P.W.W.S. 1569/18.WHEREAS by "The Water Boards Act, 1904," it isprovided that, before undertaking the construction ofwater works, the Board shall submit plans, descriptions)hooks of reference, and estimates of the proposed' worksto the Governor for approval and that, if they are ap-proved, the Governor may forthwith by Order in Coun-cil empower the Board to undertake the construction ofthe proposed works: Now, therefore, His Excellency theGovernor, with the advice of the Exocutive Council,hereby approves of the plans, descriptions, books of re .ferenee and estimates marked P.W.D., W.A., 26692, forthe construction of water works within the BunburyWater Area, which were duly submitted for approval,and hereby empowers the BRinbury Water Board toundertake the construction of the said works.

New Buoys and Lights Established.MARINERS and others are hereby notified that, on orabout the 1st November, 1930, the Entrance Channelleading into the Inner Harbour, Geraldton, will bemarked by Two Buoys fitted with A.G.A. PlashingLights. These Lights will be nine feet above waterlevel, and will flash every three seconds thus:

0.3 sees. flash 2.7 sees. eclipse.

The Buoy on the starboard side entering the Channelwill show a Red Flashing Light and will be placed inthe position:

Latitude 28deg. 46mins. 16sees. S.Longitude 114deg. 3Gmins. 12secs. E.

The Buoy on the port side will show a White Flash-ing Light and will be placed 400 feet due East fromthe Buoy on the starboard side.

To lead through the centre line of the Channel, twoBeacons, about 40 feet above low water level, areerected on shore. The front Beacon is place I immedi-ately behind the wharf and is surmounted by a triangle.The rear Beacon is placed 500 feet due South from thefront Beacon, and is surmounted by an inverted tri-angle. At night, when required, these Beacons willshow two white vertical electric lights, for the conveni-ence of vessels entering or leaving the Inner Harbour.

5. Any worker called upon to make a brown doughby machine shall be allowed 20 minutes for 100 loavesor part thereof, 40 minutes for 200 loaves, and onehour for 300 loaves.

6. For all workers, excepting doughmakers the start-ing time shall he not earlier than 12 pun. midnight onSundays, 5 a.m. on Tuesdays, Wednesdays, Thursdays,and Fridays, and not earlier than S p.m. or later than0 p.m. on Friday evening, with a finishing time of

not later than 6 p.m. on Tuesdays, Wednesdays, andThursdays ; 2 p.m. on Friday, and F a.m. on Saturdays.

7. When a treble day falls on a Friday the startingtime shall be not earlier than S p.m., a finishingtime of 8 a.m. on Saturday.

THIS Agreement, made in pursuance of "The Indus-trial Arbitration Act, 1912-1925," made this 20th dayof September, 1930, between the Minister for TradhConcerns, in his capacity as Minister in charge of StrnteImplement and Engineering Works, North Fremantle,of the one part, and the Federated Society of Boiler-makers and Structural Iron and Steel Workers' Unionof Workers, Coastal Districts, W.A., of the other part.

Whereas an Industrial Agreement, No. 23 of 1928,was made on the 25th day of September, 1928, betweenthe above-mentioned parties, and registered at the Courton the 13th clay of October, 1928, now, it is herebyagreed by and between the parties hereto, that Clause5 be amended by the addition of the following subclauses:

(r) Notwithstanding anything, hereinbefore contained,when the employer is temporarily unable to providework for the apprentice for his full time, it is herebyagreed that the employer may employ the apprentice fora lesser time per week on the conditions prescribed inSubelnuse (s) hereof.

(s) In the event of the employer employing any ap-prentice for a lesser number of hou.,, than 14per week, he is hereby authorised and empowered to re-duce tie wages as prescribed in Clause 5 (i) pro rata,but the deduction shall not reduce the wages below theamount payable for 22 hours' work per week on suchpro rata basis,

When the services of the apprentice arc not requiredon any day or days, the employer shall give the appren-tice 24 hours' notice thereof.

The reduced hours per week mentioned herein shallbe worked at the convenience of the employer.

