    Is our electoral system any different? The 1987 Constitution provides for the development of a multi-party system under

    a presidential form of government. But did you know that Philippine post-war

    politics was characterized by an indistinct two party system with intense

    competition between only the Nacionalista party (NP) and the Liberal Party (LP)?

    Simply put, only two parties have formed government from 1946-1971, similar to

    the US for the last 150 years (although contrary to common belief, the US actually

    employs a multi-party system but only two parties dominate). After the Marcos

    dictatorship, the proponents of the 1987 constitution introduced provisions

    designed to widen the democratic space and allow for greater participation ofother sectors in Philippine society, which include the banning of political

    dynasties, the introduction of term limits and recall elections, and the

    institutionalization of a party-list system for marginalized sectors.

    How does it work, really? Pertinent provisions of the Party-List System Act include: Every voter gets two (2) votes for electing members of the lower house: one for

    the district representative; and one for the party-list.

    Party-list representatives shall constitute 20% of the total number of themembers of the House of Representatives including those under the party-list.

    That is, 20% of 250 or 50 seats. The House of representatives currently has 265

    members.

    Parties are ranked from the highest to the lowest based on the number ofvotes garnered during the elections.

    Parties receiving at least two percent (2%) of the total votes cast for the

    party-list system shall be entitled to one seat each.

    Parties with more than two percent (2%) of the votes are entitled toadditional seats in proportion to their total number of votesEach party is allowed a maximum of three (3) seats.

    Party-list representatives have a term of office of three (3) years. Party-list representatives can have a maximum of three (3) consecutive terms.Upon interpretation of the Supreme Court, several major clarifications were

    highlighted:

    The 20% allocation is not mandatory, that is, not all 50 seats need to be filledup. (SC October 6, 1998 decision)

    Major political parties are disallowed from participating directly or indirectly inthe Party-List election;

    The president governs the Executive branch of the government, including theCabinet and all executive departments.

    The president as the Commander-in-Chief of the Armed Forces of the

    Philippines can ask the armed forces to prevent or stop lawless violence,

    invasion or rebellion. In cases of invasion or rebellion wherein public safety is

    being jeopardized, the president may, for a period not exceeding 60 days,

    place the country or any part under Martial Law and also suspend the writ of

    habeas corpus.

    The president has the power, except when under impeachment, to give

    reprieves, commutations and pardons and also to remit fines and forfeituresafter a final judgment.

    The president exercises general supervision over local government units.The president appoints members of the Constitutional Commission,

    ambassadors and other public ministers and consuls or officers of the armedforces and other officers.

    Members of the Supreme Court are appointed by the president.

    Unlike the Vice President of the United States of America, the Philippine Vice

    President does not have any official responsibility. The president will give the

    vice president its duties.

    The current vice president has the following responsibilities: Presidential Adviser

    on Overseas Filipino Workers, Chairman of the Housing and Urban

    Development Coordinating Council, Head of the National Price CoordinatingCouncil and Acting Chief Executive under some circumstances.

    The Vice President assumes the role of the President if (1) the position of the

    president has not yet been chosen and ends if the role is filled, (2) thepresident dies or is permanently disabled and will assume this role until the endof the presidents term and or (3) the Members of the Cabinet submits to the

    Senate President and the House Speaker a formal written declaration that thepresident is not able to do his/her responsibilities and duties.

    The congress has a general legislative power meaning they can enact laws asrules of conduct between individuals or between individuals and the state.

    The specific legislative powers of the congress are to following: power to

    appropriate, power to act as constituent assembly, power to impeach, power

    to confirm treaties, power to declare the existence of war, power to concur

    amnesty, power to act as board of canvasser for presidential/vice-presidential

    votes, power to contempt, blending of power, delegation of power,

    budgetary power, power to taxation.

    The congress also assumes some executive power such as the appointment of

    its officers, affirming treaties, confirming presidential appointees through CoA

    and removal of power.As supervisory power, the congress can decide the creation of adepartment/agency/office, define powers and duties of officers, appropriate

    funds for government operations and prescribe rules and procedure to be

    followed.

    Forelectoral power, the congress can elect its presiding officer/s and other

    officers, act as board of canvassers for the canvass of presidential/vice-

    presidential votes and elect the president in case of any electoral tie in the

    position.

    The congress also hasjudicial powers . They can expel and suspend non-

    performing members, initiate contempt proceeding in the Congress, concur

    and approve amnesty declared by the President, initiate, prosecute and

    decide cases of impeachment and decide electoral protests of its members.

    What are their functions and powers?

    What criteria must be relied upon to decide?Below are some suggestions to consider when voting. Although your finaldecisions may not be limited to these four factors, it is a good food-for-thought.

    AchievementsWhat is the candidates track record? What are the things he accomplished? Did

    those things contribute to the betterment of the Philippines? Work ethics may notbe easily apparent so judging from the basis of past performance can be a good

    indication of the candidates future actions.

    MoralityMorality might be subjective person-to-person but it is important to have

    someone whose values are steadfast. In times of grave uncertainty, a specific set

    of principles would serve as a guide to the vaguest matters. A person of integrity

    is important to serve as an example and remind the people of what our country

    stands for.

    Leadership CapabilitiesWhat is his image in the eyes of the Filipino people? Will he be able to command

    to a major extent? Would people have faith in him? A leader is only as good as

    the people who follow him. A person cannot be a leader if people do not follow.PlatformWhat are the candidates views on specific issues in the country? How might we

    expect him to tackle the problems facing the Philippines? Platforms are very

    important in that they show the specificity of the candidates plans. It is a good

    indication of his preparation for the role he will tackle. It is also a good measure

    of whether he is performing during his term.
