Mediation is an alternative to the traditional court process in order to resolve disputes. Mediation is the process by which a neutral third party, the “Mediator,” assists people to resolve their dispute and reach a voluntary settlement. A  Mediator is not a judge, he or she helps people negotiate a fair settlement of their dispute.

M.J. O’Nions Lawyers & Mediators practice both Civil Mediation and Family Mediation.

Some of the typical Civil Mediation cases involve disputes in employment context such as “Workplace Mediation,” disputes relating to an estate “Estate Mediation,” disputes relating to strata units “Strata Mediation,” or any other dispute people have that needs resolution.

Family Mediation is usually mediation revolving around divorce or the breakup of a relationship. Family Mediation can involve dealing with property division, child guardianship, spousal and child support, etc.

What Types of Mediation Do You Practice?

The philosophy of M.J. O’Nions Lawyers & Mediators is to use an array of different types of mediation techniques depending on the situation. We do not necessarily advocate one type of mediation style over another. We believe that each type of mediation has its merits depending on the appropriate circumstances. For example, in Family Mediation we prefer a  more interests based approach to mediation.

What is Your Mediation Philosophy?

Mediation can save you money compared to litigating in court.

Mediation will save you time as opposed to a lengthy court process.

Mediation is a confidential process between the parties, it does not form part of the public record like a court application.

The mediation process is less adversarial without the win or loss at court, which leads to a greater chance of preserving relationships.

Advantages of Mediation

A lawyer mediator can provide legal information informing the participants of the legal issues involved in their dispute. A lawyer mediator can also draft the settlement agreement or separation agreement on behalf of the parties.