When lesser hours per week are worked, holidays, asprescribed, or pay in lieu, shall be reduced pro rata.

the following special provisions shall apply, insofar asthe above Applicant and members or persons eligibleto become members of the West Australian TimberWorkers' Industrial Union of Workers (South-WestLaud Division) arc concerned, to the period com-mencing 1st September, 1930, and ending 31st March,1931.

1. The working hours may be reduced from 48 toa minimum of 32 per week.

2. (a) In the event of the Commissioner of Rail-ways employing the worker for a lesser number ofhours than those prescribed in Clause 15, he is herebyauthorised and empowered to reduce the wages as pre-scribed in Schedule 1 pro rata, but the reduction shallnot reduce the wages below two-thirds of the weeklywage prescribed in the Award;

(b) The reduced hours per week mentioned in (a)shall be worked at the convenience of the employer;

(c) When lesser hours per week are worked, holi-days, as prescribed in Clause 14, or pay in lieu, shallhe reduced pro rata;

(d) The provisions as to overtime, in Clause 16,shall not be affected thereby, nor shall the worker'srights for proper notice be affected, in the event of theworker being dismissed permanently from his employ-ment.

The foregoing provisionsay be continued frommonth to toot!th tr the 31st March, 1931, by agree-ment between des, a memorandum of which,signed by or on behalf of the parties, shall be filed inthe Court. In the ex cut of the parties failing to agree,the matter may be referred to the Court.

4. The provisions of this amendment shall notaffect or prejudice the right of any of the parties tothe said Award to apply to the Court for a furtheramendment thereof, in pursuance of Section 90 of theAct, or for a new Award, should occasion arise there-for.

(c) Persons doing outdoor work shall not work formore than one employer, except by the consentof the Chief Inspector of Factories ;


(d) Persons doing outdoor work shall not employlabour, except that of members of their ownfamily resident with them ;

Such outdoor work shall be paid for at the piece-work rates provided for by this Agreement;

Outdoor workers shall be provided, free of charge,with cotton, silk, thread, and all other sewingand trimmings used in manufacturing gar-ments.

Provided that the above rates or any of them mayat any time he varied by Award of the Court of Arbi-tration or Agreement between the parties hereto.

All apprentice who, after having served the full termof his apprenticeship is under the age of twenty-oneyears, may continue in his master 's employment at lessthan a journeym.an's minimum wage until the expira-tion of one year thereafter, or until he becomes twenty-one years of age, whichever first happens : Providedthat, during the first six months after the expirationof the apprenticeship, lie shall lie paid three poundsfifteen shillings and .sevenpenee per week, and northe balance of the period four pouncb eleven shillingsand sevenponce per week.

11.Apprentices.(a) The employment of apprentices shed he governed

No apprentice.under the age of sixteen years shall he taken to thepressing branch.

(d) Female apprentices shall not exceed in numberone to every two journeywomen or journeymen, orfranction of two journeymen or journeywomen coat,vest, skirt, or trouser hands, or machinists or pressers,employed by each employer or firm of employers. Pro-

vided, in reference to this and the immediately pre-ceding clause, that at the expiration of three years ofthe term of apprenticeship (and subject to the appren-tice having qualified by examination for that period),an additional apprentice may, for the purpose of com-puting such proportion, be taken in substitution forthe apprentice so completing the term of three yearsas aforesaid.

(e) The periods of apprenticeship shall be as fol-lows: -1, To coat makingfive years; 2, to vest mak-ingthree years; 3, to trouser niakingthree years;4, to skirt makingthree years; 5, to pressingfouryears; 6, to coat, trouser, - and vest machiningfouryears; 7, to fitting up and trimmingfour years.

Provided that, in the case of a youth who has hadprevious experience in the industry as a junior worker,the term Of apprenticeship may be reduced to suchperiod as the Court, or, on the advice of any persondelegated by it for such purpose, taking into considera-tion the age and previous experience of the youth, maydetermine; the rates of wages to be paid in such caseshall be the rates hereinbefore prescribed for the yearsof service which the youth has yet to serve.

(f) The provisions of this clause, and the rates ofwages hereinbefore set out, shall not apply to anyapprentices now working under a contract of apprentice-ship in writing and duly executed. All such contractsmust be forwarded by the employer to the Court forregistration forthwith.

