vehicle in a no parking area.
15 4 A personshall not park a vehicle on any portion of a street-a for the purpose of effecting repairs to it, other than the minimum
repairs necessaryto enable the vehicle to be moved to a place otherthan a street;or
b if the vehicle is exposedfor sale.
In regard to commercial vehicles the provisions of paragraph a of thissubclauseare subject to the provisions of paragraphb of clause 19.
15 5 A personsshall not standa motor cycle without a sidecaror a bicyclein a parking stall unlessthe traffic sign "MIC" is markedon that stall.
15 6 A personshall not, without the permissionof the Council, clerk or anAuthorisedPerson,stand a vehicle in an areadesignatedby signs "AuthorisedVehicles Only".16. Standingand Parking in CarriagewaysGenerallySubject to the provisions of clause 17 a person standing a vehicle on acarriagewayshall stand it-
a on a two-way carriageway,so that it is as near as practicableto andparallel with, the left boundaryof the carriagewayand headedin thedirection of the movementof traffic on the side of the road on whichthe vehicle is standing;
b on a one-way carriageway,so that it is as near aspracticable to, andparallel with either boundary of the carriagewayand headedin thedirectionof the movementof traffic;
c so that at least threemetresof the width of the carriagewaybetweenthe vehicle and the farther boundaryof the carriagewayor betweenitand a vehicle standingon the far side of the carriageway,is availablefor the passageof other vehicles;
d so that it is not lessthan 1.2 metresfrom any other vehicle, exceptamotor cycle or a bicycle parked in accordancewith this Part of thisby-law;
e so that it doesnot causeundue obstructionon the carriageway;
0 so that it is entirely within the confines of any parking stall markedon the carriageway.
17. Parking Areas
17 1 A personsshall not standa vehicle party within and partly outside aparking area.
17 2 Where the traffic sign or signs associatedwith a parking area are notinscribedwith the words "Angle Parking"; then
i wheretheparking areais in a streetreserveandabutting theboundaryof a carriagewaya personstandinga vehicle in the parking areashallstandit as near as practicableto andparallel with that boundary;and
ii where the parking area is at or nearthe centreof the carriageway,apersonstandinga vehicle in that parking areashall standit approximately at right anglesto the centreof the carriageway,unless a signassociatedwith the parking areaindicates, or marks on the carriageway indicate,that vehicles are to standin a different position.
17 3 Wherea traffic sign associatedwith aparkingareais inscribedwith thewords "Angle Parking" a personstandinga vehicle in the parking areashallstandthe vehicle at an angle of approximately45 degreesto the centreof thecarriagewayunlessotherwiseindicatedby the inscription on the parking signor by marks on the carriagewaysurface.17 4 In subclause17 3 "vehicle" meansa car or motor wagon utility typeup to 3 tonnegross.
17 5 Subclause17 3 doesnot apply to a personstandinga motor cycle orbicycle in a parking area.

18. Standingof Vehicleson Carriageway
18 1 A personshall not stand a vehicle on a carriageway-
a so that any portion of the vehicle is-
i betweenany other standingvehicleandthe centreof the carriageway;
ii adjacentto a medianstrip exceptwhereparking is permittedunderclause 17 2;
iii obstructinga right of way, passageor private drive or carriagewayor a cross-overor so close thereto as to deny vehicles reasonableaccessto or egressfrom the right of way, passageor private drive,carriageway,or cross-over;
v alongside, or opposite, any excavation in, or obstruction on, thecarriageway,if the vehicle would thereby obstructtraffic;
vi on, or within 9 metresof, any portion of acarriagewayboundedonone or both sides by a traffic island;
vii on any pedestriancrossing;
viii on a bridge or other elevatedstructure;
ix betweenthe boundariesof a carriageway,andany doublelongitudinal line consistingof two continuouslines or betweena doublelongitudinal line consistingof a continuousline anda broken ordotted line and the boundary of the carriagewaynearerto thecontinuousline, unlessthereis a distanceof at least 3 metresclearbetweenthe vehicle andthe doublelongitudinal line;
x on an intersection,exceptadjacentto a carriagewayboundarythatis not brokenby an intersectingcarriageway.
b so that any portion of the vehicle is-i within 1 metreof afire hydrant or fire plug, or of any sign or mark
indicating the existenceof a fire hydrant or fire plug; orii within 3 metresof a public letter pillar box, unlessthe vehicle is
being used for the purpose of collecting postal articles from thepillar box.
c so that any portion of the vehicle is within 6 metresof the projectionof the nearerpropertyline of any streetintersectingthe streeton theside on which the vehicle is standing.
d so that any portion of the vehicle is within 9 metresof the departureside of-
i a sign inscribed with the words "Bus Stop", or "Hail Bus Here",unless the vehicle is a bus stopped to take up or set downpassengers;or
ii a children’s crossingestablishedon a two-way carriageway.e so that any portion of the vehicle is within 18 metresof-
i the approachside of a sign inscribedwith the words"Bus Stop" or"Hail Bus Here", unlessthe vehicle is a bus stoppedto take up orset down passengers;
ii the approachside of a pedestriancrossingor children’s crossing;or
iii the nearestrail of a railway level crossing.
