AN ORDINANCE CHANGING THE ZONING OF PARCEL 260915. 003 in the

UNION STATION SUBDIVISION FROM R-3 SINGLE FAMILY TO PLANNED

UNIT DEVELOPMENT ( P.U. D.) AND APPROVING A PRELIMINARY

DEVELOPMENT PLAN

Whereas, an agent representing the owners of parcel 260915. 003 submitted an

application to the Village ofNew Richmond to change the zoning of said parcel from its

current zoning classification of R-3 Single Family to Planned Unit Development( P.U.D.

hereafter) and a Preliminary Development Plan represented by attached ( Exhibit A) forsaid P. U.D., and

Whereas, the change is proposed to allow for the development of the property for the

construction of single family residence structures, and

Whereas, the New Richmond Planning Commission has recommended the approval of

the new zoning classification and the Preliminary Development Plan, and

Whereas, these recommendations were forwarded to Village Council in writing and the

necessary public hearing was held, and

BE IT ORDAINED by the Council of the Village ofNew Richmond, Ohio a majority ofits members concurring.

SECTION 1. Changes the zoning of parcel 260915. 003 from R-3 Single Family to P. U.D.

and accepts the Preliminary Development Plan.

SECTION 2. That Council finds and determines that all formal actions relative to the

passage of this ordinance were taken in an open meeting and that all deliberations of

Council which resulted in the passage of this Ordinance were taken in meetings open to

the public, in full compliance with all legal requirements including Section 121. 22 of the

Ohio Revised Code.

Thank you for your consideration of our request for PUD Preliminary Development Plan approvalfor the planning and development of the remaining undeveloped acreage within Union StationSubdivision. Our proposal is to rezone the site as a Planned Unit Development with 76 proposed

home sites over 30.5893 acres. The overall density for the project is 2.48 units per acre with overtwelve ( 12) acres of open space ( 39%).

The requested PUD area is the balance of the raw land within the existing Union Stationdevelopment. Phase 1 of Union Station was developed many years ago by anotherbuilder/ developer. The project subsequently stalled out during the economic recession in 2008. Itwas constructed within the Village' s existing R-3 Zoning; the typical lot width is 75' wide.

Our plan assumes the exact same street configuration as the previously approved plan. The

noteworthy differences are as follows:

Reduction in lot width from 75' to 55' wide. The proposed Lots will accommodate a 45'x 84' building pad ( 3, 780 s. f.)

Lot depths will remain the same as the previously approved plan.Increase in total units from 77 Lots to 96 Lots.

Increase in total open space area as well as the addition of a playground area to be

constructed by the developer between Lots 73 and 74.Sidewalk is proposed on one side of the street on Union Station Way and Crossing CircleCourt. It is proposed on both sides of the street on Junction Point to match the existing

sidewalk along that section of roadway.

Existing Homeowner' s Association to remain in place and include the new Lots.

Existing home sales in the Union Station generally range between $ 160, 000 and $ 190, 000. There

are several transactions both higher and lower than this range. The product we propose to build

will be comparably priced with pricing most likely starting around $ 170, 000.

We entered into a purchase agreement with TBHW Investment Company earlier this year for theacquisition of this property. Unfortunately, the current zoning makes it cost prohibitive to acquireand develop. By increasing the density, we will have the ability to meet the pricing demands ofthe builder( Ryan Homes) and the overall market.

If successful in rezoning this site, our intention is to proceed immediately with constructiondrawings and our Final Development Plan. We anticipate that we could have a new phase

constructed by May or June 2019.

Ryan Homes will construct a Model Home on Lot 2 ( first lot on the left entering the community).It is anticipated that the sales center would be completed in May or June 2019.

We appreciate your consideration of our request. We are very excited about Union Station andthe development opportunity it presents. We feel very strongly that our plan is a tremendous useof the property and will be a very desirable place to live.