12.Under-rate Workers.Any worker who is unable to earn the minimum wage

may be paid such lesser wage as may from time to timebe agreed upon in writing between the Union and theemployer, and, in default of such agreement withintwenty-four hours after such worker shall have appliedin writing to the Secretary of the Union stating hisdesire that such wage should be agreed upon, suchwage as shall be fixed by the most convenient Residentor Police Magistrate, upon the application of suchworker, after twenty-four hours' notice in writing -shallhave been given by him to the said Secretary, whoshall, if he so desires, be heard by the Magistrate uponsuch application. After having given to the Secretary,and after lodging the application mentioned, and pend-ing the Magistrate's decision thereon, the worker shallhe entitled to work for 4-did be employed at the pro-posed lesser rate. The determination of the MagistrateShall have effect for a period of six calendar monthsfrom the date thereof and after the expiration of thesaid period until the wage shall have been again fixedat the instance of the said Secretary in the mannerprescribed. The Secretary of the Union may by writingunder his hand appoint an agent or substitute to re-present the Union at the hearing of the application be-fore the. Magistrate.

13.Visiting Workshops.Any person duly authorised by the Chief Inspector

of Factories in writing (such authorisation shall beterminable at the will of the Chief Inspector of Fac-tories), shall have power to inspect any part of afactory, workshop, or place where it is believed thata breach of this Agreement, is occurring, or has oc-curred. At least six hours' notice shall be given bysuch authorised person prior to his actual going onthe premises, and the employer shall be notified of hisarrival and shall, in person, or by his nominee, be entitledto accompany the authorised person in such inspection,and shall provide access to the wages book or time sheetof any worker bound by the Agreement. The necessaryproof that the worker is so bound shall be supplied bythe authorised person. The work and duties of theworkers shall be interfered with as little as possible bythe authorised person.

14.Record Book.Employers shall provide in each factory, workshop,

or place where work is carried on for him, a tine book.Such time book shall contain a correct account of thehours worked and wages received by every worker- (in-cluding outdoor workers) bound by tlds Agreement,and, in the case of outdoor workers doing piece-work,an itemised record of the work done by such workers.Such book shall be kept correc=tly entered up in ink, andshall be signed each week by the worker so bound, veri-fying the accuracy of the hours worked and the amountof wages received and, in the case of outdoor workersdeing piece-work, the itcimised details of the work done.

The said book shall be open to inspection of a dulyauthorised officer of the Union during working hours.

15.Piece-work.The mirtit tun rates to be paid for piece-work shall be

calculated in accordance with the piece-work tog ,a0-.need to Agreement No.. 14 of 1926 and amendmentsthereto, as filed at the Court. of Arbitration and applyjug to the Metropolitan Area.

16.Normal Average Output.In the order section of the Industry, where there is

a normal average output by a weekly worker, and theweekly worker makes more than that amount in the or-dinary working hours of any one week, such workershall he entite% to additional, wages for such week forsuch extra work proportionate to the extra work clonein comparison with the normal average output, togetherwith an additional twenty per cdnt. on such extra work.

17.Board of Reference.(a) For the purpose of this Agreement there shall be

a Board of Reference, consisting of two representativesof the employers and two representatives of the Unionand a Chairman, to be mutually agreed upon by suchrepresentatives, or, in default of such Agreement, to benominated by the Clerk of the Court.

(b) Either party may at any time vary its represen-tatives and fill any vacancies.

(e) If any dispute or question shall arise in thecarrying out of this Agreement between the Union andthe employers, or any of them, such dispute or questionmay be referred by either party concerned to the Board,and the decision of the Board, or a majority thereof,shall be final and conclusive.

(d) On any matter being referred to the Board asaforesaid, or at the request of any two members of theBoard, the Chairman shall convene a meeting of theBoard, to- be Itellil at such place and time as he shall ap-pont; such meeting to be held in any ease not later thanfourteen days from the date of such reference or re-quest.

(e) The Chairman shall determine whether any ques-tion or dispute properly comes within the province andfunction of the Board.