0 notwithstandingthe generalityof subclause4 1 so that any portionof that vehicle is on a street vergeif a sign on, adjacentor referrablethereto, prohibits parking or standingof vehicles on the street verge.
18 2 A personshall not park a vehicle or any combination of vehicles thattogetherwith any projection on, or load carried by the vehicle or combinationof vehiclesis more than eight 8 metresin length,on a carriagewayfor a periodexceedingone 1 hour.
18 3 Nothing in this by-law mitigates the limitations or conditionsimposedby any other provision in this by-law or by any traffic sign relating to theparking or standingof vehicles.
19. CommercialVehiclesA personshall not on a carriageway-
a park a commercial vehicle having a tare weight or load capacity ofthree3 tonnes or more for more than two 2 hours in any built-upareaexcept in a designatedareaset asidefor commercialvehicles;or
b repair, service or cleana commercialvehicle.

20. Inspectionand Directions by Authorised Persons20 1 A personsshall not standor permit a vehicleto remainstandingin anypart of a street if an AuthorisedPersonor memberof the Police Force directsthe driver of the vehicle to move it.
20 2 An Authorised Person may mark the tyres of a parked vehicle withchalk or any other non-indelible substancefor a purpose connectedwith orarising out of that person’sduties and powers.20 3 A personshall not removea markmadeby an AuthorisedPersonso thatthe purposeof the affixing of such mark is defeatedor likely to be defeated.
21. Moving a Vehicle to Defeat Time Limit
21 1 A vehicle having beenparked in an areawhereby a sign the standingor parkingof vehiclesis permitted for a limited time a personshallnot moveit to any position within the sameparkingareaso that the total time of parkingexceedsthe maximum time allowed for parking in the spacefirst occupiedbythe vehicle.21 2 A vehicle havingbeenparked in a streetwhereparking is restrictedasto time a personshall not park the vehicleagainin thestreeton that dayunlessit has first been removedfrom the streetfor at least two hours.
22. Parking on Private Land
22 1 A personshall not standor parka vehiclewithin the parkingregion onland that is not a street or a parking facility without the consentof the owneror occupier of the land on which the vehicle is parkedor stood.
22 2 For the purposesof subclause2 1 where the owner or occupierof theland haserectedsignson portion of the landsetasidefor theparkingof vehiclesdisplayingrestrictionsconcerningthe classesof personswho may standor parkvehicles or the time within which vehicles may be stood or parked on that
portion of land a personwho stands or parks a vehicle otherwise than incompliancewith the sign shall be deemednot to havethe consentof the owneror occupier of the land so to standor park the vehicle.
23. Parking on Reserves23 1 A personexceptan employeeof the Council in the courseof that person’sdutiesshall not drive or park a vehicle upon or over any portion of a reserveother than a paved areaspecifically set aside for that purpose.
23 2 A personshall not park a vehicleon anypart of a reserve,including anypaved areas, for the purposes of conducting a businessexcept with thepermissionof the Council in writing.
24. Special Permit
24 1 The Council, clerk, or an Authorised Personmay by a permit in writingallow apersonto occupya spacewith a vehiclefor an urgent essentialor officialpurposewherethe standingor parking of that vehicle is indicatedby a sign orthe provisions of this by-law to be otherwiseunlawful.
24 2 A personauthorisedby a permit under subclause24 1 shall producethe permit when requestedto do so by an AuthorisedPersonand shall leavethe permit in a conspicuousposition behind the front windscreenwhen thevehicle is left unattended.
24 4 The Council, clerk or an Authorised Person may by the permit givenundersubclause24 1 or by other meansprohibit theusefor any other purposeof a spacethe subject of a permit.
PART 6-REMOVAL OF VEHICLES
25. Removal25 1 Where an Authorised Person or a memberof the Police Force finds avehicle stoodor parked contraryto the provisions of clauses5, 14, 15, 16, 17,18, or 19 of this by-law so as to obstructportion of a street way or other publicplaceor trespassingon privately ownedland or without limiting the generalityof the foregoingcausingan obstructionto traffic, the AuthorisedPersonor amemberof the Police Forcemay removethe vehicleto a specifiedplaceandmayusesuchforce as is necessaryto enterthevehiclefor the purposeof so removingit.25 2 A vehicle removedpursuantto subclause25 1 shall be dealt with inaccordancewith the provisionsof Part 7 Division 2 of this by-law.

