Some of the younger staff here are off to the annual IBA conference in Dubai later this month. They look forward to meeting many of our international custom-ers there.

The major publishing events this month will be Blackstone’s Criminal Practice (see the ad p. 27) and the launch of the Incorporated Council of Law Reporting’s new online service (see the ad p. 28).

Pictures this month are from John Pethick’s visit to Antigua and Anguilla in Sep-tember.

We understand Jim Smith is leaving Bloomsbury Professional at the end of the year. Our relationship with Jim goes back many years and we wish him well in the future.

Finally, we have received a letter from Spain saying “The Wildy brothers showed me great kindness as a young student, and I would like to repay the kindness, in a small way. Please find enclosed a note for coffee and cakes for the staff”. The note mentioned, however, turned out to be a generous cash gift and we wish to thank the anonymous donor. It is enough to keep us in coffee and doughnuts for the rest of the year! The two brothers mentioned would have been W.E. Sinkins and Ken Sinkins, both of whom sadly passed away many years ago. W.E.’s son John and granddaughter Abbie continue the family connection with Wildy’s. It is pleasing to know that someone still remembers the two brothers.

Bingham, Tom, Lives of the Law: Selected Essays and Speeches: 2000-2010, Oxford University Press, Hardback, £19.99, ISBN: 9780199697304Wildy’s Book of the Month: September 2011 Tom Bingham (1933-2010) was the ‘greatest judge of our time’ (The Guardian), a

Foster, Charles, Human Dignity in Bioethics and

Law, Hart Publishing, Pa-perback, £30.00, ISBN: 9781849461771In this ambitious, paradigm-shattering but highly read-able book, Foster argues that dignity is the only sustain-able Theory of Everything in bioethics. For most prob-lems in contemporary bioeth-ics, existing principles such as autonomy, beneficence, non-maleficence, justice and professional probity can do a reasonably workmanlike job if they are all allowed to contribute appropriately. But these are second order princi-ples, each of which traces its origins back to dignity. And when one gets to the frontiers of bioethics (such as human enhancement), dignity is the only conceivable language with which to describe and analyse the strange concep-tual creatures found there.

Drawing on clinical, an-thropological, philosophical and legal insights, Foster provides a new lexicon and grammar of that language which will be essential read-ing for anyone wanting to travel in the outlandish ter-ritories of bioethics, and strongly recommended for anyone wanting to travel comfortably anywhere in bioethics or medical law.

IMPORTANT FORTHCOMING PUBLICATIONS

Blackstone’s Guide to the Human Rights Act 1998 6th editionby John Wadham, Helen Mountfield, Elizabeth Pro-chaska and Christopher BrownO x f o r d U n i v e r s i t y Press, Paperback, ISBN 9780199697007, due Octo-ber 2011, £49.95This book provides clear, concise coverage of the op-eration and application of the Human Rights Act 1998, discussing the successes and failures of the Act and the debate surrounding its possible eventual replace-ment with a Bill of Rights. The Guide assesses the case law of the European Court and analyses the impact of Convention rights in land-mark domestic judgements across a wide range of ar-eas, including terrorism, privacy, discrimination, and criminal law. It explains the interpretive techniques employed by the courts to read legislation compatibly with Convention rights, and maps the UK and Strasbourg courts’ divergence in ap-proach to certain areas of human rights protection. It also highlights the aspects of

the Act that the courts have not yet clarified. It considers all relevant developments since the publication of the previous edition, including the government’s proposals on a Commission for a Bill of Rights and possible changes to the Human Rights Act, and the developing contra-dictions between the juris-prudence of the European Court of Human Rights and domestic authorities. It also covers the Strasbourg pro-cedures, implementation of Protocol 14 on improving the efficiency of the European Court, as well as the possible implementation of further rights. It explains the rela-tionship between the Euro-pean Convention and the new EU Charter of Fundamental Rights and includes coverage of all significant cases in the European Court, Court of Appeal, and Supreme Court. The book contains a copy of the Human Rights Act 1998 as amended, and the European Convention for the Protection of Fundamental Rights and Freedoms.