(f) Any costs or charges attending sittings of theBoard may be awarded by the Chairman against theunsuccessful party.

18.--Higher Duties.Where any worker is engaged in any one week for

more than half of such week at work in higher classthan he or she is employed to perform, lm or she shallbe paid for the full week at the highest rate payablefor such work under this Agreement, but if he or sheis engaged for less than half of any such weA, lie orshe shall only be paid at the rate fixed by this Agree-ment for the work he or she actually performs.

19. Payment of Wages.The wo9ciug week for the purpose of this Agreement

shall ternantate on a clay other than Monday or Satur-day, and all workers shall be paid all moneys due tothem in full during the ordinary' working hours notlater than the day following the termination of theweek.

20.Waiting Time for Piece- workers.(a) Coat-makers, the rule as to waiting for work

shall be as follows:At the first try on, when theworker has picked the coat to pieces and given to the(cutter to mark up and recut, should the operative be de-tained for more than twenty minutes before the cutterreturns the same, the operative shall be paid for anytime over the said twenty minutes as follows:Malesat the rate of ls. Gd. per hour; femalesat the rate of15. per hour.

The foregoing rates, increased as under, shall be pay-able to piece, - workers only:

Males By 3.03 per cent. up to and including £4 2s.6d, per week; over £4 2s. 6d. per week add 2s. Gd. only;to the sum so obtained is then added 2.97 per cent.

FemalesBy 3.0:3 per cent. up to and including ,V24s. 7c1. per week; over £2 4s.. 7d. per week add ls. 4d.only; to the sum so obtained is then added 2.5 per cent

(b) All other piece-workers who are authorised or re-quested to wait for work on any one day for more thanhalf an hour in the factory or workshop shall be paid


for such waiting time at the rates as follows:Malesat the rate of ls. per hour; femalesat the rate of 9d.per hour.

The foregoing rates, increased as under, shall be pay-able to piece-workers only:

Males By 3.03 per cent. on rates up to and including£4 2s. 6d. per week, over £4 2s. 6d. per week add 2s., 6d.only; to the sum so obtained is then added 2.97 per cent.

FemalesBy 3.03 per cent, on rates up to and includ-ing £2 4s. 7d. per week, over £2 4s. Id. per week addI s, 4d.. only; to the sum so obtained is then added Liper cent.

The above rates shall be payable, provided that theworkers have not another job on hand.

21.Collecting Logs.Where piece-work is in operation, the employer shall

make arrangements for collecting the logs, and theworkers need not leave their places.

22.Terminating Employment.In order to terminate employment, two days' notice

shall, be given on any day, with payment to date of ter-mination, or, in lieu thereof, two days' pay shall be paidor deducted.

23.Weekly Wage, how paid.All weekly wages shall be paid in full, unless the em-

ployer, on the day ending any week, gives notice to anyworker of any day in the following week on which he orshe will not be wanted.

Notwithstanding anything contained in Clause 23hereof, the workers shall be paid for the holidays pro-vided in the Agreement.

24.--Workers Absenting Themselves.No worker shall, without just cause, be absent from

his or her place of employment during the prescribedhours whilst there is work ready to be done by suchworker, and where the wages are fixed at per week theworker to be entitled to the same so fixed must be avail-able and ready and willing to do the work on the daysand during the hours fixed by this Agreement.

25.Junior Workers.Junior workers may be employed in any branch of

the trade or trades in the proportion of one juniorworker to three or fraction of three journeymen orjourneywomen, at the rates of pay hereinbefore setout.

26. Posting of Agreement.A copy of this Agreement shall be available in a

prominent place hi the workroom for the use of allworkers in such area.

27.Area.This Agreement shall apply over the area comprised

within a radius of ten miles from the Post Office, Bun-bury.

28.Term.This Agreement shall take effect as and from the

22nd day of September, 1930, and shall continue inforce for a period of three years from the date hereof.Provided that, at any time after the expiration oftwelve months from such date, the Court may alter oramend the same on the application of any party orperson affected by its provisions.

Schedule A.