PART 7-ENFORCEMENT OF BY-LAW
Division 1-Authorisedpersons26. Identification
An Authorised Personexercisingany power or authority under this Part shallbefurnishedwith a certificateof appointmentor an identification cardin a formdeterminedby the Council from time to time and shall on demandpresentthesameby way of identification.
27. ImpersonationA personwho is not an AuthorisedPersonshall not in any way assumetheduties of an AuthorisedPerson.28. Hindering
A person shall not in any way obstruct or hinder an Authorised Person in theexecution of the Authorised Person’s duty.29. Provision of name and Place of Abode29 1 An AuthorisedPersonor memberof the Police Forcewho finds a personcommitting or who on reasonablegrounds suspectsa person of havingcommitted a breach of the provisions of this by-law, may demand from thepersonthat person’snameand place of abode.29 2 A personwho refusesto state his or her name and place of abode, orwho statesa false nameor place of abode,on demandbeing so made,commitsan offence.30. Authority
An Authorised Personappointedby the Council from time to time is herebyauthorisedby the Council to-
a carry into effect the provisions of this by-law;b report to the Council on the working effectivenessand functioning of
this by-law;
c recommendto the Council the institution of prosecutions;andd institute and conduct prosecutionsas directed by the Council or the
clerk from time to time.
Division 2-Impounding31. Application
The provisionsof this Part relating to animalsshall not affect the operationofPart XX of the Act.32. Dealing According to the LawWherean AuthorisedPersonplacesan animal or vehiclein a public pound orspecifiedplace respectively,the animal or vehicleshall thereafterbe dealt withaccordingto law.33. Entry in Register
Whereany vehicle or animal is seizedunder this by-law there shall be enteredin a register, providedby the Council for that purpose,detailsof the time anddate, a descriptionof the vehicle or animal,and of theplace from which it wasremoved and the clerk shall be notified accordingly.34. NotificationThe Clerk shall exhibit on a noticeboardat the Council Chambersnotificationthat a vehicle or animal therein describedhas beentaken into custody andshall, unlessthe vehicle or animal is sooner recovered,keep that notificationexhibited for a period of not less than fourteen14 days in the caseof a vehicleand seven7 days in the caseof an animal.35. Recovery of Vehicle or AnimalA personmay recovera seizedvehicle or animal from custodyby paying to theclerk:
a the cost incurredby the Council in removing the vehicle or animal tothe specifiedplace or pound; and
b the sum specified in Schedule5 perday for eachpart of a day that thevehicleor animal hasremainedin thatplace,anduponpaymentof thatcost and charge the clerk, if satisfiedthat the personis the owner ofthe vehicleor animal or is a personentitled to possessionof thevehicleor animal, shall permit that personto removeit.
36. Sale Destruction or Disposal of Vehicle36 1 Wherea vehicle or animal, taken into custodyhas not beenrecoveredby the owner or a personentitled theretowithin one 1 month in the caseofa vehicle or seven 7 days in the caseof an animal from the day upon whichit was taken into custodythe Council may causethe vehicle or animal to be

offered for saleby public auction or by public tenderandthereuponacceptthebest offer made,andwhereno offer is madefor the purchaseof the vehicle oranimal the Council may causeit to be destroyedor otherwisedisposedof to thebest possibleadvantage.The disposalof a shoppingtrolley shall be dealt withunder the provisionsof Part 4.36 2 The provisionsof Part XX of theAct shall apply to thesaleof impoundedcattle and in the caseof any inconsistencywith the provisions of this by-lawthe provisionsof the Act shall prevail.
37. Application of Proceedsof Sale of Vehicle37 1 The proceedsof the sale of a vehicle or animalunder the provisionsofclause36 shall be applied by the Council-
a firstly, in meetingthe costs of the sale; and
b secondly, in meetingthe cost of taking andmaintaining thevehicle oranimal in custody,andthe sumspecifiedin Schedule5 perday for eachday or part of a day that the vehicleor animal remains in that place.
37 2 Any surplusof the proceedsof the saleshall be paidby theCouncil intoits trust fund, and may be paid within ten 10 yearsto any personwho claimsand establishesto thesatisfactionof the Council the right of that personto thepayment.37 3 Any surplusof the proceedsof salemay, if not paid to the ownerwithinten 10 years, be transferredto such fund as the Council thinks proper oncondition that the Council shall repay it from that fund to a personclaimingand establishinghis right to the payment.
38. Protection from ClaimsA personis not entitled to any claim, by way of damagesor otherwiseagainstthe Authorised Person, member of the Police Force, the Council or theMunicipality in respect of any vehicle or animal seizedand dealt with underthe provisionsof this by-law or againstany personwho purchasesa vehicle oranimal sold by the Council underthe provisionsof Clause36.