EU Antitrust Procedure 6th editionby Nicholas Khan

Sweet & Maxwell, Hardcov-er, ISBN 9781847039095, £275.00, due December 2011A recognised reference work in its field, EU Antitrust Pro-cedure provides a thorough yet concise explanation of how the European Commis-sion investigates infringe-ments of EU competition law. It deals with topics such as the Commission’s investigative powers, pro-cedural rights of the parties concerned, the method for setting fines and judicial review against Commission decisions, as well as the relationship between the enforcement of EU competi-tion law by the Commission and by national courts and competition authorities. The previous edition explained the fundamental changes made to the EU competition law regime by Regulation 1/2003, and this new edition analyses how these rules have been applied in practice and the further developments that have emerged, including the implications of over 200 judgments in the field from the European Court of Justice and the General Court since the previous edition. The author adopts a practitioner-focused approach, provid-

ing clear guidance on the procedures to follow. The latest developments in Com-mission practice, such as the Settlement Notice, the acceptance of commitments, the Best Practices guidance and the role of the Hearing Officer are considered, and explanation given on how the enforcement procedures of the Commission and those of national competition au-thorities are now interacting. Court judgments at both EU and national levels are ex-amined, as well as how the Commission’s 2006 Guide-lines on Fines and Leniency Notice are being applied in practice.

Private Equity Exits: A Practical Analysisedited by David WalkerGlobe Law and Bus i -ness, Hardcover, ISBN 9781905783502, due No-vember 2011, £125.00Exits are the lifeblood of private equity: for private equity investors, at the top of their list of priorities when making an investment is an understanding of when and how they will realise it in due course. The methods of exiting private equity investments have developed over the years, and particu-larly in the more challenging

economic environment of recent times. To the usual trade sales and initial pub-lic offerings (IPOs) have been added secondary, ter-tiary (and more) buy-outs, re-financings, partial sales, private equity house spin-outs and liquidations. As the economic environment con-tinues to improve, exits ought to become easier to achieve; but in these uncertain times, private equity houses will continue to put a significant focus on what options might be available to them to realise their portfolio investments, being mindful of not just the economic risks, but also the legal, tax, regulatory and reputational issues at stake. Management teams are key to this process and their economic, commercial and personal priorities cannot be underestimated in what is a very complex environment of often conflicting aspirations. This practical guide features contributions by leading spe-cialists (including from Clif-ford Chance, Travers Smith, Freshfields and Macfarlanes) on a range of topics linked to the exit of private equity investments. Topics featured include preparing for exits, vendor diligence, manage-ment issues, auction sales, partial exits, private equity house spin-outs, IPOs, refi-nancing, winding-up, tax and

the Luxembourg perspective.

Public Procurement Law: Damages as an Effective Remedyby Duncan Fairgrieve and Francois LichereHart Publishing, Hardcover, ISBN 9781849462174, due November 2011, £65.00Public procurement repre-sents more than 15 per cent of European GDP and is one of the fastest growing sectors of the European economy. Public procurement law is also fast-growing, not least in the area of remedies for breach of procurement rules. The aim of this book is to analyse the remedy of dam-ages in public procurement law. The European direc-tive of 11 December 2007 amending Council Directives 89/665/EEC and 92/13/EEC has reaffirmed the impor-tance of damages as a tool to enforce the proper award of public contracts, but has left the exact architecture of the damages remedy in the hands of the Member States. This book offers an overview of damages liability which is inclusive, coherent and practical, covering the rel-evant law and jurisprudence from a number of countries across Europe and further afield. The contributors are

high-profile and authorita-tive commentators on public procurement law, including policy-makers, judges, aca-demics and practitioners.

Bermuda Form: Interpre-tation and Dispute Reso-lution of Excess Liability InsuranceDavid Scorey, Richard Ged-des and Chris HarrisO x f o r d U n i v e r s i t y Press, Hardcover, ISBN 9780199586614, due Octo-ber 2011, £125.00Providing analysis and inter-pretation on the construction of the Bermuda Form, this book also addresses the dis-pute resolution process and covers the legal and practi-cal issues which arise in the international arbitration of large and complex disputes under it. Since the Bermuda Form was developed in re-sponse to the collapse of the US excess liability insurance market it has become an industry standard on which such insurance is written. Bermuda Form arbitrations have since been conducted in London or Bermuda over a period of more than 20 years and represent hugely de-tailed, complex, lengthy and expensive pieces of litiga-tion. This book is a valuable guide even for experienced

practitioners in this diffi-cult area of the law, adding significantly to the nascent body of information on the analysis, interpretation and construction of the Bermuda Form. The book includes the full text of the Arbitration Act 1996 and the Bermuda Arbitration Act.