Apprenticeship Regulations.1. No person between the ages of fourteen and eigh-

teen years shall be employed in the abovementionedtrades, except as a junior worker or an apprentice, in-cluding an apprentice on probation.

2. Every apprentice shall be employed on probationfor a period of three months, to determine his fitness orotherwise for apprenticeship) and shall work only forsuch hours per day and for such remuneration as isherein prescribed. In the event of his becoming anapprentice, such probationary period shall be countedas part of the term of apprenticeship. No apprentice-ship agreement shall be entered into until the termina-tion of the probationary period, but in the meantimeall conditions as to terms and conditions of employmentshall apply as if the apprentice were a duly registeredapprentice.

3. When an apprentice cannot be usefully employedbecause of a strike, the employer shall be relieved ofids obligations under the apprenticeship agreementduring the period of the strike.

4. Subject to Regulation (6), time lost by the ap,prentice through sickness or any other cause whatso-ever may, with the consent of the Court, on the appli-cation of any party, he added to the original term inthe apprenticeship agreement.

5. The employer shall pay the apprentice for alltime lost through sickness or the holidays prescribedby this Award. Provided

(a) payment for such sickness shall not exceed atotal of one month in each year;

(b) where the time lost through sickness exceeds fourConsecutive working days, the employer maydemand from the apprentice the production ofa medical certificate, and a further certificateor certificates may be required if any time islost through sickness within seven days fromthe date of resumption of duty, the cost, ifany, of such certificate or certificates, not ex-ceeding 5s., to be borne by the employer;

(c) an apprentice shall not be entitled to receive anywages from his employer for any time lostthrough the result of an accident not arisingout of or in the course of his employment, orfor any accident or sickness arising out of hisown wilful default.

6. The employer shall pay the apprentice in respectof time lost through compulsory military or naval train-ing the amount by which the wages prescribed by theIndustrial Award for the trade, calling, craft, occupa-tion, or industry exceeds the amount received by theapprentice from the Department of Defence. Providedthat this clause shall not apply to military or navaltraining imposed through failure to attend compulsoryparades. All time lost by reason of compulsory mili-tary or naval training, other than the additional train-ing mentioned in the above proviso, shall count as partof the apprenticeship.

7. When an apprentice is absent from work for anycause other than sickness, or in pursuance of the pro-visions of these Regulations, the employer shall be en-titled to deduct from the wages of the apprentice anamount proportionate to the time so lost.

8. An apprentice shall be entitled to such holidaysas are provided for in this Award.

9. If the apprentice shall at any time during theterm of apprenticeship be wilfully disobedient to thelawful orders of the employer, his managers, foremen orother servants having authority over the apprentice,or he slothful, or negligent, or dishonest, or shall other-

wise grossly misbehave himself, or shall not conductIiinismo as a good and faithful apprentice should do, orshall not faithfully observe and keep his part of hisagreement, then it shall be lawful for the employer,with the consent of the Court, to discharge the appren-tice from his service.

10. The Court may in its discretion for any cause,which it may deem sufficient on the application of anyparty to an apprenticeship agreement, abrogate orcancel the agreement, either unconditionally or subjectto such terms and conditions as it may deem advisable

11. In the event of an employer being unable toprovide work for the apprentice, or to mutually agreevith the legal guar,lian of the apprentice to,eancelthe agreement, or to arrange a transfer, applicationmay be made to the Court to arrange for such transferor to have such agreement cancelled.

12. Where in any case an employer is temporarilyunable to provide work to employ an apprentice forhis full time, application may be made by the employe'to the Court for permission to employ the apprenticefor such lesser time per week or per month, and at suchremuneration as the Court may determine, being not lessthan the proportionate amount of the rate of wagesprescribed by the Industrial Award for the trade, call-ing, or industry.

13. An apprentice may be suspended thr misconductby the employer, but in any such ca-:e the employershall forthwith make an application for cancellationof his agreement, and, in the event of the Court re-fusing same, the wages of the apprentice, or such portion thereof as the Court may order, shall be paid asfront the date of such suspension, and, in the event ofthe application for cancellation being granted, suchorder may take effect from the date when the appren.tice was suspended.

Subscriptions are required to commence and terminatewith a month.