Division 3-InfringementNotices
39. An infringementnotice in respectof an offence:a may be given underSection 669D 2 of the Act and shall be in or to
the effect of Form 2 in Schedule2;
b may be given under Section 669D 2 of the Act and shall be in or tothe effect of Form 1 in Schedule2;
c may be given under Section 669D 2 of the Act andshall be in or tothe effect of Form 3 in Schedule2;
40. WithdrawalA noticesentunderSection 669D5 withdrawing an infringement notice shallbe in or to the effect of Form 4 in Schedule2.
41. Removal from VehicleA person,otherthan the driver of the vehicle,shallnotremovefrom thevehicleany notice attachedtheretoor left thereinor thereonby an AuthorisedPersonor a memberof the Police Force.
Division 4-General Offenceand Penalty Provisions
42. GeneralPenalty Provision42 1 Any personfailing to do any act directed to be done, or doing any actforbidden to be doneby this by-law, or any notice or orderunder this by-lawcommits an offence.42 2 Any personwho commits an offenceunder this by-law shall be liable,if no other penalty is imposed,to:
a in relation to offencesinvolving the useof a parkingstationor parkingfacility or parking at a parking meter or on private property, amaximum penalty of $80;
b in relation to any offencenot dealt with in a a maximum penalty of$500; and
c in relation to any offencedealt with underparagraphb, in addition,if the Court thinks fit, a maximum daily penalty of $50 per day.
43. The amount appearingin the final column of the Third Scheduledirectlyoppositean offencedescribedin that Schedulein the modified penalty for thatoffence if dealt with under section 669D of the Act.
44. A penaltyfor an offenceagainstthis by-law not being a modified penaltymay be recoveredby the Council by taking proceedingsagainst the allegedoffender in a Court of Petty Sessions.

45. The Council shall causeadequaterecordsto be kept of all infringementnoticesservicedand modified penaltiesreceivedunder section669D of the Actin respectof offences against this by-law.
46. Consistencywith LawsThe imposition of any penaltypursuantto this by-law shall not be inconsistentwith or repugnantto any of the provisionsof the Act or any other law in force.

5.15.2 Considerationof Applications
Without limiting the generality of the matterswhich may be taken into accountwhenmaking a decisionupon an application for planning consentto erect, place or display anadvertisement,Council shall examineeach such application in the light of the objectivesof the Schemeand with particular referenceto the characterand amenity of the localitywithin which it is to be displayed,including its historic or landscapesignificanceandtrafficsafety, and the amenity of adjacentareaswhich may be affected.
5.15.3 Exemptions from the Requirementsto Obtain Planning Consent
Subject to the provisions of the Main Roads Control of Signs Regulations 1983 andnotwithstanding the provisionsof Clause 5.15a, the Council’s prior planning consentisnot requiredin respectof thoseadvertisementslisted in ScheduleVII which for the purposeof this Part are referred to as "exempted advertisements".The exemptionslisted inScheduleVII do not apply to places,buildings, conservationareasor landscapeprotectionzoneswhich are either-
i listed by the NationalTrust;
ii listed on the registerof the National Estate;
iii included in the Schemebecauseof their heritageor landscapevalue.
5.15.4 DiscontinuanceNotwithstanding the schemeobjectives andClause 5.15.3, where the Council can demonstrate exceptional circumstanceswhich causean exemptedor existing advertisementtoseriously conflict with the objectivesof this part, it may by notice in writing giving clearreasons require the advertiser to remove, relocate, adapt, or otherwise modify theadvertisementwithin a period of time specified in the notice.
5.15.5 Derelict or Poorly Maintained Signs
Where, in the opinion of the Council, an advertisementhasbeenpermittedto deteriorateto a point where it conflicts with the objectivesof the Schemeor it ceasesto be effectivefor the purpose for which it was erectedor displayed. Council may by notice in writingrequire the advertiserto-
i repair, repaint or otherwiserestorethe advertisementto a standardspecifiedbyCouncil in the notice, or
ii removethe advertisement.
5.15.6 Notices
a "The advertiser"shall be interpretedasany oneor any groupcomprisedof the landowner, occupier or licensee.
b Any notice served in exceptional circumstancespursuant to Clause 5.15.4 orpursuantto Clause5.15.5 shall be servedupon the advertiserand shall specify-
i the advertisementsthe subject of the notice;ii full details of the action or alternativecoursesof action to be taken by the
advertiserto comply with the notice;iii the period, not beinglessthan 60 days,within which theaction specifiedshall
be completedby the advertiser.
c Any personupon whom a notice is served pursuantto this Part may within aperiod of 60 days from the date of the notice appeal to the Hon Minister forPlanning or the Town PlanningAppealTribunal in accordancewith PartV of theAct, and where any such appeal is lodged at the effect of the notice shall besuspendeduntil thedecisionto uphold, quashor vary thenotice is known andshallthereafterhaveeffect accordingto that decision.