Child Case Management Practice 2nd editionby Ernest Rider and Iain GoldreinJordan Publishing Ltd, Paper-back, ISBN 9781846612640, due October 2011, £125.00The family courts dealing with public and private child law cases are inundated with work, involving the genera-tion of large amounts of pa-per. Far more effective is the creation of a file which, from the outset, focuses on mate-rial relevant to the judicial decision-making process. So for each application there needs to be an analysis of what the judicial hearing will actually require, with checklists, questionnaires etc specifying all the neces-sary information. Child Case Management Practice fulfils this need. Fully revised and updated, for each area of child law this new edition contains a succinct resume of the legal framework, a

flowchart providing an over-view of the relevant process from start to finish, detailed consideration of what the court will actually require to achieve the result applied for (including a timetable to trial and the court’s options/pow-ers), a checklist of all steps to trial, a template Model Order and a Case Digest. Child Case Management Practice reflects the revised Public Law Outline, generates best practice case management documents and provides synopses of the law for all the major applications. It also presents core skeleton argu-ments at a glance and focuses on the Case Management re-cord. This new edition comes in a single volume to keep you abreast of all the latest developments in law and practice. It is designed for use by the Judiciary (including magistracy, justices’ clerks, legal advisers), Barristers, Solicitors, Legal Executives, CAFCASS, Local Authori-ties, Guardians, Ministry of Justice, Experts and the Legal Services Commission.

back, ISBN 9780754540144, £144.95, due November 2011VAT in the EU offers a coun-try by country guide on all 27 EU member states. Wildy Practice Guide SeriesPERSONAL INJURY LITIGATION

4th edition

Gordon Exall

Price: £29.00 ISBN: 9780854900862 Extent: 281 pp Size: 216 x 138mm Binding: Paperback

This new edition of Personal Injury Litigation deals with the new rules governing road traffic claims and contains useful guidance and checklists for both claimants and defendants dealing with these claims.

This fourth edition not only brings this much used book up-to-date but enhances the original text by introducing chapters on limitation and fatal accident claims. A section on the common pitfalls and how to avoid them will help practitioners ensure that their cases run smoothly.

Personal Injury Litigation provides a wide ranging introduction to the major elements of personal injury litigation. It deals with liability, damages and pro-cedure. It gives practical guidance on dealing with the new procedure for low value claims in road traffic cases and provides summaries and checklists for both claimants and defendants. The more difficult areas such as costs, limitation and fatal accidents are also covered with guidance on important issues like serving proceedings and drafting witness statements.

Personal Injury Litigation is an invaluable asset to trainees, newly qualified solici-tors and paralegals and assumes no prior knowledge of the subject. It will also act as a practical guide for the busy practitioner.

Gordon Exall originally qualified as a solicitor and was called to the Bar in 1991. Gordon is former Executive Committee Member of the Association of Personal In-jury Lawyers and author of Munkman on Damages for Personal Injury and Death; Periodical Payments: The New Law and The APIL Guide to Fatal Accidents.

Finding English Law: Key Titles for non-UK Lawyers and Researchers provides a listing of current and informative books on one hundred topics of English law. Each list is preceded by an instructive ‘thumbnail’ description of the legal subject giving the researcher an outline of the rudiments of the topic, by way of a quick description, a discussion of the topic’s component parts, and the details of any legislative provisions which guide the law of that subject. Each of the listings of titles orients the reader toward a roster of important titles of all types, from those written for public and student consumption, through practitioner-oriented works to the academic and theoretical. Researchers from outside the United Kingdom will find the topic descriptions and listings most useful and those based in the UK will find utility in a current, wide-ranging list of legal titles.

John Eaton is Librarian and Associate Professor of Law, University of Manitoba, Win-nipeg, Canada and is co-author of Eaton & Le May: Essential Sources of Canadian Law. He is a former President of the Canadian Association of Law Libraries and is a frequent contributor to Legal Information Management, the journal of the British and Irish Associa-tion of Law Librarians.
